PRESENT G A Berdahl Division 1 C W Poole Division 2 R W Brown Division 3 (Reeve) A W Bauer Division 4 T A Ferguson Division 5 R G Campbell Division 7 J C Jeffery Municipal Administrator Mrs Jean Wilkinson, Assistant Municipal Administrator was present and recorded the minutes APPROVAL OF Mr Bauer moved approval of the minutes of May 12th council meeting as circulated Carried There was brief discussion about the 1980 road program as established at the May 20th meeting GROSS & TARE VEHCILE Mr Jeffery also reported that the M D is exempt from the requirement of having WEIGHT the gross and tare vehicles weights showing on its truck and the order for the f DECALS decals has been cancelled Mr Berdahl moved that approval of the minutes of the May 20th meeting be tabled until later today CArried DRAINAGE ON There was discussion about a bad drainage spot on the John Gordon Road south ROAD SOUTH of Sections 4 and 5 in 30 -23 -4 and it was agreed that the road committee should of 4 & 5 in have a look at this location 1^ 30 -23 -4 Mr Poole moved that Reeve R W Brown be given permission to miss as many REEVE BROWN council meetings as he deems necessary in the months of June and July 1980 .n LEAVE OF as he is still sitting on the Local Authorities Board regarding the Edmonton ABSENCE annexation proposal Carried % OF HOUSES There was brief discussion about the number of houses Mr Spilchen will be WHICH WILL required to inspect to determine if a residence will be exempt from assessment REQUIRE and taxation under the new regulations It was generally agreed that Mr Spilchen INSPECTION will have to make this decision himself, but it appears that driving by the f majority of residences in the M D will give him the information he will require Mr Ferguson moved to accept the report as information Carried LETTER FROM Alberta Culture has sent a letter regarding a study being conducted on ALTA Financing of the Arts and Financing of Historic REsources in Alberta n CULTURE After reviewing the letter and questionnaire, Mr Campbell moved to accept and fi 1 e Carried PEG Mr Brown reported on the Regional Resouces Project meeting held at the M D RESOURCES Office on May 20th, and after brief discussion Mr Poole moved to accept the report MEETING as information Mr Brown noted the next meeting of the Reg REsources is Carried scheduled for June 17th at Hussar EAST SUMMER The Reeve of the County of Wheatland has issued a challenged to all other reeves GAMES in the area to match his skill in cribbage at the East Central Alberta Summer & CHALLENGE Games scheduled for June 27th, 28 and 29 in Strathmore After discussion and REEVE OF noting Reeve Brown will not be available, Mr Bauer moved that Mr Ferguson WHEATLAND represent the M D in this contest Carried Mr Jeffery reviewed the minutes from the Three Hills School Division meeting THREE of May 14th, 1980, and after brief discussion Mr Bauer moved to accept and file s HILLS SCH Carried DIV MINUTES Circulars from AAMD & C regarding Liability for gun ranges and a councillors AAMD & C pension plan were reviewed and Mr Poole moved to accept and file Carried Mr Cunningham has indicated the costs for lowering the sewer line in Grantville GRANTVILLE from the intersection of 3rd Street North and llth Avenue north two blocks SEWER LINE Al' 14 / ---? COUNCIL MEETING MAY 26th 1980 P 2 in order to service a new lot being created by Marc Reed - Lot 1 Block 1 GRANTVILLE Plan 7611146 will be about $10,020 00 This cost would involve lowering LOWERING SEWER about 660 feet of line and purchase of one 15' manhole The line LINE from the intersection of 4th Street N and llth Avenue to the existing residence on Lot 1 Block 1 Plan 7611146 was originally installed and paid for by the former owner of the property and it was not installed deep enough to prevent the line from freezing There is a rather sh4rp rise in the land level and in order to get the line deep enoughp ooplser� ice the existing house and the new lot to be created the line will have to be lowered for two blocks The existing lot and new lot being created cannot be charged frontage, but the new lot could be charged a hook up fee to partially off set the costs involved After lengthy discussion and noting that by lowering the line now, new lots which may some day be created to the east of the new lot being created by Mr Reed could be serviced from this line, Mr Berdahl moved that the M D undertake lowering the line and install the required man hole at the north end of llth avenue, as outlined by Mr Cunningham, and Mr Reed be charged a hook up charge, the amount of which to be deternuned when the line lowering has been completed Carried It was agreed that recovery of