COUNCIL MEETING JULY 10th, 1978 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Municipal Office, Three Hills, on Monday, July 10th, 1978, commencing at 9 00 A M Those present were G A Berdahl Division 1 PRESENT C W Poole Division 2 R W Brown Division 3 (Reeve) A W Bauer Division 4 T A Ferguson Division 5 L Litz Division 6 R G Campbell Division 7 J C Jeffery, Municipal Administrator V1 Mrs Jean Wilkinson, Assistant Municipal Administrator was present and recorded the minutes The minutes of the meeting of Council of June reviewed, and Mr Brown noted a correction on Cattle Pass - -- should be NW of 10 instead of There was also discussion regarding the two m in Division 5 omitted from the road program - in 32 -22 -4 and it was also noted on page 11 item # 1 should read East of 22- 28 -22 -4 - not APPROVAL MINUTES 26th were briefly page 11; - re Megli NE of 10 iles of road V4 West of 5 & 8 - Division 1 E of 24 Mr Berdahl then moved approval of the minutes subject to the above noted corrections and inclusion of the road project n in Division 5 2 miles West of 5 & 8 in 32 -22 -4 as project number 7A for the main crew -(see page 9) Carried There was brief discussion regarding the average spacing of secondary roads in the province, and the need for paving the access road into Linden from Highway #21 There was also discussion about the paving program for 1978 and it was generally agreed that the paving crew should now be working H MARTENS COMM Mr Jeffery noted that Herman Martens had completed a correspondence COURSE course through the University of Alberta on municipal communications The tutition fee for the course was $110 00 After discussion of VIA M D policy and noting Mr Martens passed the course with a mark of 78 4 %, Mr Ferguson moved Mr Martens be paid $110 00 reimbursement �1 for the tutition fee Carried CANCELLATION Approval has now been received from Alberta Municipal Affairs TAXES for the M D to obtain clear title to Lots 14, 15, 16, 18 & 19 LOTS IN in Block 9, Huxley After applying the purchase price of the BLK 9, HUXLEY �! lots to the unpaid taxes, there are taxes still owing as follows Lots 14 & 15 unpaid taxes $519 71 j L P 4 200 00 ess rice $ Owing. $319 71 Q � Lot 16 unpaid taxes $259 90 419'* 61 less price $100 00�' Owing $159 90 Lot 18 & 19 unpaid taxes $209 29 less price $200 00 Owing. $9 29 M... D....�- the unpaid taxes still owing as noted above be Carried 2 ko COUNCIL MEETING JULY 10th 1978 P 2 Mr Jeffery then reviewed the request for replot of Block 10 in Huxley and designation as park reserve After discussion of this matter, and reviewing the need for the replot at this time, Mr Brown moved that the request be denied at this time, due to the costs involved Carried Mr Jeffery reported that a letter had been sent to a Mr Ronald Dixon of Torrington about garbage dumped on a municipal road recently After brief discussion, Mr Ferguson moved to accept and file the report Carried REQUEST FOR REPLOT BLOCK 10 ,^ HUXLEY Alberta Environment have forwarded a brochure entitled "Bury - Don't Burn' dealing with management of a refuse disposal site f Mr Campbell moved to accept and file Carried GARBAGE DUMPED ON ROAD RONALD DIXON TORRINGTON BROCHURE MANAGEMENT OF DISPOSAL SITE The 1977 annual report from the Drumheller Health Unit has 1977 been received Mr Berdahl commented on one or two items ANNUAL REPORT Mr Litz moved to accept and file the report `� HEALTH Carried UNIT The minutes of a meeting of the Regional Resources Project held June 20th were briefly reviewed Mr Poole moved to accept REG RES and file as information PROJECT Carried 0 MINUTES Alberta Municipal Affairs have advised that oil well drilling OIL DRILL tax will soon be converted to metric rates RATES TO Mr Ferguson moved to accept and file METRIC Carried Mrs Royden Kennedy of Huxley has advised the office that it is not their intention to hook up to the sewer in Huxley and she does not intend to pay the frontage tax levied against her property - West Part of Block A in Huxley After reviewing the matter with Mr Cunningham, and determining that the property was not included in the advertisement for the by -law, Mr Cunningham recommended that the frontage tax be cancelled for 1977, and further recommended that Ishould a request ever be received for sewer hookup, i