Jeffery, Municipal Administrator and Mrs. Jean Wilkiinson Assistant Administrator were also present Mr Jeffery called the meeting to order and called for nominations for the office of Reeve for the ensuing year Mr Mueller nominated Otto Hoff as Reeve for the ensuing year Mr Jeffery called for nominations a second and third time Mr Code moved nominations ceased CARRIED Mr Jeffery declared Mr Hoff elected as Reeve, he completed his oath of office as Reeve, and took charge of the meeting Reeve Hoff then called for nominations for Deputy Reeve and Mr Code nominated R A Maerz Reeve Hoff called for nominations a second and third time, but no further nominations were received Bruce Hastie moved nominations cease CARRIED Mr Hoff declared R A Maerz elected as Deputy Reeve for the ensuing year and Mr Maerz completed his oath of office as deputy reeve. A Maerz, Bruce Hastie, Robert E. Boake, Harold Mueller and J. Finlay Code J C Jeffery, Clerk or Mrs Jean Wilkinson Acting Clerk in absence of J C Jeffery CARRIED Mr Boake moved second reading to this by -law CARRIED Mr. Maerz moved that third reading be given to this by -law at thi s time CARRIED UNANIMOUSLY Mr Mueller moved third reading to this by -law CARRIED Dates to hold the regular meeting of council were then reviewed and Mr Hastie moved that the regular meetings of council be held on the 2nd and 4th Tuesdays of each month CARRIED M D banking for the ensuing year was then discussed and Mr Mueller moved that the M D carry on its banking with the Alberta Treasury Branch in Three Hills for the ensuing year and the signing officers be one of the Reeve or Deputy Reeve, together with one of the Municipal Administrator or Assistant Administrator, and that one of the Municipal Administrator or Assistant Administrator be authorized to sign the payroll cheques for employees CARRIED The rate of pay for councillors for 1986 was then reviewed and Mr Maerz moved that the 1986 rate of pay be left at $110.00 per day, the meal reimbursement rates be kept at $5 00 for breakfast, $7 00 for dinner and $9 00 for supper and the mileage rate be kept at 40 cents per mile or 25 cents per kilometer, with the meal reimbursement payable to councillors and employees while outside the M D of Kneehill on M D business CARRIED Mr Code moved that the rate of pay for attendance at the 1985 Fall Convention be as follows Actual Hotel Costs, Total Registration Fee (for husband and wife) total mileage costs from Three Hills, parking costs and per diem for councillors, plus reimbursement for meals at the rate of $50 00 per day and he further moved that Mr Jeffery and Mrs Wilkinson receive the same reimbursement with the exception of the per diem CARRIED Mr Maerz moved that the organizational meeting of the Council do now adjourn CARRIED TIME 10 15 A` M - - - -� -- -- - - - - -- - - -j�j-- - -- - - -- Reeve Muni ipaI Adm n ator 4 COUNCIL MEETING OCTOBER 8TH, 1985 ---------------------------- - - - - -- The regular meeting of the Council of the Municipal District of Kneehill #48 was held in the M D Office, Three Hills, Alberta, commencing at 10 15 A M following completion of the 1985 -86 organizational meeting of the Council The following councillors were present J Finlay Code Division 1 Otto Hoff Division 2 (Reeve) Robert E Boake Division 3 Richard A Maerz Division 4 Harold Mueller Division 5 Bruce Hastie Division 6 Reginald G Campbell Division 7 J C Jeffery, Municipal Administrator was present and Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr Jeffery advised council he had been speaking to Mr Doug Hazelton this morning and he has submitted an account for 25,000 yards of gravel crushing at $1 75 per yard, but to date had only completed 16,000 yards. After discussion Mr Campbell moved that Linden Contractors be paid for 25,000 yards of crushing at this time CARRIED Mr Jeffery noted Mr Peter Calder will be meeting with Council today to discuss removal of gravel from the Old Torrington Pit with his dragline. He would require $2 00 per yard and also advised he would sell his dragline to the M.D for $125,000 00 Mr Jeffery noted there may be a good supply of gravel to the south of the Hutterian Brethren of Valleyview building site and perhaps council should consider this possible source of gravel also Mr Peter Calder and Mr George Rempel entered the meeting at this time Mr Calder indicated he would use a 90 foot boom with a 1 112 yard bucket in order to go down 38 feet. He felt he could remove about 50 yards an hour from the bottom of the pit Mr Calder reviewed his costs and felt they would be about $875.00 per 10 hour shift, and he could not do the fob for less than $2 00 per yard and not less than 50,000 yards. He felt the work could be done now and the gravel could be crushed next spring He also noted it would be better if the M D could pump the water from the pit area. He could start the job in about two weeks. He also offered to sell his dragline to the M.D. and noted a new machine would cost about $480,000.00 His