G A Berdahl, R W Brown, T A Ferguson, A W Bauer and R G Campbell J C Jeffery Municipal Administrator and Clerkj Peter Spilchen Assessor Mrs Jean Wilkinson Assistant Municipal Administrator, and C W Poole were present as observers L G Litz was present as an observer during the afternoon portion of the Court Mr George Appleyard of Carbon was also present as an observer during the forenoon Nominations for Chairman of the Court were called for by Mr Jeffery Mr Poole moved that R W Brown act as Chairman Nominations were called for again a second and third time, and no further nominations were made Mr Brown was declared to be Chairman for the Court of Revision The appeals were dealt with as follows 1 Helen-Penner--Three-Hills - - -SE -and -SW -22- 31 -26 -4 --- -Time --9 :00 - A - M ----------------------------------------------- - - -- Mrs Penner filed an appeal claiming the assessment on the two quarters is too high NOT Mr Spilchen advised he had inspected the property and checked his calculations PRESENT and recommended a reduction from 2350 to 2110 on the South East of 22 and no change be made in the assessment on the SW 22 After discussion of the reasons for his recommendations Mr Ferguson moved that the recommendation of the assessor be accepted and the assessment on the SE of 22- 31 -26 -4 be reduced from 2350 to 2110 and no change be made to the assessment on the SW of 22- 31 -26 -4 Carried 2 Robert -E -Vetter, -Three Hills, S; 28- 31 -25 -4 - Tsme -- -9.15 -A -M ----------------------------------------- - - ------------- NOT Mr Vetter claims the assessment on these lands is too high Mr Spilchen PRESENT had reinspected the property with Mr Vetter and recommended no change in the assessment for the SW of 28 ($2480) and recommended a reduction from 3200 to 3090 on the SE 28 After discussion of this matter, Mr Bauer moved that the assessment on SE 28- 31 -25 -4 be reduced from 3200 to 3090 and no change be made in the assessment on SW 28- 31 -25 -4 Carr.i ed 3 D --G --Smithers --Three Hi11s - SW 30- 31 -24 -4 --- -Time -9.30 -A -M ------------------------------------------------- Mr Smithers appealed the assessment as the acres are wrong NOT Due to an error one acre was taken off the quarter rather than adding it PRESENT on and assessed as a 158 acre parcel, rather than 160 acres Mr Berdahl moved to accept the recommendation of the assessor to correct the acres to 160 acres and increase the assessment from 3790 to 3840 Carried 4 Marc-Reed---Three-Hills ---Lot - 1, Block 1, -Grantville - 7611146 Time 9.45 A M ----------------------------------------- - - - -- - - -- NOT Mr Reed appealed the assessment as being too high PRESENT- Mr Spilchen noted he re- inspected the property and checked through the house Assessment is now $8450 and he recommended no changes Mr Berdahl moved that no change be made in the assessment of this property 5 NOT PRESENT Carried Ros." Williams, Trochu, NE 6- 33 -24 -4 - Time 10 00 A M Mrs Williams appealed the assessment as being too high Mr Spilchen advised he inspected the land and recommended reduction in the assessment from 3490 to 3100 After discussion of the reasons Mr Bauer moved that the assessment on NE 6- 33 -24 -4 be reduced from 3490 to 3100 Carried 2 ri COURT OF REVISION APRIL 28th 1980 Page 2 ------------------------ - Lot 5 & 6 in Block 2 Plan Time 10:30 A M Hesketh 4267 C S NOT PRESFNT ---------------------------------------- ----------------------------- Mr Peterson is appealing the assessment on his residence on this property of 1310 on the basis of farm exempt-ion, even though his residence in within the hamlet boundaries Mr Spilchen reviewed with the Coure section of the Act which is applicable to Mr Peterson's situation and after discussion of the matter, and noting that Mr Peterson' esidence is situated on two lots only in Hesketh which is less than 1 acre in size, and is within the boundaries of the hamlet and not c nsdidered as farm land, Mr Berdahl moved that this matter be tabled until latelaa ayMr Spilchen obtain more information about this situation from Provincial Assessment Board is Carried NOT 8 Wayne- J-- Ma _qnusson_ Calgary, Pt NW 3- 34 -22 -4 - 40 acres - Time 10 45 A M ---------------------------------------------- PRESENT Mr Magnusson appeal his assessment as being too high, but in discussions with him Mr Spilchen determined he felt his taxes would be $80 00 rather than his assessment being $80 00 Mr Spilchen recommended no change in this assessment Mr Bauer moved no change be made in the assessment on Pt NW 3- 34 -22 -4 Carried 9 Raymond Olson, Three Hi11s -- -Lot -6 -Block -4 --Plan 7810405 