Letter from AAMD & C re proposed changes to subdivision regulations 21 Letter from AAMD & C re new Default Judgement Program 22 A S B Minutes - September 20th and October 21st, 1985 Hail Insurance Resolution 1986 Roadside spraying Program 23 Review status of old Wimborne Curling Club property 1 • D COUNCIL MEETING NOVEMBER 4TH, 1985 ----------------------------- - - - - -- The Council of the Municipal District of Kneehill #48 held a meeting on Monday, November 4th, 1985, in the M D Office, Three Hills, commencing at 9 00 A M The date for the first monthly meeting of council was changed due to conflict with the commencement of the AAMD & C convention and all councillors were present when the motion was passed to set the date for this meeting The following were present J Finlay Code Division 1 Otto Hoff Division 2 (Reeve) Robert E Boake Division 3 Richard A Maerz Division 4 Harold Mueller (after 9 55 A M ) Division 5 Bruce Hastie (after 9 25 A.M ) Division 6 Reginald G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator Mr Boake advised Rick Vickery would like to go to the Megli Pit to do some stripping for a day or two until the Klassen culvert is ready He noted there is no 3/4 inch gravel left at the Megli Pit and stripping is required before another crush can be done Also noted that no crush was authorized for this pit this fall or next spring PRESENT MEGLI PIT GRAVEL STRIPPING, ETC Mr Code requested that graphic maps be prepared showing the MAPS OF PITS 1 ocati on of each gravel pit and the location of the stock STOCK PILE SITES pile sites in relation to the pits, and where the break even ETC point in mileage is with regard to the gravel hauls It was agreed this could be done It was noted there may be 20 feet of overburden in some 'TESTING AT areas at the Megli Pit and after discussion of this matter, MEGLI PIT Mr Code moved that gravel testing be done at the Megli Pit before any more stripping is done CARRIED Requests were made to add the following items to the agenda APPROVAL OF Report regarding Lyle Regehr's radio tower AGENDA Mrs Mabel Schmidt - road approach to land WITH ADDITIONS and after diicussion Mr Maerz moved approval of the agenda subject to the addition of the above noted items. CARRIED Mr Code moved approval of the council minutes of October APPROVAL OF 22nd, 19 8 5 MINUTES CARRIED I Mr. Jeffery noted that Robert Kennedy has received a summons R 1CNEDY to appear in court on November 28th, 1985 with regard to the SUMMONS damage caused to a passing vehicle while he was acting as a flagperson There was discussion about whether the M D. should hire a solicitor to defend him, and to act on behalf of the M D. in SOLICITOR connection with the counter charge laid against the R C M P FOR R I�NNEDY officer involved in the incident. Mr Boake moved that the M.D provide legal counsel to defend Robert Kennedy and to represent the M D in -f0 connection with the counter charge laid. CARRIED 4 I COUNCIL MEETING NOVEMBER 4TH, 1985 ----------------------------- - - - - -- Mr Code noted that the Road Committee had inspected the road access problem involving Mrs Mabel Schmi dt' s land and SCHMIDT ROAD Wayne Hoff's land and Mr Ben Ziegler and others wish to APPROACH discuss the matter with council today Mr Hoff moved that he be excused from discussion and voting HOFF EXCUSED on this matter as a member of his family is involved FROM DISCUSSION CARRIED & VOTING ON MATTER Deputy Reeve Maerz took charge of the meeting Mr Randy Gieck, Mr Ben Ziegler, and Mr and Mrs Elmer Zielger entered the meeting Mr Elmer Zielger noted he is renting the SE 34- 28 -22 -4 from Mrs Mabel Schmidt and previously access was gained through land owned by Mr and Mrs Wayne Hoff However that access has been shut off and they are unable to get to portions of the cultivated land due to the deep coulees which run through the land They asked how much assistance the M D. would provide to them for construction of a road across the coulees The matter was reviewed with them and they were advised that the only responsibility the M D has is to provide them with an approach from the M D road allowance in order to get on to the land Any internal roads to get across the coulees to reach other fields is their own responsibility. They then asked if the M D would provide them with culverts for the internal roads, and a culvert for the road approach. They were advised that the M.D would provide a culvert for the road approach, and the approach should be located at the site reviewed with them in order to ensure reasonably good visibility. However culverts required for the internal road would be their own responsibility, and it may be possible to purchase used culverts at the M.D shop for one -half of new cost Mr Zielger indicated they would proceed with construction of the internal road if the M D would sell them the used culverts at half price There was