1 Allan Gore - 442 -2622 - would like permission to purchase
2000 yards of gravel 3/4" or 1 1/4" -
2 Monty McGregor advises there will be a grant for
approximately $23,000.00 for Orkney Look out site to cover all
expenses They are also making a grant to Starland to acquire
the Oyster Beds
3 Loader demo - Caroline - Tuesday, 9 00 A M 5 1/4 yard
bucket
4 Shop has run into fairly major problems with OF 30 crawler
Bearing is gone in final drive - 2 rollers split - could have
been caused by the dumping problem experienced when machine was
new
Has 3877 hours on it now Western Tractor has been informed, but
received no response as yet
5 Connie Osterman called March 4th, 1986 and advised that 20
KM of SR 575 will be tendered this year
6 Asked Mike Welsh regarding 2nd and 3rd reading of by -law 1089
(school ) and he advised if you are really concerned about the
existing hog operation and feel there could be a potential conflict
with the proposed school, you are under no compulsion to pass the
2nd and 3rd readings
7 Keith checked with engineers - they advise about $800 00 to
do study of shop - if decide to proceed with renovations, there
would be more engineering fees later - discussed with Reed
Carruthers

A regular meeting of the council of the Municipal District
of Kneehill #48 was held in the M D Office, Three Hills,
Alberta, on Tuesday, March 11th, 1986, commencing at 9 00

Mrs Jean Wilkinson, Assistant Administrator was present and
recorded the minutes
Myles Burns, Representative from the Three Hills Capital
was also present
Reeve Hoff called the meeting to order and the agenda for
today's meeting was reviewed
It was noted that Norman Tainsh wished to meet with Council
regarding Item #33 and Mr Code asked that Item #37 -
additional street light for Hesketh be added to the agenda.
Mr Maerz moved approval of the agenda with the above noted
additions.

It was noted that Doug Hazelton had met with some of the
councillors prior to the start of the meeting and would not
be coming in today
There was discussion about printing the minutes in the local
paper and what guidelines should be established for editing
the minutes for publication It was noted that the Capital
had sent a reporter to the meeting today
Mr. Maerz moved that the M D discontinue printing an edited
verison of the council minutes in the paper as long as a
reporter is putting a report concerning council business in
the paper

After lengthy discussion of this request, Mr Campbell moved OF

serving people around the Drumheller area including that
area of I D #7 which was recently annexed into the M.D. of

He wondeW if the M D would be willing to contribute funds
towards the operation of the Drumheller Service and also
asked about the subsidy that the M.D pays to the people in
that area who make use of the Drumheller Ambulance Service
Mr Almond was advised that the M D along with the towns
and villages in this area operate the Kneehill Ambulance
Service and did not feel they could subsidize the area
around Drumheller for another ambulance service
The M D policy regarding ambulance subsidy paid to people
in an area around Drumheller was also reviewed with him
Mr Almond was thanked for coming and he left the meeting
Mr Jeffery advised Council that Palliser Regional CARNEY
Planning Commission refused the Carney subdivision SUBDIVISION
application for the South half of 10- 31 -21 -4 S2 10 -31 -21
Mr Jeffery also reported that due to concerns expressed by
Councillor Hastie, he had discussed with Alberta Municipal LETTER FROM
Affairs the motion passed by Council concerning the Carney MUN AFFAIRS
subdivision He then read a letter from Archie R Grover & M WELSH
Deputy Minister of Municipal Affairs and Mr Grover suggests
that should council wish to recommend approval for these
types of subdivisions they should make the necessary changes
to their land use by -law
Mr Jeffery also read a letter from Mike Welsh, M D
solicitor concerning this matter, and Mr Welsh also
suggested that Council should consider changing its land use
by -law if they wish to accomodate these types of
subdivisions
Mr Mueller left the meeting at this time 1 45 P M.
Ross advised Council that the Commission is not required to
bring to Council its staff report and recommendations
regarding subdivisions, but this is done only as a courtesy r
to council He also noted that the Commission is not bound
by the recommendations made by the M D Council.
Mr. Maerz moved to table this matter until later today

submitted by Mert McGhee for NE 30- 30 -21 -4 was refused s

Mr Jeffery reviewed an application for subdivision for
CT D IISIOND
North 1/2 of 20- 27 -20 -4 which is
just south of the M. D. boundary, SUBDIVISION
and after discussion of this application Mr Boake moved
that Calgary Regional Planning Commission be advised the
M D has no objections to this subdivision.

