COURT OF REVISION APRIL 12th, 1983
The 1983 Court of Revision for the M D of Kneehill #48 was held on Tuesday
April 12th, 1983, commencing at 9 00 A M , with the following members of the
court present
Otto Hoff, Robert E Boake, Richard A Maerz Bruce Hastie, R G Campbell
Mr J C Jeffery, Clerk of the Court, Mrs Jean Wilkinson, Recording
Secretary and Mr Edward Dunay, Assessor
T A Ferguson and G A Berdahl were present as observers
Mr Jeffery requested nominations for Chairman of the Court of Revision
and Mr Hastie moved that R A Maerz be Chairman
CARRIED
The Following appeals to the Court were then reviewed

Mr Dunay advised that certain equipment had been assessed on this site
Company advise the equipment is not on line,but is merely stored on site
Request cancellation of assessment of $570
Mr Campbell moved to accept recommendation of assessor and cancel assessment

Mr Dunay advised that equipment was on line for only two months and after
that time was stored on site only He noted could cancel assessment in full
or reduce assessment from 10,730 to 1790 to reflect assessment for two month

Mr Morgan entered the Court at this time Mr Maerz introduced Mr Morgan
to the Members of the Court of Revision Mr Morgan presented a letter to the
Court of Revision which basically was an appeal against his 1982 taxes and
the method of assessment of acreages He noted his house had been assessed
as a two storey house and it is a one storey with development basement The
assessment for 1982 was therefore incorrect
He felt he was over -taxed by the sum of $308 17
The Court noted they could not discuss with him his 1982 taxes They could
only deal with 1983 assessment problems and he was advised to take his
request to a meeting of Council Mr Morgan was advised by the assessor
that all assessments of houses is done using the same manual whether urban or
rural Mr Morgan left the meeting at this time
Mr Hastie moved to accept the recommendation of the assessor and make no change
to the assessment of Mr Morgan's house and land for 1983

5 9.45 A M - Terry Toews Roll 3074A - Pt SW 15-31 -25 -4 - 40 acres
Mrs Terry Toews entered the court at this time Mr Maerz introduced
the members of the Court to Mrs Toews Mrs Toews indicated they felt
the assessment of their land was too high Comparison of their taxes
to a similar house in the Village of Linden showed their taxes to be $400
to $500 higher Mr Dunay advised Mrs Toews that assessors use the
same manual and she was comparing mill rates not assessments Mrs Toews
noted she did not feel the basement was 85% complete - might be only about
50% complete It is a wood basement with dry wall and insulation only
Mr Dunay noted that 30% of the basement; totally complete and the balance
of the basement is partially completed, and that is the way it is now assessed
Mrs Toews noted that their outbuildings are worthless and should not be assessed
Mr Dunay recommended that the assessment be reduced by $450

Mrs Toews asked how a person could qualify for farm status and Mr Dunay
explained that they must earn a livelihood from the land - using about $6000
as a guideline This matter was further discussed with Mrs Toews and
she was advised that the assessment for 1983 would stay in effect for 1983
and no change could be made in the assessment following completion of
Court of Revision
Mr Boake moved that the assessment be reduced from 9650 to 9200 - reduction
of $450
CARRIED
It is to be noted Mr Maerz also advised Mrs Toews that if she was not happy
with the decision of the Court today they had the right to appeal the
decision to the Provincial Assessment Appeal Board
Mrs Toews left the hearing at this time

Mr and Mrs Ralph Main entered the hearing at this time
Mr Maerz introduced the members of the Court to Mr and Mrs Main
Mrs Main noted that the house on her land is no longer rented out
and she receives no revenue from the house Her son James, lives in the
house and is renting the land and another quarter of land from her
Mr Dunay noted that the assessment on the house is $1330 and it was
previously rented out However the house is now occupied by a farmer
and he recommended cancellation of the improvement assessment of $1330
Mr and Mrs Main were advised they would be informed of the decision of
the court and they left the hearing
Mr Campbell moved to accept the recommendation of the assessor and
cancel the improvement assessment of $1330