discussion regarding when the M D would install the road approach and it was agreed that Mr. Ziegler could install a temporary road approach without a culvert until the M D. can get around to installation of the proper road approach with a culvert Mrs Mabel Schmidt entered the meeting at this time and the situation was briefly discussed with her The people were thanked for coming and they left the meeting Reeve Hoff then took charge of the meeting Mr Hasti e moved that the accounts listed for payment today APPROVAL OF be approved, subject to further review by the finance ACCOUNTS committee of Otto Hoff, Richard A Maerz, Robert E Boake and R G Campbell CARRIED Mr Jeffery reported that the p r i v a t e truckers were GRAVEL REPORT terminated Friday night. The following gravel has been spread to date Division 1 19,714, Division 2 21,013, Division 3 12,540, Division 4 11,462, Division 5 18,921, Division 6 18,294, Division 7 35,634 Various other gravel related items were discussed and Mr Campbell moved acceptance of the report given CARRIED 2 COUNCIL MEETING NOVEMBER 4TH, 1985 ----------------------------- - - - - -- Mr Jeffery read a letter from Alberta Transportation WIMBORNE regarding the Wimborne north railway crossing in which they NORTH RAILWAY request the M D impose a 80 KMP speed limit to cover the CROSSING area 200 meters north of the hamlet boundary. After discussion of this matter, and noting that there is a 50 KMP speed limit through the hamlet right to the railway SPEED LIMIT track from the south, and therefore the speed limit should be consistent at 50 KMP, Mr Hasti a moved first reading to BYLAY AMENDMENT by - law number 1083, this being a by -law to amend by -law 1055, to establish a speed limit of 50 KPH for that portion #1083 `eo.<IrIc of SR 805 commencing at the most northerly boundary of the sue" hamlet of Wimborne a distance of 200 meters north CARRIED Mr Campbell moved second reading to this by -law CARRIED Mr Boake moved that third reading be given to this by -law at this time CARRIED U ► v-y) c)u s Mr Mueller moved third reading to this by -law CARRIED No It was noted that speed zone ahead signs would have to be erected Rohe , further north on SR 805 to warn the south bound traffic of the up- coming speed zone, and Mr Kennedy should review the entire traffic sign situation in that area Mr. Jeffery noted that Mrs Connie Osterman would be able to COMBINED LOCAL attend a combined meeting of the local governments on January 24th, and after discussion Mr Code moved that the -�T� combined meeting be held on Friday, January 24 th, 1986 , MEETING keen, commencing at 1 30 P M JAN 24/86 s� ^6 CARRIED Mr Code asked if council would meet with the A S B in the near future in order to discuss the 1986 roadside spraying program and the need for a new sprayer The next service board meeting is scheduled for Monday, November 18th, 1985 After discussion Mr Hastie moved a joint meeting of the council and A S B be held on Monday, December 16th, 1985" commencing at 1 00 P.M. CARRIED The councillors from the M D of Starland entered the meeting at this time and various items were reviewed with them as follows 1 Gravel situation in the M D - Brunner gravel, Garson Pit gravel - drill testing for gravel, gravel royalties, Mildrenstein gravel pit, amount of gravel used on roads, other sources of gravel when all gravel taken from the Garson Pit Starland asked if Kneehill would allow them more gravel from the Garson Pit, and whether Kneehill would like them to crush more gravel at the Brunner Pit. 2 Councillors per diem - same but Starland's mileage is 45 cents per mile - Kneehill's is 40 cents 3. Starland has scentless mayweed problem which is �Ispreading quite rapidly No toad flax problem as yet 4 Agreed Starland would sand the Tolman Hill during the months of October, December, February and April if required, and the M D. of Kneehill would sand in November, January and March 3 JOINT MELTING WITH A S B Dec 16/85 MEETING WITH STARLAND COUNCIL MEETING NOVEMBER 4TH, 1985 ----------------------------- - - - - -- 5 Annual ball game - set date for June 20th, 1986 6 Price paid for land acquisition and borrow pits, etc 7 Starland has price for fence removal and a price for fence replacement 8. Fire protection - 9 Need for radio communication for M D crews, fire departments, etc 10 Supervision of motor grader operators 11 Public Works superintendent 12 Use of private engineers for road construction 13. Garbage disposal - Starland contemplating a push off system 14 Disposal of pesticide containers 15 Selling or leasing of road allowances Change in use of road allowances - Starland require permission be obtained from the council before any change in the use of the road allowance - such as change from pasture use to cultivation 16 Haying ditches and clean up of hay left in ditches 17 Hauling gravel - Starland use private truckers