setbacks insufficient 27 Subdivision application - NW 13- 32 -26 -4 - Isolation existing farmstead 28 Dev Appeal Board Hearing - Allan Duer - Permit No 709 -83 COUNCIL MEETING OCTOBER 11th, 1983 A regular meeting of the Council of the M D of Kneehill #48 was held in the M D Office, Three Hills, Alberta, commencing at 9.00 A M The following were present for the meeting Gilbert A Berdahl Otto Hoff Robert E Boake Richard A Maerz Thomas A Ferguson Bruce Hastie Reginald G Campbell Division 1 (Reeve) Division 2 Division 3 Division 4 Division 5 Division 6 Division 7 PRESENT Finlay Code and Harold Mueller were present as observers J C Jeffery, Municipal Administrator was present and recorded the minutes until 11.30 A M , at which time he left the meeting Mrs Jean Wilkinson, Assistant Administrator recorded the minutes after dinner Mr Hastie moved that approval of the minutes of the September 27th meeting be tabled until after dinner today CARRIED A list of the accounts to be paid today were reviewed and Mr Campbell moved approval of the accounts for payment subject to further review by the committee of Mr Berdahl and Mr Ferguson CARRIED Mr Jeffery noted he did not have a report and council reviewed the correspondence received and building permits issued to date Mr Boake moved approval of permits issued and moved that the correspondence be filed CARRIED Mr Jeffery read the reports from the Municipal Inspector - Municipal Affairs and after discussion of same, Mr Ferguson moved the reports be accepted and the Reeve acknowledge receipt of same, as required by Municipal Affairs CARRIED Mr Jeffery reported the Acme Elks (through Mr, Orest Lukey) do not feel they can comply with the time limit set by Council (December 31st, 1983) with regard to the Public Assistance Transportation Grant They will form a committee comprised of one from Acme, one from Linden, one from Torrington, one from Swalwell and two from the Acme Elks and possibly one from Beisker and this committee would form the required society and come up with the guidelines and by -laws under which the society would operate However they do not wish to commence working on the matter if the time limit cannot be extended until some time next year After discussion Mr Campbell moved that the Council reserve the amount of the grant of $11,522 00 less funds expended in 1983 for the Acme Elks until June 30th, 1984 and if the Lodge has not complied with conditions for receipt of the grant at that time, the monies are to revert to general revenue of the M D Carried Mr Jeffery reviewed the report from the Finance Committee concerning budget matters to date and after discussion of same, Mr Ferguson moved approval of same CARRIED Mr Jeffery noted that Mr Ben Bauer has indicated his willingness to sit on the Olds Hospital Board as a representative from the M D of Kneehill 448 and the Village of Torrington for that area within the M D which is part of the Olds Hospital Board area After discussion of this matter, Mr Maerz moved that the M D appoint Mr Ben Bauer as representative on the Olds Hospital Board for that portion of the Olds Hospital District which lies within the M D of Kneehill #48 boundaries. which is designated as Ward 7 such appointment to be for a three year term CARRIED TABLE MINUTES N ACCOUNTS 0 J C JEFFERY REPORT A MUN INSPECTOR'S REPORT s PUBLIC ASSIST TRANSPORT GRANT ACME ELKS N FINANCE REPORT OLDS HOSPITAL BOARD MEMBER BEN BAUER COUNCIL MEETING OCTOBER 11th, 1983 P 2 Mr Jeffery reviewed a memo received from Mr Mickey Clark M L A regarding required upgrading of the Dinosaur Trail After discussion of same, Mr Ferguson moved to accept and file as information CARRIED Mr Jeffery read a letter in which Mr Andrews indii lease with the M D on NE Mr. Hastie moved that the the matter with him received from Mr Raymond Andrews of Drumheller gates he wishes to terminate the gravel 10- 29 -21 -4 After discussion of this matter Road Committee contact Mr Andrews and discuss CARRIED Mr Jeffery reported Alberta Bridge Branch will be working on bridge SSW 18- 28 -23 -4 and after discussion of same, Mr Boake moved to accept and file as information CARRIED Mr Norman Klassen had asked if the M D wish to use his gravel pit as the lease expires next year After discussion and noting the lease likely had already been cancelled, Mr Campbell moved to table for further information CARRIED Mr Hoff reported Mr Alfred Thurn has alot of gravel available for sale and there is the possibility of getting a pit on his land. Mr Maerz moved that the road committee check this matter with Mr Thurn and report back to council CARRIED UP GRADING V,1 DINOSAUR TRAIL GRAVEL LEASE R ANDREWS NE 10 -29 -21 �r j., BRIDGE REPAIRS SSW 18 N KLASSEN GRAVEL LEASE r �'k" G� A THURN GRAVEL SOURCE Shop & Foremen' Committee had requested council establish a brushing /���c BRUSHING project list for winter works and Mr Maerz moved that each councillor PROJECTS should bring in his suggestions for brushing projects for the next meeting FOR WINTER CARRIED Mr Jeffery reported to council on the meeting held at the Red Deer River`9ep ��� RED DEER site with Water Resources, Fish & Wildlife,Alberta Environment, and 11 RIVER GRAVE L River Engineering to discuss the possibility of getting gravel from the river The government departments will report back to the council later as to their decision Mr Ferguson moved