Add to Paragraph Five, following the motion made - "There was also discussion about the need for a by -law enforcement officer to enforce provisions of the land use by -law ” Delete from Paragraph Six a portion of sentence "There was also discussion about the need for a by -law enforcement officer and insert the following words - "There was also discussion about " - so the sentence now reads. There was also discussion about the problems being encountered because of people dumping rocks in the ditches Also change description of Paragraph Six to read - Problems with rocks in ditches October 25th Regular meeting of council Minutes 1 Page 4 Paragraph Two - Re- Amendment to Business Tax By -Law h Reference in Motion giving first reading to by -law number 1025 to amend by -law 292 - should read to amend by -law 299 CARRIED Mr Jeffery reviewed the letter received from AAMD & C which advises there will be attache cases available for sale at the convention Mr Boake moved to accept and file as information CARRIED Mrs Carol Ducs has requested council to consider paying her for the two days she was away from work during the time her son Michael was in intensive care in Red Deer She has requested the time be classed as compassionate or sick days After lengthy discussion of the request and noting it does not comply with existing sick day or compassionate leave policies, Mr Hastie moved that the request be denied CARRIED Mr Jeffery read a letter from Woods Gordon in which they outlined the various services which they provide including seminars for elected officials After discussion of the letter Mr Boake moved to accept and file CARRIED AAMD & C ATTACHE CASES FOR SALE REQUEST FOR PAYMENT OF TWO DAYS - CAROL DUCS N p,''° WOODS GORDON SEMINARS ETC rt COUNCIL MEETING NOVEMBER 8th, 1983 Mr Jeffery gave each councillor a copy of a budget comparison summary he prepared to the end of September with an estimation of what the figures will be by the year end After discussion Mr Campbell moved to accept and file same as information P 2 CARRIED Mr Richard J Page and Mr Dennis Gunther entered the council meeting at this time to discuss the taxes levied against a rental house on SW 31- 31 -26 -4 The 1983 taxes levied against the house amounted to 1032 58 and Mr Page had not appealed the assessment against the house when notice of assessment was received by him at the beginning of 1983 1^ BUDGE] COMPAF %A RUN R J REQUEST FOR TAX CANCELLATION SW 31 -31 -26 Mr Page advised council that the house is part of his farming operation and Mr Gunther keeps an eye on the cattle which are pastured on this land as well as ensuring the waterers are working, and when Mr Page requires extra help during seeding and farming Mr Gunther works for him, running machinery He also assists him during haying operations & Mr Page noted Mr Gunther is a welder also ASSESSMENT & Mr Gunther indicated he rented the house,and when he is not busy TAXATION OF as a welder he assists Mr Page with the farming operations He stated HOUSES he has a portable welding outfit and there are times when he does not have work for the welder and he is available to help with the farming work After further discussion of the matter with Mr Page and Mr Gunther, they were advised council would review the matter further and advise them of their decision in due course Mr Page and Mr Gunther then left the meeting There was lengthy discussion concerning assessment and taxation of houses J C JEFFERY rented or otherwise and also concerning the new policy established dust REPORT recently concerning assessment and taxation of mobile homes Under this Oct 25 to ruling a mobile is exempt if owned by a farmer and if not owned by a NOV 8/83 farmer and the site is rented out the mobile must be licenced and there is no exemption The ruling states a mobile must be"chieflyIused for farming PUBLIC WORKS There was also discussion about having a farmer sign a statutory declaration HOURS as to the use of the house, as well as the possibility of having all houses and mobiles assessed and taxed, and the need to lobby the government for this amendment With regard to the taxes levied against the house on SW 31- 31 -26 -4, GRAVEL Mr Hastie moved that the previous motion of council be upheld and the taxes levied against the house on SW 31- 31 -26 -4 in the sum of $1032 58 not be cancelled SUGGESTION MOTION DEFEATED FROM MEN RE negotiations for 1984 �11b Mr Code moved that the taxes levied against the house on SW 31- 31 -26 -4 WINTER in the sum of $1032 58 plus the penalty levied on October 1st, 1983 d�/ be cancelled y e'n CARRIED It was generally agreed that the existing regulations regarding assessment and taxation of houses must be reviewed with the Provincial Government Mr Jeffery reviewed his report covering the period October 25th to J C JEFFERY November 8th, 1983 and the following item was