COUNCIL MEETING JUNE 26th, 1978 P 2 The Drumheller Health Unit have written advising that they will increase the rent payable to the M D to the same rate per square foot they are paying to the County of Wheatland The montly rate will be $670 00 After brief discussion of this matter, Mr Campbell moved to accept and file with thanks Carried Mr Litz entered the meeting at this time - 9 45 A M Mr Berdahl noted that the Health Unit is hiring a full time nurse to assist Miss Lamberth in Three Hills Office The Minutes of the recent Three Hills School Division meeting of June 14th were reviewed and Mr Brown reported on various items as he had attended the meeting The Division are committed to the exbhange of land and buildings with the Town of Trochu, and are agreeable to considering our needs for storage for our motor grader when constructing their new shop in Trochu The School Division have accepted a bid from Esso for supply of gasoline Mr Bauer moved to accept and file the report Carried Mr Brown also noted that he had received a complaint about the M D lots in Huxley not being looked after RENT DRUMHELL HEALTH UNIT OFFICES ;,1 A SCH DIV MEETING LI Mr Jeffery advised Council that the lowest gas tender received M D GAS FROM by the M D was from Rollie`s Motor Products in Three Hills at L;, PUMPS TENDERS 69 5(,, for regular and 72 7� for unleaded gas, and the crews have been instructed to purchase gasoline there Minutes of the Ca -rbon & District Recreation Board Meeting of May CARBON & DIS 8th were briefly reviewed and Mr Jeffery read a letter from the V1 REC MINUTES Village of Carbon concerning their 1977 financial statement for & FIN STATEMENT recreation After discussion, Mr Poole moved to accept and file Carried' Mr Jeffery reviewed briefly the M D by -law 564 which authorizes DRUM RURAL FIRE the Drumheller Rural Fire Protection Area However it appears PROT AGREEMENT that there is no existing agreement with the City of Drumheller �A and it was agreed that this must be looked after and an agreement entered into with the City Mr Jeffery then reviewed the 1977 report of fire losses and REPORT 1977 FIRE Alta Labour have requested confirmation from the M D that LOSSES these fires did occur within the M D After discussion, Mr Ferguson moved that Alberta Labour be advised the report of fires in the M D appear to be correct `eX Carried The Agricultural Service Board in conjunction with Unifarm District NOMINATION TO of Kneehill have nominated Mr R W Brown to the Agricultural Hall AG HALL FAME of Fame Mr G G King complied the nomination form and summary VA R W BROWN required After discussion Mr Bauer moved to accept and file the report Carried Alberta Recreation Parks & Wildlife have written advising that BEAVER CONTROL it would not be practical for their office to refer all complaints PROGRAM received about beavers in this area to our office for investigation prior to doing anything about the complaint and to use local trappers in connection with the proposed Beaver Control Program Mr Jeffery noted that Mr G-,undlach has reported a beaver problem at the bridge at the north east corner of SE 24- 30 -23 -4 The beavers are building a dam here and the water backed up is softening the banks Mr Poole moved that Mr Berdahl investigate the problem and report back to Council at the next meeting Carried Mr Berdahl moved that the M D not participate in the proposed Beaver Control Program arranged by Alberta Agriculture and Alta Wildlife Carried MOSQUITO Alberta Environment have a mosquito abatement program set up for 1978 f ABATEMENT After brief discussion, Mr Ferguson moved to accept and file as information PROGRAM Carried 3 ,r E01 LJ E* K� COUNCIL MEETING JUNE 26th, 1978 P 3 Alberta Agriculture have forwarded information regarding changes to the Seed Cleaning Plant Program Mr Campbell moved to accept and file as information Carried AAMD & C have forwarded a circular regarding a sale on attache cases Mr Berdahl moved to accept and file as information Carried Building permits issued to- Elmer Kesterke , Trochu SE 19- 33 -24 -4 3 car private garage Ken Reimer, Linden, SE 35- 30 -25 -4 barn E R Wacker Swalwell SW 17- 30 -24 -4 two storage sheds Clearvalley Farms, Three Hills NE 22- 32 -24 -4 - SUBDIVISION F E Cullum SW 15- 31 -23 -4 and H E Bayes SE 21- 