Ferguson Division 5 Bruce Hastie Division 6 R G Campbell Division 7 J C Jeffery, Municipal Administrator r Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes APPROVAL OF MINUTES After brief discussion of the minutes of the council meetings of August 10th and August 24th, and noting a correction for August 24th minutes as follows Page 4 - 3rd paragraph - Establishment of new Secondary Roads :Correct legal description of Item #2 to read as follows. 2 Road West of Sections 17, 20, 29 & 32 in 33 -22 -4 and West of Sections 5, 6, 17 & 20 in 34 -22 -4 from SR 585 to the Buffalo Jump Park Road, I'Mr Hastie moved approval of the minutes of the August 24th meeting with the above noted .4 correction Carried Mr Boake moved approval of the minutes of the August 10th meeting Carried SOD TURNING CEREMONY i Mr Jeffery noted that a sod turning ceremony is scheduled for today at 10.00 A M at the Red Deer River in connection with the Three Hills Red Deer River Water Project The town has requested that the Reeve and the Water Committee Members attend the %A ceremony After discussion Mr Maerz moved that the entire council attend this ceremony, at 10.00 A M Carried BANK STATEMENTS 1`The bank reconciliation statements for the months of July and August were then reviewed After discussion Mr Ferguson moved approval for the two statements BUDGET HI -LITES Carried Mr Jeffery reviewed a draft of budget hi -lites to date and after discussion i of the statement and the need to change the penalty dates, Mr Boake moved that the meeting do now adjourn to attend the Sod Turning Ceremony, at the Red Deer River Carried The meeting reconvened at 12.30 P M BUDGET & PENALTY DAVE There was further discussion concerning change in the penalty dates, and CHANGES Mr Ferguson moved that a by -law be drafted for considL..,i __,._ at the next meeting to change the penalty amounts as follows November 1st 3% February 1st, 10% MOTION DEFEATED Mr Hastie moved that a by -law be drafted for consideration at the next meeting to change the penalty dates as follows September 1st 2% February 1st 10% CARRIED CHANGE IN SHIFT HOURS FOR There was further discussion about the budget figures and continuation of the CREWS 11 hour shifts for the crews, and Mr Maerz moved that the Public Work crews work a 10 hour shift effective September 15th, 1981, and effective October 1st, 1981 a 9 hour shift, and quitting time for the crews to be 5.00 P M CARRIED �a a COUNCIL MEETING SEPTEMBER 14th, 1981 P 2 Mr. Campbell moved that the budget report be accepted Carried J C JEFFERY REPORT ® Mr Jeffery reviewed his report covering the period August 24th to September 14th, 1981 N and various items were discussed as follows '1 Mr Ferguson moved that the M D purchase a school bus from the Three Hills NEW SCH School Division at a price not to exceed $1100,00 and if possible trading BUS the old school bus back to the Board, but if not possible the M D arrange for the disposal of the old bus. Carried ANSWERING 2 After discussion of the cost for installation of an answering service for SERVICE overload permits, Mr Boake moved that the answering service be installated effective February 1st, 1982 Carried FIRST TIME GRAVEL 3 First time gravel is required for a road ESE 25- 32 -24 -4 and after discussion Mr Maerz moved that Mr Rempel be given authority to gravel this 2 mile of road Carried RECLAMATION OF GRAVEL 4 The reclamation of gravel pits and stripping required was then discussed PITS Work is required at the Megli Pit, Vetter Pit, Hesketh Pit, Lowen Pit and WITH ECON the Garson Pit as well as the Andrews -Lowen Pit (to provide access road) STAB GRANT Mr Campbell moved that two cats and two scrapers, if necessary, be taken off the road projects and reclamation work and stripping be started immediately '^ commencing with the Megli Pit Carried 5 After discussion by telephone with Mr B Kathol, Regional Director of Alberta Transportation, who advised that the M D could hire a cat and or scraper under the Economic Stablization Grant Program to undertake the work in the H gravel pits, as long as the gravel was being used on M D Roads, Mr