HomeMy WebLinkAbout1979-11-09 Council MinutesCOUNCIL MEETING NOVEMBER 9th, 1979 A meeting of the Council of the Municipal District of Kneehill #48 was held on Friday, November 9th, 1979, in the Municipal Office, Three Hills, Alberta commencing at 9.00 A M A motion to change the date of the regular council meeting from November 12th to November9th was passed by unanimous consent of al council on October 9th 1979 Those present were. G A Berdahl Division 1 C A Poole Division 2 PRESEN R W Brown Division 3 (Reeve) A W Bauer Division 4 T A Ferguson Di vi. si on 5 R G Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson Assistant Municipal Administrator was present and recorded the minutes Mr Poole moved approval of the minutes of Council meetings of October 22nd -- APPROVAL organizational meeting and regular meeting MINUTES Carried Mr Doug Hazelton of Linden Contractors entered the meeting at 9 05 A M to discuss with councl.l the progress of gravel crushing to date GRAVEL He noted he had finished at the Lowen pit after crushing two additional CRUSHING days there The crusher is now set up at the Andrew Lowen Pit N; 10- 29 -22 -4 and he is waiting for the cats to push sufficient gravel down over the hill before starting up the crusher He has been waiting now for a day and a half s He felt the M D should hire a D8 cat with a U dozer to push the gravel over and the other M D cats could do the required stripping He noted there is probably -� million yards of pit run at this location Mr Hazelton :stated he would like at least 4000 yards stock piled before he starts the crusher working, and also noted the M D should consider crushing at least 20 000 yards at this locations Mr Paquette entered the meeting at this time After discussion of the situation, it was agreed and Mr Berdahl moved that Mr Paquette be authorized to hire a D -8 cat with a U dozer and organize a double shift or a single over -time shift to operate the cats and get the gravel pushed over so Linden Contractors can start crushing Carried Mr Hazelton noted he has put his name in for a jaw crushez next spring before road bans go on and hopes he will be successful in obtaining same s He will try to crush gravel at the Garson Pit if the weather holds, otherwise it will all have to be done in the spring Mr Bauer noted that there is gravel on R Vetter's land - NW 27- 31 -26 -4 R VETTER probably about 15 to 20 acres involved, and wondered if the M D would want GRAVEL PIT to open a pit at this location and crush any gravel at this time NW 27 -31 -26 It would not require much stripping It was briefly discussed and agreed probably could crush some gravel next spring Mr Hazelton was asked about a price for crushing at the Andrew - Lowen Pit PRICE FOR and he stated he would crush the gravel at for the same price he was charging ANDREW LOWEN for other 314" crush at the other locations, $1 38 per yard GRAVEL CRUSHING Mr Berdahl moved that Mr Hazelton be authorized to crush up to 20,000 yards r at the Andrew - Lowen Pit at a price of $1 38 per yard Carried Mr Hazelton was thanked for coming and he then left Mr Paquette also left the meeting at this time Council reviewed the bank reconciliation for the month of October BANK which showed a net balance of $2,146 659 44 S1 :211.1.:, Mr Bauer moved approval of the statement as presented Carried Mr Jeffery reviewed the budget run to the end of October and they BUDGET RUN discussed briefly various items IN Mr Ferguson moved to accept and file as information Carried The members for the Airport Commission for the ensuing year was then MEMBERS OF AIR discussed, and Mr Poole moved that R W Brown T A Ferguson be It, PORT COMMISSION J --2- COUNCIL MEETING COUNCIL MEMBERS, Mr Ralph Haller of Trochu and Mr Paul Vasseur of \.A Three Hills be named as Rural Ratepayer Members and Mr J C Jeffery or his designate be the fifth rural member on the commission, for the ensuing year Carried Mr Jeffery noted that the office staff has requested permission to DEC 24 IN take Monday December 24th 1979 as a holiday in lieu of November 11th LIEU OF NOV 11 which falls on a Sunday VA Mr Berdahl moved that the office staff be authorized to do this Carried Mr Jeffery reviewed various invitations received and room reservations CONVENTION for the AAMD & C Fall Convention �` INFORMATION The Minister of Municipal Affairs has forwarded the n t replies to GOVT REPLIES resolutions passed the AAMD & C Spring and Mr Campbell moved that copies f TO RESOLUTIONS of the resolutions be sent to the councillors with the minutes Carried A salary survey of councillors' pay has been received from the County of COUNCILLOR PAY Forty Mile and Mr Poole moved this item be tabled until a later