Ross reviewed with Council the title situation in REST COVENANT
SE 25- 30 -25 -4 and the request from Ross Todd and Company SE 25- 30 -25 -4
to discharge the restrictive covenant
He noted there are two restrictive covenants filed against (v
the land and after discussion of this matter, Mr Maerz 5e^
moved that the M D recommend the restrictive covenants be
removed only if Mr Gladwin Toews is willing to consolidate
the 5 28 acre parcel into title with the balance of the d/
quarter section, and Reimer Farms Ltd is willing to
consolidate the 5 46 acre parcel and the 14.78 title
together, so there will be only two titles instead of the
present four

Norman Tainsh, Solicitor, entered the meeting at this time
and discussed with Council the request for certification of
legal access for the North half of 4- 30 -24 -4 He noted that
Rob and Lorraine Shea, the land owners have a sale for that
portion of the NE 1/4 of 4- 30 -24 -4 which lies to the east of
the railway tracks and wish to retain title to the remainder
of the NE of 4 and that portion of the NW 4 which they
presently own The North half of 4 which they own is
presently under one title There is legal access to both
parcels which they wish to create
Mr Tainsh noted he has obtained descriptions for the
parcels from Land Titles Office
Ross noted he had also discussed this matter with Land
Titles Office and was advised that if Mr Shea wished to
obtain separate title to that portion of the NE 4 lying west
of the railway tracks and a separate title to that portion
of the NW of 4 he would have to file another certification
of legal access It was noted that that portion of the NE
4 which lies to the west of the railway tracks does not have
legal access except through the NW of 4
After discussion of this matter, Mr Campbell moved that Mr
Jeffery be authorized to sign the certification of legal
access document on behalf of the M D of Kneehill

Mr Jeffery then reviewed a resolution which has been
prepared by the M D of Foothills for presentation to their
Foothills Little Bow Association of Municipal Districts and
Counties The resolution deals with the problems being
created by Section 86 of the Planning Act - certificate of
legal access - and requests the government to give control
over signing the certification to the local municipalities
After discussion of this matter, Mr Hastie moved that the
M D support this resolution if it is brought to the
Association's Spring Convention

Mr Boake moved he be excused from discussion and voting on
Item #36 on the agenda as he has a personal interest in this 0
matter

Mr Jeffery advised Mr. Boake has requested redesignation of
two quarter sections - SE 22- 29 -25 -4 and NE 15- 29 -25 -4 from

After discussion of this request, Mr Hastie moved first
reading to by -law number 1093, this being a by -law to amend
land use by -law 1061,by redesignation of the NE 15 -29-
25-4 and the SE 22- 29 -25 -4 from agriculture conservation to
agriculture

Mr Maerz moved that the required public hearing be held on
Tuesday, April 8th, 1986, commencing at 1 45 P M and notice
of the public hearing be advertised in the local paper

Ross Rawlusyk left the meeting at this time 2 45 P.M , and
agreed he would return later this afternoon
There was discussion about appointment of an auditor for the
M D. for 1986, and Mr Boake moved that the firm of Henry
Van Den Hoven of Three Hills, be appointed as auditor for
1986

Mr Mueller returned to the meeting at this time 2 55 P M
Mr Code noted that the A.S B would like permission to
apply for one or two persons under the Alberta Environment
Employment Program in order to assist with the Toad Flax
Spraying Program
After discussion of this matter, Mr Hastie moved that the
M D apply to Alberta Environment for assistance for two
employes for the A.S B under this program

Mr Jeffery read a letter from Alberta Parks in which they
advise they are willing to assume responsibility for the
operation of the Tolman Park, but wish to have the existing
facilities at the park turned over to them.
After discussion Mr Maerz moved the M D agree to transfer
the existing facilities (toilets, well and camp kitchen)
at the Tolman Park over to Alberta Parks and Recreation,
but will not transfer ownership of the existing stock pile
of gravel, which is located on the park land, over to the
Province

