Appeal Board Hearing 1 30 P M. 28 Letter from R Csakany re Swalwell Lots COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the M.D. Office, Three Hills, Alberta, on Tuesday, October 22nd, 1985, commencing at 9 00 A M The following were present J Finlay Code Division 1 Otto Hoff Division 2 PRESENT Robert E Boake Division 3 Richard A Maerz Division 4 Harold Mueller Division 5 Bruce Hastie (after 9 05 A M ) Division 6 Reginald G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator Gwen Miles, representative from the Three Hills Capital Foremen, George Rempel, Oris Rodger, Keith Smith, Alex Cunningham, Norman Soder, Art Thomas, Lyle Gelinas Mr Hoff called the meeting to order, and asked for a motion APPROVAL OF to approve the agenda for today' meeting. AGENDA Mr Maerz asked to have several small miscellaneous items added as item #29 Mr Code asked to have roadside spraying program for 1986 added as Item #30 Mr Maerz moved approval of the agenda with the above noted items added CARRIED Mr Jeffery noted that the following reports were omitted CORRECTION from the minutes of the October 8th r e g u 1 a meeting of TO MINUTES Council " Mr Jeffery advised Council regarding the status of the KEIVERS LAKE Keiver Lake Study and the Kneehil Dugout Program " Mr Cunningham advised Council that someone is removing dirt STOP WORK from an area along the Red Deer River on the Meston Property ORDER - Section 34- 29 -21 -4 It appears the party who is living in the house on the subdivision may be responsible and Mr Cunningham advised council he would be issuing a stop work order ordering removal of dirt to cease Alberta VA Environment have been advised and have inspected the area also. Mr Hastie moved to accept the report given by Mr Cunningham CARRIED APPROVAL Mr Code moved approval of the minutes of the October 8th OF MINUTES organizational meeting of council and the minutes of the October 8th regular meeting of council, with the above noted V% correction CARRIED Mr Boake moved approval of the accounts listed for payment APPROVAL OF today subject to further review by the Finance Committee of ACCOUNTS Robert E Boake, J Finlay Code, Otto Hoff and Richard A Maerz CARRIED 1 E eaph COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- The foremen gave the following reports Lyle Gelinas Price for rental of a bank of lights from Certified Rentals - $1200 00 per week for each set of lights Should have dirt work finished on the Wilson Project middle of next week Requested direction from Council - should main crew go to Klassen Culvert next or to the Old Torrington Pit It was noted Ken Thompson is going on holidays November 1st and his crew is working at the Old Torrington Pit now. There was discussion about the Raygo Ram and the fact it is not in good shape and has not been used much this summer Men feel it should be traded off There was discussion about the Kientz intersection project and Mr Maerz reported that Alberta Transportation do not approve of Y intersections and therefore would make no recommendations regarding improvement of the intersection In order to remove the Y intersection a cattle pass would be required and it would take alot more work, and it was agreed that the original plan for backsloping the road be proceeded with and the existing bridge be replaced with about a four foot culvert. It was noted the main crew should go to the Klassen culvert job if the culvert has been delivered and then to the Old Torrington Pit to do the stripping required It was noted the M.D will have to strip dirt at Linden Contractors pit also After discussion no change was made in the hours to be worked by the main crew - remain at 10 hours per day No price is available for a slope meter Lyle advised that Frank Huxley would like the M D to do some dirt work on M.D road allowance in order to drain a slough and it would take about 2 hours The location is close to the Wilson Project Mr Maerz noted Mr Alvin Keiver would like the ditch cleaned in front of his residence in order to stop the culvert from filling up with dirt After discussion of these requests, Mr Hastie moved the main crew undertake the above noted ditch cleaning projects. CARRIED George Calder Crane Company is not taking gravel out right to the bottom of the Old Torrington Pit Mr Calder advised he could not go to the bottom on the first cut. It appears the machine is not big enough to lift the gravel with a 70 foot boom He is only going down about 10 feet There was lengthy discussion about this matter and Mr Jeffery advised that Bellco Construction from Lacombe would remove 15 feet of gravel with a backhoe for $4000 00 a day would might average out to a cost of $1 14 per yard, if the water could be kept away Mr Jeffery reviewed his report at this time and various items were briefly discussed Mr. Campbell moved approval of the report given by Mr Jeffery CARRIED Mr Jeffery then reviewed a letter received from Fiat Allis regarding the tracks on the Fiat Allis crawler After discussion of this matter, Mr Smith noted this report does not match the report he obtained at the time the work was done He presented to council the 5000 hour inspection which was done by the company on May 2nd, 1985, and that report indicated the under carriage wear was satisfactory and did not require any work. There was discussion about whether the M D. should try to sell the