Maerz (after 9:05 A M.) Division 4 Harold Mueller Division 5 Reginald G Campbell Division 7 Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr. Art Davis, representative from the Three Hills School Division entered the meeting at 9.10 A M Mr Hoff called the meeting to order and noted Mr Jeffery and Mr Hastie are both away on holidays W:��`1 Mr Code asked that Item #36 be added to the agenda - A S B Weed Survey A S B Mr Code then moved approval of the agenda as presented with r WEED SURVEY addition of Item Number 36 - A.S B Weed Survey CARRIED Mr Boake moved approval of the November 4th minutes of council meeting APPROVAL � CARRIED MINUFES Mrs Wilkinson reviewed the bank statement for the month of October, 1985, and after discussion Mr Campbell moved BANK approval of the statement STATEMENT CARRIED Mr Mueller moved approval of the accounts listed for APPROVAL payment today, subject to further review of the finance ACCOUNTS committee of R G Campbell, Harold Mueller, Otto Hoff and R A Maerz. CARRIED Mrs Wilkinson reviewed Mr Jeffery's report and various J C JEFFERY items were discussed, including the problem with amount of REPORT gravel removed from under water at the Old Torrington Gravel pit Mrs Wilkinson noted Mr Calder feels he has removed 39 500 yards and the M.D surveyor feels there is only 20,450 yards in the 5 piles After discussion of this GRAVEL AT matter, Mr Maerz moved that Pete Calder Crane Company be OLD paid the sum of $46,000 00 as a advance against the money TORRINGTON owing to him for crane work done at the Old Torrington Pit PIT with the balance to be paid when the pit run gravel PETE CALDER which has been stock piled in five piles is crushed next CRANE spring. CARRIED Various items of correspondence were reviewed Mr Hoff noted that the Local Authorities Board at the annexation CORRESPONDENCE hearing held for the Village of Carbon re. Perman land did not feel the M D had a case to request the road lying west SON of the land be included in the village boundaries, as this ANNEXATION request was not included in the M D 's letter submitted to PEgMAN LAND the Village of Carbon L' 1 COUNCIL MEETING NOVEMBER 26TH, 1985 The use of the Linden and Torrington rubble pits by urban residents was discussed and Mr Maerz moved that Mr Rempfer USE OF be advised no urban residents are to be allowed to make use RUBBLE PITS of either of the rubble pits until such time as an agreement BY URBAN for cost sharing has been arranged with the urban RESIDENTS centers concerned. Mr Rempfer has also indicated neither furnace works well in the trailers at the rubble pits and it was agreed these must REPAIR be repaired immediately. FURNACES AT RUBBLE Mr Boake moved approval of Mr Jeffery's report PITS CARRIED Mrs Wilkinson requested clarification regarding attendance at the Christmas supper and dance - are ATTENDANCE children allowed to come or not - and after discussion Mr. XMAS Code moved that attendance at the Christmas supper and dance PARTY be limited to employees, councillors and their partners CARRIED ROAD TOUR The minutes from the November 8th and November 20th MINUTES road tours were then reviewed and various items discussed as follows 1 Need to check speed limit on SR 583 east of Three Hills R K`' SPEED LIMIT and it was agreed the office should review the existing ON SR 583 speed limit by -law and bring a report back to Council RSV+ MAe cau ^C A 2 Mr Code reviewed for council the concerns expressed to J LOWEN him by Mr Jack Lowen regarding the condition of the J GRAVEL PIT Lowen gravel pit on SE 16- 29 -21 -4 Mr Lowen is not happy SE 16 -29 -21 as the pit area was not cleaned up before the crusher left and holes were left in the pit floor He felt the bottom of the pit should have been levelled off and the area left in a more tidy condition It was generally agreed there should be more supervision by the foremen when the crusher moves in and the area should be inspected by the foremen before the crusher leaves 3 The request from Crist and Dayton Unruh for construction REQUEST of a road west of SW 1- 30 -25 -4 (half mile) to provide access FOR ROAD to a possible subdivision on NW 1- 30 -25 -4 was discussed in CONSTRUCTION detail, and it was noted if this request is granted it would WSW 1- 30 -25 -4 be a change in previous M D policy It was noted there are UNRUH two bad hills which would have to be cut down so it could not be constructed as a blade grade with graders but would require some buggy and cat work It was noted there is a prairie trail in existance and access can be gained to the se�� land at least in the summer time Mr Dayton Unruh will be establishing a broiler