THREE HILLS WATER: PROJECT After discussion of same, Mr Ferguson moved first reading to by -law 996, this being a by -law to amend by -law 950, that being correction of the section of the Municipal Government Act the by -law was passed under, Section 353 not 338 Carried Mr Hastie moved second reading to this by -law Carried Mr Maerz moved that third reading be given to this by -law at this time Carried Unanimously Mr Boake moved third reading to this by -law Carried Mr Campbell moved first reading to by -law 995, this being a by -law to correct by -law 949, changing the section of the Municipal Government Act the by -law ;was passed under, as well as amending the amount of the debenture in Paragraph 3 Hof the enactment portion of the by -law to $58,083 00 Carried VA BANK STATEMENT Mr Jeffery reviewed the bank reconciliation statement for the month ending November 30th, 1982 The balance on hand is $2,208,139 76 After brief discussion Mr Campbell moved acceptance of the statement Carried Mr Jeffery reviewed a second agreement which is required with Alberta HUXLEY WATER Environment in connection with the Huxley Water Project This agreement DEBENTURE will allow for payment of a further 10% of the grant with the balance of the grant to be held until the street work is completed in 1983 After discussion Mr Boake moved that the Reeve and Municipal Administrator be authorized to sign the agreement with Alberta Environment on behalf of the M D CArried J C JEFFERY Mr Jeffery's report covering the period November 23rd to December 14th REPORT was then reviewed as follows 1 Agreed to have Pardee Equipment give a presentation on the operation of motor graders for employN s in the spring - this would be for present grader operators and those will / train as a grader operator Mr Keith Smith is to arrange date for same 2 Combined fire meeting - date was set for January 11th, 1983 at 7.30 P M 3 The minutes from the meeting held by the Ruarkville residents with Mr Maerz recently were discussed as well as the possibility of a split mill rate It was generally agreed the M D should attempt to cut costs in 1983 No decision was made regarding split mill rates Mr Boake moved to accept the report given by Mr Maerz concerning the meeting with Ruarkville residents Carried Mr Maerz moved to accept the report from Mr Jeffery covering November 23rd to December 14th, 1982 Carried iMr Jeffery reviewed by -laws 995 and 996 which were drafted to correct ;errors in by -laws 949 and 950 concerning the Ruarkville and Grantville participation in the Three Hills Red Deer River Project BY -LAWS 995 & 996. in the sum of $39 74 Carried Mr E Dunay reported to council that he had re- inspected the home of Mr M Reed in Grantville - Lot 1 Block 4 Grantville 7810669 The assessment for 1982 was in error and should have only been $11 540 instead of $13,040 The house is not a two storey home, but in fact is la bi -level The assessment was $1500 too high The taxes for 1982 lwere $259 05 too high as a result After discussion Mr Boake moved that Mr Reed be refunded the sum of $259 05 being the overpayment on his 1982 taxes Carried RE- ASSESSMENT M REED HOUSE GRANTVILLE RECREATION FIGURrC Mr Jeffery then reviewed the %population breakdown between the various recreation areas, as follows Drumheller 345, Carbon 471, Acme 417 BREAKDOWN FOR GRANT Three Hills 1844, Linden 981 , Trochu 1074 and Torringtcn629 - total PURPOSES (population 5761 He also reviewed with council possible alternatives regarding population breakdowns for the operating grants and mayor capital grants from the province to make use of the rural population from the Drumheller Recreation .n ,area This is necessary as there is no regional agreement between the M D and the City of Drumheller and the city cannot make use of any of the M D rural population figures when applying for operating and capital grants ,from the province After discussion of this matter, Mr Maerz moved as follows for recreation purposes Figures to be used for calculation of payment of M D grant funds /to the City of Drumheller, Town of Three Hills, Town of Trochu Villages of Acme, Carbon, Linden and Torrington will be Population Percentage Share of Funds Drumheller 345 5 99% Carbon 471 8 18% Acme 417 7 24% Three Hills 1844 32 01% 'Linden 981 17 03% Trochu 1074 18 64% Torrington 629 10 91% - 4 miles by contract and 4 miles by M D Major Capital Recreation Grants (MCR Grants) from the Province of Alberta ?p� in order to make use of the rural population in their area, a percentage with Greg Sheppard of Alberta Transportation in which Mr Sheppard share of the rural population in the Drumheller Recreation Area,and a except that percentage share of the 196 people allowed to bring the population figures grade width - GOVERNMENT