00 A M Those present for the meeting were PRESENT G A Berdahl Division 1 C W Poole Division 2 R W Brown Division 3(Reeve) A W Bauer Division 4 ✓' T A Ferguson Division 5 Leonard Litz Division 6 R G Campbell Division 7 Mr J C Jeffery, Assistant Secretary- Treasurer was present ✓4 for the meeting, and Mrs Jean Wilkinson was present and recorded the minutes Mr G G King, Secretary - Treasurer was present for portions of r the meeting Mrs Ada Major, representative from the Three Hills Capital was ,/1 also present for portions of the meeting xrrnUJAL MINUTES After noting that some of the councillors had not ,yet received 28%77 their minutes from the December 5th meeting, Mr Berdahl moved approval of the minutes of the meeting held �4 on November 28th Carried Mr Brown noted two corrections for the December 5th minutes and it was then agreed that approval of these minutes be left `n until the next meeting Mr Jeffery read the financial statement for the month NOV FIN ending November 30th, 1977 STATEMENT After discussion, Mr Poole moved approval of the statement, which showed a net balance on hand of $13,1143128 56 Carried OFFICIAL Mr Brown then read his official oath as Reeve for the M D OATH of Kneehill and signed same in the presence of a Commissioner REEVE &' for Oaths DEp Mr Poole then read his official oath as Deputy Reeve for the REEVE M D of Kneehill and signed same in the presence of a Commissioner for Oaths BIDS PHOTO The bids received for the old photo copier were then opened COPIER Mr Sulo Luoma of Trochu submitted a bid of $241 00 Mr Ron Howe of Three Hills submitted a bid of $375 00 V Mr Bauer moved that the bid submitted by Mr Howe of $375 00 V be accepted Carried Mr Ferguson moved that Mr Howe be sold the supplies on hand for the machine at approximately 2 /3rd our cost Carried MUN AFFAI Mr Jeffery noted that the inspectors from Alberta Municipal INSPECT�I Affairs did a brief audit and inspection recently, and their �/t report will be forthcoming in due course REPORT - Mr Jeffery noted that Mr F Wood from the Fire Commissioner's FIRE Office had tel phoned recently and stated that the report on COMM the fire survey+one for this area some little time ago should be available soon Their office has been short staffed and this has resulted in the delay Mr Campbell moved to accept and file this report as information Carried XMAS CARD A letter from Underwood, McLellan extending Christmas UNDERWOOD greetings to the Council and Staff of the M D was referred MCLELLAN to the meeting Mr Ferguson moved to accept and file the correspondence ✓1 Carried 2 M ftV LIM COUNCIL MEETING DECEMBER 12th, 1977 P 2 Mr Jeffery read a letter of thanks from the Drumheller THANKS Agricultural Society for the donation made recently DRUM AG Mr Poole moved to accept and file as information a1 SOCIETY Carried Mr Jeffery noted that the Gamble Community Association 1977 GRANT has not replied to our recent letters regarding the GAMBLE 1977 grant The Association had been asked if they wished COMM ASSO the grant paid over to the Carbon & District Recreation n Board There was general discussion regarding this matter V Mr Berdahl moved that the matter of payment of the grant to the Gamble Community Association be tabled until correspondence is received from the Association Carried Mr King advised Council that he has been ordered by JUDICIAL the Judge to be present at the Judicial Recount with RECOUNT the ballot boxes However the Returning Officer and Deputy Returning Officers while being served with notice of the recount were not directed to be present Mr King wondered if the M D would guarantee a day's pay and expenses to the Deputy Returning Officers if they expressed a desire to attend the recount After discussion of the matter and noting it would perhaps be beneficial to them for future elections, and also noting that the Court might direct payment of expenses to them if they did attend, Mr Brown moved that Mr G Ward and Mrs T Schmaltz be authorized to attend the judicial recount if they wish to do so, and the M D guarantee payment of $50 00 each and required expenses, less any payment they might receive on direction of the Court Carried V ;1 It was noted that Mr Poole did not vote on this motion �1 and further noted that Mr T A Ferguson wished to be recorded as opposed Mr Bauer moved that the Council sit as a Committee COMMITTEE AS as a Whole for discussion of certain wage matters J� A WHOLE Carried Mr Ferguson moved that Council do now continue its general meeting Carried Mr Berdahl moved that the M D accept the report prepared PAYMENT by