meeting SURVEY Carried The letter from the Executive of the Alberta Rural Municipal Administrators Association regarding the report from the Alberta Municipal Finance Council ALTA MUN on assessment and taxation was briefly referred to and it was noted FINANCE that this matter will likely be discussed at the Fall Convention f REPORT Mr Poole moved to accept and file the letter as information Carried The Salvation Army requests Council's consideration of a donation to their cause, and Mr Poole moved this request be tabled until SALVATION ARMY donations for the year are considered REQUEST Carried The report from Norman Soder Ag Fzeldman was briefly reviewed AG and Mr Ferguson moved to accept and file Carrie§EPORT It was noted this report had been tabled from the previous meeting The Federation of Canadian Municipalities has forwarded copies of their F C M monthly bulletin and wish to know if council would like to receive same V% REPORTS After discussion Mr Poole moved to accept and file as information Carried The recommendation from the A S B that no 1080 baits be put out this 1080 BAITS winter was briefly discussed and Mr Poole moved that Council accept , this recommendation and no 1080 baits be used this winter " Carried It was agreed that the need for a new chain hoist at the A S B shop CHAIN HOIST FOR should be discussed at the next Shop & Foremen Committee Meeting N "((, e1 4o A S B Mr Monty McGregor of Alberta Transportation entered the meeting at this ALTA time to discuss with Council its 1980 priorities for SR road work TRANSPORTATION Mr B Kathol Regional Engineer has indicated that the government will SR ROAD PRIORITY probably fund one project in the M D in 1980 but not two If SR 575 is paved, the work required on SR 806 would have to be done at M D expense if Council wish it done in 1980 Mr McGregor indicated that probably SR 575 should be completed as the base work has been done, and SR 806 and 585 would have to be done within the next five years He also indicated that the M D would probably have V\ to do considerable patch work on SR 806 in 1980 at its own expense, but it could probably be arranged to include the supply of hot mix required by the M D in the , :_.... t call for tenders if SR 575 is approved for paving This would probably save the M D some money After further discussion of the matter, Mr Berdahl moved that Alberta Transportation be advised the M D 's first priority for 1980 paving would be SR 575 Carbon East and further that the M D will not undertake any paving on SR 806 at its own expense in 1980 but will do necessary patch work required to maintain the road; that the M D 's second priority would be SR 806 and 3rd would be the overlay required on SR 585 Carried COUNCIL MEETING Page 3 November 9tP, 1979 There was brief discussion about other items with Mr McGregor, he was thanked 0 for coming and then left the meeting Underwood, McLellan & Associates have extended an invitation to Councillors UMA RED DEER to attend their official opening of their new office in Red Deer on OFFICE OPENING November 21st, 1979 between 4.30 P M and 8 30 P M After brief discussion, Mr Campbell moved that all councillors should attend if possible Carried Mr Joe DeBeaudrap of Trochu has requested Council to consider cancellation CANCELLATION of taxes levied on a house on NE 25- 32 -22 -4 Mr DeBeaudrap previously had TAXES NE25- it rented but for the last two years, his son has been living there and 32 -22 -4 his son is farming with him 9, Huxley be sold to the Huxley Community Hall DEBEAUDRAP The taxes levied for 1978 on the house cam to $124 71, and for 1979 that the Club obtain titles to their $142 14 existing property Lots 6 to 9, and the lots all be consolidated into Mr Campbell moved that Council refund the taxes levied on the house in NE 25- 32 -22 -4, for 1978 in the sum of $124 71 to Mr DeBeaudrap and cancel the taxes levied for 1979 in the sum of $142 14 Carried rir Jeffery reviewed the minutes from the October 16th Regional Resources REG RES Pro_7ect meeting, and Mr Berdahl reported on one or two items V� CORRESFONDENCI Mr Ferguson moved to accept and file as information Carried The Huxley Community Hall Society have requested the M D sell them HUXLEY Lots 1 to 5 in Block 9, in Huxley These lots are presently used b. COMMUNITY HALL the Hall as parking area After discussion Mr Poole moved that the REQUEST TO BUY lots 1 to 5 in Block 9, Huxley be sold to the Huxley Community Hall Lots 1 to 5 in Blk Society for $250.00 on condition that the Club obtain titles to their 10 existing property Lots 6 to 9, and the lots all be consolidated into one title Carried The Torrington & District Recze Lion Board minutes of its meeting N