There was discussion held concerning settlement of 1986
wages and salaries, and Mr Hastie brought forth a
suggestion regarding imposing a limit on the amount paid by
the M D to employees for travelling time He suggested
that travel time be paid at a specific set rate and this
money be paid to the employees for travel time getting to
and from the actual job site
Council would establish the hours to be worked on the job,
and their regular pay would not start until they arrived on
site, and regular pay would cease when they left the fob

There was lengthy discussion about this suggestion
The Council meeting then recessed for 10 minutes, and
reconvened at 4 00 P.M.
Mr. Jeffery noted the foremen have completed review of the
bids for the machinery purchases, and after discussion it
was agreed this meeting would be adjourned tonight until
1 00 P.M., March 24th, 1986, in order to review the
recommendations from the foremen and complete today's
agenda

The matter of the Carney Subdivison on South half of 10- 30 -21 -4
was again discussed as Councillor Mueller was now present
There was discussion regarding the location of the partially
completed residence on the proposed subdivision, and whether
it was within the 1 to 100 year flood plain, as well as
other concerns regarding this matter
Mr Maerz then moved to accept and file the letters from
Alberta Municipal Affairs, Mike Welsh, and Palliser Regional
Planning Commission

Mrs. Marvin Keim and Mrs. Ruth Grabinsky entered the meeting
at this time
Mrs Keim presented to Council a letter from the Acme
Christian Academy The Board of the Academy reviewed the
situation concerning the intensive hog operation which is
located close to their existing school and to their proposed
new site and stated in their letter that they would not at
any time in the future seek to shut down or remove the
Neufeld operation from its present location
After discussion of this matter with Mrs Keim and Mrs
Grabinsky, Mr Maerz moved second reading to by -law number
1089, this being a by -law to amend land use by -law 1061,
by redesignation of the NW 7- 29 -25 -4, to agriculture

Mr Campbell moved third reading to this by -law.

Mr Marvin Keim entered the meeting at this time and Reeve
Hoff advised him of Council's decision
Mr and Mrs Keim and Mrs. Grabinsky left the meeting at
this time
Ross Rawlusyk also left the meeting at this time 4 30 P.M
There was further discussion held concerning the 1986 wages
and payment for travel time It was noted that some
employees are not paid now for travelling time - such as
shop employees, office staff, etc, and only about half of
the permanent employees are paid for time spent travelling
to the work site
Mr. Hastie moved as follows
1 Those employees whose work does not start until
reaching the job site will no longer receive pay for time
spent travelling to and from the job site
2 That those employees who are covered by the Public Works
Contract be given an increase of 45 cents per hour for 1986
with the increase to be effective January 1st, 1986
3 That a rate for one hour's pay (based on a 9 hour day)
be calculated on the 1985 wage rates for the various job
classifications and that dollar rate be paid as compensation
for loss of pay for travelling time, and this additional
increase be effective April 1st, 1986 for all employees
covered by the public works contract
CARRIED
There was discussion concerning the 1986 wage scale for
temporary summer employees and the existing policy governing
these employees It was noted the policy would have to be
amended to indicate that pay would not start until the
employee reaches the job site.
After discussion Mr Maerz moved there be no change in the
existing temporary wage scale with the exception that there
will be no pay for time spent travelling to the fob site

Mr Hastie moved that a new category be added to the
temporary employee policy for - A S B Employees who have
worked for the M D for more than two summers and the wage
scale for those employees for 1986 be as follows
Operator Rate - Range between $10 14 to $11 63
Labourer Rate - Range between $5 45 to $8 99
Tandum Water Truck Driver - Range between $9 91 to $11 21
Mr Jeffery reviewed the report from the meeting held to
discuss the Three Hills Swimming Pool project He also
reviewed a suggested advertisement and after discussion Mr
Maerz moved that the M.D. advertise its intention to
contribute $70,000 00 towards the Three Hills Swimming Pool
Project, that at least 89 electors from the Three Hills
Recreation Area must petition against participation in the
project before council will consider their objections,
that notice of its intention be advertised in the local
paper for two weeks, and any petition against participation
in the project must be received prior to April 7th, 1986