Ruarkville -- --Time - - ll 00 -A -M ------------------------ - - - - -- ---------------- Mr Olson entered the Court of Revision and requested consideration of a reduction in his assessment Mr Jeffery read his letter of appeal Mr Spilchen noted he could find no error in his calculations House assessment is $6710 and land $200 00 The house is 1337 square feet with attached garage Mr Olson stated he felt the square footage was only 1274 plus the garage After discussion of the measurements it was agreed that Mr Olson and Mr Spilchen would re- measure the house this afternoon and Mr Bauer moved that a decision on this appeal be tabled until later today Mr Olson left the hearing at this time 10 Morley Mychaluk, 103 Palisway S W Calgary - W�- NW 36- 33 -27 -4 - Time 11 15 A M ---------------------------------------------------- NOT Mr Mychaluk appealed the assessment as being too high Mr Spilchen indicated PRESENT he could find no error in his calculation The house on the land is assessed as Mr Mychaluk lives an Calgary and does not farm The house is assessed at 4240 being 90% completed and Mr Spilchen recommended no change Mr Ferguson moved no change be made in the assessment on this land Carried 11 Gulf Oil Box 130, Calgary - 6- 33- 29 -24 -4 Time 11.30 A M -------------------------------------------------- Gulf filed the appeal as assessment is too high The dessicant unit at this site is not in use and therefore they request a 50% reduction for this unit The present assessment is 33390, and a 50% reduction on the unit would reduce the total assessment to 30,140 (reduction of 3250) Mr Berdahl moved that the assessment be reduced by 3250 from 33390 to 30140 Carried 12 M__R_ _Kei_m_ - _S_E__2 _NW__7_a_n_d_ NE 8- 29 -25 -4 - Time 11.45 A M Mr Keim requested the taxes be lowered on these parcels of land Mr Spilchen NOT PRESENT inspected the land with Mr A Keim, father of appellant, and recommends no change in assessment of $2760 for NW 7, no change in assessment of $2240 for NE 8 but recommends a reduction from 3280 to 3060 on SE 2 because of the sandy soil in the middle of the quarter Mr. Campbell moved to make no change in the assessments for NW 7 and NE 8 in 29 -25 -4 but to r duce the assessment on SE 2- 29 -25 -4 from 3280 to 3060 r. l� Carried COURT OF REVISION APRIL 28th, 1980 Page 3 Mr Ferguson moved that the Court of Revision adjourn until 4.00 P M April 28th 1980 Carried Mr Campbell moved that Court of Revision do now reconvene - Time 4.00 P M Carried NO 7 R J Peterson, Lots 5& 6 in Block 2 Plan Hesketh 4267 C S Mr Spilchen entered the Court and advised that Mr Peterson's assessment is correct and the house should be assessed and taxed as a residence in a hamlet area The assessment on the house is $1310 and the land is assessed at $20 00 After discussion Mr Ferguson moved that no change be made in the assessment on this property Carried NO 9 - Raymond Olson - Lot 6 in Block 4 Plan 7810405 ----------------------------------------------------- Mr Spilchen advised that there was an error in his measurements of the house and recommends reduction in the assessment because of the smaller size of the house and also a 5% reduction for the materials used on the outside of the house He recommends a reduction of $470 from $6910 to $6440 After brief discussion Mr Bauer moved that the assessment on the house be reduced from $6710 to 6240 and the land assessment to remain at $200 • Carried Mr Bauer moved that the Court of Revision do now adjourn Carried Time - G A Berdahl Di visi on 1 C W Poole Division 2 R W Brown Division 3 (Reeve) A W Bauer Division 4 T A Ferguson Di. vi si on 5 L G Litz Division 6 (after 2-30 P M) R G Campbell Division 7 J C Jeffery Municipal Administrator Mrs Jean Wilkinson, Assistant Municipal Administrator Mr Peter Spilchen Assessor V% Mr George Appleyard of Carbon was present as an observer until 1.30 P M Mr Jeffery reviewed terms of agreements arranged with land owners along the first 2 miles of the Pope Lease Road project, - namely - Leon Coates - N# 22 29 -23 -4 , Gordon & Bonnie Snell - N; 23- 29 -23 -4 Bonerva Farms Ltd , S--z 27- 29 -23 -4 C Olhauser S-� 26- 29 -23 -4 Mr Ferguson moved to accept the agreements , r...,� d by the Road Committee for is this project Carried Mr Jeffery advised Council of recent developments on the Anderson Bridge Project The lease of the Fuller Estate land expired this year and after discussions with Crown Trust Company and the former tenant Robert Larsen, it was suggested that the M D lease the land from the Fuller Estate for 1980, with an option to renew the lease in 1981, at the yearly cash rent of $1800 00 This would be a cheaper route for the M D , than trying to arrange deals with the Estate and Mr Larsen f for access when the project is undertaken, and arranging for interim fencing that might be required to confine Mr Larsen's cattle It appears that the income from the estate cannot be reduced because of a dependent person who is to receive all income from the estate for life There was discussion about the possibility of arranging a sub -lease with Mr Larsen on the pasture land and Mr Campbell moved to accept and approve the report given by Mr Jeffery and to authorize entering into a lease with the Fuller Estate for this land for the year 1980, with option to renew in 1981, at a cash rent of $1800 00 per year Carried Mr Jeffery noted that the tender accepted from Rollie Motors Products for a 314 Ton Van at a price of $7715 00 did not include the price for insulation of the van Our tender stated the van must be insulated, but Mr Koch stated he overlooked it in quoting his price, but also felt that the M D was remiss in that they accepted his bid without a quote for insulation The additional cost for insulation is about f $700 00 Mr Koch has indicated he will arrange to have the van insulated if theG�y M D will pay for one half of the costs of same, and he will absorb half the costs d After discussion Mr Bauer moved that the M D accept delivery of the 314 Ton Van from Rollie Motors Products on condition that Mr Koch arrange to have it insulated !ate and absorb one -half of the costs of providing such insulation and installation of same Y�' Carried r The! Village of Linden have arranged with Assessment Equalization Board to present a slide presentation on the new equalized assessment formula on May 13th 1980, at 7:30 P M , in the school auditorium in Linden Mr Ferguson moved that all `A councillors attend this meeting, if possible, as well as Mr Jeffery and Mrs Wilkinson Carried Mr Jeffery reviewed a comparison of the 1979 and 1980 equalized assessment figures for the M D , and also a comparison of these figures with the towns and villages' figures for 1979 and 1980, and the percentage increases Alberta Municipal Affairs has forwarded replies from the Government to the resolutions passed at the recent Fall Convention of the AAMD & C , and copies of these are to be sent to each councillor Mr Berdahl moved to accept and file as information Carried Mr Brown mentioned the changes in the Assessment Act which will provide for assessment of farm houses, and after discussion of this matter Mr Poole moved that Mr Spilchen assess each of the councillors' homes and calculate what ✓ assessment would be levied on them and report back to the next meet' g of Council Carried n �cS COUNCIL MEETING APRIL 28th 1980 P 2 This would given Council some direction and ideas as to whether Mr Spilchen would have to check every residence in the rural area to determine if it would be assessable or would be under the base level to be established ($28 500 00) AAMD & C have forwarded a circular requesting some information about the CIRCULAR RE. operation of Preventive Social Service programs in the province This type of PREV SOCIAL program is not operated in our area Mr Ferguson moved to accept and file SERVICES Carried PROGRAM A copy of the resolutions passed at the recent Spring Convention of the AAMD & C have been received, and Mr Poole moved to accept and file as information Carried RESOLUTIONS AT SPRING CONVENTION Mrs Wilkinson asked for a by -law authorizing the sale of Lots 13 and 14 in BY -LAW 903 Block 2 Plan Hesketh 4267 S C to the Hesketh Community Hall Association SALE OF LOTS This sale had previously been authorized by Council, but not completed 13 & 14 in Blk Mr Campbell moved first reading to by -law number 903, this being a by -law to 2Hesketh authorize the sale of Lots 13 and 14 in Block 2, Plan Hesketh 4267 S C to the Hesketh Community Hall Association, for the sum of $125 00 Carried V\ Mr Poole moved second reading to this by -law Carried Mr Bauer moved that third reading be given to this by -law at this time Carried Unanimously • Mr Ferguson moved third reading to this by -law Carried R W Brown Mr Jeffery noted that Mr Brown had been excused from attendance at council EXCUSED FROM meetings as necessary to the end of April He will be able to attend council ATTENDANCE meetings during the month of May, but may then be away for June and part of ✓' AT COUNCIL July MEETINGS Mr Poole moved to table this matter until the last Council meeting in May Carried Mr Jeffery reported on the recent joint recreation boards meeting on JOINT REC BOARD April 23rd, in Three Hills