( SEE OVER FOR EXPENDITURE CONTROL ) r' • ' CO(fNCTL MEETTNd APRIL 11th 1977 A regular meeting of Council of the Municipal District of Kneehill #48 was held on Monday, April 11th., 1977, in the Municipal Office, Three Hills commencing at 9.00 A M Those present for the meeting were PRESENT Gilbert A Berdahl Div 1 Clifford W Poole Div 2 Ralph W Brown Div 3 (Reeve) Art W Bauer Div 4 V T A Ferguson Div 5 Leonard Litz Div 6 Reginald Campbell Div 7 Mr G G King, Secretary- Treasurer was present for the meeting and Mr John Jeffery, Assistant Secretary - Treasurer was present for portions of the meeting Jean Wilkinson was present and recorded the minutes APPROV Mr Bauer moved approval of the minutes of the meeting of Marchl28thS 1977, as circulated. Carried FIN STATt,o,L , _ The financial statement for the month ending March 31st, 1977 was read to the meeting and it showed a net balance on hand of $184,821 13 Mr Ferguson moved approval of the financial a. statement Carried Mr Alex Cunningham entered the meeting at this time. OIL WELL Mr Brown and Mr Cunningham gave a brief report on a meeting SPACING they had attended in Calgary recently The meeting was sponsered by the Rocky View Agricultural Development Committee and it was concerned with oil well spacing, location of power lines and problems which are being encountered in respect of irrigation systems, etc It appears that because of irrigation systems in the southern part of the province oil companies are allowed to drill a well closer to the road allowances or boundary of the quarter section, rather than having it located in the middle of the field It was generally agreed that this policy would be beneficial in this area as well, as it would not cut up the fields so badly and would mean less road access taken from the farmer. After discussion of the matter, Mr Campbell moved that the M D send a letter to the meeting to be held in Calgary April 19th, 1977 stating that the M D is in favour of allowing this policy to be used i t his a -ea- J Carried RUARKVILLE There was brief discussion regarding the Ruarkville water and WATER ETC sewer installation and it was noted that there is an appointment set up for April 12th, 1977 at 1 15 P M with representatives from the P B I,, to attempt to arrive at a final agreement with A the School Mr Poole moved that Mr Bauer be appointed to attend this committee meeting, together with G G King and Alex Cunningham Carried Mr Cunningham then left the meeting. G NEUFELD Mr. G. Neufeld of Acme, then entered the meeting at 9 35 A M HOG OPERATION to discuss the plans for expansion of his existing hog operation / 41 . ...2 COUNCIL-MEETING ---- APRIL- llth,_1977 P.2 It was noted that Mr Neufeld was granted a building permit in June of 1976 to allow for expansion of his hog operation , and he was given two years to complete the expansion Mr Neufeld outlined his existing operation He has a feeder operation and has trouble purchasing sufficient weaners He also has a disease problem in his operation and will be forced to shut down for a year to clear the disease from his buildings He then wishes to raise his own weaners thereby expandirg from a feeder operation into a farrow to finish operation He proposes to use the new building as a farrowing barn which would house approximately 150 sows and part of the existing barn would be used to house the weaners He therefore felt that there would not be as much manure from this type of an operation as there is from a feeder operation He pointed out however that he could not agree to spread all the liquid manure 2 miles away from the Village of Acme In the winter it is not practical to haul it that far away He felt that at the present time at least 50 to 60% of the manure from the operation is spread over 2 miles from the Village In answer to a question about chemicals added to the pits, he stated the chemical is very expensive and there is no guarantee that it would be effective At the present time it takes him three days to empty the storage tank, and in future he hopes to have a larger tank to haul the manure away, which would reduce the time required to empty the storage tank Mr King outlined his discussions with Mr Neufeld in which he proposed that Mr Neufeld spread the liquid manure on land at least 2 miles from Acme Mr Neufeld stated