Kneehill #48 was held in the Municipal Office, Three Hills, on Monday July 14t 1980 commencing at 9.00 A M Those present were G A Berdahl Division 1 PRESENT C W Poole Division 2 T A Ferguson Division 5 R G Campbell Division 7 J C Jeffery Municipal Administrator Mrs Jean Wilkinson, Assistant Municipal Administrator ACTING CHAIRMAN Due to the absence of the Reeve and Deputy Reeve, Mr Jeffery called for nominations for an Acting Chairman for the meeting Mr Campbell moved that Councillor Poole be named Acting Chairman for this meeting Mr Jeffery called for further nominations a second and third times No further nominations were received and Mr Poole was declared appointed as Acting Chairman for the meeting and took charge of the meeting APPROVAL MINUTES Mr Berdahl moved approval of the minutes of the meeting of June 28th, subject to a correction on page two as follows. Re- Huxley Water System - costs for the study estimated at about $1000 00 is incorrect - this should read about $2500 00 Carried GRAVEL Mr Paquette and Mr Rogers entered the meeting and discussed with council CRUSHING where Linden Contractors should move to next for gravel crushing, and it was noted that the Vetter Pi perh ?ps should be opened up next Mr Doug Haze ton o Linden Contractors then entered the meeting Mr Hazelton advised Council Mr E McNair has asked him to stay at the McNair Pit and crush an additional quantity of gravel for him - up to 20,000 yards before moving on to do more crushing for the M D Mr Hazelton also asked if the M D would like him to crush more gravel for them while at the McNair Pit After discussion of this matter Mr Campbell moved that Mr Hazelton be authorized to crush an additional 20 000 yards at the McNair Pit, and no gravel be crushed at the Megli Pit this year, if Mr McNair is agreeable to selling the M D the additional pit run for crushing Carried It was agreed that Mr Paquette should contact Mr McNair as soon as possible and advise Mr Hazelton of the results of this meeting BANK RECONCILIATION The bank reconciliation was reviewed and after discussion Mr Ferguson moved approval of the statement as presented Carried The statement showed a net balance at the month end of $1 649 343 40 Mr Jeffery read the reports received from Alberta Municipal Inspection INSPECTORS' Branch, and after discussion of the reports and three items mentioned REPORT Mr Berdahl moved to accept and file the reports as information Carried It was noted that the report addressed to the Reeve and Council must be read at the next annual meeting of ratepayers if such a meeting is held H SCHMAUTZ i ANn Mr Jeffery reviewed the agreement prepared for the M D by Mr N Tainsh Solicitor in connection with assignment of H Schmautz's lease to Ron Toews over to the M D Arranging for a new agreement with Mr Toews and cancellation of his lease with Mr Schmautz is the method Mr Tainsh felt would be best suited to the situation This would have to be arranged with Mr Toews prior to the M D exercising its option to purchase the land from Mr Schmautz Mr Jeffery noted that Mr Toews will be in to see Council later today to discuss this matter & A/G WITH RON TOEW� EBA Engineering have forwarded an estimate of costs for testing the Schmautz COST FOR land for gravel at about $11,500 00 GRAVEL TESTING Mr Ferguson moved to accept and file this report as information & PREL REPORT Carried Mr Jeffery reported that a caveat has been filed against Mr Schmautz's titles to protect the M D 's interest He also reported that EBA Engineering Ltd have completed their preliminary report on the Schmautz land and they feel there is about 850,000 yards of gravel there The final test results will be completed shortly and a written report forwarded to the office There was lengthy discussion about the number of yards available and the price per acre payable on the option, and because of the reduced estimate �ardage this is now somewhat high It was agreed to contact Mr Schmautz oan8ydetermine if he would be willing to re- negotiate the price per acre for the land This matter would then be discussed again later today Mr Campbell moved to accept the report given by Mr Jeffery Carried Mr Rodger left the meeting at this time -c- COUNCIL MEETING JULY 14th, 1980 P 2 Mr Jeffery noted that Alton Parker has to date made no decision about the CAT WORK M D 's offer to provide him with 6 hours cat work on his proposed project FOR ALTON for filling in an old creek channel on his land, on condition that Mr Parker PARKER complete the project with his own resources After discussion Mr Poole moved Mr Ferguson discuss this matter with Mr Parker and