A regular meeting of Council of the Municipal District of Kneehill #48
was held in the Municipal Office, Three Hills, on Monday, May 9th, 1977
commencing at 9.00 A M

Mr John Jeffery, Assistant Secretary- Treasurer was present for portions
of the meeting.
Mr Mac Brereton, Trustee from the Three Hills School Division was '1
present for the major portion of the meeting
Mrs Ada Major from the Three Hills Capital was also present for
the major portion of the meeting.

Mrs Ada Major, reporter for the Three Hills Capital had COPY OF MINUTES
requested a copy of the minutes of the meetings to assist
her in --eporting on the council meetings. After discussion

Mrs. Major, prior to approval of such minutes by Council,

DIV MINUTES
The minutes from the Three Hills School Division meeting of
April 20th were referred to the meeting and briefly discussed.
Mr Litz and Mr Mac Brereton from the Division gave a brief
report on School Division matters including the problem with
the Division houses; rental rates, salary negotiations, and
the private schools and bus service problems being encountered
in the Drumheller area, Grantvil'e and Ruarkville
Mr Campbell will be the Council representative for the month
of June
Mr. Bauer moved approval of the report as given by Mr Litz
and Mr. Brereton

A letter received from Alberta Labour regarding smoke
protection for new buildings was read to the meeting
Mr Campbell moved to accept and file this letter as

The minutes of Regional Resources Project meeting held PROJECT
April 19th, were referred to the meeting MINUTES ETC
and briefly discussed. Mr King gave a brief report regarding
the meeting he had attended in Rockyford on April 27th
Mr King also noted that no brief had been prepared for use
in the Regional Resources Project promotional brochure, due to
a lack of time and other problems
Mr Campbell moved that the committee appointed previously
attempt to get the brief prepared in time for insertion in
the brochure

Mr King advised Council that the M D. is presently paying ST LIGHT
for a street light in Beynon, Equity and Sharples, along with others.
It was noted that there is only 1 residence at Equity and no
elevators there in operation
Mr Poole moved that the M D discontinue paying for the street
light at Equity, and the owner of the house there be advised
so he may arrange to have it transferred to his own name, if
he wishes to retain the light

A subdivision applicaton for a 40 acre parcel in NW 36- 32 -27 -4
was considered, and it was noted that Mr Friesen wishes to
sell this 40 acre parcel with existing buildings to his son
for a home site., and the son will be farming this parcel of land

Mr Bauer moved that Council recommend approval of the
subdivision; with deferral of public reserve in full

Amendments to the Preliminary Regional Plan by the Town
of Strathmore and the Town of Okotoks were considered ✓'

no objections to these proposed changes

from C R P C , and Mr Ferguson moved to accept and file

Building permits issued to John Beekman for a storage building
and pump house on Pt NE 8- 33 -23 -4 , and to Czar Resources Ltd
for a compressor station on LSD 4 in 2- 33 -25 -4 were referred
to the meeting, and Mr. Litz moved approval of these permits
as issued.

Wimborne gas plant was referred to the meeting and Mr Berdahl
moved to accept and file this report as information

A letter from the Kneehill Ambulance Society was read to AMB
the meeting, and it was noted that the Society is SOCIETY

Alberta Disaster Services have requested a resolution from

Council approving the up dating of annexes to the Emergency

Operations plan
After discussion of the matter Mr Poole moved as follows-
The Council of the M D of Kneehi.11 #48 does hereby approve of the
up -dated annexes to the Peacetime Emergency Operations Plan
• �� recommended by the Committee which met in Three Hills on
March 15th 1977 a copy of the up dated annexes is acknowledged
and

There was brief discussion of the special plan of evacuation
should any disaster occur at a gas plant
!j My Cunningham also asked about obtaining signatures on the
Mutual Aid agreement with all the surrounding areas., and it
was generally agreed that Mr Walt Oglivie of Alberta Disaster
Services would best be able to obtain the required signatures
on the agreement
Mr King reported to the meeting about the progress with
the Ruarkville waterzn— sewer, project and noted that the
P B I has agreed to tear down their existing hanger to
allow for the proposed route for the lines A proposed
replot scheme for development of lots in P B I and
Ruarville was reviewed, and after considerable discussion,
I! Mr Ferguson moved acceptance of the report as given, and
it was agreed that the work continue on the project