No one was present on behalf of the Appellant Mr Wolf Mr Dunay noted
this was a rental house but it appears now it is rented to a person who
is working for a farmer Mr Dunay was going to add an improvement assessment
for the rental house of,$1450 but further information obtained showed the
person living in the house was working for a farmer so the assessment will
not be added on Therefore there will be no change in the present assessment
on this parcel of land Mr Hoff moved to accept the recommendation of the
assessor and make no change in the assessment

No one was present on behalf of the Appellant Miss Green
Mr Dunay noted she was complaining about the assessment on the
cottage located on this land Mr Jeffery read a letter received
from Miss Green She noted there is no access to the property and
the old trail formerly used has washed away Mr Dunay noted the
cabin is 16 x 17 or 270 square feet and is assessed at the lowest
possible rate for a summer cottage He noted the land assessment
is correct and he recommended no change After further discussion
of this matter and noting the cabin has no windows, or door and the
roof leaks and is not used as a summer cottage by the owner, Mr
Hoff moved that the assessment on the cabin of $200 be cancelled
and the land assessment of $310 remain

Mr Kaechele entered the court at this time Mr Kaechele advised
the court he did not feel his assessment was in line with other people
in his area He noted he had sold the rest of his farm land and kept

20 acres and the buildings He crops the 20 acres in order to
keep the weeds down His buildings were assessed in 1981 for
the 1982 taxation year as a non farmer He wished to know what
is a farmer and was advised a farmer is anyone who makes his livelihood
from the land - using about $6500 per year as a guideline He
therefore did not qualify However he advised the court there are
others in his area with quarter sections not making a livelihood
from the land and they are granted farm status, and he wished to
be treated equally with his neighbors
After further discussion with Mr Kaechele about this matter,
Mr Dunay read the definition of farmland from his assessment manual
He also noted there is nothing written in the act as to what is
required to gain farm status but the amount of old age pension plus
total supplement is used as a guideline He noted that Mr Kaechele
does not earn a livelihood as such from the 20 acres
Mr Maerz then advised Mr Kaechele the court would advise him of
their decision in due course and if he was not satisfied with
the decision of the court he could appeal to the Provincial
Assessment Appeal Board Mr Kaechele then left the hearing -

assessor and make no change in the assessment

Mr and Mrs Stedel entered the hearing at this time Mr Stedel
asked the court to class him as a farmer instead of an acreage
owner He advised the court he has an intensive hog operation
and he does work as well He felt his income from the hog operation
was about $8000 00 Mr Dunay advised the court that Mr Stedel
does have a hog operation and he should be classed as a farmer
He recommends cancellation of the improvement assessment of $3820
Mr Stedel indicated to the court he is trying to get up to a 40 sow
farrowing operation Mr and Mrs Stedel were advised the court would
make a decision and advise them in due course, and if they were not
satisfied with the decision they could appeal to the Provincial
Assessment Appeal Board They then left the hearing
Mr Boake moved that the improvement assessment of $3820 be cancelled

Mr Martens entered the hearing He advised the court he had
removed some of the older buildings from the property and wished
the assessment checked on the house Mr Martens was advised he would
be notified of the decision and he had the right to appeal the
decision of the court to the Provincial Assessment Appeal Board
and he left the hearing Mr Dunay noted the assessment on the
house is correct and the only reduction would be because of the
removal of some of the outbuildings He recommended a reduction
of $190 Mr Campbell moved to accept the recommendation of the
assessor and reduce the assessment by $190