Mr Jeffery regarding wages owing to Mr King as of OWING TO December 31st, 1977, and approve payment to Mr King of MR KING the sum of $12,704 00, this being holiday pay for 3 days TO DEC 31 of 1976, and holiday-pay for 1977, accumulated sick nay 1977 of 94 days and overtime to November 30th, 1977, plus his normal salary for the month of December, 1977 J1 Carried It was agreed that this figure would be subject to adjustment for any additional overtime accumulated in the month of December, 1977 C G KING Mr Campbell moved that Mr King be paid a consultant fee of CONSULTA $4000 00 for the months of January, February and March of 1978, FEE and he remain covered by the M D benefit plans for employees 1978 during that period V\ Carried 3 a Ask fir' Adpk COUNCIL MEETING DECEMBER 12th, 1977 P 3 Mr Litz moved that a committee of R W Brown, T A Ferguson, Norman Soder, J C Jeffery and Vi Hart be appointed to arrange for an appreciation night to honour Mr King V1\ on his retirement, with assistance from all the office staff Carried Mr Peter Sol, Mr Colin Kinniburgh, Mr Sig Werner and Mr Norman Oster from the Torrington Lions Club entered the meeting, to discuss with Council the possibility of forming a rural fire protection area around Torrington and Wimborne areas In reply to a question, Mr Sol advised that to date no survey of the people in the area had been taken to determine the interest of the residents towards forming such an area The Lions Club have to date investigated costs of obtaining a fire truck They have received a quote from Superior Fire Fighting Equipment at Red Deer for a Dodge chassis fire truck complete with equipment for $41,498 00 This tender is good only until December 31st, 1977 This company has its office at Red Deer and have 24 hour service Mr Sol noted that several members of the Lions Club have indicated they would be willing to serve as volunteer firemen He further noted that the Village of Torrington has indicated its interest in providing a building to house the fire truck and providing space for a possible ambulance in future Mr Sol noted that the Village of Torrington have about 600 feet of 22 inch hose now and about 100 feet of larger hose for use in filling tanks There was brief discussion regarding the agreement the M D has with the Village of Linden and it appeared that any agreement with the Village of Torrington would be on a similar basis Mr King reviewed the assessment figures for the area around Torrington and Wimborne which is not now covered by a fire protection area This figure comes to $3,235,710, which of course includes the Wimborne Gas Plant It was felt that at least 3 mills would be neeeded for a period of at least three to four years in order to pay for tr..e fire truck and cover operational costs matching agreement the M D has with Three Hills an �e he regarding sending men to the Fire School at Vermilion was also reviewed After further discussion, Mr Bauer moved that thE% M D agree in principle with the Torrington Lions Club proceeding with the circulation of a petition to determine the feeling of the residents of the area towards establishment of a Rural Fire Protection Area Carried Mr King agreed he would assist Mr Sol and his committee with preparation of maps outlining the tentative area and also the area which could transfer from the Trochu or Three Hills Fire Protection areas into the new area He further agreed to review the legislation regarding the need for petitions or plebicites for this type of an expenditure, and will assist the committee in preparation of the petition or petitions required The delegation then left the meeting i�' 4 COMMITTEE TO SET UP APP RE C NIGHT TORRINGTO RURAL FIR AREA 0 ,�n ?eo '(*1 VA 1u1 COUNCIL MEETING DECEMBER 12th, 1977 P 4 Mr Jeffery reported to Council regarding the status of the titles to the Swalwell Cemetery The title to the Catholic portion of the cemetery has been obtained Titles to the remaining portions are registered in the names of persons who are all deceased It will require a Judge's order to obtain titles in the name of the Municipal District Mr Poole moved that this matter be referred to Norman Tainsh, Solicitor of Three Hills, with a view to him obtaining the titles required in the name of the M D Carried Mr Litz moved that all titles to cemeteries in the M D be checked to determine ownership and a report be brought back to Council Carried Mr Jeffery read a letter from C R P C regarding the use of funds in public reserve trust accounts Mr King noted that in 1976 some money had been transferred from this reserve trust