Municipal Office, Three Hills, on Tuesday, October 14th 1980, commencing at 9 00 A M , Monday, October 13th, being a statutory holiday Those present were G A Berdahl Division 1 C W Poole Division 2 September 22nd,1980 Carried BANK STATEMENT The bank reconciliation statement was reviewed and briefly discussed It showed a net balance of $326,561 24 Mr Ferguson moved approval of the bank statement as presented Carried CHANGING COUNCIL MEETING The possibility of changing the date for council meetings was briefly DATES discussed and it was agreed that this matter be discussed again at the DATE FOR PAYMENT organizational meeting of the new council OF ACCOUNTS There was also discussion about the date for payment of accounts and ETC it was noted that there is a problem with payment of certain accounts, utilities, etc , due to cut off dates by the companies Mr Berdahl moved that this matter be tabled until the next meeting of Council Carried GRAVEL Mr Doug Hazelton, Linden Contractors, entered the meeting at this time - 9 15 A M He stated he is working at the Garson Pit now and has about 18,500 yards crushed There is not much gravel in the stripped area He also noted he has to do some CRUSHING crushing for Alta Transportation on the south side of the pipeline, about PRICES 14 400 yards He felt there may be about 35,000 yards available in the stripped area, and noted there is a ridge to the north which may contain considerable gravel if Mr Garson would allow him to crush in that area He noted he was going to speak to him to see if he would allow him to strip and crush in that area due to the smaller quantity of gravel available in the stripped area There was also discussion about the Lowen Pit and Mr Hazelton noted he would probably be at the Garson pit until the first part of November, and then would move to the Andrews -Lowen Pit Mr Bauer moved that the councillors meet with Mr Hazelton on Friday, October 24th, at 9 00 A M to inspect the Andrews -Lowen Pit Carried It was also generally agreed that Mr Hazelton should crush all the gravel available in the stripped area at the Garson Pit so the area can be properly backsloped and reclaimed after he moves out the crusher Mr Hazelton also asked for an due to increased costs of fuel His present prices (as per con Megli Pit Schmutz Pit Vetter Garson Pit Andrews =Lowen Pit increase in the price for crushing the gravel and repairs, etc Increase of 20� a yard,except Andrews -Lowen tract granted in September of 1979) are Pit McNair $1 33 $1 38 r $2 45 Council agreed to discuss the matter and advise Mr Hazelton later He then left the meeting After discussion of this request Mr Berdahl moved that Mr Hazelton be granted the price increase effective October 15th, 1980 as follows Garson Pit $1 58 CABINETS Mr Ferguson moved that the two retiring councillors be allowed to purchase BY RETIRING COUNCILLORS their filing cabinets at a price of $75 00 each Carried It was agreed that this policy should be recorded in the policy book Various circulars from AAMD & C were reviewed and the association request AAMD & C information about which councillors will be attending the 1980 Fall CIRCULARS Convention & FALL Mr Ferguson moved that all councillors and the retiring councillors be CONVENTION authorized to attend the convention, that the retiring councillors' expenses be paid for attendance at the convention, but not a per diem rate, and further that elected councillors attending be named as delegates to the convention with Mr Jeffery as alternate delegate if any of the elected councillors do not attend the convention Carried Mr Berdahl moved that the information circulars from the AAMD & C be filed as information Carried MINUTES FROM CAAMD & C advise that the fall meeting of the CAAMD & C will be held on CAAMD & C October 30th, commencing at 10.00 A M in Stettler EXECUTIVE The minutes from the directors' meeting of September 30th were also reviewed MEETING It was agreed that copies of the M D 's resolution regarding taxation of ETC intensive agri businesses should be taken to this meeting The minutes of the September 17th School Division meeting were reviewed and discussed, and it was noted that the next meeting is set for October 15th,1980 Mr Bauer moved to accept and file as information Carried REG RES Correspondence from Regional Resources Project was reviewed and Mr Berdahl PROJECT moved to accept and file as information CORRESPONDENCE Carried Alberta Hail & Crop Insurance have requested information from all municipalities ALTA HAIL about rivers or streams in their areas which may be subject to flooding FLOOD They are attempting to establish an insurance plan to protect farmers against INSURANCE flood damage Mr Campbell moved that the Corporation be advised the Council PLAN dc, not feel there are any problem rivers or streams in this area at this time Carried The position of Public Works