line extensions 42 Minutes - Three Hills Sch Division Meeting Oct 1877 & 27/77 43 Alta Consumer & Corporate Affairs - re Morley Buyer 0 ., 11 Meeting Recovened 10 30 A M COMBINED MEETING OF THE COUNCIL AND AGRICULTURAL SERVICE BOARD OF THE M D KNEEHILL #48 A combined meeting of the Council and Agricultural Service Board of th M D of Kneehill 448 was held in the Municipal Office, Three Hills, on Monday, November 28th 1977, commencing at 9 00 A M Those present were* Clifford W Poole, Councillor Division 2 Ralph W Brown, Reeve Division 3 14 Art W Bauer, Councillor Division 4 Leonard Litz Councillor Division 6 Reginald Campbell, Councillor Division 7 Chairman Neil Hempel, Ratepayer Member Harry Church, Ratepayer Member Norman Soder Ag Fieldman and Glenn Smyth, Assist Ag Fieldman J C Jeffery, Assistant Secretary- Treasurer Herman Martens, Secretary to the Ag Service Board Mrs Ada Major Representative from the Three Hills Capital Mr Campbell Chairman of the meeting introduced Mr Harry Church new member on the A S B , and Herman Martens, new Secretary to the Ag Service Board Mr Campbell moved that the minutes of the meeting of November 7th V1 be adopted as read Carried Fieldman's report was read by Norman Soder, copy of which is filed with the minutes see �.ij rn NUS1 After discussion Mr Brown moved that Mr Soder investigate the possibilities of letting farmers cultivate the unused portions of cemeteries Carried CORRESPONDENCE 1 A S B Grant Guidelines for 1978 2 Howard Fulcher - letter regarding Resolution #8 - Compensation for crop damage done by wildlife 3 Letter of appreciation written by A S B regarding water tank and pump operation to Mr Al Reimer 4 Letter of thanks for use of seeder and combine sent to Mr Jim Wright Moved by Mr Litz that we accept and file the correspondence Carried AGRICULTURAL SERVICE BOARD ACT Moved by Mr Brown that copies of the Act be obtained and given to each of the ratepayer members and each of the counillors Carried Mr Poole moved the meeting do now adjourn and Council sit as a Dev Appeal Board Carried Time 10 15 A M AGENDA - Regional X62 Conference - The proposed agenda was read and discussed Mr Poole moved acceptance of the agenda as presented Carried AAMD & C RESOLUTIONS The resolutions pertaining to the A S B were discussed 1 The resolution that a $5 00 penalty would be imposed on all warble infested animals sold in stockyards and packing plants was passed 2 The resolution requesting assistance in the spraying of railway right of ways was also passed SOIL SALINITY - Moved by Mr Brown that a meeting be set up to create and promote interest in alkali control, also to get farmers to make a financial committment to support a test project Carried BURROW PIT AND ROADSIDE BACKSLOPING Moved by Mr Poole that a new agreement form be drawn up and used which includes legal description and type of grass to be planted This matter is to be discussed further at the Shop and Foremen Meeting AGRICULTURAL FIELDMAN'S UPGRADING - A course in Edmonton was very interesting and informative stated Glenn Smyth MINUTES TO THE CAPITAL - the C onsensus of the. meeting was that COMBINED MEETING OF AGRICULTURAL SERVICE BOARD & COUNCIL MONDAY, NOVEMBER 28th, 1977 P 2 the Fieldman's report or highlites from his report is all that requires publishing FIREWOOD FOR PARKS Alvin Keiver has offered us some wood for Keiver Lake Park Mr Poole informed the meeting that the old Swalwel skating rink walls are also available for firewood The walls are to be hauled to the Dark to let the campers dismantle them as needed It was mentioned that nails and unburnable plaster may create problems in the future Fire wood from brushing was discussed and it was recommended that the wood be cut into large lengths to decrease pilferage A S B SENIORITY - It was recommended that Otto Kurta be considered for the gravel hauling crew due to his service with the Service Board WEED NOTICES Norman Soder reported that some areas have had long and expensive court cases with appealed weed notices EMERGENCY WATER TANKS - one will be in Wimborne, one in hree Hills and one in Carbon It was felt that the fire departments could make use of this equipment in these areas RIGHT OF WAY - on the road north of Acme between the railway and road may be let out to control the weeds Mr Brown is to contact Mr Orville Snyder to see if he would be interested in some lease arrangement Mr Brown then moved the meeting do now adjourn Carried Time of Adjournment 11 45 A M Secretary to the Board IR COUNCIL MEETING NOVEMBER 28th 1977 Following completion of the combined meeting of Council and the Agricultural Service Board held in the forenoon, a regular meeting of the Council was held commending at 1 00 P M Those