Ift, �I COUNCIL MEETING DECEMBER 5th, 1977 The meeting of Council of the M D of Kneehill #48 which adjourned on November 28th, 1977 was reconvened at 9 00 A M , December 5th, 1977 in the Municipal Office in Three Hills Those present were PRESENT Gilbert A Berdahl Division 1 Clifford W Poole Division 2 Ralph W Brown Division 3 (Reeve) Art W Bauer Division 4 Vn T A Ferguson Division 5 Leonard Litz Division 6 Reginald Campbell Division 7 Mr G G King, Secretary- Treasurer was present for portions Lf of the meeting, and Mr J C Jeffery, Assistant Secretary- Treasurer was present for the meeting Mrs Jean Wilkinson was present and recorded the minutes Mrs Ada Major, Representative from the Three Hills Capital was present for portions of the meeting FOREMEN'S Mr Jeffery reviewed the minutes of the Foremen's Committee COMMITTE Meeting of November 24th There was brief discussion regarding MIN the minutes Mr Campbell noted that Mr Soder had previously requested a belly mount mower for the A S B and this should be included ✓1 in the budget discussions for 1978 After discussion of various items, Mr Berdahl moved approval of the minutes Carried RECREATION A report regarding the recreation meeting held on November MEETING 29th was given to the meeting and the minutes from the MINUTES meeting reviewed It was noted that for provincial grant purposes it is necessary to have boundaries established so there is no question what area a certain development would be in It was rioted that a second meeting to discuss the population breakdown and boundaries had been set for December 19th, 1977, and only two representatives from each council would attend that meeting Mr King had made several suggestions 1 A change in the boundaries he previously drew up moving the Trochu -Three Hills south boundary one mile south and moving the Carbon -Acme boundary one mile east 2 The need for a definite decision from the City of Drumheller as to whether they will participate with the M D In a Regional Recreation Area or not Mr Jeffery read a copy of a letter sent by Mr RoyArchibald to the Town of Trochu with regard to their application for matching provincial grant This letter stated it would be best for Trochu to hold up submitting its grant application until the population figures can be finalized There was discussion regarding the affect a change in population figures would have on the Trochu application and also the affect it would have on a rural community getting any funds from the government on a matching grant basis Mr Ferguson moved that the M D recommend the boundary between the Troc hu in hs %Se2�iltR gepe�.t' Vr areas be moved 1 mile south t makln e Tr chu Area the same area as previously outlined when the vote was taken on the Trochu Swimming Pool project Carried .y r Poole moved that the boundary between the Acme and arbon Recreation areas (the boundary from 575 south to umber 9) be moved one mile east Carried 2 �p R S r COUNCIL MEETING DECEMBER 5th, 1977 rdwlj There was discussion regarding the Linden and Acme population figures and the possibility of adding the two areas together and dividing that figure between v` the two areas because of their close proximity However no definite recommendation was made Mr Ferguson moved a registered letter be sent to the Office of the City of Drumheller, with a copy to the Mayor, advising that the City must make a definite decision prior to the December 19th meeting as to whether the city wishes to participate with the M D in the regional recreation area agreement If no decision is made by the City by that date the population figures for that area of the M D close to the City will be re- distributed among w the other areas Carried After brief discussion, Mr Poole moved that Ralph W Brown and Gilbert A Berdahl be named as M D representatives to attend the Recreation Board Meeting set for December 19th, 1977 Carried Mr Brown noted that he and Mr Jeffery had been f utiL' LD flown to the City of Lethbridge recently by Neufeld INDUSTRIES Industries to view their sanitary land fill equipment COMPACTOR and trucks and other equipment which they manufacture TRUCKS ETC There was brief discussion regarding their compactor /I truck, bumpers, etc Mr Ferguson noted that the Unifarm Association had asked him who they should refer suggestions to regarding the operation of the sanitary land fill and Mr Ferguson had referred the Association to Mr Brown. as our representative on the Kneehill Sanitary Land Fill Committee A copy of a letter from Alberta Environment addressed ACME RECREATIO to the Village of Acme regarding the Acme Recreation RESERVOIR Reservoir was read to the meeting d It mentioned that a meeting will be cal in the near future to discuss the matter in more detail A Mr Campbell moved to accept and file this letter as information Carried Letters of thanks from the Hudson Bay Route Association LETTERS OF Unifarm Association and Elks Rodeo Committee were read to the meeting Mr Bauer moved to accept and file as ✓� THANKS information Carried A report was given to the meeting regarding grants promised to the three seed plants this past year, and Mr King had reviewed the existing legislation which authorizes