discussed- REPORT How long will the public works crews remain on a 10 hour day Oct 25 to Following lengthy discussion Mr Campbell moved that the g g y P public works NOV 8/83 crews remain on a 10 hour day until November 18th 1983 and the hours of work then revert to 8 hours per day with winter rates to go into effect PUBLIC WORKS effective November 21st, 1983 HOURS CARRIED There was discussion about continuing to spread gravel on roads now SPREADING as the ground is frozen and it was noted that there are some roads and GRAVEL hills in Division 1 which must be gravelled before winter Mr Jeffery noted that some of the men have suggested they work a 9 hour day in winter and then take off every second Friday It was noted SUGGESTION this matter would have to be discussed with the employees during wage FROM MEN RE negotiations for 1984 HOURS DURING WINTER d�/ COUNCIL _ MEETING NOVEMBER_8thz_1983 P 3 Mr Mickey Clark, M L A entered the meeting at this time - 10.30 A M Mr Clark advised Council that the Minister of Municipal Affairs has decided to dissolve I D #7 and the outlaying areas of the I D #7 will be annexed by Ministerial Order to the adjoining Municipal Districts and Counties He brought a map which indicated the area which will be annexed to the M D of Kneehill The area includes the Dunphy Kirkpatrick area as well as a small area to the south of the City of Drumheller and north of the C N R railway tracks,and not presently in our area Mr Clark indicated Alberta Transportation has made no committment regarding paving any of the roads in I.D 7 prior to the dissolution or funding the paving for the municipalities after dissolution He had been attempting to have a committment at least to have the Dinasour Trail paved within a certain period of time but to date had not been successful. There was lengthy discussion about this matter and it was noted the roads in the areas to be annexed to the M D were prone to slides and could be very expensive to maintain It was suggested the annexation and resulting problems should be discussed with Mr Koziak at the Fall Convention and Mr Clark agreed he would try to arrange a time for council to meet with the Minister during the convention Mr Clark was also requested to take the following concerns to Mr Koziak about this proposed annexation- 1 Should receive additional Municipal Assistance from the government for a certain period of time to assist with the transition and take over of the area 2 Should receive consideration of funding for costs incurred for new maps 3 Should receive consideration for extra road grants as the roads are in bad shape and there are four bad hills in the area - The Orkney Hill, The Bleriot Ferry Hill, Part of the Pope Lease Road Hill and the Dunphy Hill 4 Assistance may be required for provision of services if hamlet status is requested by the people residing in the Dunphy area 5 Assistance with costs for sanding hills for the next few years Mr Clark indicated the date for the takeover is January 1st, 1984 and also noted the area has been re- assessed under the new manual It was noted this will be an extra cost to the M.D as the area must be re- assessed under the old manual as the M D will not go on the new assessment until January 1st, 1985 DISSOLUTION OF I D #7 & MEETING WITH MICKEY CLARK Mr Clark also asked that Council advise him of their priorities for secondary roads in his area so they can work together with the government rather than against each other. He indicated Highway 27 was the only primary highway in his area He felt that the Dinosaur Trail must be paved within the next 3 years and Highway 27 would be his second priority for highways There was discussion with Mr. Clark concerning the Condominiumizationcf Bare Land - amendment proposed by Mrs Osterman to the Condominium Act, and Mr Clark indicated he did not feel the amendment would pass the Legislature this fall It was suggested the matter should be discussed again with Mrs Osterman to ensure she is fully aware of council's concerns Mr Clark was thanked for coming and he left the meeting at 11.05 A M Mr Maerz moved approval of the report given by Mr Jeffery covering the APPROVAL OF period October 25th to November 8th, 1983 CARRIED A J C JEFFERY REPORT Mr Jeffery reviewed the discussions held with a committee from the Town of Three Hills concerning sharing the town's rubble pit as well SHARING RUBBLE as sharing other expenses such as recreation, on an equal basis PIT WITH The Town of Three Hills agreed to discuss the matter further in council TOWN OF THREE meeting and get back to the M D in due course HILLS Mr Mueller mover to accept the report as information CARRIED There was brief discussion about the necessity of giving third reading \e C BY -LAWS to by -laws number 1025 and 1024 and Mr Hastie moved that these �b MBER 1024 & �10'25 matters be tabled until after