Hastie moved that Articles of Agreement with Alberta Transportation be prepared under the Economic Stablization Grant Program for reclamation work and stripping in the Megli Pit, Vetter Pit, Garson Pit, and for the access route to the Andrews -Lowen Pit, and further that the M D hire a cat (minimum size of a new D -8E) to assist with the reclamation and stripping work Carried FUEL TRUCK Mr Jeffery reviewed information and prices obtained for sandblasting the tank on the fuel truck (Mack) or purchase of a new tank or a new truck and noted that the company who quoted on sandblasting would give no guarantee the tank would not leak after sandblasting. Mr Hastie moved that nothing be done about replacement or repairs to the Mack Fuel Truck until next year Carried WATER TRUCK WITH The need for a policy about having a water truck on with the gravel trucks, GRAVEL spraying the haul roads in front of people's residences,was then discussed CREW and Mr Maerz moved that no water be sprayed on M D or other roads during gravel hauls Carried FIRST TIME GRAVEL 7 A motion is now required to first time gravel two blade grade roads constructed this year - 1 S /SW 15- 28 -20 -4 2 W /SW 31- 28 -21 -4 After discussion Mr Campbell moved approval for first time gravel for IIthe Blade Grade Roads as follows- 1 S /SW 15- 28 -20 -4 2 W /SW 31- 28 -21 -4 3 W /Sec 33- 29 -23 -4 4 W /SW 28- 33 -22 -4 Carried 8 ANR Productions was given permission to construct roads Mr Boake noted he had a road between Sections 5 & 6 in 29 -26 -4 which I'should also be gravelled Mr Ferguson moved approval P 3 It for first time gravel for the above noted roads Carried AIR CONDITIONER REPAIR I!Mr Jeffery further reported there is an air conditioning repair course "available at Sait commencing October 27th, 1981 Fee is $73 00 each Four mechanics would like to take the course and ask that the M D pay the registration fee, provide them with an M D vehicle to go to the course (course is Tuesday and Thursday Evenings for 5 weeks) allow them to leave COURSE SAIT work at 4.30 P M on the Tuesdays and Thursdays, but not lose any pay for the ,,rfc(L z hour between 4.30 and 5.00 P M j Pd °� After discussion of this request, Mr Ferguson moved that the 4 mechanics , r be authorized to attend the course on the terms as outlined above, but after 5.00 P.M., the employees are considered to be on their own time CARRIED ROADS BUILT NOT TO M D Mr Jeffery then reviewed the problems which have arisen with the roads STANDARDS constructed by various oil companies for the M D, one of which is of poor quality work and the others which are too narrow to meet M D standards Three the roads have been re- measured and still do not meet M D standard width of 26 feet The road constructed by Hudson Bay was built too narrow, but because of poor construction has pounded out and is now over 26 feet wide After discussion of the matter, Mr Boake moved that the companies concerned be written advising the M D will accept the roads as constructed on condition that if complaints are received about the roads being too narrow, the M D may request the companies to re -do the roads and widen them to meet M D standards Carried It was agreed that the companies must adhere to M D standards in future Mr Hastie moved to accept the report given by Mr Jeffery Carried of A S There was discussion about the A S B spraying trees and weeds along the roadsides as it appears damage may have been caused to crops by the spray and people are concerned about the possible hazards to wildlife Mr Jeffery read a letter from the Secretary of the Acadia W I , concerning i.problem After discussion of the problem and what other steps could be undertaken to weeds in the ditches and to kill unwanted brush or trees on the roadsides, I`Mr Campbell moved that this matter be tabled and discussed at the next A S and a recommendation from that meeting be brought back to the next meeting iCouncil Carried this control B SPRAYING ROADSIDES & TREES B meeting of vA OLD SHOP DOORS 'The new doors have been installed on the shops in Three Hills and the old doors ';must now be disposed of The