COUNCIL MEETING NOVEMBER 8th, 1982
A regular meeting of Council of the M D of Kneehill #48 was held in the M D Office,
Three Hills, on Monday, November 8th 1982 commencing at 9 00 A M

APPROVAL MINUTES
Hr Boake moved approval of the minutes of the organizational meeting of council
and regular meeting of council held on October 25th, 1982

BANK STATEMENT
The bank reconciliation statement for the month ending October 30th, 1982
was reviewed It showed a net balance on hand of $1,965,943 54
After discussion Mr Ferguson moved approval of the bank statement

The need to have a Finance Committee meeting was discussed
and

Mr Jeffery reported that Mr Jack Tutt will be going onto Long
Term Disability effective November 1st, 1982 as his short term disability
payments have run out Mr Tutt has therefore been terminated from the
payroll due to illness as long term disability is not considered pensionable
earnings by Local Authorities Board Dominion Life will waive the
premiums for his coverage with them as soon as he is accepted on long term
disability His coverage with Alberta Health Care was then discussed
It was cost $19 00 per month to keep Mr Tutt covered with the M D group
plan After discussion Mr Maerz moved that the M D pay the Alberta Health
CAre premiums for Mr Tutt during the period he is on long term disability
coverage

Mr Jeffery then reviewed his report covering the period October 25th to
November 8th 1982 and the following items were discussed
Rocks on the Gogel Project and extra compensation for Marshall Construction
The Road Committee recommended the M D pay $2 00 per yard for 4240 yards
After discussion Mr Ferguson moved that the M D pay Marshall Construction
the sum of $8480 00 as extra compensation for the Gogel Project work due
to the amount of rocks encountered on this project

Mr Hastie also noted he would inspect the entire road from the
Mobil Plant south to see what other signs might be necessary
It was agreed and Mr Campbell moved that the M D send a letter of
thanks to Alberta Transportat I onaf?6 the work done to date on SR 575
from the Hesketh corner east and /advise them that the base course
does not appear to meet Alberta Transportation standards

Mr Ed McNair of Beiseker called today and asked that the
M D do some stripping work at his pit After discussion
Mr Hastie moved that a scraper (and crawler with ripper if necessary)
be taken from the main crew project to do the necessary stripping
work at the McNair Pit to expose approximately 22,000 yards .
and also moved that the packer being pulled by Cranston Construction
on the main crew be shut down immediately

Mr Paul Fenwick and Mr Colin White from Palliser Regional DISCUSSION WITH
Planning Commission entered the meeting and showed a slide presentation PALLISER COMM
concerning the Palliser Regional Planning Commission area
They then discussed with council the draft regional plan for their
area and various sections of the plan were reviewed in detail
Mr Fenwick indicated that the decision as to whether Kneehill
will be allowed to join Palliser may not now be made until April of
next year
Mr Fenwick and Mr White were thanked for coming and they left the meeting
Mr Cunningham also left the meeting
The meeting adjourned for dinner between 12 00 Noon and 1 00 P M DINNER
Mr Larry Martin and Mr Greg Houghton from C R P C entered the meeting
at this time Mr Cunningham also entered the meeting
Following completion of the public hearings scheduled for today, the
council meeting then continued BY -LAW 989
Mr Martin indicated that the by -law number number 9b9 which was given NOT PROCEEDED
first reading on October 12th was not correct The by -law merely WITH
indicated a redesignation of the SE 20- 30 -25 -4 and should have as well
indicated a relaxation of the density for that quarter, as there are W J KLASSEN
already existing subdivisions on that quarter
He suggested that council not proceed with that by -law and rescind the
motion setting the date for the public hearing, pass first reading to
another by -law and establish another date for the public hearing
Mr Campbell moved that the resolution setting the date for public
hearing in this matter be rescinded and by -law number 989 not be
proceeded with

Mr Jeffery read a letter received from C R P C regarding the possibility GRANTVILLE
of conversion of a duplex into a fourplex in the hamlet of Grantville
The solicitor who was consulted by the commission regarding this matter
advised nothing could be done until the owner actually had four families
living in the building He also suggested some changes to the land use
by -law and Mr Martin then reviewed a by -law to amend the land use by -law
to incorporate these changes The amendment would add some clauses to the enforcement
section to the by -law and also more clearly define what is a duplex and
what is a semi detached dwelling ,;

