Wimborne H residence Fert Gara $45,000 00 A regular meeting of December 21st 1981 Those present were G A Berdahl Otto Hoff Robert E Boake Richard A Maerz T A Ferguson Bruce Hastie R G Campbell COUNCIL MEETING DECEMBER 21st, 1981 the Council of the M D of Kneehill #48 was hel commencing at 9 00 A M in the M D Office, Thr Division 1 Reeve Division 2 Division 3 Division 4 Division 5 Division 6 Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson Assistant Administrator, was present and recorded the minutes APPROVAL MINUTES Mr Maerz moved approval of the minutes of the Council meeting of December 14th, 1981 _ - - - - -- Carried Representatives from the Town of Trochu - Mr Al Gehring Mr Eugene Tepper and Administrator, Tim Petersen,entered the meeting at this time MEETING WITH Mr Gehring read a brief prepared by the Town outlining some concerns the town TAU_ has including the need for additional funds from the M D for recreation and emergency services and the need NOT to allow rural industrial parks in the M D The Town feel this type of use must be kept in the urban centers because the small towns cannot survive without a larger tax base The M D indicated it must also have a tax base to survive as it is now paying a large share of other joint sharing agreements such as ambulance service, the operation of the Golden Hills Lodge and School Requisitions V\ The possibility of assessment sharing between the urban and rural areas was briefly mentioned It was noted that the urban areas must provide goods and services to the local residents7otherwise people will travel to a larger center to obtain them There was discussion about the fertilizer set up allowed dust to the south of Trochu as well as discussion about certain types of uses now operating in the rural area When these types of uses prosper the business generally moves into an urban center Themwas discussion about provision of recreet ion facilities and it was noted that there are perhaps too many facilities provided for the population being served The possibility of tax revenue sharing was again mentioned and the Representatives from the Town indicated this might have to be looked at if industry was to be allowed in the rural area Copies of the report prepared by the Town were given to all councillors of the M D Mr Gehring indicated that the urban areas will have to come up with better costing figures for recreation facilities It was agreed that more discussions between the two areas would be a benefit and would likely resolve some of the problems The representatives were thanked for coming and they left the meeting J C JEFFERY Mr Jeffery reviewed his report covering the period December 14th to ------REPORT December 21st and the following items were discussed 1 THe men appear happy with the contract and are prepared to sign it 2 Sale of avadex spreader was recommended by the A S B It was noted had been purchased with a matching grant from Dept Agriculture Mr Campbell moved that tenders be called for the sale of the avadex spreader with date for closure of tenders to be set later Carried It was noted that there may be other items to be advertised for sale the spreader Mr Jeffery also noted the M D had been served with a notice of intention to sue from Myles Milan and H Stankievich as a result of a recent motor vehicle accident He also reviewed an access problem which had arisen as a result of the Three Hills Water Project involving Mr Louis Sich, and he had advised Mr Sich to submit a claim for inconvenience damages to the Town of Three Hills � d }� r P �ylie� WUTA -L , 11L6 i �.A DECEMBER 21st, 1981 P 2 He noted that the Town, the contractors and the engineers had been L SICH ACCESS advised of the access problem and they agreed not to leave the access PROBLEM closed off for more than a day However the ditch was opened up and then the contractors shut down for a week's holiday Mr Hastie moved to accept the report given by Mr Jeffery Carried 1982 SALARY Mr Jeffery reported on the interviews held with salaried employees NEGOTIATIONS_ and Council at this time went into a meeting in camera VA The Council meeting adjourned for dinner between 12 00 Noon and 1 00 P M D_LIIA.ft Air Larry Martin from C R P C entered the meeting at 1 00 P M 0 Mr Berdahl adjourned the meeting of Council in order to hold the public PUBLIC HEARING hearing scheduled for 1 00 P M concerning an amendment to the land use by -law Following completion of the public hearing