Mr Cunningham noted he has 18 names on a petition in favour
of proceeding with the project
Mr King advised the meeting, that the Town of Trochu
has agreed to match the M D policy regarding payment
to volunteer firemen in lieu of lost wages during:
attendance at fire training school at Vermilion
Mr King also noted that three men from the Linden Department
had attended school in 1976 He further noted that Mr
fCunningham and Mr. Jim Schneider of the Town of Three Hills
attended the school in 1977, and there will be no lost wages
involved for these two men, they being municipal
and town employees
I M" Ferguson moved that $300 00 be paid for the three men
from the Linden Department who attended fire training school
in 1976, namely - Lyle Regehr, Leslie Regehr and Rodney Wiebe
as no other claims have been received for 1976 from the other
departments, and this sum be charged to the Linden Rural Fire
Protection area

Mr Cunningham then left the meeting
SWALWELL
Mr King and Mr Poole gave a report on a meeting they REPLOT
had recently with representatives from C R P C at
Swa -well in connection with a proposed replot of certain
lots in Swalwell. They noted that C. R P C was tentatively
in favour of the proposed replot and Underwood, McLellan
and Associato.o have been requested to proceed with the
tentative replot scheme There is a meeting arranged
for May 17th; 1977, at the Swalwell Community Center at
8.00 P M , for discussions with the residents and interested
parties Mr King, Mr Poole and Mr Cunningham will be
at the meeting to discuss the proposed replot, a possible
modified sewer system, possible water system and a general
clean up of the hamlet, etc. Mr Poole inquired about the
possible sale of lots to Mr Doug Webb, and it was generally
agresi this would not be possible until the replot is completed,
which will take at least 4 months, and at that time the lots
possibly should be put up for saleby tender, as there are many
people interested in purchasing lots in Swalwell.

Mr King also gave a brief report on the Melwood and Dunbar
situations and there was brief discussion of these matters
No further action was taken at this time, but it was noted
that the Dunbar problem is in the hands of the solicitors
A letter from the University of Alberta Extension
Department regarding a seminar on the new planning act
was referred to the meeting The seminar is scheduled
for May 17th to 19th at Edmonton Mr King advised the
muting that two people have been tentatively registered
to attend this seminar Mr Poole moved that Mr John
Jeffery and Mrs Jean Wilkinson be authorized to attend
this meeting, and if C R P C is not sending Mr Brown
as their representative, and if it is possible to register
him for the course that he be authorized to attend as well

had with the Alberta representative for the Anti Inflation Board MEETING
They met with him in Edmonton recently and discussed the
roll back order, and it appears our only recourse is to re
submit our report for consideration

accepted as information

Administrators Association held at Thorhild on April 29th
He noted they discussed proposed boundary changes municipal
assistance grants, mobile unit licence fees., the proposed
planning act, the metric system, the Expropriation Act
Homeowner Rebate Act, and the need for a metric co- ordinator,
among other things

1977 A S B Tour was referred to the meeting The tour is
scheduled for July 11th to 13th Mr Bauer moved that
the two council members, the two ratepayer members, together
with Mr Norman Soder or Mr. G. Smyth and Mr Jeffery be
authorized to attend the tour

There was discussion regarding the next A S B meeting which
is scheduled for May 16th, and T,.- ^,_e moved that the

as there is Court of Revision in the morning, and that the
meeting be a combined meeting with Council

A letter from Alberta Environment regarding the proposed
sale of reclaimed nuisance grounds was read to the meeting
and it was noted that the Provincial Government does not wish
to exercise its right to purchase any of these lands
Mr Paquette and Mr Dobler entered the meeting at this time
After discussion about the fcur nuisance grounds which could
be sold at this time, Mr Berdahl moved that more details
be obtained about the lands concerning legal access, acreages
etc , and this matter be discussed again at the next meeting

A telephone call /was received from DomTar Chemicals of
Calgary in which they advised that they will not supply
the fence posts as per their quote of April 15th, 1977
as they did not receive the entire order for posts and
bridge planking. After consideration of the other bids
received, the next lowest bid was from Revy Lumber at Acme
at $1 20 for 3 -4 inch posts and $1 95 for the 5 -6 inch
posts
Mr Ferguson moved that we order the posts from Revy Lumber
at Acme as per the prices quoted in their bid, and as noted
above

Mr King advised the meeting that the culvert for the
Correction Line Road project has been ordered and the tentative
delivery date is the end of May or middle of June It is
a large culvert and will require extra road right of way for
installation and a fair amount of fill 6

