( SEE OVER FOR EXPENDITURE CONTROL ) COUNCIL MEETING APRIL 10th 1978 A regular meeting of Council of the M D of Kneehill 148 was held in the Municipal Office, Three Hills, Monday, April 10th, 1978 commencing at 9.00 A M Those present for the meeting were PRESENT Gilbert A Berdahl Division 1 Ralph W Brown Division 3 (Reeve) Art W Bauer Division 4 (after 9 25 A M) T A Ferguson Division 5 Leonard Litz Division 6 Reginald Campbell Division 7 J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Municipal Administrator was present and recorded the minutes Mrs Ada Major representative from the Three Hills Capital was present for portions of the meeting APPROVAL MINUTES Mr Berdahl noted that on page 6 of the minutes of March 23rd 5th paragraph it should read - Mr Ferguson requested that when a report of this matter is instead of Mr Ferguson requested that if After brief discussion, Mr Berdahl moved approval of the minutes of March 23rd, as corrected, and approval of the minutes of March 27th and AD_ril 5th as circulated CARRIED Mr Jeffery read the financial statement for the month ending March 31st, 1978 The statement shows a balance on hand of $465,709 52 Mr Jeffery also noted that cheque #30640 for $450 00 is payable to Abraham Penner and is now stale dated This cheque was issued to him for a borrow pit in connection with the Swalwell access road It was agreed to leave this cheque outstanding until matter can be reviewed with Mr Penner after road tour as Mr Penner is unhappy with the way the borrow pit was reclaimed Mr Litz moved adoption of the financial statement for the month ending March 31st, 1978 as presented CARRIED FIN STATEMENT MARCH /78 the Mr Jeffery reviewed with Council various items arising from REPORT ON SPRING attendance at the Spring Convention, including the resolution CONVENTION about raising the drinking age presented by the M D the resolution i Q Q s A. 1 n g for a .7 L. at this time - 9 25 A M A2 C r, It was noted that the M D should have its buildings appraised y INSURANCE more often, probably on a yearly basis, should check into the matter of insurance liability for non owned aircraft, and the matter of the wrongful act insurance was also discussed It was agreed that Mr Jeffery should ascertain what wrongful act insurance would cost to cover the municipal administrator, assistant municipal administrator and councillors and report back to another meeting of council It was suggested that an M D or County should have hold harmless agreements before entering private property Mr Brown noted that the Association can now buy through TURBO Turbo Resources Ltd which is a Canadian owned company RESOURCES It was agreed after discussion that Mr Paquette or Mr K J ` Smith obtain prices from Turbo for the yearly supply of oil grease ( d etc It was noted that the cost of delivery and warehousing the supplies would have to be taken into consideration This matter is to be reviewed by Council at a later date n kh Mr Ferguson moved to accept and file the report )2�w CARRIED q\ COUNCIL MEETING APRIL 10th, 197 Mr Jeffery reported to Council on the Gulf Oil Safety Seminar held recently at Ste.ttler Gulf Oil wishes to know what facilities are available from this area and who to contact in the event of a disaster This information has been forwarded to them Andex Oil and Mobil Oil are planning similar seminars soon It was agreed that representatives from the fire departments should perhaps attend one of the seminars if possible Mr Campbell moved to accept and file this report CARRIED Pardee Equipment Ltd , is holding a Preventative Maintenance School in Calgary April 18th, 1978, commencing at 7 00 P M After discussion, Mr Bauer moved that Mr Rick Vickery, Mr Harvey Jesske and Mr Robert Cranston be authorized to attend Carried It was generally agreed that the men could take time off to make up for the time involved in attending this evening ✓1 seminar financial Mr Jeffery then reviewed /reports received from- Orkney Community Association Mr Ferguson moved to accept and file Carried Allingham Community Association Mr Bauer moved to accept and file Carried Wimborne Community Center Mr Berdahl moved to accept and file Carried Alberta Power Ltd has requested approval for a line extension to LSD 6- 11- 33 -26 -4 After brief discussion, Mr Litz moved approval as per plans submitted Carried Mr Jeffery reviewed the accounts and after discussion, Mr Campbell moved approval of the accounts as presented Carried The Municipal Finance Officers Association is holding its annual conference in Red Deer Thursday, and Friday