old shop doors from the Carbon Shop are still not disposed of either After discussion Mr Campbell moved that the doors Ibe advertised for sale in two issues of the Capital, with tenders to be opened fat the October 12th meeting of Council Carried THREE HILLS Mr Jeffery then reviewed the required by -laws for debentures for the Ruarkville WATER PROJECT and Grantville participation in the Three Hills Water Project The by -laws will be passed under Section 338 of the Municipal Government Act and after first reading BY- LAWS is given to the by -laws, they must be sent to Alberta Local Authorities Board for 949 & 950 its approval After discussion Mr Ferguson moved first reading to by -law 949 being a by -law to authorize the M D to borrow the sum of $53,083 13 by way of debenture for improvements to the Grantville water supply system Carried Unanimously kA Mr Boake moved first reading to by -law 950, this being a by -law to authorize the M D to borrow the sum of $101,670 10, by way of debenture for improvements to the Ruarkville Water Supply System Carried Unanimously ';ai I 0 COUNCIL MEETING SEPTEMBER 14th, 1981 P 4 REDUCTION OF The government have revised the 1981 assessments for power and pipelines 1981 POWER & as a result of appeals by the various companies and as our 1981 taxes PIPELINE have now been levied and in some cases paid, this will require either ASSESSMENT cancellation or refunds for the overpayment of taxes The total assessment reduction is $25,290, and affects quite a few companies After discussion Mr Campbell moved that the power and pipeline assessment figures be corrected for 1981 and the appropriate cancellations or refunds be made to the companies concerned Carried APPROVAL OF Mr Boake moved approval for the accounts paid in the month of August, 1981 August ACCOUNTS Carried DATE FOR 1981 ORGAN The date for the 1981 organizational meeting of Council was discussed and MEETING Mr Ferguson moved that the organizational meeting be held on October 26th, 1981 commencing at 9.00 A M , in the M D Office in Three Hills Carried All councillors will receive a notice to this effect by mail OFFER RE- S2 20 -32- 26-4 Mr Barry Dennis has submitted an offer of $5000 00 per year for a three year lease of the S2 of 20- 32 -26 -4, payable $2500 00 in the spring and $2500 00 in the fall, and with some requirements regarding fencing After discussion of his offer, Mr Ferguson moved that the M D accept the offer / of Mr Dennis as outlined in his letter of September 7th, 1981, for a three year lease of the S2 20- 32 -26 -4 Carried ACCESS TO LOOK OUT POINT ORKNEY There was brief discussion about an access route rom SR 837 south of Section HILL AREA 9 in 30 -21 -4, out to what is commonly called Look Out Point in the Orkney Hill area It appears from information on hand in the office that this is not a public road and therefore the M D does not have any responsibility to maintain or gravel it Mr Boake moved approval of the agreements arranged Carried GARSON GRAVEL Mr Jeffery requested a committee meet with Mr Victor Garson soon about a gravel lease for next year and it was agreed that the Road Committee and Mr Ferguson arrange a meeting with Mr Garson as soon as possible INSPECTION OF PAVING Mr Hastie requested the Road Committee inspect the West Huxley Paving JOB Project when next out on tour as the paving job is not holding up AGREEMENT RE. Vernal G Cunningham V' 12 SE 18- 31 -22 -4 - John Elmer Price 13 SW 17- 31 -22 -4 - Hugh F Morrish et ux After discussion Mr Campbell moved approval of the agreements as arranged, with the exception of the agreement with Gregory J Frolek, SW 29- 31 -22 -4, as he had requested the M D backslope an old road diversion as part of the agreement and it was felt this should be checked out by Mr Ferguson and the Road Committee'° { prior to approval of the agreement rvf� Carried GELINAS Mr Hastie noted that Lyle Gelinas, an M D employee had been given permission to SCRAPER rent an M D scraper to remove dirt from an M D road allowance and use the RENTAL dirt around his house He did the work on a weekend and Mr Paul Gelinas .v has requested