PRESENT G A Berdahl Division 1 C W Poole Division 2 V11 A W Bauer Division 4 (Deputy Reeve) T A FErguson Division 5 L G Litz Division 6 R Campbell Division 7 J C Jeffery Municipal Administrator A Mrs Jean Wilkinson Assistant Municipal Administrator was present and recorded the minutes LINDEN CONTRACTORS Mr Doug Hazelton of Linden Contractors entered the meeting to discuss with council the gravel crushing done to date He will start crushing for the M D in about 2 weeks at the McNair Pit There was discussion about the Andrews Lowen Pit, and Mr Hazelton noted he had looked at the pit again and felt council should consider using loaders to push the gravel over the hill rather than cats to avoid getting so much dirt in the gravel This work should be started soon to get a stock pile of gravel down before the crusher moves there He has a loader the M D could hire to do this He also wishes the M D to dig at least 5 test holes at the pit to see what is the best area to work in It was agreed this be arranged between Mr Jeffery and Mr Hazelton and Bud Haskell The rate for hiring a loader was discussed and Mr Hazelton noted it would require a loader and some work with a cat and dozer However no decision was made at this time ✓� Mr Hazelton asked if Council wish to have more gravel crushed at the McNair pit The original deal was for 20,000, and 5000 yards has been crushed there, and this has all been used up Mr McNair has indicated the M D can arrange to borrow gravel from his stock pile if it is required before the crusher moves there Mr Campbell moved that Linden Contractors be authorized to crush an additional 5000 yards at the McNair Pit, to make a total of 25,000 yards at this pit Carried Mr Hazelton then left the meeting APPROVAL OF MINUTES Mr Ferguson moved approval of the minutes of the council meeting of May 20th, 1980 ,n Carried TROCHU 4 H CLUB Mr Jeffery reported that the Trochu 4 -H Club obtained 4 yards of gravel from the Heer stock pile and after discussion Mr Berdahl moved that the M D donate the 4 yards of GRAVEL -4 gravel to the 4 -H Club DONATION Carried Mr Jeffery reported there has been a problem arise concerning a recent burial CRANSTON in the Huxley Cemetery Mrs Cranston had selected a plot for burial of BURIEL AT her late husband, but after the burial the family felt the plot was not appropriate HUXLEY and wished to have the body disinterred and buried in another plot This requires CEMETERY considerable paper work and Mrs Cranston had agreed she would be responsible for f arrangements to have this done After brief discussion of this matter Mr Ferguson moved to accept the report Carried INQUIRY RE- MARIGOLD Mr Berdahl reported he had been approached by a Carbon area resident inquiring LIBRARY why the M D did not participate in the Marigold Library System and the party SYSTEM ✓\ was advised the main reason was due to the considerable costs involved DEV APPEAL BOARD Mr Campbell moved that the Council meeting do now adjourn and sit as a Development Appeal Board - Time 9:30 A M Carried M Poole moved that the Council meeting do now continue, the Development Appeal r hearinq having been completed Carried PUMPING WATER FROM Mr Jeffery reported that tIn Hutterian Brethren of Rosebud are concerned about M D an oil company,Grove Arctic Island which is pumping water from a ditch on ROAD M D road allowance in the south east portion of the M D Apparently the ALLOWANCE U water in the ditch drains off land owned by the Hutterites and they are concerned -00• that by pumping so much water from the ditch it will drain the slough on their land/ ROSEBUD which they use for watering cattle etc mmnn rmz+[+ The Hutterites wished to know if the M D had given the company permission to take H water from the ditch and they were advised that as far as it was known this permission had not been given by the office After discussion of this situation Mr Jeffery was directed to contact Alberta Water Resources to see if there is any policy or regulations concerning this type of a situation Mr Berdahl moved to accept the report given by Mr Jeffery A41;tI17 Carried P 2 COUNCIL MEETING JUNE 9th 1980 Alex Cunningham entered the meeting at this time PROPOSED WATER He reported that he had discussions recently with John Johnson of Huxley about the SYSTEM possibility of installing a water system in the hamlet of Huxley A rough estimate HUXLEY of costs had been determined by Matt Bergman and himself at about $132,000 00 There 2s a meeting scheduled for