G A Berdahl, Otto Hoff Robert E Boake Richard A Maerz T A Ferguson Bruce Hastie R G Campbell Divison 1 (REeve) Division 2 Division 3 Division 4 Division 5 Division 6 Division 7 w U iJ C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Miss Evelyn Mattson, Trustee, Three Hills School Division Following completion of the Court of Revision , the regular meeting of Council H commencing at 11 00 A M APPROVAL OF MINUTES 11 Mr. Ferguson moved approval of the minutes of the meeting of April 15th, 1982 MEETING WITH E E R C B request time to meet with Council to discuss the effects of the new Energy Resource Conservation Act on road construction, and it was agreed this meeting would be held with the Board on May 11th, 1982 commencing at 10:00 A M , and all councillors would attend if possible H WALTER Harry Walters requests permission from the M D to remove and sell trees from M D road allowances After discussion Mr Ferguson moved Mr Walters be given permission to remove trees from M D road allowances on condition he level the site after removal of the tree, and that he consult with the local councillor involved prior to removal of any such trees Carried R CB TREES ON ROAD ALLOWANCES HIGHWAY #21 Henry Kroeger, Minister of Transportation advises improvements will be IMPROVEMENTS made to Highway #21 within the next 5 years Mr Campbell moved to accept and file as information Carried ROAD STUDY MEETING The minutes of the recent Road Study Committee meeting held April 23rd MINUTES were reviewed briefly and it was noted the recorm endations of the committee will be taken to the Commission meeting on April 30th, 1982 and Mr Berdahl-' It was agreed Mr Hastie would attend this meeting with Mr Hoff /if possible Mr Hoff moved to accept and file the minutes of the committee meetingaas information M0BIGOLD Representatives from Msrigold Library System ask if Council would hear the LIBRARY presentation about the library system again Mr Ferguson moved that Council not hear the presentation again Carried ALLEN REIMER Allen Reimer Mr Hoff reported on his recent meeting with Mr Aen Re He and SW 7- 31 -24 -4 Mr Dorn discussed the problem with Mr Reimer and Mr Reimer agreed he would fill in the hole he created in the M D ditch WSW 7- 31 -24 -4 and back slope the area involved This may necessitate moving a power pole which is located on M D road allowance and this would be the responsibility of Mr Reimer or the Power Company After discussion of the matter, Mr Campbell moved to accept the report given by Mr Hoff Carried It was agreed Mr Hoff follow up on the matter to ensure the problem is rectified MAIN CREW STER A Mr Jeffery reported the Main Crew cannot start work yet on the Krusky project KE PROJECT, i - can they move to the Kester Project and it was agreed this would be satisfactory -04 Mr Hoff also reported there may be a problem with culverts filling up on road allowance E/E 2 of 12- 31 -25 -4 as the land owner has broken up two draws on his property and this may allow the soil to wash down the draws and fill CULVERTS EEZ 12- 31 -25 -4 • • the culverts APRIL 26th, 1982 COUNCIL MEETING P 2 SWALWELL LADIES Mr Jeffery read a letter from the -)wa-Lwell Ladies Club about the Capital CLUB not printing their weekly news of the community Mr. Jeffery aso reported ��on the Capital's response to him about the complaint It appears Capital has printed the Swalwell news /13 issues out of the last 16 and when it is missed one week it will be put in the next week The Capital will not leave out advertisements in order to put in weekly news items After brief discussion Mr Ferguson moved that the Ladies Club be advised the information received by the M D about their complaint Carried ,,Of se d COMPLAINT ABT CAPITAL JURISDICTION Alberta Energy & Natural Resources (Fish & Wildlife Division) a vi OVER LADS the M D does not have jurisdiction over the water in Keiver Lake and (KEVIERS & Swalwell Dam, and it is the governmeW�zld establish the classification SWAL�nE L) of lakes, taking into consideration recommendations from the local municipalities There are several classifications - including prohibiting all types of vessels, prohibiting power vessels , prohibiting powered vessels except for electric motors , and speed limits which can be applied After discussion of this matter, Mr Maerz moved that the government be requested to put Keivers Lake and the Swalwell (Fyten) Dam into the classification which allows no type of motor powered vessel CARRIED Bids received for purchase of the old M D sheepsfoot packer and the old Ivlackfuel truck were then reviewed Cranston Construction Bid for 60 inch sheepsfoot packer $2200 00 Hobbema Farms - for old fuel truck without ptunp and meter - $3000 00 SALE OF USED MACHINERY Mr Hastie moved that the packer be sold to Cranston Construction for $2200 00 and the old Madcfuel truck be sold to Hobbema Farms for $3000 00 on an as is, where is, basis CARRIED Brownlee Fryett, Solicitors have drafted an agreement betweenthe M D and Jack Barnes of Carbon concerning the dugout on his property - NW 19- 29 -22 -4 After review of the agreement, Mr Campbell moved that the dugout be filled in if Mr Barnes is willing to sign the agreement CARRIED Mr Maerz reported on the results of his survey of the residents of Grantville and Ruarkville and the local farmers who might be affected by the proposed ;Three Hills annexation There were 3 undecided, two in favour and the rest were opposed He noted he had contacted all the residents of the hamlets and most of the farmers involved He had not been able to contact two farmers and it is likely they may be in favour Some of the reasons given for being opposed were - loss of snow plowing by the M D , possible loss of school bus services and quite happy with the present situation JACK BARNES DUGOUT Miss Mattson noted that the School Division does require additional land for its town school in Three Hills It was noted that the School could acquire land for school purposes even through the land might be in the M D , and the owner of the land which the school would like to acquire would not have to sell even if the land was annexed and further that the owner of the land in question is opposed to the annexation miss Mattson noted the school would likely require ,about 5 acres for a larger school ground and track area Mr Ferguson moved that the M D contact Mr Donald Anderson, owner of the land, to discuss the ;possibility of Mr Anderson selling a parcel of land to the School Division (sufficient for their require'P;tand further moved that the Local Authorities Board be advised the M.D is opposed to the annexation proposed by the Town of Three Hills CARRIED Mr Jeffery read a letter from Ron Sommerville in which Mr Sommerville claims costs from the M D for damages he claims were caused to his vehicle by gravel coming off an MD gravel truck After discussion of the matter, Mr Campbell moved that the M D not accept any responsibility for this claim. CARRIED ljThe subsidy which the M D had established for the Drumheller Ambulance Service in May of 1978 was reviewed It was noted the service had never billed the M D for this subsidy After discussion of the matter, Mr Hoff moved that Mr Berdahl and Mr Ferguson meet with the Drumheller Ambulance Service to discuss E&I, Il matter CARRIED THREE HILLS ANNEXATION A PON SOMMERVILLE DAMAGE CLAIM 0 DRUM AMB SUBSIDY the 0 U C COUNCIL MEETING APRIL 26th, 1982 P 3 J C u rr r r:tc� Mr Jeffery gave his report covering the period April 15th to April 26th, 1982 REPORT and the following items were discussed likely discussion 1 John Dorn - problem about /losing his licence After lengthy of the matter and Mr Dorn's problem with alcohol, it was generally agreed that Mr Dorn must be demoted from his position as grade foreman, but not fired as he has been with the M D for quite a number of years The matter of who could replace Mr Dorn as grade foreman was discussed in detail Mr Vickery, sub foreman has indicated he will be going farming full time if and when he can obtain sufficient land to do so, Lyle Gelinas is capable of taking over from Mr Vickery when Vickery as snabsent, Oris muc Rodger has s worked on the main crew in the past, Georg Rempe road construction It was also generally agreed that Mr Dorn will have to be demoted regardless of whether he loses his licence or not, and that any consideration for promotion in the future would depend on his work at that time and if there is an opening for a better position GRADE FOREMAN Mr Hastie moved that Mr John Dorn be demoted from the Grade Foreman Position POSITION effective immediately, but he remain in the employ of the M D on a salary V^ basis, with his salary to be dependent upon what position he is given CARRIED Mr Oris Rodger was called to the Council meeting and he entered the meeting at this time He was advised of the decision of council to demote Mr Dorn from t1aGrade Foreman position and asked if he would be willing to take the job as Grade Foreman After lengthy discussion with Mr Rodger, he agreed to consider the matter and come back to the meeting later this afternoon The meeting then adjourned for dinner MISC PUBLIC WORK 2 ITEMS The following public works problems were then noted. 