The new owner of the Lamplighter Inn in Grantvillelns SERVICE
requested the M D give consideration to some work on the ROAD
service road past the motel, and also requested a check GRANTVILLE
on the drainage in the area
After discussion Mr Campbell moved that Mr Paquette
check this matter, obtain costs involved, and bring a
report back to the next meeting

weight control of highway loading was referred to the meeting LOAD
Mr Brown moved that a copy of our existing load limit by -law ,N LIMIT
be forwarded to Alberta Transportation for their consideration CONTROL

CU Engineering requested permission for a pipe line crossing PIPELINE
for the Orkney Gas Co--Op in the area of the S3,� of 27 -29 -21-4 CROSSINGS
It was noted that the line will cross the road which is used
mainly by an oil company for access to a well site The road
is normally maintained by the oil company Mr Berdahl moved ,.A
approval of the crossing by open cut crossing, on the condition
that the crossing be properly tamped, and the road be re- gravelled
where it has been disturbed

Mobil Oil Canada has requested permission for a road
crossing between SE 10 and SW 11 in 33 -26 -4. Alberta
Transportation has approved the crossing, which is on a
♦� secondary road Mr Litz moved approval of the road crossing
as per plans submitted, subject to compliance with municipal
regulations for road crossings, and compliance with Provincial
requirements

Mr Les Hempsey from Alberta Transportation, Red Deer,
entered the meeting at this time - approximately 2 05 P M
ROAD
Mr King advised the Council he had discussed the Swalwell PROJECTS
1977
Access Road with Mr Hempsey at Didsbury recently, and Mr
Hempsey outlined to Council the work to be done on this project
and the possible funds available from the government for the
grading work He also noted that the M D will probably be
authorized to do the work It was noted that a 66 foot right of
way would be sufficient if it could be backsloped into the
fields Mr Hempsey also asked about the articles of agreement
for 1977 and was advised that this will be completed as soon as
the road program for 1977 is finalized They then briefly
reviewed the comments on the 1976 road projects with Mr Hempsey
There was also discussion of the Pope Lease Road and enforcement
of load limits, etc Mr Paquette asked Mr Hempsey to have a look

at the Sunnyslope Road project presently underway There is
a road coming into the Sunnyslope road at approximately a 30
degree angle and Mr Paquette wondered if perhaps this should
be changed while they are working on the road Mr Hempsey ✓1
ag-ced to have a look at the road on his way back to Red
Deer and contact the office immediately with his recommendations
It is noted that he called later in the day and advised
Council to purchase the required right of way from Mr Paul
Weigum and bring the road in at the proper 90 degree angle
as it is a definite hazard in Its present condition
He would attempt to have his survey crew at the project
tomorrow to survey the required right of way, so as not to
delay completion of the project
Mr Hempsey left the meeting at this time - approximately 2 30 P M
A letter was received from Rockyview Gas Co -Op for PIPELIBE
permission for road crossings to serve their members with CROSSINGS
gas, and they noted that all road crossings will be bored
unless rock obstacles make it necessary to open cut a road
and permission will be requested from Council for such a
crossing Mr. Poole moved that the Rockyview Gas Co -Op
Ltd be advised of Council's policy regarding road crossings

Allied Land Services Ltd requested permission for a road t/1
crossing for CDC Oil & Gas Ltd , at SE 25- 28 -24 -4, as per plan submitted
Mr Poole moved approval for this road crossing subject to
compl' -nee with Municipal regulations

Underwood, McLe]]an & Associates Ltd , on behalf of the Town
of Three Hills requested permission for a road crossing in
connection with the new water wells for the town, as per plans
submitted After discussion of the plans, it was moved by
Mr Ferguson that approval fcr the road crossing be given on
condition that the 100 foot ..et back from the road be maintained
f- a t1hr well to the point where the line crosses the municipal
road

Mr Poole advised the meeting of his discussions with Mr Art PURCHASE
Becker regarding the proposed sale to Mr. Becker of a small LAND
parcel of land owned by the M D in the SW 16- 29 -24 -4 He noted SW 16
that Mr Becker was willing to pay $300 00 for the parcel of land 29 -24 -4
Awl provided he received a separate title for the parcel
Mr Campbell moved that the land be sold to Mr Becker for the
sum of $300 00 only on condition that the parcel be consolidated
back into title with the balance of the quarter section
and if this is not agreeable to Mr Becker, the land to be sold
at public auction at some future time