present for Clifford W Poole Ralph W Brown Art W Bauer Leonard Litz Reginald Campbell the meeting were Division 2 Division 3 (Reeve) Division 4 Division 6 Division 7 Mr G G King Secretary- Treasurer Mr J C Jeffery, Assistant Secretary- Treasurer Mrs Jean Wilkinson was present and recorded the minutes PRESENT Mrs Ada Major,representative from the Three Hills Capital was also present Mr. King noted that there should be two corrections to the minutes of the meeting of November 10th, 1977 as follows Page 8 - name R Cheek is incorrect - should read S J Tepper Page 7 - land description - Sheldon McGougan - NE 28- 33 -22 -4 +� is incorrect should read Pt N1-2 28- 33 -22- -4 APPROVAL MINUTE. Mr Poole moved approval of the minutes of November 10th,1977, subject to these two corrections Carried Mr Brown noted the proposed road into the sanitary land would require crossing land owned by Mr M Arvidson or Mrs Perry's land not both There was brief discussion regarding the difference between V'11 a single wide mobile and a trailer GRAVEL CRUSHIN Mr Tony Hopkins of Hopkins Construction Ltd entered the meeting at this time., together with Mr Paquette and Mr G Rempel Council reviewed with Mr Hopkins the yards of gravel to be crushed at the various locations, and it was noted that two new locations have been added to the list for crushing, one at the Thiessen pit south of Linden and one at the J Lowen pit near Drumheller V Mr Hopkins noted that they will soon have crushed approximately 87 000 tons at Torrington, which will be close to 60,000 cubic yards It was noted that 20,000 yards are to be crushed at the Garson pit, 10,000 at the McNair Pit, 20,000 at the Thiessen pit and only 40,000 yards at Megli and not 60,000 as previously agreed Mr Brown noted that Mr Thiessen wishes to have some gravel crushed for his own use at the Thiessen pit and Mr Hopkins agreed to see Mr Thiessen regarding this matter V% Mr Hopkins stated he would have a look at the Thiessen pit before making any committment as to price for crushing this gravel, �e because it would involve another move Mr Brown noted that the gravel at the Lowen pit is now being stock piled by the M D crew on top of the hill Mr Paquette stated there is approximately 4000 yards stockpiled there ready for crushing and it is hoped to have at least 10,000 yards ready for v', crushing before Mr Hopkins moves his outfit there There was discussion regarding where the crusher should move next Mr Paquette noted the stripping is nearly done at the Megli pit Mr Hopkins noted it would be best to move in an orderly pattern w1 perhaps going to the Thiessen and Megli locations next Mr Hopkins then left the meeting to have a look at the Thiessen stock pile and agreed he would contact council later in the day Mr Campbell moved that Council agree to crush the following quantitie of gravel Thiessen Pit 20,000 yards Megli Pit 40,000 yards Torrington Pit 60 000 yards Garson Pit 20,000 yards McNair Pit 10,000 yards Lowen Pit 10,000 yards Carried Mr Poole moved that Mr Hopkins be allowed to arrange his moves in whatever manner is best suited to him Carried 2 �r COUNCIL MEETING NOVEMBER 28th, 1977 P 2 Mr King reported to Council regarding marks obtained by D KNAPP Mr Douglas Knapp for his second year welding course 2nd YEAR Mr Bauer moved acceptance of the report and directed WELDING COURSE a letter of congratulations be sent to Mr Knapp vA MARKS Carried A letter received from Mr Tom Lynch of Trochu regarding McGOUGAN road access through Mr SheldonMcGougan's property ACCESS FOR was read to the meeting Mr Poole moved that a letter LYNCH. be sent to Mr Lynch acknowledging his letter and the land descriptio change he outlined in the letter, and expressing thanks for same Carried Carried Mr Abraham Penner of Swalwell has complained 1 Mr Lloyd Weigum, owner of SE 3- 33 -24 -4 has indicated 'GRAVEL there may be gravel on his property and would be willing TESTING to sell gravel to the M D if testing indicates gravel SE 3-33 - is there Mr Litz moved that testing for gravel farm in wet be done on Mr Weigum's property, and terms negotiated L WEIGU for a lease 00 but RE SWAL- Carried Mr Abraham Penner of Swalwell has complained that ABRAHAM OVERPASS more black dirt that was necessary was removed from his PENNER HILLS land in connection with the Swalwell Access Road construction M D to discuss this matter and this left one area too low to farm in wet years COMPLAINT that Council should make He wished compensation paid in the sum of $250 00 but RE SWAL- in detail A letter received noted that if the dirt is replaced no further compensation WELL ACCES� they are now ready to would be necessary proceed with the new structure at this location and wish ROAD that