Meeting with D Kober re land for Huxley Water Project "�g � COUNCIL MEETING OCTOBER 13th, 1981 A regular meeting of the Municipal District of KNeehill #48 Council was held on Tuesday, October 13th, 1981, commencing at 9.00 A M , the 12th of October being a statutory holiday The following were present for the meeting- PRESENT G A Berdahl Division 1 (Reeve) Otto Hoff Division 2 Robert E Boake Division 3 Richard A Maerz Division 4 (for 20 minutes only) T A Ferguson Division 5 Bruce Hastie Division 6 R G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr Boake moved approval of the minutes of the meeting of September 28th, 1981 Carried Mr Jeffery reviewed the bank reconciliation statement for the month ending September 30th, 1981, and after discussion of same and the financial position of the M D , Mr Campbell moved approval of the bank reconciliation statement Carried Mr Jeffery reviewed the budget figures to date and after discussion of same, Mr Campbell moved to accept the report given by Mr Jeffery Carried Mr Jeffery reviewed his report covering the period September 28th to October 13th, 1981, and the following items were discussed in detail 2. Economic Stablization Grant Program and Hired Scrapers The money is close to being used up, particularly if a portion of the grant money is to be used for the hired dragline to remove gravel from below water line at the Megli Pit After lengthy discussion Mr Ferguson moved that the 3 hired scrapers be laid off as of October 16th, 1981 Carried Mr Ferguson moved that the hired crawler doing reclamation work and stripping work at the Megli Pit be laid off as soon as all the work that can be done there is completed Carried It was noted that all the reclamation work cannot be completed at the Megli Pit until the gravel is removed from below water line and it will be necessary to send a crawler back there later to do more reclamation work 5 the request from Hopkins Construction for crushing work at the Garson Pit was discussed and it was generally agreed that Council did not wish any crushing done there at this time 6 Ron Toews had crushed 20,000 yards at the Schmautz Pit in April of 1981 and since that time he has sold approximately 1900 yards of pit run The contract arranged with Mr Toews 1=, ted him to 20,000 yards of pit run per year After discussion of this matter, Mr Ferguson moved that Mr Toews must comply !' with the terms of the contract and therefore must reduce the number of yards he can remove in 1982 by the number of yards he is over in 1981 7• Carried After brief discussion about low level crossings , Mr Boake moved this matter be tabled and reviewed again in March of 1982 Carried APPROVAL MINUTES BANK STATEMENT 0 BUDGET REVIEW J C JEFFERY REPORT CULVERT ORDER 8 The need to order culverts for next year's road program was discussed, and Mr Ferguson moved that the M D place an order for the 1982 culvert requirements at this time, with 500 of the order to go to TWister Pipe, and the remaining 500 to be ordered from the other suppliers Carried 9 Mr Jeffery briefly reviewed the RRAP program and noted Mr M Steinbach may be able to work for the M D on this program after the first of the year After brief discussion Mr Campbell moved to accept and file the information concerning the RRAP program �I Carried COUNCIL MEETING OCTOBER 13th, 1981 Uri 10 Alberta Transportation have advised the M D will receive an additional GRANT FOR sum of $152,000 00 for oiling this year, and Mr Boake moved to accept and OILING file as information and to send a letter of thanks to the Minister of Transportation Carried 11 The need for gravel at the Horseshoe Canyon Site was reviewed and Mr Hoff moved that the M D gravel that portion of the parking lot south of the fence and north to the M D road allowance. Carried Council generally agreed that it would not participate in the sign program on a special event van as suggested by the Big Country Tourist Association -- Mr Campbell moved to accept Bair Jeffery's report Carried Mr Boake moved that the City of Drumheller be requested to gravel DRUMHELLER TO the road north of Sections 23 and 24 in Township 28 -20 -4 GRAVEL ROAD Carried Mr Campbell and Mr Jeffery reported that the Hutterian Brethren of Huxley had been given permission to open cut the Buffalo Jump Park OPEN CUT Road in order to install their own culverts to facilitate irrigation CROSSING of their lands The work was done during the time our crew was HURLEY working on the road HUTTERITES After discussion of the matter, Mr Hastie moved that the installation of the culverts by open cut method be approved Carried Mr Jeffery requested permission to hire a new person for the office NEW OFFICE STAFF at this time, as one of the staff will be leaving some time in the next REQUIRED six months After lengthy discussion of this matter, Mr Hastie moved that the M D hire an additional person for the office as soon as possible Carried Mr A Howard MacDonald has entered into a lease agreement with the GRAVEL LEASE M.D for gravel testing on the SW 10- 29 -24 -4 and Mr Hoff moved that the SW 10 -29 -24 Reeve and Municipal Administrator be authorized to sign the lease arranged with Mr MacDonald Carried It was agreed that the testing be undertaken soon Mr. Jack Barnes of Carbon has requested a variance in the terms of the JACK BARNES recent board order granted by the Development Appeal Board concerning DUGOUT ON NW 19 the dug out on Mr