old tracks as is or repair same and then sell them No decision was made Mr Code moved that Fiat Allis and Western Tractor be given a copy of the 5000 hour inspection report and they be advised the M D is not satisfied with their offer CARRIED � z 2 FOREMENS REPORT KIENTZ INTERSECTION PROJECT KLASSEN CULVERT PROJECT STRIPPING AT TORRINGTON PIT DITCH CLEANING PROJECTS GRAVEL REMOVAL OLD TORRINGTON PIT J C JEFFERY REPORT FIAT ALLIS CRAWLER TRACKS c.S O Art Gave a report of the summer activities of his crew and FOREMENS noted his crew will be laid off at the end of October REPORTS Mr. Hoff noted a parks committee meeting was held recently $12,230 00 and the minutes from same were reviewed. The Parks Committee Dodge V8 360 Standard recommend to council that bleachers, a baseball PARKS back stop and chain link fencing be purchased for K e i v e r s ' MINUTES Lake Park There was discussion about this request and it assistance was noted one bleacher would cost about $1400 00 PURCHASE Mr Code moved acceptance of the recommendation and the BLEACHERS report from the Parks Committee ETC Gordon Kesler has CARRIED FOR KEIVERS Art noted the park has been fenced off to prevent traffic running over the newly seeded grass George Crew is still hauling gravel - working today in Division 1, and then moving back to Division 2 The other GRAVEL crew is working in Division 7 and then moving to Division 6 CREW REPORT Private trucks can stay on for awhile yet It was agreed the costs incurred for private trucks must be monitored closely Yardage spread to date is Division 1 - 18,662, Division 2- 10,520, Division 3- 12,014, Division 4- 11,462, Division 5- 17,757 +, Division 6- 15,248, Division 7- 32,866+ Mr Campbell asked Oris and George to inspect the Buffalo Jump Park Road as he and Albert did not feel it was satisfactory Oris reported on prices obtained for a new one ton truck Garrett Motors - 1986 350 V8 $14,422 35 PRICES FOR Westergard Motors 1986 6 cylinder Ford $12,193.50 ONE TON TRUCK 1986 351 Ford $12,691 30 Gordon Kesler - 1986 Truck $12,230 00 J Frere & Son 1985 Truck - in stock $12,200 00 Excelsior Motors Dodge V8 360 Standard $11,972.00 Rollies Motors 1986 350 4 speed $11,200 00 price dependent on getting GM bid assistance truck on order - no delivery date as yet Gibbs Ford 1986 6 cylinder $12,500 00 1986 8 cylinder $12,995.00 Gordon Kesler has a 1985 truck in stock - price $11,750 00 After discussion Mr. Hoff moved a Committee of Harold APPROVAL TO Mueller, Bruce Hastie and Oris Rodger be appointed to PURCHASE purchase a one ton truck at a price not to exceed $14,500 00 TRUCK CARRIED Oris reported his crew is hauling rock and doing rip rap at MIS ITEMS the Haining Bridge Project, and did some work on the site for the salt shed. Mr Hastie reported a need for a culvert in the approach to Earl Hastie's home - east west road by Wimborne and it was agreed Mr Hastie and Oris should check into this matter Mr Hastie asked about the need for a five foot cement wall for the sand and salt shed and noted the contractor will have to charge extra for this as it is a change in the plans The extra cost will be about $2500 00 Keith noted he was advised the extra cost would be about $1400.00, but the extra height is requi red EXTRA FUNDS After discussion of this matter, Mr. Boake moved that the FOR SAND & Committee working on the sand and salt shed be authorized to SALT SHED spend up to an additional $5000 00 in order to complete the sand and salt shed CARRIED Original motion authorized up to $60,000 00 3 COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- Keith reported the underground fuel tank at Three Hills has been completed and the Wimborne tank should be completed today. He also noted there will have to be a light put up at the fuel tank and after discussion of this matter, Mr Hastie moved that the M D. purchase outright and install a sodium vapour light for the fuel island at the Main Shop and the light be equipped with a switch CARRIED It was noted a light will be required at the sand and salt shed also Keith reported Division 7 motor grader is down and it will be awhile before parts are available Alex Fence around radio tower site done Posts are about 21 feet apart and therefore should put some type of reflector on the wire to improve visabi11ty of the fence It was agreed this should be done There was discussion about the radio and interference on the system and Alex noted it would take tone access on M.D system to prevent this He advised will do more cemetery survey work if possible and will be putting some white posts around a fire hydrant in Huxley to prevent vehicle damage to the hydrant Mr Code moved that the Gas Co -Ops be written a letter requesting them to maintain and up -grade their gas line crossing signs on M D road allowances CARRIED Alex noted the Utility Officers Convention is set up for the week of November 18th to 22nd and he would like to attend Gulf Oil is having a meeting to review their disaster plan that same week. It was generally agreed it would not be necessary for anyone from the M D to attend the Gulf meeting this year Alex also noted there is a Safety Seminar on Waste Water li being held November 5th, 6th and 7th and asked if Robert Kennedy should attend Mr Boake moved that Robert Kennedy be authorized to attend this seminar CARRIED Norman Keith Irving accepted appointment