COUNCIL MEETING APRIL 5th, 1982
A meeting of the Council of the M D of Kneehill #48 was held in the Municipal District
Office, Three Hills, on Monday, April 5th, 1982, commencing at 9.00 A M ,

Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes
APPROVAL OF MINUTES
Mr Hastie moved approval of the minutes of the meetings of March 22nd and March
23rd, subject to the addition of the bid submitted by Gibbs Ford of Three Hills for a truck
on page 4, of the March 22nd meeting

It was noted this bid had been missed in typing the minutes
The following planning correspondence was reviewed.
PLANNING CORRESPONDENCE
1 Submission from the M D of Rockyview concerning regional planning systems
to Minister of Municipal Affairs, together with background report
2 Memo from Ivan Robinson, Director of C R P C to Otto Hoff and Ken Wright
concerning services provided by the Commission to the M D of Kneehill and
the Towns and Villages
It was noted that there is no argument with the commission about the level of
service provided to the M D of Kneehill
3 Brief which was discussed at the March 26th meeting of the rural municipalities
in Rockyview on March 26th The brief outlines the role of the
Calgary Regional Planning Commission and the role of the proposed rural regional
planning comnissi.on and the reasons for forming such a rural planning commission
It was noted that the Minister of Municipal Affairs had indicated at the recent
Spring Convention that he would not consider formation of a rural regional planning f
commission
The need to pursue the possible formation of a rural regional planning commission
was then discussed at length as well as trying to make the existing planning s
commission into more of an advisory board
The resolution prepared by the M.D of Rockyview which requests the Lieutenant
Governor in Council to establish a rural regional planning commission made up of
Foothills, Rockyview, Kneehill, Wheatland was then reviewed, as well as the guidelines
prepared by the Alberta Planning Board for preparation of a new regional plan
It was noted that the revised regional plan appears to be more dictatorial and more
restrictive than the 1980 plan
Ij ROCKVYVIEW GENERAL
LAND PLAN
Mr. Jeffery noted that Mr Cunningham had met on April 2nd with Bill Wray and Dennis
Hawthorne from the M D of Rockyview Rockyview is in the process of preparation of
their general municipal plan They ask if the M D of Kneehill would have any

objections to their municipal plan allowing for the following-
a) Industrial parks (large and small) in the area of Beiseker along highway 9,
it 72, Highway 806 and along the C N R and C P R. railways

b) Highway Commercial Development along Highway #9, #72, and 806 ,
c) Recreation Development along Highways - such as campgrounds.
There was lengthy discussion about this request and the possible problems which
could be created should industrial parks be created just to the south of the M D
of Kneehill borders.
Mr Ferguson moved that the M D of Kneehill #48 support the resolution prepared
by the M D of Rockyview for signature by the four rural municipalities

which resolution requests the government to establish a rural regional planning
commission comprised of Foothills, Kneehill, Wheatland and Rockyview
Mr Berdahl equested a recorded vote

The request for comments from Rockyview about their proposed general
plan was again discussed and Mr Ferguson moved that the M D of Kneehill
would have no objections to the proposals put forth by Rockyview
for their general municipal plan on the following conditions-
a) The M D of Kneehill #48 would be involved in the discussions and decisions
made concerning proposed developments within a negotiated distance of point
Rockyview and Kneehill boundaries
b) Possible tax sharing agreements being arranged for developments within
that negotiated area
SEC ROAD STUDY
Mr Jeffery reported that the secondary rural road study meeting is scheduled
for April 30th, at 1 30 P M and Mr Ferguson moved that Otto Hoff, G A
Berdahl, and R G Campbell be authorized to attend the meeting on behalf of
the MD

1981 CENSUS
Mr Jeffery reported that the M D census figures from the 1981 federal census
are 5641, which is a drop of over 189 people since the 1976 census
There was discussion about whether the M D should conduct a census in 1982
and the costs for same
Mr Ferguson moved that the M D undertake an official census for 1982

