( SEE OVER FOR EXPENDITURE CONTROL ) L t92$:_ Reeve a reasurer t IN IM LM COUNCIL MEETING JANUARY 23rd, 1978 A regular meeting of the Council of the Municipal District of Kneehill #48 was held in the Municipal Office, Three Hills, on Monday, January 23rd, 1978, commencing at 9 00 A M The following persons were present G A Berdahl Division 1 C W Poole Division 2 Ralph W Brown Division 3 Art W Bauer Division 4 T A Ferguson Division 5 Leonard Litz Division 6 Reginald Campbell Division 7 (Reeve) (after 9 30 A M ) PRESENT J C Jeffery, Municipal Administrator Mrs Jean Wilkinson, Assistant Municipal Administrator, was present and recorded the minutes V' Mrs Ada Major, representative from the Three Hills Capital was V11 present for the major portion of the meeting APPROVAL MINUTES The minutes of the meeting of January 9th and January 12th were briefly reviewed, and Mr Berdahl moved approval of the minutes of these meetings, subject to a correction on Page 9 of the January 9th meeting - third paragraph - third line - should read "inthe area' rather than "his division" Carried Mr Berdahl moved that he wished it to be recorded that Council made an error in constructing the salt shed in Three Hills, and it should have been constructed in the Carbon area in order to make use of the sand in that area - at the Berreth Pit - and because there are more hills in that area which require sanding MOTION DEFEATED E I r t r i� f 1 t L/I II Mr Jeffery reviewed the final financial statement for FIN the month of December 1977, which showed a net balance STATEMENT on hand of $740,651 09 11-1 Mr Bauer moved adoption of the financial statement as presented Carried A G T A G T have submitted a valuation notice for A G T FIGURES FOR works liable to inlliieuoof GRANT IN LIEU taxation TAXES IMr Litz entered the meeting at this time - 9 30 A M 0 Mr Jeffery read a letter from Alberta Environment regarding the funds available for land reclamation and this matter was discussed, Mr Campbell moved Mr Jeffery obtain more information regarding the program as it affects individual landowners and report back to the next meeting Carried Alberta Agriculture have forwarded a cheque for $4443 85 being the government's share of the grant for up- grading at the Three Hills Seed Plant The M D will now pay the grant plus an additional sum of $4443 85 as the M D 's share to the Plant Mr Ferguson moved to accept and file the letter Carried LAND RECL. PROGRAM SEED PLAN GRANT ALTA Ar ✓'1 The minutes of the Three Hills School Division meetings of December 14th and January 11th were briefly reviewed Mr Litz moved to accept and file Carried ti a 2 y 1 THREE HILLS SCH DIV MINUTES F MOW- A H �w COUNCIL MEETING JANUARY 23rd, 1978 P 2 A Recreation Workshop is scheduled by Alta RECREATION Recreation for March 16 to 19 in Calgary \A WORKSHOP Mr Bauer moved to accept and file Carried Mr Cunningham requested Council's decision IMPROVEMENTS regarding improvements to the M D radio system The cost would be about $4300 00 After discussion of the matter, Mr Ferguson moved that the improvement to the system not be undertaken at this time Carried The 1978 Course Calendar for the Alberta Fire Training FIVE SCHOOL School was briefly discussed and it was noted that I CALENDAR all the fire departments had received a copy of the V calendar Mr Jeffery reviewed the costs for the Annual COSTS OF XMAS Christmas party Mr Ferguson moved to accept and PARTY file the report �/' Carried Mr Jeffery reviewed the 1977 financial statements Dec 1977 and reports received from The Grainger Community FIN STATEMENT Association, the Three Hills Rural Community ✓� RURAL and Mt Vernon Community Association COMMUNITIES Mr Poole moved to accept and file the reports Carried Mrs Wilkinson advised Council that Resolution Number REPORT RE 3 to Development Control by-law 789 has been approved RESOLUTION 3 by the Provincial Planning Board, and C R P C are V1 DEV CONTROL now proceeding with the subdivision application ETC for the parcel of land in the hamlet of Bircham Amendments to the Preliminary Regional Plan have CORRESruivDnNC been submitted by Beiseker, Airdrie and the M D of A MINUTES Rocky View Mr