COUNCIL MEETING FEBRUARY 9th, 1981
A regular meeting of the Council of the M D of Kneehill #48 was held in the
Council Room, M D of Kneehill Office, Three Hills, on Monday, February 9th, 1981
commencing at 9 15 A M- following completion of a Public Hearing concerning
amendments to Land Use By -law 913 which was scheduled for 9.00 A M

Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes
Alex Cunningham, Develornent Officer and Carol Meyer, C R P C representative were also
Mrs Marjorie Hanson of Three Hills was present as an observer
As there had been no objections voiced to the proposed amendments to land BY -LAWS 924
use bylaw 913, Mr Ferguson moved second reading to by -law 924, being a by -law r
to amend land use by -law 913 & 925

Mr Hoff moved second reading to by -law 925, this being a by -law to amend
land use by -law 913

Mr Cunningham noted that a NIr W Schlichenmayer of Torrington had filed
an appeal against the decision of the Development Officer refusing a
development permit number 466 -81
Also Mr Robext Elliott had filed an appeal against the decision of the
Development Officer refusing development permit number 467 -81 because of
insufficient setbacks
Mr Campbell moved that the Development Appeal Board hold hearings as follows
Schli.chenmayer - Permit 466 -81 - Monday, February 23rd, 1981, at 10.00 A M
Elliott - Permit 467 -81 - Monday, February 23rd, 1981, at 10.15 A M
and the notice of appeal hearing be advertised in one issue of the Capital
and circulated to the landowners within a half mile radius of the proposed
development

Ms Wanda Patton of C R P C has requested about 2 hours time with Council
to discuss further points about the Rural Part Study they are doing for the
M D , and after discussion it was agreed that a meeting could be held with
Ms Patton on Tuesday, February 24th, 1981 commencing at 10 00 A M , and
if necessary the Council Meeting of February 23rd could be adjourned to
February 24th to finalize any other business which might not be completed
on February 23rd
The following building permits were reviewed.
NW 22- 30 -25 -4 - Allan Barkman - Swalwell - Pig Barn
NE 27- 30 -23 -4 - Earl Morgan - New residence & garage
NW 8- 29 -24 -4 - Earl Balderson - 2nd residence (mobile)for hired help

Mr Jeffery noted that Mr Darryl Gorr of Acme has requested permission
to add on to the existing residence on SE 20- 30 -26 -4 He has completed
the required building permit, but the set back of the existing residence
and the proposed addition do not comply with existing municipal setbacks
The house is only 90 feet from the center of the municipal road to the east
The proposed addition will not be any closer to the road
After discussion Mr Mae= moved the set back requirement of 125 feet from
the center line of the road be relaxed to 90 feet and the building permit
be approved on condition that the addition to the residence meet the 90 feet
setback requirement from the east road Carried

The M D of Rockyview have set up a meeting at the County of Wheatland
office on February 18th, 1981 at 9.30 A.M. , to review with the four A MEETINGS RE.
rural munic-t_palities concerned, the proposed amendment to the Prel PREL REG
Regional Plan regarding industrial uses in the rural areas. PLAN
Rockyview have also scheduled a meeting for 1 30 P M , on March 11th,
1981 at their office in Clagary to meet with the Chairman of the �-
Provincial Planning Board, and the councillors from Kneehill are
invited to attend this meeting
Mr Boake moved to accept the letters as information and as many `A
councillors as possible attend these two meetings

Applications to amend the Preliminary Regional Plan by Crossfield, AMENDMENTS TO
I D , 8 and Beiseker were briefly reviewed and Mr Ferguson moved VA PREL
the M D voice no objections to these proposed amendments REG PLAN

Mr William Maerz of Three Hills has submitted an application for SUBDIVISION
subdivision of the SW 26- 32 -25 -4 into two 80 acre parcels APPLICATION
However as no application for redesignation of this quarter section SW 26- 32 -25 -4
has been received and considered by Council, Mr Campbell moved
to table consideration of this application until such time as
Council has received and considered an application for redesignation