the balance of costs involved in lowering the line will be considered at a later date if additional lots are created to the �^ east of Mr Reed's property BUILDING PERMITS Building permits issued were reviewed as follows: Leonard Philipsen SE 20- 29 -26 -4 Storage building for vehicles & farm machinery Ronald Reimer Lot 1 Block 4 Grantville - Single Family residence and attached garage Louis J Sich - NE 24- 32 -22 -4 - Storage building and work shop Ron Gorr - SE 35- 32 -25 -4 - Quonset - storage farm machinery Ken Penner - Lot 3 Block 4 Ruarkville - single family residence 'A I P Goertz - SE 20-30-25-4 - Single Family residence & garage Tony Seiler - Pt NE 22- 29 -26 -4 - addition to existing residence and Mr Bauer moved approval of the permits as issued Carried DATE FOR DEV AFPE,P L HEARING Mr Cunninghan entered the meeting at this time and asked Council to set a date for a development appeal board hearing Mr Richard Grabinsky has filed an appeal against the decision of the Development Officer in connection with Development Permit Application # 401 -80 in the Municipal Mr Berdahl moved that the Development Appeal Board hold a hearing /on June 9th, 1980, commencing at 9:30 A M , that the adjacent landowners within a one half mile radius be notified of the date time and place of the hearing ane notice of the appeal hearing be advertised in the local paper for one issue Carried DATE FOR PROV PLANNING A M . BD APPEAL Office, 0 The Provincial Planning Board has set Wednesday, June 11th, 1980 at 10.45 as the date for hearing the M D appeal against the decision of C R P C regarding subdivision on NW 19- 30 -25 -4 Mr Campbell moved that Mr Bauer and Mr Jeffery attend the hearing on behalf of the M D AGA d Carried AMENDMENTS TO Applications to amend the Preliminary Regional Plan have been received from PREL REG the City of Calgary and the Town of Canmore After brief review Mr Poole PLAN moved that the M D voice no objection to the proposed amendments Carried SNOW FENCE FOR Alberta Environment are setting up a program for clean up of pesticide PESTICIDE containers this summer and will be establishing a site or sites for farmers CONTAINER SITES to bring the containers to, for later disposal by the government The program will be co- ordinated by Alberta Environment with assistance from the Ag Service Boards They request permission to borrow sufficient snow fence from the M D to set up fencing around the proposed site or sites After brief discussion Mr Campbell moved that the M D lend Alberta Environment sufficient snow fencing for the site or sites they proposed to establish in the M D Carried DUMP BOXES There was brief discussion regarding the need for establishment of dump box AT HUXLEY & sites in Huxley and Wimborne areas, and possible locations for these boxes WIMBORAE? After lengthy discussion Mr Ferguson moved this matter be tabled until such time as the councillors for Divisions 4 6 and 7 obtain further information and J11 comments from their ratepayers as to whether boxes should be established in their areas v� /2�� Carried COUNCIL MEETING MAY 26th, 1980 P 3 Mr Jim Keith Sales Supervisor for Allied Chemicals entered the meeting CALCIUM CHLORIDE at this time to discuss calcium chloride as a dust control on M D roads DUST CONTROL He noted that calcium chloride retards evaporation and keeps the moisture in the roads The road should be graded and crowned to provide good drainage, have a good cover of gravel and perhaps the road should be watered down prior to the application if the weather is hot and dry There was discussion as to whether calcium chloride will make the road slippery in wet weather how widely it has been used as a dust control measure where it has been used in Alberta, and various other items Mr Keith noted the treatment is good only for one year, And would be good in a slower traffic area He also recommended the travelled portion of the road only be treated After further discussion Mr Keith was thanked for coming and he left the meeting AMA DIRECTIONAL Alberta Motor Association have written requesting information from the M D SIGNS as to where directional picket signs should be located in the M D to assist travellers in this area Mr Ferguson moved that Mr Jeffery and Mr Friesen 1 advise AMA of various locations where the signs may be regL.ired and supply them with a map of the M D Carried Alberta Bridge Branch advise they will be undertaking repairs on tT e BRIDGE REPAIRS bridge WSW 20- 30 -25 -4 - Bridge File 2236 which was damaged by a motor WSW 20 -30 -25 vehicle recently i^ Mr Bauer moved to accept and file as information Carried Mr Jeffery reported that Rangeland Oil Company have accepted the offer