COUNCIL MEETING JULY 24th, 1978
A regular meeting of Council of the M D of Kneehill #48 was held in the
Municipal Office, Three Hills, on Monday, July 24th, 1978, commencing
at 1 00 P M , after completion of a combined meeting of Council and
the Agricultural Service Board held in the forenoon
Those present for the meeting were

the minutes
GRAVEL TRUCK
Mr Dobler met with Council to report that Robert Tindal's gravel truck ACCIDENP
had suffered some damage A pin in the hoist had broken and caused
about $1800 00 damage to the hoist This happened Friday, July 21st
The box is all right except for the sill but in order to get
the truck back working, it was recommended that a new box and ►^
hoist be purchased from Renn Cupit in Calgary
After discussion, Mr Ferguson moved that Mr Dobler be
given authority to purchase a new box and hoist for the diesel
gravel truck
Council also discussed with Mr Dobler the damage to the gas
truck and Mr Campbell moved that Mr Dobler be given ✓�
authority to purchase a new box and hoist for this unit, if
found necessary

The diesel unit is being taken to Calgary today and the box
and hoist will be installed immediately as Renn Cupit have
one in stock The gas unit will go in Wednesday for frame H
straightening work and a new box and hoist It will still
require further work here when it comes back, but all the
parts are here except for a new door

Mr Jeffery reviewed the report of the Parks Committee Meeting PARK COMM
held July 11th, 1978 at Keiver Lake, on July 11th, 1978 REPORT
After discussion, Mr Ferguson moved to accept the report

There was brief discussion about the need for a trailer dumping
station at Keiver Lake and it was generally this would
be a very expensive undertaking and nothing could be done about
it at this time
Mr Jeffery reviewed the damage which had occured in the office
due to a toilet tank cracking late Friday afternoon Quotes
had been obtained from Traders Furniture in Three Hills
for replacement of the rugs in various areas of the office
Mr Jeffery also noted that Mrs Weigum had spent the best
part of the weekend cleaning up the water, and after brief
discussion, Mr Ferguson moved that Mrs Weigum be given
a $50 00 bonus over and above her normal pay for the hours
spent in cleaning up the water, and thanks for her work
be conveyed to her

A circular has been received from Alberta Municipal Energy Management CONF
Conference regarding a meeting scheduled for October 30th and
31st After discussion, Mr Poole moved to accept and file ✓�

A letter from the City of Drumheller regarding the rural fire
protection agreement was read and it was agreed that Mr
Jeffery should get together with Mr Guidolin and work out
an agreement to cover the fire protection and possibly a mutual
aid agreement and a possible recreation agreement The Orkney
area not being in any rural fire protection area was discussed
Mr Berdahl moved that negotiations be undertaken with the City
with a view to obtaining a fire protection area agreement,
mutual aid agreement and possibly a recreation agreement

A letter from Alberta Research Council regarding proposed
test holes in this area was read The test holes will be
in Township 34, Ranges 22, 23 & 24 After diou,o6ion,
Mr Campbell moved that Alberta Research be advised
they may have a problem with flowing wells in Township 34
Range 22, and further moved to accept and file their
letter as information

Mr Litz noted that Hudson Bay OIl & Gas Company had
requested permission to install a sign and some electrical
equipment at NW 35- 33 -26 -4, within 30 feet of the pavement
and on M D road allowance They had previously obtained
permission to install a trap and fencing, etc , closer than
125 feet from the center line of the road, at this same
location After discussion Mr Ferguson motied that Mr
Litz should inspect the site, and if he feels the s'_gn would
not interfere with the road in any way, the company be
requested to take out a development permit, that Council
would relax the set -back requirements and allow the development
on the road allowance, on condition that the company would be
totally responsible for the development, no liablity would
fall on the M.D. for damage to the sign or for any other reason,
and the company would be responsible for moving the sign

Mr Jeffery noted that Alberta Energy & Natural Resources
had been advised of a complaint received from Mr. William
N Strohschein of Wimborne regarding damage to his tractor
because of a large hole left in the ditch by a seismic VA
crew
After discussion, Mr Campbell moved to accept and file
as information

Mr Jeffery noted that Gale Resources Ltd have completed
their seismic operations in the M D , and Sourcex Geophycial
on behalf of Mobil Oil Ltd , have completed thew seismic
operations
There was brief discussion about completion of the operations
by Quest Mr. Berdahl agreed he would advise the office
if the flags on the Pope Lease Road are not cleaned up soon
Mr Berdahl then moved to accept and file this report

An application for subdivision of SW 7- 32 -23 -4 - 1 mile north of
Three Hills was then discussed The application indicates the
subdivided parcel would be used as a market garden and a tree farm LIA
After discussion, Mr Bauer moved that Council recommend approval
for this subdivision, subject to normal conditions for subdivisions

