Office, Three Hills, on Tuesday, May 13th, 1986, commencing at 9 00 A M The following were present R A Maerz, Bruce Hastie, Robert E Boake, Harold Mueller and J. Finlay Code, Members of the Court of Revision J C Jeffery, Clerk of the Court Mrs Jean Wilkinson, Recording Secretary - Otto Hoff and Reginald G. Campbell were present as observers Myles Burns, representative from the Three Hills Capital Edward Dunay, Assessor for the M D of Kneehill The Court of Revision was opened and Mr Code moved that Richard A Maerz be Chairman of the Court CARRIED Mr Maerz took charge of the meeting Mr Dunay advised that no one representing J M. Huber Corporation or Renaissance Energy was planning to attend the Court and suggested that as Mr Peter Cormack from Gulf Canada was here, the Court consider the appeals filed by Gulf The Court agreed and Mr Peter Cormack entered the hearing 1 Roll 6224 - Gulf Alberta Pipe Lines Co Ltd , - LSD 12- 04 -28- 20-4 Mr Cormack indicated they were ^appealing ^the ^assessment ^ on ^ ^a building which should in fact be assessed to Tennenco. Mr Dunay advised the Court this was in fact correct and recommended the improvement assessment be reduced from 2470 to 1500 Mr Boake moved to accept the recommendation of the assessor and reduce the improvement assessment from 2470 to 1500, a reduction of 970 CARRIED 2 ROLL 6257 - Gulf Canada Corporation LSD 02- 02- 32 -22 -4 Mr. Cormack noted this well ^ has _ not ^been - producing since December of 1984, and the machinery and equipment is only stored on the si to Mr Dunay recommended cancellation of the machinery and equipment assessment of $21,480. Mr Hastie moved to accept the recommendation of the assessor and cancel the machinery and is equipment assessment of $21,480 CARRIED 3 Roll 6258 - Gulf Canada Corporation -LSD 09- 17- 34 -25 -4 Mr. Cormack noted this machinery and equipment is surplus and not in production and request cancellation of the machinery and equipment of $15,270 Mr Dunay noted this is correct and Mr Mueller moved to cancel the machinery and equipment assessment of $15 270 CARRIED 4 Roll 6228 - Gulf Canada Corporation - LSD - 06- 33- 29 -24 -4 Mr Cormack noted this assessment is on the Swalwell gas plant and there is a compressor and oil production on site also They wish to appeal the assessment on the oil portion of the development. At the present time the oil production is shut down and due to low production of oil from the plant are requesting a 55% obsolence factor be taken into consideration Mr Dunay agreed with this request and recommended a reduction of 1 C I • • • 1986 COURT OF REVISION - M.D OF KNEEHILL #48 MAY 13TH, 1986 34,490 for the machinery and equipment Mr. Boake moved accept the recommendation of the assessor and reduce machinery and equipment assessment from 616,700 to 582,210, reduction of 34,490 CARRIED Mr Cormack left the hearing at this time to the a 4 Roll No 6301 06 - J M Huber Corporation LSD 06- 33- 32 -22 -4 No one was present on behalf of the company ^ Mr Dunay noted the well is not in production and requested the machinery and equipment assessment of $23,250 be cancelled Mr Mueller moved to accept the recommendation of the assessor and cancel the machinery and equipment assessment of $23,250 5 Roll 6402 3 - Renaissance Energy LSD 06- 26- 29 -25 -4 No one was present on behalf of the company Mr Dunay noted the well is not in production and requested cancellation of the machinery and equipment assessment of $11,170 Mr Code moved to accept the recommendation of the assessor and cancel the machinery and equipment assessment of $11,170 CARRIED 6 Roll 6348 06 - Mobil Oil - LSD 07- 09- 34 -26 -4 No one was present on behalf of the company Mr Dunay noted the machinery and equipment had been removed and recommended cancellation of the assessment on the machinery and equipment of $28,500 Mr Hastie moved to accept the recommendation of the assessor and cancel the machinery and equipment assessment of $28,500 7. Roll 6349 6 - Mobil Oil - LSD 06- 15- 34 -26 -4 Mr Dunay noted the well is not in production and the machinery and equipment assessment should be removed Mr Hastie moved to accept the recommendation of the assessor and the machinery and equipment assessment be cancelled in the amount of $28,830 CARRIED Mr Dunay noted the appeals against the assessments on Roll 6349 LSD 13- 10- 34 -26 -4 and on Roll 6349 5 SW 12- 34 -26 -4 have