on A S B board, he was in Airdrie recently reviewing seed plant operations, undertaking a project - spraying winter annuals, the Torrington Hutterian Brethren having a problem with coyotes, and it appears there may be a wind erosion problem in this area this winter Mr Maerz moved acceptance of the reports given by the foremen. CARRIED It is noted there were no changes made to the October wages. CARRIED 4 COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- Mr Des Carney has requested redesignation of the South half of 10- 31 -21 -4- from agricultural conservation to agriculture in order to proceed with a subdivision of the building site located on this land Mr Campbell moved first reading to by -law number 1080, this being a by -law to amend land use by -law number 1061 by redesignation of the S 112 of 10- 31 -21 -4 to agriculture CARRIED Per Boake moved that the required public hearing be held or Tuesday, November 26th, 1985, commencing at 2 00 P M , and notice of the public hearing be advertised in the local paper CARRIED Mr Jeffery read a letter from Richard Csakany of Swalwell in which he requests council grant him an extension of time in order to complete the house on property he is purchasing from the M D The property is Lots 2 and 3 in Block 10 Swalwell 7810530 After discussion of his request and noting the agreement required the house be completed by September 15th, 1986, Mr. Maerz moved that the time extension to September 15th, 1987 be granted to Mr Csakany CARRIED Mr Hoff welcomed Gwen Miles the reporter from the Capital to the meeting Mr Jeffery reviewed with Council the complaint made by Mirrel Haller of Trochu regarding the guard rails at the Schramm Coulee on SR 585 After discussion of this complaint, Mr Code moved that the Road Committee inspect the site, measure the width of the road and report back to the next meeting of Council CARRIED Mr Boake reported to council that the Thiessen Gravel pit is not for sale at this time, but he has some rocks which are available for sale at $2 00 per yard and the M D will require rocks for the Haining Bridge Project Mr Thiessen might also be interested in leasing the gravel pit next year There was discussion about this matter, and it was noted that someone may still hold a valid gravel lease on the pit Mr Campbell then moved that when any existing lease or leases on the Thiessen Gravel Pit have expired and are no longer valid, the M D would be willing to hold discussions with Mr Thiessen regarding the gravel pit. Mr 7h�r5srP� Mr Mueller moved that the Council meeting do now adjourn in ADJOURN order to hold the Development Appeal Board hearing scheduled for today at 1 30 P M CARRIED TIME 1 30 P M Mr Campbell moved that Council meeting do now reconvene, RECONVENE the Development Appeal Board Hearing having been completed CARRIED TIME 1 35 P M Ross Rawlusyk was advised of the improvements made to the A Keivers Lake Park, and he then left the meeting COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- Mr. Jeffery read a letter from Ivan Berreth in which Mr Berreth requests the M D allow him to move his radio system on to the M D radio tower He noted in his offer that terms would be negotiated, but gave no indication of what he would be willing to pay After lengthy discussion of this matter, and noting that Mr. Berreth is in the radio system business, (rents space on his existing radio tower for the Three Hills School Division radios, Reg Buyer Oilfield Service and Bruce Hannah Truck Lines & possibly others) and whether it would interfere with the M D radio system, the amount of rent normally charged for use of someone's radio tower, Mr. Hastie moved that the M D refuse the request from Ivan Berreth Sales to rent space on the M.D radio tower CARRIED Mr Peter Calder of Calder Crane Company, and George Rempel entered the meeting at this time 2 15 P M Alex Cunningham left the meeting at this time There was lengthy discussion with Mr. Calder and Mr Rempel with regard to the manner in which the gravel is being removed from the Old Torrington Pit It appears the dragline is not going down to the bottom of the pit and Mr Calder advised council he had not guaranteed he could get down to the bottom of the pit on the first cut He also advised that there is bedrock in the pit at the north end at the 10 foot level, which he cannot get through with a dragline He indicated if there was gravel not bedrock he could go down 40 feet He also indicated he could go down 40 feet with the machine set as it is, if the pile stands up and the sides don't cave in. He explained that a first cut is the material which can be taken out of the hole without material falling back into the hole He also noted where the dragline is sitting now they are running into blue clay, and wouldn't know if they were down to the bottom of the pit without mixing alot of blue clay in with the gravel meterial George noted they have set up the pump and pumping water out now. Mr Calder stated he felt all the gravel from the north end was taken out and the crane has moved further to the south George indicated the drill test did not indicate there was sand stone at the north end of the pit He also felt that if 50,000 yards of gravel is taken off the top layer, it will be difficult to get any more gravel from the second layer of the pit Mr Calder thought there should be about 15,000 