C W Poole Div 2 Ralph W Brown Div. 3 (Reeve) Art V Bauer Div 4 T A Ferguson Div 5 (from 1.00 P M to 3 00 P M) Leonard Litz Div 6 ( after 1.00 P M ) �j Reginald Campbell Div 7 G. G King, Secretary- Treasurer portions of the meeting John C Jeffery, Assistant Secretary - Treasurer - for Jean Wilkinson was present and recorded the minutes Mrs Ada Major from the Three Hills Capital was present for portions of the meeting Mr King advised Council that Mr. T A Ferguson had been in hospital but may be able to attend the meeting for a short time in the afternoon He also noted that Mr G A. Berdahl was not well and would not be at the meeting, unless he was able to see his doctor early in the day APP$OV MINUTES There was a brief discussion of the minutes of April 11th, an Mr Brown moved approval of the minutes subject to the following correction - Page 1 - 4th paragraph - regarding oil well spacing - -- last line - c'-ngs to read " to be used in all this Municipality Carried m The minutes of the meeting of April 14th will be dealt with at the ' K LAND FILL A report from the Kneehill Sanitary Land Fill Committee was REPORT read to the meeting and it was noted that of the eight underground storage tanks purchased from Gulf Oil, one was still on hand Mr Bauer moved that Council recommend i�, this tank be sold to Edwin Sept of Three Hills, next meeting 1977 GRANT - UT. f Alberta Utilities and Telephones OFFICER A letter has been received rom approving our 1977 budget for the Utilities Officer They also forwarded a cheque for $3750.00 being a portion n 0 00 rant for 1977 Inspectors, Soil Conservation Officers, Pest Control Officers and Pesticide Chemical Inspectors for the Municipal District, and these appointments be on a continuing basis until further motion of Council Carried NEEHILL SAN at a cast of $203 24, as he was the first person to askCarriede of the $15,00 g Mr Poole moved to accept and file this as information Carried 1977 APPOINTMENTS The matter of appointment of Norman Soder and Glenn Smyth WEED INSPECTOR as weed inspectors for 1977 was discussed. There was ETC also discussion regarding their appointment as Soil Conservation Officer, Pest Control Officer and Pesticide Chemical Inspector. � Mr. Poole moved that Norman Soder and Glenn Smyth be appointed as Weed Mr Brown again asked about having 30 yard roll off containers in different areas of the M D on a shared basis with � the participating towns and villages. •2 r J COUNCIL MEETING APRIL 25th, 1977 P 2 After discussion of this matter, Mr Campbell moved the report be accepted and filed. Carried It was generally agreed that the Kneehill Sanitary Land Fill Committee continue operating the land fill on the same basis for the time being, and no roll off containers be obtained at this time The matter of the Elcar Air Purifier was discussed, and Mr Poole moved that the air purifier be returned Carried A letter from Hugh Peterson of Linden, Alberta regarding his mobile home licence fee was read to the meeting. He owes a licence fee for a portion of the year 1976, and this fee is properly payable to the M.D The 1977 licence fee should be cancelled as he was not occupying the mobile home after January 20th, 1977. Mr Brown moved that the account for the 1976 licence fee be turned over to Norman Tainsh, Solicitor, of Three Hills, for collection Carried Mr Poole moved that the 1977 licence fee in the sum of $289 95 as levied against Mr Hugh Peterson be cancelled Carried Various recreation reports and minutes were referred to the meeting *4r Poole noted that perhaps a point meeting of Council and all the recreation boards in the M D should be held to review the recreation agreement, as this was not done at the point supper meeting., held recently The minutes of the meeting held March 21st by the Three Hills Recreation Board, and the 1976 financial statement from the Town of Three Hills covering recreation for the town was referred to the meeting, as well as the Recreation Report Mr Bauer moved that the reports and minutes be accepted and filed Carried AIR PURIFIER V'\ HUGH PETERSON MOBILE LIC FEE V\ RECREATION REPORTS from Carbon It was noted that three of the rural organizations and three of the towns and villages have not yet filed their 1976 financial