HomeMy WebLinkAbout1984-10-09 Council Minutes01 COUNCIL MEETING OCTOBER 9th, 1984 A regular meeting of the Council of the M D of Kneehill #48 was held in the M D Office, Three Hills, on Tuesday, October 9th, 1984, coryriencing at 9.00 A M Those present were: J Finlay Code Division 1 Otto Hoff Division 2 Robert E Boake Division 3 PRESENT Richard A Maerz Division 4 (after 9 30 A M. Bruce Hastie Division 6 Harold Mueller Division 5 Reginald G Campbell Division 7 John C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mrs Susan Friesen, representative from the Three Hills Capital Mr Hoff called the meeting to order APPROVAL Mr Boake moved approval of the minutes of the September 25th meeting of Council MINUTES CARRIED APPROVAL Mr Boake moved approval of the accounts as listed for payment today, subject to ACCOUNTS further review by the Finance Committee of Otto Hoff and Richard A Maerz CARRIED Mr Jeffery reviewed the Road Tour report of October 4th, 1984 and various items were discussed The Road Committee agree that the M D and others are in fact trespassing on Mr Ken Ferguson's land - in order to reach the gravel stock piles at the Garson Pit and recommend that Mr Ferguson be given a letter of acknowledgement of this fact There was also discussion regarding the Garson Pit and it was noted the gravel appears to be running out in the area of the teepee rings, and it was generally agreed that the M D should strip in other areas of the pit and leave that area where the teepee rings are located Mr Campbell moved that the M D mark the visible teepee rings at the Garson Pit and this area not be disturbed and stripping be continued in those areas where the rings will not be disturbed CARRIED There was also discussion about the condition of SR 837 and whether the contractors, Alberta Transportation and the M D should continue to spend money on light coat surfacing for this road as it will continue to be used as a haul road from the Garson Pit for another two or three years It perhaps should be left as a gravel road and a cash settlement be obtained from Alberta Transportation each time it is used as a haul road and when sufficient monies are available it be heavy paved It was agreed that a meeting be held with Alberta Transportation (Larry Parliament, Monty McGregor and Bernie Kathol) the contractor presently working on Highway 21 and the Road Committee to review the condition of SR 837 following completion of the contract on Highway #21, and Alberta Transportation be requested to make a committment of funds to fix the road with heavy pavement at such time as paving projects on SR 575, the Dinosaour Trail etc are finished There was discussion regarding the road West of 5, 8 & 17 in 34 -25 -4 which road appears to provide access to an oil well site The road was not constructed by the M.D. and does not meet M D standards Mr Hastie noted the well belongs to Gulf Oil, and he also noted he had his grader operator clear some brush but did not want the road built up as a blade grade, merely opened the area to allow the farmers to get through with their machinery It was agreed Gulf should be contacted and the matter discussed with them The River Hill on SR 585 was inspected again and the only real solution to the problem is construction of a passing lane and Alberta Transportation will not undertake such a project at this time Removal of the inside guard rails and construction of a turnout might be of some assistance, but it would be difficult to maintain the turnouts at these locations, and would not solve the problems It was suggested the matter be discussed with Starland at the point meting being held this month Mr Code moved approval of the RoadCcmmittee Report CARRIED Mr Jeffery then reviewed his report for the period September 25th to October 9th as follows. I: %1711 "�1�1.7 KEN FERGUSON LAND & TRESPASS GARSON PIT TEE PEE RINGS SR 837 ROAD WEST of 5 8 & 17 in 34 -25 RIVER HILL SR 585 J -C JEFFERY REPORT COUNCIL MEETING OCTOBER 9th, 1984 P 2 Alberta Transportation prefers to have low level crossings on road allowance or land owned by the M D , and therefore the M D would have to purchase land in order to improve the Frere low level crossing However this would FRERE likely be cheaper than putting the crossing on the road allowance LOW LEVEL Mr Campbell asked if Bridge Branch would supply a bridge or culvert in order CROSSING to put the crossing on road allowance and after discussion it was suggested Mr Campbell contact the land owner involved - Mr Ziegler to see if he would be willing to sell the necessary land in order to improve the existing low level