Meston Subdivision 24 Review 1983 Main Crew Costing Summary 25 Review old road diversions in 29 -24 -4 COUNCIL MEETING DECEMBER 6th, 1983 A regular meeting of the Council of the M D of Kneehill #48 was held in the M D Office, Three Hills, on Tuesday, December 6th, 1983, commencing at 9 00 A M The following were present for the meeting. J Finlay Code Otto Hoff Robert E Boake Richard A Maerz Harold Mueller Bruce Hastie R G Campbell Division 1 Division 2 Division 3 Division 4 Division 5 Division 6 Division 7 (Reeve) PRESENT N J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr Boake moved approval of the minutes of the November 22nd APPROVAL meeting of Council MINUTES CARRIED Mr Hastie moved approval of the accounts to be paid today APPROVAL OF subject to further review by the Finance Committee of Otto Hoff ACCOUNTS R A Maerz, Bruce Hastie and R G Campbell CARRIED Mr Jeffery reviewed the bank reconciliation statement for the BANK month of October and after discussion of same, and the budget STATEMENT comparison done to the end of October, 1983, Mr Campbell moved OCTOBER /83 approval of same -A CARRIED Mr Jeffery read a letter of thanks from Mr Berdahl and Mr Boake moved to accept and file CARRIED Mr Jeffery reviewed his report covering the period November 22nd to December 6th, and the following items were reviewed. LETTER OF THANKS BERDAHL J C JEFFEI;Y REPORT Mr Hazelton has indicated he will not be able to crush any of the material at the Andrews Lowen Pit as there is too GRAVEL much dirt in the material After discussion it was CRUSHIING agreed the sloughed area at the bottom will have to be NOT cleaned up, some clean up work done at the top of the hill POSSIBLE and perhaps make a berm there to prevent further erosion ANDREWS The possibility of seeding the disturbed area was also discussed LOWEN It was agreed that Mr Vickery, Mr McMurtry and Mr Rasmussen PIT should go and have a look at the area and see if a cat would be able to push any of the material down over the hill in order to clean it up Mr Maerz moved approval of Mr Jeffery's report CARRIED Mr Maerz indicated he had not as yet been able to meet with P B I Mr Lyle Birch of P B I and Mr Campbell moved to table the MEETING matter of the 1983 grant until the next meeting of Council CARRIED The draft by -law for fire departments was again reviewed and Mr Hastie moved to table this matter until further IRE BY -LAW study of the by -law can be done in order to make it -(P applicable to the M D of Kneehill's situation CARRIED AAMD & C The AAMD & C have forwarded a brief questionnaire concerning QUESTIONNAIIf how the association should be operated and Mr Maerz moved that each councillor review the questionnaire and the matter be reviewed at the next meeting of Council. r CARRIED COUNCIL MEETING DECEMBER 6th, 1983 P 2 Mrs Carol Ducs requests permission of Council to continue with the six courses for her Local Government Certificate vA and Mr Mueller moved she be given permission to take these courses under the existing M D policy CARRIED DUCS PERMISSION FOR COURSES Mrs Wilkinson reviewed the situation which appears to REBATE of taxes for Mr Joe DeBeaudrap on crown lease land existing in the Torrington -East Cemetery The graves ,/ Ci J SURVEY TORRINGTON are not surveyed and the existing map is not correct -, about 157 acres of the lease land He has been paying After discussion Mr Boake moved that the office obtain taxes on the entire lease of 330 acres since the project EAST a price on a contract basis for survey of the Torrington CEMETERY West, Torrington East and Meehan Cemetery,such survey ETC to include staking of each plot, and the matter be � c � � of lease land discussed again at a later meeting of Council CARRIED Mr Jeffery read a letter from the Village of Acme regarding Mr Jeffery reviewed an application from David Gilberg the Alberta Transportation Public Assistance Grant ASSIST