Mr Ferguson entered the meeting at this time - 9 10 A M 04%0 After further discussion of possible problems which might arise, Mr Poole moved approval of installation of the gas line in the location requested \e� }P </�� by Mr Peterson, subject to the condition that should the line require V moving at any time by the M D for any reason, this would be at Mr Peterson's expense Carried THEFT OF M D Mr Jeffery then reported to Council regarding the theft of an M D half VEHICLE ton truck from Harvey Jesske's residence over the weekend The offender, Berwyn Koch, is a juvenille and was extremely imparied at the time The front fender of the vehicle was damaged - approximate costs $400 00 An agreement was reached with the youth and his mother whereby he will work for the ✓, M D on the main crew picking rocks, until school starts and the situation will be reviewed at that time to see how much more he still owes for the damages to the truck On this basis no charges will be laid against the youth After discussion of the matter, Mr Campbell moved :.r r.. 1 of the actions taken in this matter by the Municipal Administrator CARBON RURAL FIRE Mr Jeffery reported the results of the vote for the proposed Carbon PROTECTION AREA Rural Fire Protection Area VOTE Total Votes 87 Carbon Polling Station Hesketh For the by -law 46 6 = 52 59 77% For Against the by -law 10 25 35 40 23% Against V\ After brief discussion, Mr Ferguson moved third reading to by -law 860, 4 qu1 this being the by -law to establish the Carbon Rural Fire Protection Area Carried Mr Berdahl requested he be recorded as being opposed 1 opposed, 6 in favour THREE HILLS SCH DIV Minutes of the Three Hills School Division meetings of June 30th, July 19th MINUTES end August 9th were briefly reviewed, and discussed Mr Berdahl moved to accept and file as information Carried ' �'� 9 Minutes of the Three Hills School Division meetings of June 30th, July 19th MINUTES end August 9th were briefly reviewed, and discussed Mr Berdahl moved to accept and file as information Carried ' �'� 9 i 1 L 0 / r COUNCIL MEETING AUGUST 14th, 1978 P Mr Jeffery vised ouncil that Mrs Violet Hart, an employee with the M D for ove -l1 years, has submitted her resignation effective December 31st, 1978 She has requested someone be hired soon to replace her so she can work with that person prior to her leaving Mr Ferguson moved that Mrs Hart's resignation be accepted with regrets Carried Mr Campbell moved that the Ac-hninistrator advertise for an imediate replacement for Mrs Hart, in order to allow time for training Carried 2 VIOLET H1 RETIF= Urr,iv. The official opening for the new Beiseker Credit Union is scheduled for Friday, September 8th, 1978 at 2 00 P M As Mr Brown is unable to attend, Mr Poole, as Deputy Reeve could attend Mr Ferguson moved that Mr Poole represent the M D at the official opening, and also attend the meeting V`1 of the CAAMD & C scheduled for Friday, August 25th, 1978, at 1 00 P M ,-,? e i CA ,� at our office Carried UY Dominion Life Assurance Company advise that our group insurance policy GROUP will be renewed on September lst, 1978, and the premium rate for the coming policy POLICY year will remain the same V4 RENEWAL Mr Litz moved to accept and file as information Carried Alberta Agriculture advises that Mr Jack Hazelwood will be joining NEW D A Russ Horvey at the D A Office in Three Hills on September 1st, 1978 Mr Berdahl moved to accept and file as information Carried Marvin Moore, Minister of Alberta Agriculture has written advising R W BROWN that Mr R W Brown's nomination to the Alberta Agricultural Hall of Fame NOMINATION was considered and it was not possible to appoint him to the Hall of Fame A AG HALL OF FAME this year due to the many nominees NOT ACCEPTED Mr Bauer moved to accept and file as information Carried Mr Brown requested that his thanks to the Agricultural Service Board f and particularly to Mr G G King for preparation of the nomination, be recorded and he greatly appreciated the gesture of the Board in making the nomination Mr Jeffery noted that Mr Robert Clark, leader of the Social Credit PROPOSED MEETING Party, along with candidate for this area, Henry Goerzen SOCIAL CREDIT wished to meet with the councillors for the M D some time on Tuesday CANDIDATE and possibly use the Council meeting room for meetings with other persons r After discussion, it was agreed to leave this matter until later in the day Mr Gordon Taylor, M L A has written advising that the