and pay government rates 18 Average cost to put gravel on a mile of road Reeve Stanger thanked the Kneehill council for inviting them to this meeting as they feel it is quite useful to review how different items are handled, and they left the meeting The meeting then adjourned for dinner between 11 30 A. M. ,,, DINNER and 1 20 P M The road committee report from October 24th was reviewed and various items discussed as follows ROAD COMMITTEE 1 Need for culvert north of the Three Hi 1 1 s stock pi 1 e REPORT site was reviewed and as the exact location is in doubt, Mr Maerz agreed he would review the situation himself and get back to the road committee later 2 Need for yield signs on the Schmidt road was reviewed and Mr Maerz moved that yield signs be erected N/ NW 7 -32- YIELD SIGNS 25 -4 and E /SE 13- 32 -26 -4, so the north south traffic on this ON SCHMIDT road must yield to the east -west traffic, and further moved ROAD that the large rocks left in the ditches on the Schmidt project be removed CARROED 3 The width of SR 585 at the Schramm coulee is 24 feet and after discussion it was agreed this matter be discussed again with Alberta Transportation at the Fall Convention Mr Campbell noted he is receiving numerous complaints about the road from people living on both sides of the river It was suggested this road should be considered top priority by the M D for improvement by Alberta Transportation but no decision was made regarding this suggestion 4 Ziegler Road approach problem - SE 34- 28 -22 -4 - Mr Code moved that the M D install an approach to provide access to this quarter of land, at the location approved by the Road Committee CARRIED Mr Code moved acceptance of the road committee report CARRIED 4 SCHRAMM COULEE WIDTH SR 585 ZIEGLER ROAD APPROACH SE 34- 28 -22 -4 0'-;1 COUNCIL MEETING NOVEMBER 4TH, 1985 ----------------------------- - - - - -- Mr Jeffery reviewed his report He advised council the engine in the traxscavator is hatched and after discussion REPAIR of this matter, Mr Campbell moved the engine on the TRAXSCAVATOR tranxscavator be repaired s CARRIED It was suggested the shop should look at putting an oft `Gav\ cooler on the machine at this time The 1985 contract change regarding holidays was reviewed 1985 with regard to when any individual employee would be HOLIDAY entitled to the benefit which resulted from the change CONTRACT CHANGE Some employees feel the change was effective January 1st, 1985 and therefore would affect previous years' holidays It could make one week's difference in the holidays depending on when certain employees took their holidays After discussion of this matter, Mr Maer 1985 holiday contract change would be individual employees have earned their 1985 would be sometime in 1986, and holidays calculated using each employee's hiring anniversary date z moved that the effective when holidays - which continue to be date as their CARRIED There was lengthy discussion about the request from the SALARIED FOREMEN sal ari ed foremen and those salaried public works employees REQUEST RE who are in their last five years prior to retirement, 8 HOUR DAY to pay their sick days, holidays and statutory holidays on the basis of a 9 hour day, instead of an 8 hour day Mr Boake moved no change be made in the calculation method presently used CARRIED The request from the office for permission to hire a part time person was reviewed and Mr. Maerz moved that Mr PART TIPS PERSON Jeffery and Mrs Wilkinson be given permission to hire a FOR OFFICE person for the office on a part time basis at a starting $5 00 per hour rate of $5 00 per hour STARTING WAGE CARRIED / ;,,1 -k �0 It was agreed that a flexible time schedule could be worked 'p out for the person hired The possibility of having a hot meal for the Christmas party HOT MEAL FOR was discussed and it would noted it would be necessary to RISTMAs have tickets issued in order to know how many employees PA R2� would be at the supper After discussion of this matter, Mr Hasti a moved that the M D COVER COST M D. Christmas party be totally paid for by the M D and a OF MEAL ETC , hot meal be provided, and further moved that the foremen are to advise the office for catering purposes the exact number of people from each crew who will be attending CARRIED Mr Campbell agreed he could arrange for a caterer for the meal Mr Mueller moved a Mr Jeffery asked regard to payment lengthy discussion made cceptance of Mr. Jeffery's report CARRIED for some direction from council with of a 1985 incentive bonus and there was about the matter, but no decision was Mr Jeffery gave each councillor a copy of a main crew costing report to date and various items were reviewed Mr Mueller moved acceptance of the costing report 5 1985 INCENTIVE BONUS MAIN CREW COSTING REPORT J' Zi • COUNCIL MEETING NOVEMBER 4TH, 1985 ----------------------------- - - - - -- The servicing and moving