Weight Order 84 -D-1 41 Report on Meston Project re: Inspection August 13, 1984 42 J C Jeffery's Report is COUNCIL MEETING August J4, 1984 The Regular Meeting of the Council of the Municipal District of Kneehill #48 was held in the Municipal District office in Three Hills commencing at 9 00 A M on Tuesday, August 14, 1984 The following persons were present J Finlay Code Division 1 Otto Hoff Division 2 Robert E Boake Division 3 Richard A Maerz Division 4 Harold Mueller Division 5 Bruce Hastie Division 6 Reginald Campbell Division 7 J C Jeffery, Administrator Mrs Susan Friessen, Representative for the meeting. from the Three Hills Capital Mr Hoff called the Meeting to order After a brief discussion, Mr Robert Boake moved the minutes of the July 24th meeting be approved APPROVAL OF Carried MINUTES The Adminis trator reported that the Accounts were not ready yet APPROVAL OF Mr Harold Mueller moved the approval of accounts subject to the Committee ACCOUNTS of R A Maerz Otto Hoff who will likely sign the cheques on Thursday Carried The ADministrator reviewed the Financial Statement to the end of July 1984 He stated the net balance at the end of the previous month was $772799 88 Receipts for the month $253,382 86, Interest received $6117 74 Sub FINANCIAL Total $1,032,348 Less disbursements $980,957 07 a Bank correction from June STATEMENT $124 25, Net balance at the end of the previous month $51,219 16 Mr R G Campbell moved the approval of the July Financial Statement Carried The Administrator gave a report regarding the Meston Development in that he and Mr Mueller had done an inspection August 19, 1984 and noted that reflecting back to the pictures and evidence # 2 and #3 had been removed Some more MESTON articles were hauled in South of #6, a blue and white Trailer was hauled in DEVELOPMENT North of #11, #19 has been removed, #20 & #21 are partly dismantled, and the balance of the developments are still there After discussions, Mr Bruce Hastie moved the Administration take the necessary steps including Court Action to remove the Units according to the Development Board Hearing on the Meston Development Carried The Administrator read a letter from the Alberta Association of Municipal Districts and Counties regarding Convention Call stating the Convention will be held on the 19, 20, 21 22 23 of November 1984 in Edmonton, and that the Reeve's CONVENTION meeting will be November 19th at 3 00 in the Gallary Room #1 Terrace Inn CALL After brief discussions Mr Robert Boake moved that all Councillor's be named as delegates with Mr Jeffery as an optional Delegate if any Councillor should fail to go to Convention Carried The ADministrator read a letter from Employment and Immigration Canada the Employment Insurance Commission advising that we were no longer eligable for the 1985 Premium reduction as our Group Insurance Plan does not require all Employees to become eligable for benefits after three months or less of NO U I C Employment After brief discussion which was noted that Council does not PREMIUM REDUCTION want to change the existing Contract with Employees, Mr Finlay Code moved 1985 to accept and file the Correspondence Carried The ADministrator then referred to Correspondence from the Alberta Assessor's ASSESSMENT OF Association which asked Council whether they approved or did not approve of RESIDENCES the Assessment of all Residences without any exemption After a brief discussion Mr Reginald Campbell moved that we advise the Assessor's Association that we approve of the assessment of all Residences with no exemptions Carried The ADministrator read a letter from the Drumheller Health Unit asking for our consideration of a by -law allowing them permission to build a new building The Administrator reported that the Health Unit had a surplus of approximately $225,000 which would be likely the new cost of the new building The Doctor of the Health Unit has stated that the building is going to be approximately ✓/ 33 to 35 hundred square feet and the building is needed mostly for the expansion of the Home Care Program He stated the Town had given the Health Unit a lease on the land for a dollar for 99 years and he stated the major Page 2 objection to our Office is the problem with Handicapped people entering the Office regarding the stairs After lengthy discussion Mr Bob Boake moved First reading to the by -law # lo y:> 04, DRUMHELLER HEALTH Carried Mr Harold Mueller moved second reading to the By -law UNIT NEW BUILDING Carried Mr Reginald Campbell moved that this by -law be given third reading today The Motion was not passed unanimously and therefore defeated Mr Bruce Hastie moved to table the third reading to the next meeting Carried The Engineering investigations of the Kneehill Creek Project