been withdrawn 8 Roll No 340 - NE 16- 28 -22 -4 - Wilmer & Selma Forsch JINo one was present on behalf of the appellants Mr Dunay noted he had re- inspected the land and there is alot of alkali along the draw and heavy sub soil He recommended a reduction of 3680 Mr Code moved to accept the recommendation of the assessor and reduce the land assessment on this quarter from 33,720 to 30,040 a reduction of 3680 CARRIED 9. Roll 8058 - Business Tax Assessment Stern Bulk Sales - SE 15- 29 -23 -4 Mr Dunay noted the appellant was previously operating ^a^ bulk fertilizer business along with his bulk fuel business, but Turbo Resources will not allow him to operate a fertilizer business along with a bulk fuel business due to the dangers involved The fertilizer business has been discontinued He therefore 2 1986 COURT OF REVISION M D KNEEHILL #48 MAY 13TH, 1986 recommended deletion of the improvements and equipment assessment which would result in a reduction of 1330 from the total assessment Mr. Mueller moved to accept the recommendation of the assessor and reduce the business tax assessment from 4720 to 3390, a reduction of 1330 CARRIED 10. ROLL 991 01 - STERN BULK SALES - SE 15- 29 -23 -4 No one was present on behalf of the company Mr. Dunay noted because of the change in the business operation as indicated above, the machinery and equipment assessment of $15,580 be cancelled, and the improvement assessment of 81,680 be reduced by 15,350 to $66,330 Mr Boake moved to accept the recommendation of the assessor and cancel the machinery and equipment assessment of $15,580 and reduce the improvement assessment to $66,330, a reduction of $15,350, which is a total reduction of $30,930 CARRIED 11. Roll 8109 - John & Pat Stickel - Pt NE 18- 32 -23 -4 Business Tax Assessment No one was present on behalf of the appellant. Mr Dunay noted there was a mistake in the calculation and recommended a reduction of the assessment from $45,0 to $1580, a reduction of $2940 Mr Hastie moved to accept the recommendation of the assessor and reduce the business tax assessment on this parcel from $4510 to $1580 CARRIED 12 Roll 4312 - Pt NW 14- 33 -23 -4 - Albert Steiner Time 9 45 A M Mr Steiner was not present for the appeal hearing He is appealing the land assessment which he says is too high. Mr. Dunay noted he had re- inspected the land which is a small acreage and can find no error in the assessment or the value he has placed on the land He recommended no change After discussion Mr Hastie moved to accept the recommendation of the assessor and make no change in the assessment CARRIED Mr Dunay noted that Pan Canadian had withdrawn all of its appeals. 13 Roll 549 - Gary Lang ON BEHALF OF E V GRAMMS SE 17- 28 -24 -4 - Time 10 15 A.M No one was present on behalf of the appellant Mr Dunay noted he had reinspected this land and there is some lighter textured soil and would recommend a reduction in the land assessment from $35,010 to $34,560, reduction of 450. Mr. Mueller moved acceptance of the recommendation of the assessor and the land assessment of $35,010 be reduced to $34,560, a reduction of $450. is CARRIED 14. Roll 552 - S 112 NE 17- 28 -24 -4 - Gary Lang on behalf of E V Gramms Mr. Dunay noted he had reinspected this land and recommended a reduction from 16,050 to 15,080 a reduction of $970 Mr Boake moved to accept the recommendation of the assessor and reduce the assessment from $16,050 to $15,080, a reduction of 970 CARRIED 3 15 Roll 914 - Dan Ferguson - NE 34- 29 -22 -4 - Time 10 30 A M No one was present on behalf of the appellant. Mr Dunay noted he had reinspected this quarter and it had some poorly drained areas and some heavy sub soil He recommended a reduction from 33,640 to $32,200 a reduction of $1440 Mr Code moved to accept the recommendation of the assessor and reduce the land assessment freom $33,640 to $32,200. a reduction of $1440 16 Roll 5017 - David Muddle - 5017 - SW 25- 34 -22 -4 10 40 A M No one was present on behalf of the appellant Mr Dunay noted the government had purchased some road widening from this land but the survey plan was not yet registered He would therefore recommend a reduction in the assessment from $24,140 to $23,810, a reduction of $330, but no reduction of the acres until the plan is registered Mr Mueller moved to accept the recommendation of the assessor and reduce the land assessment from $24,140 to $23,810, a reduction