32 -25 -4 DECISIONS were discussed L/A Mr Ferguson moved to accept and file same as information Carried A letter from Mr John Ibbotson of Three Hills requesting Council's consideration of purchase of property from him for a lane to the south of his property NZ 7 Block 4 Plan Grantville 4617 F N to provide access for Mr Oris Rodger was discussed Mr Poole moved that Mr Ibbotson be advised Council would not be agreeable to the purchase of land for establishment of a lane Carried The Swalwell replot for narrowing Queen's Street was then reviewed The survey plans are now in the Land Titles Office, but it appears that the survey cannot be registered until such time as Alberta � Transportation approve the by -law for closing of the 10 foot portion of the street It also appears that the by -law 835 originally passed by Council has an error in the land description After discussion of this matter, Mr Poole moved first reading to by -law number 859, this being a by -law to narrow Oueen's Street from 66 feet down to 56 feet from Railway Avenue west to the westerly side of Block 5 Mr Litz moved second reading to by -law 859 JOHN IBBOTSON REOUEST FOR ' LANE GRANTVILL] REPORT RE NARROWING QUEEN'S STREET SWALWELL BY -LAW 859 Carried Unanimously V1 Carried Unanimously The by -law is now to be advertised and a public hearing held to allow anyone to object to the closure prior to third reading been given to the by -law Mr Jeffery reported to Council regarding a move made by Ronco Trucking RONCO TRUCKING of Medicine Hat They moved Precision Rig # 9 to LSD 11- 22- 29 -25 -4 MOVE WITHOUT over a restricted bridge and on light coat surfaced road without any PERMITS permission from our office After discussion Mr Brown moved to accept L' and file the report as information Carried A complaint has been received from Mr Norman Koch regarding seismic GALE RESOURCES operations carried on by Gale Resources near his property N? 20- 33 -23 -4 COMPLAINT They left the flags and ribbons in the ditches and a mound of mud over each hole Mr Koch cannot hay the ditches until this has been rectified Alberta Energy & Natural Resources has been notified and a copy of the letter sent to Gale Resources Ltd Mr Litz moved to accept and file the report Carried The damage to the guard rails on the hill south of the Carbon Cemetery DAMAGE TO GUAR has been repaired and an account sent to the owner of the truck involved RAILS Mr Earl Poffenroth Mr Campbell moved to accept the report as information REPAI1W Carried 4 ^ s r I s .0 Er L 2 COUNCIL MEETING JUNE 26th, 1978 P 4 Alberta Research Council have advised that they will be drilling three testholes in our area during the month of August ." ALTA RESEARCH The office will be advised completion of the drilling of the location= COAL TEST Ion for inspection purposes HOLES After discussion, Mr Berdahl moved that Alberta Research be requested to advise us of the location of the test holes prior to drilling and also requested to check the holes for a possible source of gravel and if any shows up to advise us Carried Council was advised that Lead Exploration of Calgary was LEAD EXPLORATION doing seismic work on Highway 27 west and on the municipal SEISMIC WORK road east ' Mr Bauer moved to accept and file as information Carried A letter from Mr G Taylor regarding the new streets assistance program NEW STREETS was referred to Council and Mr Ferguson moved to accept and file as ASSISTANCE information PROGRAM Carried Mr Soder requested Council to review the purposes for the soap hole project on the SE 27- 33 -24 -4 as outlined by Dr Toth PURPOSES FOR in his letter of February 17th, 1978 SOAP HOLE The project was discussed and Mr Campbell noted that the test holes PROJECT drilled there are flowing and the water is running down onto other lA lands and may create a problem Mr Bauer moved to accept and file the report as information Carried Mrs Pearl Lammle of Three Hills has requested Council to consider CANCELLATION cancellation of an old road diversion in NW 31- 30 -23 -4 as shown on OLD ROAD Road Plan 6052 Q as she would like the land consolidated back. into 0 DIVERSION title with the balance of her land NW 31- 30 -23 -4 After discussion, Mr Poole moved that Council request cancellation of the said road diversion from Alberta Transportation and