Je � P, T y� 5Q, $y\ Gov T C, ,JER - r C/ COUNCIL MEETING JANUARY 13TH, 1987 ------------------------------------ ------------------------------------ A regular meeting of the Council of the M.D of Kneehill Number 48 was held in the M D Office, Three Hills, Alberta, on Tuesday, January 13th, 1987, commencing at 9 00 A M The following were present J. Finlay Code Division 1 Otto Hoff Division 2 (Reeve) PRESENT Robert E Boake Division 3 Harold Mueller Division 5 Bruce Hastie Division 6 Lawrence Hogg Division 7 J C. Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr. Grant Alford, representative from the Three Hills Capital Reeve Hoff called the meeting to order and asked for a APPROVAL OF motion to approve the agenda for today's meeting Mr Boake AGENDA asked to add Item Number 45 - Thurn Gravel Pit Mr Code asked to Add Item NUmber 46 - Discussion re SR 841 culverts Mr Boake then moved approval of the agenda with the addition of Items Number 45 and 46. CARRIED Mr Mueller moved approval of the minutes of the December APPROVAL OF 9th meeting of Council MINUTES CARRIED Mr Code moved approval of the accounts presented for APPROVAL OF payment today, subject to further review by the finance ACCOUNTS committee of Otto Hoff and himself. CARRIED Mr Jeffery reviewed the budget comparison report and after BUDGET discussion of the report and gravel inventory on hand at the COMPARISON end of the year, Mr Hastie moved approval of the budget REPORT comparison report CARRIED Mr Jeffery read a letter from Mrs. Connie Osterman, Minister of Social Services, in which she advises it will NO ASSISTANCE not be possible for the Province to assist with the patching FOR PATCHING costs incurred for SR 583 After discussion of this COSTS SR 583 matter, Mr Mueller moved to accept and file as information. CARRIED Mr Jeffery reviewed a report he prepared listing various REPORT RE- roads he feels may be re- constructed in the next year or ROAD two, and after discussion Mr. Hogg moved to accept and file CONSTRUCTION as information. / -T CARRIED -_-p0 Mr Jeffery asked if Council would like to see some roads in ROAD TOUR other municipalities which Torchinsky Engineering had WITH TORCHINSKY engineered. Mr. Jeffery also read a letter from Alberta Utilities regarding the water project They advise the provision of a grant is based on very careful consideration of the demonstrated need for the project, and they cannot secure a committment for the funding at this time. CARRIED Mr Jeffery read a letter from Ted Earl Superintendent of DRtmBFLLER Parks and Recration for the City of Drumheller. Mr. Earl RECREATION expressed some concern about the short term of office for BOARD the member representing the M D of Kneehill on the Drumheller Recreation Board The present policy is a one year term with the position being rotated among the three rural communities in the Drumheller Recreation Area - Orkney, Over the Hill and Hesketh After discusison of the request to make the term more than one year, Mr. Hogg moved 2 COUNCIL MEETING JANUARY 13TH, 1987 ------------------------------------ ------------------------------------ the City of Drumheller be advised the M D do not wish to make a change in this policy at this time, but appreicate the concern raised by the Recreation Board. CARRIED It was agreed council would ask the rural communities to try and have the same person from their organization accept the appointment again as their turn comes around. The 1987 membership fee of $483 10 for the Big Country BIG COUNTRY Tourist Association is now due, and Mr Mueller moved this TOURIST membership fee be paid j ASSOCIATION CARRIED '.— `k\ 'L, �" j RN 2 rl) -611 Mr Jeffery noted Mr and Mrs Campbell had sent thank you THANKS FROM cards expressing their appreciation for the retirement party/ REG. CAMPBELL held for them Mr. Jeffery noted that Linden Contractors had billed the M D of Kneehill for crushing 10,000 yards of gravel at the Mildenstein Pit, and when the gravel was all hauled out there was only 8000 yards. Linden Contractors has credited the M.D. for the excess crushing costs but gravel royalties for the full 10,000 yards were paid to Mr Hans Mildenstein This resulted in an overpayment of $800 00 After discussion of this matter, Mr Mueller moved that Mr Hoff and Mr Jeffery meet with Mr. Mildenstein and discuss the matter with him. CARRIED Mr Jeffery noted Mr View is retiring and for Saturday, January Jeffery be authorized the M D of Kneehill Frank Dawley of the County of Mountain a retirement evening has been planned 31st, 1987 Mr Hoff moved Mr ✓ to attend this function on behalf of CARRIED Mr. Jeffery read an information bulletin from Alberta Municipal Affairs regarding the new Alberta Municipal Partnership in Local Employment (AMPLE) program This will be an unconditional grant to the M D. of $61,740 18 but the government would like to