HomeMy WebLinkAbout1981-01-26 Council MinutesuOUNl.1L MEETING JANUARY 26th, 1981 A regular meeting of the Council of the M D of Kneehill #48 was held in the Municipal Office, Three Hills, on Monday, January 26th, 1981, commencing at 9.00 A M Those present were- PRESENT G A Berdahl Division 1 (Reeve) Otto Hoff Division 2 R E Maerz Division 4 R E Boake Division 3 T A Ferguson Division 5 Bruce Hastie Division 6 R G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Administrator was present and recorded the minutes Mr T C Paquette, Public Works Superintendent was also present for a portion of N the meeting APPROVAL MINUTES Mr Boake moved urr� ��.1 of the minutes of the meeting held January 19th, 1981 � Carried GRAVEL CRUSHING Mr Doug Hazelton, Linden Contractors entered the meeting at this time He noted he is crushing now for Alberta Transportation, having worked 4 days last week and probably four days this week will be required There was discussion as to whether there would be enough area stripped to get gravel for chips for the M D Mr Hazelton noted that the government hauled out of the M D stock pile on Sunday night and also had some of the MD gravel trucks working that night There is a gravel checker working at the Anderson Bridge Project so the records of amount of gravel the government is getting from the M D should be quite accurate Mr Hazelton noted the government took 3000 yards from the belt last week and about 2500 yards from the stock pile, and likely they will need that much again this week Mr Hazelton noted that there is about 12,000 yards stockpiled for the M D now at the Megli Pit He agreed that if the weather holds, when he is finishing crushing for the government he will do the chips the MA If stripping is required to get sufficient gravel for the chips it will be expensive as there is considerable overburden He is going down in the pit until he hits water or until the gravel runs out It has been two years since strippingw/,a,s at the pit He noted that if the 10 foot ridge of dirt was stripped and moved to the north, it would give the M D more gravel and better access to the gravel It was agreed that Mr Paquette should check this matter with Mr Hazelton and report back to council v, Mr Hazelton also asked for a payment on the crushing done to date, and he then left the meeting No decision about this payment was made at this time MR Ray Frere of Trochu entered the meeting at this time TRUCK BIDS Mr Jeffery opened the bids received for the two sand truck units and the bids received were as follows LA Town of Trochu - T -25 $3500 00 T -15 $3000 00 one truck only required Robert Lee Donalda, T -15 $3550 00 Lorral Tractor Ltd - two units total bid $4630 00 Robert Blagen - T -25 $850 00 , T -15 $1000 00 V� Village of Acme - T -25 $1750 00 Mr Frere then left the meeting and council discussed the bids offered NIr Campbell moved that T -25 be sold to the Town of Trochu for $3500 00 40 • COUNCIL MEETING JANUARY 26th, 1981 P 2 and T-15 be sold to Robert Lee for $3550 00 Carried The bids for supply of diesel and regular gas to the M D were then o FUEL BIDS reviewed as follows Paned and 1 Linden Trading Co-Op - Clear Diesel 21 2� per liter Regular Gas 23 iG per liter 2 U F A - Clear Diesel 21 6� per liter Orange Gas 23 4� per liter 3 Gulf Oil - - Regular Gas price ranged from $1 12 to $1 13 per water consumption at the motel has decreased over the past two years After discussion gallon depending on location delivered to Mr Ferguson moved to accept the report given and or 24 6� to 24 81� per liter - Diesel Fuel Carried Mr R Kennedy, Signman received information about a Multi purpose manual price ranged from $1 03 to $1 05 per gallon traffic sign inventory system, under which each sign in the M D would be indexed or 22 7G to 23 W per liter 4 Imperial Oil Regular Gas 22 2G per liter Diesel 21.W per liter After discussion Mr Ferguson moved that the Council accept the bid from the Linden Co-Op for supply of diesel fuel and regular gas as outlined in the bid � for the coming year Carried MASTER FEED MILL There was brief discussion concerning the request from the Linden & District DEV Chamber of Commerce about the proposed development