the land be consolidated back into title with the quarter section from which it came Carried Mr Jeffery then reviewed matters concerning the establishment of the CARBON Carbon Rural Fire Protection Area and the petition received requesting RURAL FIRE same, and the work done to date in order to hold the vote AREA There are 230 people eligible to vote in the proposed area and only 112 of the 127 people who signed the petition are eligible to vote VOTE Mr Jeffery noted he has tentatively rented the Hesketh Hall for a polling station but the Community Center in Carbon will not be available It was generally J agreed that the M D Shop in Carbon could be used as a polling station Mr Jeffery also noted that under the Municipal Government Act he must act on a petition within 4 weeks of receipt of same As the Capital will be closed for two weeks in July, it will not be possible to advertise the by -law in the paper until July 19th which is more than 4 weeks after receipt of the petition He has written to Municipal Affairs requesting a ministerial order allowing for the delay There will be no voter's list, each person will be required to swear that he or she is eligible to vote After further discussion Mr Poole moved that J C Jeffery be appointed as Returning Officer for the vote Carried It was agreed and Mr Ferguson moved that the rate of pay for the Deputy Returning Officers and Poll Clerks be set at $57 00 per day Carried Mr Poole moved that the Vote be held on Friday, August IItU 1978, and the hours of polling be between 10 BY -LAW 0 I N, v COUNCIL MEETING JUNE 26th, 1978 Mr Poole moved second reading to by -law 860 P 5 Carried Unar The meeting then adjourned for dinner between 12 00 Noon and 1 00 P r Mr Jeffery then reported to Council regarding the recent Alberta Disaster Services Course he attended June 20 to 22nd in Edmonton He felt the course was very worthwhile and outlined various matters which were covered by the course Only a reeve deputy reeve or councillor (if the reeve is not available) are authcrized to declare a state of emergency After discussion, Mr Campbell moved to accept and file as information Carried Alberta Transportation have forwarded by -law 829 duly approved for clo ure ofl a����ortion of the Road Widening as shown on Plan 2611 J K and�pproceedmwith the sale of the parcel to Leo Lavoie after giving third reading to the by -law Mr Brown moved third reading to by -law 829 Carried Mr Jeffery reviewed the parcels which have been advertised for sale in Swalwell, Sunnyslope and Ruarkville He noted the surveyors have now staked the lots and it was agreed that Mr Jeffery and Mr Poole should now inspect the lots in Swalwell and determine f" reserve bids, etc for these After further discussion regarding the auction sale, terms of sale, etc , Mr Litz moved to accept and file the report as information Carried ALTA DIS COURSE A BY -LAW 829 CLOSE PT ROAD BIRCHAM AUCTION SALE LOTS v Mr Don Reynierse of C R P C entered the meeting to discuss with D REYNIERSE Council the need for a restrictive covenant on the lots involved SWALWELL REPLOT with the replot for narrowing Queen's Street in Swalwell NARROW OUEEN'S Mr Reynierse left the restrictive covenants with the office and STREET the owners must be contacted to sign the agreements Mr Reynierse then left the meeting Mr Joe Dobler entered the meeting at this time Mr T C Paquette entered the meeting Council then reviewed and discussed the problems which had arisen because of Quest Exploration and their seismic work in the area PROBLEM WITH QUEST Mr Don Rees of Alberta Energy & Natural Resources entered the meeting EXPLORATION Mr Alex Cunningham Utility Officer for the M D , Mr Guy Yuzapici and Mr Jim Mercier of Quest Exploration also entered Mr Brown introduced the members of Council and Mr Yuzapici spoke to the meeting He felt that Mr Murphy Assistant Party Chief and Mr Mercier Party Chief had made an attempt to contact the M D r' However he did admit that some damage had occured to the roads and that there was no excuse for the trucks blocking traffic as they had Mr Brown asked why the crews had continued to drill on the shoulder of the road after they had been advised they must not do this9 Mrs Wilkinson then reviewed what had taken place in the office and the attempts made through