Fuller Estate land Convention 45 Letter frcin P B 1 10911_ COUNCIL MEETING FEBRUARY 23rd, 1981 A regular meeting of the Council of the M D of Kneehill #48 was held in the Municipal District Office, in Three Hills, on Monday, February 23rd, 1981 commencing at 9-00 A M Those present were PRESENT G A Berdahl Otto Hoff Robert E. Boake Richard Maerz T A Ferguson Bruce Hastie R G Campbell Reeve Division 1 Division 2 Division 3 Division 4 Division 5 Division 6 Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator APPROVAL OF r.l Mr Maerz moved approval of the minutes of Council meeting of February 9th, 1981 Carried Mr Jeffery reviewed with Council the report received from the Board of Industrial Relations ..,_ u.- ...._._ling the application for certification of a union After discussion of this report, Mr Ferguson moved to accept and file as information RUARKVILLE nii,D -LL J"�1J MEETING WITH ALTA ENVIRONMENT UNION APPLICATION Carried Mr Maerz noted that some residents of Ruarkville are meeting today with Mr Jack Cookson, Minister of Environment for the Province and they wish him to go to this meeting with them It was agreed that Mr Maerz be authorized to attend this meeting Mr Maerz noted he will be leaving at 10.00 A M TOWN OF THREE HILLS Mr Jeffery noted that the Town of Three Hills representative will be WATER PROJECT meeting with Council this afternoon to discuss a relaxation of M D policy for road crossings The policy states pipelines must cross a road allowance at a 900 angle However enforcing this policy will create considerably more expense for the town's water pipeline and the town are asking the M D to relax this requirement Mr Maerz noted he would have no objection to this relaxation unless there is good reasons for crossing the road at the 900 angle 41r Jeffery doted that this meeting must be continued tomorrow as there is a meeting planned with representatives from Calgary Regional Planning to discuss the Rural Part Study MEETING TO ADJOURN TONIGHT Mr Maerz moved that this meeting be adjourned this evening until 9 00 A M UNTIL Tuesday, February 24th, 1981, in order to complete the agenda for the meeting FEB 24/81 (if necessary) and to meet with the representatives from C R P C Carried ART OF Mr Jeffery noted there is a seminar scheduled for Calgary April 9th and NEGO'T'IATING 10th covering The Art of Negotiating The cost is $475 00 each if more SEMINAR than two persons attend, or $495 00 for an individual After lengthy discussion, Mr Hofof moved that three out of the following four persons be authorized to attend the seminar - J C Jeffery, Bruce Hastie, R.E Boake and R G Campbell Carried Mr Maerz left the meeting at this time - 10 00 A M f Mr Campbell moved that Council meeting do now adjourn to sit as Development DEV APPEAL BOARD Appeal Board HEARINGS Carried Mr Boake moved that the Council meeting do now reconvene the development appeals having been dealt with Carried Mr Alex Cunningham entered the Counci meeting at this time USE OF Mr Jeffery read a letter from. Alberta Environment concerning the use EFFUL NT FROM of effluent from sewage lagoons for irrigation purposes and after SEWAGE discussion Mr Boake moved to accept and file as information Carried COUNCIL MEETING FEBRUARY 23rd, 1981 P 2 Mr Jeffery reviewed briefly the statement from the Town of Trochu regarding expenses incurred by the town for fire department in 1980 After brief discussion Mr Ferguson moved. this letter be tabled and referred to the 3oint meeting planned with the towns and villages regarding fire departments on April 6th, 1981 Carried Alberta Labour have planned a Plumber's Workshop for Drumheller on March 4th, 1981 and Mr Cunningham noted he would like to attend this meeting After discussion of this matter Mr Ferguson moved that Mr Cunningham be authorized to attend this seminar if he so wishes Carried Prairie Bible Institute request Council's permission to hook the new grade school in to the sewer lines south of the school at the manhole on 2nd Street North, rather than into the manhole at 11th Avenue and 3rd Street North The level of this sewer line will allow future expansion to the north of the school without requiring a lift station. Mr Ferguson moved that this request be approved Carried e Patch Work Ente -,- i -1z..� Ltd , will be conducting seismic work in the M D in the near future, in Township 34 Mr Campbell moved to accept and file as information Carried A G.T. have submitted plans regarding proposed line ions in the Acme and Torrington area, as follows. 