The subdivision application submitted by Mrs Lacombe et al for an SUBDIVISION
isolation of existing farmstead was then reviewed Mrs Lacombe owns NE 11 -31 -26
80 acres in NE 11- 31 -26 -4 and wishes to sell the balance of the 80 acres
to the owner of the other 80 acres in that quarter, and retain her building site
Mr Campbell moved that council recommend approval for this subdivision
subject to consolidation of the balance of the 80 acres after removal
of the isolation, in title with the West half of the NE 11- 31 -26 -4 and
subject to other normal conditions for subdivisions

Mr Larry Martin and Mr Greg Houghton and Mr Alex Cunningham left the
meeting at this time
TORRINGTON &
Ms Gayle Sokolam from C R P C and Mr Mery Clarkson from the Torrington DISTRICT REC
Recreation Board entered the meeting at this time MASTER PLAN
They discussed with council the proposed Torrington & District Recreation
Master Plan and Gayle reviewed a resolution she had drafted whereby
council could if they wished adopt the master plan for the Torrington &
District Recreation Area
Mr Hastie and Mr Maerz indicated they had attended meetings regarding
the master plan and had reviewed the plan in some detail
Ms Sokolam noted that the plan does list priorities for use of government
grant monies and also noted the plan should be up -dated every 5 years
After further discussion Mr Maerz moved as follows
WhFREAS the Council of the Municipal District of Kneehill No 48 deem it
desirable to prepare a District Recreation Master Plan for the Torrington
& District Recreation Area to guide recreation development over the next
five years
AND WHEREAS the Council of the Village of Torrington as signing authority for the
Torrington Recreation District has requested the Recreation Board to
authorize preparation of a District Recreation Master Plan
AND WHEREAS the Recreation Master Plan presently reflects a priority listing
of the needs and desires of the residents of the Torrington & District
Recreation Area
NOW THEREFORE The Council of the Municipal District of Kneehill #48 resolves to adopt
the Torrington and District Recreation Master Plan according to the following
provisions
1 The Recreation master plan shall be reviewed at least bi- annually in
light of changing needs and desires of the residents and
2 The residents shall be given adequate notification of any proposed changes
to the priority listing and a public information meeting shall be held prior to
these changes being made

Mr Clarkson and Ms Sokolam were thanked for coming and they left the

regarding the condition of the Orkney Road and Orkney Hill He sugges
the worst stretches of the road be scarified and left as a gravel road
next spring when it could be repaired After discussion it was agreed

Mr Jeffery then reviewed the Red Deer River Water Project as it
relates to Grantville and Ruarkville and noted that Local Authorities
Board have requested amendments to the M D by -laws 949 and 950
These amendments include '^
1 Include in the by -law the correct amount of the grant payable by
Alberta Environment towards the project - $178,708 87 by -law 949 and $338,207 90
2 Correctathe5amount to be borrowed to $53,083 00 in by -law 949, and $101 670 00 in by -1
950
3 Indicate the correct numbers of the Approval Certificates obtained from
Division of Pollution Control, Alberta Environment as follows #80 MP 310
Al (81 ) A2 (81 )
4 Correct reference to interest rate to read rate not exceeding 25%
5 Add paragraph 5 as follows
These debentures shall be issued in such manner that the principal and interest
will be combined and be made payable in, as nearly as possible, equal
annual installments over a period of twenty -five years in accordance with
the schedule attached and forming a part of each debenture in both by -laws
6 Re- number the remaining paragraphs in the by- IawsaccordingIy
After discussion of these amendments Mr Maerz moved second reading to by -law 949
as amended

Mr Jeffery reported that Alberta Environment has forwarded a cheque for �A
$74,856 15 being the second provincial grant towards the Huxley Water Project
Mr Campbell moved to accept and file as information
Carried
Mr Jeffery reported that the people in Huxley have been using the new
water system in Huxley for about a month now Council should set a flat
rate for maintenance charges for the system at this time until the water
meters can be installed, which will likely be sometime before next spring f 7
After discussion Mr Ferguson moved that a flat rate of $13 00 per month
be set for water charges in Huxley with the rate to be effective November lst, 1982

Mr Jeffery read 4 letters received from people asking council to
again consider the Marigold Library System, and after discussion Mr Ferguson
moved to accept and file the letters