all back frontage tax must be paid prior to any sewer hookup After discussion, Mr Campbell moved that the 1977 frontage tax be cancelled and Mrs Kennedy be advised that should sewer hookup be requested at any time in future, all back frontage tax must be paid prior to any hook up being made Carried FRONTAGE TAX ROYDEN KENNEDY HUXLEY W 0 Minutes of a meeting June 12th 1978 of the Carbon & District CARBON REC Recreation Board were briefly reviewed Mr Berdahl moved to BD accept and file ✓i MINUTES Carried Mr Ben Maerz has advised the office that the Maerz family MAERZ do not wish to transfer title of the cemetery to the M D CEMETERY nor transfer control of the records, but would like the M D to maintain the cemetery After discussion of the matter and noting that the title to the cemetery is in the name of 3 people who are all dead, Mr Ferguson moved that the M D will maintain the cemetery this year, but the Maerz family be advised that !! maintenance will not be done at the cemetery after this year, until such time as they have the title to the cemetery put in order, and they are in position to give the M D a proper letter of authority to enter the cemetery and that this apply to all other cemeteries which are in the same type of situation, where the owners of the cemetery are no longer living Carried ,ems( COUNCIL MEETING JULY 10th, 1978 P 3 Mr Berdahl requested he be recorded as opposed to the moti Six in favour - 1 opposed Calgary Power Ltd have forwarded plans for power line extensions -- --- - - - - -- to the Acme Golf Club NW 20- 29 -25 -4 After reviewing same, ACME GOLF Mr Brown moved approval of the plans as submitted CLUB Carried Mr Berdahl reported he had looked at the beaver dam at the bridge south of the north east corner of SE 24- 30 -23 -4 LA Mr Ferguson also noted he had looked at it as well Both felt there was no visable damage to the bridge or the banks however Mr Gundlach felt that damage might be caused if the beavers are left there There is about 3 feet of water backed up now Mr Ferguson moved to accept and file the report and recommended nothing be done about moving the beavers at this time, unless it appears a problem is developing Carried BEAVER DAM SE 24- 30 -23 -4 Building permits issued to- BUILDING ' Robert Friesen - Pt NW 36- 32 -27 -4 Hog Barn c/I PERMITS Raymond Johnson - Lot 1 in Block 4 Plan 7810405 Single Family Prin Residence were reviewed Mr Jeffery then reviewed a complaint received from Mr Gary COMPLAINT II Peterson of Swalwell regarding the need for development permits GARY and no follow up on the buildings after receipt of the PETERSEN i development permit After discussion of the matter and noting SWALWELL the M D should have a building inspector, Mr Bauer moved approval of the building permits as issued Carried No decision was made regarding the need for a building inspector V1 Mr Jeffery advised Council that Mr Bruce Hastie wishes to BRUCE i meet with Council regarding installation of a power line HASTIE a two feet on municipal road allowance He requires a new POWER LINE line run in to his property NE 25- 33 -25 -4 in order to service EXTENSION his feed lot set up and he cannot obtain consent of the ON ROAD land owners along the 2i miles as to the location of the line ALTA POWER Mr Hastie then entered the meeting, and reviewed with Council his problems in obtaining power service It was noted that at this time it does not appear likely that I the road will be up- graded as there are no people living along V% the road now After further discussion Mr Ferguson moved s that the M D would have no objection to the installation d of the power poles two feet on the municipal road allowance on condition that the company would be responsible for moving ! the poles if the M D required them moved for any reason Carried Mr Hastie then left the meeting Portions of the minutes of C R P C meetings of May 5th and MINUTES May 20th were reviewed and Mr Poole moved to accept and file C R P C as information Carried The decision of C R P C regarding the Hope subdivision in SUBDIVISION NW 7- 30 -26 -4 was briefly reviewed and Mr Brown moved to NW 7- 30 -26 -4 accept and file same as information Carried i 1 A G T have advised that the 1978 rates for moving telephone RATES FOR lines has been revised to a flat rate of $750 00 a mile with MOVING some exceptions V11 TELEPHONE After brief discussion, Mr Bauer moved to accept and file as LINES information Carried Mr Berdahl reported he had looked at the beaver dam at the bridge south of the north east corner of SE 24- 30 -23 -4 LA Mr Ferguson also noted he had looked at it as well Both felt there was no visable damage to the bridge or the banks however Mr Gundlach felt that damage might be caused if the beavers are left there There is about 3 feet of water backed up now Mr Ferguson moved to accept and file the report and recommended nothing be done about moving the beavers at this time, unless it appears a problem is developing Carried BEAVER DAM SE 24- 30 -23 -4 u 1 El s 3 COUNCIL MEETING JULY 10th, 1978 Mr Cunningham had inspected the temporary road approach installed 12 miles east of the Carbon Cemetery The well is not in production yet, and if it goes into production the company will apply for a road approach at that time Apparently it is their practice to install only a temporary approach initally until they see the well will produce Mr Cunningham had also inspected the oil well trap near SE 30- 29 -23 -4 and determined that it is located about 100 feet from the center of the original road allowance and 100 feet from Secondary 575 It was not possible due to the location of the two roads to place it 125 feet from the center line of both the roads After discussion it was generally agreed that permission should be obtained from Council for all approaches temporary or permanent Mr Poole moved that a letter be sent to all oil companies in this area advising them of M D policy regarding road approaches Carried has a radio which he purchased A report has been received that vandalism is occuring AMA CAMP at the AMA Camp at Keiver's Lake The committee would VANDALISM like M D permission to erect a steel gate at the top RADIO FOR cf the hill The old gate was installed at the bottom the rescue unit, for $450 00 of the hill out of sight and vandals have completely destroyed ``SALE ,n Avlsfci it Mr Bauer moved that the M D The gate would close off an existing road allowance, but ��� the three land owners concerned are given keys to the gate h After discussion, Mr Litz moved that approval be given - 4et-6p to the AMA to install the gate at the top of the hill rescue unit Carried It was generally agreed that a sign should be erected Carried showing that the road is not a through road Mr Cunningham has a radio which he purchased from Pye ALEX CUNNINGHAM Electronics and which he would be willing to sell to the RADIO FOR M D for use in the rescue unit, for $450 00 ``SALE ,n Avlsfci After discussion Mr Bauer moved that the M D purchase ��� the radio from Mr Cunningham for $450 00 and the radio - 4et-6p be used in the rescue unit Carried Mr Ralph Loosmore has submitted an account of approximately ACCOUNT $100 00 to $150 00 for rebuilding his corral The corral R LOOSMORE was torn down during road construction CORRAL RE- After brief discussion, it was agreed to leave this matter 0 BUILDING and discuss same with Mr Paquette later Raven Construction Ltd have completed the road COMPLETION into the Wimborne Gas Plant and have submitted their WIMBORNE GAS PLANT account for $212,478 00 After discussion about any hold ROAD RAVEN CONS. back, Mr Litz moved that the account as submitted be paid Carried Mr Dan Dole has complained about dogs running loose in DOGS IN and around Allingham and chasing his cattle After discussion ALLINGHAM and noting the R C M P had been contacted, Mr Campbell moved that no action be taken in this matter by the M D Carried &Je z �1 E �e 3 COUNCIL MEETING JULY 10th, 1978 The meeting adjourned for dinner between 12.00 Noon and 1.00 P M Mr Jeffery advised Council that problems are arising at Keiver's Lake and a parks committee meeting should be held to discuss same It was agreed a parks committee meeting be held Tuesday, July 11th, 1978, commencing at 8 00 P M at the lake A letter has been received from Alberta Local Authorities Board concerning proposed annexation to the Village of Torrington The area proposed for annexation was reviewed by Council The Board will advise later if a public hearing is to be held Mr Litz moved to accept and file as information Carried Alberta Hospitals & Medical Care have