Cemeteries Restoration Assistance Program is again in effect and up to $2000 00 maximum, or 50% of the costs involved in the project might be available for our cemeteries program for inactive or hi torical ce eteries, It was enerally agreed most of the cemeteries have been looked after underlie previous program Alberta Social Services have also written advising that they cannot waive the regulation which requires the Swalwell Cemetery to be fenced After discussion, Mr Poole moved that the letter from Alberta Social Services be accepted as information Carried Mr Campbell noted that the Tolman Bridge signs were down for a time, but TOLMAN BRIDGE have now been replaced The Government has now agreed to be responsible for SIGNS �A these signs in the future ROAD SIGN`) Mr Brown noted that Herman Kroschel of Bircham has spoken to him about the RE SEYVICE sign on the #9 highway which in4iates Bircham This is misleading to people who think it may be a town or village where services - such as gas, and food - would be available After discussion, Mr Brown moved that a letter be sent to Alberta Transportation requesting signs be erected at various locations indicating that there is no service along Highway #9 or Highway 21 after 6 00 P M for quite �! some distance Carried 3 L U COUNCIL MEETING AUGUST 14th, 1978 P The adjuster from Mandruisak and Calder has looked at the rugs 3 RUG DAMAGE IN in the office and will be getting information regarding possible OFFICE settlement soon Mr Bauer moved to accept the report Carried Various problems which have arisen at Keiver Lake were discussed, KEIVE''R LAKE including the charge for using the park for only a short time or PARK part of a day, the lake not being deep enough for motor boats, need for a pay phone, water level dropping quite rapidly, and numerous other items The fence was cut by someone on July 26th, and the R C M P requested the M D to lay a charge This will be done Mr and Mrs Horley will probably be leaving after the Labour Day Weekend The park will remain open for use without supervision V The phone will be removed and the gates taken down The letter to the Editor was also briefly discussed and it was agreed at the end of the season a financial statement covering the ✓' operation of the perk for the year be published in the paper Mr Campbell moved to accept the report regarding the park Carried The Alberta Public Service Pension Administration has scheduled two workshops covering the public service pension Mr Poole moved that Mr Martens be authorized to attend one of these seminars Carried Information has been received that Canadian Western Natural Gas will be applying for a change in its rates on August 14th, 1978 Mr Bauer moved to accept and file as information Carried Alberta Oil & Gas Cc :i.,_ ::.: _, ion Board have given approval for a sweet gas plant at LSD 10 in 4- 32 -23 -4 Mr Ferguson moved to accept and file as information Carried Neil Penner has signed a letter of agreement to UUUU�,� $70 00 and replacement of a tree next spring as full settlement of his claims against the M D Mr Bauer moved to accept and file the report as information Carried Building permits issued were reviewed as follows NE 14- 34 -23 -4 Howard Weis, Hog Barn SW 30- 30 -25 -4 A. Walter Peters Addition to existing house SW 36- 34 -21 -4 - William Waller - Machinery Storage Building Mr Ferguson moved approval of the permits as issued Carried SUBDIVISION A subdivision application for addition to Acme Sewage Lagoon in APPLICATIONS SE 30- 29 -25 -4 was then considered It will be 4 09 acres in size AFter discussion, Mr Brown moved approval for the subdivision be "' recommended by Council with deferral of reserves and other normal conditions of subdivision Carried A subdivision application for a 40 acre subdivision in NW 18- 29 -25 -4 was then considered The parcel is severed from the balance of the quarter V, by the railway, the land is low, with a large slough, and it would be difficult to locate a good building site on the parcel There is legal access to the north boundary of the proposed parcel by means of the road diversion on Plan 2144 A Z Mr Brown moved Council recommend refusal of this subdivision because of the low lying nature of the land, poor building site, the large slough on the property and intermittment creek which runs through the proposed parcel .4 1E E C7 r L COUNCIL MEETING AUGUST 14th, 1978 P4 Mrs Wilkinson reported that the Dave Regehr subdivision D REGEHR SE 18- 30 -24 -4 