Council then reviewed the accouts paid in the month of October, and Mr
Boake as a member of the committee reviewing these accounts recommended r
that council approve same Mr Boake then moved that council approve
the accounts so paid in the month of October

Mr Jeffery then reported that in future council must review the accounts
to be paid prior to payment of same and may if they wish after review ��
approve the accounts for payment subject to further review by the finance
committee
The councilthen reviewed the accounts to be paid today, and after
discussion Mr Campbell moved that the accounts listed be approved for A
payment subject to further review by the finance committee of Mr Boake,
Mr Campbell Mr Ferguson and Mr Berdahl

Mr Jeffery reported that the recreation breakdown figures from the
recent census are still not available and therefore these figures can not
be reviewed at this meeting Mr Maerz moved to table this matter until
the information is available

Mr Rempel entered the meeting at this time - 3.15 P M to discuss
with council the operation of the crews over the winter months and
the 1982 -83 gravel operation
Mr Rempel indicated they should stock pile in excess of 50,000 yards
this winter Also noted they would not likely require the Johnson
stock pile site any longer
It was generally indicated that the gravel crew should discontinue
gravelling roads now and go to stockpiling, as the roads are frozen
Mr Vickery reported they must use a ripper every morning now to get
started on their road project.
There was discussion about getting gravel on the new grades now
Mr Jeffery reported that the M D cleaned up a pile of gravel at the
Garson Pit which belonged to Mr Garson and some gravel must be turned over
to Mr Garson to replace that taken in error
There was discussion about getting the work done on the J Malaka road
and it was noted that the traxscavator cannot do the work, it will require
a buggy The fence is out now and the culvert must be extended
Discussed the possibility of shutting the main crew down shortly and doing
some of the smaller jobs
After lengthy discussion Mr Berdahl moved that the main crew cease work
on the main crew road program Wednesday night November 10th, 1982 and
the small crew continue working on its projects as long as weather permits

It was generally agreed that the temporary summer employees would be
given their notice immediately,
Mr Ferguson moved that one buggy from the main crew be sent to the Malaka
Road project to do the necessary work on this project as the fence has been

removed by the landowner

It was also noted that one buggy from the main crew should assist the small
crew in completion of the Hesketh Hill Cut if the foreman feels he requires
the help
The Albretch creek crossing was discussed and agreed this job should be done
if weather permits
Mr Maerz moved that the gravel crew continue to gravel new grades in all areas
and then go to stockpiling gravel when the new grades are gravelled

The second shift on the gravel crew will commence when the small public works
jobs are finished The hours for operation of the two shifts were also discussed ,
with Mr Rempel
There was discussion about the need to drill test the old Torrington Gravel Pit
as Mr Hazelton had indicated he knew where the gravel deposits were There was
lengthy discussion on how to mine the gravel from this pit due to the water problem
After discussion it was agreed that the pit will have to be drill tested and if
necessary a professional plan should be worked out in order to get as much gravel
as possible from the pit
There was also discussion about the possibility of gravel below the floor of the
Garson Pit
Mr Rempel left the meeting at 5 15 P M
The road crossing agreement drafted by the office using a format prepared by Brownlee
Fryett, Solicitors, was reviewed and Mr Ferguson moved that Council accept and use
the drafted road crossing agreement

1 Engineers are double checking yardage figures and reviewing contract fobs with
engineers and Marshall Construction
Recommend to council to pay yardages as per Stanley & Associates
comments - because of rocks 4240 cubic yards at $2 00 = $8480 00
2 Reviewed Reimer ditch with Mr Hoff and agreed to write off
3 Grader gates - K J Smith checked - will likely not stand up to our speed
are used more in towns
4 Ordered 1 gas saving device $90 00 - to see if it works
5 Need motion for 2 stop signs erected NW 24- 33 -26 -4 - to stop N -S
traffic
Also whole Wimborne road should be reviewed
6 Monty McGregor - gave us approximately 5000 yards of gravel from Watts
stock pile as was contaminated by screenings by their workers - and cannot
be used in their oiling program
7 Gave Dome Petroleum 300 yards gravel for West of 18 & 19 in 33-24 -4
8 Robert Cranston has D8 for rent - would leave on our crew for actual hoes
used - his man would run - has ripper on and angle dozer $75 00 per hour for time
used
9 Agreed to recommend to Council to pay $2 00 per yard for 4240 yards re, rocks