account into general revenue to cover the cost of capital items purchased for various parks in 1976 Mr Jeffery and Mr Smyth had determined that $1322 68 had been spent on capital items for parks in 1977 Mr Berdahl moved that the sum of $1322 68 be transferred from the Public Reserve Trust Account into the General Revenue Account to cover the cost of these capital items Carried TITLE SWALWE CEMETERY C R P C USE OF PUB RESERVE TRUS FUNDS C) A The Village of Acme have requested an amendment to VILLAGE ACME the Preliminary Regional Plan in order to zone AMENDMENT the entire Village of Acme as a high density area f PREL REG Mr Poole moved that the M D of Kneehill voice no PLAN objection to this proposed amendment Carried Notice of the next meeting of the Three Hills School SCH DIV Division was given to the meeting The meeting is set MEETING for December 14th, 1977 It was noted that Mr Ferguson is the representative to the School Division for the `4 month of December Mr Litz moved that Mr Ferguson be named as the representative to the School Division for the month of December Carried ALTA POWER Alberta Power Ltd have forwarded an overhead electrical AGREEMENT supply agreement for execution by the M D This is RUARKVILLE required in connection with the Ruarkville reblot Mr Bauer moved that the Reeve and Secretary- Treasurer ,1 be authorized to sign the agreement on behalf of the Municipal District Carried BUILDING Building permits issued were reviewed as follows PERMITS Murray Baerg, NE 20 30 -24 -4 - Chicken Barn V\ Raymond Ward - Lot 12, Block 5 Grantville - Double car garage Mr Ferguson moved approval of the permits as issued Carried Mr Jeffery read a letter from A G T regarding damage A G T to a buried cable This damage was caused by the M D CABLE DAMAG crew on November 16th, 1977 in Three Hills Mr Poole moved to accept and file as information, subject to clarification of the actual location Carried Mr Jeffery noted he believed the cable in Ruarkville damage occured 1 5 \/1 COUNCIL MEETING DECEMBER 12th, 1977 P 5 The meeting then adjourned for dinner between 12 00 Noon and ►A 1 00 P M enteredneeti g Mr Mac Brereton, representative from Three Hills School Division / Alberta Power Ltd have submitted plans for power line extension to LSD 6- 5-- 31 -21 - -4 and LSD 10 of 36- 31 -21 -4 After discussion, Mr Ferguson moved approval of the extension to LSD 6-5,31-21-4 Carried It was agreed that Alberta Power Ltd be advised the secondly described parcel LSD 10- 36- 31 -21 -4 is located in the M D Starland Letters from Imperial Oil and Gulf Oil regarding price increases were read to the meeting Mr Campbell moved to accept and file these a,: information Carried A letter from Alberta Transportation, Bridge Branch regarding Council's 1978 bridge requests was read to the meeting After reviewing the comments from the Bridge Branch regarding the various bridges, it was agreed this matter should be tabled until Mr Paquette is present Mr Ferguson mentioned that the Three Hills underpass is very dangerous and perhaps should have more signs posted regarding its height Mr Jeffery briefly reviewed the minutes of the recent Employer - Employee Meeting held the evening of December 1977 and various items discussed It was noted that there is an error in the minutes At the present time mechanic' slack time is the winter The mechanics feel their slack time should be summer - not winter -as recorded in the minutes see Item No Mr Brown noted that a Committed met with Mr Dorn on Friday, December 9th for a discussion of the problems which seem to be occuring between the main crew and himself ,i rra POWER LINE EXTENSION 1978 BRIDGE BRANCH REQUESTS 0 0 EMPLOYEE - 5th, EMPLOYER COMMITTEE MINUTES time 10 J1 There was discussion regarding the proposed wage offer of 5% Mr Brereton noted that the School Division is presently negotiating with the teachers who have requested a 16% increase They hope to settle with them in the neighborhood of 6 to 7 % Mr Rempel and Mr Paquette entered the meeting at this time 1 Mr Brereton noted that some government mileage is now paid at 24� a mile /I There was also discussion regarding pay for school board trustees and councillors It was noted that the pay for school trust Es and councillors in this area is one of the lowest in the 10 province Mr Poole suggested that figures for per diem pay should be obtained from the M D of Starland, M D Foothills, M D Rockyview, County of Wheatland and County- of Red Deer Mr Berdahl moved that the minutes of the meeting of the Employer- Employee Committee of December 5th, be accepted