statements, covering their recreation affairs After discussion of various matters, Mr Poole moved that PAYMENT OF trP 1976 recreation grants be now paid as per by -law number 1976 REC 801 to the Town of Trochu, The Town of Three Hills, the GRANTS Village of Carbon and the City of Drumheller, as their FOR TOWNS financial reports have been accepted and filed. & VILLAGES Carried AMENDMENT Mr Peter Spilchen Assessor, has requested an amendment to the TO BUS business tax by - -law number 299 to provide for a rate for TAX BY -LAW assessment of business tax for cement plants and for painting j and decorating businesses Mr Poole moved first reading to by -law number 826 being a by -law to amend by -law 299, to provide a rate for assessment of business tax for cement plants as follows. Mr Poole moved to accept and Carried The Alberta Recearch Council have contacted the office coal exploration in COAL advising that they will be doing some Municipal District EXPLORATION the western portion of the Brown moved to accept and file this as information ALTA RESEARCH Mr and to request the Alberta Council to advise the M D their COUNCIL if there is any indication of gravel in any of test holes Carried Mr Doug Hazelton of Linden Contractors entered the meeting at this time ing the rental and perhaps purchase Mr Hazelton is consider of a soil stabilization machine which makes use of the existing road material, by scarifing and grinding the road material adding oil to it and re]aying the material It apparently makes a reasonably good light coat surface road He wondered if the M D would be interested in having some of their roads resurfaced in this manner. He noted he did not have any exact cost figures, but it appeared it would cost approximately $6000 00 a mile There was discussion of the matter but no definite decision was made Mr Hazelton then left the meeting Alberta Power Limited have submitted plans for street lights at the intersection of Highway 21 and Secondary VA Road 585 - access road to the Town of Trochu This provides for 7 street lights e of installation There was discussion of the need for this type j; during this time of restraint and the need for conservation of energy It was agreed that the Town of Trochu be contacted to see if they have requested this installation before any decision was made by Council meeting Mr King reported to g about the Arnold Dunbar situation in Swalwell, and his discussions with Mr Byers., Solicitor from Drumheller Mr Byers will be contacting Mr Dunbar again and will give him a deadline for removal i of the buildings �! Mr Bauer moved to accept and file this report as information Carried The Three Hills School Division has submitted its proposed budget for the year 1977, and this was referred to the meeting Exact figures are not yet available, but it appears there will be about a 5' mill increase over last year The matter should be finalized within the next two weeks Mr Campbell moved to accept and file this as information Carried i i II DOUG HAZELTON ROAD SURFACING TROCHU ACCESS STREET LIGHTS ARNOLD DUNBAR SWALWELL SCH DIV BUDGET COUNCIL MEETING APRIL 25th 1977 P.4 Mr Brown gave a brief report regarding his attendance at a recent Three Hills School Division meeting � Mr Campbell moved to accept and file this report as information Carried The next School Board meeting will be on May 4th f and it was noted that Mr Litz is the representative for that meeting The 1977 School Foundation Requsition figures have f been received. The requisition is $318 373 00 and is calculated on the equlized assessment of $12,245,130 00 at 26 mills Mr Poole moved to accept and file as information Carried Mr Robert Hall of Calgary Regional Planning Commission entered the meeting at this time. The decision of C R P C with regard to a proposed subdivision of SW 20- 30 -25 -4 - Roy Rankin was referred to the meeting, and conditions of the approval were noted. Mr Bauer moved to accept and file as information Carried Mr. King read a letter from Alberta Agriculture regarding certificates of compliance for Mr. Roy Rankin of Linden and for Mr. Paul Strohschein of Trochu for construction of buildings for confinement of livestock facilities They have requested our comments as to whether these locations and or proposals are in contravention to our by -law or regulations Mr Poole moved that until Mr Rankin submits an application for development permit for a milk house we cannot make any comments on the request from Alberta Agriculture Carried Mr Poole moved that Alberta Agriculture be advised Mr. Paul Strohschein's application for a hog barn complies with all our by -laws and regulations Carried �.