the M D consider a reduction in the rent for the scraper as the removal of the dirt was a benefit to the M D as well as to Lyle After discussion of this matter it was agreed that no reduction could be granted In to a question about quitting time on Friday because of the QUITTING TIME FRIDAYS change in the length of the shifts for the crews, Mr Maerz moved that quitting time will be 5.00 P.M Monday to Friday effective immediately Carried The 1982 Bridge Priorities were then reviewed and Mr Ferguson moved 1982 BRIDGE LIST that the 1982 bridge priorities be those bridges as listed on the 1981 list, with the following additions S /SE 16- 30 -25 -4 - Division 3 IN SW 17- 29 -22 -4 - Division 1 E /NE 2- 32 -25 -4 - Division 4 S /SW 27- 30 -26 -4 - Division 3 Carried LOW LEVEL CROSSINGS There was discussion about up- grading low level crossings and Mr Jeffery was requested to find out if there are still grants available for crossing improvements C R P C AMENDMENT C R P C advise that a public hearing will be held on Friday, October 9th BY ROCKY VIEW to consider the application from the M D of Rocky View for amendments to the 1971 TO PREL PLAN Prel Regional Plan to allow more industrial uses in the rural area After discussion it was agreed that both Mr Hoff and Mr Berdahl should attend this hearing if possible FERTILIZER PLANT C R P C have reviewed the application for development of a fertilizer plant SW 6- 33 -23 -4 on Pt SW 6- 33 -23 -4 and note that storage blending and wholesale dispensing facilities for the fertilizer would be considered an industrial use and would be allowed but a relaxation of the plan must be requested to allow the retail sales as proposed They suggest that Council pass a resolutic-,� requesting the Commission A to relax Part:ll, -, Section 1(1) (h) of the Regional Plan, 1971 AFter discussion Mr Ferguson moved that the M D request the Calgary Regional Planning Commission to relax the 1971 Preliminary Regional Plan Part II, Section 1(1) (h) to allow retail sales from the fertilizer plant to be established on Pt SW 6- 33 -23 -4 Carried It was agreed that this resolution be presented to the commission meeting on October 9th SUBDIVISION An application for isolation of an existing farmstead on NW 26- 32 -26 -4 was NW 26-32 - reviewed and Mr Boake moved that Council recommend approval for this application subject to normal requirements f Carried The problem with unmowed grass on vacant lots in Swalwell and other hamlets VACANT LOTS was then discussed There was a bad fire in Swalwell on September 9th and FIRE HAZARD the residents felt the entire hamlet could have been destroyed as there is so much tall grass on these vacant lots, and most of the owners are non - residents of the hamlet AFter discussion of the matter it was agreed Mr Jeffery should discuss the matter with the M D solicitor to see if there is any quick solution and Mr. Campbell moved that each of the owners of vacant lots in Swalwell be sent a letter requesting them to clean up their property and keep the grass mowed 04 Carried \/1 26 COUNCIL MEETING SEPTEMBER 14th 1981 P 6 GAMBLE COMMUNITY Mr Jeffery reported that the Gamble Community Association advertised ASSOCIATION in a local paper on March 10th, 1981 that a meeting of all officers, DISBANDED directors, members and past members of the Community Association would be held on Wednesday, March 18th, 1981, at 8.00 P M to discuss disbanding the association Since that time the land and building have been sold by auction and the Association have decided to donate the money left over after payment of any debts of the association to the Kneehill Ambulance Service However to date no copy of any minutes from that meeting have been received from the directors of the assocation After discussion of the matter and noting that the dissolution of the association had been well advertised and discussed and people were made aware of the intention to donate the funds left over to the Ambulance Service, Mr Berdahl moved that Council approve of the dissolution of the Gamble Community Association and the duplicate title number 105 0 73 covering Pt NE 