see the funds used to generate employment. ✓ After discussion Mr Mueller moved to accept and file as information CARRIED Mr Jeffery noted the February 10th meeting of Council will conflict with the Annual A.S.B Conference, and most of the council is planning on attending the conference Mr Hastie moved the February 10th meeting of Council be cancelled due to this conflict, and be re- scheduled for Wednesday, February 4th, 1987, commencing at 9 00 A M CARRIED HANS MILDENSTEIN GRAVEL PIT C J -t FRANK DAWLEY RETIREMENT CT MT VIEW AMPLE GRANT FROM PROVINCE CHANGE OF REG COUNCIL MEETING DATE FEB 10 changed ✓� TO FEB 4 Mr Code noted the Drumheller Health Unit is planning to HEALTH UNIT hold its board meeting in the Three Hills Community Center f BOARD MEETING on Ma -h 12th 1987, and the Board extend an invitation to the council to attend the afternoon portion of their m e e t i n --4 \j eCl Mr Jeffery noted the review of the Municipal Statutes will MUN STATUTES continue at a meeting in Strathmore on February 2nd, 1987, REVIEW MEE'T'ING commencing at 9 30 A M A llbrs Alex Cunningham and Oris Rodger entered the meeting at this time - 10 30 A.M. There was discussion about the estimated costs for de- OLD TORRINGTON watering the Old Torrington Pit in order to remove more GRAVEL PIT gravel for use in 1988, and it was noted the costs for drilling the wells, purchase of pumps and hooking up same 3 C� COUNCIL MEETING JANUARY 13TH, 1987 could range between $41,600 and $74,500. The annual operating costs for the wells were also discussed Mr Code moved the M.D. agree to proceed with establishment of a de- watering system at the Old Torrington Gravel Pit in 1987, Alex Cunningham be authorized to request tenders from various contractors and the tenders received be reviewed by council at a later date. CARRIED Mr Cunningham left the meeting at this time Mr Jeffery reviewed his report covering the period December J C JEF'FERY 9th, 1986, to January 13th, 1987, and various items were ✓ REPORT discussed. Mr Boake moved the M D host a curling bonspiel for the 00 T CURLING employees in 1987. There was discussion about whether the foremen have the FOREMAN right to increase permanent employees' wages within the RIGHT TO contract restraints, or change their classification and INCREASE after lengthy discussion Mr Mueller moved that each foreman WAGES FOR has the right to increase or decrease any permanent PERMANENT employee's wages within the constraints of the contract, but Z STAFF do not have the right to make any position changes, without council's authority CARRIED It was agreed that Glen Enzie was hired on as a tractor ENZIE trailer driver, Lonnie McCook was hired as a welder during MCCOOK the winter season and will revert to a senior operator & BURDEN during the summer construction season David Burden will continue as Intermediate Operator in the summer but will be Senior Winter during the winter season as he is driving a tractor trailer unit. �0 ,OD The need for a policy for retiring employees was noted and POLICY RE- Mr. Hogg moved to table this matter until the next meeting �° RETIRING of C o u n c i l . POLICY FOR CARRIED EMPLOYEES The request from Wallace Rasmussen to purchase the old 427 motor, which was overreved back in 1980 and never repaired, OLD 427 was discussed, and Mr Code moved that Mr Rodger obtain a MOTOR price for repairing the motor and determine what the motor ,bI,Pc would be worth for parts if not repaired, and the matter be✓ /� discussed again at the next meeting of Council CARRIED Mr Jeffery noted Alberta Transportation will not cover all SR 575 the expenses being incurred for SR 575 - only costs for EXPENSES borrow pits and crop damage He also reorted Keith Baxter of Mobil Plant has advised the trucking from the Mobil Plant at Wi mborne wi l l slowly TRUCKING decrease over the next two years, and then likely will FROM WLMMRNE remain at one or two trucks per day However he did not MOBIL PLANT know about any trucking from the Degra Sol Plant Mr Hastie noted because of the ban on the heavy pavement south \e� of the plant the trucks are going north, crossing the South ab Huxley road going further north, then west and south to get / to Highway 27. Where the trucks cross the south Huxley road vision is bad and perhaps the ban on the 1 1/4 mile of road from the plant south should be removed so the trucks would not have to go north and cross the South Huxley Road It was agreed this matter would be discussed again after 1+ COUNCIL MEETING JANUARY 13TH 1987 dinner Mr. Rodger noted the motor in T -27 - (360) - is and should either be fixed or replaced After was agreed the motor should be repaired in bad sha discussion Mr. Hogg moved to accept the report given by Mr. Jeffery CARRIED 1 - G / NEEDS REPAIRED The meeting then adjourned for dinner between 12 00 Noon and DINNER ✓► 1 00 P.M Mr. Rodger