1 North of 31 & 32 and west of 33 in 29 -24 -4 2 North of 31 in 29 -26 -4 3 East of 2 & 11 in 34 -25 -4 After brief review of the plans, Mr Boake moved the M D voice no objection to the proposed line extensions. Carried TOWN OF TROCHU FIRE EXPENSES PLUMBER SEMINAR P B I GRADE SCHOOL SEWER HOOK UP f CHANGE OF LOCATION SEISMIC WORK A G T LINE Calgary Power Ltd , have forwarded a letter in which they agree to hold municipalities harmless as a result of any of their power lines being located on road allowances Mr Campbell moved to accept and file same as information Carried Alberta Power have submitted plans for line extensions as follows. ALTA POWER LINE 1 To SW 29- 34 -22 -4 - Hutterian Brethren of Huxley EXTENSIONS 2 to LSD 6- 3- 32 -24 -4 - Hudson Bay 011 & Gas - well site 3 to LSD 9- 17- 34 -25 -4 - Gulf Canada REsources - well site 4 to LSD 12- 4- 28 -20 -4 - CDC Oil & Gas - well site 5 to SW 27 -31- 22 -4 - from SW 26- 31 -22 -4 - pole replacement only 6 to various locations as follows LSD 1 & 9 of 15, LSD 2 & 6 and 10 & 11 of 25- 33 -25 -4 - Andex Oil well sites After discussion of the proposed line extensions, Mr Hoff moved approval of the proposed line extensions, with the exception of the line to LSD 1 & 9 of 15 in 33 -25 -4 as it is possible the ljpo�eroad on which this line will be located will be under construction this suTmler Carried OIL WELL Alberta Energy Resources Conservation Board has forwarded a letter in which SET BACKS they request advice as to minimum set back requirements from M D roads FROM • for location of oil wells ROADS After discussion of this matter Mr Campbell moved that the Board be advised wells must be set back at least 125 feet from the center line of a municipal I gravel road and at least 134 feet from the edge of any secondary or paved road,and if the well is to located within 300 feet of an intersection of two road allowances, Council would like the opportunity to review the proposed location Carried The meeting then adjourned for dinner between 12.00 Noon and 1 00 P M n l�' • COUNCIL MEETING FEBRUARY 23rd, 1981 P 3 Carol Meyer and Linda Yakameyschen from C R P C entered the meeting at this time 1 00 P M Mr Hastie moved that Council meeting do now adjourn in order to hold the Public Hearings concerning amendments to Land Use By -law 913 Carried Mr Boake moved that the Council meeting do now reconvene, the public hearings having been dealt with Carried HOLD PUBLIC HEARINGS is :_. _ • were received 929 As no objections /to by -law 928, this being a by -law to amend land use by- law 913 by redesignating the NE 25- 29 -26 -4 from Agricultural Conservation District to Agriculture District, Mr Hastie moved 2nd reading to by -law 928 Carried Mr Hoff moved third reading to by -law 928 Carried were received As no objections /to by -law 929, this being a by -law to amend land use by -law 913 by redesignating the NE 22- 29 -26 -4 from Agricultural Conservation District to Agriculture District, and further to exempt the NE 4 of 22- 29 -26 -4 from Subsection 11.5 1 of the land use by -law - (number of sites allowed on a quarter section)- so as to allow 3 sites on this quarter section - Mr Ferguson moved second reading to by -law 929 Carried Mr. Boake moved third reading to by -law 929 Carried 1980 ROAD PROJECTS The meeting then reviewed the 1980 road projects which were not completed & MIS during the 1980 construction season, and various items were discussed including- ROAD 1 Ross Hill - in Division 6 - should be considered again in 1981 as is now PAC' ITEMS a school bus route and the hill is quite dangerous 2 Possible provision of a road west of 26- 30 -26 -4 if Ron Isaac builds a house in 1981 3 One mile of pavement for P B I in 1981 4 Road south of the Manor Church - 4 miles requires work Mr Jeffery noted that the completed 1980 road projects will be advertised in the local paper for the next 3 months and written off after that time It was agreed that Council should go on road tour in the near future in order to set the 1981 road program Mr Jeffery noted there is a cat care school scheduled for February 24, 25, 26 and 27, and it was recommended that Oris Roger, George Rempel and Bud Haskell attend the excavation school, and John Dorn and Keith Smith attend the earth moving portion of the school This seminar is to be held in Calgary at R Angus Mr Campbell moved the five employees be sentas recommended .. 