SE Central Alta Prospectives and Prospects 30 Minutes from A S B - April 19th - review various items 31 Agreement re Pesticide Container Sites - 0 • 0 11 COUNCIL MEETING MAY 10th, 1982 A regular meeting of Council of the M D of Kneehill #48 was held in the Municipal Office, Three Hills, on Monday, May 10th, 1982, commencing at 9.00 A M Those present were. G A Berdahl Otto Hoff Robert E Boake Richard A Maerz T A. Ferguson Bruce Hastie R G Campbell .Reeve Division 1 Division 2 Division 3 Division 4 Division 5 Division 6 Division 7 (after 9 15 A M ) PRESENT ILU J C. Jeffery, Municipal Administrator Mrs. Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr Berdahl reported that Mr Barnes would not sign the agreement concerning BARNES DUGOUT filling in the dugout on Mr Barnes' land as they feel there is a clause NW 19 -29 -22 in the agreement which would make them liable if any accident occured while the M D was working on their land Mr Jack Barnes and Mrs Florence Ibey entered the meeting at this tune, and discussed with council the proposed agreement Mr Boake entered the meeting also They were advised th t th a ere would be no liability to them until such time as the M D finished filling in the dugout and completed the project The agreement was merely to protect the M D from a lawsuit after the dugout was filled in It was noted that filling the dugout would require a buggy and could not be done with a motor grader After discussion of the problem which occured with the dugout because of insufficient setbacks, they asked if the M D would pay crop damage if the work of filling in the dugout was not completed within the next 10 days It was agreed that the work could not be done in the next 10 days and therefore would not be done until next fall Mr Barnes indicated they would take the agreement to his solicitor and would have the clause added that the work would not be undertaken until fall, after the crop is off Mr Barnes indicated that he did not in any circumstances want the dugout left there now, he wanted nothing further to do with the project, even though there is a small amount of water in the dugout now He agreed to get back to M D after discussing matter with his solicitor Mr Barnes and Mrs They were thanked for coming and left the meeting. KESTER DUGOUT Mr Maerz reported he had made an agreement with Brian Kester to build 'him KESTER ROAD a dugout on his land as Mr Kester would not sign any agreement for backsloping PROJECT and necessary tree removal unless he had a dugout constructed It appeared at the time the agreement was signed the dirt from the dugout would be required for the road However due to a lack of communication between Mr Dorn, former foreman, Rick Vickery, Acting Foreman and Lyle Gelinas who is taking over while Mr. Vickery is away, a borrow pit was opened up further to the north on the road and the dirt taken from there Mr Kester then insisted the dugout be constructed for him and the dirt from the dugout was then actually excess or waste dirt and was put on the road also LI Mr Maerz also reported that INIr B Kester requires a second culvert on a vacanntCY RE. quarter of land and under existing policy he would have to supply this culvert CULVERTS himself After discussion of this matter and noting Mr Kester asked the M D TO RATE to supply him with the culvert and deduct it from the money owing him for the PAYERS road construction work, Mr Hoff moved that the M D purchase a small stock of culverts from Twister Pipe, pay the sales tax for same and keep them available for re -sale to M D ratepayers CARRIED Mr Boake reported that the Village of Acme were successful in obtaining a grant from Alberta Transportation in the sun of $130,000 00 to assist them with reconstruction of the street leading into the Village and dust recently annexed from the M D. The bank reconciliation statement for the month ending April 30th, 1982 was then reviewed and discussed Mr Hastie moved approval of the statement as presented. CARRIED Mr Campbell moved approval of the accounts paid in the month of April, CARRIED VILLAGE OF ACME GRANT FROM ALTA TRANS. BANK STATEMENT ACCOUNTS 1982 �J 0 • The Village of Linden has filed an appeal against Development permit number 572 -82 (Ellis Reamer) and Mr Boake moved that the date for the hearing be set for May 25th, 1982 at 2-00 P M , in the M D office in Three Hills CARRIED Lorne Penner and Dave Fuller entered the meeting