SETTLEMENT WITH from the M D to contribute $2000 00 towards the costs of the clean up RANGELAND OIL CO required after the oil pipeline was ruptured by the M D motor grader RUPTURED OIL LINE After discussion of this matter, Mr Ferguson moved to accept and file this report Carried The meeting then ad3ourned for dinner between 12 00 Noon and 1 00 P M Vn DINNER The policy regarding requirements to be followed when people are spreading POLICY RE- oil on M D roads was then reviewed and after dixussion Mr Poole moved that SPREADING OIL the policy be amended to include the requirement that anyone applying oil to ON M D ROADS an M D road must post signs indicating the presence of fresh oil on the roads Carried Alberta Environment have forwarded a letter which states the Wimborne sewer WIMBORNE project is eligible for the Alberta Municipal Water Supply & Sewage Treatment SEWER Grant of $107,640 00, and the project could receive a Community Services Program DEBENTURE Grant of up to $54,900 00 Total project costs will be $188,700 00 Mr Jeffery also reviewed the by -law authorizing the debenture for this project BY -LAW 905 and noted that this by -law authorizes borrowing $26,160 00 and charging a frontage tax of $1 18 per front foot A After discussion of this matter, Mr Bauer moved first reading to by -law 905, this being a by -law to authorize the M D to incur an indebtedness for construction of h the Wimborne sewer pro_7ect Carried Unanimously Mr Berdahl moved that Mr Cunningham be authorized to proceed with ordering supplies and materials for the Wimborne Sewer Project at this time Carried Alberta Environment also wish to know if the M D will be considering any sewer and or water projects for the 1980181 year and the 1981182 fiscal year Mr Ferguson moved that Alberta Environment be advised the Wimborne project will be undertaken in the 1980181 year, and also a project to provide water for Ruarkville, Grantville and the Prairie Bible Insitutute may become necessary in the next year or two Carried ALTA OTHER DEBENTURE PROJECT, POWER LINE Alberta Power Ltd have forwarded plans for power line extensions to EXTENSIONS SE 11- 34 -26 -4 and to LSD 12 in 24- 33 -25 -4 After review of same, Mr Poole moved approval of the plans as submitted, subject to Alberta Power Ltd , being responsible for moving any lines located on M D road allowance at their own expense should this be required by the M D for any reason Carried C & E SILTALA A backsloping agreement has been arranged witk Charles & Edward Siltala �. E,' SE 29 -32 -23 on EJ� of SE 29- 32 -23 -4 and Mr Jeffery reviewed terms for same BACKSLOPING COUNCIL MEETING MAY 26th, 1980 Mr Berdahl moved approval of the agreement as arranged Carried ME Alberta Environment sent a copy of a letter addressed to F J Wittstock WITTSTOCK of Acme concerning a proposed drainage project on SW 1- 30 -26 -4 to the M D SW 1- 30 -26 -4 for information After review of the matter, Mr Ferguson moved this DRAINAGE PROJECT matter be referred to the Road Committee for investigation and a report back to Council U Carried Mr Jeffery reviewed with council the existing prices charged for GRAVEL PRICES gravel at the pits and at stock pile locations He also noted that Linden Contractors sell gravel at their pit for $2 85 and Ron Toews sells gravel from his pit at $3 50 per year After lengthy discussion Mr Poole moved that the M D sell crushed /1 gravel to its ratepayers as provided in the existing policy regarding sales, at a common price of $3 50 per cubic yard at any pit location and a common price of $6 00 per cubic yard at any stock pile location Carried Mr Ferguson and Mr Berdahl - opposed Mr Brown, Mr Poole Mr Bauer and Mr Campbell - in favour Recorded motion requested Mr Jeffery then reviewed price for pit run gravel and Mr Brown moved ✓` that the M D sell pit run gravel from any of its pits at a price of $1 00 per cubic yard Carried The loading charge for pit run gravel (50fi per cubic yard) was discussed ✓� and no change was mace GRAVEL TRUCK Mr Jeffery advised Council about the accident involving two gravel trucks ACCIDENT Mr Ken Buchart ran into the back end of the gravel truck driven by Mr Glen Enzie Mr Enzie was stopped at a yield sign anc'. Mr Buchart came over a slight rise, didn't see Mr Enzie's vehicle because of the dust and ran into him Mr Buchart's employment was terminated, the accident reported to the R C M P , and to our insurance company The one truck was damaged quite extensively and may require a new motor If a new motor is required the truck may be written off, if not it will be repaired and this will take at least 4 to 6 months ADHESIVE FACING FOR Mr Brown noted that there is a new high intensity