TORRINGTON, REC held April 26th were briefly reviewed and Mr Berdahl moved to accept BD MINUTES and file Carried Mr Bauer and Mr Brown reported briefly on their attendance at the ANNUAL JOINT REC annual joint recreation boards meeting held recently Each board ^ BOAFD MEETING gave a brief report on their activities Mr Poole moved to accept and file as information Carried Mr Jeffery reviewed the minutes of the Three Hills School MINUTES Division meeting of October 25th, and after discussion Mr Campbell SCH DIVIS moved to accept and file as information Carried Mr Jeffery also reported regarding the gravel supplied by the _ GRAVEL FOR M D to the School Division for the new shop yard The agreement SCH DIV SHOP arranged between the School Division and the M D provided that YARD the M D would do landcaping work with the motor scrapers and supply gravel and the estimated costs for this work was $3500 00 Mr Rempel has reported that to date they have hauled in 1692 yards K U C of crush gravel for a total cost of $13 749 19, and the cost of work done A by the machines to date comes to $9,554 73, for a total cost of $23,303 92 R' ,k-p n.ee Our estimated costs for our share of the building was $19,385 97 which .� included the estimated cost of $3500 00 for landscaping and gravel After discussion of this matter Mr Bauer moved that a committee of Mr Jeffery, Mr Campbell and Mr Rempel meet with the School Division to discuss the costs payable by the M D towards the building, taking into consideration the amount of gravel and work done to date by the M D Carried Calgary Regional Planning Commission have set December 17th, 1979 C R P C at 7.00 P M , as the date for a public hearing to review with the CORRESPONDENCE public the new preliminary regional plan The hearing is to be held in the Three Hills Community Center Other correspondence from C R P C including notice of public hearirg to amend the Preliminary Regional Plan as requested by the City of Calgary the Town of High River and Town of Okotoks, a report of Municipal Growth - Revenue and Expenditure Anaylsis, The General Municipal Plan for the Village of Acme and a notice from of Rocky View r COUNCIL MEETING NOVEMBER 9th 1979 advises it P 4 whereby it /plans to appeal to the Provincial Planning Board because C R P C have refused to amend the Regional Plan as they requested to allow for rural industrialization were briefly reviewed and Mr Poole moved to accept the correspondence as information and file same Carried Bridgeland Engineering Ltd , of Calgary have submitted information VILLAGF LINDEN regarding a proposed subdivision in NW 20- 30 -25 -4, to provide a site DUMP BOX SITE for the Village of Linden upon which to erect their dump box transfer station SUBDIVISION for the regional Waste Disposal System NW 20 -30 -25 It was noted that the land is proposed for annexation into the Village but this has not been completed as yet Mr Campbell nr ved that the M D recommend approval of the subdivision as long as no access from the site will be allow on to SR 806, and that municipal set -backs can be complied with for any development (including fencing) on the site Carried Mr Jeffery reported that Welcome Ford of Three Hills have complied WELCOME FORD with the Notice issued against them under Development Control By -law 789 REMOVAL OF and have removed the illegal sign erected by the company on the Lamplighter ✓ SIGN Inn property in the hamlet of Grantville Mr Jeffery reviewed building permits issued as follows. BUILDING NW 21- 29 -21 -4 - Ted Stahl - Shop PERMITS NE 29 -25 -4 - Hamlet of Bircham - Addition to residence - I E Schmidt NW 20- 29 -26 -4 - Raymond Berreth - Quonset for Storage NE 33- 32 -25 -4 - Robert Tetz, Double car garage Pt NE 9- 30 -24 -4 - Dick Esau, remodel existing car garage Lot 18, Block 3, Ruarkville - Dan Campbell - Single Family Residence Pt NE 31- 32 -26 -4 - Clifford Hazel - Mobile Home for Non Farm Help s NE 2- 32 -24 -4 - A B Cullum - Machine Shed Three Hills Airport - Vern Rist - Hanger SE 26- 31 -22 -4 - Andy Nakaska - Extension to Hog Barn Lot 4, Block 2 Grantville - George Gowanlock - Single Car Garage Lot 13, Block 1 Ruarkville Dr Bruce Pedersen - Single Family Residence & Car Garage Mr Bauer moved approval of the permits as issued Carried Mr Jeffery and Mr Brown reported on their recent meeting with the THREE HILLS Town of Three Hills, Town of Trochu and the Minister of Environment regarding & TROCHU the possible solution to water problems of the two towns WATER. They are studying the possibility of running a pipe line from a filtration PROBLEMS plantnear the Bleriot Ferry north to Three Hills and Trochu and South to the City of Drumheller It would be necessary