were then referred to briefly After brief discussion Mr Finlay Code moved we hold a meeting KNEEHILL CREEK with Alberta Environment and the Ratepayers sometime in late October or early DAM November to have the Ratepayers air their concerns on the Dam proposals or systems of Cate. Basins or Dugouts Carried The Administrator reviewed the new population affidavit making the Municipalities total population of 6414 which includes the 620 people from Prairie Bible Institute and the additional 33 people from I D #7 and a request from M C R POPULATION Terry Vaughn from Alberta Parks and REcreation to allocate those students ALLOCATION Mr Reginald Campbell moved the 33 people from I D #7 be allocated to Drumheller area for the use of Orkney,Churchill and Hesketh Community Organizations Carried Mr Harold Mueller moved that the 620 students be allocated to the Three Hills Population and also that Mr Terry Vaughn be urged to have a meeting very shortly with all the Towns and Villages in the Municipal District to make sure the M C R dollars are wisely spent Carried The ADministrator advised he'd been talking to Mr Monty McGregor on August 8/84 Mr McGregor advised him that the Prairie Bible Institute paving of 6th Avenue P B I would likely come next year as they are considering sidewalks and gutters to PAVING be included along with the paving Mr McGregor advised this decision is not finalized yet but is only likely at this point Mr Bob Boake moved to accept - and file this information Carried Brief discussion took place regarding the Minutes of July 24 and the fact that RIPPER the Ripper Bids were not accepted at that time After discussions Mr Finlay SALE Code moved we sell the Ripper to the Hutterian Bretheran of Starland for $2000 00 Carried The contact person at the Hutterian Bretheran of Starland is Dave Mr Standish of Tri Eagle Security entered the Meeting at this time approximately 11 05 A M After brief discussions concerning the intecrecies of the DOG CONTROL agreement and referring to the various items in the by -law also discussions TRI EAGLE with Mr Standish on what his actual Company's practice is in relation SECURITY to Dog Control, Mr R A MAERZ moved that the Reeve and Administrator be authorized to sign the agreement to enter into a Dog Control Contract with Tri Eagle Security for a period of six months Carried The Administrator was also advised to draw up a Schedule A for next meeting Mr Standish left the meeting at approximately 11.30 A M The 1984 Ditch Cleaning Program which was tabled from July 3rd was referred CCE/�NINGCH to briefly Mr R G Campbell moved that this program be tabled until the PROGRAM TABLED last meeting in September, 1984 Carried The ADministrator read letters from several Towns and Villages requesting PUBLIC TRANSP grants from the Alberta Transportation Operating Assistance Grant After OPERATING brief discussion, Mr Bruce Hastie moved to table the correspondence and ASSISTANCE that a letter be written to all Town and Villages to ask them what possible GRANT expenses they might incur this year, those returns to be in by a maximum of one month Carried The ADministrator referred who owns the S E 13 32 26 purchase the road diversion of his property Mr Harold Road Committee has a chance Carried briefly to some Commrespondence from Mr H Schmidt W4 and the fact that Mr Schmidt would like to ROAD DIVERSION on Plan 3235BZ 0 89 acres which would form part SE 13 32 26 W4 Mueller moved that this be tabled until the to check into the facts The Administrator reported that the J Malaka Road project in Section 29 & 30 MALAKA GRADE in 31 -24 -W4 has now been surveyed and is ready to go After brief discussions BLADE Page Mr R A Maerz moved that the Malaka project be added to the 1984 Small Crew Road Program as it would require probably a Buggy and a Crawler to help build this Grade Blade Carried The ADministrator was asked to check into the Hesketh Light Coat Surfacing to see if it should be patched or perhaps redone He was also asked of check wit Mr, Robin Arthurs, our Surveyor regarding the Hastie Project to see if the Survey was completed so the land buying could be finalized Brief discussion took place regarding the Kimmel Bridge in the SW 3 31 26 W4 in regards to the low level crossing and Mr R G Campbell moved that the LOW LEVEL CROSSING MUnicipal District supply enough 18'' or 24'' culvert to enable Councillor SW 3 31 26 w4 Boake to construct a low level crossing using volunteer help Carried Brief discussion took place about the possibility of putting Calcium Chloride on the North Boundary streets in Swalwell After discussions Mr Otto Hoff. CALCIUM CHLORIDE moved that if there was Calcium Chloride left over that the same be applied SWALWELL on the North Boundary