that there will always be a problem at this location as it is too close to Acme, but he is attempting to run a good operation. Mr King read a letter received from the Drumheller Health Unit with regard to the proposed expansion and it was noted that the expansion meets minimum distance requirements under the Provincial Health Regulations After further discussions, Mr Ferguson moved that the building permit be allowed on the following conditions 1 That Mr Neufeld will on the average during the year spread 50% of the liquid manure from the hog operation on land over two miles from any urban center, and as far as practical will spread the manure when the wind is blowing away from the Village of Acme V1 Carried Mr Neufeld then left the meeting ✓1 ROAD BANS Council then discussed road bans It was noted that there is still a road ban on Provincial Highway 27 east from Number 21 After discussion, Mr Ferguson moved that the road bans be lifted on all roads in the Municipal District except Secondary Road 587 West and the Buffalo Jump Dry Island Park Road from Highway 21 East, and consideration be given to the removal of the bans from these two roads 6t#1@ift 'tile -jotdI sbq .recommends Carried LOAD LIMITS There was then discussion regarding posting load limits on Municipal District roads as per by -law 818 It was generally agreed that all the light coat surfaced roads should be posted at a weight of 59,000 pounds Mr Ferguson moved that by -law 818 should be advertised in ,f the Three Hills Capital and it should also be advertised that the M D is requesting the Provincial Government for assistance in enforcement of this by -law Carried .w COUNCIL MEETING APRIL 11th, 1977 P 3 DEV There was then a lengthy discussion regarding the CONTROL need for advertisement of by -law regarding development ADVERTISEMENT control(number 789 ) Mr Litz moved that an advertisement be published in the Three Hills Capital advising ratepayers that if they anticipate any construction, development or change in the use of their land they should contact the Municipal District Office to determine if they require a development and /or building permit Carried ACCOUNTS Mr Jeffery, Assistant Secretary- Treasurer, then reviewed the accounts It was noted that perhaps the Workers Compensation Board assessment should be paid a month early to avoid penalties being incurred due to late payments Mr Poole moved that the account as r,. .ed be paid Carried REG RES M B d MEETING r er ahl gave a report regarding a recent Regional Resource Project meeting The participating towns and PROM BROCHURE villages are planning a promotional brochure which will cost approximately $330 00 for each participant in the project There was discussion as to whether the M D would be assessed for a share of the costs regardless of whether they put anything in the brochure about the M D Mr Campbell moved that the M D prepare a promotionAl, summary regarding the Municipal District for the brochure, and pay their assessment towards the costs of the brochure It was further moved that Mr Berdahl and Mr Poole with assistance of the office staff prepare the summary Carried Mr Spilchen has asked for an amendment to the busines by -law to provide for two more categories However as no rates are available, this matter will be until Mr Spilchen returns The date for the court of revision was then discussed Mr Berdahl moved that Court of Revision be hald May 16th, 1977 at 9 00 A M BUSINESS TAX tax BY-LAW AMENDMENT tabled DATE COURT REVISION The matter of the Elcar Air Purifier sent out on a trial ELCAR AIR PURIFIER basis from Allen Enterprises Ltd , of Calgary was then discussed It was agreed that this matter be considered at the next meeting A letter from the County of Parkland regarding an attempt DEV CONTROL to set up a seminar for Development Control Officers SEMINAR on June 2nd and 3rd. 1977 , at Red Deer was read to the meeting Mr Ferguson moved that two members of the office staff and ✓� Mr Brown attend this seminar. Carried CORR PIPE A letter from Corrugated Steel Pipe Institute regarding SEMINAR a one day seminar was read to the meeting Mr Bauer moved that this matter be referred to Alex and he be authorized to attend if he deems it to be of benefit to him in his work Carried 0 WE 1 COUNCIL MEETING APRIL 11th, 1977 P 4 Minutes