written advising that their department is considering the proposed split in the Mountain View Kneehill Auxiliary Hospital and V. LOOSMORE re- building his corral was then discussed with Mr Paquette ACCOUNT FCR An agreement had been made with Mr Loosmore at the time CORRAL of the road work that the M D would assist him in the re- building if he wished it rebuilt Mr Ferguson moved that Mr Loosmore be paid $125 00 towards the costs of rebuilding his corral Carried The matter of private roads in the M D and the policy regarding POLICY RE: maintenance of these roads and gravelling same was then discussed, PRIVATE and the location of some of these types of roads was also reviewed ROADS The cost of construction of an alternate route in some locations would be quite high, and it was generally agreed each road must �PCOS` °o be considered individually Mr Poole moved to accept and file N° the report, and no policy regarding private roads be established at this time Carried Andex Oil had been requested to install a culvert at their road CULVERT approach- NW 26- 29 -24 -4 and they have contacted the office ANDEX planned seismic GALE RES program in this area was delayed and will now be carried SEISMIC out during the period July 11th to July 13th PROGRAM Mr Bauer moved to accept and file as information Carried A complaint regarding damage to the ditch south of 14- 30 -24 -4 DAMAGE TO was referred to Andex Oil and they agreed to level the DITCH ditch and re -seed it back to grass Mr Paget was advised ✓, S of 14 -30 -24 of this Mr Bauer moved to accept and file as information Mrs D Charlebois and her son, Robert have agreed to CHARLEBOIS the terms for providing road access for Mr Jack Barnes ROAD ACCESS to reach his land through NE 24- 29 -23 -4 A/G Mr Berdahl moved to accept the report as information Carried The need for a culvert at road approach LSD 7- 23- 28 -21 -4 CULVERT was referred to PanCanadian Petroleum Ltd , and they AT LSD 7-23 - have agreed to look into the matter 28 -21 -4 Mr Litz moved to accept and file as information Carried A copy of a letter from Alta Transportation to the STREET Town of Three Hills regarding lights at intersection LIGHTING of #21 and SR 583 was read Mr Ferguson moved to accept and file as information AT & SR Carried 5883 3 Mr Poole reported on his recent meeting with Mr A Penner PROBLEMS WITH of Swalwell regarding his complaints about lack of black A PENNER dirt on his land SW 15- 30 -24 -4, which he says was removed SW 15- 30 -24 -4 during construction of the Swalwell access road Mr Penner had not cashed the cheque forwarded to him in payment for the 1 acre of land taken for the road widening The cheque is now stale dated and was returned by Mr Penner to Mr Poole Mr Penner feels the top soil which was stock piled at the commencement of the project was used to fill the snake pits and not spread back over his land as it was supposed to be He wishes the black dirt replaced or $500 00 compensation He mentioned 3 acres of land but it was noted that the M D had purchased 1 acre from him, so only 2 acres might be involved Mr Penner also feels that he was promised title to the 2 acre former gravel pit area by former councillors of the M D Mr Poole noted he had subject to approval of Council, offered Mr Penner $250 00 �1 compensation, but he refused After discussion, Mr Ferguson moved that Mr Penner be advised the M D will replace black soil on his land with a motor grader from the 1 acre of land taken for road widening by the M D , on condition that Mr Penner give written permission for the M D to go on his property for this purpose Carried Mr Penner had also mentioned that a road approach had been taken out during the road construction and not replaced The request from Czar Resources for gravel on the road West of CZAR RES. 11- 22 -15 -4 was tabled pending more information GRAVEL REQUEST The agreement for gravel lease reached with Mr Harvey Schmautz was reviewed Mr Campbell moved approval of the agreement GRAVEL and authorization for the Reeve and Municipal Administrator LEASE H to sign the agreement on behalf of the M.D. SCHMAUTZ Carried It was agreed that testing should be done on the land this week 4W COUNCIL MEETING JULY 10th, 1978 P Applications for work received from Randy Weir, Rodney Pag Ron Veres and Greg Anhorn