( SEE OVER FOR EXPENDITURE CONTROL ) COUNCIL-MEETING---JULY-8th,-1977 A regular meeting of Council of the Municipal District of Kneehill ##48 was held in the Council Room Municipal Office, Three Hills, on Friday, July 8th, 1977 commencing at 9.00 A M Those present for the meeting were PRESENT Clifford W Poole, Division 2 Ralph W Brown Division 3 (Reeve) A. W Bauer Division 4 T. A Ferguson Division 5 Leonard Litz Division 6 Reginald Campbell Division 7 G. G King, Secretary- Treasurer was present for the meeting, and Jean Wilkinson was present and recorded the minutes APPROVAL OF The minutes of the meeting of June 27th, were discussed and MINUTES Mr Poole requested an amendment to the minutes on page 1 last line to read -- - - "as it affects the former Swalwell and Linden Nuisance grounds "" Mr Bauer moved approval of the minutes of June 27th, sub3ect to the amendment as requested by Mr. Poole Carried Mr Poole moved that the minutes of the Agricultural Service Board meeting of June 20th be tabled until Council meeting July 25th., 1977, which will be a combined meeting* with the A Carried The financial statement for the month ending June 30th, 1977 was referred to the meeting It showed a net balance on hand of $83,874 07 Mr. Poole moved approval of the financial statement Carried A A S. B MINUTES 8 S B FINANCIAL STATEMENT JUNE /77 PETITION FROM A letter was received from the majority of the residents SWALWELL of the hamlet of Swalwell in which they request an engineeringRESIDENT study for a modified sewer system for the hamlet be SEWER STUDY done Mr Poole moved that the firm of Underwood, McLellan & Associates be hired to carry out a study for a modified sewer system for the hamlet of Swalwell Carried SWALWELL Mr King gave a further report on various problems in PROBLEMS Swalwell The Melwood property is still unsightly and nothing further has been done towards cleaning it up Mr Poole moved that this matter be referred to Norman Tainsh, Solicitor, for the necessary action Carried. The Dunbar property - Nothing had been done by the previous solicitor and he had been requested to close his file. Mr Brown moved that Norman Tainsh, Solicitor, be consulted with regard to the Dunbar problem with a view to having the matter resolved Carried ,., 2 i COUNCIL MEETING JULY 8th, 1977 P 2 B 6 E Boyd Roberts Property Mr Roberts has commenced construction ROBERTS of his garage and it is located partly on the street PROPERTY The building permit issued for this development showed a setback to comply with municipal regulations GARAGE SET - He has requested the M D to narrow the street to L/I BACKS accomodate the garage, rather than having to move the building The surveyors have checked the site, and the building is definitely partly on the street Mr Campbell moved that Mrs Edith Roberts, the owner of the property, be advised that if she pays $250 00 to the M D, Council will, subject to required approvals being obtained, narrow Queens Street south of blocks 4 and 5 to a 56 foot width, and if approvals cannot be �� obtained, or if she is not willing to pay the required $250 00, then she must move the garage back on to her property Carried Mr Brown moved that no property owners in conni street. Vernon Court Property - lumber and junk located hotel. payment be required from other action with the narrowing of the Carried there are still piles of VERNON COURT on the property next to the old PROPERTY There is also a pile of lumber on the community center property ����,, Mr Poole noted that at various camp sites s has been at recently the wood is not cut up in small lengths for the camp fires Perhaps this would deter taking the wood from the camp sites, and if all this old lumber in Swalwell was taken to the Swalwell Dam, it might eliminate two problems Mr Litz moved that this matter be referred to the Parks Committee with power to act Carried A letter received from Mrs Kay Elliott was read to the OFFER TO meeting. PURCHASE She had made an offer to purchase Lots 5 and 6 Block 10 V n LOTS IN under Replot 2/77, on behalf of John Hamm, at a price SWALWELL of $400 00, and forwarded a cheque for $50 00 as a deposit on same. J HAMM Mr King advised Council he had discussed this matter with Mrs Elliott and also with Mr and Mrs Hamm and advised them that the price offered was too low, and also advised them of the building commi.ttment imposed by Council on the land Mr and Mrs. Hamm stated they could not commit to build within one year, and asked what penalty Council would impose for non - compliance with this condition .After discussion of this matter, Mr Bauer moved that Coun, i__l s policy for non - compliance with its one year building committment be 1 Forfeiture of 50% of the purchase price of the land 2 The purchasers do not have any right to transfer their interest 0 in the property to any other person Carried 3 COUNCIL MEETING JULY 8th, 1977 P 3 Mr Litz noted that the hamlet of Wimborne is normally very well kept, but there are