from the Carbon and District Recreation Board REC REPORTS meeting of March 14th, and minutes from the Three Hills Recreation and Parks Advisory Board meeting of February 21st ETC were referred to briefly The finanial statements and reports from the Huxley Curling Club, Huxley Community Hall, Allingham Community Hall, Sunnyslope Community Association, Over the Hill Community Association; and Wimborne Community Center were also referred to Mr Berdahl moved to accept and file the minutes and reports as presented to the meeting Carried Mr Brown gave a brief report on the Recreation Boards supper meeting held recently The meeting discussed the problems at Kei.ver Lake Park and the general feeling was that the M D should have control of the park to operate it in the best manner. They felt perhaps a discussion with Mr Hansen might be of some benefit, and perhaps will invite him to the fall combined supper meeting Council briefly discussed the number of directors required on the recreation boards, and it was agreed that this matter should be discussed at the next combined recreation board meeting to be held Wednesday, November 2nd, 1977 Mr Campbell moved to accept and file this report as information Carried The meeting then discussed taking funds from the Public MONEY FROM Reserve Trust Account to pay for certain expenditures made PUBLIC RES FOR PARK for parks in 1976 EXPENSES Mr Campbell moved that the sum of $1039 93 be taken from the Public Reserve Trust Account and transferred to the general n account to take care of expenditures made for parks in 1976 V' as follows- Picnic Tables $144 40 Beach Reclamation $175 00 Floats, rope, etc $209 38, Picnic Tables $230 65; Trees - Tolman Park $40 50, and Labor for contruction X0 of tables $240 00 Carried ALTA POWER A letter from Alberta Power Ltd , regarding proposed LINE EXTENSIO line extension to LSD 14- 9- 32 -24 -4 was read to the meeting Mr Bauer moved approval of the line extension as per plans {/1 submitted Carried The summary and policy paper on the Eastern Region meetings was referred to the meeting Mr Ferguso this matter be tabled until the meeting to be held 1977, to enable the Councillors to give the matter Carried EASTERN REG. Committee SUMMARY n moved that April 25th, further study C R P C The memorandum of transmittal of decision from C R P C SUBDIVISION regarding certain subdivisions were referred to the meeting APPROVALS as follows NE 8- 33 -23 -4 - R Phillips, Trochu NW 26- 34 -25 -4 - M V Moran , Kneshill Valley VA SE 4-31--26-4 - C Godlonton - Linden Mr Poole moved that this correspondence be accepted and filed as information Carried V -7c im • COUNCIL MEETING APRIL 11th 1197 P 5 The following proposed subdivisions were then considered NEW SUBDIV 1 George Kaechele - SW 11 -31 -22 4 Isolation of Farmstead Mr Ferrtson moved that Council recommend approval of this subdivision, subject to V1 Cash in lieu of public reserve to be calculated at $500 00 an acre Culverts and approaches being installed at the developer's expense to M D. standards Taxes paid in full Carried Mr Paquette and Mr Dobler entered the meeting at this time 2 Alfred Esau - SE 25- 30 -25 -4 - This subdivision is merely making a change in boundaries and is not creating any new parcels Mr Poole moved that Council recommend approval of the subdivision L/I and that no cash in lieu of public reserve be required Carried 3 Max Beam ., Three Hills - Lot 2 Block 1, Plan 7611146 (Grantville) This subdivision proposes to create two residential building lots , each containing 0 18 of an acre V-1 Mr Bauer moved approval of the sub(►ivi.sion as submitted Carried 4 Henry Enns - Pt NE 33- 30 -25 -4 - This subdivision is proposed to add an additional 10 acres to Mr Enns' existing 25 acre parcel V-1 It is not creating any more parcels Mr Brownzecommended approval of this subdivision Carried COAL EXPLOP A letter from PanCanadian Petroleum Ltd , wa.s read to the meeting They request permission for shallow testbole coal exploration in this area Mr Campbell moved that approval be given to PanCanadian Petroleum for this exploration work subject to compliance with Provincial Regulations Ca--- ied CULLUM DAMAGE CLAIM Mr. E G Cullum has requested the sum of $-L00 00 for levelling work done by him The M D apparently cleaned out a ditch ai.d piled the dirt