operation on the proposed 20 acre subdivision if the land can be purchased and a subdivision obtained However before they can make this decision they must know if a road will be constructed to provide good access to the land Mr Campbell moved that the M D will, because the proposed development is for an intensive agriculture operation and will therefore continue the agricultural use of the land, make a committment to construct one -half mile of a minimum standard type road, on road allowance west of the SW 1 -30- 25-4, as time permits, but road construction will not commence until after Mr Crist Unruh and Mr Dayton Unruh have purchased the North West of 1- 30 -25 -4 have created the proposed 20 acre subdivision, and established the proposed intensive broiler operation on the subdivision CARRIED rc521 • s COUNCIL MEETING NOVEMBER 26TH, 1985 Mr. Mueller moved approval of the road tour minutes of November 8th and November 20th, 1985 CARRIED Mrs Wilkinson reviewed for council an account submitted by Mr. George Van Doren for fence line clearing West NW 22 -34- 23-4 Mr Van Doren had hired a cat to cut down and bury the brush along the west side of this quarter and he felt that the trees were on road allowance The account was for $470 00 After discussion of this request, Mr Maerz moved that the M D not pay the account submitted by Mr Van Doren CARRIED The need to change the date for the second meeting of council in December was discussed and agreed it would be reviewed again at the December 10th meeting of Council, when all council members are present. APPROVAL ROAD TOUR MINUTES ACCOUNT FROM GEORGE VAN DOREN WNW 22 34 -23 -4 � 'e;oce e C �P CHANGE DATE FOR COUNCIL MEETING IN DEC I Mr Code reviewed the proposed weed survey form prepared by Mr Soder, and the reasons for requiring a survey. Mr Soder wishes to have some instruction from the A S.B as to what weeds should receive priority in the M D. which weeds are the worst, and what areas have the more severe weed problems The A S B is asking each councillor to undertake a telephone survey of a number of farmers in their division in order to get some imput regarding this matter It was noted the form prepared by Mr. Soder is much too detailed to do over the telephone, and Mr Mueller moved that the councillors undertake a weed survey using a simplified survey form, and the results of the survey be brought back to the December 16th joint meeting with the A S B CARRIED Keith Smith, Rick Vickery, Oris Rodger, George Rempel and Alex Cunningham entered the meeting at this time. Rick reported as follows- - finished the Wilson project finished the Klassen culvert, working in the Megli Pit doing stripping but have shut down today as it is too cold One cat from the Small Crew is working on a brushing project, and the Small crew buggy is working at the Megli Pit also If the weather breaks should be able to finish stripping at the Megli Pit within a week Does council wish to proceed with the stripping work at the Old Torrington Pit and the Doug Hazelton Pit? Mr Rempel indicated to council that Mr Hazelton would not sell any gravel to the M.D unless the M D entered into an agreement with him which would guarantee Alberta Environment would allow removal of gravel from under water from his pit as well as from the Old Torrington Pit He had indicated he could not get a permit from Environment to remove gravel from under water in his pit It was noted this request to remove gravel from underwater in his pit had been discussed previously but the Council felt they could not make such a long term committment Mr Rempel felt the gravel removed from under water at the Old Torrington Pit could be crushed as it is quite dry and could likely get by without crushing any gravel at Linden Contractors Pit Also the M.D could open a pit on the Hutterian Brethren land if necessary 3 • Ill. t k° COUNCIL MEETING NOVEMBER 26TH, 1985 Rick asked if council wished to shut the crews down as soon as the stripping at the Megli Pit has been completed, and it was agreed after discussion that Rick be given authority to complete the stripping at the Megli Pit if weather permits and then shut down the construction crews Keith reported as follows - worked on 44 trucks and trailers SHOP over past month, as well as 7 buggies one crawler and 4 REPORT miscellaneous items Sand and salt shed nearly done, but cold weather holding up completion It was suggested any metal brackets clamps, bolts etc should be repainted to stop corroaion Keith noted all snow plow equipment is on. Also having a problem getting parts for the Galion grader Cannot start work on any major overhauls until the