and noting that no objections LAND USE BY -LAW were received at the public hearing concerning the proposed ndmentd AMENDMENT to the by -law, Mr Ferguson moved second reading to by -law 966 be ng ed BY -LAW 961 a by -law to amend land use by -law 913 to allow for an isolation of existing farmstead below minimum parcel size, to allow for relaxation of , sideyard requirements for said subdivision - NE 6- 29 -23 -4 - and to correct the land use by -law to allow for isolations of existing farmsteads with 10 acres or less down to 4 acres Carried Mr Boake moved third reading to by -law 961, as amended Carried SUBDIVISION Subdivision application for SW 32 -30 -24-4 Barbara Elliott was then - SW -32 -30 -24-4 reviewed and Mr Maerz moved that Council recommend approval for this isolation of existing farmstead , subject to normal conditions Carried REDESIGNATION The application for redesignation of the NE 24- 28 -24 -4 by Mrs A WILLIAMS A Williams of Beiseker was then reviewed and discussed in detail NE_24 -28 -24-4 Mrs Williams wishes the redesignation in order to apply for a 50 acre intensive subdivision Mr Ferguson moved first reading to by -law 962 this being a by -law "" to redesignate the NE 24- 28 -24 -4 from Agricultural Conservation to a Agriculture , , r_, 0 Carried DATE FOR PUBLIC Mr Boake moved that the public hearing required for the redesignation HEARING_ be held on January 25th, 1982, commencing at 1 00 P M , in the M D Office- - - - - -- - - - -- in Three Hills and further moved that the application for subdivision for a 50 acre parcel be tabled until after the public hearing is held - Carried IN CAMERA Council then went back into a meeting in camera, and Mrs Wilkinson and Mr Jeffery left At 2 20 P M Council re- opened the council meeting to the public Mr Jeffery the meeting and Mr Hastie moved that the 1982 salaries be as follows $35 840 00 1982 SALARIES Edward Dunay, Norman Soder $28,375 00 - Art Thomas $19 000 00 J C Jeffery $38,590 00 John Sailer $19,000 00 Jean Wilkinson $31 213 00 John Dorn $28 943 00 George Rempel $28,943 00 Oris Rodger $27,808 00 Keith Smith $28,375 00 Alex Cunningham $28 375 00 Herman Martens $24,970 00 Linda Shearlaw $19 000 00 Carried It was noted that the 1982 salaries for Karen Boese and Carol Ducs had been set previouslyyy COUNCIL MEETING DECEMBER 21st 1981 P 3 WITH Mr B Wray Planner from the M D of Rockyview entered the meeting at BILL MEETING ING PLANNER this time to discuss with Council the proposed amendment to the Regional M D VIEW Plan submitted by the M D of Rockyview --ROCKY Mr Wray was advised that the M D of Kneehill had submitted a letter to N the Minister requesting a change in the voting structure of the commission He advised Council that the court action had been held off to see if some settlement could be arranged without proceeding any further with the court case, and he noted that no statement of defence had yet been filed by the defendants to the action He requested that the M D of KNeehill consider sending a letter to Dave Elliott, solicitor for the M D of Rockyview and other rural areas A outlining their full support for the court action as undertaken and requesting the action be amended to include the M D of Kneehill as a plaintiff in the court case There was discussion about other aspects of the regional plan including the right of a local area to set its own densities Mr Ferguson moved that the M D of KNeehill send a letter to Dave Elliott, Solicitor, fully supporting the court action as initiated by the M D of Rockyview, and requesting him to amend the statement of claim to include the name of the M D of Kneehill as a plaintiff in the court action Carried ORIENTATION Mr Jeffery noted that C.R P`C ` have set up an orientation meeting MEETING C R P C for January 6th, 1982, at the Carriage House in Calgary at 2 00 P M JAN 6/82 and it was agreed that all councillors, Alex Cunningham J C Jeffery -------- -_ - --- and Jean Wilkinson should attend this meeting if possible Mr Wray left the meeting at this time REQUESTS FROM SALARIED The matter of other requests from salaried employees were then reviewed EMPLOYEES 1 Extra and incentive holidays for two foremen, John Dorn and George Rempel After discussion of these requets, 11r Ferguson moved that no change be made in the contract concerning holidays for salaried employees Carried 2 Request from Keith Smith for permission to drive the Shop Truck back and forth to work Mr Ferguson moved