Csakany lots in Swalwell NOTE: MEETING JULY 9TH, 1986 AT THE THREE HILLS COMMUNITY CENTER RE* KNEEHILL CREEK WATER STORAGE FACILITIES 1 COUNCIL MEETING JULY 8TH, 1986 ------------------------------- ------------------------------- A regular meeting of the Council of the M D of Kneehill #48 was held on Tuesday, July 8th, 1986, in the M D Office, Three Hills, commencing at 9 00 A M The following persons were present: J Finlay Code Otto Hoff Robert E Boake Richard A. Maerz Harold Mueller Bruce Hastie Reginald G Campbell Division 1 Division 2 (Reeve) Division 3 Division 4 Division 5 Division 6 Division 7 J. C. Jeffery, Municipal Administrator Mrs. Jean Wilkinson, Assistant Administrator was present and recorded the minutes 's -_ "A Reeve Hoff called the meeting to order and there were APPROVAL OF requests to add the following items to the agenda for AGENDA today's meeting: Item #23 - Weeds on SR 575 Item #24 - Report re- Water pumping at Old Torrington Pit Item #25 - Road Damage - South Huxley Road Mr Boake then moved approval of today's agenda with the addition of the above noted items CARRIED Mr Code moved approval of the accounts presented for APPROVAL OF payment today, subject to further review by the finance ACCOUNTS committee of Robert E Boake, R A Maerz, Otto Hoff and himself CARRIED 1 Mr Hastie moved approval of the June 24th meeting minutes CARRIED Mr Jeffery reviewed his report and several items were discussed as follows- J C JEFFERY REPORT 1. Toad Flax Spraying program - after discussion it was agreed this be discussed with Art later today TOAD FLAX SPRAYING 2 Rental of Mobile Phone for Oris Rodgers PHONE RENTAL 3 Sale of gravel from Megli and Toews Pitand request from Darrel Thiessen for the M D. to either raise the price of SALE OF gravel at its pits or stop selling gravel. Mr.Thiessen is GRAVEL starting up his gravel crushing business and is losing business due to the difference in price After lengthy discussion Mr Hastie moved there be no increase in the price charged by the M D for gravel sold from a pit, but the price for gravel obtained from a stock pile site be increased to $7 00 per yard CARRIED 4 Town of Three Hills request for the M D to grade two GRADING ROADS town roads on a permanent basis. FOR TOWN OF After discussion of this request Mr Boake moved the Town be THREE HILLS advised the M D would not be able to undertake this work and the town should consider hiring private contractors to undertake this work for them. BUGGY FOR BLADE GRADE ROAD • E+ PIT NEED FOR ASSISTANCE FOR ASSESSOR SHARON LARSON HIRED FOR FULL TIME WORK SUBJECT TO Mr. Campbell moved Sharon R Larson be hired on a full time CERTAIN CONDITIONS basis to work 3 days a week on general office work as she is doing now and 2 days a week assisting Mr Dunay with the extra assessment work, on condition she be aware the full time position may terminate if the appropriate provincial legislation requiring assessment of all farm homes is not passed this fall, and that the full time position would terminate in any event when the next general assessment had been completed and further the full time position commence effective August 1st, 1986. CARRIED Art Thomas, Oris Rodger and Alex Cunningham entered the meeting at this time - 10:40 A M Art reviewed with council the progress being made with the ,LOAD FLAX toad flax spraying program and advised he felt they should SPRAYING be using Tordon now instead of Desermone as the weed is so PROGRAM far advanced He noted however that Tordon cannot be used for blanket spraying After lengthy discussion of this matter, Mr Maerz moved Art be given authority to start spot spraying toad flax effective July 9th, 1986, and to continue until the toad , flax is no longer blooming CARRIED Art advised the A S B crew have so much work to do he would like to hire two additional persons to assist with the toad flax spraying program After discussion of this request, Mr Boake moved Art be given permittion to hire two additional persons to assist with the toad flax spraying program and these persons be kept on for as long as it is appropriate to continue with the toad flax spraying program CARRIED Several other items were discussed with Mr Thomas including road side mowing, spraying, cemetery and hamlet mowing work and Mr Thomas then left the meeting - Time 11.05 a.M Mr. Rodger reported the Mildenstein gravel pit is not good What gravel is there is very small and there is alot of sand Linden Contractors has crushed about 5000 yards and will try to get 10,000 yards crushed However the quantity and quality of the gravel would not be suitable for the M D to continue making use of the pit After discussion of this matter and noting the material crushed from the pit could be used for some road base material, Mr. Hastie moved Oris be given permission to use the material taken from the Mildenstein Pit for the required