Mr. King advised the meeting regarding the Bircham property BIRCHAM
which had been discussed on the recent road tour Mr Spence PROPERTY
Alberta Surveyor for the Land Titles Office has advised SUBDIVISION
that he would accept a transfer of the property by description & ROAD
if that portion of the road was closed CLOSURE

of 26 On investigation it appears that the road was never

negotiations be carried out with Mr Reimer and Mr Toews
with a view to purchase of the required 4 acres for

of the purchase of the land., at a price of approximately
$500 00 to $600 00 an acre, that a subdivision be requested

containing 0 52 acre, was discussed, and it was noted that NW 4-30 -

of an acre more or less as shown on Plan 4303 E Z be cancelled
and returned to the quarter section from which it came, providing V11
the owner of the balance of the quarter section is agreeable
to accepting the land and to paying the costs involved in
registration of the transfer

After a very lengthy discussion of the matter, including
the possibility of this area being a natural spring area
and also the possibility that Mr Jensen might not get
water by drilling a well on his own property, Mr Jensen
left the meeting; after stating that he would not dispute
the decision of Council,
After discussion of a possible solution, Mr Poole moved
that Mr Fawcett and Mr Jensen be advised that the M D
anticipates having the wells plugged off, by the end of
July 1977, and they should arrange to drill wells on their
own land prior to that date Should they not find water
on their own land, the M D will give further consideration
to the possibility of leaving the wells open, but if no
wells hav been drilled in an attempt to find water by that
date the�weolisgwill be plugged off

A complaint was received by the office from Mr Floyd Thiessen TRUCKS
of Linden regarding one of our gravel trucks not stopping at a STOP
stop sign Mr Thiessen was required to brake very hard, skiddingIGNS
his tires and going sideways in the road to avoid a collusion
Mr Dobler had discussed this complaint with the drivers
Mr Ferguson moved that the men be informed that they must
stop at all stop signs and obey all traffic regulations
and if any further complaints are received regarding non - compliance
with this directive from Council Council will be forced
to consider more drastic steps to ensure compliance by the men

They have imposed a limit of 10 tons on this bridge if the

advised that when the crew started to work on the bridge it ✓�
was found necessary to replace both levels of the deck as it
was rotten He also pointed out that this fob will take most
of the bridge planking just purchased and noted that Crown Mart
have another small load available at the same price

Mr Brown reported that he had made a personal inspection McKEE
of the McKee North to #9 Road in Division 1 and also the #9 ROAD
alternate route for McKee to go approximate-y k mile south DIV 1
and west 1 mile to the light coat surfacing The new grading
approved at the previous meeting of council involves approximately
32 miles of rebuilding what is now a fair machinery road
Mr Brown advised that Mr McKee is strongly in favour of the road
project, but Mr Gerald Leonhardt who lives nearby stated he
is happy to leave the road "as is f1 Mr Brown estimated the
total cost would be about $50,000 00 Oil well revenue is minimal
Mr Brown then stated the expense of rebuilding the 32 miles would not
be justified in his opinion and he felt that he had made a mistake
in voting for approval of the same
Mr Berdahl gave a rebuttal and stated that he had personally
looked over many other roads which have been done recently and
some proposed for the 1977 road program In many cases the
need was no greater yet they were approved. He charged that
the statement of Mr Brown showed discrimination against Division
1 and against that area in the south east corner in particular
He further stated the McKee North road has first priority and he
did not wish to have it removed from the program and any other
road or roads substituted
Considerable discussion followed regarding the pros and cons of the
Cp
project
Mr Brown moved that the motion of Council as passed and recorded
in the minutes of April 25th page 11, be rescinded and that
approval for the grading of the McKee - #9 Road be taken from the
list of the approved projects for 1977
The vote showed four in favour of the motion and three against

and dozer recently being hauled on the low boy east of Swalwell ✓A

Mr Berdahl_ advised that the road from Carbon east to its sewage
lagoon and north to the Pope Lease is in rather poor condition,
partly due to the Village ,vork Drift soil has also added to the
problem north of the lagoon This is to be inspected
Mr Berdahl also referred to bad conditions on parts of the Pope
Lease road Mr Paquette stated that some of the worst pares vo)
are being fixed and Mr Dobler suggested that the east 3 miles
will need to be redone
Mr Berdahl asked about Council policy in allowing use of road allowances
by farmers and advised that I,,cKee and Leonhardt are in dispute regarding

that original road allowances are public unless officially leased or