Poole moved that the M D have no objections C R P C to these proposed amendments Carried Mr Jeffery reviewed portions of the minutes from C R P C as they related to this area Mr Berdahl moved to accept and file Carried Mr Ferguson noted that there is a spring running V0A'f. FLOODING �%% across across the road near Highway 27,1 mile q��1+`t M D ROAD east of 21 and it was agreed that Alberta NEAR HIGHWAY Transportation should be notified of this problem '30 27 east Mr Poole moved that the Council meeting do now V1 adjourn and sit as a Development Appeal Board Carried Mr Ferguson moved that the Council meeting do now DEV APPEAL continue, the Appeal Hearing having been dealt with 0 HEARING Carried Mr J Drew, Engineer for Rangleland Pipe Line Company RANGELAND entered the meeting at this time PIPE The company have requested relaxation of the municipal REQUEST FOR set backs to allow a pipeline to be installed approximately RELAXATI 90 feet from the center line of the road This is necessary in order to by -pass the airport hangers and the Mobil Oil Plant, in SW 33 32 23 4 After discussion of the matter, Mr Poole moved that the relaxation of municipal set back from 125 feet to 90 feet from the center line of the road be approved in order to by -pass the airport hangers and the Mobil Oil Plant, subject to approval being obtained from the Town of Three Hills and other interested parties Carried Mr Drew also requested relaxation of municipal set back �Jr to allow for installation of a cleaning trap close to the ', '.a N [A N iw COUNCIL MEETING JANUARY 23rd, 1978 fence at NW 8- 32 -23 -4 This would minimize crop damage and inconvenience to the farmer AFter discussion, Mr Ferguson moved that Council approve relaxation of the municipal set back from 125 feet from the center line of the road to 50 feet from the center line of the road for installation of the cleaning trap at NW 8 32 -23 -4 Carried Mr Peter Spilchen, Assessor entered the meeting to discuss with Council a request from Mr Muddle 'A of P B I regarding mobile home licence fees, etc Mr Spilchen reviewed the matter and noted the reasons for licencing a mobile as opposed to assessment of a mobile home The depreciation factor involved with licencing mobiles was also discussed Mr Muddle and Mr Dolsen from the P B I entered the meeting Mr Muddle outlined his case to Council and noted that because of the minimum benefit grant of up to $100 00 for most individuals and up to $200 00 for those receiving the guaranteed income supplement, and because of the depreciation factor involved, the people who were included in the bulk assessment of the, P B I were being more heavily taxed than those paying licence fees Mr Muddle presented the meeting with a copy of the agreement under which he and his wife purchased the mobile home from the P B I in June of 1972 He felt he should receive some benefit for both 1976 and 1977 Mr Dolsen noted that there are at least 12 mobile homes which are affected Mr Litz moved that all mobile homes at the P B I Campus which are owned by individuals be llcenced for the year 1978, and in future Carried Mr Muddle and Mr Dolsen were thanked for .��., to the meeting and then left the meeting P 3 P B I MOBILE HOMES LICENCE FEES ETC MR MUDDLE ET AL 0 VA There was further discussion regarding this matter and It was noted that Council could make a rebate of all or any portion of taxes paid in any year Mr Ferguson moved that a report be brought back to `ok,�e 00 Council outlining in each case the amounts the= individuals 40 have lost in the year 1977 because of the taxation of their mobiles, as opposed to a licence fee Carried The meeting then adjourned for dinner between 12 00 Noon DINNER and 1 00 P M A copy of a letter addressed to Mr Leslie D Kinch f W B C from the Workers Compensation Board was read to the RE meeting Mr Bauer moved to accept and file as information L KINCH Carried Richlyn Engineering Ltd requested permission to cross ROAD municipal roads in 10 33 -22 -4 and other areas as per CROSSING plans submitted Mr Campbell moved approval for the 10 -33 -22 road crossings, subject to compliance with municipal '� etc regulations Carried