report back to Council Carried (�ad Mr Rodger requested permission to screen gravel from the McNair Pit for SCREENING use on his paving projects Screened gravel would improve quality of the GRAVEL FOR pavement, but would slow down the program somewhat It would take about 2 days to screen 1500 yards After discussion Mr Campbell moved Mr Rodgers be PAVING given permission to screen the amount of gravel he requires to complete the 1980 paving program Carried REQUEST FOR Mr Paquette advised there is an oil available which has latex added to it PERMISSION As it would be more flexible it might be better than the oil presently being TRY NEW OIL used Cost is about 72� per gallon higher He suggested using some on a two mile stretch of road west of Acme as a test Additional cost would be about $1200 00 After discussion Mr Berdahl moved Mr Paquette be given permission to purchase the oil for use on the two mile stretch of road west of Acme Carried REPORT ON Mr Jeffery reported EBA Engineering recommend the following regarding the SR 583 Three Hills East Road 1 First two miles from 21 east might hold a surfacing for awhile, and then would need a further 3'' overlay 2 The 3rd, 4th and 5th miles east of #21 should be rebuilt before any surfacing is applied After discussion Mr Poole moved that the project to apply cold mix to the first 5 miles of SR 583 be cancelled for 1980, and normal light coat surfacing repairs be undertaken on those portions of the road which require same Carried TELEDYNE Teledyne Exploration have moved their camp out of the area and terminated EXPLORATION their lease of part of the Berreth stock pile site The site has been cleaned LEASE up satisfactorily Rent had been paid in advance for the month of June and FOR CAMP SITE July After discussion Mr Berdahl moved the M D refund Teleyne the $200 00 J damage deposit and $175 00 being half a month's rent for July Carried Further correspondence has been received from the government regarding the SUBDIVISION split of the NE 3- 34 -22 -4 when a portion of the quarter section was purchased NE 3-34-22 - by the government for addition to the Buffalo Jump Park After brief discussion Mr Ferguson moved to accept and file as information Carried ANDEX OIL Andex Oil have been given permission to put in an approach subject to M D ROAD APPROACH regulations to provide access to an oil well on 8 of 17- 29 -24 -4 Also Andex advise they are going to spread oil on the road west of 20- 29 -24 -4 for Allan Becker Mr Campbell moved to accept and file as information Carried The School Division have requested the M D to move its fuel tank to the SCH DIV south west corner of their shop yard to Albert can fill his grader without REQUEST TO going inside the fenced area The tank has been moved and appears to be MOVE FUEL satisfactory Mr Ferguson moved to accept and file TANK Carried Alberta Transportation telephoned the office today requesting permission to use REQUEST a portion of SR 575 from the Acme Cemetery west three miles during the paving TO USE of secondary roads in the M D The government stated they would put the road PARTS OF SR back into good condition upon completion of the projects Mr Campbell moved ROADS that Alberta Transportation be given permission to use this portion of SR 575 BY ALTA for the period required to complete the paving projects TRANSPORTATIN Carried It was agreed that Mr Paquette meet with a representative of Alberta Transportation today at 3 00 to review the present condition of the road Alberta Transportation have also requested permission to use a portion of SR 837 during the paving of Highway 27 (From #27 south two miles) Mr Ferguson moved Alberta Transportation be given permission to use this portion of SR 837 subject to restoration of the road upon completion of the project Carried bs COUNCIL MEETING JULY 14th 1980 P3 Alberta Transportation have forwarded the M D a cheque for $11,914 00 which is the 1980 Public Transportation Operating Assistance Grant ALTA PUBLIC This grant has been tentatively set aside for the Eltrohills Hospital TRANSPORTATION Group for purchase of a van for transportation of elderly and handicapped persons GRANT After discussion Mr Poole moved that Eltrohills Group be advised that once the group form a society, with appropriate regulations and by -laws for the operation of the society, and it can be shown to the satisfaction of the M D , that the Society can purchase, operate and maintain the van service without any further grant or monetary assistance from the M D , and no further liability will accrue to the M D in future years, the M D will make the 1980 operating