The meeting reviewed the by -law which established MEETING the various recreation boards, and various suggestions for changes were `1\ discussed The Recreation Boards will be submitting a letter to the M D requesting amendments to the existing by -laws and agreements 1980 BY -LAW FOR The by -law for 1980 establishing grants for the rural communities and the RECREATION towns and villages was also discussed After brief discussion of this matter GRANTS it was agreed this matter be left and discussed later today when Councillor Litz will be present REPORT ON Alberta Municipal Affairs have prepared and forwarded a report on Country Residences - A Municipal Perspective Each councillor was given a copy of the report and Mr Berdahl moved to accept and file as information 1\ RESIDENCES Carried An appeal has been filed by I P Goertz of Linden, against the decision of the DEV APPEAL Development Officer with regard to Development Permit 379 -80 I P GOERTZ Mr Poole moved that the Development Appeal Board hold a hearing on this appeal VA at 9 00 a M , May 12th 1980, and notice of the appeal hearing to be advertised in one issue of the Capital and circulated within one -half mile of the proposed development Carried LETTER FROM A copy of a letter from Palliser Regional Planning Commission to Calgary Regional PALLISER Planning Commission was read to the meeting Palliser Commission suggest that REG perhaps their area might be expanded to cover the M D of Kneehill #48 and certain PLANNING other areas as these areas might be more compatible with their region than with COMMISSION the Calgary Region After discussion of this matter Mr Ferguson moved to accept .n and file as information Carried AMENDMENTS C R P C advise that the Town of Black Diamond has requested amendment to the TO PREL Preliminary Regional Plan as well as the M D of Rocky View and Mr Poole moved that REG the M D voice no objections to the proposed amendments VA PLAN Carried C R P C also advise that a public hearing is scheduled for Friday, May 9th, 1980 to consider proposed amendments to the Prel Regional Plan by the City of Calgary y, and the Town of Canmore Mr Bauer moved to accept and file as information Carried SUBDIVISIONS Pt SW 35-33 - Applications for subdivision from L G Litz and Raymond Rear of Wimborne� 26 -4 COUNCIL MEETING APRIL 28th, 1980 P 3 for parcels of land (7 21 acres and 6 08 acres respectively) in SW 35- 33 -26 -4 (part of the C P R Railway right of way) were then reviewed and after discussion of the applications Mr Poole moved the M D recommend approval of these subdivisions subject to normal conditions for subdivisions and deferral At of public reserve `fir Carried NW 3- 34 -22 -4 SPLIT OF LAND BY The matter of the purchase by the Alberta Government of 120 acres in the NW 3- 34 -22 -4 was then discussed The title to this quarter was divided and the government purchased 120 acres and the original owner of the quarter retained a 40 acre parcel This split was done without going through the normal subdivision application ALTA GOVT procedure After discussion of this matter and noting that an application for subdivision by the land owner about one year ago had been refused by the Commission on recommendation of the M D , because of the problems VA to providing road access to the area and other reasons, Mr Berdahl moved that a letter be sent to the government department involved requesting Council be informed of an ar 1 d y simil / �1e splits in future so council imput into the matter may be made available to the government Carried SUBDIVISION Alberta Provincial Planning Board has allowed the subdivision of an old farmstead APPEAL site in NE 11- 33 -23 -4 and Mr Jeffery reviewed the reasons set forth by the KNIEVEL Board for allowing the subdivision Mr Berdahl moved to accept and file as information NE 11- 33 -23 -4 re uestin Carried SUBDIVISION q g Council s comments The Town of Trochu have forwarded a letter / ozr a proposed industrial subdivision in SE 17- 33 -23 -4 The Town of Trochu have entered into an agreement to purchase about 10 acres immediately adjacent to the Town from Mr Knei vet The land is SE -2 also part of the annexation proposal 33 -23 -4 p p presently before the Local Authorities Board Mr Poole moved that this matter be tabled pending receipt of information from the Local Authorities Board on the annexation proposal for this and other lands Carried Mr Jeffery advised Council about the establishment of the new Alberta 75 Birthday 75 BIRTH Grant Account, and how the funds will be transferred from the general capital DAY GRANT savings account to this account to cover cheques