base work on the South Carbon Road, the pit area closed up and the area E HIRE TWdO MORE PEOPLE FOR A S B MILDENSTEIN GRAVEL PIT NO GOOD l� COUNCIL MEETING JULY 8TH, 1986 ------------------------------- ------------------------------- reclaimed as soon as possible, and the lease with Mr. Mildenstein be cancelled when the reclamation has been completed carried Alex reported on the water pumping test done at the Old WATER PUMPING Torrington Pit and advised it is definitely possible to OLD TORRINGTON lower the water level in the pit to a level which would PIT allow removal of gravel from the bottom of the pit. He suggested council might consider undertaking the necessary work to drill the wells which will be required and set up the pumps in 1987 and then when a crush is required perhaps in 1988 the water level could be lowered and the gravel removed with a loader Mr Cunningham left the meeting at this time Mr Rodger reported he has used Dust down 70 and Dust stop DUST CONTROL in his dust control tests Dust Down 70 does not work well, TESTS but Dust Stop appears to be working reasonably well so far. Dust Stop costs about $2400 00 per mile and calcium chloride costs about $3200 00 per mile and has to be applied twice a year It was agreed this matter be discussed again at the next meeting of Council, and Mr Campbell moved to table this matter until the next meeting of Council. / CARRIED Oris noted the main crew will require a rubber tired packer RENTAL RUBBER in order to complete SR 841 road project and there is one TIRED PACKER available at a cost of $700.00 per month. After discusison Mr Maerz moved Rick Vickery be given permission to rent a rubber tired packer for a maximum period of three weeks ✓' CARRIED There was discussion about the asphalt repairs being done by the M D on SR 583 and Oris was advised to keep track of the ASPHALT REPAIRS costs incurred so Alberta Transportation can be billed for ON SR 583 this expense. � The meeting then adjourned for dinner between 12.00 Noon and 1.00 P M DINNER Ross Rawlusyk from Palliser Regional planning Commission entered the meeting at this time He discussed with Council a subdivision application STICKEL submitted by John and Pat Stickel Mr. and Mrs. Stickel own SUBDIVISION 25 49 acres in the NE 18- 32 -23 -4 and wish to subdivide a NE 18- 32 -23 -4 2 29 acre parcel from the 25 49 acres After lengthy discussion of this proposal, Mr Hastie moved the M.D. recommend refusal for this proposed subdivision as Y f r;, it does not confirm to the M D land use by -law - Section 34 (c) and (f) and Section 5(a) of the M D land use by -law CARRIED Mr Jeffery reported an appeal has been filed by Stan APPEAL HEARING Schumacher with the Provincial Planning Board in connection PLANNING BOARD with the Beattie Andrews exchange of land but it is likely the appeal will be withdrawn After discussion Mr Boake f moved to accept and file as information ► CARRIED Mr Mueller moved the council meeting do now adjourn in ADJOURN FOR order to hold a development appeal board meeting at this DEV APPEAL BOARD time. ; � MEETING CARRIED Mr Maerz moved the Council meeting do now reconvene, the RECONVENE development appeal board meeting having been completed. A CARRIED 3 COUNCIL MEETING JULY 8TH, 1986 ------------------------------- ------------------------------- The rate of pay for clerks was discussed be established at required the deputy be paid for 1 1/2 da follows: 40 cents a meal allowance deputy returning officers and election and Mr Campbell moved the rate of pay $110 00 per day and if an election is returning officers and election clerks ys plus mileage and meal reimbursement mile or 25 cents a kilometer and $14.00 CARRIED RATE OF PAY FOR DEPUTY RETURNING OFFICERS ETC IF ELECTION as REQUIRED 11 Mr Jeffery advised council that if the Orkney view point ORKNEY VIEW area can be purchased by the M D from the province, the area POINT can be surveyed and dedicated on a road survey plan rather than going through a plan of survey and the required subdivision application. He also advised to date no official answer has been received from the Province regarding this matter Ross Rawlusyk left the meeting at this time Mr Jeffery then reviewed a budget comparison report and BUDGET COMPARISON after discussion Mr Maerz moved acceptance of the report REPORT given by Mr Jeffery CARRIED Mr Jeffery reviewed in detail with Council the summer SUMMER EMPLOYEE employee appraisals done by the foremen as requested by APPRAISALS Council Mr Maerz moved to accept and file as information CARRIED Mr Jeffery then reviewed with council a new organizational ORGANIZATIONAL flow chart which he had prepared and after discussion Mr FLOW Mueller moved approval of the chart as prepared with the CHART effective date for same to be from June lst, 1986 CARRIED N �. Mr Jeffery read letters received from Dr P Currie of the SEEDING