left the meeting at this time. Mr Alex Cunningham and Mr Ross Rawlusyk from Palliser Regional Planning Commission entered the meeting at 1 00 P M. Mrs Wilkinson read a letter received from the M D of RO CKYVI LW Rockyview with regard to a resolution passed at the AUMA LETTER RE- Fall Convention The City of Calgary presented a resolution PROPOSED CHANGE TO which asked for an amendment to the Planning Act which would PLANNING ACT force the Alberta Planning Board to comply with regional BY CITY OF plans, land use by -laws, etc , in making its decisions on CALGARY appeals. The act presently states the Board must consider the regional plans, but the board can make a decision which hold the Development Appeal Board Hearing scheduled for would overrule the regional plan or a local land use by -law j G b�PCi Ross noted he did not believe the change in the act would affect the M.D one way or the other, but agreed he would review the matter with Mr. Fenwick Mr Hoff moved to table this matter until Ross can bring a report back to Council CARRIED Mr Jeffery and Mr Cunningham reviewed the draft response council he prepared by Palliser Regional Commission with regard to a OFF SITE report on off site levies prepared by a Provincial LEVIES Government Advisory Committee LAND USF Ross also reviewed the matter with Council and after REPORT discussion Mr Boake moved the M.D support the response BY -LAW C prepared by the Commission and the comment raised by Mr � there will Cunningham be forwarded to the Commission for its s Y'N consideration. with regard CARRIED Mr. Mueller moved Council meeting do now adjourn in order to be conducted hold the Development Appeal Board Hearing scheduled for DEV APPEAL today a t 1 30 P M ✓ entered the meeting at this time BOARD HEARING CARRIED Mr Hogg moved Council meeting do now reconvene, the f Development Appeal Board hearing having been completed. CARRIED Mr Boake moved the M D of Kneehill advise the Red Deer Regional Planning Commission it would have no objection to a proposed subdivision on the SE 1- 30 -27 -4 which is located just across the M D of Kneehill west boundary, in the V County of Mountain View CARRIED Mr Hoff moved to table the applicaton for subdivision submitted by Ross Cullum for Part of the SW 21- 31 -23 -4 until the next meeting of Council CARRIED RID DEER REG PLANNING COMMISSION SUBDIVISION SE 1-30-27-4 ROSS CULLUM SUBDIVI; TABLED Ross advised council he has been looking at an amendment to the land use by -law regarding intensive agricultural uses, LAND USF and should have a reort for council in the near future BY -LAW C He also noted there will be seminars held in March or April of this year with regard to how Development Appeal Board hearings should be conducted Mats Bergman entered the meeting at this time COUNCIL MEETING JANUARY 13TH, 1987 ------------------------------------ ------------------------------------ Mr. Dave Harper and Mr Jim Doyle from the Drumheller area also entered the meeting, and discussed with council plans PROPOSED to establish a water co -op They hope to be able to WATER CO-OP establish the co -op, get grants from the government to DRUPEELT,FR install the required water lines and buy water from the City AREA of Drumheller. They noted the City may not wish to sell water direct to the Co -Op and they would like the M D to become involve, buy water from the City and re -sell same to the Co -Op, or provide the City with a guarantee that the water would be paid for by the Co -Op. There was discussion about whether having a piped in water system would have any affect on land taxes and information from the M D assessor indicated that under existing regulations, it would not affect the assessment base There was further discussion about the proposal, what type and how large a system might be required, and Mr Harper noted at present 23 people are interested and there may be 8 more It would take about 25 to 30 miles of pipeline Mr Bergman discussed the proposal with the delegation and advised them of similar co -ops which have been formed in the south part of the Province Mr Harper asked that Council forward a letter to the Co -Op indicating its position on this matter and Mr Harper and Mr Doyle left the meeting at this time After further discussion Mr. Code moved the M D send a letter acknowledging receipt of the information about the proposed water co -op CARRIED It was agreed that further information would have to be made available to the M.D. before any decision could be made by council with regard to provision of any guarantee or M D s participation in the proposal Ross Rawlusyk, Alex Cunningham and Mats Bergman left the I' meeting at this time > Mr Roger Bishop, Administrator of the Village of Linden, Lyle Regehr, Fire Chief for the Village of Linden, Kevin DELEGATION Reimer, Deputy Chief, Chester Tetz and Earl Reimer Captains