Gieck & Brost access problems s , i 1 4 3 r [7 E 17!j COUNCIL MEETING JUNE 12th, 1978 A regular meeting of the Council of the Municipal District of Kneel beld in the Municipal Office, Three Hills, on Monday,June 12th, 191 at 9 00 A M Those present were G A Berdahl C W Poole R W Brown A W Bauer T A Ferguson L Litz R G Campbell Division 1 PRESENT Division 2 Division 3 (Reeve) Division 4 Division 5 Division 6 Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Municipal Admini— __)r was present also and recorded the minutes A letter of thanks from Clark Swanby & Company Ltd , was read to the meeting CLARK SWANBY THANKS Mr Ferguson moved to accept and file Carried `/I The bids for purchase of the electric typewriter were opened and considered, as follows Peter Spilchen $80 00 ELECTRIC G G King $25 00 TYPEWRITER BIDS Mr Poole moved that the typewriter be sold to Peter Spilchen for the V11 high bid of $80 00 Carried Mr Jeffery reviewed the 1977 financial statement for the Carbon and CARBON REC BD District Recreation Board, as it appeared on the Village of Carbon FINANCIAL 1977 financial statement V% STATEMENT After discussion, Mr Berdahl moved to accept and file the statement Carried Mr Henry Dick of the Kneehill Ambulance Service has advised that LINDEN RURAI FIRE the Ambulance Committee have authorized the purchase of a washer CONTRIBUTION TO for use in washing the ambulance He wondered if the Linden Rural Fire Department would be interested in contributing $100 00 WASHER_ towards the purchase so it could be used for washing the fire truck as well Hfter discussion, Mr Campbell moved that the M D of Kneehill X648 contribute the sum of $100 00 towards the cost of purchasing the washer, and this sum be charged against the Linden Rural Fire Protection Area Carried Alberta Parks & Wildlife have contacted the A S B and advised that A S B BEAVER: there is a good possibility of a beaver problem in this area this year CONTROL PROGRAM The Province has established a beaver control program in co- operation I with the Parks and Wildlife Department and Alberta Agriculture i and will enter into a cost sharing program for beaver control up to a maximum of $6000 00 per municipality They will share costs on a 60 -40% basis The province wish to know if this M D would be interested in participating The A S B had discussed the program and felt possibly should wait to see if a problem did develop in this area However it was noted that the government wish to know now if an area will participate !° in order to set aside funds for the program After lengthy discussion, 0 Mr Campbell moved that the province be notified that the M D of Kneehill will consider entering into the program if the government will agree to the following conditions. (a) Fish and Wildlife office agree to contact our office prior to doing any work in this area (b) The M D will inspect each complaint As it arises to determine if there is really a problem (c) That the Fish and Wildlife agree to use local trappers from our area if the need arises to trap and remove the beaver I Carried ji { L 19 COUNCIL MEETING JUNE 12th, 1978 Mr Soder had requested authorizat a new weed eater for the A S B After discussion, it was generally out the old chain saw to see if it Mr Ferguson moved that the A S B weed eater Lon to purchase a new chain saw and agreed that the shop should check could be repaired be authorized to purchase a new Carried P 2 The matter of fencing off the unused road allowance leading into re 'O r Keiver Lake Park was discussed It appears that Mr Peter Tainsh f had used this road allowance to gain access to some of his land It was agreed that Mr Jeffery check into this matter with Mr Soder and arrange to have a gate installed for Mr Tainsh WEED EATER ETC FOR A S B v1<11 FENCING UNUSED ROAD ALLOWANCE AREA OF KEIVER LAKE PARK An application for subdivision of a 7 acre parcel from SW 26- 30 -24 -4 was SUBDIVISION then discussed There are no existing buildings on the parcel and SW 26- 30 -24 -4 it is not an isolation of existing farmstead V1 After discussion of the subdivision Mr Bauer moved that Council recommend refusal of the subdivision Carried A subdivision of SW 6- 33 -22 -4 to create a 4 13 acre parcel as isolation SUBDIVISION of existing farmstead was then reviewed SW 6- 33 -22 -4 It was noted that the son of the owner of the land lives on the property and wishes to obtain title to the building site as he is making improvements to the residence Mr Campbell moved that Council recommend approval of the subdivision as an isolation of existing farmstead, with other normal conditions of subdivision to apply Carried Mr Max Beam of Grantville had requested a load of gravel on the road in PROBLEMS IN front of his driveway He noted that when the water and sewer line to ,A GRANTVILLE Mr Nick Bobecel's house to the north of