Superintendent was then reviewed and discussed P W at considerable length Mr Paquette will be retiring at the end of February, SUPERINTENDENT 1981 Two applications have been received for the position, one from John f, JOB Dorn and one from George Rempel and it was agreed that they should be interviewed this afternoon WIMBORNE Garnet Bauer, Fire Chief for the Wimborne- Torrington Rural Fire Area entered the TORRINGTON meeting at this time Their department request council assistance towards the FIRE purchase of a paging system for the department There is no 24 hour place AREA where a phone could be installed and because alot of their members are farmers PAGERS with only 4 men on the department from the village of Torrington, they feel the pagers would be more suitable to their needs Installation of fire phones to the rural residents would be quite expensive Total cost for the paging system is N estimated at $10,000 00 and the department has about $4100 00 available to put towards the costs They may also be able to raise more money The men have agreed to put their 1980 honorarium of $1600 00 towards the costs and have received $2500 00 from the Alta 75 Birthday grant Also some men are purchasing their own pagers It would require permission from the M D for their department to use the M D radio frequency a, The department hope tha towards the system, but Council Mr Ferguson moved that the Torrington- Wimborne COUNCIL MEETING OCTOBER 14th, 1980 P3 L the Village of Torrington will also make a contribution no definite decision has been made as yet by the Village the M D extend credit up to a limit of $5000 00 to Fire Area for purchase of the paging system Carried Mr Bauer also noted they wish to arrange for a set up where they can fill their own air pack bottles, rather than having to send them to Red Deer to be refilled and it was agreed that this should be done Mr Bauer then left the meeting - 11 50 P M The meeting adjourned for dinner between 12 00 & 1 00 P M Mr Litz entered the meeting at this time - 1 00 P M There was further discussion about the public works superintendent fob and the possibility of splitting the responsbility of this position between the two applicants was also reviewed and discussed in detail Mr Dorn and Mr Rempel are to be in for interviews about 2 00 P M Mr Poole reported he had checked the street light situation in the hamlet of Swalwell and did not feel that an additional light would be necessary After discussion of the matter, Mr Poole moved that no additional street light be installed in the hamlet of Swalwell, at this time Carried DINNER P W SUPERINTEND- ENT JOB ITEMS FOR HAMLET OF SWAL- WELL Mr Poole also noted that there are quite a few weeds on the edges of the streets It appears that this problem was created by disturbance of the land when installing the sewer system The weeds should have been mowed this summer, and the area re- seeded to grass After discussion Mr Ferguson moved that this matter be referred to the A S B for consideration and resolution of the problem Carried It was agreed that any work would be restricted to M D streets and M D property only, and not on any private lots The Swalwell Town and Country Club request Council to install a stop sign on the north -south road west of the community center so traffic would be required to stop as it comes from the north to the south on this road After discussion Mr Brown moved that this request be referred to the Road Committee for inspection Carried Mr Poole also noted that a road in the vicinity of the Dorne Fyten farm requires gravel as an oil rig moved in and left considerable amount of mud on the road It was agreed that this road be inspected by the gravel foreman VN BECKER Mr Poole also noted he had discussed the rock problem in ditches along SR 575 FOR near the Grainger Bridge with Mr Becker He had also discussed the account TRESPA� submitted by Mr Becker against the M D for crossing his land to get water from the Kneehill Creek After discussion Mr Becker had agreed to settle the claim for $150 00 rather than $200 00 Mr Brown moved that Mr Becker be paid $150 00 as settlement of this account LUMPS Carried ROCK`. The problem with the rocks, and lumps of sod in the ditches was further discussed D and it was noted that Oris will try to break down the lumps with the harrows Of However nothing will likely solve the problem to the satisfaction of the 575 farmers along the road Mr Poole noted no written agreements had been arranged for borrow pits, etc WEBB EMPI on the Empey Webb road - and the following persons had been affected PRO, Jerry Penner - large borrow pit - suffered some grass damage - SE 30- 30 -25 -4 AGREEI Dick Webb - two small borrow pits - NE 30 - 30 -25 -4 (or perhaps one is on SW 29) Lloyd Howe - large borrow pit - SE 31- 30 -24 -4 Robert Empey - one small borrow pit - NW 29- 30 -25 -4 (some drainage