- -- Reeve -7� --- - - - - -- ;� Municipal Administrator i COUNCIL MEETING NOVEMBER 16th, 1981 A regular meeting of the Council of the M D of Kneehill #48 was held in the Mi Office, Three Hills, on Monday, November 16th, 1981, commencing at 9:00 A M Those present for the meeting were- PRESENT G A Berdahl Division 1 (Reeve) Otto Hoff Division 2 Robert E Boake Division 3 Richard A Maerz Division 4 T A Ferguson Division 5 (until 10.40 A M) Bruce Hastie Division 6 (after 10 30 A M ) R G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minus APPI Mr Boake moved approval of the minutes of the organizational meeting of Counc_ held October 26th, 1981 Carried Mr Ferguson moved approval of the minutes of the regular meeting of Council of October 26th, 1981 Carried BANK RECONCILIATION Mr Jeffery reviewed the bank statement for the month ending October 30th, which showed a net balance of ($15,475 80) After discussion of the statement, Mr Campbell moved acceptance of the statement as presented Carried APPROVAL OF OCT ACCTS Mr Maerz moved approval of the lists of accounts paid in the month of October, 1981 ^ Carried BUDGET REVIEW Mr Jeffery reviewed the budget figures to the end of October, and after discussion of the financial picture, Mr Campbell moved approval of the report Carried Mr Jeffery reviewed his report for the period October 26th to November 16th and various items were discussed, as follows. 1 Rate for use of the old 12 Volt Post Hole Auger - Mr Ferguson moved that the rental rate for the post hole auger be set at $5 00 per day Carried 2 Gravel Crushing - Linden Contractors is now working at the Andrews Lowen Pit and after discussion of the situation, Mr Campbell moved that if the gravel is good, and the weather holds, Linden Contractors be given permission to continue crushing at this pit until December lst, 1981, and the number of yards crushed by Linden Contractors be reviewed by Council at the November 30th meeting Carried The reclamation work at the 14egli Pit was also briefly discussed and it was noted that the hole at the bottom of the pit should be filled in soon, but the water will have to be pumped out before it is filled in The work required at the Anderson Bridge Project was also discussed and it was noted further work will have to be done there next summer to repair the two slump areas It was agreed that Crown Trust be requested to allow the M D access next year in order to complete the work, as there is no renewal clause provided for in this year's lease 3 First time gravel has been requested for the road west of 12- 30 -25 -4 and after discussion Mr Hoff moved approval be granted for first time gravel for this road as required to provide reasonable access to the SE of 11- 30 -25 -4 J C ihr"r,ExY REPORT POST HOLE AUGER RENTAL GRAVEL CRUSHING RECLAM WORK MEGLI PIT ANDERSON BRIDGE' FIRST TIME GRAVEL WEst 12 -30 -25 Carried HAMLET GARBAGE Mr Jeffery read a letter received from Superior Disposal concerning costs for garbage pickups in hamlet areas, as follows PICK UPS Huxley $3 85 per month x 35 pickups = $134 75 Wumborne $3 85 per month x 35 pickups = $134 75 Sunnyslope $3 75 x 14 = $ 52 50 COUNCIL MEETING NOVEMBER 16th, 1981 P Swalwell $3.75 x 27 = $101 25 Grantville $3 75 x 33 - $123 75 Ruarkville $3 75 x 48 = $180 00 Hesketh $6 25 x 8 = $ 50 00 HAMLETS - - -- GARBAGE PICK UPS Total per month $777 00 The Town_ of Three Hills has offered to pick up Grantville and Ruarkville at a cost of $2 50 per pick up and the Town of Trochu has indicated it would be willing to negotiate a cost for pick up in Win-borne and Huxley However as Carbon, Acme, and Linden are continuing with Superior Disposal for their garbage pick up,pick ups for Sunnyslope, Swalwell and Hesketh might be a problem After discussion of the matter, Mr Campbell moved that the M D enter into an agreement with Superior Disposal for hamlet garbage pick up for the year December lst, 1981 to November 30th, 1982, at the prices quoted in their letter of November 12th, 1981 Carried APPROVAL J C ikxv. LLd Mr Ferguson moved approval of the report given by Mr Jeffery REPORT Carried The Deputy Minister of Alberta Hospitals has forwarded a letter requesting HOSPITAL comments from the Council concerning the withdrawal of part of the BOUNDARIES M D from the Mountain View Kneehill Auxiliary and Nursing Home Area for inclusion in the proposed Drumheller General and Auxiliary Hospital and Nursing Home District The area of the M D involved is that area of the M D presently within the Drumheller General Hospital Board area After discussion of this letter, Mr Boake moved that the Deputy Minister be advised the M D would have no objection to the proposed changes in Auxiliary and Nursing Home area boundaries in order to make these boundaries co- terminious with general hospital area boundaries, but feel that that such hospital area boundaries should be co- terminious with Municipal District boundries, and further that the�o^rth boundary of the Drumheller Hospital Area should be reviewed an sinue to the east between townships 30 and 31, rather than jogging further north and then east as it presently does Carried MEETING WITH ED Mr Ed Dunay, Assessor the M D then