to draw the water from the river north of where the Three Hills Creek and Ghost Pine Creek come into the river to avoid the extra contamination from these two creeks To date no definite conclusions have been reached Mr Jeffery aZ so reviewed a problem which had arisen in the Trochu area The Town of Trochu had drilled a well on land north east of Trochu and were testing it to see if it could supply sufficient water for the town, and the surrounding farmers were very concerned that drawing this amount of water from the well to supply the town would seriously affect their existing water supply Agreements were arrived at and Alberta Environment wi.11 monitor the tests to be done to ensure that the water level of the surrounding wells is not affected Mr Poole moved to accept the reports given Carried McElhanney Surveying and Engineering Ltd of Calgary would be interested MCELHANNEY in doing work for the M D , and after brief discussion, Mr Berdahl moved SURVEYING to accept and file as information Carried Mr Cunningham has suggested changes be made in the existing M D road ROAD crossing policy, in particular making it mandatory for the company to CROSSING locate and move its line if the M D requires it for any reason at the POLICY expense of the company After discussion, Mr Campbell moved that Mr Jeffery and Mr Cunningham consult with our solicitor and draft new regulations for road crossings anC report back to a later meeting of Council Carried Mr Cunningham requests permission to attend the annual convention of ALEX TO Alberta Utilities Officers and the 1979 convention and Trade Fair of the CONVENTIONS Federation of Alberta Gas Co -Ops These meeting are scheduled for November 20th to November 23rd, at Red Deer COUNCIL MEETING NOVEMBER 9th, 1979 P 5 Mr Ferguson moved Mr Cunningham be authorized to atterd these conventions Alberta Power Ltd , have made application to the Public Utilities Board for a rate increase, and the hearing is scheduled for November 13th, 1979 at 9 30 A M in Edmonton Mr Bauer moved to accept and file as information f Carried s ALTA POWER RATE INCREA9 Carried Energy Resources Conservation Board have approved an expansion EXPANSION TO GAS of the existing gas plant on LSD 14- 35- 29 -24 -4 If' PLANT LSD 14 -35 -29 Mr Poole moved to accept and file as information 24 -4 Carried Alberta Power Ltd have submitted plans for line extensions to LINE EXTENSIONS NW 22- 33 -24 -4 and to SE 33- 30 -22 -4 � After brief review Mr Bauer moved to approve the line extensions ALTA POGt%E'R as per plans submitted Carried Mr Kent Walker has requested council install a culvert and KENT WALKER approach in to NW 22- 33 -24 -4 and also to blade grade and gravel the road J REQUEST FOR west of this quarter for a distance of about 800 feet ROAD WORK After discussion, Mr Bauer moved that this be approved -'' NW 22- 33 -24 -4 Carried A report was received from Mr Ferguson that garbage was dumped on road allowances near NE 19- 30 -21- and SW 29- 30 -21 -4 GARBAGE ON This matter was checked out by the Drumheller R C M P , and names ROAD of people involved were ascertained However to date the people ALLOWANCE had not cleaned up the garbage Trev Friesen and other employees of the M D have cleaned it up and hopefully the costs for the clean up can be charged against those involved Mr Berdahl moved to accept the report Carried Mr Jeffery reviewed a letter received from R Angus regarding the arrangements agreed upon for delivery of the new 950 Cat Loader, R ANGUS NEW and rental of a machine until delivery can be made of the new machine CAT LOADER After discussion of the arrangements, Mr Ferguson moved to table acceptance of this letter until a later date Carried Mainline Farm Sales of Three Hills have advised that if the M D MAINLINE wished to order a new Steiger tractor, it could be delivered in March STEIGER TRACTOR of 1980 After discussion, Mr Poole moved to accept and refer k(> the matter to the next Shop & Foremen Committee meeting �4etr��Me -0- Carried The meeting then adjourned for dinner between 12.00 Noon and 1 00 P M DINNER Mr Poole moved that the Council meeting do now adjourn and Council sit DEV APPEAL BD as a Development Appeal Board �` HEARING The council meeting then reconvened, following completion of the Development A Appeal Board hearing Mr Arthur Chamberlain of Three Hills has requested council to consider CHAMBER - allowing him to hook up his proposed new residence on Pt NE 1- 32 -24 -4 LAIN REQUEST 1 acre parcel - to the Ruarkville water and sewer lines After discussion TO HOOK UP of this request, Mr Poole moved that the matter be tabled until the J% RUARKVILLE requestcan be referred to the Town of Three Hills for their comments WATER & SEWER and approval Carried The Three Hills Chamber of Commerce has requested council consider making a donation towards their 1979 Christmas Festival Days activities ,n DONATION After discussion Mr Poole moved that the M D not make a donation towards THREE HILLS this project ChAMEER COMMERCE committee of Carried Mr Jeffery reviewed the items discussed by the /council members W.