yards of gravel out now, but has not measured the pile There was discussion about getting the water pumped out of the pit and the possibility of doing some levelling on the west side of the pit and making a second cut in the area (away from the sand rock) where the first cut was made George noted that if the M D does not remove the pile of gravel which has been removed from the pit away from the dragline, Mr Calder cannot get gravel at a depth of more than 16 feet . After lengthy discussion of this matter, it was generally agreed that the pit run gravel must be moved away from the excavation so that the dragline can go down to the bottom of the pit 1 IVAN BERRETH MOVE TO RADIO TOWER Senl;- DISCUSSION WITH CALDER & REMPEL RE. OLD TORRINGTON PIT f /2�w COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- Mr Calder indicated that if the M D supplied a truck and a loader to move the pit run gravel, he could get the gravel right to the bottom of the pit He noted where the dragline is sitting now is about 250 feet from the sandstone area. It was suggested that Mr. Calder continue to remove the 50,000 yards , leave the gravel and crush it next summer and then if the water cannot be pumped out a dragline be hired again to set up on the east side and remove another 50,000 yards from the area Mr Calder is presently working in The cost for renting a loader was discussed as well as the amount of blue clay which should be removed before the decision is made that the bottom of the pit has been reached It was felt that one cut two feet deep of blue clay would appear to indicate that the bottom of the pit had been reached George reviewed with Mr Calder and Council the testhole results from the pit. Mr Mueller moved that Mr Rempel be given authority to rent a loader (about a 2 to 2 112 yard bucket) to move the pit run gravel away from the dragline so that Mr Calder's operators can go deeper and remove gravel to the bottom of the pit CARRIED Mr Calder noted his machine and two men have been shut down for about 4 hours pending the discussions with council and wanted to know who was responsible for these costs Mr Calder was advised the M D would accept responsibility for the time he was shut down Mr Calder was also advised that Councillor Maerz would be checking with him every morning to monitor the work being done at the pit and the formen will also be checking the situation Mr Mueller moved to table discussions of the servicing and moving policies for the gravel crew until the next meeting of Council CARRIED There was discussion about the method of deciding on a 1985 bonus for the employees, and after lengthy discussion Mr Boake moved to table Item No 7 on the agenda until the December 10th meeting of Council CARRIED Mr Maerz moved to table the 1986 capital requirements until the November 26th meeting of Council CARRIED There was also discussion about meeting with the Foremen and it was generally felt it was taking too much time and the system should be streamlined somewhat Mr Code suggested that only imput should be received from the foremen and decisions regarding these items be made after the foremen have left Mr Code also moved the foremen come to the Council meeting at 10 30 A M instead of 9 00 A.M CARRIED 7 AUTHORITY TO RENT A LOADER TO MOVE PIT RUN GRAVEL AT OLD TORR PIT -rr'Oe l TABLE MOVING & SERVICING POLICY RE GRAVEL CREW ?1985 BONUS FOR EMPLOYEES ETC TABLE CAPITAL REQUIREMENTS -fablct� MEETING WITH FOREMEN 10 30 A M COUNCIL MEETING OCTOBER 22ND, 1985 ----------------------------- - - - - -- Mr Jeffery read a letter from C T C and they feel that C T C DEC signal lights at the Wimborne North railway crossing cannot WIMBORNE be justified They suggest the train coming from the north NORTH be limited to a 10 mile per hour speed RAILWAY After discussion of this matter, Mr Campbell moved that the CROSSING M D accept the recommendation from C T C SPrl} Mr Hastie moved that third reading be given to this by -law CARRIED at this time Mr Maerz moved that the M D Office and crews be given M D SHUT permission to shut down on Friday, December 27th, 1985, as DOWN DEC long as there are sufficient people available for emergency 27/85 snowplowing if required, and further moved that the foremen set up three different groups to be on standby during the Pu T three day holiday period CARRIED NO ANNUAL The 1985 annual donation by -law was reviewed, and after DONATION discussion Mr Code moved first reading to by -law number BY -LAW 1081, this being a by -law to make the following donations NO 1081 Salvation Army $500 00, Cystic Fibrosis Association $100 00 by IGw Canadian National Inst for the Blind $200 00 - Total $800 00 '4° ^ �- CARRIED Mr. Mueller moved second reading to this by -law. CARRIED Mr Hastie moved that third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr. Campbell moved third reading to this by -law CARRIED Mr Jeffery reviewed the need to pass a by -law to adopt the ANNUAL 1985 assessment roll for assessment and taxation purposes in ASSESSMENT 1986 Mr. Boake moved first reading to by -law number 1082, BY -LAW this being a by -law to use the 1985 assessment roll with No 1082 appropriate annual changes for assessment and taxation purposes in 1986 done CARRIED Mr Maerz moved second reading to this by -law CARRIED Mr Mueller moved that third reading be given to this by -law at this time.