The application for subdivision of a 20 acre parcel from NE 4- 30 -26 -4 SUBDIVISION
by Brian Payne was then reviewed and it was noted that this quarter V^ NE 4 -30 -26
has been redesignated by by -law 924 After brief discussion Mr
Boake moved Council recommend approval for this subdivision subject
to normal conditions

AUMA & AANID & C have completed a study on the set up of regional planning REG PLANNING
comni.ssions and a copy of their study has been received A COMMISSIONS
It was agreed that all councillors would try to review the study and
Mr Hoff moved to accept and file the study as information

Mrs Marjorie Hanson who was still present as an observer to the meeting

mentioned to council her concern that prime agricultural land should be
preserved and not lost to urban encroachment or to country residential parcels
Mrs Hanson then left the meeting PURCHASE OF
Mrs C Meyer noted that the Commission will supply the M D with 20 copies COPIES OF
of land use by -law 913 with amendments to date and any additional copies must LAND USE
be purchased by the M D , After discussion Mr Ferguson moved that the M D
BY -LAW 913
obtain 50 copies of the by -law with amendments to date, from the commission

Mrs Meyer then left the meeting
After brief discussion Mr Ferguson moved approval of the minutes of
council meetings of January 23rd and January 26th, 1981

Mr Jeffery reviewed the bank reconciliation statement for the month
ending January 31st, 1981 which shows a net balance of $1,988,912 07
Mr Campbell moved approval of the statement as presented

Mr Jeffery then reviewed briefly with Council the 1980 financial statement
as finalized by our auditors, The Firm of Henry Van Den Hoven of Three Hills
There was also discussion about the need to hold an annual meeting and the
replies received from ratepayers to date were also reviewed
It was noted that a total of 23 replies had been received to the advertisement
placed in the local paper about whether an annual meeting should be held or not.
Mr Boake moved that no annual meeting be held in 1981, but that each councillor

and Mr Campbell moved that Mr Jeffery publish a breakdown of the 1980 revenue and FIN ATE

financial statement, in one issue of the Capital, and the booklets

It was agreed that the costs for holding the divisional meetings should
be paid by the M D , as no annual meeting is to be held
Mr Ed Denay has asked if Council will pay for his attendance at a
one day course on the new manual on February 27th, 1981, as the
County of Vulcan will not After discussion Mr Hoff moved that
the M D agree to reimburse Mr Denay for expenses incurred to attend
the one day seminar, such as hotel room (if required), mileage and
meals, but will not pay his salary for that day, as he is not
officially starting work for the M D until lurch lst, 1981. SO

The Drumheller Health Unit would like to rent additional space in the
M D Office for its extended health care program and wonder if they
could rent the public works superintendent's office which they understand
will be vacant as of March 1st
After discussion of this request, Mr Maerz moved that the office of the
public works superintendent be rented to the Drumheller Health Unit
on a month to month basis on condition that they will agree to vacate the
office at any time on 30 days notice and further that no alterations
be made to the room

The matter of gifts for the two retiring employees was again discussed
and Mr Ferguson moved that a pocket watch with suitable engraving be
purchased for Mr paquette,and Mrs Weigun be given a bonus of $200 00

as Development Appeal Board

Mr Gordon Taylor, M P has written a letter thanking the M D for arranging
the Local Government Officials meeting held recently

Mrs Osterman had telephoned the office and advised that there is no reason
the M D could not erect signs indicating miles underneath a metric sign, s

but they would advise notduplicating statutory signs - such as speed limit f

because it would likely result in a loss in court for speeding tickets, etc ,
due to the possible confusion duplication of signs might create in the minds
of the travelling public
Mr Sillito, Administrator of the Village of Linden has sent a letter s
suggesting a possible change in format for the local government meeting
in order to allow more time for questions and discussions
Possible changes would be all reports be submitted in writing and become
part of the minutes of the meeting, but not read at the actual meeting
Each municipality contribute a suggestion for discussion at the meeting,
this to be sent in by December 15th and the proposed agenda be sent
out with the invitation to attend the meeting
After discussion of this suggestion, Mr Boake moved to accept the above
correspondence as information