assistance grant of $11,914 00 available to the Society Carried Mr Harvey Schmautz telephoned the office at this time and stated to Mr SCHMAUTZ LAND Jeffery he would under no circumstances negotiate the price for his land, OPTION even if there was not as much gravel as first indicated After discussion Mr Berdahl moved that a decision on exercise of the option on the Schmautz land be tabled until the next meeting of Council Carried Mr Ron Toews and Mr Richard Leyden of Ron's Excavating and Trucking RON TOEWS entered the meeting at this time The terms of the drafted agreement AGREEMENT RE regarding removal of gravel by Ron's Excavating from the Schmautz land SCHMAUTZ was reviewed in detail with them and the number of yards they would be LAND allowed to remove from July 31st, 1980 to May 1st, 1981 also discussed as well as the need for a checker during crushing operations by Mr Toews' company Mr Toews indicated he has about 17 000 yards crushed at the Schmautz Pit now Mr Toews also indicated they would like some committment from the M D that they would be granted a renewal of the agreement after May 1st, 1981 He noted at the present time he has the right to remove as much gravel as he wishes from the Schmautz land until May lst, 1981 and he would not like to give up this right without some committment from the M D about future years He would like the right to remove up to 20,000 yards (at least) each year There was discussion about giving the company the right to remove up to 20,000 yards of gravel and 1000 yards of sand each year for a three year period after May 1st 1981 In as much as council has not made a decision about exercising the Schmautz option as yet, Mr Toews was requested to come back to the council meeting on July 28th, at 1 00 P M to finalize this matter, and he agreed to this request Mr Toews and Mr Leyden then left the meeting The meeting then adjourned for dinner between 12.00 Noon and 1 00 P M DINNER The Accounts were then reviewed and discussed and Mr Campbell moved that the . accounts as presented be paid with the exception of the accounts for ACCOUNTS Mountain View Disposal and Superior Disposal, which are to be held back until a satisfactory explanation is received regarding their poor service Carried Mr Jeffery reviewed backsloping agreements arranged as follows BACKSLOPING LAND & GRAVEL SW 15 and NW 10 in 31 -24 -4 - Frank Richardson, Three Hills AGREEMENTS NE 7- 31 -23 -4 - Marie Rosgen Three Hills SE 32 -32 -23-4 - Niemi Farms Ltd - Trochu SE 15 & NE 10 in 31 -24 -4 - Keith Leonard , Three Hills - NOT SIGNED BY MR LEONARD as he felt compensation insufficient for crop damage - should be $160 00 per acre not $120 00 as offered Mr Campbell moved that compensation for loss of crop for all 1980 road projects be increased from $120 00 an acre to $160 00 an acre Carried Mr Jeffery reviewed an agreement arranged with Bill Richardson for purchase of land on SW 15 and NW 10- 3124 -4 for road improvement Price payable for land on SW 15 is $528 00 an acre and on SW 10 is $584 00 per acre HE ALSO reviewed a gravel lease arranged with Dennis & Peter Poffenroth on NW 34- 31 -26 -4 and also one on E2'33- 31 -26 -4 After discussion of these agreements, Mr Berdahl moved to accept and approve of same CArried CHANGE Mr Jeffery reported that at a committee meeting on June 24th it was recommended RE GRAVEL to change one of the trailer units on the gravel crew over to a body job,leave TRUCKS two tractor trailers hauling gravel, put the body job on with the paving crew and & HIRE hire 1 truck to haul gravel on a yard mile basis ONE TRUCK After discussion of this recommendation Mr Berdahl moved approval Carried bp. COUNCIL MEETING JULY 14th, 1980 P 4 T C PAQUETTE Mr Jeffery reported that Mr Paquette has completed a request to the RETIREMENT Pension Board for a pension commencing in March of 1981, so his retirement date will be February 28th, 1981 Mr Jeffery also reported that Alex Williams has now retired and there was discussion about a possible retirement gift for him It was agreed this ' be discussed at the next meeting of Council Richard Vickery was off work for 3days on compensation due to an accident Under the contract he would receive pay for a 9 hour day, but at this time the crew is working a 10 hour day, so he is losing 3 hours pay After discussion of the request for payment of this extra threehourspay, Mr Campbell moved Mr Vickery be paid oi�� tht basis of a 10 hour day MOTION DEFEATED Two for and two against As this was a tie vote the motion was defeated CHANGE YIELD The County of Red Deer have requested the M D to put a yield sign on the