standard is 11 meter grade back to the highest figure in the 10 year period in which the MCR grants moved to accept and file as information ^ will be paid by the province Population Percentage Share of 196 — Total Percentage Drumheller -O- + - In favour Mr Hoff, Mr Campbell Mr Boake, Mr Maerz, and Mr Ferguson Opposed Mr Hastie and Mr Berdahl MOTION CARRIED Mr Jeffery reviewed the final cost comparison figures arrived at for the ��,�� contracted road projects - 4 miles by contract and 4 miles by M D crews ?p� He also reviewed a report from a meeting held by himself and Rick Vickery with Greg Sheppard of Alberta Transportation in which Mr Sheppard indicated the proposed road standards drafted by the M D appear to be good except that Type 1 road is medium secondary standards - and the passing width is 2 meters less than grade width - GOVERNMENT standard is 11 meter grade After discussion of these matters Mr Ferguson moved to accept and file as information ^ Carried The meeting then adjourned for dinner between 12 00 Noon and 1 00 P M Mr Campbell moved that the Council meeting do now adjourn in order to hold the public hearingsscheduled for 1 00 P M today and 1 15 P M Time 1.00 P M Carried Mr Ferguson moved that the council meeting do now reconvene, the public hearings have been completed Time 1 45 P M Carried The application submitted by Mr and Mrs Klassen for redesignation of SE 20- 30 -25 -4 was then reviewed and discussed in detail Mr Martin indicated that by -law 993 was drafted to redesignate the quarter and also to relax the density of 2 parcels per quarter for that particular quarter section It was noted there was a residential parcel which would virtually be surrounded on three sides by the intensive use proposed for the subdivision The environmental impact on the creek was also discussed as well as the impact of an intensive use so close to the village of Linden Mr Houghton indicated that Alberta Environment have reviewed the subdivision application and they would have no objection to the proposed subdivision as long as the boundaries of the parcel do not cross the Kneehill Creek f The Drumheller Health Unit would have no objection to the proposed subdivision as long as the run off from the intensive operation is controlled and does not pollute the creek Mr Ferguson moved second reading to by -law number 993 to redesignate the land and relax the density requirements MOTION��� r r r I r 1 G a • L] COUNCIL MEETING DECEMBER 14th, 1982 The proposed subdivision application submitted by Mr and Mrs Kl; was then reviewed and Mr Hastie moved that the counvel recommend refusal for the subdivision as the land has not been redesignated By -Law number 994 was then reviewed and it was noted that there w( no objections raised to the by -law at the public hearing held tod< Mr Hastie moved second reading to by -law 994 Mr Maerz moved third reading to by -law 994 Mr Martin gave each councillor a copy of a brief he has prepared in connection with the Three Hills annexation and it was agreed that the contents of the brief would be kept confidential until such time as the date for the Local Authorities Board hearing has been set It was agreed that the brief would be reviewed by the councillors and discussed again with Mr Martin at a later date Mr Houghton then reviewed with council certain standard or normal conditions for subdivisions and the meeting also reviewed council's existing policy regarding normal conditions for subdivisions Mr Hastie moved that the M D adopt the following as normal conditions for subdivisions. 1 Access to be located and culverts and approaches installed at the owner's expense to the satisfaction of the Municipality 2 The owner to negotiate and come to an agreement with the Municipality with regard to its road right of way requirements 3 The owner to enter into a Developer's agreement pursuant to Section 92 of the Planning Act 4 The owner to negotiate with the Municipality with regard to construction of roads to provide access to the proposed subdivision and if required by the municipality,roads must be constructed at his own expense to Municipal standards 5 All outstanding taxes current from the date of the application are to be paid to the Municipality - Planning Act, Section 91 (1) (d) Carried The following subdivisions were then reviewed 1 NE 25- 31 -25 -4 - Robert B Robertson Isolation of Existing Farmstead 2 1 acre parcel - Applicant has requested a parcel of only 2 1 acres rather than the 4 acres presently allowed under the M D by -law and regional plan to avoid taking more farm land out of production It was noted that there is a residence under construction on this land, but the house is not habitable After discussion of this matter, Mr Hastie moved the council recommend refusal for this