It was agreed that each jurisdication be requested to submit 30 copies VN
of their written report to the M D Office prior to the 15th of December
1981, and to submit a maximum of 3 items for discussion at the meeting
This would allow the M D time to formulate an agenda for the meeting
and to send out copies of the agenda and copies of the reports to each
jurisdication
It was agreed that all concerned should be contacted to see if this
change in format would be satisfactory

It appears that Mr Wilbert Esau /of Donavon, Saskatchewan has been BUSINESS TAX
charged business tax for 1978, 1979 and 1980 However as he sold the land W ESAU
early in 1978 and moved to Saskatchewan, the business tax should not have
been levied against him After discussion Mr Maerz moved that the
business tax of $76 00 and penalty of $19 54 be cancelled

AAMD & C advise that 8 rooms have been reserved for the Spring CONVEN'T'ION

Convention and they must be advised who will be attending
It was noted that all councillors will be attending
Mr Campbell moved that all councillors be named as delegates to the
convention and Mr Jeffery be named as alternate delegate to act if any one of f
the councillors does not attend the convention for any reason

The minutes from the School Div_i_sinn meeting of January 14th were briefly MINUTES
reviewed and some items discussed Mr Campbell moved to accept and file
the minutes and the report given by Mr Berdahl

The Three Hills Hospital have written stating that they are now in THREE HILLS
a position to complete the subdivision of the land required for the new HOSPITAL
hospital The hospital has signed the developer's agreement and SUBDIVISION
have agreed to install culverts and approaches to M D standards
at their own expense.
Mr Maerz moved that C k P C be advised as far as the M D. is concerned
this subdivision - Pt SE 6- 32 -23 -4 - 10 acres more or less - may now be
completed

The minutes from the Drumheller & District Solid Waste Management WASTE ASSOC
Association of January 22nd, 1981 were then reviewed and discussed,
as well as the request from the association for an interim payment
on the 1981 requisition The Association is requesting an interim payment INTERIM
of $18,325 00 ($5 00 per capita based on a population of 3665 ) as they PAYMENT ON
are out of funds and their 1981 budget has not yet been finalized 1981
The need for scales at the land fill site was also discussed in detail REQUSITION
and it was noted that the installation of scales would add considerably
to the costs of the system It was generally agreed the scales do not
appear totally necessary There was also discussion about compaction
equipment required and it appears the association will continue to rent
this type of equipment rather than purchasing a similar unit
It appears the transportation costs for hauling the garbage from the
dump box sites to the land site fill are going up very rapidly The
possibility of the M D hauling its own garbage to the dump box site was
briefly reviewed as a possible way of reducing the costs which are being incurred
Mr Ferguson moved to accept the minutes of the meeting as information, and
the report given by Mr Campbell and further moved that the M D pay the
interim requisition of $18,325 00 at this time

The minutes of the Regional Resources Project meeting of January 20th
were reviewed and Mr Boake reported briefly on this meeting
Mr Maerz moved to accept and file the minutes and report as information

The Sarcee Butte Social Center has submitted their 1980 financial statement
and a list of activities carried on in the hall during 1980
After discussion of the report, Mr Ferguson moved to accept the report
as information

Alberta Housing & Public Works have written advising that there are no
CSP funds available to further assist the Huxley Curling Club, but should

Mr Campbell moved to accept and file the letter as information

Mr Campbell reported that the Huxley Curling Club had their official
opening on Saturday, February 7th, 1981 and it was noted the club
hope to have the rink paid off by next spring
Mr Jeffery reviewed the 1980 financial statement for the Trochu TROCHU SWIMMING
Swimming Pool and it was noted that the M D is reponsible for 50o POOL FIN
of the operational deficit of $16,927 70 and a percentage of the capital STATEMENT FOR 1980
deficit
Iv1r Boake moved to accept the statement as information and pay to the
Town of Trochu the necessary portion of the operational and capital deficits