the Fall Convention ,r CARRIED TABLED'��. COUNCIL MEETING NOVEMBER 8th, 1983 P 4 There was discussion about donation of gravel to community centers Mr Hoff noted the Swalwell Community Center had obtained 50 yards of gravel from the Megli Pit and to date they have not been billed POLICY for same The Huxley Community Club was billed for 40 yards of DONATION gravel - $140 00 After discussion of these matters and noting OF GRAVEL there is no existing policy concerning donation of gravel to a community TO CEMETERIES center, only a policy that rural cemetery organizations may obtain & RURAL up to 100 yards of gravel at no cost on a one time basis, Mr Hastie ORGANIZATIONS moved that the M D establish the following policy. Any rural community organization or rural cemetary organization may obtain in any one year up to 50 yards of crush gravel or pit i� Pool run gravel from the M D of Kneehill 4448 and the M D will cancel 50% of the costs for such gravel on condition the said organization pays for the remaining 50% of the costs, and if gravel in excess of the 50 yards is obtained such gravel must be paid for at the then existing rate, and further moved that the existing policy concerning donation of gravel to rural cemeteries be revoked CARRIED It was noted that the? emit of 100 yards of crush gravel and 100 yards of pit run gravel would apply to such organizations It was also agreed that the Swalwell Community Center and the Huxley Community Center be advised of the new policy and their accounts be settled accordingly Mr Jeffery read a letter from the Town of Three Hills in which the town TOWN OF asks the M D to fund one -half of the costs for installation of ramps THREE HILLS in the Three Hills Community Center The ramps would provide easier RAMPS FOR access for handicapped persons Total cost is $1813 00, and they COMM CENTER suggest the funds might come from the Public Transportation Operating USE OF PART OF Assistance Grant received annually from Alberta Transportation 1984 PUBLIC After discussion of the matter and noting that the 1983 grant has been ASSISTANCE fully committed, Mr Maerz moved that the M D pay to the Town of TRANSPORTATION Three Hills the sum of $906 50, at such time as the 1984 grant is GRANT received, and such sum be deducted from the Three Hills area allottment CARRIED Mr Jeffery noted that by -law 1026 had been given first and second reading last meeting The by -law provides for annual donations to various DONATION BY -LAW organizations - total amount of $1000 00 After brief discussion Mr Maerz NO 1026 A moved 3rd reading to by -law 1026 CARRIED Mr Jeffery read a letter from Julian Kozi.ak Minister of Municipal Affairs LETTER FROM in which Mr Koziak indicated he would like to discuss any problems that MIN MUN council may have at the Fall Convention, and also extended his congratulations AFFAIRS � on council's recent election Mr Boake moved to accept and file the letter CARRIED There was further discussion at this time about the annual grant which is ANNUAL GRANT made to Prairie Bible Institute in lieu of provision of services and Mr TO P B I Hasti.e moved that a meeting be arranged with Mr Lyle Birch of Prairie IN LIEU OF Bible in order to discuss with him the annual grant and the services which SERVICES the M D does not now provide for the school 5".4 CARRIED The grant made to the Linden Nursing Home in 1982 was briefly discussed 1982 GRANT but no decision was made It was suggested that this grant might be V\ TO LINDEN a one time grant only and not an annual grant NURSING HOME Mr Jeffery noted that Mr Ben Bauer finds he will not have time to sit as a member on the Olds Hospital Board and Mr Herb Ziegler had indicated APPOINTMENT TO he would be willing to accept the appointment Mr Ziegler is also a HOSPITAL BD. councillor for the Village of Torrington After discussion Mr Campbell OLDS AREA moved that the appointment of Mr Ben Bauer as a representative to the Olds HERB ZIEGLER Hospital Board be cancelled and Mr Herb Ziegler be appointed as representative REPLACE BEN to the Olds Hospital Board on behalf of the Village of Torrington and that BAUER Atjcel portion of the M D of Kneehill #48 which falls within the Olds Hospital Area r' CARRIED ;k4/ i Mr Jeffery read a letter from Alberta Housing Corporation in which the GOLDEN HILLS LODGE AGREEMENT 2 �f �k COUNCIL _ MEETING ------------------ NOVEMBER _8th2 Corporation indicated an error had occured in an amending agreem signed in 1981 concerning the addition to the Golden Hills Lodge The agreement stated the addition would contain 20 units but in the addition contains 21 units An agreement must be signed to this error Mr Mueller moved that the M D is in agreement with the need to the agreement and authorized the Reeve and Municipal Administratc sign the amending agreement when same is received The meeting then adjourned for