had been approved by C R P C on July 17th SUB SE 18-30 - Mr Regehr has until September 1st, 1978 to comply with the 24 -4 terms of the agreement regarding removal of the second house on the subdivided parcel Mr Brown then explained to Council the reasons for C R P C re- D PRYOR considering at this late date the D Pryor subdivision on SW 1- 32 -24 -4, and SUBDIVISION reviewed the commission's reasons for requiring the service road on the SW 1- 32 -24 -4 north boundary of the parcel instead of on the south boundary next to SR 583 It appears that traffic coming off a service road around a corner directly onto another road is creating a dangerous traffic situation, and is confusing to people By locating the service road to the north of the parcel, this problem is eliminated Mr Bauer moved to accept the reports given regarding the subdivisions Carried Alberta Local Authorities Board have advised that a notice of board TORRINGTON annexation hearing in regard to annexation proposed for the Village ANNEXATION of Torrington will be held in the Torrington Village Office, on September 12th, 1978 at 11 00 A M After discussion, Mr Poole moved that Mr Bauer, Mr Brown, Mr V1 Jeffery and Mrs Wilkinson be authorized to attend the hearing as representatives from the M D Carried It was generally agreed that the M D 's position is basically unopposed to the annexation, although it seems rather large, VA and as long as the rural land assessment remains in effect until there is a change in the use of the land Mr Russ Horley entered the meeting at 10 35 A M to discuss with Council Keiver Lake Park MR & MRS Mr Horley noted they had experienced some rather difficult situations R HORLEY RE there over the summer, with some people, but he did not& that the KEIVER LAKE majority of the people did try to keep the park clean Mrs Horley does not feel it would be of any benefit for them to remain at the park after the Labour Day weekend, and therefore will be terminating her contract at that time Mr Horley noted that Mrs Horley would not be interested in the job another year Council expressed their regrets and also thanks to both Mr and Mrs Horley for the excellent job done by them at the park this summer It was agreed that the parks committee should meet with Mrs Horley to obtain their recommendations regarding possible improvements to the + park for another year I Mr Horley also noted that the level of the lake has dropped to about four feet After further discussion with Mr Horley about various items, he left the meeting ACCOUNTS Mr Jeffery reviewed the accounts and Mr Poole moved approval of Payment for the accounts as presented Carried Mr Alex Cunningham and Mr Matt Bergmann of U M A entered the meeting at this time - 11 35 A M The Swalwell sewer project was then reviewed as well as the by -law to authorize the required debenture for the project Mr Poole then moved first reading to by -law number 861 Carried The by -law must now be forwarded to Local Authorities Board for approval The agreement arranged with Mr Dorne Fyten for access to the sewage lagoon site was then reviewed, and Mr Poole moved and approval of the agreement as arranged Carried Mr Bergmann noted that tenders close August 24th, 1978 and it was agreed that Mr Bergmann meet with a committee of Council at 8 00 A M on August 28th, 1978, prior to the start of council meeting to review the bids 5 SWALWELL SEWER PROJECT EO E191 ,.., COUNCIL MEETING AUGUST 14th, 1978 P5 Mr Cunningham was asked about certain items purchased by the Three ITEMS FOR RESCUE Hills Rural Fire Department for use on the new rescue unit UNIT Mr Cunningham explained that the men had agreed to use their honorarium this year to purchase these items Council requested V4 that he bring a report back to the next meeting of Council as to the cost of the items purchased for the rescue unit The meeting then adjourned for dinner between 12 00 Noon and 1 00 P M DINNER ,,,\ A Shop & Foremen Committee meeting was arranged for Thursday, August V�' 17th, 1978 at 3 00 P M Mr Jeffery advised Council that a meeting has been scheduled with THREE HILLS C T C and Alta Transportation (Gerry Mazurek) for August 22nd UNDERPASS 1978, at 1 30 P M I, at the Three Hills Underpass to discuss this A MEETING AUG 22/78 project, and as many councillors as possible are requested to attend Alberta Energy & Natural Resources have granted the Trochu Rifle & P TROCHU GUN CLUB Pistol Association a 21 year lease on NW 14- 33 -22 -4 for a shooting