No one was present for the appellant Mr Dunay noted that the
fertilizer shed at this location was not properly depreciated
during the period 1965 to 1970 and recommended reduction of the
assessment on the shed by $230 After discussion of this matter
Mr Boake moved to accept the recommendation of the assessor
and reduce the assessment by $230

louses are not taxed and my is He noted he had 40 acres which is
being farmed by other people MR Dunay asked Mr Harder if he
had another fob and Mr Harder indicated he did, and he made most
of his income from his other job Mr Dunay reviewed the definition
of farmland from his assessment manual and as it appears Mr Harder
does not make a livelihood from his acreage he is a non - farmer
After further discussion with Mr Harder of the situation and
provincial legislation, Mr Harder indicated his taxes are too high
compared to a house in the Village of Linden Mr Dunay advised
him the difference would be in the mill rate, not the assessment
base for the house, and that there did not appear to be any error
in the assessment for his house Mr Harder was advised that court
Mould notified him of their decision in due course and if he was not
satisfied with the decision he could appeal it to the Provincial
Assessment Appeal Board Mr Harder then left the hearing
Mr Campbell moved that the recommendation of the assessor be accepted
and no change be made in the assessment

Mr Amstutz felt his assessment was incorrect and Mr Dunay noted

and reduce the assessment by $730

A regular meeting of the Council of the M D of Kneehill #48 was
Office, Three Hills, commencing at 9.00 A M , on Tuesday, April 1

Mr Boake moved approval of the minutes of the March 22nd meeting of Council

RESERVE BIDS FOR
Mr Jeffery reported that there are two parcels which will be offered for TAX SALE
sale at the tax sale scheduled for 1 00 P M today Council must set
reserve bids for these parcels of land
Mr Jeffery reviewed the appraisals prepared on these properties and
noted the reserve bids recommended by the appraiser are as follows
Pt SW 8- 29 -21 -4 - 2 acres more or less - $600 00 per acre - total reserve $1200 00
Lots 25 to 31 in Block 4 Plan Swalwell 5050 A K - $400 00 per lot - 7 lots total reserve
$2800 00
Mr Ferguson moved that the reserve bid for Pt SW 8- 29 -21 -4 - 2 acres more or less
be set at $1200 00, with the terms of sale to be cash

Mr Hoff moved that the reserve bid on Lots 25 to 31 in Block 4 Plan Swalwell
5050 A K be set at $300 00 per lot or a total bid of $2100
MOTION DEFEATED
Mr Hastie moved that the reserve bid on Lots 25 to 31 in Block 4 Plan
Swalwell 5050 A K be set at $400 00 per lot or a total reserve bid of $2800 00

Mr Boake moved that the Council meeting do now adjourn in order to hold REVISION
the 1983 Court of Revision

Mr Campbell moved that the Development Appeal Board hearing be held
at 2 00 P M , in the M D Office, Three Hills, on the 26th day of

Mr Berdahl noted that the County of Wheatland and the County of Vulcan
wish to know if the M D would be interested in sending someone to a
meeting on April 15th at Hussar (7 00 P M ) to discuss with Alberta
Transportation extension of Highway #56 south to Lethbridge
After discussion of this request Mr Ferguson moved that Mr Berdahl
and Mr Hoff attend the meeting on behalf of the M D of Kneehill

Mr Jeffery reviewed his report covering the period March 22nd to
April 12th, 1983 Various items were discussed including the cost of
the paint fob for the .jeep and after discussion of the costs of $650 00
or $750 00 Mr Ferguson moved that the ,jeep not be painted

Mr W Koch has asked the M D to haul back some gravel to the former
stock pile site on NW 8- 32 -24 -4 as he would like to use the old base as
a base for some new grain bins It was noted he was sent a letter in
March of 1982 advising the lease of the site was terminated and the
site would be cleaned up and reclaimed in the summer of 1982
After discussion of this request Mr Hoff moved that the Road
Committee inspect the location and discuss this request with Mr Koch

It was noted that the contract with the Three Hills Capital for newspaper 3 Hills
subscriptions for ratepayers is due again and the price has not changed CAPITAL
from 1982 - subscriptions $7171 50 and $1000 00 for blanket advertising
costs After discussion of this item, Mr Ferguson moved that the contract
with the Three Hills Capital be renewed for the period April 1st 1983 to
March 31st, 1984 CARRIED

