Third reading required for by -law number 1118 - Lone Pine Holsteins I � I/W COUNCIL MEETING MARCH 10TH, 1987 PAGE A regular meeting of the Council of the Municipal District • of Kneehill Number 48, was held in the Council Chambers, M.D Office, Three Hills, Alberta, on Tuesday, March 10th, 1987, commencing at 9 00 A M The following were present for the meeting J. Finlay Code Division 1 Otto Hoff Division 2 (Reeve) Robert E. Boake Division 3 Harold Mueller Division 5 Lawrence Hogg Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes. Grant Alford, Representative from the Three Hills Capital Councillors Hastie and Maerz are away on holidays Reeve Hoff called the meeting to order and requests were made to add the following items to the agenda 36 Thomas, McLean Drainage Problem 37 Hesketh Street surfacing 38 Thurn Gravel Pit Mr Boake moved approval of the agenda for today's meeting subject to addition of items 36, 37, and 38 CARRIED Mr. Mueller moved approval of the February 24th council meeting minutes. CARRIED It was agreed the minutes of the March 2nd meeting will be reviewed at the next meeting of Council Mr Jeffery reviewed the February bank reconciliation statement and after discussion Mr Mueller moved approval of the statement as presented CARRIED Mr Jeffery reviewed his report and several items were discussed The request from Dan Thomas to transfer to the Small Crew was reviewed and Mr Code then moved approval of the report given by Mr Jeffery CARRIED Mr. Jeffery requested clarification of the meal rate of $50 00 per day established in the convention attendance policy number 3 -4. The office wish to know if this rate applies to A.S.B ratepayer members and to employees, and after discussion Mr Code moved the meal rate of $50 00 per day as established in Policy 3 -4 is payable to employees and councillors for attendance at the AAMD & C Spring and Fall Conventions only, and for attendance by councillors, employees, A S B ratepayer members or any other person authorized to attend, at any other convention or seminar, reimbursement for meals will be at the per meal rate established annually by Council CARRIED Mr.Jeffery reviewed a report from the recent Employer Employee Committee meeting and there was discussion regarding the recommendation from the council members on the employee- employer committee regarding using sick days and or holidays if additional time away from work is required due to a death in the family It was agreed the Administrator may grant permission for an employee to make use of sick days or holidays if extra time is required to recover from the stress of a death in the family, with this change to be effective January 1st, 1987. The need to expand Policy 7 -9 - use of safety equipment - was discussed and Mr Hoff moved to table this matter until the foremen can bring a recommendation back to Council. CARRIED SAFETY EQUIPMENTT IIMIPLOYEE DAY T_Gb � cd Mr. Code moved the M.D. hold an employee day in 1987 (half ORS + day) with lunch to be provided by the M D , and Occupational RRi T° -00 Health and Safety, and a safety supplier be invited to attend the meeting CARRIED It was also suggested the film prepared by Alta. Power about the dangers of electricity might be shown Mr Mueller moved Council approve the draft 1987 Public Works employee contract and the draft 1987 Office employee 1987 contract, including changes previously authorized by EMPLOYEE Council, and the use of sick days or holiday time if CONTRACTS required by employees due to a death in their family. sir r�o CARRIED Mr.Jeffery noted Mr Cunningham wishes to attend two conventions and a workshop in 1987 and after discussion of ATTENDANCE the existing policy regarding in service training ( number 7- AT CONVENTIONS 2) , Mr Hogg moved Mr.Cunningham be given permission to ETC ALEX attend the two conventions and one course he wishes to CUNNINGHAM attend in 1987 CARRIED Mr Jeffery also noted Mr Cunningham has been requested to take on the job of Manager for the Three Hills Gas Co -Op After lenghty discussion of this matter Mr Code moved Mr Cunningham be requested not to accept this position due to the possible conflicit of interest between his position as utility officer and employee of the M D of Kneehill, and as manager of a local gas co -op. CARRIED Oris Rodger entered the meeting at this time 10 41 A.M. Mr. Jeffery noted he received a telephone call form Ernie Walters solicitor for the AAMD & C and he has suggested the M D should back off a bit on their requirements for the road crossing agreement Mr. Cunningham entered the meeting at this time, and there was lengthy discussion about this matter It was noted the M D Foothills and likely other municipal districts and counties are having the same problem with C W N Gas There was also discussion about whether ALEX CUNNINGHAM MANAGER GAS CO—OP