10- 30 -23 -4 in the name of the Gamble Community Association be sent to the solicitor, Stan Schumacher, so that the sale of the property may now be completed Carried RECREATION AGREEMENTS The proposed recreation agreements with the towns and villages was again reviewed and it was noted that Three Hllls, Trochu and Carbon have expressed concerns about the new agreement No reply has been received from Acme or Linden, and Torrington is the only village which has signed and returned the agreement After discussion of the matter, and noting that a change has been agreed upon as far as composition of the board (minutes of July 27th meeting of Council) Mr Ferguson moved that no further changes will be made in the proposed recreation agreements with the Towns and Villages Carried The minutes from the Parks Committee meeting of September 3rd were then reviewed and after discussion of various items, Mr Ferguson moved approval of the minutes Carried' VA PARK COMM MINUTES POLICY RE- M D PINS The need for a policy about donation of M D pins was then reviewed and Mr Boake moved that M D pins may be donated by a councillor or the Municipal Administrator,in their discretion,to visiting individuals or groups Carried PESTICIDE Mr Jeffery read a letter sent by the Minister of Alberta Environment to CONTAINER SITE the Association about establishment of pesticide container sites throughtout the province This is for information only Mrs Wilkinson left the meeting at this time. GARBAGE COLLECTION IN Mr Jeffery reported that as the contract with Superior Disposal will HAMLETS expire soon, he had contacted the Towns and Villages as well as Mountain View Disposal regarding possible arrangements for pick up of garbage in our hamlets A further report on this matter will be made when more information is available a MISC ITEMS Mr Campbell gave a report on /hazardous waste meeting he attended recently in Trochu and Mr Maerz moved to accept the report Carried A G T have submitted quotes for a communication system for fire departments and after discussion Mr Ferguson moved to accept and file Carried HUXLEY COMMUNITY Norman Tainsh, Solicitor for the Huxley Community Club has been successful CLUB PROBLEM TITLE TO LOT in obtaining a court order and title to Lots 7, 8 & 9 in Block 9 Huxley 6 is now registered in the name of the community club However he was not able to obtain title to Lot 6 After lengthy discussion of this problem, Mr Boake moved that this matter be tabled and discussed again when more information is available Carried Item Number 21 was on the agenda in error emd this matter is to be discussed at the 2nd meeting of October COSTING REPORT MR Jeffery reviewed a report on public work projects completed to date and after discussion Mr Campbell moved to accept and file Carried n ,o6' I COUNCIL MEETING SEPTEMBER 14th, 1981 P 7 Mr Maerz left the meeting at 6.40 P M Item Number 23 was on the agenda in error The R C M P at Beisker wrote suggesting the M D erect signs on R C M P an intersection north and east of Linden After discussion of SUGGESTION RE ROAD this request Mr Boake moved to accept and file as information SIGNS Carried Mr Campbell moved that the joint meeting with Starland for 1981 be JOINT bi,Li.LA6 held on October 27th, 1981, commencing with a noon luch and meeting WITH STARLAND after Mr Boake moved that the letter received fromarPremiere Alta T V Ltd be filed Carried Mr Chris Helm of Wimborne has submitted a bill for $419 66 CHRIS HELM ACCOUNT in connection with installation of plumbing %Eris residence to hook on the M D sewer After brief discussion of the matter Mr Ferguson moved that no payment be made to Mr Helm for this account and further information be obtained about this matter Carried as a committee COMMITTEE MEETINC Mr Berdahl moved that Council meet /on Tuesday, September 22nd, 1981 RE- GRAVEL PIT at 1 00 P M , with Mr Doug Hazelton to review the Andrews Loewen Pit situation Carried Mr Ferguson moved that this meeting do now adjourn ADJOURNMENT Carried Time - 7.00 P M _z - A_--- - - - - -- - - - -- _ -_ ---- -___ -- - - - Reeve Municipal Administr or P k ! !