it will share in the Mr Poole noted that an old gravel pit area on this quarter was filled by the M D for Mr Penner at the time of the road construction ` �f► Mr King noted that there is a possibility that the M D may own this old gravel pit area Mr Poole moved that this matter be tabled pending receipt of information regarding the ownership of the old gravel pit area, which is approximately an acre Carried Mr King reported that Mr Ed Mazurek from Alta C N R Transportation in Red Deer telephoned him regarding OVERPASS financial sharing for railway improvements such as SOUTH 3 the proposed C N overpass project south of Three Hills HILLS Alberta Transportation are attempting to set up a meeting with C N R and the M D to discuss this matter A tentative date set is 10 00 A M Tuesday, November 29th 1977 Mr Mazurek stated that Council should make no committments to the C N R regarding this project until the matter can be discussed in detail A letter received from the C N R regarding this project was also read to the meeting C N R advise they are now ready to proceed with the new structure at this location and wish confirmation from the M D that it will share in the costs for this project Mr Bauer moved that a committee of Mr Litz and Mr Brown be appointed to meet with the C N R , and Alberta Transportation to discuss this project, at such time as a meeting can be arranged Carried Mr King advised Council that a meeting was held with Alberta Energy Resource Conservation Board representative, Mr Metro Kozial, Mr Al Ronney representative from Western Land Services and Mr Jerry Penner, land. owner with regard to the well site in LSD 8- 30 -24 -4 It was agreed that the well site is too close to the Swalwell Dam Terms of agreement reached were. location to be moved to a site further to the west over the brow of the hill, a dike to be constructed to prevent any spillage into the coulee the inlet road to be along the south side of the east west fence, and the west boundary not to be beyond the south north fence and further that the company make a new agreement with the land owner for the site location 3 a OIL WELL SITE & SWAL WELL DA NIL COUNCIL MEETING NOVEMBER 28th, 1977 Mr Campbell moved acceptance of this report Carried Mr King reviewed the matter of gravelling a road damaged by Mobil Oil and also the road improved by the M D at the request of Mobil Oil on condition that Mobil Oil gravel the road After discussion of the matter and noting that the M D had in fact gravelled the roads and Mobil had agreed to pay for the gravelling, Mr Poole moved to accept and file the report as information Carried IT WAS noted that Mr Rempel is to submit figures of number of yards of gravel used on the roads so an account may be sent to Mobil Oil P 3 MOBIL OIL ROAD IMPROVEMEN S ETC LA A letter from Dr Hugh Horner, Minister of Transportation PAVING was read to the meeting and noted that the government #27 EAST is considering paving Highway 27 east in its budget negotiations over the next two years Mr Litz moved acceptance of this letter and directed that a letter be sent to Dr Horner thanking him for his consideration of this matter Carried Mr Ron Toews of Three Hills has requested relaxation RELAXATIO of municipal setbacks in connection with a development MUN SET on his land - SW 6- 32 -24 -4 He wishes to move the BACK building onto his farm for use as stora e for farm mac1, R Toe g ery, and put it in line with his other buildings. The set back will be only 115 feet from the center line of the road, rather than the required 134 feet from the edge n of the property J Mr Bauer moved that the relaxation be granted to Mr Toews - to 115 feet from the center of the road Carried Alberta Government Telephones have plans for buried A G T cables at BURIED r +, 1 North of 22- 28 -20 -4 f CABLES Mr Poole moved approval of this request Carried 2 West of 6 and 7 in 32 -25 -4 Mr Litz moved approval of this request on condition that the cable be buried in the ditch near the toe of the grade Carried Associated Engineering Services Ltd , submitted revised CROSSROAD plans for road crossings for the Crossroad Gas Co -Op Ltd CO -OP They wish a road crossing on the north south road allwoance ROAD between LSD 13- 31- 32 -23 -4 and LSD 16- 36- 32 -24 -4 � CROSSINGS Mr Bauer moved approval of this road crossing subject to compliance with municipal regulations Carried Mr Rempel reported that the gravel crew is now working G REMPEL from the Torrington Pit He also noted that the REPORT Correction Line new grade has been gravelled, but may require another lift of gravel in spring Mr Rempel also mentioned that work will be done on the roads in Ruarkville within the next day or two Mr Myles Maerz is working