HomeMy WebLinkAbout1984-06-12 Council Minutesi COUNCIL MEETING JUNE 12th, 1984 A regular meeting of the Council of the Municipal District of Kneehill 448 was held on Tuesday, June 12th, 1984, in the Municipal District Office Three Hills, commencing at 9 00 A M Those present were Otto Hoff, Division 2 (Reeve) Robert E Boake Division 3 PRESENT Richard A Maerz Division 4 Harold Mueller Division 5 Bruce Hastie Division 6 (after 1.00 P M ) �' Reginald G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Jack Benedict, representative Three Hills School Division after 1 00 P M Mrs Susan Friesen,representative from the Three Hills Capital APPROVAL Mr Maerz moved approval of the May 22nd and May 29th minutes MINUTES of Council CARRIED Mr Jeffery read a letter from AUMA regarding the possibility AUMA CONCERN of AUPE attempting to unionize all local government employees. RE AUPE ATTEMPT This is a concern as AUPE now control all provincial government TO UNIONIZE employees and could effectively control all government employees LOCAL GOVT if it succeeded in its attempt to unionize local government employees Mr Jeffery noted there is a seminar scheduled to discuss this EMPLOYEES matter - June 28th, 1984 in Calgary It was suggested that a resolution should be passed by council to protect this action and after discussion Mr Campbell moved that the Council advise the government that the scope of any bargaining agent given s exclusive jurisdictional rights by the government be restricted from organizing employees outside of their exclusive franchise, or in the alternative that no union be given exclusive jurisdictional franchises, and that any employees, including provincial government employees be given freedom to be represented by any union of their choice, or the right not to be unionized at all CARRIED It would agreed that Mr Hoff, Mr Boake and Mr Jeffery should attend the seminar in Calgary on behalf of the M D i J C JEFFERY Mr Jeffery gave his report covering the period May 22nd to REPORT June 12th. He noted the M D of Starland is not going to hold an auction sale now as insufficient equipment was consignedfor the sale After discussion concerning disposal of the old equipment Mr Mueller moved that the M D advertise the used equipment ✓A DISPOSAL for sale in two issues of the Capital, the Drumheller Mail and USED the Red Deer Advisor and if not sold the equipment be placed EQUIPMENT in an appropriate auction sale CARRIED Mr Jeffery reported that the M D gravel truck involved in GRAVEL TRUCK the recent accident on Highway #9 was quite severely damaged and ACCIDENT will cost about $18,000 00 to repair ,� Mr Boake moved approval of Mr Jeffery's report CARRIED Mr Jeffery read a letter from Alberta Municipal Affairs concerning proposed divisional boundary changes The government will wait DIVIS to see the results of the proposed annexation of Ruarkville and BOUNDARY P B.I. to the Town of Three Hills, but wish to have the boundary CHANGES changes in place prior to the 1986 election It was agreed that council should review the proposed boundary chnages again soon There was discussion concerning the proposed annexation of Ruarkville PROPOSED and P B I to the Town of Three Hills, and it was noted MPH- ��/' P B I FUEL TENDER Mr Jeffery noted that the contract with Esso had not yet GULF BETTER been signed as Gulf Canada had conta tedie office and PRICE indicated the saving for diesel fuel ;was considerably higher than that offered by Esso - approximately $15,000.00 per year Gulf also offered a discount on oil After discussion of this matter, Mr Maerz moved that the M D rescind its previous u motion to purchase its gas and diesel fuel from Esso for the period July 1st, 1984 to December 31st, 1984 and purchase the gas and diesel fuel from Gulf Canada in Three Hills for the six month period in question , and continue to purchase oil and grease from Esso Resources in Three Hills CARRIED BACK UP ALARM Mr Jeffery reviewed prices obtained for purchase of back up PURCHASE FOR alarms for M D. equipment - total cost will be about $1700 00 TRUCKS Old school buses and one ton trucks or less do not require alarms After discussion of this matter, Mr Mueller moved that the M D proceed with purchase and installation of the required back up alarms CARRIED It was agreed that Keith should review the difference in prices i for the actual alarms ' NORCEN ENERGY Norcen Energy has requested permission to up -grade the road West of 16 and 21 in 29 -21 -4 (Loewen Pit Road) and wonder what assistance they might expect from the M D to assist with construction of PERMISSION this road as a lot of dirt will have to be moved There is one TO UP -GRADE mile of road involved After discussion of this matter, Mr ROAD Campbell moved that the company construct the road and the M.D agree to supply all culverts, regardless of size