dinner between 12 00 Noon and 1.0( Mr Jeffery reviewed a proposed fire department by -law which has been drafted by the Alberta Provincial Fire Chiefs Association This by -law PROPOSED if passed would given power and authority to the Fire Chiefs to FIRE DEPT remove buildings, destroy buildings, tresspass on other people's BY-LAW property commandeer vehicles and do other things necessary to fight and control fires After discussion of the need to have �( such a by -law Mr Hasti.e moved that this matter be tabled until the next meeting of council in order for Mr Jeffery to obtain information from Jubilee Insurance about the M D 's liability ,insurance CARRIED It was also noted that the M D should likely be confirming by motion the appointments of the various fire chiefs following their appointments by the Towns Mr Jeffery reviewed a comparison of prices paid for land bought and prices requested for land available for sale by various municipalities, COMPARISON as well as prices paid for crop damage, fence replacement etc OF LAND AND It was noted that the minimum established by the M D - $300 00 per OTHER PRICES acre - is likely too low and also the rate of $1200 00 per mile of fence is likely much too low It was agreed that each councillor be given a copy of the comparison and the policy be reviewed in the near future Mr Mueller moved to accept and file the report as information. CARRIED Mr Jeffery reported Mr Victor Garson has agreed to a further one year LEASE WITH gravel lease with the M D at a royalty rate of 40� per yard VICTOR GARSON Mr Maerz moved that the Reeve and Municipal Administrator be authorized (GRAVEL) to sign the lease on behalf of the M D \/% CARRIED Mr Code reported that Mr Hazelton is now crushing gravel at the Andrews Lowen Pit Mr Jeffery reported that he had spoken to Mr Jim Simpson of the M D of Starland about the possibility of the M D opening a gravel pit in their area Under the Municipal Government Act a municipality must obtain permission from another municipality before acquiring or leasing land in their area Mr Simpson had indicated the M D of Starland also require gravel and requested the M D submit a letter to the Council for their consideration Starland is testing for gravel on the Brunner land as well as other land It was suggested that a committee of Mr Mueller and Mr Campbell might meet with a committee from Starland - Norman Stanger and Bill Smyth - at the Fall Convention to see if some mutual agreement could be arranged with regard to a point gravel operation, and Mr Boake moved that this be done CARRIED It was also generally agreed that no discussoos be held with Mr Brunner at this time Mr Hoff noted there is a possible source of gravel on Keith McAfee land in the County of Wheatland - just across Highway 49(11 miles south) on the boundary between Wheatland and Rockyview Wheatland has tested on the land and it appears there is a supply of reasonably good gravel It was agreed that this matter should be followed up with Mr. McAfee and the County of Wheatland. Mr Jeffery reported on gravel spread to date on roads- Division 1 5272 Division 2 18060 BRUNNER LAND POSSIBLE GRAVEL SOURCE M D STARLAND POSSIBLE GRAVEL SOURCE IN WHEATLAND COUNCIL MEETING NOVEMBER 8th, 1983 P 6 Division 3 17314 Division 4 18986 Division 5 17698 Division 6 12094 Division 7 23235 Total 112659 yards GRAVEL Mr Rempel Rempel requests the M D crush 10 000 to 12,000 yards at the H K ToewsSHING Pit and from 20,000 to 25,000 yards at the Schmautz Pit He also indicates he will be stockpiling gravel at the following locations From Andrews Lowen Pit to Horseshoe Caynon From Garson Pit to- From Megli Pit to- Schmautz Pit to- Watts F Huxley Grainger Correction Line Three Hills West Paulson Arthurville X621 & 27 5000 yards (Weather Permit- ting) 5000 yards 6500 5000 yards STOCKPILING 6000 yards 5000 yards 5000 yards 5000 yards 15000 yards plus The above stockpiling would keep two shifts of the gravel crew busy all winter After discussion of this matter, Mr Campbell moved that the M D have Linden Contractors crush 11,000 yards at the H K Toews Pit and 25,000 yards at the Schmautz Pit at a price of $1 76 per yard and Mr Rempel be given authority/ to stock pile gravel as per his suggestions CARRIED Mrs Wendy Sowerby, Administrator of the Village of Carbon, Bill Horn, Councillor for the Village of Carbon, Don Appleyard, and Terry Reed Firemen entered the meeting at this time to review with council the problem they are having with their existing radio system - Time 2.00 P M Mr Appleyard indicated their existing radio system does not work as the signal cannot get out of the valley It will require a tower to do this They have reviewed costs for different systems as follows• A G T repeater, tower, antenna, auto patch and phone line $31,045 plus monthly charges of $120 95 Ivan Berreth - repeater, muticouplers, phone