PROPOSED
Mr Jeffery reviewed in considerable detail the proposed recreation NEW
agreement drafted by the Village of Linden with comparison to the old RECREATION
recreation agreements AGREEMENT
Possible problems which might arise - jurisdications included in the M D
BOUNDARIES - - does this include the City of Drumheller - interpretation problem
Clause regarding no board member receiving pay has been removed
The reason for this was discussed
Change in number of board members from 5 to 7 to 5 to 9
It was felt that the composition of the board should be included in the
actual agreement - not in the regulations - so that no change in the compostion

After lengthy discussion of this matter, Mr Maerz moved that a meeting be
set up with the towns and villages to discuss fire and recreation matters
on Monday, April 6th, 1981, commencing at 9 00 A M ; that
the towns and villages be requested to bring complete cost breakdown of
their expenditures for these two departments, and further moved to accept
the report given by Mr Jeffery

Mr Jeffery noted that Crown Trust Company have forwarded a new lease
agreement covering the Fred Fuller Estate land for 1981 The rental
has been increased from $1800 00 to $2500 00, and after discussion of
the lease, Mr Ferguson moved that this matter be tabled until Mr Jeffery
can review the new lease in more detail and report back to council at the
next meeting as to changes made in the lease for this year

Mr Jeffery read a letter received from Mr Robert Larsen in which
he requests reimbursement for expenses incurred. He feels that a gate
was left open allowing his cattle to wander off the Fuller Estate land
on October 10th, 1980 The cattle were later found at the Lloyd Anderson
farm where they had damaged some hay - cost of $100 00 - and it was
necessary for Mr Larsen to hire a truck to take them home - cost of $126 00
Also one cow was missing and she was never found After discussion of this
matter, Mr Ferguson moved that a copy of M:r Larsen's letter be sent to
Alberta Bridge Branch, at Airdrie for their information

to explain to them the Three Hills Water Project and the costs which will
be payable by the hamlets

Mr Jeffery reviewed at this time statements of income and expenses applicable
• to each of the water and sewer systems and it was noted that the Ruarkville
system is in a deficit situation, whereas the Grantville system appears to have
a surplus However it was noted that neither of these statements include
any depreciation factor
The residents of the hamlets had requested answers to questions about the 41
new system and would also like to see the costs for the existing systems.
Also how will new lots (if any are created) pay a contribution towards the
system -

Grantville residents wish to know how long the funds built up for their
system will be retained or when will the extra money no longer be required
How does the M D pay the Town for water - at what cost per thousand gallons
What administration fees are charged to the systems by the M D
When are the original debentures paid off
The possibility of using some of the Alberta Debt Reduction money
towards the costs of this project was also discussed at some length
and it was agreed by Council that further thought must be given to
a possible solution to the Ruarkville problem with the costs of this system
The Town of Three Hills has submitted an application to Alberta
Energy & Natural Resources for a lease of the crown land required for
the water treatment plant at the Red Deer River - SE 31- 32 -21 -4
and the government has referred the application to the M D. for
comments concerning the proposed use of the land
After discussion Mr Ferguson moved that the M D recommend
approval for the proposed use of this parcel of land by the
Town of Three Hills

UMA have forwarded plans for location of the Three Hills reservior
on Pt SE 6- 32 -23 -4 (P B I Land) and request approval from the M D
to construct the reservior After review of the plans Mr Ferguson
moved that the Town of Three Hills be given permission to construct
the reservior on this land and they further be advised that no relaxation
of set -backs are required from the M D as the land is located within a
hamlet area (P B I ) and the set -back for developments within a hamlet
is 25 feet from the boundary of the property

It was noted that UMA should contact Alberta Transportation for
clearance of the setbacks from SR 583 as the possibility of widening
this access road has been considered in the past

It was generally agreed that motor grader operators who normally work
from their shops in Acne, Wimborne, Carbon or Trochu should consider
that shop to be their normal headquarters Mr Maerz moved that
Mr Ehrmann be paid for 13 hour days (rather than 12 hours) during
the time he was working on the Anderson Bridge Project, as his
hours of work would start on his arrival at the Wimborne Shop and
end when he return ed to that shop