adhesive facing available TRAFFIC for re- facing traffic signs and Mr Friesen noted if he could use this tune of SIGNS material he can re -face a sign riaht on the post Mr Ferauson moved that Mr Friesen be aiven authoritu to tru this tune of material on a trial basis Carried Mr Brown also noted that there has been a problem with the new Dodae trucks boiling and if several alternatives suggested to solve the problem do not work includina the need for a shroud or a laraer fan it mau reauire installation of a larger radiator SHOP & Mr Jeffery reviewed the Shop & Foremen Committee meeting minutes of May 22nd, FOREMEN COMM and reviewed recommendations regarding the 4 recent accidents and demotions or MEETING loss of safety awards MINUTES Mr Jeffery also reported that Norman Soder had an accident today backing into another vehicle when backing out from the curb on main street in Three Hills ACCIDENT The damage to the other vehicle probably did not exceed $350 00 so the R C M P NORMAN SODER were not involved There was no damage to Mr Soder's truck After discussion of this matter Mr Poole moved this matter be tabled and reviewed again at the next meeting of Council Carried FLAG PERSONS The Shop & Foremen Committee have recommended the M D hire two flag persons FOP CRACK for the crackfilling crew After lengthy discussion of this recommendations FILLING and possible solutions to the problem of people driving too fast past the crew, CREW Mr Ferguson moved Mr Jeffery contact the R C M P to see if they can charge people for speeding when signs are up indicating a road crew is at work, and a speed limit is posted Carried Mr Jeffery advised Council after speaking to the R C M P about this matter that these types of signs are only advisory and cannot be enforced After further discussion it was agreed that this matter be tabled and discussed again at a later meeting and also the possibility of submitting a resolution to the Fall Convention requesting change in provincial legislation to allow the COUNCIL MEETING MAY 26th, 1980 P 5 MIS PUBLIC WORK R C M P to lay charges be considered ITEMS Mr Ferguson noted he had been advised the Cat loader is not working well and it has transmission problems There was also discussion about the problems experienced with the D6 cat Mr Ferguson moved that Mr Jeffery contact the firm of Brownlee, . Fryett to ascertain what changes might be required to provincial legislation to allow the R C M P to lay charges for speeding past a road crew when proper signs are posted Carried Mr Berdahl moved to accept the Shop & Foremen Committee Meeting minutes Carried T C Mr Jeffery reported that Mr Paquette is planning on taking early retirement PAQUETTE in March of 1981 but this depends on the state of his wife's health at that POSSIBLE o DATE FOR time Mr Bauer moved to accept the report as information and this matter be discussed again at a later date Carried ALTA 75 Mr Jeffery noted he had regeived a request from Gail Tainsh on behalf of the GRANTS 1970 Three Hills High School Graduation Class They would like to purchase commemorative pins for their reunion from the Alberta 75th grant monies allotted to them After discussion Mr Ferguson moved that od s with cos ;s would be�cceptable expenditure r�aJ► o for any group allotted fun s or a re- union, home - coming day, or other similar activity Carried J �> The Allingham Ladies Club have requested permission to change their allotted funds as they wish to purchase chairs for the Allingham Hall or repair the steps to the tai hall After discussion of this request Mr Bauer moved that the Allingham Ladies Club be authorized to spend a portion of their Alberta 75th grant monies for the purchase of chairs or repair of the steps to the hall Carried 1980 FIRE The 1980 Fire Chiefs Convention is scheduled for Stettler on June 15th CHIEF 16 and 17 The membership fees of $30 00 are now due Mr Ferguson CONVENTION Mr Campbell and Mr Litz were authorized to attend the convention Mr Brown moved that the membership fees in the association be paid Carried RELAX SET BACKS Canadian Western Natural Gas have requested permission from the M D to make FOR C W N G a permanent tank installation on 10 of 4- 29 -22 -4 within 50 feet of the, road TANK ON 10 of diversion After discussion of this request Mr Bggabhg@ob ?d that permission 4- 29 -22 -4 be given to C W N G to install the tank: 50 feet from /the existinc, road diversion � Carried Mr Jeffery reported that the road damage to the road west of 26- 28 -21 -4 is the ROAD DAMAGE respcnsib.ility of Pan Canadian Company, who have taken over W of 26- 28 -21 -4 the well drilled in that area The road damage occured when the well was .