crossing agreements , l Z�t 1 • COUNCIL MEETING JANUARY 25th, 1982 P 4 There was brief discussion about the request from the Town of Three Hills for the M D to store the town garbage truck inside during the winter and it was noted that there is no room in the M D shops to store this vehicle Mr Jeffery read a letter received from the Town of Three Hills at the joint fire meeting held on January 20th 1982, in which the town advises it wishes to cancel its fire agreement with the M D , and further advises that the town will provide fire protection to the rural area on a contract basis There was discussion about this matter, and it appears the town is unsatisfied with the contribution the M D is making towards fire protection THREE HILLS GARBAGE TRUCK STORAGE JOINT FIRE MEETING & TOWN THREE HILLS CANCELLATION OF FIRE 1 AGREEMENT Mr Jeffery then reviewed the minutes from the recent fire meeting, and the following requests were m ade at that meeting 1 Trochu - increase the rate for hauling water to fires from $10 00 a load to $15 00 per load Mr Ferguson moved that the rate be increased to $15 00 a load Carried 2 Trochu - Supply them with a tandem water truck for the winter months Trochu was advised this was contrary to existing M D policy and could not b 3 Carbon - feel there should be a charge for highway fires i C.laicd 4 Torrington - received approximately $400 00 for fighting fires - should they turn this money over to M D or keep it for the department After discussion of this matter Mr Hoff moved that the funds be left with the Torrington Fire Department with Mr Hastie moved that this matter be tabled until after the Three HIlls Fire Department situation is resolved Carried � \C d Mr Campbell noted that there is an area in Mt View just across the M D r G boundary which has no fire protection and the Olds Fire Department will not come out into that area or into the M D of Kneehill should help be required There was discussion about the possibility of charging farmers in that particular area of Mt View if the Torrington - Wimborne fire department go to a fire there Mr Campbell agreed he would discuss this matter again with the Fire Chief for that area and bring the matter back to council later The budgets for the fire departments were then reviewed and it was noted that the Linden budget figures are incorrect Everying with the exception of vehicle maintenance and repairs ($1000 00) should be doubled kA It was noted that the Carbon Department is having problems with communications � as their pagers will not work, and it was agreed that a meeting should be held with the Carbon department to resolve this problem Mr Ferguson moved that the fire department budgets be tabled until the other problems can be resolved Carried 1982 GRAVEL Mr Boake moved that the 1982 gravel royalties be set at 40� per yard ROYALTIES Carried C� A date to review with the A S B its 1982 budget was discussed and agreed -„ this be done on Monday, February 8th, 1982, in the morning J BARNES Mr Schumacher Solicitor for Jack Barnes has forwarded another letter DUGOUT concerning the dugout on Mr Barnes' land and the need for guard rails around the dugout After discussion of the problem, Mr Campbell moved that 11r Berdahl and Mr Hoff discuss with Mr Barnes whether he still requires the dugout and report back to Council Carried WRITE OFF, The following unpaid 25th, 1982 P 5 WRITE OFF After discussion Mr Hastie moved that the three accounts be written off WATER Carried ACCOUNT The site for the Huxley Reservoir was briefly discussed and Mr Campbell roved to table this matter until the next meeting of Council HUXLEY WATER Carried PROJECT Alberta Bridge Branch advise that there are no plans to replace the REPORT RE Allingham Bridge in 1982, although they did some survey work at this ALLINGHAM location BRIDGE Mr Ferguson moved to accept and file as information CArried Mr Hastie 3 Westank Willox have a water tank - 50 barrel WATER TANK & capacity for sale at $5000 00 - unpainted, and a 2000 gallon fuel tank FUEL TANK with two compartments (300 for gas and 1700 for diesel) cost $8200 00 No decision was made about the tanks at this time TRUCK AT Mr Ferguson reported he had called the Treasury Branch in Drumheller concerning the repossessed truck at Westergards' in Drumheller and the bank suggested the M D submit an offer for consideration by Westergards and the bank r �` It was agreed Mr F ..,_. _,.: should proceed with an offer to Westergards for the truck CALL FOR TENDERS Councillors then reviewed the specifications prepared for tenders for 1982 1982 capital requirements and it was agreed that no tenders be called for CAPITAL a single axle gravel truck or for a tandem gravel truck Mr Maerz moved that tenders be called for the following equipment and trucks One small front end loader tractor One Motor scraper - larger than a TS 14 One 4 wheel drive loader One Motor Grader - 180 H P Range One half ton truck with tenders to close 9 00 A M March 11th, 1982 Carried It was agreed that the cab and chassis offered for sale by Mr Wacker might be suitable for hauling rocks if a high lift rock picker is purchased and no tenders are to be called for this type of a truck Mr Hastie reported the 1981 truck which Maclin Ford had quoted on had been sold and no other 1981 trucks eppear to be available in the Western