patch, crystals, A G T line $ 7,950 00 plus monthly charges of $31 00 per month Berlando Equipment - quoted on used system no guarantee the system would work $ 8,651 36 P R Communications Ltd , Calgary - repeater, duplexer interconnect pager encoder, base antenna, etc $7885 00 pay 30% down and will take bads system if does not work Price does not include tower and there would be a monthly line charge to A G T Mr Reed indicated they might be able to get a tower from Alta Power in Drumheller - cost about $1000 00 - and erection costs would be around $4000 Noted the existing system is not very good even in the village but existing equipment would be compactable with P R Communications equipment The firemen and the village favour the quote from P R Communications VILLAGE OF CARBON FIRE DEPT COMMUNICATION PROBLEMS Mr Cunningham, Utility Officer entered the meeting at this time They would have a separate frequency but would have special aystals which would allow them to switch to M D frequency if necessary Firemen indicated they likely would not require much in the way of equipment for the next two or three years Mr Appleyard indicated there are only 13 men on the department and five live out of the village They must have an effective means of communications in order to reach the rural members, and to ensure that someone can answer the emergency phones (by means of the pages) Mr Horn indicated the total costs for the system fro nP R would be about $13000 00 including tower costs and installation and the Village has agreed COUNCIL MEETING NOVEMBER 8th, 1983 P 7 to supply $6000 00 for the radio equipment if the M D will match that amount and anything in excess would have to be paid for by the firemen, using their honourium fund It was noted the tower would have to be 150' high and would be located on land owned by the Village - by the water reservoir and it would require a phone line from the tower back to the fire hall base station The firemen left the meeting and council discussed the situation with Mr Horn and Mrs Sowerby and they then left the meeting Mr Cunningham also left the meeting at this time Mr Code moved that the M D of Kneehill agree to contribute $6000 00 towards the costs required to improve the radio system for the Carbon Fire Department, on condition the Village of Carbon match that contribution and that anything in excess of $12,000 00 would be paid for by the Fire Department from their honourium fund, and that the cost of the radio equipment be charged to the Carbon Fire Department area and recovered from the equipment budget over the next three years CARRIED Council then reviewed accounts which are to be paid today Mr Hastie asked for clarification of the amount paid to Mr Rollin Hasaltine for borrow pits and fence costs Mr Hastie indicated the M D had spent about 15 hours removing page wire fence in order to backslope and then Mr Hasaltine refused to allow the M D to do the backsloping, and he felt Mr Hasaltine should be charged for the time spent removing the fence, Cost 15 hours x 2 men at $7 00 per hour - $210.00 Mr Hastie also asked for clarification of the amount paid to Mr John Ferguson for backsloping borrow pits as the amount seems to be too low After lengthy discussion of the existing policies regarding backsloping and borrow pit compensation it was agreed Mr Ferguson should receive $150 00 per acre also as he suffered a loss of hay crop for the next two years Total payment $1018 00 It was also agreed that the damage for hay crops as opposed to pasture land damage should be reviewed Mr Hastie moved that the cheque for Mr Hasaltine be cancelled and he be charged $210 00 for removal of the page wire fence and his compensation cheque be reduced accordingly e3 L 1 e��ey' '� S e r' CARRIED Mr Campbell then moved approval of the accounts subject to the cancellation of the two cheques - one for Mr Ferguson and one for Mr Hasaltine, and subject to further review by the finance committee of Otto Hoff, Richard Maerz, Reginald Campbell and Robert E Boake ACCOUNTS HASALTINE CHEQUE FERGUSON CHEQUE .� o ri f t r CARRIED Mr Hastie moved he be excused from voting on the next item - Hastie Bridge HASTIE BRIDGE Project - as he is personally involved PROJECT CARRIED Mr Hastie and Mr Jeffery then reviewed with council the bridge project and the land agreements which Mr Jeffery has attempted to arrange with the land owners involved - Mr Bruce Hastie, Mrs Norma Hastie, Mr Max Reichel, Mr Paul Gelinas and Mr Robert Christensen As the bridge will be replaced it was felt that council should at this time purchase the extra land required along the two miles of road to make it a 100 foot right of way Extra land will also have to be purchased from Mr Gelinas for the creek diversion and the creek diversion will cut off about 2 91 acres of his land Total required plus cut off area -