1 Water Problem S /SE 5- 28 -20 -4 - ditch needs cleaning - cutting gullet' 2 NW 33- 31 -25 -4 water running into R A Maerz land to the east of Mary McFarlane land - check the location of culvert 3 R E Boake requests inspection of bridge 4 miles west of Linden on pavement - S /SW 27- 30 -26 -4 - bridge too narrow for equipment to cross Check for possible low level crossing at this location 4 Check out waterproblem at Manor Cemeter - fence, culvert and road approach 5 Check Read North of 9- 32 -24 -4 (Krusky Project) water running under culvert 6 Check into claim M D removed fence when brushing the Oelke Road -(Earl Jorgensen) and did not replace - 30 -22 -4 - culvert caved in and backing 7 South of Joe Baird Residence ENE 28 water up gpp,D COMMITTEE 8 Must purchase land for road improvements on SR 575 It was agreed the Read Committee would meet Thursday, April 29th, 1982 at 8-30 A M pFRTAT PHOTO 3 Need for new aerial photographs Mr Dunay requested new photographs be taken to assist him with the general assessment After discussion Mr Campbell moved that new aerial photographs not be taken at this time CARRIED R BUYER Mr Jeffery reported that Mr Reg Buyer of Carbon would be willing to rent TRACTOR & the M D his tractor and dozer for use on the Huxley Water Project (unit would DOZER be used about 2 hours per day) without an operator, on condition the M D HUXLEY would pay him for the two hours work at 1982 government rates including operator's WATER wages P � After discussion of this matter, Mr Boake moved this arrangement would be Abe X satisfactory, on condition that no one from the Huxley area was interested in undertaking this job CARRIED SWALWELL 4 The Swalwell residents are again expressing concern over the fire hazard FL TS HAZARD ` created in the hamlet by the vacant lots not being taken care Mr Hoff also noted that the lots in the south west corner of the hamlet �Q�c should be cleaned up After discussion of the problem, Mr Berdahl moved PJ v I-OW COUNCIL MEETING APRIL 26th, 1982 P 4 that Glenn Schmaultz and any other owner of land in the hamlet whose property is not looked after be sent a written notice to clean up the propoerty and cut the grass within 30 days of the date of the notice, failing which the M D will undertake the work and charge the costs to the property CARRIED Mr Hastie moved that this meeting do now adjourn in order to hold the public hearings scheduled for 1.30 P M , 1 45 P M , and 2.00 P M Mr Larry Martin and Mr Greg Houghton, representatives from C R P C entered the meeting at this time - 1.30 P M Alex Cunningham also entered the meeting After completion of the public hearings the council meeting resumed By -Law Number 968 was then reviewed, this being a by -law to redesignate SW 3- 32 -24 -4 from ag conservation to agriculture Mr Ferguson moved second reading to by -law 968 Carried Mr Maerz moved third reading to this by -law Carried HOLD PUBLIC HEARINGS "I BY -LAW 968 REDESIGNATION SW 3- 32 -24 -4 Y BY -LAW 969 By -Law Number 969 was then reviewed, this being a by -law to relax the RELAXATION OF maximan parcel size for an isolation of existing farmstead on NW 24- 29 -25 -4 MAX PARCEL SIZE from 10 acres to 12 57 acres NW 24- 29 -24 -4 Mr Hoff moved second reading to this by -law Carried ,. j Mr Ferguson moved third reading to this by -law Carried BY -LAW 97U By -law Number 970 was then reviewed, this being a by -law to redesignate REDESIGNATION SW 22- 29 -25 -4 from ag conservation to agriculture to allow for a n SW 22- 29 -25 -4' intensive ag subdivision Mr Ferguson moved second reading to by -law 970 Carried J Mr Boake moved third reading to by -law 970 Carried APPLICATION Mr Larry Shaw then entered the meeting to discuss with Council his REDESIGNATION application for redesignation of the NW 9- 31 -26 -4 He wishes the I NW 9 -31 -26 redesignation in order to proceed with an application to subdivide and sell L SHAW a 70 acre parcel off his quarter This would generate sufficient capital for him to construct a dairy barn Mr Shaw then left the meeting BY -LAW 975 f Mr Maerz moved first reading to a by -law 971, to amend by -land 913 REDESIGNATION to redesignate the NW 9- 31 -26 -4 from ag conservation to agriculture Carried NW 9- 31 -26 -4 Mr Campbell moved that the public hearing for the redesignation be held on Tuesday, May 25th, 1982, at 1 00 P M Carried SUBDIVISIONS The following subdivisions were then reviewed• 1 NW 24- 29 -24 -4 - Isolation of Existing Farmstead 12 57 acres - R Zeigler 1,1r Campbell moved that the M D recommend approval for this subdivision, subject to normal conditions Carried i� 2 SW 22- 29 -25 -4 - C Unruh - 20 acres There was lengthy discussion about creating subdivisions for proposed intensive uses, and the means of enforcing development of the proposed subdivision after subdivision. It was noted that Mr Unruh had not yet applied for development permits for the use of the proposed 