HomeMy WebLinkAbout1978-04-24 Council Minutes,11 E� COURT OF REVISION April 24,1978 The court of Revision of Municipal District of Kn met in the Municipal office in Three Hills,Alberta on April 24,1978 commencing at 9 00 a m Members presen R W Brown A W Bauer L G Litz R G Campbell T A Ferguson Councillor G A Berdahl was present as an observe Mr Peter Spilchen, Assessor and Mrs Ada Major froi Hills Capital were present throughout the hearing Mr J C Jeffery, Municipal Administrator was pres, recorded the minutes Mr T A Ferguson moved that Mr R W Brown act as Chairs Court of Revision - Carried The appeals were dealt with as follows. 1 Mr Leslie G Forrest - Pt SW- 18- 28 -24 -4 Mr Forest was not present but his note stated the acreage was assessed at 46 43 acres and the correct total is 43 57 acres He further stated in his note that the old house assessed for $670 00 was to be removed by M D instruction Mr Spilchen recommended the land be reduced from $930 00 to $870 00 and the improvements remain the same until the old house is removed Mr T A Ferguson moved the acreage be reduced from 46 43 to 43 57 acres and the land assessment be reduced from $930 00 to $870 00 and the total assessment be reduced from $8,350 to $8,290 and the balance of assessment be confirmed - Carried 2 Prairie Bible Institute re -Block 1, Lot 10 and Block 6, Lot 9 Ruarkville A letter was read from P B I advising the above lots have been sold to Mr Ronald Hewitson and Mr Gerald Unger respectively Mr Spilchen agreed Mr A W Bauer moved the assessment be transferred from P B I to Mr Hewitson and Mr Unger respectively - Carried 3 Hudson Bay Oil & Gas Company Limited RE 1) 6- 21- 31 -24 -4 Lease #438 2) 2- 4- 32 -24 -4 Lease #448 A letter from Hudson Bay Oil & Gas Co Ltd was read advising that our application #1 above that equipment was no longer at the site and asking that the assessment be lowered from $630 00 to Nil On application X62 that the Eight time cycle controls were no longer at this site Mr Spilchen agreed to the above and recommended on #2 reduction from $8,650 to $8,280 Mr R G Campbell moved the assessment on 6- 21- 31 -24 -4 be reduced from $630 00 to no assessment - Carried Mr L G Litz moved the assessment on 2- 4- 32 -24 -4 be reduced from $8,650 to $8 280 - Carried 4 Bumper Development Ltd A letter was read from equipment have been removed concurred and recommended t $430 00 Mr A W Bauer moved we $430 - Carried 10- 9- 29 -23 -4 Bumper advising that buildings and from the above site Mr Spilchen D reduce assessment from $2 590 to reduce assessment from $2,590 to 1 i U 1 Page 2 5 Alberta Wheat Pool - Wimborne 461 elevator A letter was received from Alberta Wheat Pool asking for 80% economic obsolescence Mr Spilchen agreed and recommended the assessment be lowered from $18,170 to $15,590 Mr R G Campbell moved the assessment be reduced from $18,170 to $15,590 - Carried 6 Alberta Wheat Pool - Huxley Fertilizer Building A letter was read from Alberta Wheat Pool advising they were leasing the land from Mr Edwin Heer and therefore the $10 assessment should be his and not theirs Mr Spilchen agreed Mr AW Bauer moved the $10 assessment be transferred from Alberta Wheat Pool to Mr Heer - Carried 7 Alberta Wheat Pool - Equity 462 and 463 A letter was read advising that Alberta Wheat Pool leases in Equity have been cancelled and transferred to C N R Mr Spilchen recommended to cancell the assessment Mr L G Litz moved we cancell the assessment of $420 Carried 8 Lumont Farms Ltd SW- 2- 29 -24 -4 A letter was read from Mr M Metzger is which he felt that the land is assessed too high after subsidizing the buildings out of the quarter Mr Spilchen stated he had explained to Mr Metzger that the buildings were not previously assessed and therefore the assessment was not reduced re improvements after subdivision and recommended to confirm the assessment Mr R W Brown moved the assessment be confirmed - Carried 9 Lawrence Bragg Pt 23 & 24 - Block P Wimborne A letter was read from Mr Bragg stating this assessment was too high Mr Spilchen agreed and recommended the assessment be lowered from $4,380 to $3,730 Mr R G Capmbell moved the assessment be lowered from $4,380 to $3,730 - Carried 10 Frode M Jensen NE 34- 28 -20 -4 A letter was read from Mr Jensen advising that a family was living in the assessed residence but no rent was being charged Mr Spilchen explained that whether or not rent is being charged had no bearing on the assessment and recommended to confirm the assessment Mr R G Campbell moved the assessment be confirmed - Carried 11 A J Chamberlain Lot 4 Block 5 Ruarkville A letter was read from Mr Chamberlain advising the building in question is only the remains of an old slaughterhouse and is useless Mr Spilchen recommended the assessment be changed from $120 to Nil Mr A W Bauer moved the assessment be removed - Carried Mr A Baldwin Pt NE 6-30 -25 -4 Mr Baldwin was present and stated the building in question is i very poor state Mr Baldwin left the court and Mr Spilchen >mmended reducing the assessment from $4,390 to $3,770 Mr A W Bauer moved the assessment be reduced from $4,390 to 770 - Carried I ot 7"t 0 L1, Page 3 13 Miriel Haller NE 21- 32 -22 -4 Mr Haller was present and complained that he had heavier land closer the the highway that was assessed only a few dollars lower He further stated that one 40 acre strip had completely blown off Mr Haller left and Mr Spilchen recommended the assesment be reduced from $3,810 to $3,650 Mr T A Ferguson moved the assessment be reduced from $3,810 to $3,650 - Carried 14 Tom Baerg SW 27- 30 -26 -4 Mr Baerg was present and stated that comparable land immediately south of his quarter is assessed $380 00 lower Mr Baerg left and Mr Spilchen recommended the assessment be lowered from $2,010 to $1 870 00 Mr T A Ferguson moved to table decision until after lunch - Carried The court recessed for lunch from 11 50 a m to 1.00 p m Mr R W Brown moved that Mr Baerg's assessment be lowered from $2,010 to $1,870 - Carried 15 Mr Svend Nielson Pt NE 19- 29 -25 -4 A letter from Mr Neilson complaining his assessment was too high was read and Mr Spilchen recommended the assessment be reduced from $3 910 to $3 460 Mr R W Brown moved the assessment be reduced from $3,910 to $3,460 - Carried 16 Mr A J Bigelow NW 1- 34 -27 -4 A letter was received from Mr Bigelow complaining his assessment was too high Mr Spilchen recommended the assessment be reduced from $3,560 to $2,780 Mr Litz moved the assessment be reduced from $3 560 to $2,780 - Carried 17 Walker Farms Ltd SE 6 and NE 6 34 -24 -4 A letter was sent from Mr George A Walker complaining the assessment was too high and that sloughs could not be seeded in the spring Mr Spilchen recommended the assessment be confirmed Mr T A Ferguson moved the assessment be confirmed - Carried 18 Grey Banks Ranch Ltd NW 19- 30 -23 -4 Mr Larry Edwards was present and stated the house was in very poor repair and that the land was severed by coulees Mr Spilchen recommended the assessment be reduced from $5,110 to $4 600 Mr T A Ferguson moved the assessment be reduced from $5,110 to $4,600 - Carried 19 I P Goertz Lot 3 block 1 Ruarkville Mr Goertz was present and stated his building on the property was valueless Mr Spilchen agreed and recommended the assessment be nil Mr A W Bauer moved the assessment be reduced from $500 to Nil - Carried Fi LI Page 4 20 Nick Waisman Business Tax Mr Waisman was present and stated he had not run his business since 1975 Mr Spilchen recommended removing the assessment Mr L G Litz moved the assessment be reduced from $480 to Nil - Carried 21 Ray Pahal SW 4- 32 -24 -4 A compaint was read from Mr Pahal advising his assessment was too high Mr Spilchen recommended the assessment be confirmed Mr R G Campbell moved the assessment be confirmed Carried 22 D G Harper Pt SE 27- 28 -20 -4 A letter was read from Mr Harper advising he thought he had received too many assessment slips for only a 4 23 acre parcel Mr Spilchen agreed and recommended the assessment be reuced from $8,160 to $8,050 Mr A W Bauer moved the assessment be reduced from $8,160 to $8,050 - Carried 23 J Brisbin PBI Staff #30 Mr Brisbin was present and stated that he thought his assessment was too high as compared to other years Mr Spilchen explained that Mr Brisbine was on Bulk PBI Assessment previously and recommended changing the assessment to a license structure Mr A W Bauer moved that Mr Brisbine be licensed rather than assessed - Carried 24 Jim Barkman NW 2- 31 -25 -4 Mr Barkman was not present and had no letter but Mr Spilchen explained that Mr Barkman would like to be classified as a farmer re his mobile hcme on the above land Mr T A Ferguson moved that Mr Barkman be classified as a farmer and that his license be cancelled - Carried 25 A F Freeman PBI Staff 414 A letter of complaint was read from Mr Freeman and Mr Spilchen recommended the assessment be reduced from $4530 to $3,710 Mr A W Bauer moved the assessment be reduced from $4,530 to $3 710 Carried Mr T A Ferguson moved the Court of Revision adjourn at 3.30 p m Carried G Muni 'pa m' istrator