two vacant lots on main RNE REPORT street that are overgrown with weeds, etc. REPORT /t Mr King noted that this problem has been referred to Mr Soder, Agricultural Fieldman for a report Mr Campbell moved that Council do now adjourn and sit as Development Appeal Board Carried Time - 10.15 A M Mr Poole moved that Council do now reconvene as the Development Appeal hearings have been dealt with Carried Council than adjourned for dinner from 12 00 Noon until 1 00 P M Mr King then reviewed the monthly accounts, and after ,., discussion of same Mr Campbell moved payment of the accounts subject to a check being made of the Westburne Ltd account number 30489 - to determine how much of the account is for the Ruarkville sewer and water project Carried ADJOURN AND SIT AS DEV APPEAL BOARD i RECONVENE AS COUNCIL DINNER ACCOUNTS BUILDING PERMITS Building permits issued by Mr King were then referred to Council as follows - 1 Gordon McArthur, Trochu - NE 31- 33 -24 -4- far Garage 6 Workshop 2 Levi Boese - NW 3- 31 -25 -4 Second Residence 3 Frank & C. Klassen - SW 26- 30 -26 -4 - Hog Barn, Garage, ✓% 4 F A May - Lot 2 Block 2, Ruarkvi.11e - Residence 5 Walter Unruh, SW 6 -31 -24 4 - Addition to prin residence 6 Douglas Webb Lots 13 to 20 in Block 10 Swalwell - Single Family Residence Mr Bauer moved approval of the permits as issued A Carried A proposed subdivision of NW 15 - -31 22 -4 submitted by SUBDIVISION Clay Thomas for isolation ef- .stead - 2 4 acres was NW 15- 31-22 -4 considered by Council C THOMAS Mr Poole moved that Council recommend approval of this subdivision, subject to a request for relaxation of minimum parcel size, cash in lieu of public reserve to be calculated at $500 00 an acre, and payment of all outstanding taxes Carried The decision of C R P C with regard to the subdivision FRIESEN proposed in NW 36-32-27-4 - Walter Friesen, was read to SUBDIVISION Council Mr Bauer moved to accept and file this decision NW 36- 32 -27 -4 n as information APPROVAL V, Carried The request received from the Rosebud Gas Co -Op Ltd ROSEBUD GAS for a utility right of way over certain lots in Hesketh was considered by Council It was noted that it was a CO-OP UTILITY blanket easement with no definition of the easement RIGHT OF WAY boundaries Mr Poole moved that this easement not he HESKETH LOTS signed, and the Co -Op be requested to supply a plan of the ry location of the utility right of way across the lots V1 Carried J COUNCIL MEETING JULY 8th, 1977 P 4 A letter from Plains Western G line extension to serve E R was considered by Council Mr Ferguson moved approval of submitted, subject to approval as Co Ltd , for a proposed LINE EXTENSION Eskeland in NW 4 -28 -20 4 o NW 4- 28 -20 -4 PLAINS WESTERN the line extension as per plans GAS being obtained from the land owner Carried An application for work from Lorrie Lee Sommerfeld WORK APPLICATION of Three Hills was referred to the meeting Mr Litz moved L L to accept and file the application and advise Miss Sommerfeld SOMMERFELD that there is no vacancy at this time ✓� Carried The minutes of the Three Hills School Division meeting held SCHOOL DIVISION June 1st, 1977 were referred to the meeting, and discussed MINUTES It was noted that Mr Berdahl would be the representative for the School Division meetings in August A copy of the insurance policy in effect on the Hesketh HESKETH Community Hall was referred to the meeting f COMMUNITY They have $100,000.00 liability insurance on each building HALL INS and $10,000 00 fire insurance on the school building POLICY Mr. Campbell moved to accept and file this report as information 4. Carried A letter from the Deputy Fire Commissioner, Alberta Fire FIRE SURVEY Prevention Branch was read to the meeting Mr Makey, FOR THE M D Deputy Fire Commissioner advised that a survey of the M D V1 will be carried out by their office in the very near future Mr Ferguson moved to aceept and file this letter as information Carried Mr King gave a report on the Alberta Weather Modificiation OPEN HOUSE Open House held recently at the Red Deer Industrial Airport ALTA WEATHER He noted that there is approximately two million dollars MOD BOARD worth of equipment and about 120 people on staff Mr Campbell moved acceptance of the report o Carried VARIOUS OFF i OPENINGS Mr Ferguson advised Council that he had attended the opening of the Robertson Manor on behalf of Council He noted that Allan Warrack and Bill Yurko were both in attendance and also many ® representatives from the Robertson family Mr Bauer moved accpetance of the report Carried Mr Campbell advised Council that he had attended the opening of the Trochu Valley Manor recently and noted that Allan Warrack was at this opening as well I Mr Litz moved acceptance of this report Carried Mr Campbell had also attended the opening of the Trochu j Meat Packing Plant as representative of the M D n II He noted that the new plant cost over $400,000 00 and is a very V 1 modern facility Production at the plant is