tonight to discuss the project and Mr Bergman has indicated he could attend this meeting if Council wished him to do so The test on the water well there indicated it would be sufficient to handle V� a water system, but the proposed system would not given the hamlet fire protection without a tower or a big pump to provfde the necessary water pressure Mr Bergman had indicated there would be grants available and a possible front foot charge would be about $1 00 After discussion of this matter, Mr Litz moved that Mr Cunningham Mr V\ Campbell and Mr Matt Bergman of Engineering Canada be authorized to attend the meeting with the residents of the hamlet Carried It was noted that Alberta Municipal Finance Corporation should be advised of this possible project for the year 1981 -82 REDUCTIOb OF RUARKVILLi WATER & SEWER Mr Jeffery reported that Alberta Environment has forwarded the grants for the DEBENTURE Ruarkville water and sewer projects for a total grant of $127 443 77, and by paying this amount on the water and sewer debenture the front footage ETC charge could be reduced to $1 06 He further reported that Local Authorities Board will not give approval to any of the by -laws forwarded to them for reduction of frontage tax u2til possibly September but the budget has been set using the reduced frontage tax levies for Huxley, Swalwell and Ruarkville Mr Jeffery also reported he had sent a cheque to Alberta Municipal Finance Corporation for $127,443 77 to be applied against the Ruarkville water and sewer debenture on June 16th, 1980 Mr Campbell moved to accept and approve the report given by Mr Jeffery WIMBORNE SEWER Carried Mr Cunningham reported all the material for the Wimborne sewer project has been PROJECT ordered and he has rented a back hoe from R Angus and work on the project should start soon There was discussion about having the sewage lagoon dug and Mr Campbell moved that Mr Cunningham be authorized to hire R Cranstgate onstruction of Trochu, if possible to construct the sewage lagoon at a hourly;hot to exceed government rates Carri ed It was noted this project will require use of a scraper, a cat and a packer Mr Litz noted there is a problem at the lagoon site with a pipeline and a row of trees and after discussion it was agreed that the trees will have to be V, moved in order to complete the project Mr Cunningham left the meeting at this time BANK STATEMENT Mr Jeffery reviewed the bank reconciliation for the month ending May 31st, and MAY 1980 after discussion Mr Berdahl moved approval of the statement as presented Carried 1980 BUDGET & Mr Jeffery then reviewed with Council the proposed 1980 budget figures as MILL RATE complied by the Finance Committee and also reviewed possible mill rates After lengthy discussion Mr Poole moved first reading to by -law 906, this being a by -law to set the 1980 mill rates for taxation purposes. Carried Mr Litz moved second reading to by -law 906 Carried Mr Berdahl moved that third reading be given to this by -law at this time Carried Unanimously Mr Campbell moved third reading to by -law 906 Carried Copy of the by -law and estimate levy form attached A COUNCIL MEETING JUNE 9th 1980 P 3 DATE FOR A letter of appeal against the decision of the Dev Officer regarding Permit APPEAL HEARING No 397 -80 has been received and Mr Poole moved that a development appeal RE PERMIT board hearing be held on June 23rd, 1980, in the Municipal Office, Three Hills NO 397 -80 commencing at 9.30 A M to hear this appeal, and notice of the appeal be advertised in the paper for one issue and circulated within -� mile Carried ��� Vl REG RESOURCES Mr Jeffery reviewed the minutes from Reg REsources Project meetinc of May 20th MINUTES and Mr Ferguson moved to accept and file as information `1 Carried The Drumheller Stampede and Ag Society have written requesting representation DRUMHELLER from the M D Council at a meeting to be held in the Prcvincial Building in AG SOCIETY DRumheller on June 12th, 1980, at 7 30 P M to discuss construction of a nn MEETING RE- building at the grounds for various community functions V NEW BUILDING Mr Bauer moved that Mr Ferguson attend this meeting as an M D representative PROPOSED Carried j- T-0 P 1_r;:_,4 Ms Debra Bishop from C R P C entered the meeting at this time SUBDIVISION Subdivision application from Lawrence Vasslin of Three Hills for a 10 79 acre APPLICATION. parcel on NE 34- 30 -23 -4 was then reviewed and discussed Mr Ferguson moved that Council recommend approval for this