Letters from C U Engineering Ltd and Underwood, McLellan (1977) Ltd were read to the meting Mr Poole moved to accept and file as information l Carried Eq 14 COUNCIL MEETING JANUARY 23rd, 1978 P 4 Mr Jeffery reviewed the meeting held recently_ with Mr R Shea with regard to the Swalwell Sewer lagoon site and discussions held with Mr D Fyten regarding SWALWELL an easement for access to the lagoon site He also SEWER PROJEC read a letter received from Underwood, McLellan regarding the high cost grant which might be avilable for the project Mr Shea wishes the lagoon site moved another 1000 feet further south and would require approximately $10,000 for the lagoon site and the easement No definite committment was made by Mr Shea, but he was agreed in principle to the project Mr Fyten will require payment equal to that which oil compnaies are presently paying for easements, which generally appears to be around $500 00 an acre Underwood, McLellan had included the sum of $2000 00 in the cost estimates for land and easements, so this would add another $8000 00 to the costs, plus the cost of moving the line another 1000 feet south The overall additional costs would be approximately $20,000 00 Mr Berdahl moved that the committee continue with negotiations and arrange for an evening meeting with the residents of the hamlet to discuss the costs involved with them Therewas discussion regarding the possibilityof proceeding with a cost estimate for a sewer system in Wimborne WIMBORNE and Mr Poole moved that a committee of Mr Litz, SEWER Mr Cunningham and Mr Jeffery arrange a meeting with UA PROJECT the Wimborne residents to discuss the project with them Carried It was noted that Mr Litz did not vote on this motion There was brief discussion regarding the joint meeting JOINT MEETING held on January 20th, and the question raised by Mr JAN 20/78 Wilson regarding the age of majority & RESOLUTION Mr Ferguson moved that a i�ssolution be presented to RE RAISING the Spring Convention of the AAMD & C to raise the AGE MAJORIT age of majority to 20 Carried ETC Mr Litz requested he be recorded as opposed to this motion ✓" Mr Berdahl moved that a letter be sent to Dr. Warrack outlining the matter of calling for public tenders for sewer projects in order to qualify for provincial grants Carried The Alberta Apprenticeship Board has forwarded the DALE LESLI results of Mr Dale Leslie's exams for completion vA APPRENTICE of his heavy duty mechanic apprenticeship SHIP Mr Poole moved to accept and file and a letter of congratulations be sent to Mr Leslie Carried Applications for work received from Ken Buchart and WORK Tim Webb were referred to the meeting Mr Poole APPLICATIONS moved to refer the applications to Mr Paquette Carried Mr J Dorn entered the meeting at this time There is a Federal program in effect to provide for METRIC assistance for employees who are required to purchase TOOL ASSIST metric tools as a condition of treir employment v%' GRANT Mr Bauer moved to accept and file this report as information and a copy of the application be referred to the shop Carried A letter from Percival Machinery & Supply Ltd regarding PERCIVAL a road stabilization seminar was read to the meeting MACHINERY Mr Campbell El N irr._ COUNCIL MEETING JANUARY 23rd, 1978 that the M D � P 5 Union Tractor will be holding a technical seminar MEETING on March 16th and 17th, in Edmonton by the Mr Ferguson moved that Harvey Jesske and Robert v^ Cranston be authorized to attend this seminar Carried and to authorize Mr Dorn noted that the crew is working at the McNair REPORT RE Pit today CREW & There was discussion regarding the gravel ,corking McNAIR GRAVE on Sunday and it was noted that the crew start a shift PIET ETC late Sunday afternoon It was agreed that the matter of the crew working on V11 Sunday be left in abeyance for the time being unless road rental for access to NE 24- 29 -23 -4 further complaints are received and further the CHARLEBOIS matter be discussed at the next meeting of the Shop NE and Foremen Committee D E Charlebois and also with her son, Mr Jeffery reviewed various problems which have arisen with the McNair Tit Mr McNair felt that the M D � should do some stripping at the pit for him this year MEETING as the stripping has been done previously by the council meeting January 30th, 1978 to discuss the County of Wheatland capital budget for 1978 Mr Campbell moved to accept the report and to authorize V/° the crew to do the stripping which Mr McNair has MEETING requested JAN 30/78 Carried Unanimously Carried Mr Berdahl reported that he had discussed the ROAD ACCESS road rental for access to NE 24- 29 -23 -4 D with Mrs CHARLEBOIS NE 24-29 -23 -4 D E Charlebois and also with her son, Robert They wish $150 00 a year rental After discussion io Mr Berdahl moved to table this matter until he can V'�� ��• discuss the matter again with Mrs Charlebois, Carried The minutes from the Shop & Foremen Committee Meeting SHOP & held January 20th, 1978 were reviewed by Mr Jeffery FOREMEN CO This meeting will be continued January 25th, 1978, MEETING and it was felt that the Council should hold another ✓' MINUTES council meeting January 30th, 1978 to discuss the capital budget for 1978 Mr Poole moved that Council hold a meeting on Monday, SPECIAL January 30th, 1978, commencing at 9 00 A M to COUNCIL discuss the capital budget requirements for 1978 `n MEETING and any other business which may come before it JAN 30/78 Carried Unanimously Mr BaUEr moved to accept and file the minutes of the Shop & Foremen Committee Meeting Carried Mr Poole noted that the road rho edirlfoardr SNOW PLOWING Lloyd Howe SW 28- 30 -24 -4 -7s and r n agree o 0 PROBLEMS check this with the snow plow operator Mr Jeffery noted the premium for heavy equipment nn vi EQUIP insurance is $7040 00, and there is a $1000 00 deductible INSURANCE Mr Litz moved to accept and file 'A PREMIUM Carried The matter of municipal equipment doing private work was again reviewed Mr Jeffery noted he had again discussed the matter with Mr Jack Fleming of Municipal Affairs, who had in turn discussed it with Mr D Gingara of the Mobile Equipment Licencing Department It was generally agreed that this matter be left in abeyance at this time Mr Bauer moved to accept and file the report Carried The overnight rate of $25 00 for employees attending meetings was reviewed Mr Poole moved that no change be made in this policy �., Carried MUN EQUIP DOING PRIV WORK V" OVERNIGHT RATE FOR EMPLOYEES N COUNCIL MEETING JANUARY 23rd, 1978 are Mr Jeffery reported regarding information he received C N R from Mr B Kathol regarding the C N R underpass UNDERPASS project, south of Three Hills Alberta Transportation has no definite policy established for cost sharing on these types of projects C T C will make no financial contributions Mr Ferguson moved that Council submit a letter to Alberta Transportation and to the C N R stating the M D would like to have the underpass constructed with a 36 clear opening, and wish to obtain figures for the cost sharing arrangement in order to give further consideration to the M D's participation in the project Carried Alberta Environment have now paid to the M D the GRANT RECD sum of $9126 12 to cover the costs of reclamation RECLAMATION OLD of the old nuisance ground sites NUIS GROUNDS Mr Berdahl moved to accept and file the letter and the M D write to the Department to determine why the total cost of the project of $9561 95 was not paid Carried MIS Miscellaneous correspondence was then reviewed as follows CORRESPOND- ENCE 1 Western Canada Hardware Ltd - Change of name 1P 2 Circular from AAMD & C regarding special price ✓t on light bulbs 3 Circular from AAMD & C regarding need for more traffic sign identification decals It was agreed that if Mr Duncan requires more decals these be ordered Mr Berdahl requested that the signs at the gravel pits V, be amended to include permission may be obtained from the local councillor has been received 4 A letter /from Dr Hugh Horner, Alberta Transportation NEW AXLE enclosing copy of the new Motor Transport Act which now LOADING provides for axle loading control rather than gross vehicle ACT weight control. A pamphlet covering the details of the new program was enclosed It was noted that the municipal by -law regarding gross weights on roads would now have to be changed