of the Master Feed Mtll / C�b\e' within the village of Linden and the need for the construction of a spur line Mr Maerz moved that this matter be tabled �� c•��''� Carried ROAD DIVERSION 114r Hoff noted that Mr John Regehr had spoken to him about the possibility Of obtaining part of an unused original road allowance and adding it to NW 12- 29 -24 -4 a small part of his land in thc_ NW 12- 29 -24 -4, which is cut off from the H rest of the quarter by a road diversion and then obtaining a subdivision for this i Mr Paquette reported that the 4 M D scrapers are now working on the Anderson Bridge Project +� He left the meeting at this time WATER RATES Mrs Wilkinson reviewed the rates presently being charged the Lamplighter LAMPLIGHTER Inn for water and sewer The motel pays a flat rate of $72 00 per month The INN water consumption at the motel has decreased over the past two years After discussion Cow Mr Ferguson moved to accept the report given and Mrs Wilkinson investigate the matter further Carried Mr R Kennedy, Signman received information about a Multi purpose manual SIGN traffic sign inventory system, under which each sign in the M D would be indexed SYSTEM on a card, and the card would indicate when the sign was put up, when it was checked by the signman, etc However it appeared the system would involve considerable paper work, and time on Mr Kennedy's part to get the system up =dated After discussion of the possible benefits, Mr Ferguson moved to accept and file as information Carried A request has been received from the Marigold Library System for the MARI M D Council to review its decision not to participate in the system LIBRARYOLD Fourteen reasons were outlined After discussion Mr Ferguson moved that the M ✓1 D confirm its decision not to participate in the Marigold Library System k. lbeen An application for redesignati.on of the NE 22- 29 -26 -4 has received from Mrs r�2`�T 22 -29 9 -26 26 A Seiler and Randy Seiler It was noted that there is already an existing subdivision on this A quarter, so it has reached its maximum density It was agreed that this matter be discussed again after lunch when the ._wvr.,_ s::,:.,�tative from C R P C is present ROAD DIVERSION 114r Hoff noted that Mr John Regehr had spoken to him about the possibility Of obtaining part of an unused original road allowance and adding it to NW 12- 29 -24 -4 a small part of his land in thc_ NW 12- 29 -24 -4, which is cut off from the H rest of the quarter by a road diversion and then obtaining a subdivision for this i A COUNCIL MEETING JANUARY 26th, 1981 P 3 small parcel of land It was agreed that this matter also be discussed again after lunch. Mr Jeffery reported that Mr Ed Denayslas written accepting the 0 ED A DEN Position of assessor with the M D effective March 1st, 1981 ENAY Iv1r Boake moved to accept the letter as information Carried The meeting then adjourned for dinner between 12.00 Noon and 1.00 P M DINNER Mr Jack Connor from Acme, and Mrs Carol Meyer, representative from C R P C entered the meeting at this time f CONNOR Mr Connor has applied to Council for redesignation of his land - NE 25- 29 -26 -4 REDESI REDESIGNATION from Agricultural Conservation to Agriculture to allow him to NE 25- apply for a 40 acre subdivision He wishes to turn the 40 acres over to 29 -26 -4 his son, who proposes an intensive hog or poultry operation for this land Mr Jeffery read the letters received from the Drumheller Health Unit, Alberta Agriculture and Alberta Environment about location of an .intensive farming operation within 2 miles of an urban center Carol noted that the main concern to be considered is the impact such an operation would have on the Village of Acme, as the proposed land use would not be compatible r with the land uses in the Village of Acme Mr Connor noted his son is considering the possibility of a 60 to 100 sow farrow to finish operation He noted there would be no problem making arrangements for disposal of the manure on land outside the two mile radius of the village He noted his son is looking at various types of develoF went - one being a covered lagoon for storage of the manure and the other a holding tank Mr Connor also noted that