on the gravel crew now, having obtained his number 3 licence dust recently, and Mr Rempel noted he is working out very well It was noted that Mr Otto Kurta has seniority and should be considered for work on the gravel crew if opening s arise Mr Rempel stated that J B Ross Trucking no longer has a truck working with the crew Mr Poole asked if the crew would have time this winter to tear down the old Swalwell skating shed for fire wood, and Mr Paquette agreed that this could probably be done A i COUNCIL MEETING NOVEMBER 28th 1977 P 4 Mr King reported that Mr Berdahl had contacted Mr ACCESS Kenneth Lowen of Drumheller in connection with access TO J LOW to the Jack Lowen gravel pit Mr Lowen wishes GRAVEL P $150 00 compensation to allow access for the M D� THROUGH K It was noted that the road access through Mr Ken LOWEN LAND Lowen's land would be z mile Mr Poole moved that Council agree to pay Mr Lowen C)fA V�J' $150 00 for access through his land, SW 16- 29 -21 -4 90 to the Jack Lowen gravel pit site,such payment to be %A o �fl3 for the term of the lease, and further that Mr Berdahl FOB' nZ CA continue with the negotiations with Mr Lowen to arrange any other terms which may be necessary Carried After discussions with Mr Rempel regarding gravel GRAVEL stock piles sites, it was agreed that Mr Rempel �_'. STOCK PIL should stock pile about 5 000 to 6500 yards at the Marshman stock pile and none at the Beynon and #9 stock pile this year A letter from Tom Slater of Alberta Environment, Water T SLATER Resource Management Division was read to the meeting MEETING WI' Mr Slater stated he would be willing to attend a COUNCIL Council meeting on December 12th, and reviewed various DEC 12/77 items he would like to discuss with Council / Mr Poole moved that Mr Slater be invited to attend the Council meeting on December 12th, at 2 00 P M , and Mr Keiver be invited to attend the meeting also Carried It was agreed that Mr Bauer contact Mr Keiver regarding this meeting, and also that Mr Ferguson be contacted regarding the need for Mr Permann and Mr Johnson to be invited to the meeting in connection with the Orkney Drainage Project Mr Elmer Albretch had complained that the north south road by his property - SW 7- 33 -24 -4 has not been maintained this year and it was agreed this matter should be checked Mr Rempel noted that the gravel crew is now on a triple shift EMPLOYEE - It was agreed that the Employer- Employee Committee should EMPLOYEI have a meeting soon to commence wage negotiations Mr Bauer MEETING moved the meeting be held Monday December 5th, 1977, at 0 WAGE 7.00 P M EGOTIATION! ;N :T ►A Mr Campbell requested Mr Paquette arrange for a water truck to be sent to the Trochu Rural Fire Department f MIS ITE S for the winter months It was agreed that some brushing should be done this winter and Mr Paquette was given various locations which require brushing Mr Bauer noted that an approach had been requested at NE 22- 32 -25 -4 and Mr Paquette agreed to check into this matter Mr Cunningham entered the meeting at this time Canadian Western Natural Gas Company have requested permission for various road crossings as per plans submitted After discussion of the plans Mr Poole moved approval be granted to the company for the road crossings as outlined by Mr Cunningham Carried Pan Canadian had requested permissions for various road crossings as per plans submitted Mr Cunningham had checked these and outlined two changes which he felt should be made Mr Campbell moved approval of the crossings as per plans submitted, subject to the changes as outlined by Mr Cunningham, and subject to compliance with other municipal regulations Carried 5 i f C W N ROAD CROSSINGS A V PAN CANAD At RD CROSSING: COUNCIL MEETING NOVEMBER 28th, 1977 Alberta Utilities & Telephones submitted maps GAS CO -OP showing the boundaries of the various gas co -ops in MAPS our area Mr Cunningham had checked same and stated the maps merely outlined the franchise areas for the co -ops Mr Poole moved to accept and file same as information Carried Mr Rempel requested the radio equipment at Mr Dobler's RADIO home be moved to his residence and it was agreed that TO G REMPE Mr Cunningham do this as soon as possible J, RESIDENCE There was brief discussion regarding sub - foremen on the gravel crew and it was agreed that no appointments be made at this time A letter was received from Alberta Environment regarding WATER & a water and sewage operator's course Mr Cunningham SEWER noted he would like to attend the basic course which is COURSE scheduled for January 30th to February 3rd A CUNNINGH Mr Brown moved that Mr Cunningham be authorized to attend this course Carried A report from the Fire Commissioner's Office was then