work undertaken for Mr Empey) Mr Litz moved that Mr Jeffery contact these people and arrange settlements with 1 them for this project r Carried COUNCIL MEETING OCTOBER 14th, 1980 P4 George Rempel entered the meeting at this time - 2 10 P M There was lengthy discussion with George regarding the possibility of PUBLIC WORKS splitting the Public Works Superintendent Job between John Dorn and himself A SUPERINTENDENT POS I'TiON Mr Rempel expressed his views on the suggestion and noted that perhaps all the foremen should discuss this suggestion with Mr Jeffery and review ✓A possible problems He noted it would take alot of co- operation between the foremen involved Mr Rempel left the meeting and Mr Dorn entered the meeting After he presented his views on the suggestion, Mr Darn requested council's 0 view regarding a fence - backsloping agreement he has tentatively arranged R, PETERS with Mr Robert Peters of Wimborne Mr Peters wishes his fence removed BACKSLOPING and replaced by the M D., and the M.D is to supply two wires for the FENCE AGREEMENT replacement fence and he will supply 2 wires He would allow the M D WIMBORNE RD to backslope on his land and have a borrow pit in return for this consideration PROJEC Mr Litz moved that the M D enter into an agreement with Mr Peters on this basis Carried Mr Bauer moved that the discussions regarding the Public Works Superintendent position be tabled until the next meeting of Council Carried The Select Legislative Committee regarding surface rights have sent a letter acknowledging receipt of the letter from the M D Council supporting the Three Hills Surface Rights Group brief Mr Ferguson moved to accept and file Carried There was brief discussion regarding the status of exempt property in the M D and Mr Poole moved that this item be tabled until a later meeting of Council CArried SURFACE RIGHTS ACT A EXEMPT PROPERTY STATUS The need of including the old Wimborne School Property within the hamlet (Y`'' `WIMBORNE SCH boundaries was briefly discussed and it was agreed that this matter should SITE IN be discussed again prior to finalizing the new land use by-law HAMLET BOUNDARY? Alberta Municipal Affairs have now issued Board Order No 798/80 which BOARD ORDER authorizes the M D to use the 1980 assessment roll for taxation purposes in RE 1981 1981 ASSESSMENT ROLL Mr Berdahl moved first reading to by -law number 920 regarding adoption of the 1980 assessment roll with changes for taxation purposes in the year 1981 BY LAW Carried 920 Mr Poole moved second reading to this by-law Carried ,,- Mr Bauer moved that third reading be given to this by --law at this time Carried Unanimously Mr Litz moved third reading to this by-law Carried Mr P Madden Solicitor has requested the M D sign a RUAR PROPERTY q postponement of PROPERTY ✓' its caveat in order to allow Alberta Home Mortgage to be a first charge POSTPONEMENT against Lot 2 in Block 2 Plan Ruarkville 7810405 After discussion of OF CAVEAT this matter Mr Campbell moved that the M D sign postponements of this caveat if required to allow a mortgage to be a first charge against the property Carried DRUM REG SOLID Mr Jeffery reviewed correspondence received regarding the Drumheller & District WASTE Solid Waste Management Association and the minutes of the meeting of the ASSOC Association held on October 16th, 1980, were reviewed Various items were discussed and the financial statement received was also discussed KNEEHILL Mr Jeffery noted that the Kneehill Sanitary Land Fill Committee held SANITARY LAND a meeting on September 22nd He also reported that there was a fire FILL which spread from the rubble pit out into surrounding farm land and MEETING Merl Arvidson lost about 250 bales because of the fire There was also brief discussion about who is responsible for costs incurred for maintenance of the dump boxes Mr Poole moved to accept the reports given regarding these two matters f Carried COUNCIL MEETING OCTOBER 14th_ 1.980 P5 After review of the accounts, Mr Poole moved approval of same for payment,A APPROVAL OF Carried ACCOUNTS Mr Jeffery noted that Robert Kennedy objects to his rate of pay as set R for the month of October for the Sign Man job, The rate was set at Intermediate Operator for the first month and raised to Senior Operator after completion of the first month Mr Kennedy was previously classed as a Senior Operator with Sub - Foreman classification so was earning $8 62 per hour and as an Intermediate Operator would drop to $7 83 per hour He did not feel he should receive such a drop in wages as he had been employed by the M D prior to taking the Sign Man Job After discussion of this matter, Mr Brown moved that Mr Kennedy be paid as a senior Operator effective from the date of commencement as Sign Man Mr Ferguson requested a recorded vote Councillors Poole, Brown, Bauer, Litz and Campbell in favour Councillors Ferguson and Berdahl