machine is a 1965 model and in good shape He also indicated it would take about 50 days to remove 50,000 yards if he ran two 10 hour shifts per day. Mr Calder was thanked for coming and he left the meeting After further discussion Mr Boake moved that the M D hire Peter Calder Crane Company of Calgary to remove 50,000 yards of pit run gravel from the Old Torrington Pit with his dragline, at a price of $2.00 per yard, with the job to be started as soon as possible, and further moved that the M D if necessary rent at least a 6 inch portable pump and sufficient pipe in order to pump the water from the pit into the Kneehill Creek CARRIED It was noted Mr Calder should be wish alot of blue clay mixed in with foremen, George Rempel, Oris Rodger monitoring the gravel material being 1 advised the M D do not the gravel and that the and Rick Vickery will be removed from the pit t f i PRESENT ADVANCE LINDEN CONTRACTORS' PETE CALDER CRANE CO OLD TORRINGTON PIT GRAVEL REMOVAL HIRE CALDER CRANE TO REMOVE GRAVEL VA COUNCIL MEETING OCTOBER 8TH, 1985 ---------------------------- - - - - -- Mr. Jeffery noted that Larry Hooper of Reimer Industries, LEND GRAVEL Three Hills would like to borrow 1000 yards of 3/4 inch TO REIMER gravel from The Schmautz Pit and would replace the gravel INDUSTRIES when he has some gravel crushed at the Linden Contractors Pit After discussion of this request, Mr. Campbell moved that FROM Reimer Industries be allowed to borrow 1000 yards of 3/4 SCHMAUTz inch crush gravel from the M D with the gravel to be taken PIT from the Schmautz Pit, and the gravel to be replaced as soon (e as Reimer Industries is able to have gravel crushed at the eV r"fo Linden Contractors Pit near Torrington REMOVE CARRIED CAVEAT Mr Jeffery then reviewed the number of yards of gravel FROM NW 5 -31 hauled on to M D roads to date and he advised council that GRAVEL the total dollars budgeted for hiring private gravel trucks REPORT has been used up Mr Rempel noted the worst roads are in Di vi s on 6 and 7 and some in Division 3. After lengthy HIRE PRIVATE discussion of this matter, Mr Hastie moved that the M D TRUCKS allot an additional $50,000 00 for rental of private gravel trucks and the pri vate trucks be kept on u n t i 1 thi s EXTRA FUNDS additional money has been expended and if the weather permits the road gravelling to continue CARRIED The meeting then adjourned for dinner between 12 00 Noon and 1 00 P M DINNER Ross Rawlusyk and Alex Cunningham entered the meeting at this time. The agenda for today's meeting was reviewed and Items #35 - APPROVE new Sand Truck and #36 - Water for the Keim Project were AGENDA added and Mr Maerz moved to approve the agenda with the addition of the above noted items CARRIED Mr Code moved approval of the minutes of the September 24th APPROVAL meeting of council , subject to correction on page 2 - MINUTES "reference to Andrews - Lowen Pit should read - Jack Lowen Pit" CARRIED Mr Jeffery read a letter from Norman Tainsh, Solicitor for REMOVE Robert and Diane Penner in which he requests the M D remove CAVEAT the caveat filed against subdivision on NW 5- 31 -25 -4 20 05 FROM NW 5 -31 acres more or less Mr Tainsh noted the subdivision has 25 -4Q been sold to Mr and Mrs. Les Toews and they have purchased 54�N A � dairy cows and a dairy quota and wi 11 be r u n n i n an intensive operation from that parcel of land They therefore G �o would be in a position to justify having the second residence on the parcel of land After discussion of this matter, Mr Boake moved that the M D remove the caveat filed against the subdivision on the NW 5- 31 -25 -4 CARRIED Mr Jeffery read an application for redesi gnati on from REDESIGNATION Gerald Haller of Trochu Mr Haller would like the NE 22- 33 -23 -4 redesignated to an agricultural district NE 22- 33 -23 -4 After discussion of this matter, Mr Maerz moved first reading to by -law 1079, this being a by -law to amend the �e M D land use by-law 1061 , to redesi gnate the NE 22- 33 -23 -4 from agricultural conservation to agriculture CARRIED 2 COUNCIL MEETING OCTOBER 8TH, 1985 ---------------------------- - - - - -- Mr Campbell moved that the required public hearing be held PUF on Tuesday, November 26th, 1985, commencing at 1 30 P M , HEI and notice of the public hearing be advertised in the local r paper CARRIED In view of conflict with the Fall Convention in November, Mr Maerz moved that the November 12th regular meeting of Council be changed to Monday, November 4th, 1985 CARRIED Mr Boake moved that Council meeting do now adjourn in order to hold a Development Appeal Board Meeting and a Development Appeal Board Hearing CARRIED TIME 1 15 P M Mr Mueller moved that Council do now reconvene, the Development Appeal Board meeting and Development Appeal Board Hearing having been completed CARRIED Mr Rawlusyk advised Council that the Town of Three Hills will be holding a public hearing this evening in connection with their new land use by -law Mr. Rawlusyk and Mr Cunningham left the meeting