the M D to make such grants Mr Poole noted that the KIBA Seed plant would like a committment from the M D of $15,000 00 over and above its previous committment of $3750 00 After lengthy discussion of this matter, and noting, that giving such a committment would establish a precedent for the other two plants in the area, and also noting that 1978 budget figures have not been looked at, Mr Brown moved that a total grant of $15,000 00 (to include the previous grant promised to the plant of $3750 be committed to the KIBA Seed Plant for use in construction of the new plant, providing the County of Wheatland and the M D of Rocky View make their proportionate contributions to the new plant I� / MOTION DEFEATED KIBA SEED PLANT GRANT 1A 00) V`� 40 COUNCIL MEETING DEGniri,D�R 5th, 1977 P 3 Mr Campbell and Mr Ferguson both noted that this Vi matter might be reviewed when the 1978 budget is set There was brief discussion regarding the percentage share which the M D accepts in regard to the plant at Beiseker It was noted that the M D accepts responsibility for 25% with the M D of Rockyview and County of Wheatland accepting responsibility KIBA SEED P for 50% and 25% respectively This percentage GRANT breakdown was used in connection with matching grants for up- grading of plants Due to the number of shareholders in the M D !! using the plant at Beiseker, it was felt that perhaps the M D could increase its committment from $3750 00 to $5000 00 Mr Berdahl moved that the 1977 grant promised to the KIBA Seed Plant of $3750 00 be increased to $5000 00, on condition that this sum be used 471 towards the costs of construction of a new plant, and on condition that the M D of Rockyview and the County of Wheatland make committments for contributions as well Carried Mr Bauer moved that the Council do now go into COMMITTEE a committee as a whole for discussion of wages ✓) TO DISCUSS for 1978 1978 WAGES Carried Time - 11 15 A M Mr Ferguson moved that the Council meeting_ do now continue V� Time - 3 20 P M It was noted that the Council had discussed the 1978 wage situation, but no decisions were reached V� The 1977 Annual statement from the Swalwell & 1977 FIN District Curling Club and Community Center was STATEMENT read to the meeting After discussion, Mr Poole 0 SWALWELL COM moved to accept and file the report aS information CLUB Carried ton Minutes of the Torring /and District Recreation Board TORRINGTON meetings of July 27th, 1977 and October 26th, 1977 v/) REC MINUTES were briefly reviewed Mr Campbell moved to accept and file as information Carried Minutes from the Regional Resources Project meeting REG RESOURI of November 22nd were reviewed, with particular V1 MINUTES reference to the request by the Board for money from NOV 22/77 the Provincial Government to establish a pilot project for sanitary land fill Mr Poole moved to accent and file same as information Carried A letter from Glenn Smyth requesting cancellation of G SMYTH his 1977 licence fee on his mobile home was read to CANCELLATION Council After discussion Mr Ferguson moved that v LIC FEE the licence fee for 1977 be cancelled Carried Mr Jeffery noted that a business tax levied against K NYGARD Mr Ken N,ygard for sale of farm equipment from NW CANCELLATION 30- 29 -22 -4 was an error Mr Litz moved that the BUS T X business tax levied in the sum of $ 21 60 r be cancelled Ali CARRIED J COUNCIL MEETING DECEMBER 5th,1977 Canadian Broadcasting Corporation have advised that it will not pay a grant in lieu of taxes on tower or transmitter equipment The grant in lieu of taxes was set at $1278 93 and the Corporation have paid only $742 84 The balance V� owing of $536 09 should be cancelled Mr Berdahl moved that the balance of the grant in lieu of taxes assessed against the C B C be cancelled P 4 C B C CANCELLATION GRANT IN LIEU OF TAXES Carried PERMIT Building permits issued were reviewed as follows BUILDING Robert F Catonio - NW 22- 28 -20 -4 - Metal Quonset Mr Ferguson moved approval of the permits as issued Carried Mr Jeffery reported on the policies now in effect POLICY RE for water and sewer charges in Wimborne and Grantville RUARKVIL as follows WATER & SEWER 1 Charge for turning water on and off - -$6 00 for turning on and $6 00 for turning water off 2 Water Account not paid at the end of three months - water may be turned off 3 Monthly rate covers 4000 gallons of water - number of gallons over 4000 per month charged at $1 50 per thousand 4 Meters are read every 3 months - residents billed monthly with meter reading every 3 months Mr Berdahl moved that the same policies be in effect for Ruarkville water Carried Replies have been received from the R C M P , Three Hills School Division, Three Hills Hospital and Plains Western Natural Gas naming representatives to the M D Disaster Service Agency as follows 1 Three Hills School Division - W C Adrian, with Les as alternate 2 Plains Western Gas & Electric Co Ltd - Jim Oakes 3 R C M P - A M McLeod 4 Three Hills Hospital - Mrs L deBeaudrab Mr Bauer moved to accept the correspondence and file as information Carried J\ M D DIS SERVICE AGENCY Campbell PEACETIME The matter of the M D Peacetime Mutual Aid Agreements MUTUAL AID with