policy of the gravel crew was discussed and it was suggested a service man should be available on Saturdays to service the gravel trucks rather than shutting the trucks down during working hours The need to have each driver grease his own vehicle was also discussed It was suggested the foremen of each crew should meet with council to discuss how the crews could be made more efficient The gravel crew moves were also discussed. Mr Maerz moved to table this matter until the December 10th meeting of Council CARRIED GRAVEL CREW SERVICING & MOVING POLICY Mr Jeffery reviewed his report concerning various ways the M D recreation grant monies could be distributed to the RECREATION towns and villages and the city of Drumheller and after REPORT lengthy discussion Mr Boake moved to table this matter M D GRANTS until the next meeting of council CARRIED It was noted a meeting will be held this evening with representatives from the recreation board and urban council s Mr Jeffery noted committment from from his gravel 1i purchase gravel purchasing the apparently feels area is stripped. Council made no such a long term Doug Hazel ton was in today and requested a REQUEST FROM the M.D with regard to purchase of gravel DOUG HAZELTON pit He wants to know if the M D will RE GRAVEL FROM from underwater i n hi s pi t as well as HIS PIT gravel which is not underwater He this would have a bearing on how the pit motions as they felt they could not make committment There was brief discussion about how the gravel is being removed from the Old Torrington Pit and how much water was OLD TORRINGTON pumped from the pit area It appears the dragl i ne is g o i n PIT GRAVEL down about 28 feet now Mr Jeffery reviewed a letter from the Town of Thre Hills in RRAP PROGRAM which they request the M D accept RRAP applications from residents of the Town of Three Hills as well as rural residents ,-? After discussion Mr Mueller moved that the M.D RRAP agent 40 accept applications from residents of the Town of Three Pip+ Hills for the RRAP program. CARRIED Mr Jeffery read a letter from the Town of Trochu in which they request permission to make use of one channel on the MD radio frequency After discussion of this matter Mr Campbell moved to table this matter until further information is available regarding how much use the town would be making of the M.D radio channel CARRIED Mr. Jeffery read a letter from the County of Ponoka regarding control of seismic operations on road allowances and there was discussion as to whether the M D should present a resolution to the Fall Convention The existing M.D policy regarding no seismic operations on road allowances which are surfaced was reviewed and Mr Hastie moved to accept the letter from the County of Ponoka and the report given and no resolution be presented to the Fall Convention CARRIED TROCHU USE OF M D RADIO FREQUENCY I'`1b1 e� SEISMIC WORK ON ROAD AL TI- aIANCES Y` Pie* Go The meeting then adjourned for supper between 5 15 P M and SUPPER 7 00 P M 11 6 I r COUNCIL MEETING NOVEMBER 4TH, 1985 ------------------------------ - - - - -- Council meet with representatives from various recreation boards and urban councils as follows Acme - Gordon Kessler - Tracy Lei nwei ber RECREATION MEETING Carbon - Caroline Bodmer and Dennis Church WITH URBAN Torrington - Ben Bauer and Mery Clarkson CENTERS Linden - Darwin Moon, Sam Megli, Roger Bishop and M Dyck Three Hills - Louis Perrault and Wade Brosseau Trochu - Raymond Frere and Maureen Frere Mr Jeffery reviewed the results of the survey conducted by the Three Hills Recreation Board and the three possible ways council had considered to make the distribution of funds Mr Sam Megli spoke to the meeting on behalf of Linden The Village looks after two fish dams, which should be considered as a recreation facility. He felt it would be unfair to a large segment of their people to cut down the funding to the Village of Linden fie also indicated the village has been using the grant for recreation purposes They have donated to the Beiseker arena and the Acme swimming pool and have a community center as well The communities seemed to agree that pools and arenas incur the largest costs for municipalities Caroline Bodmer from Carbon felt use of the formula taking all facilities into consideration was best Sam Megli noted use of the new formula would affect the donations made by the Village to other communities Three Hills and Carbon representatives felt the $5000 00 minimum was the best formula to use and indicate what facilities were covered with the $5000 00 minimum grant Raymond Frere - Trochu asked if the M D would consider raising the recreation portion of taxes After further discussion of this matter, the delegation was thanked for coming and left the council meeting Mr Code moved that the balance of the council agenda be TABLE BALANCE OF tabled until the next meeting of council.