ROAD CROSSING AGREEMENT C W N G 14 X There was discussion about the temporary wage rate schedule ADD SUB and Mr. Hogg moved approval of a sub foreman rate (extra 30 FOREMAN cents per hour) if required on the A S B temporary summer� RATE TO c r e w � ,� TEMPORARY CARRIED ,�WAGE SCALE 2 Po� FOR A S B There was discussion about what committee should purchase the A.S.B. equipment as the motion passed at the last COMMITTEE TO meeting gave this authority to a committee of Oris Rodger, PURCHASE Otto Hoff and R.A. CARRIED Mr. Hoff moved C W N Gas be advised the M D is not willing to accept the proposed road crossing agreement and Mr Emil Ziegler and Mr. Robert Barnes also be advised of this decision. CARRIED Mr. Code suggested road crossing agreements might be a topic for discussion at the annual meeting Mr Cunningham reported on progress of plans for the de- watering of the Old Torrington Gravel Pit Mr Jeffery reviewed the gravel crushing prices received as follows McMullen Contracting Ltd. Old Torrington Pit $1.90 Megli Pit and Garson Pit material) McNair Pit $1 90 Lowen Pit $2 00 Didsbury $2 40 (crushing up to 18inch Hopkins Construction Ltd Lacombe Old Torrington Pit $1 94 Megli Pit $1 94 McNai r Pit $1.94 Garson Pit $1 94 No mention re use of jaw crusher at Megli and Garson Pit Linden Contractors Old Torrington Pit $ Megli Pit $1.75 per Garson Pit $1 75 per McNair Pit $1 75 per Lowen Pit $2 35 per 1 75 per yard yard yard yard yard Ut' WL- fhi' UL,U TORRINGTON GRAVEL PIT GRAVEL CRUSHING PRICES Extra 50 cents a yard for use of jaw crusher at the Megli and Garson Pit After discussion Mr Boake moved Linden Contractors be hired to crush the M D 1988 3/4 inch gravel requirements as previously established by Council CARRIED Mr Rodger noted the crews are working on the shop and yard clean up and he felt he would be able to keep them busy for CLEAN UP awhile yet Mr Hogg moved acceptance of the report given %`SHOPS & by Mr. Rodger YARDS CARRIED Mr Jeffery reviewed the February 25th road tour report and various items were discussed ROAD TOUR The problem with the installation of the Klassen culvert on the Denver Eitzen land was discussed and it was noted the D EITZEN area has not yet been fenced Also Mr Eitzen does not wish RPOBLEM to accept the offer of $500 00 as compensation, and he has indicated he will hire a buggy to move the dirt from the hill area himself He also feels there is another problem �c�c which should be resolved on the NW 9- 30 -25 -4 It was suggested Mr. Eitzen should be contacted to see where he wishes his fence to be located and Mr Rodger was directed U COUNCIL MEETING MARCH 10TH, 1987 PAGE to inspect the location take pictures of the area to show how it looks now and also mark the boundary of the road allowance After further discussion Mr Mueller moved Mr Eitzen be advised the Council feel the offer of $500 00 is fair and will attempt to resolve the other problem raised b Mr. Eitzen in connection with thistle and need for seeding on the berm and borrow pit area on the NE 9- 30 -25 -4 CARRIED The road committee inspected N /NE 30- 30 -23 -4 where there wa suppposed to be a texas gate As there is no gate there Mr Hogg moved to accept the report CARRIED L UAZIUN NNE 30- 30 -23 -4 L" , The road committee also inspected another location where Re m bQc there was supposed to be two texas gates and could noto locate any. However after discussion it appears the road committee was not at the right location and Mr Mueller moved the road committee review this situation again on the next road tour. CARRIED The need to cancel an old road diversion in SW 35- 32 -25 -4 and NW 26- 32 -25 -4 was discussed and Mr Boake moved that as the lands hereafter described are no longer required for public travel the Council of the Municipal District of Kneehill Number 48 does hereby close the following described road diversion, subject to rights of access granted by other legislationn or regulations Road Plan 6369 B M , affecting the South West of 35 in 32- 25-4 and the North West of 26- 32 -25 -4 on condition the land owners involved are willing to accept the land back into title with the balance of the quarter sections CARRIED Mr Mueller moved acceptance of the Road Tour Report, with the exception of the recommendation with regard to Mel Albretch's complaint and this matter be discussed when Mr. Hastie has returned from holidays CARRIED Mr Hogg moved to table discussion about the Linden West Road until the March 24th meeting of Council CARRIED CANCEL OLD ROAD DIVERSION -Z . +0 jc� e t ers se n� APPROVAL REPORT EXCEPT M ALBRETCH COMPLAINT LINDEN WEST ROAD TABLED Mr Roder noted Robert Kennedy, signman, has inspected the intersection of SR 587 and SR 805, and has put up truck SIGNS AT entering signs Mr Boake moved acceptance of this report. G'' lmm�= COUNCIL MEETING MARCH 10TH, 1987 PAGE