Mr Jeffery reviewed the Marigold Library Situation and gave council
a report of the number of persons indicating approval for the M D to point the system
and the number opposed to the M D joining
A letter had been received from the Carbon Library Board and the Carbon & District
Recreation Board which outlined their views on the system
After discussion of this matter, Mr Ferguson moved to accept and file as information

It was generally agreed that the Steiger tractor would not be suitable for
the M D operaticnand further agreed that the used cats in Edmonton likely
would not be suitable as they have alot of hours on them

decision

A price has been received for packers and it was agreed Mr Berdahl and

The purchase of trucks was then discussed Mr Rempel has indicated he
would like to try a cat engine in a gravel truck this year but cat
engines cost about $4000 00 more than a Detroit diesel It was noted
the committee has been authorized to proceed with purchase of a truck
The accounts to be paid today were then reviewed and Mr Ferguson moved

The assessor had indicated council should consider a change to its business
by -law to set rates for tire sales and storage and for liquid fertilizer
tanks After discussion of this matter with Mr. Dunay Mr Campbell moved
the matter be tabled until Mr Dunay can obtain further information
i about rates being charged by other areas for liquid fertilizer tanks

The Shop & Foremen Committee meeting minutes of March 31st were reviewed
and various items discussed The Committee recommend to council that they
dispose of T -17 but keep the flat deck from T -17, purchase a plain one
ton truck, sell T -13 and keep T -22
Mr Jeffery reported that Earl McRae has checked over T -1 - one ton truck
used by the Carbon Shop and it requires alot of work It is a 1968 and has
150,000 miles on it It was suggested that T -17 be kept for use by the
Carbon Shop and dispose of T -1 instead After discussion Mr Hastie moved
that T -17 be transferred to the Carbon Shop &the Committee be authorized
to purchase a long wheel base one ton truck with dual wheels at a price not

at a price of $243,494 00 cash no trade price less a 1% discount if machine
is paid for within 10 days after receipt of same, and further moved that the
1 D6 cat be put on consignment with Costello and /or the M D. sell the D6 cat
itself

Mrs Wilkinson reported the transfer of the M D over to the Palliser Regional
Planning Commission has been authorized by the Minister of Municipal
Affairs and as a result of the announcement of the transfer, Calgary Regional
Planning Commission will do no further work for the M D All subdivision
applications and other work in process will be forwarded over to Palliser
and must be completed by their office
Mr Hoff reported that C R P C advised Mr Ken Wright representative of
the Towns and Villages and himself that they no longer needed to come
to the meetings as they were no longer members and did not have a vote on
the commission It was agreed this matter would have to be looked into
and the transfer to Palliser completed as soon as possible
Mr Jeffery read a report of the meeting held by the Drumheller & District
Solid Waste Management Association with Mickey Clark, M L A Mr Clark
noted the Minister of Environment is reluctant to invest further funds
in the association if some member municipalities continue to threaten to
opt out The existing agreement is for a period of 10 years The
Association is asking for letters from each municiplaity outlining their
position in this matter - will they continue with the association or are they
considering opting out? These letters will be forwarded to Mr Clark
and he will then discuss the situation with the Minister of Environment
After discussion of the situation, noting the Health Unit had shut down the
Town of Three Hills rubble pit for a time, and that it would take the M D
some time to locate a site suitable for a dump and to locate its own equipment,
Mr Campbell moved that the M D agree to stay in the Drumheller & District
Solid Waste Management Association for a period of two years on the
following conditions-
1 That the costs do not increase too rapidly and do not become too much of
a burden on the M D ratepayers
2 That the participation of the M D in the association remain on the same
basis as in previous years - using a population figure of 3665 for the
calculation of its contributions to the association

and Mrs Jean Wilkinson, Assistant Administrator recorded the minutes

offered for sale today would be

As no bids were received Mr Jeffery declared the property would not be
sold at the public auction sale
He then advised those present that other properties advertised in the
paper had been redeemed prior to today's sale
Mr Jeffery then declared the tax sale closed