of Swalwell to the foot of the hill Carried Mr Hoff also advised he would let Council know regarding the Swalwell paving next meeting The Administrator read a letter from Mr Bernie Kathol of Alberta Transportation advising us as follows a)Secondary Road #583 Mr Kathol suggests that we continue to patch this road for the next few years and the Department will monitor the condition of this Secondary with the view of projecting a pavement overlay in his future programs b)Secondary Road #575 final paving on Hesketh Kirkpatrick base coarse will be ALBERTA completed this season TRANSPORTATION c)Buffalo Park Road Alberta Transportation Staff will undertake a preliminary Survey on the last 44 miles this year to determine what work might possibly be done This project would be possibly included in the 1985 Road Program d)Highway #27 Junction #836 to the Red Deer River - grading reconstruction on this Road is expected to be completed this Season and e)Highway #21- Reconstruction of Three Hills to Trochu section is underway and Right -of -way acquisition is underway from Trochu North This project may be tendered later this season Mr Harold Mueller moved to accept and file as information Carried The ADministrator read a letter from CP Rail advising us of their Rail Ballast Program on the Langdon Subdivision from Acme going East in which they will be raising a lot of the crossings up to 10'' The Administrator reported he CP RAIL BALLAST advised CP Rail that they must repair any damages they incurred as we would PROGRAM have no manpower available Mr Bruce Hastie moved to accept and file as Information Carried The Administrator reported that the Assessor's had found a Road Diversion on the SW 1 29 21 which had never been registered although it appears that ROAD DIVERSION the quarter section only has 157 Acres Mr Finlay Code moeved that the SW 1 29 21 file be turned over to Mt Robin Arthurs and if the Road Diversion is not surveyed for him to go ahead and survey and take from Title which would likely need an agreement from Mrs Jutras Carried The Administrator read a letter from Alberta Transportation, the Honorable ALBERTA Marvin E Moore, which Mr Moore advised us he is sending a Survey Crew to do TRANSPORTATIOP the Eastly 4 25miles of the Dry Island Buffalo Jump Park Road but in his letterDRY ISLAND Mr Moore also stated he was not in a position to confirm the time of the BUFFALO JUMP grade reconstruction as it will be dependant upon the assessment of overall U'� ROAD Provincial priorities and budget availabiliy Mr R G Campbell moved to accept and file this information Carried The ADministrator gave a brief report on an Accident between Mr Jim Davidson driving Mr Harold King's vehicle which had hit our Motor Grader with Brian DAVIDSON- Bauman being the operator he Adminis..trator advised that our Insurance v BAUMAN would not cover the cost of the repairs as it was under $1000 00 deductable ACCIDENT and further that Accurate Auto Body had billed us for $558 60 After brief discussion Mr Robert E Boake moved that the parties involved be advised that we accept no responsibility for the Accident Carried The ADministrator reported that Mr Lawrence Vasselin had been in the Office to see him regarding permission to run a 6'' water line through a 24'' Culvert ✓ on the South of the SW 27 30 23 Mr Vasselin advised it would be very Page 4 temporary only and would be for pumping from the creek to a dugout for a two week period after Spring run -off and after Harvest. Mr Vasselin VASSELIN WATER further advised he Would have a licence from Environment later on and PIPELINE that he required a letter of permission to Environment Mr R G Campbell S of SW 27 30 23 moved that Mr Vasselin be given a letter of permission as long as he will sign our Save Harmless Agreement with us regarding any accident on this or any possible future accidents in this site Carried The ADministrator read a letter from Mr John O'Brien, Alberta Transportation 1985 Bridge Branch regarding 1985 Bridge requests Mr. R A. Maerz moved to BRIDGE REQUESTS table to the next meeting Carried A letter was read from Alberta Labour regarding the ventilation in the SHOP VENTILATION existing M.D Shop Parcel A Plan 5392SK Three Hills After brief discussion of all areas of the letter, Mr Harold Mueller moved that Mr K J Smith supply a point by point price on the Alberta Labour suggestions along with checking Courtney Berg Industries and Three Hills Collision and Paint buildings for possible suitable renovations Carried A letter was read from the Palliser Regional Planning Commission concerning the proposed Subdivision NW 25 28 23 Sharp Farms Ltd and it was noted that SHARP FARMS Mr. Alex Cunningham had inspected this site and had approved the location NW 25 