HILL Tyrrell Museum Drumheller and from the Drumheller CUTS ON SR 575 Tourism Development Commission with regard to the M D wishing to have the hill cuts on SR 575 (near Nacmine) seeded to prevent erosion After discussion of this matter, Mr Maerz moved there be no change in the decision of the rc M D to have the hills seeded and no further discussion be entertained by council regarding this matter unless Alberta Culture on behalf of the Tyrrel Museum is prepared to accept responsibility for the costs incurred by the M D for the ditch cleaning which will result if the hills are not seeded CARRIED Mr. Jeffery read a letter from R Angus regarding the R ANGUS proposed buyback for the 815B Cat Compactor and after BUYBACK FOR discussion Mr. Boake moved to accept and file as 815 B CAT A information COMPACTOR CARRIED Mr. Jeffery read a news release issued by Alberta NEWS RELEASE Transportation in connection with re- construction of SR 575 RE SR 575 L' Mr Jeffery reviewed the backsloping borrow pit agreement Acme East arranged with Paget Ranches the other day Alberta PAGET RANCH Transportaiton required a borrow pit from the lands owned by BACKSLOPING Paget Ranches and the arrangements the land owners imposed BORROW PIT A/G for taking a borrow pit from their land exceeded the existing M D policy After lengthy discussion of this matter, \� and noting by obtaining the borrow pit from the Paget land a \� it was saving the M.D. paying for two other borrow pits, and would result in a shorter dirt haul, Mr Code moved the M D approve the agreement entered into with Paget Ranches Ltd ,✓ Q 4 COUNCIL MEETING JULY 8TH, 1986 ------------------------------- ------------------------------- for a borrow pit on the south half of Section 25- 29 -24 -4 CARRIED Mr Jeffery then reviewed the request from Allen Becker on his backsloping borrow pit agreement arranged in 1985 for BECKER AGREEMENT the SR 575 bridge project to have a cattle pass installed so RE- CATTLE PASS his cattle will not be cut off from their water supply He ON SR 575 presently pastures cattle on both the north and south side of the road and there is water on both sides However the water on the north side of the road will be buried by the 6 road construction and he will not be able to pasture his cattle on the north side of the road unless they can get to water on the south side A culvert large enough for a cattle pass would cost about $6000 00 After discussion of this matter, and noting the road committee will be going out on road tour tomorrow, Mr Mueller moved the Road Committee and Otto Hoff be authorized to review the situation with Mr Becker and Alberta Transportation and arrange some acceptable solution either by buying the land which will be cut off from water by the road construction, by installation of a cattle pass or some other reasonable alternative CARRIED There was further discussion about the need to change the M D FENCING existing M D. fencing policy and Mr Jeffery was given POLICY numerous suggestions as to how the policy should be re- � drafted Mr Campbell then moved this matter be tabled and Mr Jeffery bring a draft of a new fence policy to the 40 next meeting of council for further discussion. / CARRIED Mr Jeffery asked which community organization should be ANNUAL GRANT receiving the annual grant from the M D of Kneehill - the FOR CROSSROADS Crossroads Community Hall or the Crossroads Agricultural AG SOCIETY Society as the Agriculture Society had submitted a financial statement and report covering its 1985 activities ���� when Mr. Hastie moved that the 1986 grant be paid to the �6 �`�`� �cj_ Crossroads Agricultural Society and any future grants be made payable to the Agricultural Society - not the Community �p Hall Board CARRIED AAMD & C has sent a questionnaire out to all Jurisdications requesting some imput from councillors in regard to the Elected Officials Symposium. Mr. Jeffery reviewed the questions with council and answers to the questions were provided Mr Hastie moved the completed questionnaire be returned to the AAMD & C CARRIED Mr Jeffery read a letter received from Jubilee Insurance Agencies with regard to obtaining insurance on buildings owned by municipal jurisdications. The Executive of the Association has voted to enterinto a reciprocal exchange agreement and the necessary agreements have been forwarded for review by all councils After lengthy discussion of this matter, Mr Boake moved the M D agree to enter into the reciprocal exchange agreement and the Reeve and Municipal Administrator be authorized to sign the required power of attorney and Reciprocal Insurance Exchange Agreement on behalf of the M D of Kneehill #48 ✓ CARRIED The East Central Games Committee have forwarded an invitation for a representative from the M D of Kneehill to attend the official opening ceremonies on Friday July 11th, 1986 Mr Maerz moved Harold