• i6 drilled, and to date has not been repaired BERRETH Mr Jeffery also reported that Ivan Berreth was hired to pull a packer with INCREASE IN his Versatile 4 wheel drive tractor on the Pope Lease Road Project The government RATE FOR rate including operator and fuel is $29 85 However Mr Berreth will not continue USE OF with the job unless he is paid $30 00 an hour plus half of the fuel costs TRACTOR After discussion of this request Mr Paquette was asked to obtain a price for renting a tractor from a machinery dealer for comparison C.__l � It was noted this price would not include an operator or fuel This matter will be discussed later today OVERLOADED Mr Jeffery reported that Alberta Highway Patrol had stopped a trucker TRUCK ON SR Goulet Trucking on SR 841 When he was stopped the truck was empty However 841 tare slips in his vehicle indicated the truck had been overloaded on several trips I/N and the road had been damaged After discussion of this matter and noting it would be difficult to prove the damage was in fact caused bu this particular truck as he was not overloaded when stopped Mr Berdahl moved to accept the report as information Carried ROAD Mr Jeffery read a letter from Alberta Transportation reaardina the work undertaken REPAIRS on SR 841 at the railway crossing over the Rosebud Creek This work was done by SR 841 Alberta Transportation C N R and the M D of Kneehill AT ROSEBUD Mr Poole moved to accept and file the letter as information CREEK Carried � /�� COUNCIL MEETING MAY 26th, 1980 M Mr Paquette entered the meeting at this time Applications for work from Russ Jewell, Brian Smith, Wat7ne Nelson, RL7an Rear, Barrie Vickert7 Dan Campbell were reviewed and Mr Poole moved these be referred to U` Mr Paquette Carried Mr Paquette reported that the results of the Benkleman Bean test on the Three Hills East road have not been processed yet, but it appears that the road is not in very good shape and the first 5 miles will Mquire ripping and packing before any surfacing is applied After discussion Mr Ferguson moved that if the. first section of the Three Hills East road is not suitable for surfacing, five miles of this road receive the cold mix application starting at a point 4 miles east of Highway #21 Carried It was agreed that compaction tests be taken on this portion of the road, and it be compacted to a good standard as necessary using crushed gravel Perhaps this gravel could be purchased from the government pile at the. Garsor Pi t After further discussion of the request from Mr Berreth for an increased rate for hiring his Versatile Tractor Mr Campbell moved Mr Berreth be paid the sum of $30 00 per hour and one -half of the fuel used while pulling packers on the Pope Lease Road Carried Mr Paquette also noted Shaw G M C have a new gas truck in stock for a price of $31,500 00 and there is a Louisville 9000 Truck available for $48,400 00 This is a cab and chassis only After discussion Mr Poole moved the M D purchase a gas truck for an approximate price of $31 500 00 to replace the one damaged in the recent accident Carried Mr Berdahl moved that Mr Paquette and Mr Ferguson be appointed to purchase a replacement gravel truck as outlined in the previous motion as soon as possible Carried Ir �r° Mr Brown reported that Mr Carl Marr of Linden wishes to build a house on �,ep °� C6400' LSD 5 -in 24- 30 -26 -4 and will require a road in to the property Mr Brown moved after discussion that Mr Paquette and the Road Committee investigate this request and come up with an estimate of costs to construct a road into this property, and Mr Marr be advised of the costs for same Carried Mr Ferguson noted Mr C W Thomas reported to him the gravel trucks had gravel falling off the top and his windshield was broken V) He was also asked if the M D receives any money from seismic companies as compensation for drilling in M D ditches Mr. Ferguson was requested to advise Mr Thomas the M D accepted no liability for his broken windshield, and to advise Mr Vasseur that the M D does not receive money from seismic companies for drilling on M D road allowances Mr Berdahl reported that the official opening of the addition to the Drumheller VN Health Unit Office is scheduled for June 23rd 1980 at 2 00 P M This is unfortunately a council meeting day Mr Brown moved that councillors attend the official opening Carried ,Qi Mr Berdahl reported he had been contacted by Mrs Louise Feltham, Reeve of the ° M D of Rockyview and Mrs Feltham asked if the M D would agree to attend a meeting of the four rural municipalities in the C R P C , and a person from the Provincial R°t_v'j Planning Board would be asked to attend this meeting to discuss the new Preliminary e�Y voc?