were reviewed and Mr Poole me these be referred to Mr Paquette Carried A copy of a letter from CNR to Railway Transport Commissic was read The letter concerns the proposed reconstruction of the Three Hills underpass After brief discussion, Mr Ferguson moved to accept and f as information Carried The agreement prepared by Mr Tainsh Solicitor regarding the exchange of land with Mr Archie Becker for road acces was then reviewed and Mr Bauer moved to approve the agre and authorize the Reeve and Municipal Administrator to sig the agreement on behalf of the M D Carried It was noted that Mr and Mrs Archie Becker have signed t agreement Mr Jeffery advised that Alta Transportation (Mr McGregor) has reviewed Secondary Road 575 and they feel that the road is not in condition to be paved The road should be reconstructed before paving and consideration is being given to doing this reconstruttio.n this summer However no definite decision has been made as yet Mr Campbell moved to accept and file this report as information Carried Alberta Transportation have forwarded a letter requesting comments from the M D on the usefulness of their road weight guide map which they recently completed After discussion Mr Litz moved that Alta Transportation be advised we do not feel an additional supply of the maps is needed in our office, as we have little call for same Carried Mr Brown has reviewed the burrow pit agreements obtained in connection with the two road projects in his area and payments required should now be made Mr Paquette mentioned that the proposed project for Division 5 - removal of the Y corner at NW 35- 31 -22 -4 would be too big a job for the small crew It would take engineering work, and about 10 days with the main crew After discussion it was generally agreed that this job could not be done this year Mr Paquette noted the main crew will be going to the M Charlton job next in Division 4, and the small crew is working now in Division 5 There was discussion about the South Carbon road and Mr Paquette noted the crew is patching some of the bad holes However the road is in very bad condition Mr Paquette then reviewed the paving program he had drafted for 1978 and after discussion, Mr Bauer moved approval for the program as follows, and the projects to be done in the order as listed 1 Acme East to #21 writte to Alta Transportation for their recommendations about road Mr Brown noted that George Melenchuk had mentioned a pr he has with the road near the Mt Olive School and it was agreed that Mr Bauer and Mr Paquette should con Mr Melenchuk and investigate the problem Various items which need completion on the F Keirle road project in Division 3 were referred to Mr Dorn by Mr Brown Mr Brown also noted that there is an old wooden culvert on the road south of the Acme road which should be replaced, and there is a ditch near Kroschel's - south of Acme going east which needs cleaning out Mr Berdahl noted that the Braunberger washout problem in his area has not been completed and after discussion it was agreed that Oris Rodger could perhaps complete this fob in co- operation with the A S B It was agreed that Mr Paquette should have a look at it and arrange to have the job completed Mr Poole noted he had authorized having the Carbon Shop sign painted and there will be an additional charge for this He also noted the new doors on the north shop are not hanging very well Mr Bauer noted that the main crew could probably do the job on the road allowance next to T Greke's property in Sunnyslope when they are in the area Mr Ferguson noted a culvert is required at the approach on the Buckerfield land SW 36- 31 -23 -4 There was also discussion about the need for a culvert and approach on the former C Thomas quarter which was recently subdivided and it was agreed that installation cf the culvert and approach was the responsibility of the owner as a condition of subdivision Mr Campbell noted he has several culverts which should be installed in his division and requested Oris Rodger do these as soon as possible Mr Poole noted the checker board sign at the Peter Baerg corner - NW corner of NW 9- 30 -24 -4 is down and has been down for some little time It was noted that Mr Duncan has been away from work quite alot lately, partly due to his shoulder injury and partly