Mr Maerz moved that Mr Jeffery obtain more information about what is
required to take an official census and possible costs for same

1982 CENSUS
Further information about conducting a census was reviewed and after
discussion of the matter, and noting that both Hutterite colonies had
split in the last year or two, which would account for a goodly portion
of the drop in population, Mr Campbell moved that the M D not undertake
a census until such time as the township population breakdown is available
from Stat Canada

The accounts paid in March were briefly reviewed and Mr Boake moved ACCOUNTS
acceptance of the accounts so paid

The meeting then adjourned for dinner between 12.00 Noon and 1:00 P M DINNER
Mr Hastie moved that the Council meeting reconvene at 1.15 P M , after
completion of the public hearing scheduled for 1.00 P M
BY-LAW 967
By -law number 967 was then reviewed - the by -law provided for certain BY-L BY -L USE 7 LAW
additional uses in the Hamlet Educational Institutional District
and Mr Ferguson moved 2nd reading to this by -law. AMENDMENT

Mr Campbell moved third reading to by -law 967

Alberta Municipal Affairs have asked if Council would accept a municipal MUNICIPAL INTERN
intern for a one year term The salary would likely be $1500 00 per PROGRAM
month -half paid by the M D and half paid by the government
It was generally felt that the salary range is too high compared to
existing salaries in the office
Mr Maerz moved that the M D not hire a trainee under this
program

Mr Jeffery's report for the period March 22nd to April 5th J C Jktk,kiKz

Miss Joanne Bulanda, representative from the Capital entered the meeting
at this time - 1 20 P M
The following items from Mr Jeffery's report were discussed
1 Work for the main crew - likely will finish the Megli Project MAIN CREW PROJECTS
by April 6th It was generally agreed that upon completion of the
Megli Bridge Project, the crew could try the project south of
18- 30 -25 -4 - which is sandy land - and if the frost is not out
sufficient to do a proper job at this location the crew should be
shut down until the weather .improves
2 Compaction Seminar - Calgary at Costello Equipment COMPACTION SEMINAR
Mr Ferguson moved that Mr Berdahl, and or Mr Campbell attend
this seminar
Carried SERVICE
3 Service mechanics feel they should go out together one or two hours MECHANICS
earlier than the crews rather than staggering their hours HOURS
It was generally agreed this could be done on a trial basis
The crew taking a 40 minute break at noon rather than two 20 minute DINNER BREAK
breaks was again discussed and it was generally agreed this should be FOR CREWS
discussed again with the men It would be more beneficial to the M D
for the men to take only one break per day due to the shorter working hours
It was agreed to hold an employer- employee committee meeting on Monday EMPLOYEE
April 12th, 1982 at 7.30 P M MEETING
4 Paving crew request permission to work overtime if the crew is O/T FOR PAVING
considerable distance away from main shop or if the foremen wish to CREW
to finish a particular project and it was agreed this could be done
at the foreman's discretion
HIRING TRUCKS
Hiring trucks for the paving crew was also discussed and Mr Boake PAVING TRUCKS
moved that the M D hire up to 3 trucks for the paving operation if
required

Stripping at the Garson, Schmautz and Toews gravel pits was discussed STRIPPING AT
and Mr Ferguson moved that the required machinery be taken off the GRAVEL, PITS
crews, if necessary,and the stripping be done as ground conditions
and weather permits, and if possible the work be done before the
main road projects are started

There was discussion about the steamer not being ready when required
this spring
Therewas discussion about the Marrigold Library System and the
$35 00 charge for non - participating members
MR Maerz moved acceptance of the report given by Mr Jeffery

Mr Jeffery reviewed the report of the divisional meetings held in REPORT
March DIVISIONAL
MEETINGS
The following items were discussed
1 Road west of 36 & 25 in 30 -21 -4 - A Bergos south - ditches need cleaning out
both sides before resurfacing done
2 Orkney Hill and Orkney Flat - road in bad shape
3 Culvert in Section 10 -30 -23-4
and Mr Boake moved these matters be referred to the Road Committee