crossing and the matter be discussed again Mr Jeffery then reviewed for council the situation regarding filling the OFFICE vacancy in the office Alison Reid has been offered the position but VACANCY she has indicated she would wish to continue with her assessor's training A REID at the same time and also be paid at her assessor's rate of pay of . does work for Mr Dunay Mr Jeffery also reviewed for council the pay & LORI presently been received by Lori Gales and after lengthy discussion of this GALES matter, Mr Hastie moved that Alison Reid be offered a salary of $16,000 00 per year for the office position, with this salary to take effect on January v""r lst, 1985, and the M D agree to pick up the costs for her one week's annual assessor's } training course, and Lori Gales' salary be increased to $15,500 00 effective ,:- October lst, 1984, and further that Lori Gales would be entitled to any'�� \�� salary increase for 1985 should one be granted by council v f r °r'G CARRIED a' ca A c �� It is to be noted that Alison Reid' salary of $16,000 00 will not be subject to any increase for 1985 Item Number 3 on Mr Jeffery's report was reviewed but no policy was established There was discussion regarding people taking sand from the Berreth stock SAND AT pile site and it was suggested that people should be instructed by means THE BERRETH of a sign that sand should be taken from one particular location only STOCK PILE This would eliminate possible hazards being created SITE After discussion of this matter, Mr Code moved that sign be erected at the Berreth stock pile site, advising people where//sand should be excavated CARRIED LIGHT COAT The request from Otto Hoff for light coat surfacing on the north boundary SURFACING road of the hamlet of Swalwell - about 300 yards from the Webb house to SWALWELL Penner's fence line was discussed and Mr Maerz moved application of NORTH light coat surfacing be approved as outlined by Mr Hoff BOUNDARY CARRIED ROAD Mr Jeffery advised Council that Mr B Kathol of Alberta Transportation advised there is a grant available of between $50,000 00 to $70,000 00 which he would provide to the M D for light coat surfacing of the LIGHT Three Hills East Road and council could then review with his department COAT the possibility of heavy pavement for this road in 1985 He noted the SURFACING heavy pavement should be more than 2 inches THREE HILLS EAST Council agreed to accept this recommendation and advise Mr Kathol to reserve the grant money for the M D Mr Mueller moved to approve the report given by Mr Jeffery The need for advisory speed signs on the curves on SR 806 was SPEED SIGNS reviewed and after discussion Mr Boake moved that the necessary 75 KM per hour ON SR 806 advisory speed signs be installed below the curve signs on this road \tftt,e1�<<y ,\ CARRIED at-\ GRAVEL CREW Whether the gravel crew should continue working a 12 hour day was discussed 12 HOUR and agreed they should continue until further motion of council, as long DAYS as the weather permits The condition of the road three miles wost and 2 miles south of Acme ROAD WEST has not yet been inspected by Mr Boake and Mr Campbell moved to table & SOUTH this matter until Mr Boake has been able to inspect same ACME CARRIED Mr. Hoff noted he and Mr Smith had inspected the Stahlville Hutterian Brethren FURNACE shop and the furn aces used there is a new type and heats the shop at a very AT STAHL reasonable cost He noted another shop he had inspected himself also MLLE COLONS use,-this type of furnace and it saves the owner about 300 on heating costs E r Rfr ~.J I . r •' - ILI 1 i S' A r Kati ref_. �� Ami - Ir '.r - _.:. AIIIIII ~�r I �• COUNCIL MEETING and the ventiliation in the shop is good OCTOBER 9th, 1984 P.3 Mr Smith is to get more information about this type of furnace SHOP VEN'T'ILATION and costs and there will be another report made to the next Shop & Foremen ' s meeting �` ` '. "" � yl�� 1"� Mr Jeffery asked if Council was in favour of erecting directional DIRECTIONAL signs to Drumheller via SR 575 from Highway #21 and after discussion SIGNS TO DRUM of this matter, Mr Hastie moved that Alberta Transportation be ON SR 575 requested to erect signs on #21 indicating the intersection with SR 575 if same are not already erected, but no directional or mileage signs to Drumheller should be put up CARRIED Mr Jeffery noted Alberta Power have asked if council wish to retain STREET the street light in Sharples The light was between the two elevators LIGHT IN and one elevator has been torn down and the other is scheduled to be SHARPIES removed After discussion Mr Code moved