there are three existing pig operations closer to Acme that this proposed development would be It was agreed that good management determines whether the operation is a problem or not Carol again noted that Council's only concern at this time should be whether they feel an intensive operation should be allowed that close to the Village of Acme NIr Connor was thanked for coming and he left the meeting BY -LAW After further discussion of this matter, Mr Boake moved first reading to 928 by -law 928, this being a by -law to amend by -law 913 to redesignate the NE 25- 29 -26 -4 from Agriculture Conservation to Agriculture N Carried DATE FOR Mr Maerz moved that the Public Hearing for this amendment to the By -law PUBLIC HEARING be held on Monday, February 23rd, 1981, commencing at 1 00 P M Carried The request from Mr John Regehr to Mr Hoff about possible subdivision ROAD DIVERSION of a small parcel of land from the NW 12- 30 -25 -4 Was then reviewed & POSSIBLE SUBDIV Mrs Wilkinson noted that if there is a roaa uiversion crossing Mr Regehr's NW 12 land it is not surveyed and dedicated as public road access However there 12- 30 -25 -4 is an existing subdivision on this quarter, so the quarter has reached its maximum density Pair Regehr would like to obtain title to the unused portion of original road allowance in exchange for the land required ,4 for the road diversion, and then apply for a subdivision of that portion of r +e C. the quarter cut off by the road diversion including the portion of unused road le allowance It was noted that this parcel could only be used for a country residential parcel , which is not a permitted type of subdivision in the rural part After lengthy discussion Mr Hastie moved that this matter be tabled until such time as Mr Regehr may make a formal application for redesignation of this quarter, and further moved that the Road Committee .inspect the road and report back to Council as to whether the road diversion is required Carried There was then lengthy discussion about the application from Randy and Mrs SEILER A Seiler for redesingation of the NE 22- 29 -26 -4 to allow for a 40 acre REDESIGNATION subdivision for intensive farming operation Carol advised that under NE 22 the existing preliminary regional plan 4 40 acre parcels could be allowed, 29-26 -4 but under the present land use by -law the maximum density has been reached V' for this quarter as there is already an existing 5 acre subdivision .4 14 14 COUNCIL MEETING JANAURY 26th, 1981 She also noted that once the proposed prelim nary regional plan is P 4 approved by the Province, only two parcels per quarter section would be allowed in the rural parts However at this time Council could write an exception clause into the land use by -law to specifically designate the particular quarter section and state that the quarter would not have to comply with the maximum density outlined in the land use by -law After lengthy discussion Mr Maerz moved first reading to by -law 929, this being a by -law to amend land use by -law 913, to redesignate the NE 22- 29 -26 -4 from Agriculture Conservation to BY -LAW 929 f, "_ C. r U ^ VJ A griculture, and further to amend the Agricultural District (A) Land Use Rules and regulations to allow a maximum density of three parcels on the NE 22- 29 -26 -4 Carried Mr Boake moved that the date for the public hearing for this amendment PUBLIC HEARING to the land use by -law be set for February 23rd, 1981, at 1 30 P M , `IA Carried ASSESSb= Mr Jeffery advised that several assessment roll changes had been missed ROLL CHANGES by the assessor when completing the 1981 assessment roll Under the Municipal Taxation Act, Council can direct the assessor make these changes and to assess and tax the property for the 1981 taxation year After discussion of this matter, Mr Campbell moved that the Assessor be directed to make the changes and assess and tax the following parcels of V land for the taxation year 1981 Fa 6 1 Pt NE 11- 33 -26 -4 - Roy Ashcroft - subdivision completed in 1980 k , e' 2 Pt NW 31- 29 -22 -4 - David STewart - subdivision completed in 1980 cl 3 Pt SW 7- 31 -25 -4 - Aileen Prohl - old subdivision - assessment not previously