range LEASE After brief review of the conditions of the lease, Mr Litz moved to NW 14- 33 -22 -4 accept and file as information Carried Mrs Wilkinson advised Council that Lots 7 to 10 in Block 2 Hesketh TAX RECOVERY LOTS 4267 C S , are still under tax recovery proceedings They were offered for sale by public auction in October of 1947 and not sold HESKETH After discussion, Mr Berdahl moved first reading to by -law 862 this being a by -law to acquire clear title to these lots at a price of $50 00 a lot Carried Unanimously Mr Poole moved second reading to this by -law Carried Unanimously Mr Ferguson moved third reading to this by -law Carried Unanimously Mrs Wilkinson also noted that Lots 17, 18 and 19 in Block 2 Plan Swalwell 5050 A K , do not appear to have a tax notification SWALWELL filed against them, although no taxes have been paid or levied on the property for many years It appears that the notification may not have been filed by the former M D , or it has been lost in the Land Titles Office over the years After discussion, Mr Poole moved that the necessary procedure be now undertaken to place a tax notification against these lots Carried It appears that the same situation is involved with Lots 6, 73, 8 & 9 �ZTXLEY in Block 9, Huxley where the Huxley Community Hall is located There are two titles - one for Lot 6 and one for Lots 7, 8 & 9 Mr Campbell moved that the necessary procedure be now undertaken to place a tax notification against these lots Carried Council was advised that registration of transfer to Mr Alfred SALE OF CLOSED Kostrosky, Triple K Ranching Ltd , of the closed portion of original ROAD ALLOWANCE road allowance adjoining the south boundary of Section 29 in 29 -24 -4 NORTH OF 20-CE has been completed and Mr Kostrosky has received the duplicate certificate of title in the name of his company - Triple K Ranching Ltd V1 The land was consolidated into title with the adjoining quarter section Mr Poole moved to accept this report as information Carried R Arthurs, Land Surveyor has completed the linen for survey and BECKER BROST dedication of the 66 foot access in NW 21- 29 -24 -4 ACCESS In order to proceed with closure and sale of the original road allowance which is being exchanged with Mr Becker, a by -law must now be passed and adjoining land owners notified, and a public hearing held After discussion, Mr Poole moved first reading to by -law 863 this being a by -law to close a portion of the original road allowance lying to the N of the NW 21- 29 -24 -4 for sale to Mr A A and E L Becker Carried Unanimously Mr Bauer moved second reading to this by -law Carried Unanimously 0 i L� C•. C7 W COUNCIL MEETING AUGUST 14th, 1978 The by -law will now be advertised, adjoining land owners notif: and a public hearing arranged, before third reading is given tc by -law Mr Jeffery noted that a Kneehill Sanitary Land Fill committee KNEEHILL SANITARY meeting is scheduled for August 17th, 1978, at our office, commencing at 7 00 P M to discuss the plans for the Regional Land Fill site The bids �� LAND FILL have been received from Neufeld Industries and from Central Dispose +' MELTING All and costs compared Mr Brown reviewed the costs involved in the two systems and what each system would provide in the way of boxes, pick up service, equipment, etc It appears that the Neufeld System would be the cheapest system Mr Paquette, Mr Dobler and Mr Dorn entered the meeting at 1 40 P M After further discussion, it was agreed that this matter would be again reviewed at the meeting of the committee and all councillors should attend this meeting As no one came to the public hearing scheduled for 2 00 P M BY -LAW 859 with regard to the proposed narrowing of Queen's Street in Swalwell TO NARROW by 10 feet, Mr Poole moved third reading to by -law 859, this being ✓' QUEEN'S STREET a by -law to narrow the Queen's Street by 10 feet SWALWELL Carried The by -law is now to be sent to Alberta Transportation for approval of the Minister The status of the road in the NE 3- 29 -22 -4 was then discussed It appears STATUS OF that 4 rods was purchased by the M D from the former owner, Mr C Steward ROAD IN NE in 1954, but it does not appear to have been surveyed and registered as a road The land is now owned by Mr and Mrs Donald Metzger Mr Berdahl 3-29-22-4 noted that the access is required to allow access to NW 3 and SW 10 in 29- 22 -4 -, After discussion of the matter, Mr Poole moved that the M D arrange to have the road surveyed and dedicated