Provinces The price for a new 1982 truck will be $50,077 00 THREE HILLS Mr Ferguson reported on the costs expended to date by the Town of Three WATER Hills for the Red Deer River Water System and Iv1r Campbell moved to accept and file as information Carried A S B Mr Maerz noted he will not be able to attend the A S B conference in Calgaxy CONFERENCE on February lst, 2nd and 3rd should anyone else wish to the M D of Kneehill #48 was held in the M D Office Three HIlls on Monday January 25th 1982, commencing at 9,00 A M Those present were Gilbert A Berdahl Reeve Division 1 Otto Hoff Division 2 Richard A Administrator APPROVAL OF MINUTES Mr Ferguson moved rr.. :.l of the minutes of council meeting of January 11th, 1982 Carried BUDGET Mr Jeffery noted the budget comparison run is still being used by the COMPARISON auditor so no report is available for this meeting Mr Jeffery then reviewed his report covering the period January 11th J C to January 25th, 1982 JEFFERY REPORT He noted a review of the policy book is required and it was agreed this be done the afternoon of February 16th, after meeting with the towns and villages in the morning Mainline Farms Sales wish one councillor to go to North Dakota to view the Steiger Tractors, and it was agreed that Mr Robert E Boake would go on behalf of Council The trip is scheduled for February 8th, 1982 Mr Campbell moved to accept the report given by Mr Jeffery Carried ELECTED wk OFFICALS The firm of Woods Gordon have set up a seminar Elected Officials Seminar SEMINAR for February 25th and 26th, and after discussion Mr Campbell moved to accept and file as information Carried REC SEMINAR The recreation seminar scheduled for Three HIlls on January 29th and 30th was discussed and Mr Maerz moved that any councillor who wishes should attend the seminar Carried E GIECK There was brief discussion about the appeal filed by Mr Ed Gieck SUBDIVISION against the refusal by the commission of a subdivision for Pt NE 20- 29 -24 -4 APPEAL and it was noted council would be advised of the date for the appeal later Mr Jeffery reported that the Village of Linden have submitted the following LINDEN li accounts 75th GRANT Paid to the Sunnyslope Community Association $1500 00 for renovations to their hall Paid to the Swalwell Community Association $500 00 for chairs for their hall Paid to the Linden Trading Co-Op $2284 80 for rug for the school gym and the Village now wish to receive its Alberta 75th birthday grant of $5000 00 Mr Boake also reviewed minutes he received from recent Linden & District Recreation Board meetings and it was noted the Board have at leapt $15,000 00 invested in term deposits f, It was noted that the payments made by the Village to Sunnyslope and Swalwell and the Co-Op were not part of their original submission tothe M D for use of the Alta 75th Grant monies After discussion of this request Mr Ferguson moved that the Village of Linden not be paid the $5000 00 Alberta 75th Grant on the basis of the submitted invoices noted above, as these were not part of their original proposal presented to the M D for use of the grant monies Carried '� 0,-) � COUNCIL MEETING JANUARY 25th, 1982 P 2 The minutes from the Shop & Foremen Committee meeting of January 20th were reviewed and discussed as follows SHOP & FOREMEN 1 Policy re Sanding gravel roads and hills MINUTES Committee recommend that sanding gravel hills and gravel road intersections be done only as absolutely necessary and as a second priority to paved roads POLICY FOR SANDING Mr Boake moved that the Council accept the recommendation from the GRAVEL ROADS & Shop & Foremen Committee and this be set up as an M D Policy HILLS N Carried 2 Permission to set up pesticide container sites at Three Hills and PESTICIDE Acme CONTAINER SITES Mr Hastie moved that the M D grant permission to Alberta Environment Cd to set up pesticide container sites at the Three Hills Dump Box site and Acme dump box site, subject to permission being obtained from r '9- the urban municipalities involved Carried A S B CAPITAL 1982 capital requirements for the A S B were briefly discussed and it was agreed this should be discussed at the joint meeting between Council and the A S B - date for which will be set later today P W CAPITAL 3 Mr Hastie and Mr Ferguson reported that the truck at Drumheller REQUIREMENTTS ( Westergards) and the truck offered for sale by Mr Wacker of Swalwell are too light for hauling the traxscavator, but would be suitable for other uses The water tank available from Jim Hanger is too large The truck available from Maclin Ford would be suitable for moving the traxscavator TRUCK pURCHAS After discussion Mr Boake moved that the committee of Mr Hastie and Mr Ferguson proceed with the purchase of the truck at Westergards at a price not to exceed $24 000 00 Carried TRUCK PURCHASE Mr Campbell moved that Mr Ferguson, Mr Hastie and Bud Haskell continue ETC looking for a suitable water tank and fuel tank and report back to Council, and further purchase a truck suitable for hauling the traxscavator at a price not to exceed $51,000 00 Carried C HELM Mr Hastie reported he had discussed with Chris Helm of Wimborne the account ACCOUNT he submitted regarding installation of sewer lines into his residence RE SEWER The sewer lines were installed by the engineers too high and Mr Helm is forced LINES