Rawlusyk entered the meeting at this time Mr. Bergman provided each councillor with a letter from his firm and then reviewed the quoted price for engineering work ENGINEERING on the Adams Road Project. He also noted Alberta COST FOR Environment might be willing to absorb 75% of the costs for ADAMS ROAD the re- alignment of the creek as it would eliminate a PROJECT dangerous road and also bring some farm land back into production Mr Hogg noted the two farmers involved indicated they would be willing to enter into whatever agreement is necessary in order to get the road problem resolved Mr. Bergman also noted the existing culverts will likely be satisfactory Mr Bergman noted Alberta Environment have requested funding for the Kneehill Creek Project of up to $150,000.00 and it appears there should be no problem in getting approval for the funding Mr Jeffery then read a letter from Alberta Utilities in connection with the proposed Swalwell Water Project and the SWALW= letter outlined the costs for the different alternatives WATER PROJECT looked at It was felt that Council must now make a PROCEED WITH decision as to whether it would proceed with the water PROTECT project and after discussion Mr Hoff moved the M.D. proceed with construction of a water system for the hamlet of- FORCED ROAD Swalwell subject to the M.D. obtaining grants from the SE 20- 31 -21 -4 Province of Alberta and P.F.R A and as long as the costs��� to be charged as a local improvement against the land owners in the hamlet do not exceed $75,500.00. Finlay Code j MOTION WAS CARRIED se�� Mr. Frank Davidson and Mr Ron Ferguson entered the meeting at this time - 2 00 P.M. Mr. Davidson and Mr. Ferguson then left the meeting. Mr Mueller then moved the M D agree as follows 1. to pay 50% of the survey costs to a maximum of $1000.00 in order to have an alternate access road surveyed across the SE 20- 31 -21 -4, making use of the old oil lease road, in order to provide access to the land to the east of this r E MEETING There was discussion about Mr Ferguson's plans to construct RON FERGUSON a house on Mr Davidson's land - SE 20- 31 -21 -4 & FRANK It appears the location where Mr. Ferguson plans to locate DAVIDSON the house would encroach on to the forced road which provides legal access to land lying to the east of Mr FORCED ROAD Davidson's quarter Mr Ferguson wondered if council would SE 20- 31 -21 -4 be willing to cancel the forced road plan as this is not the route used by Mr Trentham to get to his land east of the SE 20- 31 -21 -4 Mr Trentham uses an existing oil well road which goes north, and then follows the coulee banks in a south easterly direction There was lengthy discussion about this matter, about blanket easement agreements, surveying the old oil company lease road and dedicating same as public access, and the fact that the the M.D. must se�� ensure the land owners to the east are not deprived of access to their land as there is legal access provided now Mr Davidson felt he would prefer to have the old road plan cancelled and work out some suitable agreement between Mr Trentham and himself as to access. Mr Ferguson noted his surveyor indicated the existing M D. forced road south of the South half of 20- 31 -21 -4 is not constructed in accordance with the legal survey plan, but is in fact constructed in error on land owned by Mr. Gorman and Mr Davidson Mr. Davidson asked if the M.D. would consider sharing the survey costs with him in order to resolve these problems Mr. Davidson and Mr. Ferguson then left the meeting. Mr Mueller then moved the M D agree as follows 1. to pay 50% of the survey costs to a maximum of $1000.00 in order to have an alternate access road surveyed across the SE 20- 31 -21 -4, making use of the old oil lease road, in order to provide access to the land to the east of this r E MEME6 '% COUNCIL MEETING MARCH 10TH, 1987 PAGE quarter, on condition Mr Davidson is willing to provide the land required at no cost to the M D 2 The M D agree to cancel the south portion of the forced road as shown on Survey Plan Number 6268 B M and return this land to Mr. Davidson on condition he is willing to have same consolidated back into title with the balance of the quarter 3 The M D agree to pay total costs for survey of the additional half mile of road across land owned by Mr Al Trentham - South West of 21- 31 -21 -4 - in order to provide legal access to the South East of 21- 31 -21 -4 on condition Mr Trentham is prepared to donate the land required at no cost to the M D CARRIED There was further discussion about the fact that the road as shown on Plan 7797 A Z , is not constructed where it was legally surveyed and Mr. Hogg then moved the M D re- survey the road as it is constructed, have a new survey plan prepared and registered, cancel that portion of the old survey plan which is incorrect, and