other municipalities was briefly discussed AGREEMENTS Mr Poole moved to table this matter until Mr Cunningham is able to be present to discuss the matter VI) Carried ROAD RENTAL The matter of the need for rental of land for road J SAILER access in SE 36- 34 -22 -4 was briefly discussed Mr Campbell moved to table this matter until he is able to discuss SE 36 -34- 2 the matter with Mr Sailer , Carried The matter of the land required for the M Anderson M Anderson Bridge at SW 17- 30 -22 -4 was briefly discussed and ✓1Bridge Mr Poole moved that Council should start negotiations SW 17-30-22 - for the land required for the bridge Carried Mr Campbell noted that he had discussed the Postill Postill Stoc Pile Site 5 '�4�v COUNCIL MEETING DECEMBER 5th 1977 stock pile site with Mr William Postill and he had no objections if Council paid for a portion of a year only After brief discussion, Mr Poole moved that Mr Postill be paid for a full ,year's rental for the site Carried A letter from Gordon Park of the Surface Reclamation Board was read to the meeting An inspection had been made of the coal test holes at SE 17- 30 -21 -4 and SE 13- 30 -22 -4, and the sites were cleaned up by the company involved in October The wet weather had delayed the clean up Mr King noted that Mr Watt who had mentioned the poor job done on clean up had since called to say the clean up had been done Mr Ferguson moved to accept and file this as information Carried P 5 VA SURFACE RECLAMATION TEST HOLES COAL EXPLOR V1 Alberta Power Ltd submitted plans for two power ALTA POWER line extensions as follows ff LINE EXTENSIO] 1 LSD 8 and 16 of 31- 32 -24 -4 \J 2 LSD 6 of 13- 33 -25 -4 Mr Bauer moved approval of the extensions as per plans submitted Carried Mr Jeffery noted that Mr Edward Schlag had EDWARD SCHLAG called at the office some time ago and was very upset about the letter he received concerning the ownership of the ditch past his property J` Mr Litz noted that he had discussed this matter again with Mr Schlag It appears nothing further is required Mr Bauer moved to accept and file the report Carried BY -LAW Mr Jeffery noted that By -law 838 which was previously given two readings was advertised in the Three Hills ROAD Capital for two issues in October, and the notice of proposed closure and sale of the road allowance was sent to the adjoining land owners No objections having been received to the proposed closure and sale, Mr Poole moved third reading to by -law 838, authorizing the closure and sale of the portion of the road allowance adjoining the south boundary of Section 29 in Township 29, Range 24, West 4th lying to the east of the production of the road on Plan L522 H X , and to the west of the railway on Plan R W 128 containing 2 34 acres more or less Carried Unanimously A letter from the Canadian Transport Commission regarding the railway crossing at Huxley was read to the meeting The Commission noted that the crossing which was removed was a private crossing and if Mr Heer is suffering a hardship, he should make application to the C N R for a private crossing at a location suitable to himself and the railway Mr King suggested that the C N R should be required to i CLU,--)urcP LA C T C RAILWAY CROSSING E HEER guarantee that the road access on their property on the west side of the tracks will remain open at all times in the future After discussion of this matter, Mr Campbell moved that`1 a copy of the letter from the C T C be sent to Mr the future P Carried � �'� 6 JS [A 9 L----,2 COUNCIL MEETING DECEMBER 5th, 1977 are There was brief discussion regarding the Gieck and Brost access problem near Grainger, and Mr Poole moved that the C P R be requested to grant a long term easement on the north east side of their north track off Secondary Road 575 and running north westerly along their railway right of way to the north south road allowance to provide access to the South East Quarter of 29- 29 -24 -4 and other lands The C P R would retain the necessary width required for wide loads hauled by train Carried Mr King noted that Seiscan Seismic had been requested to drill some holes in the J Lowen Gravel pit and arrangements were made to blast the pit in order N to shake loose the gravel No costs for this work are available as ,yet, but it was necessary to have it done for safety reasons and for time factors involved Mr Berdahl moved to accept and file this report Carried An application for work has been received from Robert Tindal of Huxley Mr Poole moved to refer the application to Mr Paquette V II, "Q-y � Carried Mr Brown noted that Mr R-e- t Thiessen is not happy with the location of the crusher at his gravel pit, nor with the location of the gravel stock pile Mr King outlined the reasons for the change in location, which involved lack of room for the crusher, and a gas line Mr King also noted that the next time bids are called for gravel it should specify the size of rocks which are to be crushed, as a lot of rocks are being thrown off the crusher at the Thiessen pit, which perhaps would be suitable for gravel, GIECK BRO ACCESS VA BLASTING AT J LOWEN GRAVEL PIT APPLICATION FOR WORK R TINDAL THIESSEN GRAVEL PIT M Mr Poole moved that the Road