Ij to haw a pump in his basement in order to pump the sewage up to the line which comes in through his basement wall rather than under his floor WIMBORNE Mr Helm had to paid an additional $780 67 to the plumber because of the m� engineer's error After discussion of this matter Mr Hastie moved that h ° ^e� the M D pay Mr Helm the sum of $780 67 in full settlement for all claims, P cw \\ damages and expenses he has incurred or may incur in the future neon Cyr in regard to this matter, and further that the M D attempt to recover all t-v)G or a portion of this cost from the engineering firm involved in the project �`s} ipor Carried �i Mr Campbell moved that the Shop & Foremen Committee minutes be accepted 14 n��^ Carried c..._ ROAD COMMITTEE Mr Jeffery reviewed the report from the Road Committee, and the following recommendations were made 1 D Page - NE 1- 31 -26 -4 - M D not become involved in this matter as access road is all on private land A After discussion Mr Campbell moved that the M D not become involved in this access problem as the access road is all on private land Carried 2 Alkali Slough - 29, 31 & 32 in 31 -26 -4 - Recommend cutting the old road diversion down to the level of the previous water channel before considering lowering the culvert 3 Torrington East C.. y - Road Committee inspected the damage to the gates and posts as a result of accident - Mrs F Becker - and recommend the M D purchase an additional 12' gate to make a 24 foot opening and have the extra gate installed by Mrs Becker when she has the required repairs done /� COUNCIL MEETING JANUARY 25th, 1982 P 3 Mr Ferguson moved approval of the minutes from the Road Tour of January 21st 1982 Carried Mr Jeffery reported he had checked with E Walters, Solicitor, regarding the possible closure and lease of an original road allowance and also whether the M D could give first right of refusal to purchase same should it ever be sold M[r Walters advises the road allowance could be closed and leaseA�and he would recommend no longer than a 5 year term and also advises no first right of refusal can be given After discussion of the request by Mr R Bowman to purchase a portion of original road allowance North of 21 -30 -26-4, Mr Berdahl moved that the original road allowance not be sold to Mr Bowman Carried Mr Jeffery read a letter from the Town of Three HIlls in which the Town requested the M D to close and sell to it at a nominal sum a portion of original road allowance north of the NE 22- 31 -24 -4 The Town will be developing the land to the north and south of this road allowance into a golf course and would like to :make use of this portion of the road allowance as well After lengthy discussion of this matter, Mr Maerz moved that the M D not close and sell the original road allowance to the Town of Three HIlls at this time POSSIBLE SALE OF OR ROAD ALLOWANCE R BOWMAN TOWN OF THREE HILLS Carried The meeting adjourned for dinner between 12 00 Noon and 1 00 P M Alex Cunningham, .Denel©pmnt Offices together with Larry Martin, Greg Houghton & D Trot representatives from Calgary Regional Planning Commission entered the meeting at this time, and the council meeting was adjourned in order to hold the public hearing scheduled for this time, concerning re- designation of NE 24- 28 -24 -4 Following completion of the public hearing , Mr Campbell moved BY -LAW 962 2nd reading to by -law 962, this being a by -law to redesignate the NE 24- 28 -24 -4 from Ag Conservation to Agriculture REDESIGNATION Mr Hoff moved 3rd reading to this by -law Carried NE 24- 28 -24 -4 Carried The following subdivisions were reviewed SUBDIVISION APPLICATIONS 1 SW 3- 32 -23 -4 - Isolation of Existing Farmstead - Ray Dau- Mr Ferguson moved that the M D recommend approval for this subdivision subject to normal conditions 2 Pt SW 29- 31 -23 -4 - J Tullikopf - Isolation of Existing Farmstead After discussion of this application Mr Hastie moved that the M D recommend refusal for this subdivision as the maximum density for this quarter has already been reached CArried 3 Pt SW 6- 32 -23 -4 - P B I - utility site for water reservoir - Mr Boake moved that the M D recommend approval for this subdivision, subject to normal conditions CArried 4 Block y Plan 4069 T Trochu - Mr Ferguson moved that the M D would v have no objection to this subdivision within the Town of Trochu CHANGES NEEDED Carried IN LAND Mr Martin noted there are one or two technical problems in the M D land use USE BY- by -law concerning the definition of a lot and a site and these should be LAW Mr Cunningham indicated some other changes should be made in the Hamlet Educational Institutional District - signs should be a permitted use and Home Occupations and Accessory Buildings added as a discretionary use It was agreed that Mr Martin should prepare the amending by -law and bring it back to council in due course SUBDIVISION The application for subdivision filed by Mrs A Williams NE 24- 28 -24 -4 NE 24-28-24 - was then reviewed and Mr Hoff moved that the M D recommend app o. l for this subdivision subject to normal conditions Carried The representatives from C R P C and Mr Cunningham left the meeting at this time Mr Jeffery advised Council there is a meeting scheduled for March lst, 1982 MEETING AT at the County of Wheatland office commencing at 10 00 A M to discuss planning