crews shut down Still having a problem with the end dump trailer - cracks, etc C -3 will require a major overhaul this winter Shop will start working on the D7F cat right away Alex reported as follows: - finished cemetery surveys - did six cemeteries this year and will likely do two next year - UTILITY Arthurville and Lumni. This will complete the project OFFICER Worked on the Megli Pit plan which must be sent to Alberta REPORT Environment. It appears there may be another 100,000 yards there but it may require removal of 15 feet of overburden to get 15 feet of gravel Reviewed the test hole reports on the pit with council. Attended Utility Officers convention - reviewed the water grant program and Small Power Producers Program Behind on radio repairs at this time as signal generator is in Ontario being repaired Town of Trochu has requested permission to use one channel on the M D radio frequency and have checked this request with Tim Petersen They have obtained their own town frequency but wish to have access to the M D radio frequency for emergency purposes Can see no problem with this request Oris reported as follows - finishing up snow fence UTILITY installation - still some in Division 4 and 6 to do Will FOREMAN have to fill sand and salt shed when it has been completed REPORT Sand will be hauled in from the Old Torrington Pit Sanding trucks ready to go. George reported as follows - hauling gravel in Division 2 until last Tuesday - shut down and stock piling gravel now GRAVEL Working from the McNair Pit stockpiling at Marshmann stock FOREMAN pile Put boxes back on the trucks Asked if council wish REPORT to run a double shift for stock piling this winter. It was suggested the office should contact Alberta Transportation to see if the M D could stock pile gravel at the Highway 21 and 27 site now. Doug Hazelton has about 2000 to 3000 yards crushed at the Old Torrington Pit, but is not working now There is an area stripped where he could crush gravel Mr Hazelton indicated to George that he would not crush the gravel removed from under water until spring There was discussion regarding how many shifts should be operated this winter to stock pile gravel, the number of regular employees who could work on the second gravel shift and whether it would be necessary to keep any additional men on over the winter It was noted there are five people on the gravel crew now and there are 7 other regular employees who could also run the gravel trucks There was also discussion about the temporary employees 4 t�w COUNCIL MEETING NOVEMBER 26TH, 1985 Keith asked council about the interpretation of the 1985 contract with regard to the abolishment of slack time and scheduling of 1984 holidays. He noted Mr Jeffery is taking the position that holidays which are taken in 1985 were earned in 1984 and therefore should be taken under the terms and conditions of the 1984 contract The employees feel that as of January 1st, 1985, slack time was done away with and therefore any holidays taken after January lst, 1985 whether earned in 1983 or 1984 should be able to be taken in accordance with terms and conditions laid out in the 1985 contract This interpretation is affecting quite a number of employees, because they have scheduled their holidays in 1985 in accordance with the 1985 contract - no more than 2 weeks taken in summer time frame, and were planning on taking the balance of holidays during the winter months Mrs Wilkinson reviewed notes left by Mr Jeffery concerning this problem Mr Jeffery feels the correct interpretation of the contract is that deletion of the incentive holidays time frame would only be effective at such time as each employee was entitled to take his 1985 holidays some time in 1986 Any holidays taken in 1985 should be taken in accordance with the 1984 contract However he requests council to make a motion to the effect that any employee would not lose holiday time by misinterpretation of the contract, provided they can show a prior pattern in how they were taking their holidays The foremen indicated to council they dial not agree with Mr Jeffery's interpretation and the employees feel that slack time was abolished as of January 1st 1985 and therefore any holidays taken in 1985 should be taken in accordance with the terms of the 1985 contract Keith also pointed out to Council that he along with Oris and George are paid a monthly salary and are on,,jYe salaried contract, but are actually treated�as'nv a &AS 4@l�ic works hourly employee They work a 9 hour day and do not earn overtime until after 9 hours Rick is a foreman, but is still paid on an hourly basis and is still on the hourly