subdivision as it does not comply with Section 10 (6) (0) of the M D land use by -law - does not have a habitable house Carried 2 John Regehr - NW 12- 30 -25 -4 - Application for a boundary adjustment The applicant obtained a subdivision in 1978 for an intensive use Parcel was to be 20 acres However when the measurements were taken the parcel was only 17 9 acres The land was sold to Murray Regehr f and trees and shelter belt were planted on the balance of the quarter rather than on the 17 9 acres Mr Murray Regehr wishes to acquire additional land in order to bring his parcel size to 20 acres so his trees and shrubs would be on his own land Mr Houghton indicated this could be handled as a boundary adjustment, but after discussion and noting the owner of the acreage had not proceeded with his proposed intensive use for the acreage, and there did not appear to be a need to increase the size of the residential parcel, Mr Maerz moved that the M D recommend refusal for the boundary adjustment as the owner ;# the acreage has not proceed with his proposed intensive use for the subdivision as indicate on the original subdivision application Carried F 0 0 COUNCIL MEETING DECEMBER 14th, 1982 P 5 ow G A Berdahl moved approval for the accounts ps per list dated December 14th, 1982, subject to review by the Finance Committee Carried A delegation from the Trochu Fire Department and the Town of Trochu entered the meeting at this time - 2.30 P M Roy Enzie, Lawrence Hogg, Ed Adolph, and Ross Dean They discussed with Council the need for replacement of the Town of Trochu fire truck in 1983 They had obtained costs from Superior Equipment at Red Deer for a new truck - 27,000 G V W ,& 840 gallon front mount pump to give underwriter coverage Cost $65,875 00 Equipment $27,845 42 Total cost $93 720 42 Truck would be purchased from Garrett Motors at Carbon with a 1000 gallon tank Under the new agreement the cost for this truck would be shared 50 -50 by the Town and the M D The Trochu fire area has a $24,014 98 book credit to the end of 1981 Mr Jack Benedict, Chairman of the Three Hills School Division entered the meeting at this time - 2 55 P M It was noted that the Town of Trochu has given approval in principle to the purchase of a new truck The delegation left the meeting at 3 15 P M Mr Benedict reviewed with council what portion of employee benefits are presently paid for by the School Division and various other matters were reviewed with him Mr Benedict then left the meeting The employee committee meeting minutes from November 30th were then reviewed and after lengthy discussion Mr Hastie moved that the M D shop personal and the A S B personnal work up to 9 hours per day in 1983 Carried It was noted that the remainder of the Public Works employees will go to an eight hour day during the winter season effective January 1st, 1983 It was agreed coffee breaks will remain the same, Mr Campbell moved approval of the minutes from the employee committee meeting Carried � Mr Boake moved that the M D approve in principal the purchase of a new }er fire truck for the Trochu Fire Protection Area and the Town of Trochu with costs to be shared as per the terms of the new fire agreement Carried Mr Hastie moved that the balance of the agenda be tabled until the next meeting of Council Carried Mr Maerz moved that this meeting do now adjourn Carried Time- 450 PM - Louis Lemay was altered by persons unknown in order to cross bridge with machinery - damaged guard rail will have to be repaired 3 Two shifts of gravel crew are now operating 7 to 4 and 3 to Midnight 4 Purchased flow meter $500 00 for checking hydraulic flow for most of our equipment - Regular $1500 00 - was used only once by Massey dealer in Sask who lost dealership - require motion approving expenditure 5 Orly Pederson of Pardee Equipment willing to give presentation on operation of motor graders - possibly on employee day? 6 Set date for next annual fire meeting ? 7 Men taking 27 and 28 off in lieu of Christmas and Boxing Day and January 3rd in lieu of New Years 8 General Assessment - Council kept delaying doing a general assessment as they felt assessor was keeping assessment current and were not aware of depreciation factor (Information obtained from G G King) Depreciation on a residence is only allowed in the year of a general assessment Therefore a house built in 1962 (last date of general assessment) and based on a 60 year life is 33 1/3� over assessed due to no depreciation being allowed over the past 20 years A house built in 1972 is 16 6% over assessed due to same depreciation factor Feel a split mill rate is very complicated but could be done Easiest solution is to bring general on stream in 1983 which would require hiring 2 more stenographers and two more assessors -