subdivision subject to relaxation of the M D minimum parcel parcel and relaxation of the Preliminary Regional Plan, and other normal conditions for subdivision Carried Mr Leslie Crawford of Three Hills has requested a subdivision of 40 acres on NW 24- 31 -23 -4 but there is already a 40 acre subdivision on this quarter After lengthy discussion of the reasons for this subdivision, Mr Ferguson moved that Council recommend approval for this subdivision only on condition that the applicant consolidate his existing 40 acre subdivision back into title with the balance of the quarter section, so there will be only a 120 acre parcel and a 40 acre parcel on this quarter section, and further that the applicant comply with other normal conditions for subdivision Carried REPLY FROM GOVT Mr, Jeffery read a letter from Mr Mickey Clark, M L A Rr Clark RE NW 3-34-22 - forwarded a copu of a letter he had received from The Honourable Peter Trunchu SUBDIVISION regardina the subdivision in NW 3- 34 -22 -4 The 120 acre parcel had been purchased from Mr Maanusson for future park use and the 40 acre parcel created was retained bu Mr Maanusson However the government indicate that no roar' construction or other financial burden will be required from the municipalitu Mr Ferguson moved to accept and file as information PROV PLANNING Carried INTER -MUN The Alberta Planning Board have written regarding the possibility of inter - municipal DISPUTES and or municipal regional planning disputes in the old Act these could be referred to the Provincial Planning Board for resolution , but in the new act this provision has been deleted However the Board would be willing to act in an advisory capacity in any such dispute Mr Poole moved to accept and file the letter as information Carried kA CIRCULAR AAMD & C again remind all municipalities of the need to pay their account promptly AAMD & C After brief discussion Mr Campbell moved to accept and file as information Carried RATE INCREASES Alberta Power Ltd , and Canadian Western Natural Gas Co Ltd , are going to - ALTA POWER the Public Utilities Board for a rate increase again Mr Poole moved to accept & C W N G and file as information Carried CALGARY POWER Calgary Power Ltd have forwarded plans for a line extension to serve SW 5- 30 -25 -4 LINE and after reviewed of same Mr Litz moved council would have no objection to ,A EXTENSION this proposed line extension SW 5 -30 -25 Carried SURVEY REQUESTEL The Swalwell Community Club have requested that Council undertake a survey SWALWELL COMM of the community club property as the club wish to build an addition on to CLUB the curling rink and they will need to know where the property lines are AFter discussion of this request Mr Ferguosn moved that the Swalwell Community Club be advised determining their property boundaries would be the responsibility of the club Carried RECLAMATION Alberta Environment has adopted minimum reclamation standards to ensure proper STANDARDS conservation and reclamation of land After brief discussion Mr Berdahl moved to accept and file as information Carried DISASTER Alberta Disaster Services have issued a statement of government. policy regarding ASSISTANCE disaster assistance which would be payable in the event of certain disasters POLICY ,�O/V Q COUA -CIL MEETING JUNE 9th, 1980 ME and also have issued a cheque to the M D for 1980 assistance towards operation of the disaster services agency After brief discussion Mr Berdahl moved to accept and file as infornation Carried The meeting then adjourned for dinner between 12.00 Noon and 1 00 P M DINNER Building permits issued were then reviewed- BUILDING PERMITS Archie McDiarmid - Wimborne Sewer Project WIMBORNE SEWER Carried Councillor Litz left the room BY -LAW 885 Mr Jeffery reported that Alberta Local Authorities Board have approved the debenture borrowing for the Wimborne Sewer Project, and council should now give second and third readings to by -law 885 as amended, the amendments to the by -law having been outlined by the Local Authorities Board (to cover increased grants, lessor amount COUNCIL MEETING JUNE 9th, 1980 P 5 of debenture borrowing required etc) After discussion Mr Campbell moved second reading to by -law 885 Carried Mr Bauer moved third reading to by -law 885 Carried Mr Poole moved approval of the accounts as presented 0 Carried OFF] Mr Jeffery reported that the A S B have sprayed the lawn in frc -nt of the M D office and will be laying sod there in the near future This was