that this request be denied Carried 3 The request for change in the office hours was not discussed and was withdrawn 4 Mr Soder had requested hiring additional office staff for the A S B Mr Maerz moved that no additional office staff be hired for the A S B Carried 5 Mr may requested incentive holidays after 5 years Mr Hoff moved that no change be made in the contract concerning holidays for salaried employees Carried It was reported by Mr Darlay that the County of Mountain View will be finishing their general assessment some time this summer and perhaps Council should consider attempting to hire one or two of the assessors who will be laid off when the general assessment is completed It was generally agreed that Mr Jeffery should advise Mr Dawley the M D may be interested in hiring one or two depending on progress made on our general assessment at that time EMPLOYEE COMM The minutes of the Employee Committee meeting of December 14th, 1981 were MINUTES- - reviewed and it was noted that the mechanics had requested a meeting with Council likely to discuss the tool allowance Mr Hoff moved that there be no change in the decision concerning no tool allowance payment in 1982 and no meeting be held with the mechanics at this time Carried 9�'C"i WUAV -LL MEETING DECEMBER 21st, 1981 I Mr Campbell moved approval of the minutes of the employee committee meeting `^ of December 14th 1981 Carried The budget run,after the December 14th cheque run,was reviewed and RUN discussed and Mr Boake moved approval of same Carried CANCELLATION MOBILE Mr Jeffery noted that there is a mobile home licence outstanding since _LICE __ 1977, which with penalties added now stands at $224 31 Account No 110 - Dave Enns Linden The mobile has been moved out of the area and after discussion of the ��44,v matter, Mr Campbell moved that the outstanding licence fee and --go penalties be cancelled in the sum of $224 31 DATE FOR 1982 TAX % Carried SALE The date set last meeting for the 1982 tax sale was again reviewed and it was noted that this date should be changed to sometime in April of 1982 F. After discussion Mr Boake moved that the 1982 Tax Sale Date be changed from March 22nd, 1982 to 1 00 P M , April 26th 1982 commencing at 1 00 P M , in the M D Office, Three Hills Carried D PAGE his buildings on ACCESS TO BUILDINGS The request from Derek L Page for access to /NE 1 -31 -26-4 was reviewed NE 1- 31 -26-4 and discussed in detail The notes made back in 1967 concerning the problem were also reviewed and it was noted that a large culvert and }� a hill cut would likely be necessary to provide access to the buildings Mr Maerz moved that the Road Committee have a look at the site and make a recommendation to council CArried ALKALI SLOUGH Mr Jeffery read a letter from Alberta Environment concerning a large Sections 29, 31 & 32 alkali slough in Sections 29, 31 & 32 in 31 -26-4 and what Environment --in-31-26-4 feel is an unauthorized dam on Section 31 ­r"b\e After discussion of the letter DZr Maerz moved that the Road Committee inspect this site and report back to Council Carried BIN MAERZ Mr Jeffery read a letter from Ben Maerz in which he requests payment REQUEST FOR EXTRA for additional hours he claimed he work on the R Toews Road Project - - - -MOB He submitted a schedule of hours he claims he worked — total of 134 - but the hours submitted by the foreman were only 119 He has received a cheque for the 119 hours, but he feels he should receive VA the extra money of $429 75 After discussion of the mater Mr Ferguson moved that the foreman's calculation of hours work e confirmed and no additional payment be made to Mr Ben Maerz Carried There was discussion concerning the definition of livelihood from DEFINITION OF farm land" as it concerns farm land status and Mr Ferguson moved ^ LIVELIHOOD to accept and file the report Carried KIBA SEED PLANT The request from KIBA Seed Plant at Beiseker for funding up- grading REQUEST FOR FUNDS of the plant was discussed and Mr Boake moved this request be tabled - - -� a�--- - - -_ -- and discussed at the meeting scheduled for December 22nd, 1981 9e Carried Mrs Wilkinson left the meeting at this time TABLE AGENDA Mr Ferguson moved that the balance of the agenda items - 15, 14, 20 21 and 13 T ��; r'e%` ! be tabled until December 22nd, 1981 tlf Carried SOT Mr Hastie moved the meeting do now adjourn ---- - -_ - -- C arried � Tune -506 PM J I Reeve ;Mun or A r i MUNICIPAL DISTRICT OF KNEENILL No 48 P.O.