FIRE REPOR reviewed It was noted that the M D was credited with a fire that actually occured in the Village of Acme The Fire Commissioner's Office had been advised of ff� this error Mr Campbell moved to accept and file as information Carried BUILDING Building permits as issued were then reviewed as follows PERMITS Les Crawford - Three Hills, Grain Storage Building NW 24- 31 -23 -4 Douglas Parker, Three Hills Double Car Garage - Lots in Twining ,A Don Klassen Linden, Barn - SW 3- 30 -25 -4 W` Mr Brown moved approval of the building as issued Carried C P R Mr King and Mr Cunningham reported to Council regarding WTMBORNE a request from the C P R for a water line from Wimborne WATER LINE to their property west of Secondary Road 805 and east of the tracks They have moved a building on to their property and wish to hook it up to water and perhaps install a septic system Mr Cunningham stated that perhaps when boring the secondary road 805 for this line a larger casing to accomodate up to a 4 inch water line should be installed This would avoid boring the road again if a larger line to this area should be required in future, particularly in view of the possible expansion of the hamlet Mr Litz moved that a water line be installed for the C P R using a 6" casing for crossing the secondary road 805, and the costs for the water line be charged to the C P R Carried Mr Jeffery reported regarding the photo copier left PHOTO on demonstration by Looker Office Equipment Looker COPIER Equipment will sell the copier to the M D for $2845 00 including the metal stand the one extra cassette The company would allow $350 00 as a trade in on our old machine ", After discussion of the matter, it was agreed that the old copier be put up for sale by tender Mr Poole moved that the photo copier from Looker Equipment be purchased at a price of $2845 00 including the stand and one extra cassette Carried Mr Bauer moved that the old copier be advertised for sale by tender in the next two issues of the Capital with bids to be received by December 12th, 1977 � Carried �� (, 6 COUNCIL MEETING NOVEMBER 28th, 1977 P 6 Mrs Anne Boake has advised that she would be available A BOAK to stay until December 16th, 1977 if Council would be EMPLOYMEN agreeable V After discussion, Mr Poole moved that Mrs Boake be authorized to continue her employment until December 16th, 1977 Carried Mr King advised Council that Mr Tony Hopkins HOPKINS telephoned back and stated he would like an additional PRICE FOR 100, a yard to crush gravel at the Thiessen Pit, because GRAVEL of the move required CRUSHING AT Mr Brown moved that Council approve of the increase in THIESSEN price per yard for gravel crushing at the Thiessen Pit, - to be $1 17 per yard instead of $1 07 Carried Mr King noted that the tentative date of November 29th MEETING for the meeting with the C N R and Alberta Transportation WITH C N regarding the C N R overpass is too soon, and the & ALTA meeting will be held at some later date TRANSPORT Alberta Transportation again stressed the fact that Council should make no committment to the C N R until discussions regarding possible financial assistance for the project can be held Mr King also noted that Mr Hopkins felt additional THIESSEN PIT stripping would be required at the Thiessen pit to STRIPPIN allow for more space to set up the crusher It was agreed that Mr Paquette should meet with Mr Hopkins foreman at the site to discuss this matter Alberta Bridge Branch had advised by telephone that the BRIDGE bridge east of Trochu, which was damaged by a vehicle EAST TROCHU some time ago, will not now be repaired until next spring, REPAIR as the repairs require cement work The costs will be submitted to the M D for collection from the insurance company Mr King advised Council that the old cash receipting OLD CAS machine has recently be sold for the sum of $40 00 RECEIPTING The machine was a 1949 model and was not suitable for a MACHINE trade in on the new machine Mr Bauer moved approval of the sale of the machine at the sum of $40 00 Carried Mr Albert Stickel of Three Hills had requested Council CANCELLATIO to consider cancellation of a portion of taxes levied TAXES on his farm house - SE 32- 31 -25 -4 The house had been A STICKEL rented out for a six month period from October 1976 to April 24th, 1977 Since that time Mr Stickel has been lving at the farm �t ^kr Mr Bauer moved that one half of the taxes levied on the VN r4k V'IL farm house be cancelled The total taxes levied on the'Sv1 -`,,te house amounted to $288 25, and the cancellation will be $144 12 Carried CANCELLATION Mr King requested Council to consider cancellation of MOBILE HOM portions of two mobile home licences LICENCES as follows Lynn Jensen -