June 1st and 2nd, 1978 The Federation of Canadian Municipalities is holding its 1978 annual conference MAINTENANCE SCH 5 CA R�kise a PUry Yr h RECREATION REPORTS ACCOUNTS V1 v' VARIOUS CONFERENCES An occupational Health and Safety Seminar is being held in Calgary, Thursday, May 4th, 1978 After brief discussion, Mr Campbell moved that no delegates be sent to any of these conferences or seminars Carried The 1978 Spring Refresher Course in Banff is scheduled to start June 5th, 1978 After discussion, Mr Litz moved that Mr Bauer, Mr Brown and Mr J C Jeffery be authorized to attend the refresher course Carried Mr Jeffery noted that the M D has a safety deposit box at the Alberta Treasury Branch in Three Hills, but the box is not being used After discussion, Mr Ferguson moved that the two items in the box be removed and brought to the office, and the box be cancelled Carried V 3 SPRING REFRESHER COURSE CANCEL SAFETY DEP BOX 11 COUNCIL MEETING APRIL 10th, 1978 P 3 A letter of thanks from the P B I regarding the adjustments LETTER THANKS made by Council on the 1977 taxes for some mobile homes P B I was read to Council Mr Ferguson moved to accept and file Carried A letter from P B I has been received in which they P B I GRANT request Council's consideration of a grant in lieu of FOR 1978 services which the M D would normally have to provide to a hamlet area After discussion, Mr Berdahl moved that the P B I be paid a grant of $6500 00 in 1978 V Carried Mr Bauer mentioned a road which was constructed some PRIVATE RD. years ago by the M D The road crosses the SE 31 -31 -26.4 Slz 31- 31 -26 -4 in order to provide access to the buildings located on the SW 31- 31 -26 -4 It was not practical to build a road to the SW 31- 31 -26 -4 on the road allowances The road requires gravel After discussion, it was V1 agreed to find out if this road was surveyed and dedicated as a public road and to discuss the matter again later in the meeting Alberta Municipal Affairs have requested 1978 population 1978 POPULATION figures for the M D After discussion, Mr Ferguson moved that the M D use the 1976 federal census figures for FIGURES 1978 Carried There was discussion regarding the water and sewer rates GRANTVILLE & charged in Grantville and Ruarkville for residences which RUARKVILLE have a suite or are classed as a duplex, but have only one WATER & SEWER water meter RATES FOR Mr Bauer moved that where there is only one water meter to DUPLEX ETC a residence, whether a single family residence with a suite., or a duplex the owner of the property be charged the minimum 00Y- charge per month of $16 00 to cover 4000 gallons o water 10 and sewer charges, and overages over 4000 gallons %peramonth 1 W ® r'' V, be charged at the rate established of $1 50 per thousand This policy to be effective from April 1st, 1978 CARRIED Mr Brown reviewed with Council the need for holding an annual meeting The costs for this year's annual meeting was abor} $450 00 and there was only approximately 37 ratepayers therE This matter was discussed and Council felt if the possibilit of not holding an annual meeting was advertised in the paper ratepayer's reactions might be received Mr Brown also mentioned the matter of garbage being found'. in a ditch in 1977 and being traced to a ratepayer who deniE responsibility for this action The same ratepayer was contacted in 1971 about a similar situation and he also denj dumping the garbage at that time A letter received from NAIT was read to Council There ar( several students graduating from NAIT in June who have taker a municipal administration course Mr Ferguson moved to accent and file as information CARRIED Mr Jeffery reviewed the draft of the 1978 budget and nossit mill rates for 1978 Various items were discussed, in part: the mill rate for rural fire protection It was noted that Town of Trochu has requested the M D to increase its grant the town for fire services Previous years the M D has pa: the Town of Trochu $500 00 A motion had been made previoi whereby the mill rate for rural fire protection areas was established at one mill for 1978 After lengthy discussion of this matter Mr Ferguson moved that the motion passed NEED FOR HOLDIN( COUNCIL MEETING APRIL 10th, 1978 P 4 at Council meeting January 30th 1978 page 6 be resinded and the matter reviewed again later There was further discussion regarding the rural fire RURAL FIRE PROT protection budgets and mill Carried REPORT ON 1978 Mr Jeffery noted that the budget as drafted and proposed DRAFTED mill rates would create a surplus for 1978 PROPOSED BUDGET Mr Bauer