of $330 CARRIED 17 Roll 5020 - David Muddle - SE 26- 34 -22 -4 Mr. Dunay recommended a reduction of the assessment from $23,100 to $22,820, due to the road widening Mr Code moved to accept the recommendation of the assessor and reduce the land assessment from $23,100 to $22,820, a reduction of $280. CARRIED 18 ROLL 5021 - David Muddle - SW 26- 34 -22 -4 Mr Dunay recomended the acres be increased by 1 acre due to amalgmation of an old school site into title with the balance of the quarter 154 87 acres to 155 87, and a reduction in the land assessment from $23,400 to $23,300, due to the addition of the one acre and the road widening Mr Boake moved to accept the recommendation of the assessor and change the acres to 155 87 and reduce the land assessment from $23,400 to $23,300, a reduction of $100 CARRIED 19 Roll 5022 - Pt SW 26- 34 -22 -4 - David Muddle Mr Dunay noted that due to alagmation of this parcel in with the balance of the quarter section the assessment on this parcel should be cancelled Mr Hastie moved to accept the recommendation of the assessor and the assessment of $170 on this parcel be cancelled CARRIED 20 Roll 5021 01 - Margaret Quennville - Pt SW 26- 34 -22 -4 - 4 13 acres No one was present on behalf of the appellant Mr Dunay noted some land had been taken for road widening and recommended reduction of the land assessment from $210 to $150 Mr Mueller moved to accept the recommendation of the assessor and reduce the land assessment from $210 to $150 , a reduction of $60 CARRIED 21 ROLL 8110 - TRIPLE B TRUCKING BUSINESS TAX ASSESSMENT PT SW 6- 32 -24 -4 Mr Dunay noted the company is using a large area of the farm yard for storage of trucks and estimates the area to be 50 by 200 feet, and felt there should be an assessment on this area Mr Code moved to accept the recommendation of the assessor and add $2500 to the business tax assessment of $300, making a total of $2800 CARRIED 4 �n 1986 COURT OF REVISION M D KNEEHILL #48 ROLL 1931 - NE 1- 30 -24 -4 - GORDON PAGET No one was present on behalf of the appellant. CARRIED Mr. Hastie moved third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr Campbell moved third reading to this by -law CARRIED 1 COUNCIL MEETING MAY 13TH, 1986 By -law number 1097 which was given first and second reading at the last meeting was reviewed again by Council, and after discussion of the need to amend the business tax by -law to provide for a rate for open air storage for trucking businesses, Mr. Hastie moved third reading to this by -law CARRIED Mr Jeffery reviewed his report and various items were discussed. 1 Request for subforeman on paving crew, and Mr Maerz moved to tabled this matter until the next meeting in order to discuss the matter with the foreman CARRIED 2. There was discussion about the need to monitor more carefully the amount of oil and gas used in M.D. trucks and whether having a log book in each truck would be useful. It was suggested Alberta Transportation should also review the Old Torrington Pit road at the same time Mr Maerz noted his grader operator is having problems keeping up with his roads as he is being called into Division 6 to help keep the roads in that division in passable shape It was agreed the ROPS canopy could be sold for $300 00 Mr Mueller moved the M D pay Teresa Rodgers $100.00 as a token compensation for the two weeks work she did for the M D in order to complete her secretarial training CARRIED ✓ Myles Burns left the meeting at this time Mr Jeffery reviewed the need for all councillors to carry adequate liablity insurance in order to protect themselves in case of an accident while on M.D. business. Following discussion fo this matter, Mr Boake moved that the M D arrange to monitor the Valleyview Colony water well for at least one week, and then water be pumped from the Old Torrington Pit into the Kneehill Creek using an 8 to 10 inch pump CARRIED Mr Hazelton advised he is now at the Megli Pit crushing and would then go to McNair Pit, the Mildenstein Pit and then to the Garson Pit It will require some stripping and road work at the Mildenstein Pit before he can get his equipment and crusher in After discussion Mr Hoff moved that access into the Mildenstein pit be opened up in the next two or three weeks, making use of a divisional motor grader, the Small Crew, or hired equipment,if necessary in order to do the work required to provide access and