increasing, and they are now processing about 30 head a week Mr Ferguson moved acceptance of the report Carried V1 Mr Paquette entered the meeting at this time a, nt Cr It was noted that the new Linden will be officially opened V1 August 17th, 1977 at 2.30 P M /� COUNCIL MEETING JULY 8th, 1977 P 5 The easement for the access to the Huxley Sewer Lagoon site as prepared by Norman Tainsh, Solicitor, was .referred to the meeting, and discussed Mr Poole moved that the Reeve and Secretary - Treasurer be authorized to sign the easement on behalf of the Municipal District, and further that it not be necessary to have all other parties involved with the land consent to the easement, as these interested parties had consented to the legal survey of the lagoon site and were aware of the location of the easement for access purposes Carried Mr King advised Council about various air conditioners available from Trochu Home Furnishings Ltd , at Trochu A model suitable for the Council Room would cost approximately $386 00 on sale Mr Henkelman agreed to bring one down for demonstration purposes, but to date has not done so Mr Poole moved that Mr Henkelman be requested to bring; an air conditioner to the office for a demonstration Carried EASEMENT HUXLEY SEWER LAGOON SITE AIR CONDITIONERS FOR COUNCIL ROOM V Mr King reported to Council that Mrs Marion Stickel COMPLAINT RE '--A lodged a complaint about Council allowing farm animals resident to be kept in close proximity to the hamlet of Grantville, by a Grantville/ She noted that most of the residents of Grantville were in agreement with her She noted that there are chickens LIVESTOCK IN rabbits and a cow being kept at one location and also noted AND NEAR that her complaint had been lodged with the P.B I the GRANTVILLE owners of the land where the animals are being kept Mr Campbell moved that Mr and Mrs Tilzey be advised n that their temporary permit for the barn will expire September 27th, 1977, and application must be made if they wish to retain the structure on their land in Grantville They are also to be advised that to date they do not appear to have been complying with the terms of the temporary permit issued to them Carried LINE EXTENSION A letter was received from Alberta Power Ltd requesting, ALTA. POWER LTD approval for a power line extension to LSD 6 6 11 in 30-31 -24 -4 V/1 Mr Ferguson moved approval of the proposed line extension as per plans submitted Carried Alberta Power Ltd have received an easement from Alta EASEMENT Energy & Natural Resources for a power line in NE 9-- 30 -21 -4 ALTA POWER and a copy of the proposed easement route was referred to NE 9 -30 -21 Council Mr Bauer moved acceptance of the proposed route ✓1 for the power line as per plan submitted Carried Cr,uncil was advised that a letter protesting the requested RATE INCREASE rate increases for Alberta Power Ltd. had been sent to the PROTEST Public Utilities Board, and a telephone call had been received ALTA POWER from the Board asking if we had received all the available information from Alberta Power Ltd A letter had been sent to the solicitors for Alberta Power requesting the information Mr King noted that it is the practice of the Public Utilities Boa-,' to allow reasonable costs for anyone attending the hearing After discussion of this matter, Mr Poole moved to accept and file this as information Carried 5 COUNCIL MEETING JULY 8th, 1977 P 6 A number of circulars from the AAMD & C were referred AAMD & C CIRCULARS to the meeting as follows. 1. Information re Forest & Prairie Protection Act - Fire Permits V111 2 Request for Vehicle Inspection Report for any vehicle over 5 years old After discussion of this matter Mr Ferguson moved that a letter be sent to the AAMD & C , stating that we have our own shop and mechanics,& i ,urzn7 the association that all our municipal vehicles are checked regularly and repaired promptly Carried 3 Information regarding insurance fcr prairie and /or forest firefighting expenses Mr Campbell moved that Council advise the Association we are not interested in this type of insurance Carried 4 Request for confirmation of previous anti - freeze tentative order The Association noted that the prices are not yet final After discussion, Mr Poole moved that an order be placed with the Association for the anti - freeze as tentatively ordered previously Carried 5 The request for an order for metric road signs had been tabled previously, and to date no report had been received from the committee as to the number of road signs which may be required Mr Brown moved that this matter be tabled until a report has been received Carried 6 Information regarding the formula used by the Provincial Government in determining distribution of road grants to local governments was discussed Mr Bauer moved to accept and file this as information Carried W C B A letter from the Workers' Compensation Board regarding changes REGULATION in regulations was referred to the meeting Mr Litz moved CHANGES