moved to accept and file Mr Jeffery`s report on the proposed budget Carried DINNER The meeting then adjourned for dinner between 12 00 Noon and 1 00 P M There was further discussion regarding the rural fire RURAL FIRE PROT protection budgets and mill rate, and Mr Ferguson moved MILL RATES FOR that the grants for the Town of Three Hills the Town of 1978 Trochu and the Village of Linden for assistance towards the operational costs of the fire trucks be increased from $500 00 to $600 00 for 1978 with the grants charged to the fire protection areas concerned Mr Campbell moved that the following mill rates for rural fire protection be set for 1978 Trochu Rural Fire Protection Area 1 mill Three hills Rural Fire Protection Area 1 5 mills Linden Rural Fire Protection Area 1 5 mills Carried Mr Jeffery reported to Council with regard to thE: recreation supper meeting held recently at Torrington After brief discussion, Mr Berdahl moved to accept and file the report Carried Mr Jeffery reviewed the minutes of the Park Committee meeting held March 28th, 1978 He mentioned he had received two applications for the job as park supervisor for Keiver Lake The Council discussed the proposed salary range and commission split A copy of a contract has been received for use in preparing a contract with the supervisor After discussion, Mr Litz moved to accept and file the report Carried Mr Paquette, Mr Dobler, and Mr Dorn entered the meeting at this time - 1.35 P M RECREATION SUPPER MEETING TORRINGTON PARK COMM MEETING Alberta Environment is conducting its derelict vehicle programDERELICT VEHICLE again this year After brief discussion, Mr Ferguson moved PROGRAM to accept and file as information Carried A letter has been received from Able Irrigation Ltd , advising CORRESPONDENCE they could be of assistance with waste management problems A solid waste seminar is being held in Edmonton on April 27th 1978 A letter from the Drumheller Health Unit regarding a regional solid waste management meeting to be held April 27th, 1978 r was noted Mr Berdahl moved to accept and file the letters as information Carried n 7� COUNCIL MEETING APRIL 10th 1978 P 5 Correspondence from the AAMD & C was referred to the AAMD & C CORRESF meeting as follows. All culvert companies have agreed on new prices Alberta Environment offers assistance for establishment of oil storage depots for used oil Prices for flags for Canada Day quoted ✓' Master Liability Policy claims and notice of occurences Increase in coverage for volunteer fire brigade accident insurance Gopher poison available Special price from Crown Tire for 1400 x 24 general grader tires There was discussion about the increased coverage for volunteer firemen and the increased costs Mr Campbell requested Mr Jeffery to determine that the towns involved and the M D were not duplicating the insurance coverage as some men are both rural and town firemen Mr Bauer moved that the accident insurance coverage for volunteer firemen be increased as outlined in the circular from the Association at the increased cost of $100 00 Carried Mr Campbell moved to accept and file the correspondence Carried 9 applications for work were referred to the meeting and there have been referred to Mr Paquette Mr Paquette noted the crew is nearly complete now for the summer season Mr Campbell asked Mr Paquette if there should not be a two man crew to do patching work full time this summer The patching work is not getting down when it is needed After discussion, Mr Paquette noted th�.t perhaps 4 men could work on this - 2 in the north and two in the south when the weather was suitable and in rainy weather the men could help with the fencing INCREASED ACCIDENT COVERAGE VOLUNTEER FIREMEN 0 APPLICATIONS FOR WORK DISCUSSION REGARDING PATCHING ROADS Mr Paquette mentioned the cracks in the pavement require oiling again this year and this requires two men There is an outfit available which would be more helpful in filling the cracks It is a pressurized tank and it forces the rubberized oil under pressure into the cracks It was agreed that a price for this outfit should be obtained and the matter discussed later today ;It was generally agreed that the crack filling and patching work should start very soon There was brief discussion as to who works on the Datch crew normally Manco Industrial Supplies Ltd have a plow bolt special on now the M D of Starland have a used Cutler V Plow for sale , a circular has been received from Tubeco Company, and a letter from Waterous G M Diesel Ltd was read to the meeting Mr Ferguson moved to accept and file