to accept the report as information CARRIED Mr Jeffery read a memo received from Superior Disposal regarding garbage pickups for the M D They are requesting an increase in price for pickups from $750 00 to $900 00 per month, such increase being required due to the loss of pickups in the hamlet of Grantville and cost of inflation The loss of pickups in Grantville makes the run uneconomical at the rate of $750 00 per month The original price for pickups including Grantville was $882 00 per month After discussion Mr Campbell moved that the M D agree to pay $900 00 per month to Superior Disposal calculated as follows Huxley 35 pickups Wimborne 35 pickups Sunnyslope 14 pickups Swalwell 27 pickups Ruarvkville 48 pickups 159 pickups at $5 03 per pickup = $800 00 Plus Flat Rate for Hesketh $ 55 00 Plus Flat Rate Charge for Linden Nursing Home$ 45 00 Total Charge per month $900 00 with the rate to be effective commencing August 1st, 1983 CARRIED MAO GARBAGE PICKUP COSTS SUPERIOR DISPOSAL COUNCIL MEETING OCTOBER 11th, 1983 P 3 Mr Jeffery reviewed a rural gas school safety program which Mr Cunningham has suggested he would be interested in putting on for the various schools RURAL GAS in the area The program takes about 11 hours per school and the SAFETY equipment and instruction material is available from Utilities and Telecommunications PROGRAM free of charge 0), eIa xS-e� Mr Boake moved Mr Cunningham be authorized to put on the program at the various schools if the schools are agreeable CARRIED Mr Hastie noted that the residents of Wimborne would like the FILTER filter installed in order to eliminate the chlorine taste from their FOR WIM water The costs of installation of such a filter would be $4118 00 WATER which would include 2 year service maintenance WELL ` After discussion Mr Hastie moved that the M D install a filter aJ�Stc� on the Wimborne water well at a cost not to exceed 4118.00 W�e� A�ifa. CARRIED REQUEST FOR Prairie Bible Institute has asked if the M D would turn their old rural fire truck from the Three Hills area over to them at no cost OLD THREE They would maintain the truck as a 2nd Prairie Unit and would continue HILLS RURAL to use it as a stand -by unit for the Three Hills Fire Area FIRE TRUCK Mr Ferguson moved this matter be tabled until the next meeting of P B I council CARRIED Mr Edward Dunay, Assessor,has requested council consider cancellation REQUEST of the tax levied on a rented farm house on SW 31- 31 -26 -4 The taxes FOR CANCELL- for 1983 are $1032 58 on the improvement assessment The owner of ATION TAXES the quarter section Mr Richard John Page has indicated to Mr Dunay RENTAL HOUSE that the occupants of the house, Mr and Mrs Dennis Gunther assist SW 31- 31 -26 -4 him with the farming operation, although Mr Gunther is also a welder rO< After discussion of this matter, Mr Boake moved the matter be tabled �� Q 64 until further information is obtained from Mr Page as to whether c<" U ` he is paying wages to Mr Gunther CARRIED � Mr Jeffery read a letter received from Mr Gerald G Leonhardt of COMPLAINT Drumheller in which Mr Leonhardt indicated he did not feel the tax structure GERALD is equitable, and he also outlined several other complaints he had LEONHARDT concerning roads, particularly SR 841,1ack of gravel on the municipal road past his farm and the poor approach into his farmyeard After discussion of this letter Mr Berdahl moved that the two miles of SR 841 presently in the calcium chloride experiment, be removed from that program and put back on the 1984 paving program CARRIED It was also agreed that a letter be sent to Mr Leonhardt explaining matters to him M COMPLAINT Mr Jeffery then read a letter received from Mr J E Frere outlining JOHN FRERE some complaints he has concerning lack of culvert between Sj 16- 33 -23 -4 and S1 15- 33 -23 -4 After discussion of the letter, Mr Hoff moved that the Road Committee look into Mr Frere's complaint with a view to correction of the problem if possible CARRIED Mr Jeffery read a letter from Alberta Environment regarding the water shortage WATER on local creeks this year They will arrange a meeting in due course SHORTAGE ON to discuss this matter They also mention they would like to discuss CREEKS a possible dam on the Kneehill Creek After discussion and noting the Road Committee should check out the dam on Ron Toews - 5 miles south of ETC Richard Maerz' house- West of Section 15- 31 -25 -4, Mr Boake moved the M D asked Water Resources (Kent Berg) and P F R A to meet with the M D Council and farmers along the local creeks, and also moved that Water Resources be advised the M D is not interested in a dam as it would be too expensive CARRIED M COUNCIL MEETING OCTOBER 11th, 1983 p 4 Mr Jeffery reported Mr John Reboul of Acme was not interested in having the land from the old road diversion in NW 31- 30 -26 -4 returned to title NOT with the balance of his quarter section, and Mr Hastie moved to accept '\ TO CANCEL and file the report and further moved the road diversion not be cancelled ROAD at this time DIVERSION CARRIED NW 31 -30 -26 'G v AAMD & C has forwarded the official government replies to resolutions 4r� passed at the 1983 spring convention and Mr Maerz moved that copies x'13) 0 SPRING of the replies be given to all councillors RESOLUTIONS CARRIED REPLIES FROM GOVT The AAMD & C has gavels available for sale and Mr Maerz moved