south SIGN side of the road north of the NE 33- 34 -23 -4 so the traffic coming from the west N /NE 33-34 - going east will have to yield rather than the traffic,on the north -south road, 23 going south having to yield After discussion Mr Campbell moved that this be approved and our sign man be authorized to arrange the sign changes with the County of Red Deer sign man Carried Mr Jeffery and Mr Campbell had contacted Miss Mary Green and obtained her RED DEER RIVER consent to use of a portion of her land for a haul road, in connection with GRAVEL attempting to remove gravel from the Red Deer River These signed forms have now been returned to Alberta Transportation for their further consideration Mr Berdahl moved to accept the report Carried Mr Poole reported there is a meeting scheduled for Wednesday, July 16th MEETING WITH commencing at 9 00 A M , in Calgary to discuss with Alberta Provincial Planning ALTA Board, the Commission and others the problems with planning that are arising PLANNING BD Mr Poole noted he would be attending the meeting and it was agreed that RE PLANNING Mr Berdahl, Mr Ferguson and Mr Campbell attend if at all possible PROBLEMS C' Mr Ferguson reported that Pat Madden Solicitor from Drumheller is withdrawing THREE HILLS �. his services as solicitor for the Three Hills Seed Cleaning Plant, and the Board SEED of Directors are now attempting to obtain a new solicitor to act for the PLANT Plant in connection with the law suit filed against the Plant r ry Mr Jeffery reported that Crown Trust Company has forwarded a lease from the ANDERSON ;. Allan Fuller Estate to the M D for the South half of 18- 30 -22 -4, at a yearly BRIDGE rental of $1800 00, with the right to renew the lease in 1981 if so required PROJECT in order to complete the road project The rental for this year is due in full at this time and will be paid They also ask that the M D pay the estate 75% of the estimated price for the land to be purchased with the balance payable to the estate upon completion of the actual road survey After discussion Mr Poole moved approval of the report and authorization for execution of the lease on behalf of the M D Carried Mr Jeffery reported that two parties in Grantville have chickens on their ANIMALS IN property and one of the parties had a lamb and a goat as well The persons GRANTVILLE were contacted and requested to have the livestock and chickens removed from the hamlet Mr John Ibottson however has requested permission to keep the goat as his children are allergic to cow'smilk and require the goat's milk After discussion of this request Mr Campbell moved that Mr Ibbottson be given permission to retain the goat on a temporary basis until his children ° no longer require the goat's milk, unless further complaints are received Carried CHANGE TO Alberta Health Care have contacted the office and advised that under our contract EMPLOYEE with them all employees must be registered on our group plan within 90 days of CONTRACT commencing employment At the present time the employee contract reads they RE ALTA must registered on the plan after six months of employment After discussion` HEALTH CARE Mr Ferguson moved that the employee contract be amended to read that all employees registered with the M D Alberta Health Care group plan effective their first day of employment and pay 100% of the cost of monthly premiums, and after completion of six months employment the premium costs will be shared on a 50 -50 basis Carried LOSS WATER Mr Jeffery reported that due to a damaged clean out line on a service installation IN to a vacant lot in Ruarkville, the M D had lost about 1,200,000 gallons of RUARKVILLE water The clean out line was draining into the sewer and because of the damage to the line the valve was pushed partly open, and water was running directly into the sewer It was only located when the party building on the lot dug down to connect the water pipes to the new house r� AMR COUNCIL MEETING JULY 14th, 1980 P5 After discussion of this matter, Mr Ferguson moved that the costs for the lost water be charged to the Ruarkville water system and also the Town of Three Hills be requested to consider a partial reduction in the account Carried BY -LAW 910 Brownlee Fryett, solicitors, have prepared a by -law to enforce a speed SPEED LIMIT r+. limit on Secondary and Municipal Roads in the M D during construction ON ROADS or work on the roads by M D crews UNDER Under the by -law the Municipal Administrator is authorized to fix a maximum CONSTRUCTION speed limit in respect to that portion of the road under repair After discussion, Mr Campbell moved first