opposed MOTION CARRIED Mr Edward Noble of Calgary has offered the sum of $1000 00 for Lots2 and 3 in Block 10 Plan Swalwell, on condition that he be allowed to place his mobile home on the property on a temporary basis while he is constructing his new home After discussion Mr Poole moved that the M D sell the lots to Mr Noble for $1000 00, on condition that he pay for the land in full, enter into the normal agreement for sale whereby he agrees to construct a single family KENNEDY RATE OF PAY FOR SIGN MAN SALE OF LOTS N SWALWELL E, NOBLE residence on the property within the required time limits, and further that he apply for the required permits for the single family residence and apply and obtain a temporary permit to place his mobile home on the property for a six month period during construction Carried A copy of a letter from Elton Wilkinson of Carbon addressed to Mr and Mrs Donald Hansen of Edmonton was referred to the M D for its consideration There is a problem with access to the NE 17- 30-23 -4 and Mr Hansen presently trespasses on private land - NW 16- 30 -23 -4 (Wilkinsons' land) to aain access to his property As Mr Hansen was considering a subdivision for his land f Mr Wilkinson has pointed out that there is a problem with trespass and the private portion of the trail will be marked and closed off After brief discussion Mr Bauer moved to accent and file as information Carried The Village of Carbon have sent a letter advi:sinq they are proposing an annexation of the balance of the NW 14- 29-23 -4 to the Village After discussion the letter Mr Poole moved that the M D voice no objection to this proposed annexation to the Village of Carbon Carried Mr Jeffery reported that some -one apparently left the gate open at the Anderson Bridge Project late on Friday and Mr Larsen's cattle got out They strayed quite a distance, got into a hay stack on the B Anderson land and destroyed it, and Mr Larsen had to get a cattle liner in to haul them home There is also one cow still missing The M D crew was not at this project at that time, but it is possible that Alberta Bridge Branch crew or Linden Contractors' crew could have left the gate open There had been no sign of any cattle in the property previous and it was also noted that there is still crop in swaths It was agreed that Mr Jeffery should check further into the situation and report back to Council at the next meeting LETTER RE- ACCESS E WILKINSON NW 16- 30 -23 -4 & NE 17 -30- 23-4 CARBON of PROPOSED ANNEX- ATION STRAY CATTLE AT ANDERSON BRIDGE PROJECT The Village of Torrington request permission to acquire land in the M D ANNEXATION They are purchasing 30 acres more or less in SE 34- 32-26 -4 for a new sewage lagoon VILLAGE and sewage outfall discharge line Mr Litz moved that the M D would have no TORR- objection to the Village of Torrington acquiring land i'n the M.D INGTON Carried & PURCHASF The Village of Torrington are proceeding with annexation of the Street surveyed NEW SEWAGE on Plan 8010154 , which street presently lies within the M D This annexation LAGOON is necessary in order for the Village to reclaim ownership of the street and a portion SITE of the right of way to their old sewage lagoon site After discussion Mr Litz moved that the M D voice no objection to this proposed annexation Carried [YOUNG iL MEETtNP OCTOBER 14th,, 1980 P6 C R P C have forwarded a letter concerning a proposed annexation to the Village of Acme, %n which the Village proposes to annex the balance ACME ANNEXATION of Section 19 - Rockyyi'ew appeal against the Prel, Regional Plan s REG PLAN Mrs Wilkinson reported on the Alta 75th Grant money and its distribution ALTA 75TH to various organizations to date,. Four organizations have applied for GRANT an extension of time to December 31st, 1980 to claim the funds allottd to them. The deadline for applying for the funds is October 31st 1980.. After discussion Mr, Campbell moved to acknoweldoe the report and ,A to grant the extension to December 31st, 1980 for the Three Hills Performing Arts Group, the Linden & District Recreation Board the Hesketh Community Association and the Church_i'll School Associ'ati.on Carried Mr, Jeffery reported he had reviewed the applications received for ASSESSOR'S the assessor'`s job, with Mr, Roy Kinsey of the Provi:ncia► Government POSITION Assessment Branch, and the council then reviewed the applications received After discussion Mr Brown moved that Mr Jeffery be authorized to negotiate with. Mr, Mel Harper of Drdsbury regarding acceptance of the position of assessor with the M,D,, at a reasonable salary taking into consi_derki;on the Municipal Affairs guidelines for assessors Carried Mr Jeffery noted that a level four assessor with the Department presently earns $32,000 -.00, ACME & DRUMHELLER Statements covering 1979 recreation income and expenses for the Village of RECREATION Acme and the City