1371.9-700 7bor P V1 Carried REDESIGNATION An application from W Maerz of Three Hills for redesignation of the SW 26- 32 -25 -4 REQUEST from Agricultural Conservation to Agriculture was then reviewed SW 26 Mr Maerz wishes the redesignation in order to allow him to subdivide the 32 -25 -4 quarter into two 80 acre parcels There was discussion about whether allowing a subdivision would be an intrusion into a formerly unsubdivi.ded area, and Linda noted that the soil classification is mainly 2 -D which is good land After discussion of this request, Mr Campbell moved first reading to by -law 930, being BY -LAW 930 a by -law to amend by -law 913, by redesignating the SW of 26- 26- 32 -25 -4 from Agricultural Conservation to Agriculture Carried Mr Ha.stie moved that a public hearing be held concerning this proposed amendment to by -law 913, on Monday, March 23rd, 1981, at 2 00 P M\' and the notice of public hearing to be advertised in two issues of the local paper Carried td' • 7� COUNCIL MEETING FEBRUARY 23rd, 1981 IM, Representatives from C R P.0 left the meeting at this time Alex Cunningham left the meeting at this time PRESENTATION TO Mrs Lily Weigum of Three Hills entered the meeting at this time MRS LILY and Mr Berdahl made a presentation to her of a cheque in appreciation for WEIGUM the many years of service given by Mrs WeigLun and formerly by her husband Chris Weigum as janitors for the M D Office Mrs Weigum retired from the position recently The minutes from the recent Road Committee tour were then reviewed, and item number 4 - request for extension of existing culvert and approach in to SE 12- 30 -24 -4 was discussed Mr Gust Reinsch, Councillor for the Town of Three Hills entered the meeting at this time - Mr Reinsch requested Council to consider relaxation of its policy requiring pipelines to cross any road allowance at a 90 degree angle as compliance with this would cost the Town quite a bit more money than crossing the roads at about a 70 degree angle If this was allowed it would eliminate the need for cement buffers to prevent damage to the pipe at the jobs i_- the line fram press=e surges Mr Jeffery also noted that UMA have forwarded a request for approval for road crossings, but after review of the plans with Mr Reinsch it appears that the map of the road crossings may not be quite accurate and it was agreed this be return ed to UMA for further consideration The need for boring the road crossings was also discussed and it was noted that open cut crossings would be less expensive and could be just as satisfactory if the proper tamping methods were used Mr Reinsch noted that the Town intend to provide full time supervision during the pipeline construction to ensure that a proper fob is done for all concerned ROAD TOUR MINUTES There was also discussion about ensuring that the pipeline is put low enough on any road crossing to avoid problems with road construction in future especially on hills which might have to be cut down to accomodate road construction Mr Ferguson then moved that the Town of Three Hills be allowed to cross municipal road allowances with the water pipe line at about a 70 degree angle rather than the required 90 degree angle outlined in the road crossing policy, and further that the Town be allowed to open cut the road crossings on any road allowance that is not paved or light coat surfaced, on condition that the proper method of tamping the crossing is undertaken by the town to ensure return of the road surface to a good condition THREE HILLS WATER PROTECT Carried L�l "1'LK r KUri KC�SlUrLLN'15 Mr Jeffe then reviewed a letter received b the M D from the residents RUARKVILLE rY Y of Ruarkville in which they advise they are not prepared to accept the financial responsilality for the costs for the Three Hills Water Project Mr Reinsch was also advised that the residents and Mr Maerz, Councillor for Division 4 are today meeting with Mr Jack Cookson, Minister of Environment to discuss this problem Mr Reinsch thanked Council for their co- operation in this matter and left the meeting Mr Campbell moved that the letter received from the Ruarkville residents be tabled until February 24th for further discussion Carried Mr Jeffery briefly reviewed the minutes from recent water committee meetings Mr Hastie moved to accept the reports and minutes concerning