on his land - NE 35-- 30 -24 -4 The dirt was not I� levelled satisfactorily, and he was forced to do considerable work to level the land After discussion of this matter with Mr Paquette, Mr Poole moved that this account not be paid Carried ALTA A4letter from Deputy Premier Hugh Horner was read to the meeting TRANS It appears that Alberta Transportation will not be able to pave SEC ROAD Secondary Road 583 west of Three Hills this year, nor the access PAVING read into Swalwell It is now planned to tender the work late in 1977 for completion of the project in the 1978 program It was noted that this matter had been discussed with Dr Horner and Mr Harvey Alton at the recent Spring Convention It was noted that the Swalwell access road will have to be graded before it can be paved and a suggestion was put forth that perhaps the M D might share the costs with the government on this portion of the project in 1977 No definite decision has been made Mr Poole moved that a letter be sent to Mr. Alton requesting hJs reply to our request to do the grading work on the Swalwell access road in 1977 Carried ROAD GRANT 41 A' letter from Alberta Transportation regarding the 1977 Road Grant was read to the meeting, and it was noted that our 1977 road grant has been set at $228,771 00. This is down approximately $1000 00 from v 19 76 6 a )4 COUNCIL MEETING APRIL 11th 1977 P 6 Mr Berdahl moved that this letter be accepted and filed as information V'\ Carried SCH DIV The Three Hills Schocl Division have requested approximately MACHINE WORK twolDurs work with our scraper at the time the M D does the work on the Trochu Fair grounds This is to upgrade their school V, race track Mr Poole moved approval of this request, on the sameterms as the work which will be done for -the Trochu Fairgrounds A Carried am _ A letter has been received from Calgary Power in which they state they will require at least 80% prepayment for work involving relocation of power poles This matter had also been discussed at the Spring Convention Mir King stated he had spoken to Calgary Power Ltd , and noted that the M D has always attempted to co-- operate with Power in the past and could see no reason for this rather harsh policy requiring prepayment REQUEST CALGARY POWER COSTS FOR MOVING POLES Calgary �r Ferguson moved that we advise Calgary Power Ltd , that the Municipal District of Kneehill #48 does not see any need for this policy and in any event the M D does not pay in advance for work that is not yet done Carried The proposed closure of road south of the NW of 36- 30 -24 -4 ROAD CLOSURE was then discussed, and it was noted that no objections had NW 36- 30 -24 -4 been received to the intended closure of the road by ad]oi.ning land owners An agreement had been reached with the owner of the quarter section from which the land was taken for purchase of the land if the road is closed Mr Berdahl moved first reading to by -law number 825 this being a by -law to close the unused roadway on the south side of the North West Quarter of Section 36 30 -24 -4 containing 2 acres more or less , and to return the land to the quarter V section from which it came Carried Unanimously BY -LAW Mx Ferguson moved second reading to by -law number 825 8Z5 Carried Unanimously Mr Bauer moved third reading to by law number 825 Carried Unanimously Various Bridge authorizations File 13852 -- ISE 4- 30 -21 -4 Ftle 76483 INW 27-29-21-4 File 70128 - WSW 31- 32 -26 -4 File 8210 - ISW 29- 27- -20 - -4 Mt Litz moved that these be were referred to briefly as follows accepted and filed as information Carried BRIDGE INFORM VN Other information had been obtained from Alberta Bridge Branch 1' Merle Anderson Bridge - Details regarding land required will be sent as soon as possible. 