Mueller attend on behalf of the M D of Kneehill CARRIED 5 QUESTIONNAIRE FROM AAMD & C RE ELECTED OFFICIALS SYMPOSIUM 5ey\k A RECIPROCAL INS AGREEMENT a Sep` a verbs \i� COUNCIL MEETING JULY 8TH, 1986 ------------------------------- ------------------------------- _.. Mr Jeffery reviewed with council the second draft of the Keviers Lake Level 1 Study done by Hydrogeological Consultants Ltd AVER It would be necessary to spend about $10,000 00 to determine if LAKE; there is a sufficient water table in the area to drill a well WATER STUDY and pump water into the lake, and a further sum of about $17,000 00 to pump water into the lake for a six month period to further evaluate the situation A copy of this report has been sent to Alberta Water Resources for their consideration After lengthy discussion of this matter, Mr. Maerz moved the M D advise Alberta Water Resources it would like to proceed with drilling the water well and undertake the pump test at an estimated cost of $27,000 00 but due to limited funding would like to obtain a committment from Alberta Water Resources as to how much their department would be willing to contribute towards these costs prior to the M D making a final committment, and further moved a copy of this letter be sent to Mrs Connie Osterman, M.L.A., Stan Schumacher, M L A, and Negal Pengelly, M L A CARRIED It was also suggested Mr Jeffery should contact the local INVITE members of the legislature and invite them to meet with LOCAL M L A. the council at a council meeting some time at their convenience TO COUNCIL MEETINGS There was discussion about the existing fire policy 8 -7 regarding a limit on training costs, and after discussion FIRE POLICY Mr. Hastie moved that policy 8 -7 be cancelled as limits on 8 -7 ��- training costs are addressed in each fire agreement. CARRIED Mr Jeffery noted the Linden Fire Chief would like an M D councillor to attend a meeting with the Acme and Linden Fire MEETING Departments on July 9th, 1986 and it was agreed Reginald WITH LINDEN Campbell would attend the meeting on behalf of the M D & ACME FIRE DEPT There was discussion concerning the meeting held recently with the Village of Acme regarding fire protection in the Linden Rural Fire Department area and Mr. Mueller moved to table this matter until after the meeting which will be held July 9th, 1986 with the two fire departments y CARRIED The matter of the Trochu Fire Agreement was reviewed briefly and Mr Boake moved to table this matter until the next FIRE A/G meeting of Council CARRIED Mr. Hoff noted he has received numerous complaints regarding R CSC the lots in Swalwell which the M D sold to Richard Csakany LOT'S IN and after discussion of this matter, Mr Boake moved that SWALWELr, if the lot has not been cleaned up within one week from today, the A S B be directed to cut the grass and clean up the lot and the costs incurred be charged to Mr Csakany ��n� `sj%�. CARRIED `� 5�l --D Mr Boake noted he had discussed the weed problems which are WEEDS ON occuring on SR 575 with Art Thomas, and the A.S.B. crews +/ SR 575, will look into the problem. There was discussion about the road damage which occured to ROAD DAMAGE the south Huxley road as a result of a contractor, who was SOUTH HUXLEY hired to clean corrals for a local farmer, hauling loads of ROAD manure on the light coat road instead of crossing the farmer's land to get access to a gravel road Mr Mueller moved the Road Committee inspect the road damage and report back to the next meeting of Council D CARRIED 2 COUNCIL MEETING JULY 8TH, 1986 ------------------------------- ------------------------------- There was discussion about the rubble dumped on the M D environmental reserve and private land at the bottom of the Pope Lease Road Hill and it was agreed that if the garbage is not cleaned up Oris Rodger should arrange to have the site cleaned up and the land owner charged for the costs incurred It was also noted that the rubble pile next to the Sarcee Butte cemetery has been cleaned up and the land owner is to be sent an account for $300.00 which was the costs incurred for doing this work. / It was also noted Mr Cunningham should follow up with regard to removal of the sign which is too close to SR 583 and to the north -south gravel road near South half of 4 in 32 -24 -4 Mr. Maerz moved this meeting do now adjourn CARRIED TIME 5.00 P 4 REE E MUNI IP A INI RATOR RUBBLE ON LAND BOTTOM OF POPE LEASE ROAD HILL fy RUBBLES NEAR SARCEE CEMETERY SIGN TOO CLOSE TO ROADS ^ ADJOURN J C JEFFERY REPORT COVERING PERIOD JUNE 24TH TO JULY 8TH, 1986 1 Discussed reallocation of Art's time - afraid roadside spraying will not be accomplished. Art advised has been spraying as top priority project sprayer has been acting up but feels is okay now 2 Ori.s phone - we rented one for one year and will cancel at three months if necessary -at a cost of $400.00 to $500 00 3.