at this time Tenders received for the backhoe work on the Huxley Water pro3ect were then opened as follows- 1 2 Ed's Backhoe Service, Trochu $2 95 per running foot for 9 foot depth L F P Construction Three Hills, $8 75 per lineal meter 3 meter depth Hourly rate $40 00 per hour Hourly rate $37 00 per hour DEV APPEAL HEARING E REIMER 572 -82 BIDS FOR i HURLEY WATER PROJECT _ 1 3 4 Kneeh>_ll Evcavating $9.40 per meter , Hourly Rate - cubic yard backhoe $81 00 plus labourer $18 50 per hour Dave Fuller, Carbon - $3 50 per meter, Hourly rate $35 00 per hour Mr Penner and Mr Fuller left the meeting Council agreed Mr Cunningham should review the prices and come in with a recommendation later today MEETING WITH There was brief discussion about the meeting today with Hospital Board members HOSPITAL and Mr Ferguson indicated he felt very strongly the M D should have members BD on the hospital board even if it necessitated a change in ward boundaries The need to pass a by -law to establish recreation grants to the towns and 1982 URBAN GRANTS villages for the URBAN g year 1982, payable in 1983 was then reviewed CENTERS Mr Campbell moved first reading to by -law 976 this being a by -law to By -LAW 976 establish recreation grants to the urban areas for 1982,such grants being payable an 1983, in the following amounts Town of Three Hills $18,541 02 Trown of Trochu $13,370 41 Village of Acme $ 6,959 66 Village of Carbon $ 6,969 66 Village of Linden $ 6,969 66 Village of Torrington $ 9,243 41 City of Drumheller $ 5,733 08 II Total $67,766 90 Il Carried Mr Ferguson moved second reading to this by -law Carried Mr Boake moved that third reading be given to this by -law at this time Carried Unanimously Mr Hoff moved third reading to this by -law Carried J C JEFFERY REPORT Mr Jeffery reviewed his report covering the period April 26th to May 10th, 1982 and the following items were discussed. 1 Allied Chemicals advise not to use Calcium Chloride on the Buffalo Jump Park Road as it will not work It was agreed to leave the road as is for this year, except possibily some oil for dust control 2 Mr Rodger advised he did not wish to accept the position as Grade Foreman Rick Vickery and Lyle Gelinas have agreed will handle the crew for the time being until a replacement is located Mr Dorn has been very helpful to all and is working well on the crew The possibility of not hiring a replacement for the grade foreman was discussed at length, the idea being others assume more responsibility for the work involved Mr Maerz moved that the M D advertise for a person to fill the grade foreman position, both within and outside the M D employees MOTION DEFEATED The possibility of increasing the sub - foremen's rates was then discussed n • • AdW COUNCIL MEETING MAY 10th, 1982 as well as how the added responsibilities would be divided men There was also discussion about whether Rick Vicke: accept the position of grade foreman and it was noted he does not feel he would want the position Mr Ferguson moved that the crews be requested to carry on on a temporary basis for the next two weeks or so, and appointments be set up for Mr Vickery, Mr Gelinas and Mr Rempel for the next meeting of Council Carried The remainder of Mr Jeffery's report will be discussed later in meeting Mr Jeffery reports that Stat Canada will not be able to supply population breakdowns by townships at this time and the information may be available some time next year if Ottawa decide to undertake the work After discussion of this matter and the federal census figures for the M D , Mr Campbell moved that the M D undertake a 1982 census with same to be completed prior to June 30th, 1982 There was further discussion about what should be included in the census form and who might be hired to do the work, and the amount of compensation payable It was agreed to get more information about this and discuss it later today Mr Jeffery then continued with his report. Culvert at B Gibson - N of 10- 30 -23 -4 cannot be replaced by Bud Haskell will require small crew to do the work It also appears that the machinery and men from the small crew will be busy doing stripping various culvert jobs and will not be able to go onto the small crew road projects for at least 6 weeks. GRADE FOREMAN POSITION 1982 CENSUS Gr Y� Ge r su 5 J J r1r YERY REPT . Mr Maerz asked that the ditch in NW 33- 31 -25 -4 be deepened so the water would run north rather than into