at this time Carried There was also discussion regarding the need for retaining the gravel stock pile site in the NE 10- 29 -22 -4 as there is no gravel lease in effect with Mr Metzer now, the previous lease having expired in 1973 The stock pile site was not used in 1978 There was discussion about location of gravel for use in Division 1 and Mr Campbell moved that a committee of Mr Brown, Mr Berdahl, Mr Paquette and Mr Dobler arranged to look for a new source of gravel there soon Carried Mr Bauer reported that the road north of Sections 17 and 18 in 32 -24 -4 has been constructed partly on Sections 17 and 18 and partly on 19 and 20 It will be necessary to negotiate acquisition of the land required for the road from Mr Gorr and Mr Sandermann Mr Berdahl moved that negotiations be undertaken with the land owners with a view to acquiring the land required to have the road surveyed and dedicated, and a report brought back to Council Carried GRAVEL LEASE GRAVEL IN DIV I ROAD NORTH of 17 & 18 in 32 -24 -4 Mr A B Cullum, owner of NE 2- 32 -24 -4 noted that the road when it was COMPLAINT RE constructed past his land was not built on the road allowance, and he is .A ROAD PAST of the opinion it is about 4 to 8 feet on his property After discussion NE 2- 32 -24 -4 of the matter, Mr Ferguson moved to accept and file as information Carried Mr Jeffery reviewed the matter of the M D erecting a crossroads ahead SIGN IN sign in the County of Mountain View, in error, at NE corner of SE 19- 31 -26 -4 MOUNTAIN VIEW After discussion of the matter, and noting the sign has been removed, Mr Litz moved to accept and file the report Carried (0/ N L J \_J COUNCIL MEETING AUGUST 14th, 1978 P 7 The backsloping and work at the road project- M Charlton Job south of 29- 31 -26 -4 was then discussed The R C M P recommended M CHARUPON that a stop sign be erected going west down the hill at the ROAD PROJECT corner However this does not appear satisfactory, and it was S 29- 31 -26 -4 generally agreed that yield signs should be put on the north south road , and the M D will put up a sign on the north side ✓' of the road if the County of Mountain View agree and install a sign on the south side Mr Berdahl noted that the sign at the Ghost Pine Bridge has SIGNS been broken off about three foot above ground He felt that Mr Duncan was installing the signs too close to the road and he should be requested to ensure this does not happen in future Mr Jeffery then reviewed various letters received from Alberta ERIDGE BRANCH Bridge Branch as follows RECOMMENDATIONS RE 1 File 70377 WNW 2- 30 -25 -4 Kneehill Creek VARIOUS BRIDGES File 1703 SSW 2- 30 -25 -4 Kneehill Creek Letter dated July 24/78 Request survey information on these two bridges for reconstruction in future 2 Letter dated August 3rd, 1978 - Ken Hazelton - Settlement of $7987 50 offer as partial settlement for the truck and the insurance company will also pay for the repairs to the box and hoist The M D will retain the box and hoist, but the truck will be transferred to the underwriters Mr Berdahl moved to accept this offer of settlement Carried SPEEDING TRUCKS V, INSURANCE CLAIMS ON 3 GRAVEL TRUCKS L' A letter from Mandrusiak & Calder regarding the Dennis Berreth, A Schrieber accident on February 16th was then read, and discussed Mr Campbell moved that Mr Jeffery be authorized to sign the release forms if the settlement appears to be satisfactory after future discussion;- with the insurance adjusters Carried The insurance adjuster has looked at the gravel truck which was being driven by B Little when it rolled over The insurance company will not pay for a new box for this truck, but would probably pay for the hoist Council was advised about a gas line south of the approach at Morris Charlton's Section 29- 31 -26 -4 which was exposed, but not cut, by the main crew, during road construction The gas line did not appear to A be burled to its proper depth and the co -op should be responsible for re- burying the line Mr Dorn noted that the line had been reburied by the company Mr Bauer moved to accept and file the report as information Carried CROSSROADS GAS CO -OP LINE EXPOSED Section 29- 31 -26 -4 The Town of Three Hills has requested the support of the M D with their bid to have Alberta Transportation lower the Three Hills Access road and widen same from #21 to the Dairy King corner After discussion, Mr Ferguson moved that a letter in support of this project be sent to Alberta Transportation Carried