the office, through the R C M P, at both Beiseker and Drumheller, through Alberta Energy & Natural Resources and through personal contact with Mr Murphy and Mr Mercier to stop the crews from damaging our roads and blocking traffic Mr Brown also noted that the crews were planning on shooting test holes much too close to a water well near Acme and also too close to the Village of Acme water well Mr Berdahl noted that a very large hole had been left at one location presumably from the dynamite going off at the surface of the hole, and it had been necessary for the M D to take a load of dirt to this location, fill the hole and level it with a grader in order to prevent a possible accident Mr Yuzapici stated that Quest Exploration have always attempted to co- operate with the people of any area Mr Rees noted that Ouest has in the past co- operated well with his department and he has not experienced so many problems with one company in his experience over the years It was noted that Quest had cut an A G.T. cable in the Carbon area which caused inconvenience to the people of that area for 2 days, and the cable location had been flagged Mr Cunningham noted that when Quest was shut down the drilling trucks were still drilling right in the shoulder of the road There are flags and wires left in the ditches There was discussion regarding holes that are loaded with M N C7 in COUNCIL MEETING JUNE 26th, 1978 P 6 dynamite and will not be exploded Mr Rees noted that Quest had been instructed by Alta Energy & Natural Resources to pull the lead wires and seal these holes up It is impossible to retrieve the dynamite Many other items were discussed with Mr Yuzapici including their reason for drilling on the shoulder of the road when the regulations state they must be 5 feet from the toe of the ditch, the method of paying the drilling companies, which are sub - contractors for Quest, the experience Quest has had with the sub - contractors previously, and who is responsible to see the drillers are doing the job properly Mr Yuzapici indicated that it was Mr Murphy's job to see the drillers were doing the job properly Mr Brown noted that the damage to our light coat surface road is an expensive claim and someone must pay for the damages Mr Yuzapici noted he had driven the Secondary Road from 421 west to Acme and noted some damaged and he was advised the major damage on this road was from #21 east Mr Mercier noted that they drilled 12 holes per mile Mr. Poole end Mr Berdahl noted they counted 25 holes per mile on one stretch of road Mr Mercier noted that they are 50% completed with the drilling and about 1 /3rd done with the recording crews He noted that Quest is doing the seismic work for Norcen Energy Resources Ltd It was generally agreed that a map should be supplied to the M D showing the actual roads which the company will be doing work on, prior to commencement of operations so the M D could indicate to the company any sensitive areas which they should avoid The damages caused and assessment of amount was then discussed Mr Rees suggested that a crew should go back and check each hole and make sure there is a tag on each hole as required by the regulations There was about 35 miles on Secondary 575 which was worked on and the majority of the damaged occured on this road Mr Yuzapici stated he would have two men drive the area and ensure that no large holes were left and inspect the area for damages and it was agreed that Mr Cunningham should accompany them Mr Brown noted that Council will wish some assurance that this type of operation and damages will not occur again Mr Rees noted that Quest has been given to understand that should this situation occur again they will be shut down permanently Mr Yuzapici and Mr Mercier then left the meeting Mr Rees suggested that the M D should have their engineers inspect the Secondary Road to assess the damages done He also noted that his department holds the company responsible for the holes on a continuing basis After further discussion of the situation, Mr Ferguson moved that Quest Exploration be requested to deliver to our office a certified cheque for $10,000 00 as a partial payment on account of damages to be assessed against the company for damages done and damages which may occur, that they agree to notify