Committee along with Mr King and Mr Paquette check the Thiessen Pit to determine the size of rocks being rejected by the crusher, and also check the Megll Pit to determine the amount of stripping done Carried It was agreed the committee would meet at 9 00 A M Tuesday, December 6th for this purpose A letter received from Howard Helton of Three Hills regarding the gate on the municipal road allowance leading in to his property was read to the meeting After discussion of the matter and noting that the M D cannot accept any responsibility for damage .1 to the gate by any equipment, Mr Bauer moved to accept and file as information Carried Mr Campbell noted that Mr William Ottosen of Huxley maintains that the grass was not seeded in the ditch along the west side of Section 26- 34 -23 -4 fj Mr Ottosen had submitted an account for 11 hours work with a tractor and rock picker and three hours with a tractor and disc for work on this ditch After discussion, Mr Campbell moved that Mr Ottosen be paid for the work done at government rates for a 50 horse power tractor and the appropriate equipment Carried HOWARD HELT GATE ON MUN ROAD W OTTOSEN ROCK PICKING ACCOUNT Mr Jeffery noted that the Village of Linden has now VILLAGE OF paid $2422 71 owing for the road oil account previously LINDEN in dispute The balance of the account of $576 35 ACCOUNT is cancelled as agreed upon by Council 1 'T L COUNCIL MEETING DECEMBER 5th, 1977 WA A report regarding the new areas set up by Alberta Transportation was referred to the meeting ALTA TRANSP The M D of Kneehill is now in the Hanna District NEW AREAS and the Regional Office for this area will be located in Airdrie ✓ Mr Berdahl had brought the map of the various areas to the office for our information Mr Berdahl moved to accept and file this as information Carried A circular from Alberta Transportation regarding ALTA TRANS their new axle weight program was referred to the AXLE WEIGHT meeting Mr King noted that McLean Brothers Trucking PROGRAM from Drumheller telephoned and asked if the M D is considering an increase in its maximum load limits" for the winter months M D Starland has increased its maximum load limit to 80,000 pounds during the winter months After discusson, Mr Lit moved that no increase be made in gross vehicle weight or he winter months Mr Berdahl moved to accept and file this report as information Carried The Grimble Consulting Group of Calgary have extended `INVITATION an invitation to attend their Christmas Open House in their GRIMBLE new office in Calgary Mr Bauer moved to accept and file CONSULTI as information GROUP Carried A letter from the Alberta Land Surveyors Association LETTER ALTA was read to the meeting Mr Litz moved to accept '' LAND SURVEYORS and file as information Carried ASSOC Mr Jeffery noted that the M D as successor to the Village GRAVEL of Swalwell is the owner of one half an acre in SW 15- 30 -24- PIT AREA 4 , which was formerly used as a gravel pit SW 15 -30 Mr Abraham Penner owns the balance of the quarter section 24 -4 Mr Penner had requested compensation for black dirt removed from his land during construction of the Swalwell V17 Access Road After discussion of the matter, Mr Brown moved that the one -half of an acre in SW 15- 30 -24 -4 be sold to Mr Abraham Penner for the sum of $1 00 on the condition that he accept the land in full settlement of all claims which he may have against the Municipal District of Kneehill #48, and on condition that the land be consolidated back into title with the balance of the quarter Carried A booklet containing all the resolutions passed at the Lowen of Drumheller DEATH passed away on November 28th, 1977 J LOWEN Mr Lowen had just recently granted a one year lease to the M D for gravel removal on his land - SE 16 -29 -21 It was agreed that at a later date the executors of Mr Lowen's estate should be contacted with a view to obtaining an extension of the gravel lease V° Mr Berdahl moved to accept and file this report as information Carried NOVEMBER Mr Brown read a letter he received from tr"e APPRECIATION County of Palntearth regarding an appreciation NIGHT FOR GU' night being held for their retiring secretary, V/11 TOMILSON Guy Tomilson on Saturday, December 17th, 1977 in Castor Mr King noted he will be attending if weather conditions permit Mr Poole moved to accept and file as information f Carried Mr Berdahl noted that one resolution passed at RESOLUTION the recent Health Unit Convention requested AT HEALTH that any subdivision in a rural or hamlet area UNIT CONV must provide for a lagoon area for sewage disposal Despite arguments against the resolution It passed Mr Jeffery noted that two councillors had been SECRETARY FOR appointed to attend the Recreation Board meeting �`' REC MEETING, scheduled for December 19th, and wondered about the need for someone to attend to act as Secretary for the meeting Mr King noted that the Judicial Recount for DATE FOR JUD Division 2 has been set for 10 00 A M December 20th RECOUNT in Calgary Mr Poole moved that Mr G King or an alternate n SEC FOR RE be named to act as Secretary to the proposed Recreation MEETING Board meeting scheduled for December 19th, 1977 Carried Mr