Carried 6 � Ap", `,, IN COUNCIL MEETING DECEMBER 12th, 1977 P 6 Mr Alvin Keiver, Mr Glen Keiver, Mr Tom Slater and ,,1 Mr G Dizusiak entered the meeting at approximately 200 P M MEETING WITH MR T SLATER Mr Slater and Mr Dizusiak, representatives from ALTA WATER Alberta Water Resources had several matters to discuss RESOURCES with Council, one being a request by Mr Alvin Keiver to investigate the possibility of raising the water level in Keiver Lake Mr Slater noted he had not made extensive investigation into the possibility of raising the level of water in Keiver Lake, but have checked out some items Mr Keiver had suggested pumping water from the Kneehill Creek into the lake In order to study the matter, it would require approval from the M D , the surrounding land owners, and the Alberta Motor Association who presently have a camp site located at the park Mr Slater noted the lake has a limited inflow Photographs of the lake in previous years indicate the level is about the same now as it was in previous year He also noted there is a high ridge between the creek and the lake and this would make it difficult and very expensive to pump water from the creek into the lake The capacity of the creek and needs of other people on the creek would also have to be taken into account, along with the rising energy costs The other aspect involved is that Keiver Lake is a sandy lake and has very little weed growth or algae This is very unusual for this area The water is very clean and presumably comes from springs with very little run off to polluxte the water The concern of Water Resources is what effect pumping water from the creek into the lake might have on the quality of the water It might promote growth of weeds and be a detriment to the quality of the water in many other ways Mr Keiver noted that spring run off from a coulee on the Peter Tainsh property to the east of the lake might be diverted by means of a ditch so as to run into the lake instead of into the slough It was noted that the lake is too shallow to support fish, and Mr Glen Keiver noted that the lake in 1959 was about 10 feet deep It is now about 5 to 7 feet deep Mr Slaterroted that Fish and Wild Life feel a lake must be at least 15 to 20 feet deep before it is worth stocking with fish This depth would enable fish to survive over the winter After further discussion of various matters, Mr Slater noted that Alberta Water Resources would be willing to conduct a survey of the area to determine if water could be diverted into the lake, providing the M D was agreeable and all adjoining land owners consented to Alberta Water Resources going on their land to conduct the survey Mr Ferguson moved that the M D request AlbE�rta Water Resources to conduct a survey, providing the required consent forms can be obtained from the surrounding land owners Carried There was brief discussion with Mr Glen Keiver regarding the Allingham Bridge and use of same in the winter time It was noted the motor grader cannot cross the bridge due to the imposed weight limit of 10 tons It was agreed that the school bus would have to go around in the winter time Mr Glen Keiver and Mr Alvin Keiver then left the meeting Mr Slater briefly reviewed the proposed Three Hills Creek Diversion at SW 7- 33 -24 -4 - Elmer Albrecht' land There are three possible locations for such a diversion and he will be forwarding maps showing these possible sites in the near future However there is no financial assistance available for such a project Mr Litz moved to accept and file th's report as information Carried 7 ter* ,4-. iar COUNCIL MEETING DECEMBER 12th, 1977 P 7 Mr Slater reviewed the Swalwell Dam project and noted MEETING WITH there is no spillway or gate on the dam and there T SLATER should be a good overflow channel installed WATER RES This project was reviewed with Alberta Fish and Wildlife because it is a fish damlto see if they would assist in funding this project To date no reply has been received from this department Mr Slater noted the project would cost about fifty to 75 thousand dollars W' Mr Slater also discussed the location of the sewage lagoon if the M D went ahead with installation of a modified sewage system for Swalwell The proposed location would not be approved because of the proximity to the dam The lagoon should be located to the south of the dam, which of course will mean added expense due to the distance involved Mr Slater also reviewed with Council the proposed Acme Recreation Reservoir project The study has been completed and the study indicates that the facility would be used