28 23 of the approaches After brief discussion Mr Otto Hoff moved that a letter of final approval be sent to Palliser subject to checking the Taxes having been paid Carried A further letter from Palliser regarding the proposed subdivision on BALDERSON NW 8 29 24, Earl K Balderson is was noted Mr Alex Cunnungham had NW 8 29 24 approved the approaches Mr Otto Hoff moved the approval of the Subdivision subject to the Taxes being paid ` Carried A final letter from Palliser being the proposed Subdivision Lot 1 Block 5 CHAMBERLAIN Plan 7810405 Arthur J. F Helen M Chamberlain After brief discussion LOT 1 BLOCK 5 Mr. R.A Maerz moved we recommend approval of this Subdivision subject PLAN 7810405 to normal conditions Carried The Administrator referred briefly to a Draft Paper named ''The Preferred PRAIRIE ASSOC Future Speaking for Our Share of the Water Resources in the Red Deer WATER MANAGEMENT River Basin'' After brief discussion Mr Robert Boake moved to accept v and file the copy and a copy of the draft to all Councillors Carried. The ADministrator read a letter from Mr Julian Koziak, Minister of Municipal Affairs regarding a copy of a White Paper proposals for a Industrial and Science strategy for Albertans 1985 to 1990 WHITE PAPER FOR After a brief discussion Mr Finlay Code moved that all Councillors STRATEGY FOR read the White Paper and be passed starting with Mr Robert Boake, r and to accept and file the information ALBERTANS Carried A letter was read from the City of Drumheller stating their hosting of ECONOMIC DEVELOPERS the 1984 Economic Developers of Alberta Conference November 3,4, & 5 CONFERENCE and asking for a donation of $75 00 After brief discussion, Mr Harold Mueller moved to accept and file Carried A letter was read from the Village of Carbon regarding the proposed VILLAGE OF CARBON annexation of NW 15 29 23 James R & Carol L Permann who own 7 3 V ANNEXATION acres After a brief discussion Mr Finlay Code moved that we have no PERMANN objection to the proposed annexation Carried The Administrator read a letter from the United Transportation Union UNITED regarding the CN & CP Railways running trains without Cabooses ✓ TRANSPORTATION After brief discussion Mr R G Campbell moved to accept and file UNION Carried A letter was read from the County of Wetaskiwin #10 regarding a RESOLUTION resolution on Scentless Mayweed After discussions Mr Harold SCENTLESS Mueller moved that we support this resolution at Convention and MAYWEED let the County of Wetaskiwin know that we will be supporting Carried A letter was read from Mr Lloyd Krisdale, Deputy Minister of Hospitals and medical Care to the Drumheller General and Auxiliary Hospital and Nursing Home District #3 in which the Deputy Minister advised that the 1984 Requistion of the Drumheller General and Auxiliary Hospital-Nursing Home District #3 in the amount of $25,000 00 was not acceptable and therefore not approved by the Minister Brief discussion followed and it was noted we would have to advise the Auditor as we have already requisitioned this amount After the discussion, Mr R G Campbell moved to accept and file Carried A letter was read from the Alberta Electoral Boundaries Commission, Mr Kenneth Waurk, noting that Public Hearings on the Boundaries Commission were comming up on August 29 at 2 00 in the Capri Centre in Red Deer and the same day at 7 30 P M in the Palliser Hotel in CAlgary After discussions Mr Otto Hoff moved that Mr Finlay Code be authorized to attend the hearings on our behalf Carried The ADministrator read a letter from the Central Alberta Association of Municipal Districts and Counties, Mr John Mountgomery, advising us that the Director's meeting will be held in our Office in Three Hills August 24, 1984 commencing at 1 30 P M Mr Robert Boake moved to accept this CArried The Administrator advised he'd been in contact with Mr Jack Edworthy of Jubilee insurance and that Mr Edworthy advised him that our Master Policy could handle all of the Rural Community Centres at the rate of 25 5 cents per $100 00 replacement cost After discussions Mr Harold Mueller moved that all Community Centres bewritten and asked if they are interested in the proposed coverage and if so to send in their buildings and contents values as soon as possible Carried r Page 5 DRUMHELLER REQUISITION CANCELLED ALBERTA ELECTORAL BOUNDARIES COMMISSION C A M D & C DIRECTOR ''S MEETING AUGUST 24, 1984 RURAL COMMUNITY CENTRES INSURANCE THROUGH JUBILEE The Administrator read a letter from the Three Hills Progressive THREE HILLS PC Conservative Association regarding the proposed new Electoral ASSOC ELECTORAL Boudaries After discussion Mr R A Maerz moved to accept and file BOUNDARY CHANGES Carried A letter was read from Mr Marvin Moore, Minister of