regarding b y- law enforcement officer position A GRANT D GILBERG Mr. Maerz moved this application be placed on file and the After discussion of this matter, Mr Code moved to accept B11-LAW matter of having a by -law enforcement officer be reviewed ENFORCEMENT by council at some later date Mr Jeffery noted the Three Hills Seed Plant has undertaken OFFICER CARRIED SEED PLANT a dust control system They require a motion from council Mr Campbell moved to table Item Number 14 on the Agenda(lack of Development Permit 'I / NO DEV for development) until the next meeting of Council / PERMIT CARRIED NED FULLER Mr Jeffery read a letter from the Town of Three Hills in which the Town request the M D to consider a rebate REBATE of taxes for Mr Joe DeBeaudrap on crown lease land OF TAXES Mr DeBeaudrap had a lease on approximately 330 acres J and due to the Red Deer River Water Project has lost DEBEAUDRAP about 157 acres of the lease land He has been paying LEASE LAND taxes on the entire lease of 330 acres since the project Aot G commenced in 1981 After discussion of the matter Mr Boake ( moved that r f ethe D1983f ���� � � $13039 being taxes paid himponhtheu 330 acres P y � c � � of lease land Ce � 1� ti� CARRIED Mr Jeffery read a letter from the Village of Acme regarding PUBLIC the Alberta Transportation Public Assistance Grant ASSIST The Village have decided not to make a contribution A GRANT from this grant to the Elks handivan project SENIOR After discussion of this matter, Mr Code moved to accept CITIZENS and file as information CARRIED Mr Jeffery noted the Three Hills Seed Plant has undertaken THREE HILL; an upgrading project in 1983 which cost $39,224 90 - for SEED PLANT a dust control system They require a motion from council UP- GRADING approving the up- grading in order that the plant may obtain the available 40 %grant from the Province of Alberta It is to be noted the M D is not making a grant towards this up- grading cost After discussion, Mr Mueller moved the M D approve the up- grading project of a dust control sytem - cost $39,224 90, with the costs to be shared 40% by the government of Alberta and 60% by the plant CARRIED ROSEBUD It was noted that the Rosebud Seed Plant should submit SEED PLANT final cost figures to the M D of Kneehill prior to the M D paying the final grant to the Plant in 1984 The situation concerning the account sent to Mr Doug Meding DOUG regarding alleted removal of gravel from M D road allowance MEDING was discussed and after discussion Mr Mueller moved that A ACCOUNT nothing further be done as the account has been cancelled CARRIED Mrs Wilkinson read a letter from Alberta Environment SOUTH SASK regarding proposed public hearings on the South Saskatchewan .A RIVER 0 BASIN I COUNCIL MEETING DECEMBER 6th, 1983 P 3 River Basin Planning Program They will be holding sessions for the public using their Water Simulator Dates for these sessions in this area are- January 5th Three Hllls January 20th in Drumheller Mr Maerz moved that all councillors attend one of these sessions if possible CARRIED Mr Jeffery read a letter from Alberta Energy & Natural Resources in which the Department advise they have received an application from Mr and Mrs Andrew Kopjar to purchase Pt of the S1 of 9- 31 -22 -4 which the Government own _The area in question was the site of old mines and was reclaimed by the government some years ago They wish to know if the M D has any objection to this proposed sale Mr Code moved that the M D have no objection to the proposed sale on condition the land is consolidated back into title with the balance of the half section which is owned by Mr and Mrs Kopjar CARRIED CROWN LAND FOR SALE S1 9 -31 -22 KOPJAR we\ 0 Mr Jeffery reviewed an application received from Messrs. Elmer and Clarence Currie for redesignation of the SE 23- BY -LAW 30 -22 -4 Obtaining the redesi.gnation is a condition of NO approval of their proposed 