20 acres and the plans for development of the 20 acres were not definite at this time Mr Maerz moved that Mr Cunningham contact other municipalities and find out what their redesignation policies are, whether they use bonds or letters of credit to ensure development of the intensive operation on the subdivision, what is involved in developers agreements and any other VN N �8 Jpei 0 • COUNCIL MEETING APRIL 26th, 1982 P 5 information that is available and report back to Council as soon as po�sslble Mr Ferguson moved that the M D recommend approval for the 20 acre subdivision on SW 22- 29 -25 -4 subject to normal conditions and subject to the applicant taking out the necessary development permits for the intensive dairy operation proposed COED 3 SW 8- 31 -25 -4 - Allen Thews 9 18 acre isolation of existing farmstead It was noted there is a house and a mobile hone on the proposed subdivision and an intensive farming (dairy) operation is carried on from this location After discussion of the matter, Mr Maerz moved the application be tabled until further information can be obtained about the proposed use of the subdivision CARRIED 4 SE 18- 32 -25 -4 - Old Mill Farms 6 4 acre isolation existing farmstead Mr Boake moved the M D recommend refusal of this subdivision CARRIED f It was agreed by Council that C R P C should review the M D land use by -law to see if the regulations concerning isolations of existing farmstead and intensive agriculture subdivisions could be strengthened The representatives from C R P C agreed they would do this and report back to council around May 25th 5 NE 25- 30 -25 -4 - 7 23 acres - Isolation of Existing Farmstead Ellis Reimer Mr Hastie moved that the M D recommend refusal for the subdivision as the isolation of the existing home would create a residential parcel immediately adjacent to an existing intensive feed lot operation, and would likely restrict future expansion of the feed lot operation CARRIED I! 6 NW 9- 31 -26 -4 - Larry Shaw 70 acre subdivision _ Mr Maerz moved this application be tabled until after completion of the public hearing set for May 25th, 1982 CARRIED 7 G Machell - SW 3- 32 -24 -4 - 40 acre subdivision- Mr Maerz moved the M D recommend approval for the subdivision subject to normal conditions and subject to the applicant taking out the necessary development permits for the use of the proposed subdivision as an intensive ag operation CARRIED The application for an amendment to the land use by -law to allow for 4- plexes in hamlet areas was discussed and Mr Maerz moved to table the request until he can obtain further information from the residents of the hamlets as to whether they would wish 4- plexes in their hamlets CARRIED Mr Oris Rodger entered the meeting at this time and indicated to council he would likely prefer to keep the job he presently has, rather than taking the grade foreman position After lengthy discussion with Mr Rodger he agreed to try it on a trial basis, if he could resume his former position as utility forman if the new job did not work out The placement of Mr Dorn on the main crew was i5riefly discussed and agreed the sub foreman and new grade foreman would have to decide what Mr Dorn's • position on the crew would be The application received from Gary Schneider of Torrington for employment was discussed It was noted Mr Dorn had indicated previously he did not wish to re -hire Mr Schneider, but Mr Vickery had indicated Mr Schneider was a good worker and would like him back on his crew It was agreed this matter would be left to the discretion of the sub foreman and new grade foreman Mr Ferguson moved that Oris Rodger be appointed as Grade Foreman on a trial basis effective April 27th, 1982 CARRIED I f 4- PLEXES IN HAMLET AREAS v GRADE FOREMAN POSITION ORIS RODGER�` � d s OY • COUNCIL MEETING APRIL 26th, 1982 P 6 Mr Hastie reported that Mr W Faught, owner of SW 1- 35 -25 -4 is not willing to sell the M D land for road purposes at 20 times the assessed value of the land, but would sell for $700 00 an acre Mr Faught's solicitor is sending down an agreement signed by Mr Faught at $700 00 an acre It will likely require purchase of about 22 acres of land for the road construction $700 00 an acre is in excess of existing policy Mr Hastie noted that the Mr Faught. will not be able to make any use of the land lying to the south west of the new road as it will be severed by the road, and would be willing to accept $544 00 per acre (20 times assessed value of $2720) if he is paid severance damages at $156 00 per acre It was notedthat the same situation will exist with Mr Walter Tetz, owner of the NE 34- 34 -25 -4, as the M D will have to purchase land for the same road project