contract, so receives overtime after 8 hours a day The foremen paid on a monthly basis feel their holidays and sick days and any holiday payouts should be based on a 9 hour day as their contract says they must work a 9 hour day The foremen also noted they had not been given the chance in the past few years to negotiate their pay with Council Council agreed these matters would be reviewed during the 1986 wage negotiations The meeting then adjourned for dinner between 12.15 P.M. and HOLIDAY CLAUSE IN 85 CONTRACT DINNER 1.20 P M V1 Alex Cunningham and Ross Rawlusyk from Palliser Regional Planning Commission entered the meeting at this time A request has been received for the M D to loin the FEDERATION Federation of Canadian Municipalities - cost is per capita CAN based on population with minimum fee of $350 00 ,.4 MUNICIPALITIES Mr Maerz moved that the M D not loin this association. MEMBERSHIP CARRIED The Hudson Bay Route Association have requested the M D pay HUDSON BAY its membership fee in the association at this time ROUTE ASSOC. Membership is $100 00 per year After discussion Mr Boake L� moved that the membership fee of $100.00 be paid CARRIED 5 COUNCIL MEETING NOVEMBER 26TH, 1985 ------------------------------------ ------------------------------------ Mr Campbell moved that the Council meeting do now ad3c in order to hold the public hearing scheduled for today 1.30 P M CARRIED Mr Maerz moved that Council meeting do now reconvene, public hearing having been completed CARRIED Time 1 45 P M the Council then reviewed by -law number 1079, to redesignate the BY -LAW NE 22- 33 -23 -4 from agricultural conservation to agriculture NO 1079 Ross noted that if the redesignation is allowed an REDESI(NATION application for subdivision will follow and there is no real NE 22 -33 -23 reason to allow a subdivision at this time as there is no 4 definite buyer available for the proposed subdivision and no indication what use might be made of the land by any potential buyer It would fragment agricultural land After further discussion of this matter, and noting the land to be subdivided is very poor pasture with only about 40 acres of good cultivated land, Mr Mueller moved second reading to by -law number 1079 this being a by -law to amend the land use by -law 1061 by redesignation of the NE 22 -33- 23-4 from agricultural conversation to agriculture CARRIED Mr Campbell moved third reading to this by -law. CARRIED Mr. Code reported that PAWN is requesting payment of the 1986 membership fees at this time He reviewed the projects PAWN proposed by the association for next year and noted the REPORT association is hoping that most areas will pay a minimum of MEMBERSHIP $1000 00 membership fee Mrs Wilkinson noted the account received from PAWN FEE suggested a membership fee of 20 cents per capita and for PAYMENT the M D this would be $966 20 Ross noted that Palliser has requested funding from the $966 20 Province to enable the commission to hire a person to assist PAWN with some of its projects as Palliser has in past Ccl- (through Bill Ashton and Paul Fenwick) assisted the rojnb�e association with preparation of maps and other related matters LIA Mr Code moved that the M D pay its 1986 membership fee of $966 20 to PAWN at this time CARRIED Mr Boake moved that the Council meeting do now adjourn in public order to hold the public hearing scheduled for today at 2 00 4 hearing P M Time 2:00 P M Mr Campbell moved that the Council meeting do now reconvene the public hearing having been completed CARRIED Time 2 25 P M Council reviewed by -law number 1080, which is a by -law to BY -LAW amend the land use by -law number 1061 by redesignation of NO 1080 the south half of 10- 29 -21 -4 from agricultural conservation REDESIGNATION to agriculture S12 10 -29 -21 After discussion of this by -law and views expressed during the public hearing, Mr Campbell moved second reading to by- law number 1080 CARRIED Mr Maerz moved third reading to by -law number 1080 CARRIED 2 COUNCIL MEETING NOVEMBER 26TH 1985 Mr Mueller moved that Council meeting do now adjourn in DEV APPEAL order to hold a Development Appeal Board meeting BOARD CARRIED V1 MEETING Time 2.27 P.M. The City of Drumheller will contact Terry Vaughn of Alberta Recreation to review the matter with him, and Mr Code therefore moved that discussion of Item Number 34 - M D distribution of recreation funds - be tabledl until January 14th, 1986 CARRIED Mr Code left the meeting at this time 3.10 P M Council then reviewed items discussed this morning with the foremen including. Purchase of gravel from Linden Contractor's pit Mr Campbell moved that the M.D. not