Mr Jeffery noted that the former Maerz property in Ruarkville
is to be sold and the purchaser has agreed to sign an agreement
whereby he will move the old building which now encroaches on
to the street back on to the property He has signed the VA
agreement and after discussion Mr Litz moved the Reeve and
Municipal Administrator be authorized to sign the agreement
for the M D

The auction sale scheduled for 2 00 today was then declared
open Five people entered the council room Mr Jeffery reviewed
the terms of sale for all parcels and also read out the
terms of the agreement which must be entered into by anyone buying
any of the lots After brief discussion about the size of Lots 41
in Block 3 Swalwell 5050 A K , Mr Jeffery called for bids
for Parcel #1 Block 12 Plan Sunnyslope 771096 2 19 acres

Mrs Gary Peterson then stated she and her husband
would be interested in the purchase of Lots 11 to 26
in Block 7, Swalwell 5050 A K , for a commercial
development and Mrs Roberts asked questions about
other problems in Swalwell and about the tenders for
the sewer project
The parties interested in the sale then left the meeting
There was discussion about disposition of thE: lots which
were not sold It was generally agreed that the people
in Swalwell whose property touches Lots 11 to 26 in Block
7 be contacted to see if they would have any objections
to a commercial development at that location
Mr Poole then moved that those lots not sold at the sale
today would be available for sale as a residential lot
with the building committment at the reserve bid price previously
established, however if no objections are received to a
commercial developement for Lots 11 to 26 In Block 7 Swalwell
5050 A K , these lots be re- offered for sale by public auction
for a commercial development

Mr Dave Regehr recently subdivided the SE 18- 30 -24 -4 and a
condition of the subdivision was that he remove the old
house from the subdivided parcel He had entered into an
agreement with the M D to this effect to have it removed
by September lst, 1978 He now wonders if the M D would
have the crew tear down the old house and charge him for this
work After discussion of this matter, Mr Brown moved
that Mr Regehr must fulfill his agreement with the M D ,
and arrange to have the house removed, as the M D crew
cannot do this work

It was agreed that C R P C be advised that the condition
of subdivision has not been met and to hold off completion
of the subdivision if possible
Council was advised that clear title has been obtained
to Lots 14, 15, 16, 18 & 19 in Block 9 Huxley 6680 A P
and these could now be sold to the Huxley Community
Association as they had requested
After discussion, Mr Ferguson moved that the five lots
be sold to the association at $50 00 a lot

Mr Jeffery then reported on progress being made with
the Swalwell Sewer Project An agreement has been arrived
at with Mr and Mrs Robert Shea for the lagoon site, and
easement required, for a total sum of $15,000 00 After
reviewing terms of the agreement, Mr Berdahl moved to
accept the report and authorize the Reeve and Municipal
Administrator to sign the agreement with Mr and Mrs Shea
on behalf of the M D

Mr Jeffery then reviewed a complaint received from Mr
and Mrs Neil Penner about a tree destroyed by an M D
tractor, and other complaints which Mr Penner has about
work done by the M D He is still not happy with the
condition of the dugout on his property, and wishes a
tree to replace the one destroyed by the M D tractor
After discussion, Mr Campbell moved that Mr Penner be
offered the sum of $70 00 and replacement of a tree of a
similar size, as full compensation and settlement of all
claims which he feels he may have against the M D ,

The complaint received from Mr Herman Clark was then

believes he lost about 50 bales to the acre because of
this, but he would be satisfied with 50 pounds of alfalfa
seed Mr Bitz did not have permission to be on Mr
Clark's land After discussion of this matter, Mr Brown
moved that Mr Clark be cCfa-] $50 00 for this damage,
with this to be accepted as full compensation for all
claims which he feels he may have against the M D

a yield sign be installed at the Schmaltz corner

NW 20- 32 -26 -4 in order to obtain access to the SE 20- 32 -26 -4
Alta Transportation have also authorized the M D to have the
gravel along the boundary of their gravel pit crushed, on condition
the overburden material is preserved for future pit restoration

Mr Tom Lynch then met with Council to discuss a possible
access route through his lease land to reach the Red Deer
River, and a source of gravel at a location near Section 2
in 34 -22 -4 and south in 33 -22 -4
Mr Jeffery reviewed discussions held with Mr Lynch by
Mr Campbell and himself several days ago, during which
Mr Lynch indicated he might consider allowing the access
if the M D would close an old road diversion through
NE 15, SE 22 and SW 23 in 33 -22 -4, and return the land
to the quarters from which it was taken
Mr Lynch then spoke to Council and indicated that he
did not now wish to allow access through his leased
land and the M D could obtain a shorter route through
the Tetz property He had many reasons for not wishing
to open up an access route through this land, including
traffic being hard on the pasture, problems with trespassers,
cutting up his pastures, etc
Mr Lynch indicated he would be willing to go with the
road committee and show them a possible route and after
discussion, Mr Poole moved that the committee meet with
Mr Lynch at some convenient time to have a look for an
alternate route
Mr Lynch then left the meeting
Mr Jeffery then reviewed the other agreements he had
obtained for the proposed access route
It was agreed that this matter be Left until such time
as a meeting is held with Mr Lynch to look for an alternate
route
Mr Jeffery then reviewed the accident with the new gas gravel
truck Bill Little was driving the truck and was going
around a corner spreading gravel, the box swayed and the truck
rolled over The hoist was damaged A new box and hoist will
cost about $4900 00 installed at Renn Cupit in Calgary
It was agreed that the gravel trucks should not be spreading
gravel when travelling around a corner
Mr Poole moved to accept and file the report