necessary as the lawn was not growing well and was infested with crouch grass AAMD & C advise Frontier Steel Industries Ltd will supply culverts to CU] association members at a lower price than that of other culvert suppliers SUPPLII Twister Pipe Ltd have advised they will continue to supply culverts in PRIG both metric and imperial sizes and have sent out a new price list After discussion Mr Ferguson moved to accept and file as information Carried Mr Litz returned to the meeting Mr Donald F Gordon of Swalwell has requested Council to supply a load of gravel for the front of his property as the gravel which was there was lost during construction of the sewer for the hamlet After lengthy discussion Mr Ferguson moved that Mr Poole inspect the site and report back to the next meeting of Council D F GORDON SWALWELL REQUEST FOR GRAVEL ��h1e Carried DUST Mrs Wilkinson requested council to review its existing policy for spreading CONTROL oil on M D roads The existing policy requires only that the N.D, motor grader POLICY operator blade the gravel to the side of the road, the oil be spread and then the gravel be spread back over the fresh oil if a person wishes to spread any waste substance (such as waxy oily material) then several conditions apply including signs being posted It was felt that these conditions should be applicable to either situation c Mr Poole moved that the Policy for dust control be amended to read as follows. An M D ratepayer may make arrangements, at his own expense,to have road oil spread on an M D road adjacent to his building site subject to compliance with the following conditions. 1 The M D Office must be notified of the proposal at least two daw in advar•ce in order to ensure that an M D motor grader will be available 2 The gravel must be bladed to the side of the road, and after the oil is spread the gravel must be bladed back over the fresh oil 3 The ratepayer must supply and erect signs on the road to indicate the presence of fresh oil AND FURTHER A ratepayer may make arrangements to have a waste substance(such as a waxy oily material which maybe obtained from oil companies) spread on the road subject to the following conditions- 1 The ad3oining land owners must be agreeable 2 Arrangements to have the M D motor grader available must be made with the M D Office at least two days in advance 3 Gravel is to be ridged to the center of the road 4 Waste substance to be spread on the road with a hose 5 Grader to work the gravel back over the road as soon as the waste substance has been spread 6 Road must be properly signed while the work is in progress, with signs to be supplied and put up by the ratepayer concerned Carried ROAI' COMMITTEE Mr Jeffery reviewed recommendations from the Road Committee as follows: REPORT 1 Carl Marr Road Pro3ect - LSD 5 of SW 24- 30 -26 -4 - Construction of a road to this location would require corsiderable dirt work and could not be done C MARR with a motor grader It would require a scraper culverts would be required, ROAD and there is some brush work which would have to be done as well 24 -30 -26 Costs are estimated at between $8000 00 and $10,000 00 The small crew could not do this project in 1980 due to other committments After discussion of this matter, Mr Ferguson moved Mr Marr be advised the M D could not undertake this project in 1980, but he may if he wishes hire a contractor to build a road in to this property to M D standards, at his own expense or he may request the M D to construct the road in their 1981 road program, and if this is done Mr Marr would be responsible for the total costs incurred by the M D for construction of the road Carried ��9 COUNCIL MEETING JUNE 9th, 1980 P 6 Temporary repairs to the raod east of the John Gordon residence - SE 5- 30 -23 -4 v1 are to be made and gravel placed in the boggy area The committee looked around the area mentioned in the letter from Alberta Environment regarding the Wittstock Drainage Project, SW 1- 30 -26 -4, but could not see that any drainage problem existed Mr Poole moved to accept the report from the Ro&d Committee Carried AGREEMENT HUTTERITES A backsloping- borrow pit agreement has been arranged with tke Hutterian ^ HUXLEY Brethren of Huxley for Sections 17 aid 18 in 34 -22 -4 and terms for this 17 & 18 in 34 -22 -4 were reviewed Mr Campbell noted that the Hutterites would like to have the road BACKSLOPING West of 20- 34 -22 -4 backsloped this year, but it would require removal of ON ROAD West a fence The road was