his land - Item Number 21 on Mr Jeffery's report. The need for a bull crusher at the Garson Pit and possibility the Megli pit was discussed and agreed Linden Contractors should get a price for hiring ✓� a bull crusher and report to council at the next meeting Mr Hazelton would like to purchase the old Torrington Gravel Pit from the M D, and Mr Campbell moved that the M D not sell the Torrington gravel pit CARRIED Mr Ferguson and Mr Maerz left the meeting at this time, and the meetinglNNER adjourned for dinner between 12 30 P M and 1.30 P.M Mr Ellis Reimer entered the meeting to discuss with council's its recommendation for refusal of his subdivision application - isolation of farm house on NE 25- 30 -25 -4 The M D had recommended refusal due to the proximity of the house to the existing feed lot on the quarter section MEETING WITH E REIMER PROPOSED SUB. NE 25- 30 -25 -4 Mr Reimer presented his views on the matter and his reasons for requesting the subdivision He has not been able to sell the entire quarter section with the feed lot but could sell the new house and about 8 acres of land This would give him sufficient capital to construct a new home on land south of the Village of Linden where he has his broiler operation He noted the house is 800 feet from the closest pen and is uphill from the feed lot The capacity of the feed lot now is between 1500 and 1800 head and Mr Reimer noted it likely could not be increased due to insufficient water on the quarter After discussion of this matter with Mr Reimer he was advised council would discuss the matter further and he would be advised of their decision later Mr Reimer left the meeting VIN Council then discussed the matter further but made no change in the recommendation for refusal of the subdivision J C i k2,kERY Mr Jeffery then continued with his report SORT Three HIlls School have asked if the M D would accept donations from people toward improvement of their school yard and after discussion Mr Boake moved n ll • • COUNCIL MEETING MAY 10th, 1982 . , that the M D agree to accept donations from people towards unprovement of the Three Hills School yard and give receipts for such donations Carried Mr Hoff reported on the recent road study meeting and noted that SR 575 from Hesketh to Krikpatrick will be worked on in 1982 Various othe reads jn the area were discussed as well It was suggested that the condition of the Buffalo Jump Park Road be referred to Alberta Parks and Recreation The Rosebud south road will be reconstructed by Wheatland in 1982 Mr Hastie attended the meeting and presented his views on the road from 583 north to SR 816 (Gorr Road) Mr Hastie moved that the M D contact Alberta Parks and Recreation about the condition of the Buffalo Jump Park Road, and request their department consider making improvements to it Mr Campbell moved acceptance of the report given by Mr Hoff reed Carried Mr Jeffery noted that the 1982 road surfacing material will be purchased from Pounder Emulsion at the prices quoted in his report He also noted a 20,000 gallon tank had been ordered from Bomega Metals The company allowed the M D $18,000 00 trade on the old 8000 gallon tank Mr Hastie moved that the M D approve the purchase of the 20,000 gallon tank at a net cost after trade of $28,000 00 Carried Request for first time gravel on the road west of 16- 31 -24 -4 was discussed and Mr Berdahl moved that first time gravel (screenings) be put on this road if the foreman feels the road is suitable, and further moved that the necessary gravel ends signs be erected at the end of the mile of road Carried Mr Hoff noted that Mrs Calhoon from Swalwell (2- 30 -24 -4 has requested permission to erect a sign 'Slow - Children Playing" and it was agreed she could do so - People have requested a sign be put up on the SR 575 to indicate which is the Grainger Road Mr Campbell moved acceptance of the report given by Mr Jeffery Carried Mr Cunningham entered the meeting and the bids received for the Huxley Water backhoe work were briefly discussed and Mr Campbell moved that the bid submitted by Mr Dave Fuller of Carbon be accepted The minutes from the Road Tour held on May 6th were reviewedried The committee recommend - 1 Installation of a low level crossing in the creek south of 27- 30 -26 -4 rocks only - no cement - this fall or next fall RVAN t?u rc- k C, T� h k. f W Mr Boake moved that a low level crossing be installed at this location j