Barnes' land He wishes to use z" cable around the 29-22 - dug out rather than installation guard rails. Alberta Transportation standards for installation of guard rails were reviewed and after discussion of the request, Mr Campbell moved that Mr Barnes be given permission to install 8" x 8" posts , minimum of 12 feet centers, with 4 stands of 2" cable, properly fastened to the outside of the posts, in lieu of installation of the guard rails Carried Mr A Judt was charged $400 00 by the Innisfail Farm Fire Association when their department was called to a fire on their farm NW 14- 34 -26 -4 rather than calling the Torrington Fire Department After discussion of the request from Mr Judt for the M D to re- imburse him for this cost, Mr Campbell moved that the M D not accept responsibility for this account Carried Mr Jeffery reviewed some corrections which the Inspectors, during their recent inspection „ requested be made 1 Approval of minutes of the meetings of February 24th, March 23 and May 20 Mr Ferguson moved approval of these minutes Carried 2 Official Appointment of Ed Denay as Assessor the M D Mr Boake moved that Mr Edward Denay be appointed as Assessor for the M D JUDT FIRE CALL $400 00 r CORRECTIONS REQUIRED BY th MUN AFFAIRS INSPECTORS ir �.VVLVl..1L MEETING OCTOBER 13th, 1981 P 3 )f Kneehill #48, effective March lst, 1981 Carried [r Boake moved L ..:..:.. ,... _s to the following council meeting minutes June 17th, 1981. Mr Campbell moved first reading to by -law 943 to set the 1981 mill rates and to rescind by -law 939 Carried Mr Ferguson moved second reading to this by -law AMENDMENTS TO COUNCIL MINUTES June 17/81 DATE FOR FALL �5e Mr Jeffery reported that the Fall Meeting of the CAAMD & C is scheduled MEEETING OF for October 29th, 1981 at the Rockyview Office in Calgary, cony encing at CAAMD & C �G �G 10 00 A M 2\ Mr Berdahl reported on the recent meeting of the directors of the CAAMD & C held in our office recently, and he noted there were 14 present for the meeting I! It was agreed that all councillors other than Tvir Ferguson will attend the Fall Meeting in Calgary There was discussion about presentation of resolutions to the Fall Convention �,� k particularly about the requirement for both French and English in all provinces other than Quebec, and it was agreed that this matter should J° n n° be discussed with the M L A's and M P at the next combined meeting. It was agreed that the M D dig out the inside row with a back hoe Meeting WITH SVAI RESIL 5 Vacant Lots - People want the M D to get the vacant lots cleaned up and cut It was agreed the M D lots in the hamlet areas should be cut now with the rotary mower rather than waiting until next spring and before any decision is made about requiring other owners of vacant lots to clean up their property This matter to be reviewed again at a later meeting 6 Residents are not happy with the use of calcium chloride on the streets in Swalwell this year I' Matter discussed but no decision made Mr Jeffery also reviewed with Council the existing litter and nuisance by -law 836 which would allow the M D to issue directives to owners of untidy and unkept lots in hamlets ACME SWIM] ING 13 The Village of Acme have requested umput from the M D concerning their problem POOL with financing the o COSTS village 20 000 00 a� ration of their swimming pool It is costing the g $ , year now to operate the pool and the village does not feel it can continue to operate the pool on its own After discussion of this matter, Mr Campbell moved that the Village of Acme , be advised they can impose a two price system, one for village residents and one for rural residents, if they so wish, or alternately discuss with the rural 11 residents in the Acme area the possibility of the rural residents submitting a petition to the M D to hold a plebisite vote, which if passed, would authorize y the M D to set up The Acme Swimming Pool area and to levy an additional mill rate charge against the landsin that area to assist with the operational costs and I capital costs for the pool Carried TROCHU FIRE The Trochu Fire Department have recently purchased a used school bus with their DEPT own funds, and intend to convert it into a water carrying vehicle They are WATER TRUCK requesting the M D to assist them in this venture and to help them equip and maintain the bus After discussion Mr Hastie moved that if the Fire Department is willing to turn the ownership of the bus over to the M D for the stun of $1 00 VN the M D will licence and insure the vehicle and assist with the maintenance of the vehicle, and further moved that if the Department wish to sell the converted bus at any time in the future the M D will return ownership of the vehicle to the Department Carried HENRY rIAERZ Mr Henry Maerz had requested the M D refund h3mthe 1981 taxes levied against REFUND PT the improvement assessment on the NW 7- 32 -23 -4 This is a rental house, but TAXES has not been rented since June of1980 After discussion of this request, Mr Boake moved that the M D refund Mr Maerz the stun of $132 58 being the taxes ✓ levied against the improvement assessment on NW 7- 32 -23 -4 in the year 1981 Carried OLD SHOP DOORS As no bids were received for purchase of the old shop doors either in Three Hills or Carbon, Mr Hoff moved after discussion of this matter, that if anyone wishes to pay $5 00 a sect n for any of the old Three Hills shop doors, they be