Mr Litz moved to table this matter until further information can be obtained including regulations Carried 5 A circular from the AAMD & C regarding the suggested 6% 6% guideline for wages was read A meeting to discuss WAGE GUIDE this matter has been arranged for February 9th, immediately LINE & following completion of the A S B conference in Edmonton MEETING TC Mr Berdahl moved that Mr Campbell and Mr Litz be authorized DISCUS` to attend this meeting on behalf of the M D and Mr Jeffery 0 attend if he so wishes Carried 6 A letter received from the law firm of Brownlee Fryett LEGAL regarding the dugout located in the hamlet of Swalwell OPINION and other matters was read DUGOUT IN Mr Ferguson moved that a copy of this letter be sent to V1 SWALWELL the owner of the dugout to make him aware of the situation ETC Carried After discussion of the other items covered by the .1 VA Mr Litz moved to accept and _file as information Carried' Ver � The possibility of hazards with the culverts at the Bigelow �_1?10� Dam and the Swalwell Dam were discussed, and it was agreed VA Q� these should be looked at on the next road tour 1v% 7 Circular from the AAMD & C regarding changing tl�e FORMAT OF format of the Refresher Course was read SPRING REFRESHER 1`� COURSE N N COUNCIL MEETING JANUARY 23rd, 1978 WA It was agreed that perhaps a discussion of new legislation and a discussion of the pros and cons of a municipal ✓i district contracting out projects would be useful Mr Poole moved to advise the Association that Council would like the above items discussed at the Spring Refresher Course v11 Carried The Honourable D J Russell, Minister of Environment 1977 Assistant has forwarded a cheque for $2544 00, this being Huxley Sewer the 1977 assistance provided under the Alberta ✓1 Project Municipal Sewage Treatment Assistance Program for the Huxley system The Municipal Inspector's report was read to the meeting After discussion of the comments made by the Inspector, Mr Bauer moved to accept and file the report and noted that the report is to be referred to the annual meeting of the ratepayers to be held March 20th, 1978 and further that the Reeve reply to the letter Carried Mr Jeffery reported on his recent discussions with the Anti Inflation Board and with Mr Jack Fleming and Mr Tom Buchanan It appears that the M D must comply with the regulations and roll back the wages at least 2% for 1976 Mr Jeffery noted he will work on the forms as soon as possible after the audit is completed and will then see Mr Buchanan in Edmonton, as he is considered to be an exper.% on these matters He requested Council forward a letter to the Board stating they will comply with the regulations Mr Ferguson moved that the Board be advised the M D will comply with the roll back requirement and the forms will be submitted as soon as possible Carried MUN INSPECTOR REPORT V') ANTI INFLATIOI REGULATIONS v1 It was noted that one of the water tanks purchased CHARGE FOR for emergency water hauling has not been returned EMERGENCY WATE Mr Wilf Evans has had the tank since last fall and TANKS to date has not returned it to Wimborne as promised V1\ After discussion of this matter Mr Berdahl moved that Council establish a policy as follows If any of the emergency water tanks are not returned P 5 \A after expriration of three days from the date of obtaining the tank, a charge of $5 00 per day will be levied £01T wGo� �yhw Carried JP" Mr Evans is to be advised by registered letter of •^ this policy The minutes of the A S B meeting of January 16th, A S B were briefly reviewed The recommendation that the MINUTES A S B spray truck be fitted for firefighting,filled and stored in the A S B shop was discussed Mr Brown moved that this recommendation be accepted Carried The bid submitted by Mr Glenn Smyth for the old projector was discussed It was agreed that this item should be put up for sale by tender at a later date Mr Bauer moved to accept those portions of the minutes referred to this meeting Carried Mr Poole moved that this meeting do now adjourn P hJOURNMENT Carried Time of Adjournment 4 30 P M ---- - - - - -- --- .� =�'- =-- - - - - -- Reeve Mun - ipa dminjtrator