as per the recommendations from the Road Committee IIII Carried 2 Recommend first time gravel for the road south of 16- 29 -22 -4 Dave wing west I i+ Mr Hoff moved approval for first time gravel for this road 3 Pan Canadian 1982 P Carried roject West of 18- 29 -22 -4 Mr Boake moved that the M D supply culverts (up to 24" culverts) and gravel for this road project 4 B Baird Dam - water level is stationery at the top of the Carried 5 Carney Dam was also inspected - water is right at the edge of the road, and could cause damage Mr Campbell moved that Mr Baird be requested to lower the spillway on his dam by at least 3 feet to drop the water level to the bottom of the existing culvert, and further moved that Messrs Carney be asked to come to the next meeting of Council and discuss the dam location with Council Carried i • • • 0 COUNCIL MEETING MAY 10th, 1982 P 5 Baird South Culvert - replacement of the culvert would not solve the problem, build up of the road would be necessary to solve it Mr Hastie asked if the Ross Hill had been tested to see if it was sand or clay and it was agreed this be done immediately AAMD & C advise that rooms have been reserved for the Fall Convention and FALL Mr Hoff moved that 8 double rooms be reserved at the Western Hotel for the ✓CONVENTION convention Carried The Association are preparing an anniversary handbook for the 1983 ANNIVERSARY convention and it was agreed that a group HANDBOOK g g p photo be taken and submitted for inclusion in this book %A CONVENTION The Association are also up- dating the Association History Book and request an up -date from the M D for inclusion on the book The possibility of having Mr G King assist with preparation of the up -date was discussed and agreed this be discussed with Mr King later today Mr Hastie moved that the M D purchase 20 copies of the History Up -date and offer same for re -sale to anyone who might be interested in same Carried Alberta Transportation report that a 90o ban should be retained on 806 from 583 south to the M D Rockyview Boundary Other bans on heavy pavement could be removed Mr Campbell moved that the road ban be lifted from heavy paved roads with the exception of that portion of 806 from SR 583 south to M D 44 which will be set at 900, and the ban remain in effect on all light coat surfaced roads Carried Mr. G G King and Mr Art Chamberlain, Members of the Three Hills Hospital Board entered the meeting at this time - 3 30 P M ASSOC HISTORY BOOK t ROAD BANS THREE HIIJc- HOSPITAL MEETTNC, They wish to discuss with council adding two members from the M D Council to the Hospital Board The present board has 5 members, and according to figures calculated by Mr King that number of members represents reasonably fairly the rural and urban people within the Three Hills Hospital Board area Four of the members represent the rural area and Acme and Linden and one member represents the Town of Three Hills The Hospital Board suggests that the present hospital board be named to continue on the new board until the elections in 1983 and between now and then a study be undertaken to review the existing ward boundaries and the number of people who should be appointed or elected to the hospital board It was noted the ward boundaries have been in effect for many years and likely should be reviewed as they may now not accurately represent the changing population It was noted that the M D will be undertaking a census and information from that would be helpful for this study Mr Chamberlain asked if council would re- consider its motion to have two additional members appointed to the board at this time and leave the board as is until 1983 elections He also noted that control of costs is difficult becasue 70o of the costs are for salaries, and a large portion of the costs are for food, and utilities etc It was also noted that the Minister of Hospitals has the final authority to change any ward boundaries or to make any decision concerning the operation of a hospital board Mr Chamberlain and Mr King noted that the next meeting of the hospital board is May 12th, 1982 at 7 30 P M , and the two council members are at liberty to attend as a viewer any hospital board meetings However most board meetings are not open to the public Mr Chamberlain left the meeting at this time Council then asked Mr King if he would be interested in assisting with the up -date of the history of the M D since 1969 and if