entered the meeting He noted that Day there may be a resolution come up at the Fall Convention concerning assessment of oil field equipment The oil companies are attempting to ASSESSOR convince the government to allow them straight line depreciation on oil well equipment each year until it is fully depreciated At the present time depreciation is allowed at 10% per year down to 50% Assessors feel that oil equipment should be assessed at 65% of its value and dde-pxeciation allowed only during general assessments After brief discussion of this matter, Mr Dunay left the meeting Mr Ferguson left the meeting at this time 10.40 A M to attend a meeting in Edmonton as Deputy Reeve MEETING WITH A delegation from the Rosebud Seed Plant entered the meeting at this time ROSEBUD SEED Mr Berdahl introduced Mr Merle Marshman and Mr Jim Clark to the Council PLANT and Mr Marshman then gave a presentation about the need for a new seed cleaning DIREC'T'ORS plant at Rosebud After discussion of this matter with Mr Marshman and Mr Clark, i they were thanked for coming and left the meeting - Time 11.05 A M After further discussion of this request for funding for the new plant, Mr Hastie moved that the M D agree to contribute its one -third share of the municipal contribution of 20% towards a new seed plant at Rosebud to a maximum of $66,666 00 on the following conditions 1 That the Provincial Government change its grant structure and contribute 40% of the costs of the new plant without any maximum limit on its contributions 2 That the Board of Directors obtain contributions from the plant shareholders to meet the requirEd shareholders' contribution of 40% of the costs for the new plant 3 That the County of Wheatland agree to contribute its two thirds share of the It municipal contribution of 20% towards the costs of the new plant 4 That the M D of Kneehill's contribution would be payable to the Board, upon compliance of the above noted terms, and payable in equal amounts over a period 4,942 WWI �1 N up to three years FWMAW COUNCIL MEETING NOVEMBER 16th, 1981 Carried P 3 Alberta Housing and Public Works have agreed to pay an additional grant HUXLEY CURLING of $2374 00 to the Huxley Curling Club under the Community Services Grant CLUB GRANT Program and require an agreement with the M D in order to pay this additional grant Mr Maerz moved that the Reeve and Municipal Administrator be authorized to sign the required agreement with the Provincial Government in order to obtain the additional grant for the Huxley Curling Club Carried TORRINGTON AG SOC. Mr Maerz noted that the Torrington & District Ag Society would SCRAPER like to hire an M D scraper for approximately 1z days to do some landscaping RENTAL work around their building in Torrington The work would be done on Saturday and Sunday by an M D employee After discussion of this request Mr Boake moved that the Torrington & District Ag Society be allowed to hire an M D scraper for Saturday and Sunday - November 21st and 22nd on condition that an M D employee be hired by the Society to operate the scraper, and the Society obtain permission of Alberta Transportation to cross Highway 27 if they wish to move the dirt across the highway and further that they have good traffic control available to prevent any accidents or liability accruing to the M D , and further moved that the Society be charged for the use of the scraper at half the government rate less the operator's wages, and the Society agree to pay the operator's wages. Carried MEETING WITH ALTA Mr B Kathol, Mr M McGregor and Mr Peterson from Alberta Transportation TRANSPORTATION entered the meeting to discuss with council a possible solution to a problem with the intersection at NW 31- 33 -25 -4 (On Highway 27 West) There is a bad hill on the highway and traffic coming from the south and turning west could create a dangerous situation for traffic coming from the west This problem has been discussed many times over the past years, and no solution has been found to date The possiblity of installing a service road from the intersection either going west or east might solve the problem, but the service road to the east appears to be the best solution and in order to do this, it would likely require the removal and re- location of the D Oster farmstead, as a service road would isolate his buildings between the highway and the service road. After lengthy discussion of the matter, the costs involved and the need for a service road on both the north and south sides of the highway, the fact that the sight distance now meets minimum transportation standards, and further that if a service road was installed it would take more agricultural land out of production and the service road would become the responsibility of the M D , it was generally agreed that installation of service roacb from the intersection to the east appeared to be the most logical solution, if a reasonable compromise could be arranged with Mr Oster regarding re- location of his building site, and if for safety the installation of the service roads appears to be totally necessary There was discussions with Mr Kathol and Mr McGregor regarding possible government projects in Kneehill