split between two 80 acre parcels 4 Pt SE 14- 32 -26 -4 - Milton Rempfer - subdivision completed in 1980 5 SE 20 and SW 20 in 32 -26 -4 - M D of Kneehill 048 - change land to exempt status M D purchased land in 1981 The matter of P Y a i g Linden Contractors at this time for gravel crushed to date rather than waiting until the next cheque run in February was discussed, and L- LiWL'64 Mr Maerz moved that Linden Contractors be paid $20,000 00 at this time, CONTRACTORS in advance of the M D normal cheque run, and Mr Hazelton be advised that in future his accounts are to be submitted to the office by Friday morning prior to the 2nd & 4th Monday of each month if he wishes to be paid in that cheque run, otherwise his YKC Ctityu C.H accounts will not be paid until the next cheque run Carried A S B The Council then briefly reviewed the Memorandum of Agreement with regard GRANT A/G to the 1981 Grants from the Provincial Government to the Agricultural Service Board An estimated figure for wages for the Ag F.ieldman was arrived at, it being necessary to estimate because of the possible union certification pending, and the fact that no wages have been settled for 1981, and one item was changed from $1700 00 with a grant of $1000 00, down to $800 0 0 with the apr . _ c L ,. _ :_ ..te change in the grant figure Mr Ferguson then moved to approve the memorandum of agreement for the 1981 grant programs for the A S B Carried SECOND RADIO There was discussion about the possibility of a councillor obtaining a second FOR radio, for use in his vehicle and leaving a radio in his residence After COUNCILLOR discussion Mr Boake moved that any councillor be allowed a second mobile radio if he requests one, and if there is a spare unit available, however the radio may be taken back immediately if the same is required for any M D vehicles Carried DEj,c t� �11VLV A delegation of Mr Art Chamberlain, Ken Penner, Ken Amstutz and Paul Meier from RUARKVILLE the hamlet of Ruarkville entered the meeting at this time - 3.30 P M RE- WATER There was lengthy discussion with the delegation about the proposed Three Hllls PROJECT Water Project and what effect the costs of the project will have on the residents V� of Ruarkville Mr Jeffery reviewed the estimated costs of $7,400,000 00 and the amount of $198,679 18 will have to be picked up by the residents of Now 6.2 L I-- is • COUNCIL MEETING JANUARY 26th, 1981 P 5 Ruarkville The amount payable by the hamlet is higher because the hamlet used a portion of the grant available to it under the Provincial Infrastructure Grant Program when the water and sewer was installed in Ruarkville in 1978 Therefore the hamlet will receive only the balance of the grant available towards this project The delegation request the M D Council to give the hamlet a portion of the Alberta Debt Reduction money to help off set the large costs of this project The delegation was thanked for coming and they left the meeting There was further discussion about this matter, and how the problem might be resolved Mr Boake moved that the Water Committee hold a meeting with the residents A MEEI'IN RLALL\ v ii of Grantville and Ruarkville as soon as possible (betw(--,en February 2nd to C5 & GRANi'VILLE February 5th) to discuss this matter and give the residents all the `Ck ��,� u� information about the project which is available to date s Carried NEIL HAZEL Mr Maerz reviewed the recent accident incurred by Neil Hazel on an M D road AL1 - LjrLVt ON because of a snow ridge left on the road, and after discussion Mr Maerz . Tc� moved that no letters be sent as a result of the previous motion made concerning p this matter at this time Carried MIS PUBLIC Mr Hoff reported there is still a problem between Mr A Becker and Mr V YORK ITEVJS Brost regarding road access Mr Hastie reported that E Albrecht advised him the cementJcrossing at SE 12 - 33 -25 -4 is very rough and it was agreed that the road committee should have a look at the crossing some time when on tour Mr Hoff suggested the road committee .inspect the road west of SE 12- 30 -25 -4 and south half mile Mr Maerz moved that this meeting do now adjourn Time - 5.30 P M Reeve V, Carried Muni 'pal a or fs It :S • ""