� application for subdivision submitted by Mainard Seiler for a 45 acre parcel in the NE 22- 29 -26 -4 was then considered Mr Hall advised the meeting that the previous subdivision in this quarter - a 5 acre parcel owned by Anton Seiler - was an isolation of farmstead - and therefore no further subdivisions are permissable in the quarter Mr Bauer moved that Council recommend refusal of this application for subdivision as there is already an existing isolation of homestead subdivision in that quarter Carried SCH DIV MEETING REPORT SCH REQ FOR 1977 The application for subdivision submitted by Mr Max Beam of Three Hills covering Lot 2 Block 1 Plan 761146 (Grantville) was then considered Mr Hall outlined the proposed subdivision Mr BRam proposes to subdivide lot 2 into two lots with 66 foot frontage It was noted that there is a shed located on the most easterly parcel, but as the set backs comply with M D regulations, it would not create any problem Mr Campbell moved approval of the subdivision as submitted Carried PLANNING MATTERS V PA V1 �'1 • COUNCIL MEETING APRIL 25th, 1977 P 5 BUILDING The building permits as issued by Mr King were then considered PERMITS as follows L Vasselin, NE 34- 30 -23 -4 Shop and Storage Building W Madsen NE 36- 30 -23 -4 Single Family Residence ✓1 Mobil Oil LSD 5- 12- 34 -26- -4 - Extension to Office Gordon Ward Pt SW 4- 29 --24 -4 - Single Family Residence & Porch Lorne Davis NW 36- 30 -25 -4 - Single Family Residence - Second Dwelling Henry Sukkau - Lot 1, Blk 1 Plan 7510438 - Single Family Residence Clarence Brosseau - SW 13- 31 -24 -4 - Single Family Residence - Second Dwelling Donald Klassen -- SW 3.30 -25 -4 - Single Family Princiapl Residence Mr Campbell moved to approve these permits as issued. Carried EASTERN REG Council then considered the Eastern Region Summary and Policy REPORT paper as forwarded by C R P C some time ago for consideration by the Council Mr Brown reviewed various points and there was considerable discussion about the summary Resort Cottage Development was discussed as well as possible hamlet expansion It was noted that ✓\ hamlets should not be required to take all the undesirable businesses such as auto wreckers scrap metal businesses, etc. The meeting adjourned for dinner between 12.00 Noon and 1.00 P M DINNER Mr Leonard Litz and Mr G A Berdahl ertBred the meeting at 1.00 P M and Mr Ferguson entered at 1 05 P M Discussion of the proposed Eastern Region Plan then continued The need for subdivision of land to settl �esstates was discussed and the density to be allowed in the Red Deer a ey The meeting then reviewed the policies approved by the committee to date, and suggested changes in the following items as follows 5 That there be no density on a quarter section of non - productive farmland 6 Delete this clause entirely 12 Perhaps this green belt should be considered again as it imposes a hardship on owners within the green belt 15 The one year period for home occupations was discussed but no definite decision was reached The meeting rather felt the limitation was not entirely fair 16 Delete the word minor 19 Delete this clause 20. Delete this clause Mr Berdahl moved that these recommendations be sent to C R P C for its further consideration Carried Mr Dobler and Mr Paquette entered the meeting at this time Mr King gave a brief report to Council about a proposed replot for the Ruarkville area subject to consent of all la ^A owners involved, being obtained This replot is being considered because of the propose water and sewer installation for Ruarkville The re] would allow for lanes and future subdivision of the and would include a portion of the P B I land �R PROPOSED± REPLOT RUARKVILLE P 6 eaume%L Mrrv2ps APRIL 4641h, L999 Mr King asked Mr Hall if it would be possible to discuss this proposed replot at the site tomorrow and Mr Hall agreed that this would