his house had been installed MAX BEAM the road was dug up and now he cannot get to his driveway off the road It was agreed that this matter and the matter of signs requested by Mr Beam on a road in Grantville be looked at on road tour tomorrow Mr Poole moved that the Council meeting do now adjourn and sit as a ADJOURN TO Development Appeal Board HEAR DEV Carried APPEAL Time - 10 15 A M Mr Bauer moved that Council do now reconvene, the development appeal RECONVENE having been heard Carried Alberta Power Ltd have submitted plans for line extension to NE 25- 33 -25 -4 EXTENSION for a commercial service After reviewing the plans, Mr Ferguson moved VA POWER LINES approval of the line extension as per plans submitted NE 25- 33 -25 -4 Carried The matter of the request from Czar Resources for gravel on a road !' west of 11- 33 -25 -4 was briefly reviewed, and Mr Campbell moved that the request be tabled pending receipt of more information Carried I The problems being created by ?? Quest,lO ation Ltd during their seismic operations in Townships 29, 30 and .4,]in Ranges 21 to 26 were then discussed Mr Berdahl noted that they were drilling shot holes right on the top of the shoulder of the road and were parking their vehicles right across the roads, creating traffic hazards They are also stringing out cable and the same was left over the weekend There is no report yet from the R C M P regarding the traffic hazards and it was agreed that the R C M P be contacted again, that Alberta Energy and Natural Resources be contacted and also the company if necessary to stop the damage to our I roads GRAVEL ROAD WEST OF 11- 33 -25 -4 PROBLEMS WITP QUEST EXPLORATION �Q ix Gh i� q H 1E Eir COUNCIL MEETING JUNE 12th, 1978 P 3 Mr Jeffery then reviewed the accounts and after discussion, Mr Poole moved that the accounts be approved for payment with the exception of cheque 32 040 for $500 00 for the city of Drumheller This account is not our responsibility as the fire was not in the rural fire protection area Carried Mr George Bertram and Mr Terry Reed both of Carbon entered the meeting at this time to discuss the proposed rural fire protection area for the area around the village of Carbon Time - 11.10 A M Mr Reed noted that the petition requesting the M D to establish a rural fire protection area around the Village of Carbon had been circulated by the Carbon Lions Club Mr Jeffery reviewed the procedures which Council could follow if they were in favour of establishment of the fire area Mr Poole and Mr Berdahl noted that some people have asked to have a plebiscite on the matter The petition was circulated throughout the area not now covered by the Drumheller or Linden Rural Fire Departments, with the exception of the Orkney area, and there are 133 signatures on the petition The signatures are all resident land owners of the area, as far as they were aware Mr Bertram noted that the Village of Carbon must make a decision soon about purchasing a fire truck for the village and would like an answer as soon as possible from the M D regarding the establishment of the area and purchase of the truck by the rural area Mr Reed noted they have a quote of $50,790 00 from Superior Fire Equipment in Red Deer for a suitable truck and equipment Mr Bertram noted that the Village would have to have a back- up unit to look after the village during times the rural truck was out of the village There was discussion regarding the ACCOUNTS CARBON RURAL FIRE AREA need for holding a plebiscite, and also the need for an agreement with the Village of Carbon Mr Reed read a letter from the tillage which outlined certain items which would be covered by any agreement, and also reviewed for council some of the specifications of the truck quoted on After further discussion, Mr Poole moved that the matter of establishment of a Carbon Rural Fire Protection Area and purchase of a rural fire truck be referred to the people of the area by way of a plebiscite vote, Carried It was noted that the figures for the money by -law would not exceed the sum of $55,000 00 Mr Brown noted that a child had been bitten by a dog at the Swalwell Dam this past weekend and it was agreed and Mr Poole moved that signs be erected at all municipal parks stating that dogs must be kept on a leash while in the park areas Carried Mr Jeffery noted that Mr B Ardrian of the Three Hills School Division had contacted him regarding the puggestion put forth by Council about sharing building facilities in Three Hills with the School Division Mr Ardian noted that the Board feel they must construct a new shop in Trochu and wonder if the M D would be interested in contributing funds for construction of an extra bay on the shop to provide storage for their motor grader in Trochu After discussion Mr Ferguson moved that the M D. approve in principle making a contribution