the correspondence as information Carried Mr Doug Hazelton of Linden Contractors entered the meeting at this time - 2.05 P M He noted he hopes to have his drum mix plant in operatic witH;the next 3 to 4 weeks Mr Litz asked about using cold mix on the Wimborne Plant road this year and this matter was discussed There was also discussion as to t cost for hot mix for this road Mrs Brown noted there i f ETC ie OUTFIT FOR FILLING CRACKS IN PAVEMENT CORRESPONDENG MEETING WITH Tl T] A 7 S7 T T!1 TT COUNCIL MEETING APRIL 10th, 1978 P 6 z mile of road opposite the Acme Sewage Lagoon on Secondary 806 which should be repaired this summer Mr Hazelton inquired what Council intends to do with the 20 acres it owns north of his pit - SE 16- 32 -26 - -4 After lengthy discussion about the possibility of getting gravel there, which would require extensive and very expensive stripping, Mr Hazelton noted he would like to rent a portion of the 20 acres to store cold mix The price for cold mix was discussed, and the type of oil used was also discussed Mr Hazelton noted he will use MC 250 for the cold mix with a 5% mix Mr Hazelton noted he would like to use the old base on the M D gravel pit land for storage of the cold mix and after discussion of this matter, it was generally agreed Mr Hazelton could use the site for this summer season There was discussion about a possible overload to enable Mr Hazelton to move his crusher to the pit and he was advised to contact the office for the permission when he was ready to move Mr Hazelton then left the meeting There was further discussion regarding the work required on the roads, and the use of cold or hot mix Raven Construction at Red Deer have be n awa d d the r lnc 1 overnment contract and it was agreed? � get. alpricevFrromFhoem Hrr a hot mix and for a cold mix fob on the Wimborne Plant Road - 2 miles and the 2 mile road on Secondary 806 opposite the Acme Lagoon site Carried Mr Brown reported on the recent secondary road study meeting held March 29th in Calgary, and he reviewed briefly the items covered which were applicable to this area Mr Berdahl moved to accept and file the report Carried Alberta Transportation has advised that the consent of the Minister of Transportation is not required for our by -law 848 as the M D has been given authority under Section 14 (1) of the Motor Transport Act to pass the necessary by -laws However they suggest a different format for the by -law, and forwarded a copy of a proposed by -law After discussion, Mr Bauer moved first reading to by -law 852, this being a by -law to establish weight restrictions on certain bridges in the M D Carried Unanimously Mr Ferguson moved second reading to this by -law Carried Unanimously Mr Brown moved third reading to this by -law Carried Unanimously There was also discussion about whether the M D can ban a road to a maximum gross vehicle weight and it was agreed that Mr Jeffery should check this matter again and report back to Council It was also noted that a new by -law must be prepared for axle weight limits for roads during non -ban times Ok VI i PRICES FOR ROAD WORK WIMBORNE PLANT ETC SEC ROAD STUDY MEETING V' BRIDGE WEIGHT BY -LAW NO 852 A letter has been received from Jo -Ann Trucking Ltd of PAYM Brooks forwarding a cheque for road damage incurred last O AN: fall Mr Campbell moved to accept and file as ROAD information Carried �f V, COUNCIL MEETING APRIL 10th, 1978 P 7 Brian Sowerby motor grader operator has officially lost his 1976 holidays and he has requested Council consider BRIAN SOWERBY allowing him to take these holidays now 1976 holidays After discussion Mr Campbell moved that Mr Sowerby be authorized to take the balance of his 1976 holidays on condition these are taken as soon as possible Carried Mr Brown again reviewed the matter of the private road across SE 31- 31 -26 -4 to reach buildings on SW of 31 He noted there are several situations similar to this where it was more practical and less expensive to build a road on private property to gain access to another quarter than to build on the road allowances due to topography, etc He noted he has a similar situate in his division with Mr Richard Toews and Mr Donald Kostrosky, whereby the only way Mr Toews can reach his buildings is to cross Mr Kostrosky's land After lengthy discussion about the type of situation, it was generally agreed that the M D should not gravel more than one half a mile on any private road if the road is the only means of access to a building site, but the best solution would be for the M D to purchase the land and dedicate