he would be interested in assisting with the M D census He indicated he would likely be able to do this and he then left the meeting Ye' � 4 A Mr Hastie moved that the request from the Hospital Board be tabled until the next meeting of Council Carried Mr Campbell moved that the M D accept the requisition from the Three Hills W I n N �3 • A COUNCIL MEETING Hospital in the sum of $15,966 00 MAY 10th, 1982 Mr R W Brown of Acme has asked if the M D would return to him an old CANCELL road diversion in NW 36-30-25-4 The old road diversion is no longer L OLD ROAD required for public access, and the original road allowance could be l,JDIVERSION :developed should that access be required in the future NW 36-30-25 - .,�After lengthy discussion of this request Mr Campbell moved that the q ,/ M D request Alberta Transportation to close trhe old road diversion in c 'r NW 36- 30 -25 -4 1� 11 acres more or less and it approved the v;,3 r M D return the land tot _ 1 t1' W1 `sub ' ect to ° consolidate n'back Ito title with the balance of the quarter section 17W Carried Mr Hastie reported that before the streets in Wimborne can be unproved with light coat surfacing or calcium chloride, one street must be cut down to improve the drainage The water now runs over the sidewalks and into people's property Also something should be done about the old United Church property It is a definite fire hazard and unsightly Perhaps the dirt from the street could be used to fill the depression on the United Church property Lowering the street would take about 1 day Mr Jeffery noted that Alberta Transportation have advised the sum of $14,000 00 will be made available to the M D for street improvement in Wimborne in 1983 It was agreed Alberta Transportation must be contacted to see if the grant would be available in 1982 or 1983 STREET IMPROVE WIMBORNE Mrs Wilkinson left the meeting at this time 4 45 P M \ After discussion of the matter and noting that the church is attempting to arrange a meeting to discuss the future of their property in Wimborne, Mr. Hastie moved that the M D have a scraper lower the level of the main street in Wimborne to improve the drainage,and the matter be discussed again at the next meeting of Council when further information is available concerning the possible disposition of the church property and the availability of the grant monies Carried There was discussion about speed zone signs on the SR 806 at the Linden BY -LAW intersection and the need to have a warning sign further back from the 977 intersection It was also noted that the by -law 880 does not authorize a s SPEED ZONE at this loeatlon peed zone sign After discussion Mr Boake moved first reading to by -law _977, this being a by -law to amend by -law 880 an3set a maximum speed limit on the road West of Section 20 & west of Section 29- 30 -25 -4 of 50 Kilometers per hour, and known as the Linden Intersection Carried Mr Campbell moved second reading to this by -law Mr Hastie moved that third reading e Carried g given to this by -law at this time Mr Hoff moved third reading to this by -law Carried Unanimously It was agreed a warning sign should also be put up Carried The proposed annexation of the Town of Three Hills was discussed and it wasRFF HILLS agreed that some recommendations should be drafted Mr Hoff moved that ANNEXATION the M D request C R P C assist the M D to oppose the proposed annexation to the Town of Three Hills, with the exception of areas #5 and 9 as shown on their proposal Carried PAY FOR Mr Campbell moved that the M D pay census takers the sum of 50� per capita CENSUS and 40� a mile for all mileage incurred while taking the census, and a $50 00 fee with no mileage for attendance at the information seminar The need to call for tenders for h Carried I BERRETH STOCK discussed and Mr Berdahl moved that tenders bercalledtink the lsame tmanner PILE as last year Mr Hoff noted Mr I Berreth would like to Carried se Mr Campbell moved that the M D not sell the site the stock pile site, and Town of Trochu request a meeting with the M D and other urban ried Car to discuss I� U U COUNCIL MEETING MAY 10th, 1982 Y / the possibility of this area transferring into the Palliser Regional MEETTING RE: PALLISER Planning Commission area, and Mr Boake moved that a meeting be COMMISSION arranged for May 31st, 1982 at 1 30 P M , with all towns and villages and representatives from Pallser Commission in attendance.