that the street light be left in Sharples until the end of December, 1984 and the situation reviewed again at that time CARRIED Mr Jeffery noted that Dome Petroleum will re- negotiate the surface SURFACE lease rental for the surface lease on 4- 3- 30 -21 -4 The lease,. TEASE rental is presently $705 00 After discussion of this matter, ,�� r,' G-30 DOME Mr Maerz moved that the M D contact Dome Petroleum and commence 4- 30- 30 -21 -4 negotiation for the 1985 to 1990 surface lease rental CARRIED Mr Jeffery read a letter from Alberta Agriculture regarding the 1984 -85 PEP GRANT Priority Employment Program and after discussion Mr Maerz moved PROGRAM to accept and file as information CARRIED The meting then adjourned for dinner between 12.00 Noon and 1 00 P M DINNER Mr Hastie did not return to the meeting at this time Ross Rawlusyk from Palliser Regional entered the meeting at this time CHANGE TO Mrs Wilkinson noted the Town of Three Hills is holding a public THREE HILLS hearing regarding a proposed change to their land use by -law to LAND USE allow for an automobile racing track within the Town's industrial BY -LAW park Mr Maerz moved to accept and file as information CARRIED Mrs Wilkinson read a letter from Palliser Regional Planning JIM PERMAN regarding Mr Jim Perman's proposed annexation of NW 15- 29 -23 -4 PROPOSED dF to the Village of Carbon and after discussion Mr Mueller moved to ANNEXATION accept and file as information TO CARBON CARRIED Mr Rawlusyk presented a by -law which he had drafted to amend the M D land use by -law to allow for auto wreckers as a discretionary BY-LAW NO use in an Agriculture district 1047 After discussion of this matter, Mr Campbell moved first reading to �r� by -law number 1047 this being a by -law to allow auto wreckers as a Tamendment TO LAND U SE discretionary use in an agriculture district O AND U CARRIED BY -LAW Mr Boake moved that the required public hearing for this by -law be held on November 13th, 1984 at 1 15 P M in the M D Council Chambers PUBLIC FARING Three Hills, and notice of the public hearing be advertised in the local paper CARRIED THREE HILLS Mr Rawlusyk advised Council that he has received a copy of the ANNEXATION report to be submitted by the Town of Three Hills to the Local Authorities OF RUARKVILLE Board concerning the proposed annexation of Ruarkville and P B 1 to the & P B I town He also noted that Palliser Regional is working on a brief to be submitted SOUTH SASK to Alberta Environment concerning the South Saskatchewan River Basin Study RIVER BASIN Mr Hastie returned to the meting at this time - 1.30 P M % Mr Rawlusyk left the meting at this time r COUNCIL MEETING OCTOBER 9th, 1984 P 4 Mr Jeffery reviewed briefly the new up -dated Trochu & District Recreation Master Plan which covers the period 1984 to 1989 and Mr Campbell noted that the plan adequately addressed issues which affect the rural communities Mr Maerz moved that the M D approve the up -dated Trochu & District Recreation Board master plan for the period 1984 to 1989 CARRIED Mr Jeffery reviewed a report showing the distribution of the MCR grants to date and what proposals have been received from the various areas for use of the balance of the grants and it appears that all areas are anticipating using all funds allotted to their area The only funds which have not been allotted would be $3300 00 which would be monies available as a result of the annexation of the additional 33 people from ID #7 These funds could be used for projects proposed by the Orkney Community Association or for Over the Hill Community and the Hesketh Community should they submit applications There was also discussion about the new 5 year grant program recently announced by the Minister of Parks and Recreation and after lengthy discussion of this matter, Mr Maerz moved that the $3300 00 not yet allotted be retained by the M D for use on projects in the 9 ?f� Drumheller Recreation Area such as the Orkney Community Association project, Over the Hill Community and Hesketh Community projects `G^ and proposals must be submitted to the M D some time prior to November 15th, 1984. CARRIED TROCHU & DISTRICT RECREATION BD MASTER PLAN UP DATE MCR GRANTS & DISTRIBUTION TO DATE ;Q("j REQUEST NOT Mrs Wilkinson read a letter from the solicitors for Mrs Audrey TO LEVY Appleyard explaining the reasons for late payment of taxes owing PENALTY by the Estate of Joe Appleyard and requesting the M D not to levy MRS. JOE the 3% penalty After discussion of this request, Mr Code moved APPLI;YARD that no exemption be allowed and the 3% penalty be imposed as t2 ! n required by the by -law 5 CARRIED Mr Code reported that the Estate of Jack Lowen wishes to purchase ESTATE JACK 143 yards of gravel from the Jack Lowen Estate gravel pit and LOWEN as this is in excess of existing policy of 100 yards to a ratepayer PURCHASE OF family, Mr Code moved that the Estate of Jack Lowen be allowed to GRAVEL purchase 143 yards of crushed gravel from the J Lowen Estate pit It is to be noted that $1914 93 is one half of the total cost overrun incurred for this project REG RES Mr Boake noted that the next Regional Resources meeting will be held MEETING in the M D Office, on October 18th, 1984 OCT 18/84 Mr Hoff noted that the CAAMD & C meeting will be held in Lacombe on CAAMD & C October 12th, 1984 and those councillors who will be attending should MEETING OCT meet at the M.D Office at 8.00 that day 12 84 CARRIED Mr. Code also noted that Mr Jack Lowen indicated to him he felt LOCATION OF the Jack Lowen Estate gravel pit was not located entirely on his THE JACK LOWEN quarter but crossed the quarter section line on to the Alex Lowen ESTATE GRAVEL Quarter and after discussion it was agreed that the M D should PIT determine the quarter section line between the two quarters in order to know who was entitled to gravel royalties from the gravel being taken from these lands COST OVERRUN Mr Jeffery read a copy of a letter from the Village of Carbon to the CARBON FIRE Carbon Fire Department in which the Village advise the Department DEPT RADIO they will reduce the cost overrun incurred for the radio tower project SYSTEM ($3829 86) by the sum of $1500 00 as the Village had received a grant PAYMENT TO from Alberta Disaster Services to assist with .improvements to the radio REDUCE OVERRUN system This would leave $2329 86 owing for the project, which amount the Department is required to pay After discussion of this matter, Mr Maerz moved that the M.D. contribute the sum of $1914 93 towards the cost overrun `spec Gbh from the grant it received from Alberta Disaster Services, which would \9 then leave $414 93 to be picked up by the Fire Department. vt �,�c� CARRIED R�L It is to be noted that $1914 93 is one half of the total cost overrun incurred for this project REG RES Mr Boake noted that the next Regional Resources meeting will be held MEETING in the M D Office, on October 18th, 1984 OCT 18/84 Mr Hoff noted that the CAAMD & C meeting will be held in Lacombe on CAAMD & C October 12th, 1984 and those councillors who will be attending should MEETING OCT meet at the M.D Office at 8.00 that day 12 84 L i do C COUNCIL MEETING OCTOBER 9th, 1984 Mr Mueller asked for clarification regarding the policy for general land damages and same was explained There was also discussion concerning compensation being paid for borrow pits for road projects Mr Mueller noted Mr John Frere had asked about traffic signs on the Finn Hall Road - between Section 20 and 21 in 32 -24 -4 There is a hill dust to the south of the intersection of this road with the east -west road and there is a yield sign which requires the traffic coming from the south to yield to the east -west road Mr Frere felt there should be either a stop sign and a stop ahead sign installed as the vision is very poor Traffic comes over the hill right in to the intersection. After discussion it was agreed Mr Campbell should inspect this location and report back to council with his recommendations regarding signing Mr Jeffery noted that Pan Canadian have si- "dthe necessary agreement accepting responsibility of texas gates which they have installed on the road East of 21 and 26 in 33 -23 -4 However they have never requested permission from the M D to up -grade the road and the road they did construct does not meet M D standards for a type 3 road After discussion of this matter, Mr Boake moved that Pan Canadian be advised the M D will waive its requirements for construction of a type 3 road at this location at this time due to the swampy nature of the land on condition that Pan Canadian will accept responsibility of up- grading the said road to a type 3 standard should the M D require this up- grading at any time in the future CARRIED Mr Campbell then moved first reading to by -law 1048, this being a by -law to authorize installation of texas gates on the road East of of 21 and 26 in 33 -23 -4 as indicated on plan attached to and forming part of the by -law CARRIED Mr Code moved second reading to this by -law P 5 TRAFFIC SIGN FINN HALL RD RUN. 31 11 4 BY -LAW No 1048 & ROAD CONSTRUCTION. CARRIED Mr Maerz moved that third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr Boake moved third reading to this by -law.