The payment of fire protection by P Grenier - 5- 29 -21 -4 was discussed It was
noted his land is 27 miles away from Carbon and only 12 miles from Drumheller
The possibility of a boundary change was discussed and Mr Ferguson moved
that representatives from the Village of Carbon be requested to attend the
May 25th meeting of Council to discuss a possible eastern boundary change
to the Carbon Rural Fire Protection Area

It was agreed that the Road Committee would meet on Thursday, April 8th, 1982
Mr Hoff moved the reports from the Divisional meetings be accepted and filed

An amendment to business tax by -law 299 was reviewed The rate of 10� per
gallon for anhydrous anrnonia tanks was discussed and Mr Campbell moved
the matter be tabled pending receipt of information from other areas as
to rates charged for this type of business

The need to set reserve bids for lands going into tax sale on May 26th
was discussed, and the suggested bid prices submitted by Mr Dunay, Assessor
Mr Maerz moved that the reserve bid for Part of the NW 12- 31 -26 -4 - 21 of
an acre be set at $200 00, and "further moved that Mr Ferguson be appointed
as agent for the M D to acquire this property for the M D of Kneehill 48

Mr Campbell moved that the reserve bid for Lots 13 and 14 in Block 1 BID
Plam Wimborne 7015 E F , be set at $20,155 00

1983 PENALTY
The need to change the penalty dates for 1983 was discussed and Mr DATES
Ferguson moved that there be no change in the 1983 penalty dates

REGISTRATION
Alberta Local Authorities Board have advised that Long Term Disability L T DIS
Plans may be registered with their office so that a person on long term ABILITY
disability could still pay contributions into the pension fund PLAN
The contributions would be paid by the employer during the period the
person was on long term disability
After discussion of this matter Mr Campbell moved that the M D 's long
term disability plan not be registered with the Local Authorities Board

The possibility of acquiring clear title to certain lots in Grainger CLEAR TITLE
was discussed and Mr Boake moved that the office prepare the required TO LOTS IN
by -law in order to acquire clear title to the tax recovery lots in GRAINGER

The $5000 00 Alberta 75th Birthday funds still held by the M D was ALTA 75th
then discussed. FUNDS
The Linden Care and Share Society has requested the funds to be used
for their proposed senior citizens drop in center
The Village of Linden have requested again that the funds be turned over
to the village for the new skate change rooms at the rink However no
accounts have been submitted by the Village for this project
Mr Jeffery had contacted a Terese Theobold in Edmonton who is in charge
of completion of the Alberta 75o�r�r�am� sStie advises the M D can
give the funds out to the Villag o p f �a�98ther project
- it is strictly a decision of the council

After lengthy discussion of this matter, Mr Boake moved that the ALTA 75 FUNDS
Alberta 75th Birthday grant of $5000 00 be allotted to the Linden TO LINDEN CARE
Care and Share Society towards the construction of the proposed drop in & SHARE SOC
center, and payment of the funds be made to the society on receipt of
a paid invoice from the society for the purchase price of the building

Purr Cunningham reports that C M H C suggest the M D act as agent for PROGRAM RRAP
the M D of Kneehill and the Villages of Linden, Torrington and the
Town of Three Hills for the RRAP program
After discussion of this suggestion Mr. Campbell moved that the M D not
act as agent for the Town of Three Hills, or the Villages of Linden and
Torrington fcr the RRAP program

Mr Cunningham reports that K & K Farms will lease the required land
for the Huxley reservoir site on a 99 year lease basis WATER PROD
Alberta Environment have advised that a 99 year lease would be satisfactory n
and the M D solicitor advises he could prepare a lease that would be
very difficult to break After lengthy discussion of this proposal,
Mr Ferguson moved that the M D again attempt to purchase the required t
land from K & K Farms, failing which the M D should negotiate a 99 year
lease with them for $1 00 per year for the land required for the reservoir site