towards construction of an extra bay for storage of the M D motor grader, should the School Division proceed with construction of a new shop building in Trochu Carried Mr Berdahl requested he be recorded as opposed to the motion All other coucillors were in favour -(eUle G or DOGS ON LEASH IN PARK AREA 3 HILLS SCH DIVISION NEW SHOP BUILDING TROCHU VI L Iqp E ■ COUNCIL MEETING JUNE 12th, 1978 P 4 Mr Jeffery noted that Mr Tony Hopkins of Hopkins Construction had quoted prices for gravel crushing as follows Lowen Pit $2 00 per yard DeBeaudrap stock pile $2 50 per yard PRICE FOR GRAVEL CRUSHING HOPKINS CONSTRUCTION There was discussion about the problem of the crusher kicking off so many of the rocks over 6 inches Mr Dobler noted that the gravel at the Lowen pit is nearly all large rocks and if the crusher kicks these off there will not be much gravel, and the rocks must be crushed or the gravel will not be suitable as it would be too sandy Mr Dobler noted that if the gravel crew continues to work two shifts all summer gravel will be required by September There was discussion about hiring gravel trucks to assist with the gravelling the possibility of discontinuing construction of new roads until the existing roads are put back into shape the possibility of calling for tenders for gravel crushing at all pits now, and various other items Mr Dobler noted that Rockyview has a maximum 59,000 pound load limit on its gravel roads and the center dump trailers cannot be used to haul gravel from McNairs pit without overload permits Mr Jeffery was instructed to contact Rockyvi.ew and attempt to get overload permits for the roads from the McNair pit into the M D Mr Jeffery contacted Hopkins Construction and they advised that the smallest cone crusher they have will crush 8" rocks and they could see no reason why they could not crush the large rocks at the Lowen pit Mr Ferguson moved that Hopkins Construction be authorized to crush the pit run gravel at the DeBeaudrap stock pile and the Lowen pit on condition that all rocks regardless of size are to be crushed Carried Council discussed the many complaints being received about the condition of the M D roads, but no definite decision regarding same was made ` "' ✓1 COMPLAINTS RE M D ROADS Mr Jeffery noted that all the bids for gas from the pumps hay e not GAS FROM PUMPS been received as yet, and this matter is to be left for the time being �� BIDS Mr Brown reported on his recent meeting with Mr Art Becker and Mr Allan Becker regarding access problems to SE 29- 29 -24 -4, and SW 28- 29 -24- BECKER BROST The Beckers have now agreed to exchange a 66 foot strip along the railway ACCESS tracks - about 200 feet long - in exchange for a portion of the PROBLEM original road allowance to the north of the 'A 1- 29 -24 -4, if the M D j is successful in having the road allowance clo ed by the provincial government After discussion of the matter, Mr Bauer moved to accept the report given by Mr Brown Carried Various public work items were discussed with Mr Dorn and Mr Dobler including.gravel for a road approach for Mr Penner west of Swalwell, PUBLIC replacement of an old wooden culvert in the approach to Des Carney's land, �� WORK the request for a load of gravel on the road south of the railway tracks ITEMS at Carbon - nebLr Albert Bramley's location & a few loads of gravel required at the top of t1-5 Orkney Hill There was discussion about hiring 6 or 7 gravel trucks to work with the crew on the light coat surfaced roads this summer, rather than using our own trucks Mr Dobler advised that 4 divisions have each received over 5000 yards of gravel and the crew is working in Division 3 now He also noted that the bridges on the Kneehill Creek are creating a problem because of the load limits imposed on them by the province, and the gravel trucks are having to travel around the bridges or will have to carry smaller loads to get gravel from the Megli Pit and the I Thiessen Pit Mr Berdahl reported that a vehicle had damaged the guard rails on the hill going from the Carbon Cemetery south into the village It was agreed that the name of the driver and insurance company be obtained ✓� from the R C M P so a claim could be put in for costs of repairing the guard rails Mr Jeffery read a letter from the City of Red Deer The city has 100 pieces of guard rail available for sale It was agreed to file this as information VA ACCIDENT HILL NEAR CARBON DAMAGE TO GUARD RAILS quite a number of signs down Mr Dobler was instructed to obtain information for comparison purposes regarding mileage obtained from the diesel trucks as compared to the gas trucks The terms of sale for M D property being advertised for sale were then discussed and it was agreed as follows 1 Block 12, Sunnyslope 771096 - Mr Brown moved terms of sale be Building committment for residence Construction