40 acre subdivision off this 1028 quarter After discussion of the matter, Mr Maerz moved REDESIGNATIOD first reading to by -law number 1028 this being a by -law SE 23 -30 -22 to redesignate land use by -law 913 by redesi.gnation of the SE 23- 30 -22 -4 from agricultural conservation to agriculture `j 0 CARRIED 11 Mr Campbell moved that the required public hearing be held on January 10th, 1984 at 1 30 P M CARRIED Mr Maerz moved that the applications for subdivisions SUBDIVISIONS from A Schneider SW 3- 33 -26 -4 and Cyril Toews NW 20- 30 -25 -4 SCHNEIDER be tabled until the next meeting of Council & TOEWS CARRIED Mr Jeffery read a letter from Mr Norman Tainsh concerning the Meston Subdivision situation Mr Tainsh advised that if the MESTON M D wish to apply for an injunction in order to stop SITUATION further development on the land, the M D should advise him of the types of development presently there now and the location of such developments After discussion of this matter, Mr Campbell moved to table same until the first meeting of Council in January, 1984 CARRIED Mrs Wilkinson reviewed several old road diversions as follows OLD ROAD DIVERSIONS 1 1 40 acres in corner cut off Plan 1193 E Z NE 28- 29 -24 -4 2 Road Diversion on Plan 4876 E Z SE 31- 29 -24 -4 3 Road Diversion on Plan 6660 B M in SE 7 and NE 6- 29 -24 -4 4 Private Road on Plan 4019 E Z , S1 29 -24 -4 and Road Diversion in EJ 23- 29 -24 -4 on Plan 6661 B M 0 5 Road Diversion in EJ 9- 29 -22 -4 Plan No 7055 B M ^r� V `, After discussion of same, Mr Boake moved that the old Road Divisions Number 1, 2, 3, and 5 be cancelled on condition that the land owners of the balance of the quarter sections involved are willing to accept the land back into title with their land are willing to pay the registration fees payable to the Land Titles Office, and further that Alberta Transportation is agreeable and will cancel the said road diversion and he further moved that Item # 4 - Private Road on Plan 4019 E Z , and Road Diversion in EJ 23- 29 -24 -4 Plan 6661 B.M., be referred to the Road Committee for further investigation n V CARRIED J COUNCIL MEETING DEUENIBER 6th, 1983 Mr Jeffery reviewed the 1983 costing figu projects and there was discussion It was noted a complaint had been received and side slope work done on the DeBeaudrap agreed the road committee would review the on Road Tour, P 4 res for main crew MAIN CREW about the same COSTING regarding the backsloping project and it was project while out VA It was agreed that the lease situation with Mr Jack Lowen should be reviewed as soon as possible and Mr Code agreed he would try to arrange an appointment with Mr Lowen Mr Maerz presented to council a map showing adjustment to divisional boundaries and he requested council to discuss and review same over the next little while and he then moved to table this matter until the next meeting of council CARRIED ?, JACK LOWEN LEASE FOR GRAVEL DIV BOUNDARY ADJUSTMENTS Mr Mueller asked if there would be any merit in putting ?SAND sand boxes on the Orkney and Pope Lease Hills and after J �`� BOXES ON discussion it was agreed costs for construction of sand � SHILLS boxes should be obtained and Mr Boake moved to table g this matter until the next meeting of Council CARRIED Mr Campbell noted he had discussed with the Town of RUBBLE Trochu the possibility of sharing their rubble pit and PIT had set up a meeting with a committee of councillors TROCHU to review the situation ',for Wednesday, at 1 30 P M h in Trochu It was agreed Mr Jeffery, Mr Hastie and Mr Campbell should attend this matter on behalf of the council One of their concerns was dumping of cement in the rubble pit Mr Maerz moved that this meeting of council do now ADJOURN adjourn CARRIED Time 11 55 P M Reeve Muric pal A inistrator V I =I co V qk I aG I I II w MII O 001 1 h 1I II U 11 U 0i N 11 211 � H1I f I I W11 II E+ H 1 I W OII � $11 ii H 1i E-,!