it as a public road It was then agreed that these above mentioned situations should be looked at on the road tour, before any decisions are made The three roads in question are - R J Page - S2 31 -31 -26 4 Richard Toews NW 26- 29 -25 -4 and possibly the Charlebois Harris access problem A general policy regarding maintenance and work on a private road will be drafted for consideration by Council after the road tour t' PRIVATE ROAD MAINTENANCE POLICY { V ETC Mr Emil Litke of Kelowna has complained about a COMPLAINT EMIL problem with a blade grade road which wasbuilt near his LITKE ROAD NEAR property - Section 34 -28 -23--4 Mr Berdahl moved to Sec 34- 28 -23 -4 table this matter until Mr Poole returns from vacation -r-G )0 e LA Carried Mr Fred Haller and Mr AlvinHaller have requested permission to install a culvert and approach at SE 13 33 23--4 The site is below a hill and perhaps might be hazardous if large machinery was on the road However the minimum site distance is complied with Mr Campbell moved to approve the installation of the approach, subject to placing at least an 18 inch culvert at the location Carried Alberta Transportation have authorized repairs to the bridge east of Trochu which was damaged last fall by a motor vehicle Costs for this will be forwarded to our office for collection from the insurance company Mr Litz moved to accept and file as information Carried P 8 ROAD APPROACH SE 13-- 33 -23 -4 V1 BRIDGE REPAIRS BRIDGE EAST TROCHU ✓\ � 01 r5s XS G COUNCIL MEETING APRIL 10th 1978 P 8 Alberta Transportatation have forwarded a letter outlining LETTER ALTA the reasons for changes in their department structure TRANSPORTATION Mr Bauer moved to accept and file as information 1� Carried Council then reviewed at great lengthy secondary road priorities for the next few years It was generally agreed that a joint meeting with County of Mountain View to discuss joint priorities would be helpful, and perhaps an annual meeting with Mountain View could be instituted Mr Litz moved that the M D of Kneehill invite the council from the County of Mountain View to attend a joint meeting and be guests of the M D at lunch or supper in Three Hills or some other suitable location Carried It was then agreed that the balance of the secondary road priorities should be left until after the meeting with Mountain View Mr Jeffery noted that the Wimborne north south road into the Mobil Oil Plant has been scarified in several locations and in as much as the road will be re -built this year felt that the road should be treated as a gravel road and not banned After discussion Mr Campbell moved that the north south road into the plant be removed from the road ban list Carried N SECONDARY ROAD PRIORITIES 1A V1 WIMBORNE NORTH ROAD INTO MOBIL PLANT Mr Ellis Reimer of Linden requested Council's REQUEST TO consideration to close the portior of road allowance ALLOWANCE which separates his property - Lots 1 to 6 PERMIT Block 4 in Swalwell was referred to the meeting Mr Bauer moved approval of the permit as issued V'N Carried 11 COUNCIL MEETING APRIL 10th, 1978 P 11 Mrs Wilkinson reported to Council on various cemetery matters as follows Request from a Ron Davis in Calgary for the M D to erect a footstone or plaque on grave of their child in the Mt Davis Cemetery CEMETERY REPORT The M D had in previous years under a provincial grant erected footstones on the graves of people buried many years ago in some of the older cemeterieq After discussion it was agreed that the M D would not be continuing this program as no provincial grant is now available, and Mr Davis is to be advised accordingly A Tim Bauer mentioned that there are 3 children and one older person buried on the NE 6- 32 -25 -4 and believed it should be marked as a cemetery V/1 After discussion and noting that the exact location of N0 0A the graves has never been accurately determined it was agreed that nothing be done at this time Mrs Wilkinson then reviewed the work done to date in obtaining titles or permission to do work in ✓� cemeteries where the titles are not registered in the name of the M D The- Meehan Cemetery at Trochu has been transferred to the M D The Mt Davis Cemetery may be transferred to the M D soon Arthurville Cemetery - Church of England has been requested to let us have a letter authorizing the M D to do maintenance work as they do not wish to transfer title Lumni Cemetery (Catholic) The church will not transfer title but have given permission for the M D to do maintenance work at the cemetery St John's Evangelical Luthern Cemetery Pt NE 30- 33 -