commenced within 12 months Completion within 24 months Reserve Bid $1250 00 Agreement to be entered into by the purchasedr arrie 2 The lots in Huxley were not considered at this time, but will be look( at during the road tour tomorrow 3 Ruarkville - Lot 15 Block 3 Plan 7810405 Mr Ferguson moved terms of sale be Building committment for construction of a new house Construction commenced within 12 months Completion within 24 months Reserve Bid $7000 00 Agreement to be entered into by purchaser Carried 4 Swalwell - Lots 11 to 26 in Block 7 Plan 5050 A K Mr Poole moved terms of sale be. Lots sold as one unit Building committment for residence Construction commenced within 12 months Completion within 24 months Reserve Bid $1000 00 Agreement to be entered into by the purchaser 5 Swalwell - Lots 41 & 42 in Block 3 Plan 5050 A K Mr Campbell moved terms of sale be Lots sold as one building site Building committment for residence Construction commenced within 12 months Completion within 24 months VA Reserve Bid $500 00 Agreement to be entered into by the purchaser 6 Swalwell - Lots 2, 3, 4 & 5 in Block 10 Plan Swalwell Replot After discussion about these lots and noting there is a coulee running through at least 2 lots, it was agreed that all the lots should be staked out by the surveyors so people would be aware of what they are purchasing Mr Campbell moved that Mr Poole and Mr Jeffery be authorized after locating the boundaries of the lots, to establish the reserve bits on these lots and the terms of sale for same Carried It was generally agreed that the surveyor should stake all the lots which are to be sold PON n • Ll COUNCIL MEETING JUNE 12th, 1978 P 6 Council then continued with a review of M D policies REVIEW OF Y.. D POLICIES Page 56 - Regulations regarding Land Purchases. After discussion of these regulations, Mr Bauer moved that the land purchase regulations be established as follows No land or fence deals be made except by the committee as authorized Payment for land taken for road adjacent to the existing road be at 15 times the assessment, with a minimum of $250 00 per acre Compensation to a farmer for moving his fence be at a maximum of $700 00 per mile depending on the condition of the fence If the fence must be built by the M D the general policy be to use 3" treated posts 13 febt apart to use larger posts for the corners the M D will supply sufficient wire where necessary to return the fence to the condition it was in at the commencement of the project, and if the farmer wishes to improve the fence standard by replacing the existing wires or by the addition of more wires, he must supply the wire AND further Moved that Council set a policy of allowance of $120 00 per acre on the estimated acreage which is damaged during road construction AND Further Moved that the normal rate of compensation for a borrow pit be $125 00, but this may be more or less under special conditions Carried Page 56A Policy regarding building committments on lots owned by the M D in Hamlets or land owned by the M D elsewhere This matter was briefly discussed and tabled until Mr Jeffery has an opportunity to see Mr Tainsh regarding the matter Page 61 - Machinery , Culvert Markers, etc After discussion of these policies, lJr Campbell moved That old grader blades be used to mark culvert locations where there are fences, with the blades to be put at the fence, and painted The policy regarding flares for each motor grader is to be retained The policy regarding machinery rental be as follows* 1 Municipal equipment may be used to do private jobs for anyone outside of the towns and villages of the area, if the machinery is close and there II is no private equipment readily available 2 Government rates to be charged including moving time except that motor grader rates shall be set by Council and special snow plowing rates may also be set by Council 3 Minimum charge to be $5 00 4 Maximum time for any one person not to exceed an estimated time of three hours 5 [Mork is subject to the approval of the foreman and /or councillor 6 All motorized machinery must be operated by a regular M D employee being paid by the M D 7 Reduction in the rate may be given by the amount of the employee's wages, if the employee certifies that he is donating his time Carried It was generally agreed that all the motor graders and trucks established July 14th, 1975 that no credit for miscellanec accounts over $250 00 be given without Council's consent be deleted and that M D policy regarding miscellaneous accounts be amended to read 1 Any person who owes the M D a miscellaneous account more than si months old shall not be given any more municipal services for items E as snowplowing, service board work etc Page 63 Motor Grader Rates Carried July 8th, 1977 After discussion of this policy, Mr Ferguson moved that no change