in 1982, as well as the improved approaches on Highway #9, the Economic Stabilization Grant, The Anderson Bridge Project, the need to widen SR 585, the condition of the Buffalo Jump Park Road, and the use of calcium chloride as a dust control on roads Mr Kathol, Mr McGregor and Mr Peterson were thanked for coming and they left the meeting at 11 50 A M The meeting then adjourned for dinner until 1.00 P M. DINNER L` :7 COUNCIL MEETING NOVEMBER 16th, 19E The Three Hills Hospital are holding a meeting in the M D Council Room on November 24th to review with all concerned the new hospital plans and construction and requests that an M D councillor be present for the afternoon portion of the meeting Mr Jeffery noted that Mr Ferguson had volunteered to attend this meeting on behalf of Council THREE HILLS HOSPITAL ANU24DMENTS TO The following amendments are required to the Development Control By -law 913• BY -LAW 913 1 Albert Stickel has requested an isolation of existing farmstead on SE 32- 31 -25 -4 of 2 53 acres This is less than the rrununum size of 4 acres allowed in the by -law and requires an amendment to allow for this size of a subdivision After discussion Mr Maerz moved first reading to by -law number 957, this being an amendment to by -law 913 to allow for an isolation of farmstead on SE 32- 31 -25 -4 of less than 4 acres in size Carried 2 Don Bruck & Stan Christon of Ruarkville have submitted an application for subdivision of Lots 7 & 8 in Block 3 Plan 7810405 to create new lots 22, 23 & 24 The sideyards for Lot 24 do not comply with M D requirements for five feet, and an amendment is required to allow for this subdivision BY -LAWS 957, 958, 959 & Mr Maerz moved first reading to by -law 958, this being an amendment to by -law 913 to allow for relaxation of the north side yard requirement for proposed Lot 24 in Block 3 Ruarkville, from five feet to four feet Carried 3 Mr G Kimmel has submitted an application for subdivision of 21 acres for an intensive hog operation from the Sz of 3- 31 -26 -4 This would require redesignation of both quarters from Agriculture Conservation to Agriculture, and Mr Kimmel has paid the required $50 00 per quarter fee After discussion of the request for redesignation, Mr Maerz moved first reading to by -law 959 to redesignate the S2 of 3- 31 -26 -4 to Agriculture Carried •.1 4 Mr John Johnson of Huxley has submitted an application for redesignation of the SE 11- 34 -24 -4 in order to allow for a subdivision of this quarter into two 80 acre parcels He wishes to sell one 80 acre parcel to his daughter and son -in -law so they may build a home there and continue with their present farming operation After discussion of this matter, Mr Boake moved first reading to by -law 960, this being a by -law to redesignate the SE 11- 34 -24 -4 from Agriculture Conservation to Agriculture Carried DATE FOR PUBLIC Mr Hastie moved that the public hearings required for amendments to the land HEARINGS use by -law 913 be held on Monday, December 14th, 1981, as follows Re By -law 957 1.00 P M By -law 958 1:15 P M By -law 959 1.30 P M By -law 960 1.45 P M and the required advertisements of the public hearings be published in the Three Hills Capital Carried CANCELLATION OF TAXES RE Mr Dave Harper has requested Council to consider cancellation of taxes levied Pt SE on a rental house he owns, which house is located on land owned by the Churchill 27-28-20-1 Community Association There is no land assessment,only an improvement assessment j! of 1360 against the house and the 1981 taxes amounted to $183 74 The house has been vacant since December of 1980 and will be sold and moved in due course After discussion Mr Campbell moved that the Council cancel taxes levied against this improvement assessment of 1360 in the sum of $183 74 for the year 1981 Carried • COUNCIL MEETING NOVEMBER 16th, 1981 P 5 Mr Hoff moved that the balance of this agenda be tabled until the next meeting of Council Carried Mr Hastie reported that the Wimborne Rural Electric Association has hired a firm to do some brush clearing for them on some roads in the Wimborne area and the PEA wonder if the M D would like to enter into a cost sharing arrangement with them for total brush removal on these roads The cost for the equipment and men is around $200 00 per hour After discussion Mr Berdahl moved that the M D agree to cost share with the Win-borne R E A , for removal of the brush on a one mile stretch of road West of 29- 33 -25 -4 as a test project and the matter be reviewed again at that time Carried Mr Maerz noted he has problems with two culverts 1 Culvert needs to be raised West of 25- 31 -26 -4 Alvin Keiver 2 Culvert needs to be lowered South of 14- 32 -27 -4 It was agreed both these requests be inspected by the Road Co =ttee BRUSH CLEARING ON ROAD West of 29- 33 -25 -4 PROBLEMS WITH CULVERTS �L f 1-n WATER DRAINAGE Mr Maerz further reported the M D raised a road south of Elmer id retch's PROBLEM residence and by doing so created a water drainage problem The water now stays between the road and Mr Albretch's buildings It was agreed that i-'Ir Maerz attempt to rectify the problem with his w_,-. »u.ial motor grader V\ a adjourn ADJOURNMENT .