reading to by -law number 910 this being a by -law to authorize the Municipal Administrator to fix a maximum speed limit on secondary and municipal roads in the M D , while under repair Carried Mr Ferguson moved second reading to by -law number 910 Carried Mr Berdahl moved third reading be given to by -law number 910 as this time Carried Unanimously Mr Poole moved third reading to by -law number 910 Carried Mr Brian Parry of Three Hills has requested Council to consider CANCELLATION ROAD cancellation of an old road diversion in the NE 19- 31 -24 -4 and return DIVERSION the land to his quarter section It involves about 2 06 acres After discussion and noting that the road diversion is no longer used for road access,Mr Ferguson moved that the road diversion as shown on Plan 6694 B M in NE 19- 31 -24 -4 be cancelled and the 2 06 acres returned to the quarter section from which it was taken Carried Mr Jeffery reviewed the results of reports complied by Mr Sp d at e. REPORT ON dump box site, over the past months To date the M D residentts /,a total of 344 USE OF DUMP times or 58 6% and town residents 240 times or 41 4% After discussion BOXES Mr Berdahl moved to accept the report as information Carried Keith Baxter of Mobil Oil has asked if the M D will gravel the road west GRAVEL FOR ROAD of 29- 32 -22 -4 The road was constructed by Mobil Oil but apparently has not W 29 -32 -22 been gravelled After discussion and noting it would require about 300 yards Mr Campbell moved that the road be gravelled when the gravel crew is in the area CArried Mr Jeffery left the meeting at this time Mr Soder entered the meeting NEW MOWER & Mr. Soder noted that Nick Mamona suggested if he had a mower at Keiver Lake WEED EATER he would be able to do some mowing around However the Yazoo now used for the Parks is getting older and Mr Soder suggested that a new yazoo be purchased FOR PARKS for the parks'work together with a new weed eater, and the old Yazoo and weed &CEMBTARY eater could then be used at Keiver Lake The possibility of purchasing the new equipment from the Public Reserve Funds was also discussed as these funds can be used for capital park improvements Mr Soder indicated it would probably cost around $4000 00 to replace the tractor and the weed eater The possibility of purchasing a straight riding mower,rather than a tractor was also discussed Mr Ferguson moved that Mr Soder be given authority to purchase a replacement mower and a weed eater at a price not to exceed $4500 00, and the funds be taken from the Public Reserve Trust Account for Capital Park Improvements Carried Mr Soder reviewed other items as follows problem getting wood for the parks purchase of a new chain saw, cost around $195 00, well at Keiver Lake is contaminated, complaint received about Swalwell Cemetery, A S B Plots, increase in pay for T Greke and problem with mowing at the Three Hills Airport Mr Soder then left the meeting TRANSFER FUNDS Mrs Wilkinson requested a motion from Council to authorize the transfer of FROM PUBLIC the sum of $5873 00 from the Public Reserve Trust Account to cover the cost RESERVE ACCOUNT of power installation at Keiver Lake Park Mr Berdahl moved that the transfer POWER AT of $5873 00 from the Public Reserve Trust Account to the M D general account be KEIVER LAKE approved Carried COUNCIL MEETING JULY 14th 1980 P6 Les Crawford of Three Hills, and Debra Bishop from C R P C entered the meeting at this time CRAWFORD Mr Crawford and Ms Bishop explained the problems with the recommendation SUBDIVISION from Council regarding Mr Crawford's subdivision proposal for a 40 acre parcel out of the NW 24- 31 -23 -4 Council had recommended approval subject to NW 24 -31 -23 Mr Crawford consolidating the existing 40 acre parcel back into title with the balance of the quarter section, so only two parcels would exist in the quarter, one 40 acre parcel and one 120 acre parcel However Mr Crawford stated this consolidation would not fit in with his plans for his farming operation or his estate planning and he felt he must keep the existing 40 acres as a separate t i t l e and requ i i AA , tCTaMrAO1 @rF[etR� 991 l �i� W W R I 2 f Aeson for h i s intensive poultry operation / After lengthy discussion and noting that under the existing development control by -law this can be allowed, Mr Ferguson moved that Council's recommendation for this subdivision be revised to delete the need ' for consolidation of the existing 40 acre parcel back into title with the balance of the quarter section, Carried SUBDIVISIONS Mr R Hatch of Calgary had submitted an application for subdivision of his 1 9 SW 19 -