the Three Hills Water Project Carried The Grainger Community Society have written requesting permission from the M D to dispose of their assets and disband the society. After discussion Mr Campbell moved this matter be tabled until February 24th so further information about the title to the community hall property can be obtained Carried Ills, COUNCIL MEETING FEBRUARY 23rd, 1981 P 5 The remainder of the Road Committee minutes were then reviewed The request from John Regehr to trade land which is now being used ROAD COMMITTEE for road access for existing original road allowances (undeveloped) MINU'T'ES was reviewed (NW 12- 30 -25 -4) After lengthy discussion Mr Boake moved that the area be measured to ascertain how much land Mr Regehr would have without inclusion of the existing road allowances Carried The request for the M D to knock the edges off an old road diversion in SE 14- 31 -25 -4 was discussed, and agreed it should be discussed tomorrow when Mr Maerz councillor for that division is present The balance of the minutes of that meeting were reviewed and discussed Mr Ferguson noted the following requests/coming nffrrom his recent COMMAS FROM divisional meeting DIVISIONAL MEETING 1 Narrow spot on the Three Hills Access Road dust east of the DIVISION 5 Dairy King should be widened to allow farm machinery to travel the road 2 The Tolman and Morrin Hills should be signed 'Steep Hill - check brakes" because of the many accidents which have occured on these hills 3 M D should not spend money on providing a spur line into the Village of Linden POLICY RE- The matter of the M D supplying gravel for cemeteries in the M D was then GRAVEL FOR discussed CEMETERIES Mr Berdahl moved that the M D establish a policy as follows- 1 The M D will supply on a one time basis only - up to 100 yards of crushed gravel for any cemetery in the Municipal District of Kneehill or for any cemetery owned by any town or village within the M.D at no charge 1 ,u- 2 The gravel must be obtained from an M D Pit only and cannot be obtained from a stockpile 3 Those responsible for the cemetery must arrange to have the gravel hauled and spread at their own expense 4. A permission slip to enter the M D Gravel Pit must be obtained either from the M D office or from an M D Councillor Carried PROBLEM WITH Mr Boake noted that the stock pile site at the Joe Johnson farm - SE 17 STOCK PILE 29 -26 -4 is too close to the road and is creating a sight distance problem SE 17 After discussion Mr Boake moved that the existing yield sign located 29 -26 -4 at the SE corner of the SE 17- 29 -26 -4 which forces the traffic coming from the north going south to yield to the east -west traffic - be replaced prb with a stop sign Carried OF The Town of Trochu has requested permisson to obtain 100 yards of crush TRTOW TOWN N REQUEST gravel from the M D for its streets Mr Hoff moved that the M D sell ^ FOR the Town of Trochu 100 yards of crush gravel from either an M D Pit GRAVEL or a stock pile site Carried The Council wish it recorded that a presentation was made today to Mr T C Paquette, Public Works Superintendent for the M D of Kneehill Mr Paquette has been employed by the M.D. of Kneehill since 1955 and has been public works superintendent for many of those years He is retiring effective February 28th, 1981, and council presented him with a gold watch as a token of appreciation for the many years of service given to the M D Put uuuivl.iL MEETING FEBRUARY 23rd, 1981 The matter of setting a reserve bid for Lots 17, 18 & 19 in Block 2 Swalwell RESERVE 5050 A K , was then discussed BID ON LOTS Ivir Boake moved that the reserve bid for the lots be set at $200 00 per lot FOR TAX Carried SALE Consideration of cancellation of the following items were then discussed CANCELLATION 1 Business Tax owing by Britannia Painting & Decorating of Acme Roll 8057 OF TAXES The owner of the business moved to British Columbia �''' The Balance owing is $1 62 Mr Ferguson moved that the Council cancel the balance of business tax owing in the sun of $1 62 Carried F: 2 Balance of taxes owing on a power and pipeline assessment against Shell Canada Resources Ltd , Roll 6859 A Balance owing 88G Assessment is nil Last billing against the company was in 1978 Dir Hastie moved that the Council cancel the balance of the taxes owing in the sun of 88� Carried The Town of Trochu has written expressing their concern about the possibility of RE.