required, and 3/4" crushed gravel for the road surface and the company submit a breakdown of W 16 & 21 VA the costs incurred for the road construction and council may at that time consider some cash assistance toward these in 29 -21 -4 costs CARRIED ke� 4"r 1,ei\'f' It was agreed the road should be a type three and the company should be sent a copy of the M D road construction standards BRIDGE FILE 6571 Mr Jeffery read a letter received from Alberta Bridge Branch SSW 26- regarding bridge file 6571 SSW 26- 31 -26 -4 - bridge near Sunnyslope 31 -26 It appears the bridge is in reasonably good condition and the bridge branch propose some repairs and some rip rapping will also be required After discussion Mr Boake moved to accept and file la'. the letter as information and advise Bridge Branch the M D will assist with hauling the necessary rip rap when required, and will install the necessary bump sign. NEED FOR I _Mr Jeffery read two letters from Jubilee Insurance concerningADDITIONAL the possibility of obtaining more liablity insurance After LIABILITY discussion of this matter, Mr Maerz moved that the M D not INSURANCE request the extra coverage offered ✓\ CARRIED The minutes from the Parks & Cemeteries meeting held PARKS MEETING May 29th were then reviewed and the park committee recommend MINUTES the M D purchase a 2000 gallon tank for use as a sewer dump SEWER DUMP station at Keiver's Lake Park. After lengthy discussion of STATION this matter, the size of tank which might be required, and whether AT KEIVERS the portable toilets might also be up- graded, the costs which LAKE would be incurred to pump out the tank and toilets every week and other items, Mr Boake moved that the installation of a sewer dumping station at Keiver's Lake Park be tabled and the Aer\.`b matter be discussed again in April of 1985 CARRIED HUXLEY Mr Jeffery left the meeting at this time and Mrs Wilkinson MAINTENANCE advised council concerning the need to amend the Huxley Sewer BY -LAW Maintai.nance by -law number 918 in order to include a new parcel SEWER of land which has been developed and is being served by sewer BY -LAW NO After discussion of this matter, Mr Campbell moved first reading 1041 to by -law number 1041 this being a by -law to amend by -law 918 hj� s "vJ by changing schedule A to add an additional 100 feet of frontage to be charge on First St S (North Si.de)from Railway Avenue to 350 feet East on Queens Avenue - total footage on that street to be 710 feet, CARRIED Mr Boake moved second reading to this by -law CARRIED Mr Mueller moved that third reading be given to this by -law at this time CARRIED UNANIMOUSLY Mr Maerz moved third reading to this by -law CARRIED DATE FOR Mrs Wilkinson advised council it will be necessary to hold court CT OF of revision for business tax appeals and Mr. Campbell moved that REVISION the court of revision be held on Tuesday, June 26th, 1984 at 10 00 A M v` CARRIED Mrs Wilkinson reported that Council could now take clear title BRODIE if they so wished to the Barry Brodie property in Swalwell - Lots PROPERTY 25 to 31 in Block 4 as the required one year from date property SWALWELL TAX RECOVER' i COUNCIL MEETING JUNE 12th, 1984 P 4 was offered for sale at public auction has expired u Mrs Wilkinson noted the reserve bid established for the auction sale was $2800 00 and further noted that '(o an offer was received some time ago to purchase two of the lots After discussion Mr Maerz moved that the M D proceed to obtain clear title to Lots 25 to 31 in Block 4 Plan Swalwell at a price of $2800 00 CARRIED Mr Jeffery returned to the meeting at this time He advised council that Mrs Susan Toews had called him DAM T0O CLOSE regarding the dam located on Pt 15- 31 -25 -4 and she advised TO ROAD they had only removed about 6" of dirt by levelling the bottom Pt 15-31 - of an existing depression (or slough) to allow easier access 25 -4 for cattle to the water She also noted it likely will be dry by mid summer � Qct�� After discussion of this matter, Mr Maerz moved to accept and file the report given concerning this matter CARRIED Mrs. Wilkinson noted that Councillor Code had requested a GLEN letter be sent to Mr Glen Grenier concerning the destruction GRENIER by Mr Grenier of portion of M D roads adjacent to SW 22 -29 -21-4 DESTRUCTION After discussion of the matter, Mr. Hoff moved that the Road M D ROAD Committee have a look at the situation and discuss the matter with the divisional motor grader operator and report back to j council as to whether Mr. Grenier should be billed for costs incurred to repair the road I CARRIED FALL Mrs Wilkinson reported that the Fall Meeting of CAAMD & C MEETING will be held on Friday, October 12th, 1984 at Lacombe .,. CAAMD&C Oct 12/84 Mr Maerz moved to accept and file as information. CARRIED Mr Maerz moved that item number 18 - review of grants for