open up the pit area CARRIED It was agreed that Oris Rodger and Alex Cunningham should inspect the site and determine what is necessary to be done Mr Jeffery noted the M D crew will not be able to construct the foundation for the Keiver's Lake washhouse and Atco will do the necessary work Mr. Maerz noted there should be a parks committee meeting held as soon as possible after the wash house has been installed Mr Campbell moved to accep the report given by Mr Jeffery and Mr Maerz CARRIED 4 PLANS FOR OLD TORRINGTON PIT MONITOR VALLEYVIEW COLONY WELL & PUMP WATER FROM OLD TORRINGTON PIT GRAVEL CRUSHING MILDENSTEIN PIT ROAD ACCESS REQUIRED P�e�'_ KEIVERS I WASH HOUS PARKS COr MEETING F SOON VN COUNCIL MEETING MAY 13TH, 1986 Mr Jeffery reviewed the prices quoted for supply of emulsion for 1986 and noted Pounder Emuslion has the lowest price Mr Mueller moved that the M D purchase its emulsion requirements for 1986 from Pounder Emulsion CARRIED Mr. Jeffery noted the Three Hills Golf Course would like the M D to haul 3 loads of screenings to the course and after discussion of the existing M D policy, Mr Hastie moved the M D would donate the 60 yards of screenings to the Three HIlls Golf Club from screenings at the Old Torrington Pit, but the club would have to make its own arrangements for hauling as the M D gravel crew would not be able to do it CARRIED Mr Jeffery noted Laron Excavating would demolish the buildings in Swalwell and Wimborne at a price of $3400 00 for the Swalwell building and $1800 00 for the Wimborne building After discussion Mr Campbell moved that Bud Haskell be directed to demolish and clean up the two sites CARRIED ✓ Mr Jeffery noted the gas line must be removed from the Wimborne building and the cost for this will be $320 00 / Mr Jeffery reviewed the road ban situation and after discussion Mr Hastie moved that the road ban on SR 585 be removed, on condition the M.D. of Starland is agreeable, and removal of road bans from all other roads be tabled and j discussed at the next meeting of Council ` CARRIED Mr Jeffery noted Alberta Bridge Branch has up- graded two bridges in the Sharples area to legal load limit and the restrictions should be removed from them He reviewed a draft by -law to remove the two bridge restrictions and after discussion Mr Campbell moved first reading to by -law number 1101, this being a by -law to amend the bridge load restriction by -law number 1084 by deleting any reference to Bridge File 13199 - ISW 17- 29 -22 -4 and Bridge file 70976 - ISW 17- 29 -22 -4 CARRIED Mr Boake moved second reading to this by -law CARRIED Mr. Mueller moved that third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr Maerz moved third reading to this by -law. PROPERTY RE He felt the M D policy regarding location of pipelines was BORROW PITS vague and that some system must be worked out whereby any ETC lines within a certain distance of the road project are to be located and flagged. Mr. Code moved that Mr. Cunningham and Mr Vickery review this problem and draft up a policy which could be implemented by the M D in an attempt to eliminate this problem and which would provide for identification and flagging of all pipelines within a given C� area adjacent to the road construction project CARRIED Mr Jeffery read a letter from the Calgary Amateur Radio REQUEST FOR SPACE Association The Association would like permission to make ON M D TOWER use of the M D radio tower to provide better ham radi o AMATEUR RADIO coverage for thei r c ub. Mr. Cunningham reviewed what the ASSOCIATION club does and noted it would provide a wider network of coverage in the event of any disaster in this area He noted there are about 30 to 35 ham radio operator members in this area and about 250 in Calgary He stated there would be no extra work for the M D , and their frequency band should not cause any intereference with the M D radio system They would only be making use of tower space and a small amount of space in the radio building at the tower site. There would be a small amount of power used by the club as well After discusion of this matter, Mr Code moved that the Calgary Amateur Radio Association be allowed to install a VHF repeater and UHF linking system on the M D radio tower at Carbon, but the M D retain the right to request removal of the equipment at any time should the M D deem it necessary for any reason, and the M D agrees to