RE- LINDEN and Brian McEvoy from the Fire Prevention Branch, entered FIRE TRUCK the meeting at this time to discuss with Council the need for a new fire truck for the Village of Linden and the rural area The Department had prepared specifications for the type of truck they feel they require and the estimated cost would be $130,000 00 Mr Regehr noted the Linden Rural Fire Area is the smallest in size and has the largest concentration of buildings such as broiler barns, hog barns, dairy barns, etc. They showed council a number of slides showing problems with some of the intensive operations and the potential for major fires in that area, and this is one of the reasons for requesting the type of truck they prepared specifications for, Some extras are a canopy, a good water management supply system, a built in foam system, an automatic transmission a diesel motor and a minimum of 1000 gallon tank. Council reviewed with the firemen the quote obtained from Superior Emergency for a truck similar to the one purchased for the Trochu Fire Department, and there was lengthy discussion regarding the difference in the quotes. It was noted the Linden Rural Fire Protection area only generates about $10,000 00 a year from the fire protection tax levy Mr Bishop noted the Vilage of Linden has been setting aside funds over the past four years and should have sufficient funds in 1987 to pay for its share of the costs of a new truck The delegation was thanked for coming and left the meeting at this time Time 3 40 P M After further discussion Mr Code moved the M D authorize purchase of a new fire truck for the Village of Linden and the Linden Rural Fire Protection Area on condition the total > price of the truck and all equipment which is required does COUNCIL MEETING JANUARY 13TH, 1987 ------------------------------------ ------------------------------------ not exceed $120,000 00 and as long as the Village of Linden is prepared to authorize the said purchase and is willing to accept responsibility for its 25% share of the cost of the truck and equipment as per the terms of the existing fire agreement between the M.D. and the Village of Linden J MOTION DEFEATED Mr. Hastie then moved the Linden Fire Department be advised the specifications prepared are too extensive, the M D is not able to fund such an expensive truck in 1987, and therefore requests the department to review same and bring specifications for a lower priced vehicle to the January 27th meeting of Council. CARRIED Mr Jeffery noted the government culvert which was installed on SR 841 was not installed to the satisfaction of Alberta Bridge Branch. The culvet must have extensions put on which will extend onto private property and the M D will have to purchase land from the land owners sufficient to accomodate the culvert extensions and an area around the end of the culverts, and also the M.D. will have to re -do the side slopes as they are too steep and are starting to erode After discussion of this matter Mr Code moved the M D agree to proceed with purchase of the land required in order to properly accomodate the culvert extensions, and have the necessary legal survey done. CARRIED Mr Jeffery read a letter from Canadian Landmasters Resource Services Ltd , in which the company requests on behalf of Canadian Westgrowth Ltd., permission to drill an oil well on LSD 8- 18- 30 -21 -4 within 50 meters of the M D road allowance After discusion Mr Hogg moved Canadian Westgrowth Ltd be granted permission to drill an oil well on LSD 8- 18- 30 -21 -4 as long as the well is located a minimum f of 100 feet back from the property line CARRIED r TC: A�v L� ve T GOV'T CULVERT ON SR 841 OIL WELL 3 LSD 8- 18 -30 -21 (2��rr The Drumheller Solid Waste Management Association request the M D pay its 1987 requisition of $39,627 00 at this time DRUM r.FR or make an interim payment of $20,192 00 now and the balance SOLID in June WASTE After discussion Mr Mueller moved the M.D. pay $20,192.00 f REQUISITION as an interim payment at this time. LT-ot 1987 CARRIED �RiP TANan��� Mr. Mueller noted Mr Stan Milan was quite upset about his name being mentioned in the Three HIlls Capital in connection with straw bales too close or on an M D road OBSTRUCTIONS allowance After discussion of this matter and noting it ON OR TOO will be difficult for Mr. Milan to move the bales at this NEAR ROAD time of year, Mr Mueller moved Mr Stan Milan be given ALLOWANCES until July 31st, 1987 to move the straw bales away from the M.D. road allowance, on condition he agrees he will in future comply with the M D land use by -law set back requirements CARRIED Mr Mueller noted Alberta Transportation require a stock pile site for gravel they wi 1 1 be removing from their land - STOCK PILE SITE SE 28- 30 -21 -4 for use on Highway 27 They would like to FOR ALTA make use of an area in the gravel pit on Mr. V.