issued to the various organizations ACCOUNT as accounts are received for payment Mr Ferguson moved to accept the report and P P approve same Carried Building permits issued were reviewed as follows NE 16- 32 -25 -4 Lloyd Hazel - Peter Dyck - Single Family Prin Residence Pt NE 17- 28 -23 -4 - W & M Baldwin - principal residence NW 22- 29 -25 -4 - Crist Unruh Shop Lot 1 Blk 6, Grantville - Single Family Residence - Davidson and Mr Campbell moved approval of the permits as issued MMM01 Carried BUILDING PERMITS TOWN OF TROCHU Mr Jeffery reported on the recent annexation hearing by Local Authorities ANNEXATION Board for the Town of Trochu Mr Campbell and Mr Jeffery attended the hearing HEARING and the M D voicedno objection to the annexation proposal as long as the farm land involved is assessed on farmland basis until the use of the land actually changes Mr Poole moved to accept and file the report Carried AAMD & C have forwarded a circular from Alberta Power regarding line moves and making contact with Alberta Power to arrange such moves Mr Campbell moved to accept and file as information Carried Alberta Power Ltd have forwarded revised plans for line extension to serve SE 31- 31 -25 -4 and MR Poole moved approval of the revised plans Carried ALTA POWER PROCEDURE ON LINE MOVES ALTA POWER LINE EXTENSION SE 31- 31 -25 -4 AAlberta Environment have forwarded plans showing a proposed water diversion ALTA ENVIRON pro3ect for E'er 21- 31 -21 -4 The applicants wish to draw water from the Red n MENT Deer River and irrigate land on the E# 21 and also on a portion of M D road allowance WATER The road allowance is not open and the area on the road allowance appears to have DIVERSION t� E-� 21- 31 -21- 4 or- V4116- 0 NO( COUNCIL MEETING APRIL 28th 1980 M been farmed in conjunction with the cultivated land on E'er 21 Mr Ferguson moved that the M D would have no objection to the use of the road allowance by the applicant and irrigation of the area, on condition that if for any reason the M D find it necessary to construct a road on the road allowance or the road allowance is used by any person for public access, the applicants will have no claim against the M D for any losses which they may incur Carried CARBON The minutes from the Carbon & District Recreation Board meeting of March 10th RE were reviewed and briefly discussed The Board has passed a motion that the M D be asked to pay 50% of the 1980 operating budget for the Recreaton Board After brief discussion of this motion, Mr Campbell moved to accept and file the minutes as information Carried THRE- Mr Sulo Luoma, Director of the Three Hills Seed Plant, entered the meeting SEED PLANT at this time - 11 45 A M He advised Council that a statement of claim has been issued against Canberra PROBLEM Seeds and the Three Hills Seed Plant for damages resulting from poor quality rape seed being delivered to about 8 farmers in the Standard area by Canberra Seeds The reason the Three Hills Seed Plant was named as a defendant in the action is that the rape seed was brought to the Three Hills Seed Plant by Canberra for cleaning and the company claimed,in a previous action against ✓� Canberra by the Federal Government for delivering poor quality and contaminated seed to the farmers that the seed must have been mixed in the Seed Plant It appears that there was about 9% Polish Rape Seed mixed in with the Argentine Rape, along with numerous weed seeds of many different types The rape seed was purchased by Canberra from the Alberta Wheat Pool Elevator in Bon Accord trucked to Three Hills for cleaning and then picked up by Canberra for delivery to the 8 farmers involved Buying seed grain from an elevator is not consistent with good farming practices It appears that there are other errors in the statement of claim Mr Luoma left the meeting at this time The meeting adjourned for dinner between 12.00 Noon and 1.00 P M f DINNER The matter of the suit against the Three Hills Seed Plant was again discussed and Mr Poole moved that the Three Hills Seed Plant should hire their own solicitor and file a statement of defence to the Statement of Claim Carried CARBON & DISTRUT Mr Jeffery advised Council that the Carbon & District 75th Anniversary 75t11 Birthday Committee have arranged a meeting for April 29th, at the Carbon Community Center Committee to discuss the allottment of the M D Birthday Grant funds and request council representation at this meeting The meeting is scheduled for 7:30 P M Mr V Ferguson moved that Mr Jeffery, Mr Berdahl and Mr Poole attend this meeting if possible Carried Mr George Appleyard left the meeting at this time -