worked on about two years ago, bvt no backsloping of 20 -34 -22 was done at that time After discussion of this request Mr Berdahl moved that the M D undertake the require backsloping on this road, only on condition the Hutterites accept the sum of $350 00 for removal of their fence along this road, rather than the normal sum of $700 00 per mile Carried COMPASSIONATE Mr Jeffery reported that Wilf Schmidt, a new employee with the M D had LEAVE WILF taken 3 days compassionate leave in the month of May due to the death of SCHMIDT his father in law Mr Schmidt had worked for the M D for a short time in 1979 was terminated and then re -hired on the main crep this spring He started late in April Mrs Wilkinson had not paid Mr Schmidt for the three days, but only for one day.and requested Council make a decision as to whether v/1 he should be paid for the full three days The contract states an employee may be paid for three days compassionate leave in any year if in the discretion of Council or the Public Works Superintendent the leave is reasonable After discussion of this matter Mr Campbell moved that Mr Schmidt receive pay for compassionate leave for one day only Carried RAY CANNINGS Mr and Mrs Ray Cannings of Carbon request permission fromCouncil to install DITCH a pipe line from the M D ditch on SR 836 adjacent to NE 31- 29 -22 -4 to a dugout WATER on their property, and also for permission to temporarily dam the ditch to divert DIVERSION the spring run off into the pipe line After discussion of this request Mr Ferguson moved that Mr and Mrs Cannings be authorized to install a pipe NE 31- 29 -22 -4 line from the ditch on SR 836 adjacent to NE 31- 29 -22 -4 to a dug out on their property and to divert spring run off from the ditch into the pipe line subject to the following conditions: 1 Landowners to be responsible for installation of the pipeline at their own expense 2 No liability will accrue to the M D slvuld any damage be caused to the pipeline by any person, vehicle or machinery 3 The landowners will save harmless the M D from any claims which may arise as a result of the pipe line being installed on M D prcperty 4 The landowners will remove the pipe line from M D property at their own expense N if required by the M D for any reason 5 The landowner will be responsible for moving the pipe line back in the event that SR 836 is widened by the M D at any time in the future 6 The landowners may temporarily dam the ditch to divert water into the pipe line only during the spring run off season each year and the landowners agree they will remove the temporary dam when the run off has ceased or if removal of the temporary dam is required by the M D for any reason Carried FORCED ROAD The status of the forced road between Sections 3 & 10 in 29 -22 -4 was again reviewed 3 & 10 in and it was noted that a solicitor had indicated there may be a possibility of 29 -22 -4 obtaining title to this piece of land for road access, having regard to the circumstances of the case After discussion of this matter, Mr Ferguson moved that Mr Poole ( 'u Mr Campbell and Mr Jeffery and file the report Carried COUNCIL MEETING JUNE 9th, 1980 P 7 LARIAT OIL Lariat Oil & Gas Company request council to spread gravel on the road REQUEST FOR west of 11- 31 -23 -4 The road is only a trail and to up -grade the road to GRAVEL a condition where gravel could be spread would be very expensive due to the West of 11 coulee through the area The work could not be done with a motor grader 31 -23 -4 After discussion Mr Ferguson moved that the oil company be advised they may build the road to M D standards (somewhat over .12 mile of road)if they wish and the M D will supply the necessary culverts and gravel for the road Carried Prairie Bible Institute request permission from the M D to hook up their new grade school building to the Grantville sewer lines After brief discussion Mr Ferguson moved this request be approved and the necessary agreement be drawn up Carried Prairie Bible Institute also request permission to use the road west of the Don Lammle property in Grantville to gain access to the new grade school under construction The road is light coat surfaced, but they request permission to bring in 100% loads rather than only 90% After discussion, Mr Campbell moved that Prairie Bible Institute be given permission to use this stretch of road and haul 100% loads on it during the construction of the grade school only Carried Alberta Transportation advise the government