make no charge for the use of the tower or for the power used by the club at this time, but this arrangement is subject to review and negotiation if deemed necessary by the Council at any time. CARRIED Mr Jeffery noted that Mike Welsh, M D solicitor had suggested council consider imposing direct control on the land adjacent to SR 806 in order to protect the route which may be required should re- alignment of the road be proceeded with in future Mr Boake moved that Palliser Regional Planning Commission be requested to review the M D land use by -law with a view to implementing direct control on the lands adjacent to the proposed route for re- alignment of SR 806 south of Linden CARRIED Mr Richard Csakany has requested the M D provide him with title to the property he purchased under agreement for sale in 1983 However the house which was to be constructed on the property has not yet been started He advises the bank will not provide him with financing for the house until he has title After discussion Mr. Hastie moved that the M D prepare a transfer in favour of Mr Csakany, the transfer and duplicate title be forwarded to the M D solicitor and appropriate trust conditions be imposed to ensure the transfer is registered only after Mr. Csakany's mortgage arrangements have been finalized and the mortgage is registered against the property concurrently with registration of the transfer to Mr Csakany CARRIED Mr. Jeffery reported that The Sunnyslope Ball and Hockey Teams will be sponsoring an outdoor festival on July 13th, 1986 at the Robert Vetter farm west of Three Hills and they have submitted a letter outlining how the concert will be managed After discussion of this matter, Mr Maerz moved the M.D allow the concert to be held on condition the applicants post the $500 00 cash bond, pay a $5 00 licence fee and ensure the concert is conducted in the manner they have outlined in their letter of May 6th, 1986 CARRIED Mr Jeffery read a letter received from Thiessen Sand & Gravel (Darrel Thiessen) and he indicates he would be willing to sell the M.D a minimum of 20,000 yards of crushed gravel in 1986 at a price of $2 00 per yard and this price would include crushing and royalties and they would be willing to accept responsibility for the costs of any reclamation work required. After discussion of this offer Mr Campbell moved that Darrel Thiessen be advised the M D would be willing to enter into a contract with him to purchase 20,000 yards of gravel in 1986, subject to the gravel being tested to ensure it is of a quality acceptable for M D. purposes. The County has used a product called Dust Stop which costs about $1200.00 per mile Mr Jeffery noted the M D has arranged a test of a product called Humic Acid Mr Code noted the County was charging individual farmers $250 00 each to put the dust control product on the road in front of their residences, but since that time have decided to cover the cost of putting the product on heavily travelled roads - such as gravel haul roads After discussion Mr Code moved the M D undertake a test of the Dust Stop product on one or two spots to be selected by the Road Committee and Oris Rodger CARRIED Mr Jeffery reported that the Provincial Court of Alberta will no longer attempt to collect a fine imposed for any violations if the money when paid is to be turned over to the municipality If the fine is not paid voluntarily it will be the responsibility of the M D to collect it After discussion Mr Campbell moved to accept and file as information. CARRIED DUST CONTROL PRODUCTS & TESTS COLLECTION ' OF POLICE COURT FINES i Mr Jeffery noted the office requested permission to close PERMISSION the office on June 30th and after discussion Mr Hoff moved To CLOSE the office be given permission to close on June 30th, 1986. OFFICE JUNE 39 CARRIED Mr Jeffery reported the Province has now paid the 1986 Alberta Transportation Assistance Grant in the sum of $14,493 00, and after discussion and noting there had been an overpayment of these funds in 1985 which must be taken into consideration this year, Mr Boake moved that the M D policy for distribution of these funds be the same as the 1985 policy, and the towns, villages and city be notified of same and the policy be advertised in the local paper CARRIED Mr Jeffery reviewed the minutes from the A S B meeting held on April 21st,and Mr Maerz moved approval of these minutes.