from Ivir Tetz (20 times assessment of $1800) Mr Boake moved that Mr Faught be paid the sum of $544 00 per acre for land to be purchased from him and $156 00 per acre as severance damages, and Mr Tetz be paid the sum of $360 00 an acre for land to be purchased from him and $156 00 an acre for severance damages CARRIED Mr Jeffery and Mr Hastie left the meeting at this time J The balance of Mr Jeffery's report was reviewed Bomega Metals have offered the sum of $15,000 00 firm for the M D 's 8000 gallon storage tank It was agreed this matter be tabled and discussed again at the May 10th meeting Building permits were reviewed and Mr Hoff moved acceptance of the building permits so issued CARRIED TLTZ FAUGHT ROAD PROJECT C i r r'r rxY REPORT -1-C' "V BUILDING PERMITS TORRINGTON The Village of Torrington has applied for a modified land fill site MODIFIED LAND on PT SE 34- 32 -26 -4 and Alberta Community Health has requested comments FILL SITE from the M D concerning the location of the land fill After discussion of this matter and noting the land fill will be located dust to the north of the existing village sewage lagoon site, Mr Campbell VA h moved that the M D voice no objections to the proposed site CARRIED Mr Berdahl moved that the Village of Torrington be requested to discuss with the M D of Kneehill possible point use of the modified land fill site CARRIED Miss Mattson left the meeting at this time 1982 BLADE The 1982 Blade Grade projects were then discussed as follows. GRADES Division 4 - West of A. Kevier - South of 25- 31 -26 -4 1 mile - W Oelke Road South 30- 32 -26 -4 - should be improved but will require a cat to level the tree stumps etc -�-U �¢ t Division 2 - West of 33- 28 -24 -4 12 miles (f- - East of 19- 28 -24 -4 - 1 mile - West of 24- 30 -25 -4 - 12 miles (this also might require a buggy to fill a low spot) Division 1 - East of 1- 29 -22 -4 - 1 mile - Between Section 33 & 34 in 29 -22 -4 - 14 mile Division 6 - Hoppins North - West of 13 & 24 in 34 -25 -4 - 2 miles will require cat & buggy to move a small amt of dirt for drainage) Division 3, 5 and 7 - none at this time. J DORN Mr Hastie and Mr Jeffery returned to the meeting at this time Mr Hastie reported that Mr Dorn had been advised of the decision of council to demote ham from the Grade Foreman Position He was advised that should his situation change, if he quits drinking, and if a position comes up, he would be considered along with any other employee wha might apply for that position Mr Hastie moved that this meeting continue until 6.00 P M CARRIED The letters from the Three Hills Hospital, Olds Hospital and from the Government on behalf of the Drumheller Hospital were then reviewed and discussed in detail HOSPITAL BOARDS ��r� [-,I 0 34 COUNCIL MEETING APRIL 26th, 1982 P 7 Ivr Ferguson reported on his meeting with the Three Hills Hospital Board and suggested that the M D should recommend two council members be appointed to sit with the existing hospital board members on the new Three Hills General Auxiliary and Nursing Home Board After discussion of this matter, Mr Berdahl moved that the M D recommend that the new Board consist of 7 members, namely five existing board members n G G King, Art Chamberlain, James Bishop, Kay Elliott, and Sam Megli plus R A Maerz, and T A Ferguson Carried Mr Ferguson moved that Finlay Code of Carbon be appointed as representative from the M D of Kneehill on the new Drumheller General, Auxiliary and Nursing f Home Hospital Board Carried Mr Maerz moved that the current members on the Olds Hospital Board Neil Leatherdale, Marilynn Hodgkinson, Frank Heck, Norah Wilton and Wayne Notley be appointed as board members for the Olds General and Auxiliary Hospital and Nursing Home District NO 26, but that the Minister of ✓� Alberta Hospitals & Medical Care be advised this municipality would like to be able to appoint a member to the Olds General, and Auxiliary Hospital and Nursing Home District Board to represent that area of the M D of Kneehill which is within the Olds Hospital District at such time as the 1983 elections for hospital board members are held Carried 3 HILLS The Three Hills Hospital advise that the 1982 requisition against the M D HOSPITAL of Kneehill will be $23,948 00 After discussion of this matter, Mr Maerz REQUISITION moved that a letter be written to the Hospital Board requesting them to reduce the requisition by $21,400 00, this being the amount they will or have received as a down payment on the sale of the existing hospital property Carried J C r r r rtcY The Administrator's report was further discussed Torchinsky Engineering REPOT will undertake engineering for M D road projects in 1982 at the following ENGINEERING prices.