Various public work items were reviewed as follows 1 Mrs Charles Siltala has complained that the pig operation carried on at NE 13- 33 -25 -4 is not being operated in a reasonable manner The smell from the lagoons is unbearable The matter was reported to the Drumheller Health Unit who agreed to inspect the operation again when time permit s Mr Poole moved to accept and file as information Carried 9 IMPROVEMENTS TO THREE HILLS ACCESS ROAD VARIOUS PUBLIC WORK ITEMS J 1 D� 0 C uudiAl;1L MEETINTG AUGUST 14th, 1978 P • The annual rental payable for road access to Mr Jim Sailer was then discussed, and it was ag -eed this be checked by Mr Campbell and ivl� Jeffery Mr Mel Ralston called and advised that the pipe from the Swalwell Dam is leaking and Mr Paquette has been advised to check same Mr Poole moved to accept and file as information Carried Mr 0 Davis had advised Mr Poole he had supplied his rock picker for about two days work on the Correction Line job, and this was to be in exchange for a small amount of cat work he wished done After discussion of this with Mr Dorn, Mr Poole moved that the account for the work done by the cat - about hours - be exchanged for the work done with Mr Davis' rock picker Carried Mr Jeffery advised Council that Mr Tom Downe would be willing to stock pile gravel at his yard at the farm in Carbon from his pit at Irricana and would sell same to the M D at a price not yet determined but below what the M D could obtain it for His trucks are presently delivering sand to Calgary and could bring gravel back from the pit on the return trip It would also keep his men working over the winter months It was agreed to ask him for a price for between 8000 to 10,000 yards of gravel at the farm yard in Carbon and a price for the same amount stock piled at the Marshmann stock pile site Mr A Keiver entered the meeting at this time (4 05 P M ) to discuss his complaint regarding the road west of 25 and 36 in 31 -26 -4 Mr Keiver noted the road is very poor, it has been narrowed to a 22 foot top, the shoulders are sand and very soft, there are a lot of rocks left on the rock and it is generally in very poor condition Council noted that the road had been narrowed in order to gravel it and because of the soil conditions it would flatten out over a short period of time After further discussions with Mr Keiver, Mr Poole moved that the road committee and Mr Paquette have a look at this road and make some decision regarding improvement for same Carried Mr Keiver also noted the buses going to the AMA camp cannot make the turn off the road because the motor grader has gouged out the corner Mr Keiver then left the meeting - should have a sign Cement dumped in ditch south of Bert Cirankewitsch - should be removed Hutterian Brethren of Huxley wish to push a 10 inch pipe under the road south of their buildings in order to use the manure from the lagoons for irrigating the land across the road Mr Berdahl moved that the colony be given permission to do this, on condition there be no disturbance to the road Carried Mr Campbell discussed the road project for South of 25- 34 -24 -4 and it was agreed that possibly pit run could be hauled from the Ginther Pit which would assist with the reclamation of that pit and also supply the required fill for the road Mr Bauer and Mr Paquette are to arrange for the fence and other agreements for the M Charlton road project soon V1 The Administrator was requested to look up the E Albrecht bridge file ✓ Pp �in 5 and report back to the next meeting with alternate solutions Stripping is required at the Schmatz pit The need for crushing gravel was discussed,and Mr Poole moved that tenders be sent out for crushing gravel as follows 75,000 yards at Schmatz, 40,000 yards at Megli and 10,000 yards at the McNair pit Bids to be back by September 11th, and tenders must specify commencement date for crushing Carried Mr Brown noted that the cattle guard has not been installed yet at the Megli Pit Mr Poole stated he had nothing further to report at this time Mr Berdahl noted that the Pope Lease road requires repairs, especially at the Rowbottom coulee He also noted a problem has developed between Mr Ralph Lowen and Mr Gerald Leonhardt regarding use of an m d road allowance in Section 32- 27 -20 -4 The administrator is to determine whose land the C.C, force d road was taken from and to send a letter to the two parties involved,. ^" advising them of the M D policy regarding use of road allowances r,_.