at this time ,n CHI REG COUNCIL MEETING TO NOV 4/85 DEV APPEAL BOARD MEETING & HEARING TOWN THREE HILLS PUBLIC HEARING Mr Jeffery reviewed the bank reconciliation statement for BANK the month ending September 30th, and after discussion Mr. STATEMENT Campbell moved approval of the statement as presented CARRIED Mr Mueller moved approval of the accounts listed for APPROVAL payment today, subject to further review by the Finance OF ACCOUNTS Committee of himself and Reeve Hoff CARRIED Mr Hoff reported he had attended the official opening of the museum in Drumheller on behalf of the M D , and noted it is very interesting Mr Boake moved to accept the report given by Mr Hoff CARRIED Mr Jeffery reviewed his report covering the period September 24th to October 8th, and various items were discussed. The Village of Torrington advise they would be willing to pay $3.00 per load for rubble dumped in the Torrington Rubble Pit After lengthy discussion of this matter, Mr Maerz, moved that the Village of Torrington be advised the M D. would allow the residents of the village to use the rubble pit if the Village agrees to pay 25% of the costs of construction and maintenance of the Torrington Rubble Pit, and the Village of Acme and the Village of Linden are to be advised the residents of their villages may use the Linden Rubble Pit if the Villages are willing to each pay 25% of the costs for construction and maintenance of the Linden Rubble Pit CARRIED Mr Jeffery reported that the Torrington Fire Department used the M D rural fire truck recently to flush the Village water tower and water lines DRUMHELLER MUSEUM OPENING J C JEFFERY REPORT RUBBLE PIT CHARGES .r ca 614 w -ta wp �.e COUNCIL MEETING OCTOBER 8TH, 1985 ---------------------------- - - - - -- Mr Jeffery requested council to consider a policy regarding POLICY grass s e e d i n di tches on roads which have been T(, RE GRASS constructed by private companies After discussion of this 6r REEDING matter, Mr Mueller moved that the M D agree to undertake Pu'( the grass seeding on roads constructed by private companies ,o ON ROADS and the companies to be charged a flat rate amount per CONSTRUCTED mile in order to recover the costs incurred by the M.D. ��" BY PRIVATE CARRIED COMPANIES Mr Code moved acceptance of the report given by Mr Jeffery CARRIED Mr Jeffery reviewed a budget comparison run and after and moving policies for the gravel discussion Mr Campbell moved acceptance of the report BUDGET by council in order to make the REVIEW CARRIED COMPARISON and Mr Hoff moved this matter be MOVING tabled until RUN Mr Jeffery reviewed the minutes from the foremens' meeting obtained from held October 7th, 1985, and various items were discussed POLICIES Fencing around the radio tower site was discussed in detail FOREMENS and Mr Maerz moved that the entire trianguluar area used for MEETING the radio tower and guy wires at the Berreth stock pile site, be fenced using a 4 wire high tensile steel wire, and FENCING a chain link fence be put up around the building and tower RADIO CARRIED TOWER SITE Mr Jeffery reviewed the accident which happened October 4th, involving Art Thomas with A -2 and another vehicle He also noted the service and moving policies for the gravel SR 806 and a letter from the County of Mountain View crew should be reviewed by council in order to make the REVIEW gravel crew more efficient and Mr Hoff moved this matter be MOVING tabled until the next meeting of council so imput may be & SERVICE obtained from the foremen regarding this matter POLICIES CARRIED CARRIED FOR GRAVEL CREW The capital items suggested by the foremen were reviewed CAPITAL briefly and Mr Maerz moved that Oris Rodger be directed to obtain prices for a new one ton truck, with standard four MS NEW ITEMS SAND speed transmission, dual wheels and a V8 or Big 6 motor, TRUCK and the balance of the 1986 capital requirements be PRICES ETC tabled and discussed at the next meeting of council CARRIED Mr. Mueller moved acceptance of the minutes of the Foremens' meeting CARRIED Mr Jeffery read a letter from Alberta Transportation with ALIGNMENT regard to the 1 ong term al i gnment of SR 582 from SR "I "' .�to OF SR 582 SR 806 and a letter from the County of Mountain View addressed to Alberta Transportation with regard to extension of the secondary designation of SR 583 into the County of Mountain View to connect with SRS' Tqf : •I "�, c There was lengthy discussion about this request and Mr Maerz moved that a letter be forwarded to Alberta Transportation outlining the status of SR 582 and SR 583 as far as the M D is concerned, the history concerning these two roads and the reasons the M D would wish to keep the secondary designation for both SR 582 and SR 583 CARRIED 4 COUNCIL MEETING OCTOBER 8TH, 1985 ---------------------------- - - - - -- Mr. Hoff advised he had discussed with Mrs. Connie Osterman, M L A the possibility of obtaining funds from the Province for Secondary road improvements should there be funds left over this fall, and