proceed with purchase of any gravel from the Linden Contractor s pit until Mr Hazelton has a meeting with Council on December 10th, 1985 CARRIED Number of shifts for the gravel crew in winter time - Mr Maerz moved that the gravel crew run two (2) eight hour shifts during the winter time frame - maximum six trucks per shift CARRIED Interpretation of the 1985 contract with regard to holiday scheduling Mr Boake moved to table this matter until the next meeting of Council CARRIED 7 SUBDIVISION CHANGE TO REGULATIONS �A SALE OF M D LAND USE BY -LAW FEE FOR SAME Pa TABLE DISTRIBUTION OF M D FUNDS FOR 1986 T"'A ta. i Doi �Do SHIFTS FOR GRAVEL CREW IN WINTER 85 CONTRACT rzd C IS;! COUNCIL MEETING NOVEMBER 26TH, 1985 Mrs Wilkinson reported that Alberta Bridge Branch would like council to establish a priority list for six bridges which are due for replacement, or mayor improvements The bridges are- Vetter File 71175, Page File 2119• Kientz File 1084 Albrecht Low Level Crossing File 78996 Dann Low Level Crossing File 80878 ; Litke Culvert File 80887 Bridge Branch likely could do one or two bridges a year if funding is available. After discussion Mr. Maerz moved the bridge priority list be as follows- File 71175 Vetter - 1st File 80887 - Litke Culvert - 2nd File 1084 - Kientz - 3rd File 78996 - Albretch low level crossing - 4th File 80878 - Dann low level crossing - 5th File 2119 - Page bridge - 6th CARRIED Mrs Wilkinson gave each councillor a copy of Mr Jeffery's report regarding operating costs per hour for the crawlers graders and buggies and Mr Maerz moved to table this matter until the next meeting of Council CARRIED Mrs Wilkinson read a letter from Darren Paget and a letter from Page Insurance Ltd representing Russell Vasselin and it appears they suffered damage to their motor vehicles as a result of the operation of an M.D sand truck After discussion of these letters, Mr Campbell moved that the parties involved be advised the M D does not accept liability for this type of damage CARRIED PRIORITY LIST FOR SIX BRIDGES ALTA BRIDGE BRANCH i 5Q�,' ` Cie• (�," REPORT RE, COSTING ON MACHINES CLAIMS FROM D PAC17 AND RUSSELL VASSELIN 1e.��rs \r-,%(P Mrs Wilkinson read a letter from Alberta Transportation and '(c�b\e ALTA they have provided estimated costs for improvements to the TRANSPORT King Hill on SR 583 east of Three Hills They estimate it ESTIMATE will cost at least $140,000 00. After discussion Mr.d, COSTS KING Mueller moved consideration of this matter be tabled and HILL discussed when the 1986 road program is established sect INTERSECTION CARRIED I Mr Boake noted he had discussed the M D s decision RADIO regarding use of the M D. radio tower with a party TOWER involved in providing radio tower space to others and he was ,A USE pleased with the M.D 's decision The request from the Town of Trochu to make use of a channel TOWN OF on the M D radio frequency for emergency purposes was TROCHU USE reviewed and Mr Maerz moved that the Town of Trochu be M D RADIO allowed to make use of the M D radio frequency for FREQUENCY emergency purposes only, and further moved to accept the report given by Mr Boake �Pv CARRIED POLICY RE Mrs Wilkinson reviewed the existing policy regarding SANDING ROADS sanding gravel roads, and Mr Campbell moved that the Council confirm its existing policy and any calls received by the office from ratepayers for sanding other roads be referred to the divisional councillor CARRIED 1.11 (01 COUNCIL MEETING NOVEMBER 26TH, 1985 Mrs Wilkinson read a letter from the Village of Acme in which The Village Council request the M D undertake sanding REQUEST TO of same of their streets as they do not have equipment available SAND After discussion of this matter, Mr Boake moved STREETS IN the Village of Acme be advised the M D is unable to ACME undertake this type of work for any of the urban centers, v c' but the Village may, upon request and if necessary purchase a L t eic small amount of sand and salt mixture from the MAD CARRIED Mrs Wilkinson read a letter received from Dome Petroleum Ltd The company is concerned that they were not notified the M D planned to work over their pipeline during work on a road West of 10- 32 -22 -4 (Wilson Project). After discussion of this letter Mr Mueller moved to accept and file the letter as information and a reply be sent to Dome Petroleum Ltd , advising them council has been notified of their concerns. CARRIED It was agreed that this matter be reviewed with Rick Vickery Mrs Wilkinson read a letter from Alberta Transportation regarding the new winter works program which could be used to cover the cost of brushing on road intersections.