TABLE rural community organizations be tabled until the next meeting REVIEW of Council COMM ORG. CARRIED GRANTS Mrs Wilkinson read a letter received from J D Mollard and GRAVEL Associates regarding the gravel search conducted by his SEARCH firm and after discussion it was agreed that Mr Rempel J D and Mr Jeffery should review the report in more detail and MOLLARD , have the backhoe testing done as recommended and further , that the testing on the McGuggin Riep land also be undertaken CARRIED Mr. Michael Welsh, Solicitor from Edmonton entered the meeting M WELSH at this time and discussed various items with the Council IN Mr Mueller moved that the council meeting do now adjourn for dinner and the meeting reconvene later this afternoon following ADJOURN completion of the development appeal hearing scheduled for 1.00 P M this afternoon CARRIED RECONVENE Mr Boake moved that Council meeting do now reconvene - 3 05 P M as the Development Appeal Board hearing has been completed `� CARRIED Mr Boake asked for permission for first time gravel on the Gary FIRST TIME Klassen Road - east and south of Linden - which road was GRAVEL built this year by Mr Klassen After discussion Mr Campbell E 20- 1 moved that first time gravel be applied to the approximate 1000 30 -25 -4 feet of newly constructed road east of 20- 30 -25 -4 CARRIED COUNCIL MEETING JUEN 12th, 1984 p 5 Mr Hastie moved approval of the accounts listed for payment today, subject to further review by the finance committee of ^ Otto Hoff Mr Jeffery reported the foreman of the main if the M D should be paying the total costs moving the Crossroads gas line on the Hastie and after discussion of the matter with the it was agreed the payment was satisfactory CARRIED crew wondered incurred for Bridge Project councillor involved Mr Hastie reported the crew is now working north of the bridge and the bridge will be moved likely Monday It will be necessary to dam the creek off and he requested permission for the crew to work longer hours if necessary to get the fob completed as quickly as-possible so the creek does not have to be dammed off too long He also noted the project will take about 2 or 3 weeks yet to finish Mr Boake moved to accept the report and allow the crew to work longer hours if necessary to complete the bridge move CARRIED There was discussion about allowing the crew to work longer hours to make up time if they are forced to shut down because of rain but it was agreed this could not be done Mrs. Wilkinson asked council if they wished to have stop signs erected between Section 12 in 34 -26 -4 and Section 7 in 34 -25 -4 and between Sections 7 & 8 in 34 -25 -4 - roads leading on to the South Huxley light coat surfaced road After discussion and noting all other roads have stop signs Mr Maerz moved that the necessary stop signs be erected to allow the east -west traffic the right of way and having the north -south traffic stop prior to crossing or turning on to the Secondary Road 587 at the above noted locations CARRIED —• c.. c, i 5 T- 0 The need to give by -law number 1040 (dog control by -law) third reading was reviewed and Mr Maerz moved third reading be given to this by -law CARRIED Mr Campbell noted that the Trochu Rifle Club feel their taxes ((;; are too high and have requested the council to consider allowing them a reduction in taxes or exemption fromtaxation After discussion/ of this matter, Mr Campbell moved the matter be tabled to the next meeting of council and Mr.Dunay and Mr Jeffery review the entire matter of properties exempted from taxation in the M D O� CARRIED Mr Campbell also reported that several culverts were filled with blow dirt during the recent windstorms and it will be necessary to clean them out It was agreed that water under pressure might do the fob, and this should be investigated Mr Mueller noted that the crew is now working on ripping the Three Hills East road and it will be necessary to clean the ditches this fall after harvest This will require the use of a buggy in order to clean the ditches and spread the dirt back in the fields Mr Hoff thanked Mr Welsh for coming to the meeting today Mr Jack Benedict noted there is some confusion regarding speed limit signs on the Wimborne Road (north end) and also there is a playground sign in Wi.mborne which could be removed Mr Maerz noted a school bus loading sign by Jim Bri.etzke's was blown down and should be replaced Mr Maerz then moved that this meeting do now adjourn CARRIED Time 4 00 JP M - - - - - -- -- - -- ----- - - - - -- - -- - - -- dic mistrator Reeve M I 1 1 J C JEFFERY REPORT May 29th to 1984 Starland not holding auction sale CORRESPONDENCE COVERING PERIOD June 12th, Letter (COPY) to Rockville Stock Farm granting certification of legal access N1 10- 31 -21 -4 and SW 15- 31 -21 -4 2 Linden & District Recreation Board report for 1983 3.