sold at that price and thoe�arbcn shop doors be disposed of, as it appears they are of no value Carried COUNCIL MEETING OCTOBER 13th, 1981 P 6 The agreement arranged with Greg Frolek _ backsloping and borrow pit BACKSLOPING AGREEMENTS SW 29- 31 -22 -4 was again reviewed and Mr Ferguson confirmed that Mr Frolek wishes to have only that portion of the old road diversion in front of his house levelled off Rick Vickery indicated it would take about 1 hour and the dirt would be required for the road • If additional dirt is required Mr Frolek will allow the dirt to be taken from the bottom of the coulee and this area will be left open No compensation will be payable to Mr Frolek for the dirt removed However if a borrow pit is taken from Mr Frolek's barley field this must be paid for It was also agreed that the M D would slope the old bridge approaches Mr Boake moved approval of the agreement with Mr Frolek subject to the above conditions Carried Mr Jeffery reviewed backsloping agreements arranged as follows- John and Alfred Stickel NW 6- 32 -24 -4 Betty Ann Toews - SW 6- 32 -24 -4 Melvin Raymond Koch - SE 12- 32 -25 -4 Ben Maerz - SE 1- 32 -25 -4 Robert Robertson - SW 7- 32 -24 -4 Mr Hoff moved approval of the agreements Carried BORROW PIT There was discussion about the problems incurred in determining the MEASUREMENTS size of borrow pits after the job has been completed and it was generally agreed that the councillor (if possible) and the foreman working on that project should measure the borrow pits before the pits are closed in The Town of Three Hills have requested authority to purchase 1600 yards SALE OF GRAVEL TO TOWN of crush gravel from the M D for use on the road down to the Red Deer River 3 HILLS After discussion Mr Boake moved that the Town of Three Hills be given permission to purchase 1600 yards of gravel from the M D at $6.00 a yard, the gravel to be obtained from the F Huxley stock pile site Carried I' ROAD BUILDING Mr Jeffery gave out copies of a draft road building policy and after POLICY { discussion of the proposed policy, Mr Ferguson moved that the M D accept the policy Carried 1982 1983 ROAD The need to establish the1982 and 1983 road programs was reviewed and Mr _PROGRAMS Hoff moved this matter be tabled until the next meeting of Council } -Ar- 8 Carried FORCED ROAD The need to retain the forced road through Section 12 in 30 -23 -4 was discussed Sec 12 -30 -23 and Mr Ferguson moved this matter be tabled and the Road Committee have a look at the area and report back to a later meeting of Council !° Carried BRIDGE Correspondence received from Alberta Bridge Branch was reviewed as follows- BRANCH 1 Anderson Bridge Project SR 836 - Bridge Branch have requested some additional work on the north bank downstream from the culvert and Mr Campbell moved that the M D undertake this work as soon as possible Carried �) 2 Megli Bridge INW 2- 30 -25 -4 - File 70377 - Bridge Branch propose to construct a new bridge this winter, and request the M D to install a temporary crossing up- stream from the existing bridge and to do some minor channel improvement work, as well as the bridge fills Mr Campbell moved that this work be undertaken by M D crews and the temporary crossing be put in using the crawler hired from Don Beddos Construction Ltd , Carried 3 Inspection of various bridges by Bridge Branch have been undertaken as follows File 71940 WSW 6- 32 -24 -4 - Bridge Branch will supply culvert for this fob File 72256 - WSW 1- 32 -25 -4 - No action is recommended at this time File 13480 - INE 35- 33 -25 -4 - No action File 7361 - INW 21- 34 -25 -4 - No action File 530 SSE 17- 33 -26 -4 - Minor Repairs will be undertaken - M D forces should restore the hole in the West approach to this bridge Council agreed this would be done W ODUNCIL MEETING OCTOBER 13th, 1981 P 7 File 71175 INW 26- 31 -26 -4 - File 8852 - SSW 18- 32 -22 -4 Bridge Branch will review alternatives for realignment and contact M D at later date Mr Boake moved to accept the recommendations of the Bridge Branch Carried Mr Jeffery noted that Mr Kober had come to meet with Council dust after the meeting with Mr A Waters had commenced He did not return to meet with f Council later in the day After discussion of this matter, Mr Ferguson moved that the M D offer Mr Kober the stun of $5000 00 for the land required for the Huxley Water Reservoir and access to the site Carried Correspondence has been received from C R P C , concerning proposed a amendments to the Regional Plan and after discussion Mr Boake moved this be tabled until the next meeting of Council Carried ' Mr Berdahl took the proposed amendments home with him to read, and will report back to council ' G The Drumheller Auxiliary Hospital and Nursing Home Board has requested 1,,n� �4"; that portions of the M D of Kneehill within the Drumheller General Hospital area, be added to the Drumheller Auxiliary Hospital and Nursing Home Area so the boundaries would be co- terminus After discussion of this matter, Mr Hoff moved that the M.D invite all the hospitals in the area - Drumheller, Three HIlls, Trochu,& Linden Nursing Home 2 to a meeting at the M D Office on Tuesday, October 27th, 1981, for a discussion of the boundary situation, and the correspondence be tabled until after that meeting Carried It was agreed that the haul road into the Garson Pit should be inspected soon Mr t moved that this meeting do now adjourn Carried Tune -