to accept and file as information Carried ANDEX Andex Oil Ltd have a well site ROA D APPROACH. OIL on LSD 16- 25- 31 -25 -4 - Robert Robertson land west and south ROAD of Three Hills and have requested permission for the approach The ^houlders of the road had been damaged by the rig moving n in and the road approach was approved, subject to the company ' repairing and regravelling the road first There is a similar problem at the old Brown corner on the Pope Lease Road at the approach to the well on the south side of the road The road shoulders had been damaged by the oil ri.g moving in Mr Bauer moved to accept and file this report as information. Carried MURPHY A circular from Murphy Equipment Ltd regarding equipment MUUIPMEN they have available for sale or rent was read to the meeting v" LTD Mr Ferguson moved to accept and file this as information Carried K & L A request from K & L Planing Ltd for attendance at a demonstration PLANING of their road construction equipment was referred to the DEMO meeting They are presently working for the County of Wheatland n COUNCIL MEETING JULY 8th,1977 P 7 south of Taylor Siding Their costs are about $2100.00 per mile It pulverizes the surface and gathers the material into a windrow It does not add oil to the mixture and requires a motor grader to replace the material after adding new oil Mr Poole moved to accept and file as information Carried A letter from Alberta Transportation regarding cement creek crossings was referred to the meeting The govenment will only supply technical ass ?stance towards such a project However they would provide assistance towards such a crossing at the location WNW 26 -32 -2744 on the Spruce Creek - File 1275 - F Art location, up to $1500 as they dad previously agreed to assist with construction of a salvage span on a 75 % -25% cost sharing basis After discussion it appeared that a bridge would be the best solution for this location Mr Poole moved that a salvage bridge as approved by the Bridge Branch be instate led at this location . a f;rant from Alberta Agriculture to purchase one 1000 gallon \ water storage tank and a large pump similar to those used by the fire departments, providing there are not too many government restrictions and regulations involved Carried Mr Poole mentioned that Mr E G Cullum had discussed CULLUM with him the problem of the road allowance south of ROAD ALLOW North West of 36- 30 -24 -4 This road allowance had been CANCELLATION cancelled and was to be sold to Mr Cullum for 15 times S /Nip.' 36 -30 the assessed value, or ;871 50 24 -4 He stated however that other people had land returned to them at no cost, and cited the L Sich road diversion cancellation as an example After discusdon of the matter, Mr Ferguson moved that Mr Cullum be advised the Sich land had been a deal made with them over 15 years ago, and further that the Sichs 9 COUNCIL MEETING JULY 8th, 1977 P 9 are required to use their own land to gain access to certain quarters, and also that Council had established the policy of selling cancelled reed allowances or diversions back to the adjoining land owners at 15 times assessed value last year Carried a Mr Poole mentioned that Mr J W Penner had requested Council to re- consider their decision to sell the Swalwell nuisance grounds at public auction He is willing to pay 15 times the assessed value for the land, and felt that the parcel should be returned to him as the owner of the ,f balance of the quarter section It was generally agreed that no chan7e be made in the decision of Council to sell the land at public auction Mr Campbell noted that au oil rig moving into the Elmer Meding Place -- 23 -.34 24 -4 on the north Huxley Road had done damage to the road Mr King outlined the various rigs moving in and out of the area recently Mr. Campbell noted that Mr Kimmel had done some grading work on the road and had requested a load of gravel Mr Paquette noted he had inspected the road and he is to discuss the matter with Mr Kimmel and determine the costs involved in repairing th; road damage, and an account is to be sent to the oil company evolved Mr Ferguson asked that the delivery date for the culvert v� on the Correction Line fob be checked, as the crew will be moving to this job soon SALE OF FORMER SWALWELL NUIS GROUNDS DAMAGE TO NORTH HUXLEY ROAD BY OIL RIG Mr Dennis Gagyi had submitted an account for rock DENNIS GAGYI picking with a tract -)r and rock picker and also for ACCOUNT FOR rock picking by hand The M D had brushed the road ROCK PICKING allowance and done some levelling work, but had not completed PAj the j•ob The rocks had to he picked before the road allowance could be seeded to grass It was agreed that the machine work be paid at $15 00 an hour and the hand work at $5 00 an hour Mr Brown moved that the account as submitted for $140 00 be paid Carried Mr Kin`. advised Council that Hopkins Construction had moved HOPKINS its dragline in to the river location and were removing pit �!)