Transportation advising the Provincial Government had revised the Motor Transport ALBERTA TRANSPORTATII REgulations to allow a tolerance of 1000 kg (2200 lbs) to be permitted NEW WHEAT TOLERANCE over the legal axle load on each axle of the hauling vehicle and in addition the tolerance allowable Gross vehicle weight is increased from the present 5% to 15% and to a maximum 2000kg (4400 Lbs) After discussions Mr R G Campbell moved that the tolerances set out under Section 3 (4) of the Motor Transport Board Wheat Order 84 -D -1 are in effect in the Municipal District of Kneehill #48 Carried And further that the Highway Patrols be advised The ADministrator then read his Report Dated July 24 to August 14, 1984 Discussions were then held on how to handle Salesmen and /or POLICY ON Engineers when they wish to come in to speak to Council After SALESMEN discussions, Mr R A Maerz moved that there be no Sales person allowed in Council time and also tocancel the appointment for Alpine Engineering ✓ It was agreed by all Councillors thatthey would rather see Salesmen on their own time rather than during Council time Carried The Administrator reported that Mr Harold Mueller would like to change his Andrews project to possibly ditch cleaning projects because of J C J REPORT problems encountered with buildings too close to the road there AFter discussion, Mr Harold Mueller moved that the Small Crew rotation from now on be Division #4, Division #6, Division #7 and finally Division #5 Carried Mr R G Campbell reported that he had to extend a couple of Culverts at the Louma property After discussion, Mr Bruce Hastie moved that this be authorized Carried Mr Mueller reported that the King hill was in very bad shape He didn't know whether to patch it or rip it After brief discussions Mr R G Campbell moved that a committee of Mr Harold Mueller, Oris ✓ Rodger, George REmpel make a dfcision on how to repair the Kinq Hill Carried yl Page 6 After more brief discussion Mr R G CAMPBELL moved the acceptance of the Administrator's Report ° Carried The ADministrator reported an agreement involving no dollars had been signed ROAD regarding the Road Diversion on NW 18 28 21 and the SW 19 28 21 in which DIVERSION the Road Diversion is Surveyed differently from what the road is actually NW 18 & SW 19 built After discussion, Mr Bruce Hastie meved that the actual road be ,/ 28 21 surveyed as is, and cancel the road diversion and return to Title Carried Brief discussions were held concerning the Road Committee Report of ROAD COMMITTEE August 1, 1984 Mr Robert Boake moved approval of the Road committee AUGUST 1/84 report and also that the Grade slipping at the Paul Frere farm be added to the Small Crew's work load Carried A brief discussion was held concerning the Policy review Mr R A Maerz POLICY REVIEW moved totable to the first short agenda r Carried Mr Harold Mueller and Mr R A Maerz gave an interesting Report on the PROV A S B Provincial Serivice Board Tour held in Athabasca After brief discussion TOUR Mr HOff thanked Harold and Richard for their report Mr Hoff gave a brief report on the Incineration meeting held in Trochu INCINERATION Brief discussions followed which would seem that the Incineration SYSTEM system sould be approximately the same cost as the Landfill system we are currently in No decisions were made Several Councillor's then gave Reports as follows a) Wimborne Store - The Administrator was asked to check out the Tax situation b) Stop Sign reported down on South Huxley Road where South Huxley Road meets #8o6 c) The Administration was advised to get with Gulf oil regarding the South Huxley Road and damage they had done with their water truck d) Speed limit sign was down on the South East Carbon Road on the West side fo the road approximately 1/8 mile south of the Bridge w right at Carbon Mr Otto Hoff moved the meeting adjourned at 5 10 P M Carried i REEVE A I STRATOR J C JEFFERY REPORT - July 24 - August 14, 1984 I Agreed to send one Truck and one man for one day to Hanna to help work on New Palliser Regional Planning Commission Building will be donation to help defray building costs - approved by Otto Hoff 2 Sales Pitches - how Contract on #575 4 Alberta Transportation are doing Preliminary Survey on 44 miles East of Huxley Hutterites on Buffalo Jump Road 5 Harold Mueller Project near Andrews - Ken Thompson advises would likely take minimum of two weeks and probably more than three weeks to complete 4 mile project from North of Andrews house South through the Coulees 6 Doug Hazelton moving over to Sundre for approximately three weeks and then back to Linden Pit. 7 Tony Hopkins advises .jaw crusher for Garsons would be $2 50 per yard which is approximately 50� per yard over the conventional price of $2 00