%MBORNE with the Village of Torrington in regard to the proposed fire agreement TORRINGTON and it was generally agreed that the village should be contacted again. FIRE AGREEMENT to see if they will sign the a.; _..:ro t as it now stands Mr Ferguson PO moved that Mr Jeffery, Mr Bauer, and Mr Campbell attend a village council meeting to review the agreement with them and arrange to have it signed in its present form Carried .vUiv�.1L MEETING NOVEMBER 9th 1979 P 6 it was generally agreed that the format of the agreement could then be reviewed with all fire departments at the annual joint meeting of all fire departments Mr Campbell reported that a joint meeting of all firemen in the M D was held recently and it appears that there will be requests from at least one department for an increase in the honorarium paid to the firemen Mr Jeffery reviewed the recommendations from the committee regarding 1980 1980 wages, and Mr Brown noted that the men will not settle for 9 %, but WAGE NEGOTIATIONS have asked for an increase based on the cost of living index at December 31st, 1979 '^ The Canada wide average is at 9 6% now The employee committee have also requested the M D to review the benefit package for employees, and in particular a short term disability program Mr Jeffery reviewed information he received from Alberta Power Ltd , and from Mr Dale Poxon, .. .ntative from ManuLife, regarding employee benefit programs such as short term disability coverage long term disability, dental plans and other benefits Mr Brown reviewed the alternatives open to Council and after lengtht, A discussion, Mr Poole moved that the hourly employees be offered a percentage increase for 1980 based on whatever the Calgary and Edmonton average cost of living increase is as of December 31st, 1979, plus a short term disability benefit package with costs for same to be shared on a 50 -50 basis by the employee and employer Carried Mr Bauer asked if Council would rent its loader to the Torrington & TORRINGTON & DIST District Agricultural Society and supply an operator, to load sand u�9 AG SOCIETY RENTAL \o Z� OF LOADER Saturday November 10th, 1979 from the Ron Toews sand pit After discussion Mr Ferguson moved that the M D rent the loader and supply an operator for the Society and the Society be billed for one half �A the costs for rental of the machine, plus the entire costs for the operator's wages Carried Mrs Wilkinson left the meeting and Mr Jeffery reviewed with Council the recommendations made by the committee regarding salary increases CONTINUED for salaried employees SALARY Mr Jeffery then left the meeting and council reviewed the recommendations L1 JcUJJIONS Mr Jeffery and Mrs Wilkinson were called back to the meeting and Mr Ferguson moved the 1980 increases for salaried employees be set as follows- Ted Paquette - same percentage increase as hourly employees receive John Dorn - ' "' ' ' "' "' """ Oris Rodger - $300 00 adjustment plus percentage increase as noted above George Rempel - same percentage increase as hourly employees receive Keith Smith - M D vehicle home with him at night at least until he has completed the general assessment These matter will be reviewed at a later meeting SHOP FOREMAN JOB The recommendations from the committee of Mr Brown Mr Litz, Mr Jeffery Mr Paquette and Mr Bauer regarding the new shop foreman were then considered, The committee recommended that Keith Smith be appointed as Shop Foreman on a �� V probationary basis until March lst 1980, and further recommended he also maintain OF�� supervision of the parts department t4 The need for another mechanic at the shop and possibly an apprentice mechanic J,� �qI was discussed and also e need for the shop to be painted and kept cleaner was d reviewed COUNCIL MEETING NOVEMBER 9th, 1979 P 7 After discussion of this recommendation, Mr Campbell moved that Mr Keith Smith be appointed as Shop Foreman on a proba- tionary basis until March 1st, 1980, effective November 19th 1979 and his salary be set at $23,500 00 per year with no change until December 31st, 1980, and further that he now be required to work a nine hour day Carried Mr Jeffery tren opened fuel bids received as follows: 1 Gulf Oil Ltd FUEL BIDS Gulf Diesel Fuel $0 6701 per gallon 2 Linden Co -Op Ltd Clear Diesel $0 636 per gallon 3 Texaco Canada -