our office each day of their area of operations for the next day, that they agree to abide by the geophysical regulations established by the provincial government, and that an assessment of the damages will be made by.our office on completion of their proj ect and payme Off NAY dk"%'t%"6V made at that time, that payment for the damages in no way releases the company from claims for any damages which may arise in future because of their seismic operations, and that Quest Exploration will notify our office in writing of their acceptance of our terms, and on receipt of such letter and certified cheque the M D will permit Quest Exploration to commence their seismic operations in the M D of Kneehill X648 again Carried Mr Yuzapici and Mr Mercier came back in to the meeting and were advised of the decision of Council After brief discussion of matters The company struck a flowing well and left the h -ie nnnn Mr Rees agreed to check the matter out nd Mr Cunningham then left the meeting 0 A 1 COUNCIL MEETING JUNE 26th, 197 Tenders received for painting the Carbon and Acme Shops wet considered as follows- Hannah Contracting Ltd , Box 1473, Edmonton, Alberta $7 Britannia Painting & Decorating, Box 37, Acme, Alta $199C Mr Ferguson moved that the low bid of $1990 00 from Britannia Painting & Decorating be accepted Carried A G T had advised that they will be installing buried cable west and south of 2 29 -25 -4 Mr Brown moved that Council advise A G T they have no objections and no road construction is planned for this area Carried AESL have forwarded plans for road crossings for the Crossroads Gas Co -Op between NW 35 -and NE 34 in 33 -23 -4 and between NW 34 33 -23 -4 and SW 3- 34 -23 -4 Mr Cunningham has checked the area and has no objections Mr Campbell moved approval of the road crossings as per plans submitted subject to compliance with municipal regulations Carried Canadian Western Natural Gas Company have requested permission to construct 1882 feet of road on road allowance east of SE 7- 29 -22 -4 Mr Berdahl moved approval subject to the road being constructed to M D standards Carried Mr Bauer reported that he and Mr Paquette had investigated certain areas for a source of gravel - on the Hutterite lands Harvey Schmautz' land and M Charleton's land They felt the best possible source would be on land owned by Mr Schmautz - SW 20- 32 -26 -4 After discussion regarding access to the site, amount of royalty to be paid and various other matters, Mr Ferguson moved that a lease be drafted for at least a two year term, royalty to be paid at 25�, a cubic yard and Mr Bauer be authorized to continue negotiations with Mr Schmautz for the best possible lease Carried Council then reviewed the revised crushed gravel price and pit run price list It was noted that if 25G a yard is paid for royalties to Mr Schmautz then all royalties will have to be increased accordingly After discussion, Mr Litz moved that all the crushed gravel prices including the crushed gravel at pit locations be increased 5� per yard plus the new hauling rates for 1978, and the pit run gravel price be increased by 5� a yard, at all locations Carried K 0 P V^ Council then considered the rates for private work with motor graders The lowest government rate for our graders is $30 20 and the highest is $42 30 After discussion, Mr Poole moved that the rate for doing private work with a motor grader be set at $35 00 an hour and with a minimum charge of $7 00 Carried Alberta Transportation has forwarded a letter stating that $10,000 00 has been alloted by the government towards the necessary corrective work required on the 2 mile stretch of Secondary Road 806 north of Acme After discussion, Mr Poole moved that Alberta Transportation be advised that the work on the portion of road will not be undertaken this year as the road needs time to dry out and Council will consider a possible patch job on the 2 mile stretch later this year Carried Mr Jeffery reviewed the road committee report of June 16th 1978 Mr Campbell Mr Berdahl, Mr Jeffery and Mr Dorn inspected the area near NE 34- 33 -22 -4 with a view to the best access route out from the river It appears that there is a feasible route and Mr Dorn felt it would require about 8 days work with the cats and scrapers to construct a reasonable road.