be possible fr after the meeting at Swalwell scheduled for 1 30 P M Mr Bauer agreed that he would come to the meeting at Ruarkville if possible Mr Ferguson moved that Council recommend a replot scheme covering these areas in Ruarkville, subject to consent of the land owners involved being obtained Carried Mr Hall left the meeting at this time Mr Soder entered the meeting, at this time, to discuss the proposed zero tillage demonstration plots Mr Larry Welsh of Alberta Agriculture has advised that two plots would be best, and the plots should not have been worked last fall He would also like to see another plot next to the demonstration plot for comparison purposes Mr Soder also pointed out that the entire scheme may fall through if they are not able to get a tiller Mr Soder has arranged with Mr Jim Bishop for a plot for this purpose and is still looking for a plot on light land He noted Mr Bishop's land is heavy soil Mr Soder therefore requested permission from Council to proceed on this basis rather than as authorized by the A.S B meeting held recently, which authorized four plots. Mr Bauer moved that Mr Soder be authorized to set up only 2 zero tillage plots, as requested by Alberta Agriculture Carried Alberta Transportation have returned two of our road closure by- -laws. Due to a change in procedure in their office, it is not necessary to pass a by -law unless Council wish to advertise the closure in the local paper A motion of Council and the consent of the land owner who is to receive the land after the road diversion is cancelled is all that is necessary This procedure can be used in regard to road diversion closures in NE 1- 30 -26- -4 and SE 1- 30 -26- -4 - Wittstock and Price, and NW 36- 30 -24 -4 - Cullum Mr Brown moved first reading to by -law 827 this being by -law to repeal by -law number 820 in its entirety Carried Unanimously Mr Poole moved second reading to by -law 827 Carried Unanimously Mr Litz moved third reading to by -law 827 Carried Unanimously Mr Poole moved that Council request closure of unused road diversion as shown on Road Plan Number 1249 B M . in the North East Quarter of 1-- 30 -26 -4 and South East Quarter of 1.30-26 4, containing 74 of an acre and 1 00 acre more or less respectively, and the lands involved be returned to the quarter section from which it came, providing the consent of the owners of the quarter sections involved is obtained Carried N SODER ZERO TILL PLOTS ROAD CLOSURE PROCEDURE BY -LAW 820 and 825 Mr Poole moved first reading to by -law 828, this being a by -law to repeal by -law number 825 in its entirety Carried Unanimously Mr Bauer moved second reading to by -law 828 Carried Unanimously Mr Berdahl moved third reading to by -law 828 Carried Unanimously Mr Poole moved that Council request clooure of unused road V1 P7 COUNCIL MEETING APRIL 25th, 1977 diversion on Plan 5250 E Z , in NW 36- 30 -24 -4 2 acres to quarter section from which it came, with consent of Carried The matter of road closure in W /SW 15- 33-23 -4 Ziegler, tabled pending further information being obtained VII and land be returned such land owner A letter from Calgary Power Ltd , regarding payment being required in advance for relocation of power poles was referred to the meeting, and it noted that our letter protesting this requirement had been referred to the Division Manager was Mr Ferguson moved to accept and file this as information. Carried The STEP program proposed by theProvincial Government was referred to the meeting, and after discussion, Mr Poole moved to accept and file this as information. Carried A letter from Gulf Oil Canada regarding road crossings for pipelines in the Ghost Pine Area was reviewed by Council. Carried Mr Ferguson left the meeting at this time Mr Campbell moved that we aceept the bid of Dom Tar Chemicals for purchase of the 2000 3 to 4 inch fence posts and the 300 5 to 6 inch fence posts (pointed) as per their bid -- namely 96� each for the 3 to 4 inch post and $1 96 for the 5 to 6 inch posts Carried A letter from The District Engineer for Alberta Transportation regarding our 1976 road grading program was referred to the meeting and his comments discussed. Mr Berdahl moved to accept and file this report Carried A reply to our inquiry about diesel