The matter of the insurance claim regarding the D Berreth
and Schrieber accident was noted and as the letter from the
insurance adjusters had not arrived, Mr Bauer moved to table
this matter until the next meeting

Canadian Western Natural Gas Company Ltd have written CULVERT
advising they will be installing a permanent access road C W N G
into LSD 10- 22- 29 -22 -4 after harvest this fall, and a culvert 10- 22- 29 -22 -4
will be installed at that location at that time After discussion
and noting the approach is holding back water now, Mr Berdahl L-1

Mr Jeffery then reviewed the minutes from the Shop &
Foremen Committee meeting held July 20th, 1978
Various items were noted including a letter received
by Mr Dennis Berreth regarding the eye requirements
to obtain a #1 driver's licence Neither Mr
Berreth nor Mr Robert Gundlach can obtain a #1
licence because of their eye problems and therefore
cannot be classed as senior drivers
After brief discussion Mr Bauer moved to accept and
file the minutes of the Shop & Foremen Committee Meeting

Mr Jeffery reviewed the progress made to date with
regard to the acquisition of land for the M Anderson
bridge project It may take some time to obtain
approval from the beneficiaries of the A R Fuller
Estate
Mr Paquette reported that the main crew is now working
on the Charlton job in Division 4 The patch crew are
working in Division 7, and the surfacing crew have done
the Grainger Road and about 3/4 of a mile on the Linden road
Three trucks have been hired to work with the chip spreader
Mr Jeffery noted that half of the 1978 road grant from the
province was used on the Correction Line job - approximately
$135,000 00
Mr Dobler reported regarding the work of the gravel crew
They are working now at the Megli Pit He also noted
that to date gravel has been spread as follows
Division 1 12,124 yards
Division 2 13,057 yards
Division 3 15,965 yards

and 10 for corner posts As he had supplied the posts
he should be paid for 120 posts at the price for posts
which the M D would normally use (3 to 4 inch posts)
and be paid for the 10 corner posts, which cost about $2 18 each
A small job had been done for Mr Howe during the work on the
correction line road and he is to be billed for 2 hour work
with the scraper and 2 hour work with the motor grader, total
of $45 20
`Mr Orville Davis had some private work done at the same time
about 22 hours with the cat, and he was to be billed for this
�* However he objected as he had supplied his rock picker for
�rr�r about 2 days on the job and the work was to be done in exchange
for use of his rock picker It was agreed this matter should be
discussed with Mr Dorn on his return from holidays
Mr Poole also noted that the ear the south approach
into the yard of Mr Albert Toews requires cleaning He also

noted the new seed cleaning plant at Beiseker is now under
construction
It was agreed that Hopkins Construction should be contacted
to ensure that the crushing at Lowen and DeBeaudrap stock
piles will be done soon There was discussion regarding
crushing gravel at the pit, but no decision was made
Mr Litz noted that Czar Resources have requested gravel
on approximately 4 mile of road west of 11- 33 -25 -4 and the
road requires some up- grading It was agreed that the M D
could do some work on the road with a motor grader and would
put gravel on the road on condition that the company pay
for the gravel

Mr Litz noted also that the committee looking after the Arthurville ,/1
Cemetery still wish some work done there this fall It will
require a motor scraper
Mr Campbell noted there are rocks which should be picked on the
Frere Road
Mr Dobler mentioned that R Skytt had asked him for gravel
recently and stated that Mr Berdahl had promised him about
two loads of gravel for his yard as he had donated land for
the road through Section 36- 27 -20 -4 Mr Dobler noted he
had spread about 56 yards of gravel there, but it is creating
a problem with other people in the area requesting gravel
for their yards He felt this type of agreement should be
in writing so he would be aware of what agreement was made
Mr Dobler and Mr Paquette then left the meeting V,
Mr Jeffery reported that Mr Albert Steiner of Fort St John

he was not advised that the house etc had been disposed of,
and wishes the house replaced,otherwise he will have to consult

that the items were disposed of after approval was obtained
from Alberta Municipal Affairs, Mr Bauer moved to accept
and file the report