return the land to the quarters from which it was taken. CARRIED There was discussion about by -law number 1118, being a by- law to redesignate the SE 21- 30 -26 -4 from agriculture conservation to agriculture, and Mr. Hogg moved third reading to this by -law CARRIED � Time 3a02upyM � left the meeting at this time / � N-4 � ✓ There was further discussion about the G Adams Road Project and Mr. Hogg moved the Adams Road Project - West of 18 -33- 23-4 be undertaken in 1987, the Walker ProjecV.,be left until a later date,and the firm of Fenton Bergman be hired to do the engineering work for this road project on condition the engineering costs do not exceed $12,300 00. FINLAY CODE MOTION WAS CARRIED 0 BY -LAW 1 1118 LAND USE BY -LAW REDESIGNATION SE 21- 30 -26 -4 13S i.aw Acme iCt4zf ADAMS ROAD PROJECT APPROVED & HIRE ENGINEER 1 e� �-c sit, t ,•, SWALWELL WATER PROTECT Mr. Jeffery noted Mr Cunningham and Mr Code had attended a meeting of the Horseshoe Canyon water Co -op recently HORSESHOE Alberta Environment had asked for a recommendation from CANYON Council for a surveyor to do some engineering work on the WATER CO -OP project, and Mr. Code moved the M D recoomend the firm of Fenton Bergman i CARRIED Mr. Jeffery noted Alex had drafted policy number 5 -8 which POLICY would allow him to approve development of a well or battery 5 -8 or an installation or structure incidental to the operation WELL OR BATTERY of a pipeline as long as the development complies with the SITE M.D. land use by -law setbacks but is within 150 feet of the M.D road allowance Under provincial regulations the c, � e company must obtain written permission from the M D. to locate the development within 150 feet of an M.D. road allowance. v°I'�� After discussion Mr Hogg moved approval of the policy Y__ drafted by Mr Cunningham. CARRIED e� " COUNCIL MEETING MARCH 10TH, 1987 PAGE Mr. Cunningham and Mr Rodger left the meeting at this tim 3 21 P M Mr. Art Thomas entered the meeting at this time and Mr. Jeffery reviewed the minutes of the February 17th A S B meeting Several items were discussed Mr Hoff moved the A S B be authorized to obtain a display board as long as the cost does not exceed $250 00 and further moved the A.S.B. may put a booth in the 1987 Three Hills Trade Fair long as the total cost for having the booth and purchasing an item for the draw does not exceed $300 00 CARRIED as Mr Boake then moved approval of the February 17th A S B minutes, with the exception of that portion dealing with the proposed 1987 Weed Control Program CARRIED Mr Jeffery read a letter received from the Honourable Minister John Wise, Federal Minister of Agriculture in connection with 2,4 -D Mr. Mueller moved to accept and file as information. CARRIED Mr Mueller noted Mr. Wise will be at a meeting in Stettler on March 23rd Mr. Thomas gave each councillor a copy of his proposed weed control program for 1987 and there was lengthy discussion about the this matter, particularly with regard to the Toad Flax Control Program. Mr Boake then moved Council approve the proposed 1987 weed control program as outlined by Mr. Thomas, including hiring two weed inspectors for 4 months this summer, and applying for Step Program funding for the two weed inspectors. CARRIED It ws agreed the proposed weed control program must be advertised in the local paper in order to encourage people to attend the divisional and annual meetings and the Tordon training course to be offered, in order to obtain more information about control of toad flax on private and public property Mr Jeffery read a letter form the Village of Carbon and they request the M D spray weeds in the village limits as they do not have equipment available to do this kind of work After discussion Mr. Hogg moved the Village of Carbon be advised the M.D. would not be able to undertake this work for the Village. CARRIED It ws suggested the Village be advised Mr Thomas could provide them with some technical information as to how to control the weeds, and they might contact Mr Soder to see if he could be able to assist them with this work There was discussion about the hourly rate of pay for the person hired as assistant ag fieldman for this summer as well as for other A.S B employees Mr. Mueller moved a committee of Mr. Code, Mr Hogg and Mr. Thomas be given authority to set wages for the A S B. Assistant Ag Fieldman and other temporary A S B summer staff within a wage range of $5.00 to $11 21 plus an additional 30 cents (sub- foreman rate) per hour for the Assistant Ag Fieldman, but must take the existing temporary wage scale regulation regarding years of service with the M D , into consideration when setting the rates CARRIED Mr Thomas noted there is some old chemicals down at the A.S B chemical shed which should be disposed of, and this will cost about $250.00 per 45 gallon drum.