fuel overhead tanks in towns, villages r hamlets has been received verbally from the Fire Commisser's Office as follows Overhead tanks for gasoline must be 120 feet from the edge of the adjoining lot Therefore gas tanks cannot be located in a hamlet, unless it is a particularly large lot However there are no special regulations concerning diesel fuel unless a local by -law is passed prohibiting them FENCE POST BIDS REPORT FROM ALTA. PROJECTS is in the area Mr. Paquette advised it should be there by the end of this week and he will have the job vl� done at that time A letter from Alberta Transportation, Bridge Branch ,✓° was referred to the meeting and items discussed as follows' File 1657 Bridge South of Bigelow Dam - Rated at 19 tons and the necessary signs should be erected File 71175 Allingham Bridge - previously condemned Meeting arranged for April 18th 1977 Mr King advised that as a r -sult of that meeting a limit of 10 tons had been authorized for that bridge and the necessary signs should be erected File ISE 25- 28 -22 -4 South of Hesketh - there is no need for Vl\ a cattle pass at this location Other information regarding work to be done by the Bridge A Branch on bridges in 1977 was referred to the meeting. Carried CEMENT The matter of cement crossings for certain locations was CREEK discussed and Mr Litz moved that the Alberta Bridge Branch CROSSINGS be requested to supply financial assistance towards installation of cement creek crossings for the following locations SW 18- 32 -22 -4- Tourneur West of SW 7- 33 -24 -4 - Albretch WNW 26- 32 -27- -4 - F Art WNW 2- 33 -23 -4 - John Smvth Carried Mr Poole moved that Alberta Transportation, Bridge Branch be requested to supply a culvert for the road South of 1 and 2 in 31 -24 -4 for installation in 1977 Carried V CULVERT FOR CORR LINE PROJ. A letter received from Alberta Transportation - Dr Horner SWALWELL was read to the meeting and Mr King outlined his discussions ACCESS held with H Alton The government have decided to proceed RD with the up- grading of the eastern 1 mile of the Swalwell Access Road, and the sum of $70,000 00 has been alloted VIA to that project by the government Mr Hempsey will come to the next meeting of Council for further discussions of this matter Mr. Poole moved to accept and file this as information Carried There was further discussion of the road program for 1977 and it was noted that if the culvert can be obtained, the ROAD PROG next job for the main crew should be the Correction Line job in Division 5 Mr Paquette mentioned several other projects which must be done in 1977 such as clean up at the Tolman stock pile, removal of gravel from the Elvin River location etc a j Mr King advised that the budget does approve for full time operation of both the main and small crews at regular hours �' 11 COUNCIL MEETING APRIL 25th, 1977 P 11 ROAD Considerable discussion took place regarding the priority given PROJECTS by Mr Berdahl for grading and gravelling from SW 3- 28 -20 -4 north to #9 highway (McKee North) Some councillors suggested the road would not carry enough traffic to warrant the expense., but Mr Berdahl stated that this job is at the top of his priority list Mr Paquette suggested the patch crew might be more efficient for that job, but Council's opinion favoured the main crew if it is to be done. Mr Poole moved that the main crew complete the Sunnyslope East job and then go to the job as referred to above in Division 1 �^ McKee to #9 Carried Mr Litz asked to be recorded as opposed WORK Mr Poole moved that the applications for work as received from APPLICATIONS Kenneth Lyle Hazelton, Three Hills, Alberta, Dale H Bauer Torrington, William D Little, Trochu, Kevin Paul Clow of Carbon, Garnet D Shaw of Olds Douglas Kline of Olds, and Phil Dyck of Three Hills be referred to Mr Paquette Carried The R C M P at Drumheller have advised by telephone STOLEN that they have been unable to trace the stolen snow fence SNOW FENCE Mr Bauer moved that this be accepted as information and filed Carried OIL Mr Dobler reported on the requirements for repair of light REQUIREMENTS coat surfacing His figures show a need for 270,000 gallons of emulsion oil as compared with a total of 267,000 gallons last year No new 1977 work is included.