Mr Jeffery reported on the prices received for road surfacing, and the MATERIAL
comments from the foremen Bomega Metals had been contacted and PRICES &
would supply the M D with a new 15,000 or 20,000 gallon tank A 20,000 STORAGE
gallon tank without heater and axles would cost $46,000 00 They would
not take the M D 8000 gallon tank (without heater) in trade, but would
attempt to sell it for the M D
After discussion of the prices quoted for the surfacing material, and the
price for a larger tank, Mr Hastie moved that Pounder, Chevron and Ace
be advised the M D will require prices for the road surfacing material
again on April 30th, and the prices received will be reviewed again at that
time, and further moved that Bomego be adivsed the M D will purchase a

only on the following conditions-
a) The company take the M D 's 8000 gallon tank without heater and axles
in trade for $20,000 00
b) OR. The company attempt to sell the M.D 's 8000 gallon tank without heater
and axles within the next 30 days,at a price of $20,000 00 and upon completion
of the sale the M D will then enter into a contract to purchase a 20,000
gallon tank

THREE HILLS
Mr Cunningham reports that UMA request permission from the M D to RID DEER RIVER
design an amendment to the Three Hills Water Project to tie into WATER PROJECT
12 inch main from existing 6 inch main, abandon section of 6 " main that
is paralleled by the 12 inch main, remove meter and meter chamber, and add
two hydrants on the 12 inch main The water comsumption would be calculated by
household readings
After discussion Mr. Ferguson moved that the design amendment be approved

A /letter from Robert Nelson, Alberta AGriculture addressed to the Rosebud
Seed Plant was read to Council It noted that the government gives approval
in principal but final approval for the grants will be given when various
requirements are met, in particular when the shareholders' portion of the
cost for the new plant 'is available
Mr Boake moved to accept and file the letter as information

The 1982 budget for the Three Hills Airport Commission was reviewed and
it was noted the M D 's share would be $2600 00 Mr Hoff moved approval
of the budget as submitted

The South Eastern Central Perspectives and Prospects report was briefly
reviewed and Regional Resources note that if the M D is interested in
establishment of a large Regional Development Committee for this area
a representative should be sent to the meeting scheduled for April 14th
in Hanna After discussion of the matter Mr Maerz moved that the
M D not participate in this proposed committee

Halstead, President of New Horizons Group in Carbon was read to the meeting TRANSPORTATION

The 1982 Hamlet Street Improvement Program was briefly discussed and
Mr Hastie moved that an application be made to Alberta Transportation ✓1
for the grant for improvement of the streets in Wimborne and this work
be undertaken in 1982 Carried
A letter has been received from William Isbister concerning topics discussed
at the joint M D and urban meeting held in February
He noted that if all agree there should be no problem about transferring from
the Calgary Regional Planning Commission area to the Palliser Commission area

Mr Hoff reported that Palliser is presently having their new regional plan
printed and will be sending copies of the plan to the M D shortly
Mr Berdahl reported on his recent attendance at a Palliser Commission meeting i
This was for information only There are 18 members n the Palliser Commission
They have 9 persons on their regional plan committee, 6 on staff and 6 people
sit on the subdivision committee Their budget is $360,000 00
It appears likely that the towns and villages in the M D area would be favourable
to the move to Palliser. AFter further discussion Mr Hoff moved that

Mr Jeffery read a letter from Palliser Regional Planning Commission PALLISER COMM
regarding the possible move over to Palliser and also reviewed
other information forwarded by the Palliser Commission
It was agreed that this correspondence be tabled and reviewed again
at a later date

The need to pass a by -law to establish 1982 recreation grants was RURAL
discussed, as well as payments made to the rural communities and ORGANIZATIONS
towns and villages in 1981