2f. A safe load limit on the bridge south of the Bigelow Dam was requested and this will be sent out as soon as possible 3` Culvert at SSW 1- 31 -24 -4 is not on order and if Council wish to have it ordered the Bridge Branch should be advised soon It was agreed that this matter should be left until the road program is settled 7 �P COUNCIL MEETING APRIL llth, 1977 P 7 After discussion of a date for discussion of the road program DATE FOR and the 1977 budget, Mr Campbell moved that a meeting be held BUDGET on Thursday:. April 14th, 1977 commencing at 9 00 A M , MEETING to -!1-cuss the 1977 road program and the budget Carried Work applications from Alex Johnson, Anthony Greke and WORK Dennis Hazelton were referred to the meeting APPLICATIONS Mr Poole moved that these applications be referred to Mr 0 Paquette Carried RADIATORS Mr King and Mr Jeffery advised the meeting that after telephone GRAVEL discussions with Shaw G M C , and a letter sent to them outlining TRUCKS the problems incurred with the gravel truck radiators, Shaw G M C have agreed to reimburse the M D for a portion of the costs involved in replacing the radiators The rebate in the sum of $884 00 will be sent out shortly Mr Bauer moved that this matter be accepted and filed, with thanks to Shaw G M C for their co operation Carried MR Dobler mentioned that Crown Tire have made certain suggestions regarding the tires on the trucks and this has help eliminate some of the problems as well It appears that the trucks did not have the proper rims and these have been replaced This matter will be discussed with Shaw G M C as to responsib.lity for costs incurred '^ ':,-)lacing these rims A quote has been received from Pounder Emulsion for oil QUOTE The quote is 47 3� a gallon. and will be confirmed by letter V\ POUNDER This is subject to escalation Mr Ferguson moved to accept EMULSION and file this as information ROAD OIL Carried MIS PUBLTr Various matters were discussed with Mr Dobler WORKS and Mr Faquette Thepe was discussion about the John Deere grader It was noted that there is a Join Deere seminar being* held in Calgary Tuesday April 12th commencing at 7 00 P M and it was agreed that Rick Vickery, he grader operator, Mrs Jesske VA John Dorn and Mr Cranston would benefit seminar from attending this Mr Litz moved that the 4 men be authorized to attend this seminar on condition that no orer time be paid, but that they be allowed equivalent time off work ✓� Carried Mr Poole requested Mr Paquette to see Mr Grant Paget about the culvert in the road east of Jack Tutt's farm Mr Paget complained that the culvert is allowing water to drain across his field There was also discussion about the beaver problems and Mr Litz agreed to check with Mr Linderman to see how many beaver he had trapped under the M D permit There was discussion about testing for gravel, and it was noted that there is a possible 80 feet of gravel on the Jake Reimer land -- SW 18- 30 -24 -4 and this is to be checked with Mr Reimer Mr Poole asked if any checking had been done on the Art Becker land at SW 16--29 -24 -4 and Mr Paquette agreed to check this d�^ A c,ie�k is also to be made on Nl2 of 13- 29 -24 - -4 Elliott land and Mr Berdahl requested a follow up on the Jack Lowen gravel lease agreement - E2 16-- 29 -21- 4 It was noted that some patching work needs to be done on all light coat surfaced roads 8 i 14 rA C3 COUNCIL MEETING APRIL 11th, 1977 E.i7 It was agreed that Mr Dorn, Mr Dobler and Mr Paquette should attend the budget and road program meeting set for Thursday `f April 14th., 1977 Mr Dobler left the meeting Mr Paquette su ?gested that the 4 wheel drive now used by John Dorn should` be ,)ut up for sale soon This was tabled for discussion on Thursday Mr Kin, advised that the M Anderson stock piled ravel is d'sa earin_ And $er aps the site should be fenced. Trochu and Elnora Hospital Linden Nursing Home and the Drumheller Auxiliary Nursing Home Carried It w-?s noted that depending on attendance the meeting may have to be held in the Three Hills Community Center. Mr Bauer moved that the meeting be set for May 31st 1977 commencing at 8 00 P M Carried There was brief discussion about the condition of the existing hospital in Three Hills and it was noted that there is ample room at the existing hospital site for any needed expansion Mr Wright and Mr Brown agreed they would prepare an agenda & Mr Wright then left the meeting BIGELOW DAM "r Brown gave a brief report on a meeting he attending regarding MEETING the Bigelow Dam sponsered by the District Agriculturists He noted that the government and Ducks Unlimited have turned the area around the dam into a bird and wildlife sanctuary and the adjoining land owners feel they are suffering crop loss from the birds and also have lost land which they felt they would be able to lease from the government at the time the dam was constructed.