to accept ✓� and file the letter as information CARRIED Mr Jeffery noted that Karen Boese had been secretary to the Development Appeal Board and since she has now left the employ of the M D a new secretary SECRETARY should be appointed FOR DEV Mr Maerz moved that Mrs Jean Wilkinson be appointed as secretary to the APPEAL BOARD Development Appeal Board and her appointment as a Development Control Officer be cancelled effective immediately `} CARRIED The meeting then adjourned for dinner at 11.30 A M � DINNER Mr Jeffery left the meeting at this time Mrs Wilkinson entered the meeting at 1.00 P M to record the minutes Mr Ross Rawlusyk from Palliser Regional Planning and Mr Alex Cunningham also entered She noted Mr Allan Winther wishes to construct a double car garage on the SW 14- 34 -24 -4 but the garage will be located approximately 75 feet RELAXATION from the center line of the road to the west of his land He does not MIN SET have sufficient room to move the garage back as the lands falls away quite BACKS FOR quickly After discussion of this matter, Mr Boake moved that council GARAGE authorize a relaxation of the minimum set -back from the road from 125 feet SW 14- 34 -24 -4 from the center line to 75 feet from the center line of the road lyingtakAo�``'ce to the west of the SW 14- 34 -24 -4, such relaxation to be applicable only to the construction of the proposed double car garage CARRIED Mr Rawlusyk reviewed the application for isolation of existing farmstead by Old Mills Farm on NW 13- 32 -26 -4 The proposed parcel is 7 29 acres' ISOLATION and is a irregular shaped parcel with a long approach into the building site EXISTING Alberta Environment did not have any concerns about the proposed subdivision FARMSTEAD and the staff have recommended approval of the subdivision subject to certain NW 13- 32 -26 -4 conditions After discussion of same, Mr Hoff moved approval for the subdivision be recommended, subject to the following conditions 1 Subdivision be done by means of survey 2 All outstanding taxes be paid 3 Satisfactory arrangements be made for services at no cost to the M D 4 The portion on the tentative plan shown as access be surveyed as part of the parcel and is not to be dedicated as public access 5 Reserve requirement be waived CARRIED Mr Ferguson moved that the council meeting do now adjourn in order to HOLD DEC hold the development appeal board hearing scheduled for today at 1.30 P M APPEAL CARRIED BOARD HEARING Mr Maerz moved that the council meeting do now re- convene, the development appeal having been dealt with 0 RECONVENE CARRIED Minutes from the recent A S B meeting were reviewed - September 26th 1983 - A S B and after discussion of various items, Mr Boake moved approval of the said s MINUTES minutes CARRIED COUNCIL MEETING OCTOBER 11th, 1983 P 5 Mr Berdahl noted he had asked several times for gravel for roads in��+rn Division 1 and in particular had mentioned this request at the last t� G RAVEL NEEDED council meeting This was not recorded in the minutes and he AOADS IN DIV wished the minutes corrected to show this request I Mr Hastie moved approval of the minutes of the September 27th meeting subject to addition of the request by G A Berdahl for provision of ✓A APPROVAL OF gravel on numerous roads in Division 1 MINUTES SUBJECT CARRIED TO APPROVAL The matter of whether the M D must install a culvert for Vincent Maurz or not was discussed again and it was noted the office was CULVERT still looking for information concerning the matter Mr Campbell moved VINCENT MAURZ the request for a culvert be tabled pending receipt of additional informtion from Mr Jeffery concerning the status of Mr Maurz' access road CARRIED Mr Maerz noted that when the work was done on the road dust to the north LIGHT of P B I it was necessary to have Prairie remove some of their light poles POLES ON These must now be re- installed and P B I do not wish to pay Alberta Power for cost of re- setting the poles They have asked if the M D would ROAD NORTH OF undertake this work for them However it was noted the M D does not P B I have necessary equipment required to erect power poles and if they were to do the work for P B I they would merely hire Alberta Power, Q�kev' pay the costs and this cost would be deducted from the annual grant 1 5#00 in lieu of services normally paid to the school CARRIED Mr Ferguson moved that P B I be advised they should arrange for installation of the poles themselves CARRIED Mr Berdahl indicated to the meeting that this would be the last meeting for both he and Mr Ferguson Mr Berdahl further indicated the M D has a good office staff, and good men on the P W staff and he felt that council should take a larger part in the planning of programs - such as road program- and then see that the work is carried out, perhaps through liasion with a public works superintendent He felt there must be someone directing the overall work of the crews He thanked the council for their co- operation during his terms on council and during his terms as reeve Mr Ferguson also thanked the council for co- operation during his term on council and noted he would certainly miss the work particularly his association with the Health Unit and the Ambulance Committee which he has served as Chairman since its inception in 1971 Mr Campbell moved a vote of thanks to the two retiring councillors, Mr T A Ferguson -