of Drumheller were reviewed and after discussion Mr. V STATEMENTS Campbell moved to accept the statements and to pay the 1979 grants to the FOR 1979 Village and the City, Carried Mr, Drown requested that the 8 mile stretch of road from Beisker to Acme ADD PT SR 806 0 miles in the M,D, of Rockyvi.'ew and 4 mi'1es in the M,D of Kneehill) be TO LIST OF added to the Secondary Road priority list PRIORITIES A list had been sent to Alta Transportati;Ion recently but this portion of road in the M D, was-not included Mr Brown left the meeting at this time and Mr Bauer- as Deputy Reeve took. charge of the meeting Mr Litz noted he could not attend the School Division meeting tomorrow and Mr Berdahl agreed to attend if he could CULLUM Mr Earl Cullum has applied for a 2.0 acre isolation of existing farmstead SUBDIVISION on NE 16- 31 -23 -4 Mr Cullum has an intensive operation on this parcel of land. Carried Alberta Transportation have reiuested permission to use a portion of ALTA the Watt stock pile (NE 36- 30 -22 -4) to stock pile about 7000 yards of material TRANSPORT for a period of time They feel the material would be gone prior to the fall of f 1982 Alta Transportation also advise that their crew will be working on Highway 27 shortly attempting to level out the washboard condition of the pavement ROCK HILL They also request that the M D make the Rock Hill a one way road down the hill ONE WAY until they can complete the road construction on Highway 27 across the river They wish to haul gravel from the pit down the hill and then out across the river and feel that it would be very dangerous if traffic was coming up the hill while the gravel trucks were hauling gravel down After discussion of this request and noting that the people who normally make use of the Rock Hill for access to their land have been contacted and have no objections, Mr Berdahl moved that the M D erect the necessary signs to make the Rock Hill a one -way road during this construction period, and further moved to accept and file the other correspondence a Ll COUNCIL MEETING OCTOBER 14th, 1980 received from the Department Carried P 7 It was noted that the power is still on at Keiver Lake Park and it was agreed that Alberta Power again be notified to have it shut off POWER AT KEIVER LAKE ALAN HAZEL Alan Hazel was involved in an accident on September 26th, 1980 with T -17 ACCIDENT the crew cab truck He parked between the chip spreader and the packer and when he left he backed into the packer ��,r Costs for repairs to the truck will be about $340 00 Mr Campbell moved this matter be referred to the Shop & Foremen Committee S d for a recommendation Carried Mr Jeffery reported briefly regarding the purchase of the Schmautz Gravel Pit PURCHASE and land Titles have been received in the name of the M D and the deal SCHMAUTZ has been completed The matter of leasing the farm land for 1981 was then LAND discussed, and it was agreed that this be discussed at a later meeting of Council Alberta Transportation have written advising that Alberta Environment and Alberta Energy & Natural Resources have refused to allow Transportation or the M D to remove gravel from the Red Deer River near Section 2- 34 -22 -4 After discussion of this matter, Mr Ferguson moved to accept and file as information Carried There was discussion about the Ross - Cunningham Project - cleaning the ditch to the west and improvement of drainage to the south - on the road south of SE 27- 33 -24 -4 and Mr Campbell moved that this project be undertaken when the main crew move from the Wimborne Job Carried Correspondence from Alberta Bridge Branch was reviewed RED DEER RIVER GRAVEL ROSS ROAD PROJECT S SE 27 -33- 24-4 BRIDGE BRANCH a) Letter re Bridge in NE 1- 31 -24 -4 - no structural damage done to the bridge by the cat crossing the bridge with picks on and minor damage to the deck b) Letter re Bridge in NE 12- 29 -22 -4 (Hesketh) - crew will repair the deck as soon as possible Mr Berdahl moved to accept and file as information Carried MIS ITEMS Mr Litz reported that the pavement south of Wimborne (On SR 805) has some bad dips in it, and also reported that the entire hamlet of Wimborne requires gravel Mr Bauer has several road projects in Division 4 which require attention and it was agreed that the Road Committee should meet with Mr Bauer to review these matters It was also agreed that the Road Committee should meet with Mr Litz to finalize the Wimborne Sewer Project TABLE BALANCE Mr Ferguson moved that the remaining items on the agenda be tabled until the AGENDA next meeting of Council Mr Litz moved that this meeting do now adjourn Time of Adjournment 5 45 P M Reeve Carried Carried - - - - - -- - -/f - -- -- - - - - -- Municip 1 A- inis rato i ADJOURN Date of next meeting - October 27th, 1980 - Organizational Meeting of Council to be held in Three Hills ,Municipal Office , commencing at 9.00 A M