heavily by the residents of the City of Calgary and the surrounding area A similar project is being studied for the Irricana area and at present it is not known V). if both projects would be approved The site for the reservoir would be at the Reimer Coulee and would be a supplement to the Village of Acme water supply Mr Slater noted that his department will be discussing this project soon with the Village of Acme The Orkney Drainage Project was briefly reviewed and it was noted that the adjoining land owners were not agreeable to proceeding with this project, at this time Mr Poole left the meeting at this time - approximately 3 00 P M Mr Slater and Mr Dizusiak left the meeting at this time also Mr Ferguson moved to accept and file the report received ✓-) 1978 from Alberta Bridge Branch regarding our 1978 bridge requests BRIDGE Carried REQUEST Mr Jeffery verbally reviewed the minutes of the meeting of the Foremen' Committee held December 9th, FOREMEN MEET C as the minutes have not ,yet been typed MINUTES After brief discussion, Mr Campbell moved to approve the report of the Foremen's Committee Meeting Carried Mr Jeffery noted that Mr SheldonNbGougan has S McGOUGAN agreed to accept $50 00 a year rental to continue ROAD RENTAL to provide access for Mr Tom Lynch through his property N2 28- 33 -22 -4 to reach SE 33- 33 -22 -4 Mr Berdahl moved to accept and file this report as information Carried Mr Campbell reported on the need for the road ROAD RENTAL diversion through Mr Jim Sailer's land J SAILER The road access is still required in order to r SE 36 -34 -22 provide access for Mr Hugh McLean J to his land - Part SW 31- 34 -21 -4, and it was agreed that the annual rental of $20 00 continue to be paid to Mr Sailer As the committee had not checked the Thiessen and Megli gravel pits due to the cold weather, it was agreed the committee meet at 9 30 December 13th, to do this J 8 -.L COUNCIL MEETING DECEMBER 12th, 1977 PERVICAL MACH A letter from Percival Machinery & Supply Ltd was SEMINAR referred to the meeting They are holding a road stabilization seminar in Edmonton some time in the month of February It was agreed that Mr Paquette review the material supplied and report back to Council if he feels it would benefit anyone to attend Mr Jeffery read a copy of a letter from L J Hempsey C N R addressed to C N R regarding the proposed reconstruction UNDERPAS of the C N subway south of Three Hills SOUTH 3 HILL Mr Bauer moved to accept and file as information Carried A letter from Alberta Transportation regarding a substandard BRIDGE bridge at SSW 25- 30 -25 -4 was referred to the meeting SSW 25 -30 It was noted that this bridge had been removed and V1,11 25 -4 Alberta Transportation had been advised accordingly This was referred to Council for information only A letter from Alberta 150 of Red Deer requesting permission to use M D roads in the cross country snowmobile race was read to the meeting It was noted that no map of the route had been supplied Mr Litz moved that the request for permission be tabled until the route map is supplied Carried A circular from the AAMD & C regarding Alberta's withdrawal from the anti inflation program as of December 31st, 1977 was read to the meeting Mr Berdahl mentioned that Mr Ken Lowen has requested more compensation for use of his land for access to t�}}e J ck Lowen ra�v el pit on SE 16- 29 -21 -4 It was agree tHt rrg ing anvdeU Berdahl should negotiate this matter with Mr Lowen Carried Mr Bauer referred a request for a T intersection sign on a road in his division to Mr Paquette ') Mr Campbell noted that the guard rail on the bridge east of Trochu is missing and this should be replaced Mr Litz noted there is a stop sign missing on a road north of Mr Jeffery noted that Mr Ed Duncan is ill and will be away from work for some time Mr Campbell reported that the pump house building at Huxley was destroyed by fire on the weekend and the contents of the building were also destroyed The well is not working There is one person dependent on the pump for water in the winter time and it appears more will have to use it in future Mr Campbell felt that the well should be tested, and a pit dui and a new pump installed The regarding ridging in fields for prevention of snow -drifting on municipal roads It was agreed that permission must be obtained from thE: land owners before the work is done, and it was generally agreed that the motor grader men should advise each councillor of the location for ridging and the councillor is to obtain permission from the landowners It was moved by Mr Campbell that the