bE this policy Carried Mr Dorn and Mr Dobler left the meeting at this time - 5 20 P M After discussion of pages 66 and 76, Mr Campbell moved that the policy regarding nuisance grounds be deleted completely and the policy regarding pounds be deleted completely Carried Page 77 - Policies regarding buffer zone, municipal set back and public reserve strip along creeks - After discussion Mr Poole moved that these policies be deleted as these stems are covered in Development Control by -law Carried Page 77A Policy regarding advertisement of development permits etc. After discussion, Mr Ferguson moved That the Development Officer must. 1 Advertise permits for developments in hamlet areas for one week in the Three Hills Capital 2 May advertise permits for developments in the rural area for one week in the Three Hills Capital OR May circulate the permit within &5 mile radius of the quarter section OR May in his discretion circulate within 1 mile radius of the quarter section for permits which are of an intensive nature Carried Page 77B It was agreed no change in this policy is necessary Pages 83 and 83A Roads - Improvements requested by oil companies IIApril 27th, 1970 - page 6 It was agreed no change was necessary in Roads built by private companies, etc Moved by Mr Poole that the policy be Road must have minimum 24 foot top Minimum 2 1 slope from road grade to ditch and 3 1 backslope culvert across a road must be at least 15 diameter culverts and approaches where required goodworkmanship gravel if required must be 3/4 inch Carried Road Crossing Policy After discussion Mr Campbell moved the policy be 1 We should first have a definite map showing the proposed road c 2 Secondary roads must be bored and cased unless specially approv Council M 0 n In COUNCIL MEETING JUNE 12th, 1978 3 Boring must be done for all surfaced and gravelled roads 4 Any line parallel to a road must be set back at least 125 feet from the center line of the road 5 Depth not less than 6' below the center of the road or 3'6" below bottom of the ditch, whichever is the greater 6 All backfill must be well tamped - but Council has not demanded u an actual tamping machine 7 Gravel must be replaced over the affected area on any open cut cY 8 Traffic must be safely accommodated at all times during the work The contractor must be responsible for adequate warning signs, etc f public safety 9 All provincial regulations must be followed 10 When the line is staked and before any work commences the crossing locations should be inspected by one of -- a councillor, sup foreman, Utility Officer or Municipal Administrator - together with a company representative They have the right to require a deeper der if the crossing is at a location where a "cut" will be required for road improvements, in some cases the location is relocated to get awe this situation 11 Immediately after completion of the work the Municipal District must be notified and an inspection of the crossing will be made 12 Ditches to be cleaned up,levelled and re- grassed where necessary 13 If a crossing location is not inspected by the Municipal District prior to installation the company is to be responsible for location and exposing and moving the pipe line at its own expense if it is found to be necessary by the M D during road construction Carried DUST CONTROL It was agreed that no change is necessary in this policy SPEED LIMIT - July 24th, 1972 - age 8 It was agreed no change is necessary in this policy Page 83B PRIVATE APPROACHES FROM ROADS After discussion, Mr Campbell moved the policy be. 1 Minimum width of the approach on the road - 32 feet and narrowing to 24 feet 2 Minimum 600 foot sight distance in either direction 3 Suitable culverts for drainage must be installed , and minimum size is 15" diameter 4 Prior approval for the approach to be obtained from the councillor for the area, the office or the public works superintendent Carried Policy regarding elevator road work - Page 83B - April 2nd, 1974 page 5 It was agreed no change was necessary in this policy The balance of the policies will be reviewed again at some later date Mr Ferguson left the meeting at this time - 5.50 P M Mr Campbell noted that Dick Sommerville of the Town of Trochu will be forwarding a letter to the M D requesting the Municipal District pave a road near the Town of Trochu Mr Berdahl noted that the stucco on part of the Carbon shop will require some work before painting is undertaken and one of the persons who may submit a tender for the painting will quote for the repair job also Mr Berdahl also mentioned two locations which require culverts installed in the approaches - one at NE 22- 29 -22 -4 and one at ENE 23- 28 -21 -4 west side of road - Pan Canadian oil well site Pan Canadian should also be requested to clean up the ditches along the pipeline Mr Bauer moved that the