Mr Hastie moved that the M D write to The Honourable Marvin Moore, Minister of Transportaiton, with copies to Mrs Connie Osterman, and Bernie Kathol, Regional Director of Alberta Transportation, asking if they would consider contributing funds towards the costs incurred for the Regehr Hill Project on SR 582 CARRIED Mr Code asked to have soil testing done on SR 841 before the road is constructed next spring in order to determine if the soil in that area would be good enough for road construction and how far the dirt would have to be hauled, or whether it would be better to haul gravel in to build the road Mr Jeffery noted that Greg Sheppard of Alberta Transportation would be willing to do this work for the M D , but Council should be aware that he is only a technican, not an engineer After further discussion of this matter, Mr Mueller moved that Alberta Transportatioan be requested to undertake this work for the M D CARRIED Mr Boake moved to table Item # 17 (Rawlyn Thiessen Gravel Pit) as he has not yet been able to see Mr Thiessen CARRIED The need to establish a list of bridge priorities for 1986 was discussed in detail and bridges which were on the 1985 bridge priority list were reviewed Mr Hastie moved that Mr Jeffery draft up a list of the 1986 bridge priorities and forward same to Alberta Bridge Branch CARRIED Mr. Smith, Shop Foreman has requested permission from council to attend the up- coming auction sale at Mainline Farm Sales as there will be some good shop equipment up for sale After discussion of this matter, Mr Campbell moved that Keith Smith, one of the mechanics, Harold Mueller and J Finlay Code be appointed as a committee to review this matter, and the committee be authorized to spend up to $5000 00 at the auction sale, if the equipment is in good shape, and is required and needed at the M D shop CARRIED It was suggested the committee would have to have a meeting prior to the sale, and determine new prices for the equipment, what equipment is actually required at the shop and a maximum amount to be bid for any individual item The road committee minutes of September 25th and October 3rd were reviewed and various items discussed Mr Mueller asked about the Bleriot Ferry Road and whether the M D would maintain it in the winter time due to the dangerous condition of the road It was noted the Road Committee had discussed the situation with Marcus Moar, father of Clint Moar who has constructed a home near the river, and Clint will be living there year round It was noted that the road can be very dangerous and has not been maintained in the winter in the past After further discussion of this matter, Mr Mueller moved that the M D will not maintain the Bleriot Ferry Road if there is any concern about the condition of the road or the safety of the M D equipment and operator going down the road and this policy will be in effect on a year round basis. I�t ' ROAD COMMITTEE REPORTS POLICY RE BLERIOT FERRY ROAD t to COUNCIL MEETING OCTOBER 8TH, 1985 ---------------------------- - - - - -- It was agreed that a copy of the above policy should be forwarded to Mr Clint Moar It was noted that various light coat surfaced roads improved this year with 1 1/2" base now have quite a sharp shoulder and perhaps should have sharp shoulder signs put up After lengthy discussion Mr Mueller moved that the M D erect sharp shoulder signs on each end of the roads in question CARRIED The Kimmel low level crossing was not completed by the farmers as previously planned and Mr Boake moved that this project be put on the Small Crew Program for 1986 CARRIED local the ICA Poi x`46 Mr Mueller noted he will require a cat and a buggy for one day in order to complete the ditch cleaning project E of 31- 31 -22 -4 The motor grader was unable to complete the job After discussion Mr Campbell moved that a buggy and cat from the main crew be authorized to complete this ditch cleaning project following completion of the Wilson Project. CARRIED Dome Petroleum has requested the M D supply them with gravel for the roads West of 7- 33 -24 -4 and West of 31- 32 -24- 4 and the company will spread the gravel on the roads After discussion Mr Maerz moved that the M D. provide Dome Petroleum with gravel for the above noted roads on condition the company spread the gravel at no cost to the M D CARRIED Mr Jeffery advised Council that Robert Kennedy was acting as a flagman on a road project recently and became involved in a dispute with a passing motorist. The motorist indicated he would lay a charge against the M D and apparently has done so. Mr Jeffery noted he instructed Mr Kennedy to lay a charge against the motorist for failing to obey the warning to slow down Mr Mueller moved to accept the road committee reports CARRIED Mr Jeffery read a letter from the Drumheller Health Unit thanking council for the rental space over the past years There was discussion about what should be done with the basement and whether any of the provincial departments might need office space.
